 <section id="HEA8A3A36E71641ED8B572FADB4FE44CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immigration Advisory Program Authorization Act of 2018</short-title></quote> or the <quote><short-title>IAP Authorization Act of 2018</short-title></quote>.</text> </section><section id="H8C96FE69672A4D8399E1E7C08A4F15EC"><enum>2.</enum><header>Authorization of the immigration advisory program</header> <subsection id="H0CBDBC07D5FC4536992B07580352A788"><enum>(a)</enum><header>In general</header><text>Subtitle B of title IV of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211</external-xref> et seq.) is amended by adding at the end the following new section:</text>

					<section id="H53BF2083647446ACB00BE39E2A368517"><enum>420.</enum><header>Immigration advisory program</header>
 <subsection id="H6EC2E2FA8BE44C3BA3EEA724A45FFE34"><enum>(a)</enum><header>In general</header><text>There is authorized within U.S. Customs and Border Protection an immigration advisory program (in this section referred to as the <quote>program</quote>) for U.S. Customs and Border Protection officers, pursuant to an agreement with a host country, to assist air carriers and security employees at foreign airports with review of traveler information during the processing of flights bound for the United States.</text>
 </subsection><subsection id="HEF406FE852B542D2BE2D97D854225D8B"><enum>(b)</enum><header>Activities</header><text>In carrying out the program, U.S. Customs and Border Protection officers may—</text> <paragraph id="H2BDD024F56D145B0BB23E8DC08143C38"><enum>(1)</enum><text>be present during processing of flights bound for the United States;</text>
 </paragraph><paragraph id="H388734F0B26E47CC9C4ABBEAA20861B6"><enum>(2)</enum><text>assist air carriers and security employees with document examination and traveler security assessments;</text>
 </paragraph><paragraph id="H276AF69785AB4A8FB92F2F1EB508C26B"><enum>(3)</enum><text display-inline="yes-display-inline">provide relevant training to air carriers, security employees, and host-country authorities;</text> </paragraph><paragraph id="H334AF1A9904548CBABC37C1B0AE24658"><enum>(4)</enum><text>analyze electronic passenger information and passenger reservation data to identify potential threats;</text>
 </paragraph><paragraph id="H008DAB57E1854EBCA13E2583DDD32C99"><enum>(5)</enum><text>engage air carriers and travelers to confirm potential terrorist watchlist matches;</text> </paragraph><paragraph id="H6DDCD19DAA7E47F4915742DFCE3B1267"><enum>(6)</enum><text>make recommendations to air carriers to deny potentially inadmissable passengers boarding flights bound for the United States; and</text>
 </paragraph><paragraph id="HF704BE6BD7C04D76808052CAAAE7CF84"><enum>(7)</enum><text>conduct other activities to secure flights bound for the United States, as directed by the Commissioner of U.S. Customs and Border Protection.</text>
 </paragraph></subsection><subsection id="H8E3F91BDFED2497A8E494DFB011F9B9C"><enum>(c)</enum><header>Notification to Congress</header><text>Not later than 60 days before an agreement with the government of a host country pursuant to the program described in this section enters into force, the Commissioner of U.S. Customs and Border Protection shall provide the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate with—</text>
 <paragraph id="HFA375C8C7C7A432F88450F809CA50E26"><enum>(1)</enum><text>a copy of such agreement, which shall include—</text> <subparagraph id="H35AFC6E726864DA6957A17E48ADE88EA"><enum>(A)</enum><text>the identification of the host country with which U.S. Customs and Border Protection intends to enter into such agreement;</text>
 </subparagraph><subparagraph id="H88BEB82D2C0945D18AF8E18356683A17"><enum>(B)</enum><text>the location at which activities described in subsection (b) will be conducted pursuant to such agreement; and</text>
 </subparagraph><subparagraph id="H644BF3A18E4C47E79817E44D7DEB87F4"><enum>(C)</enum><text>the terms and conditions for U.S. Customs and Border Protection personnel operating at such location;</text>
 </subparagraph></paragraph><paragraph id="HA0E3F67C4D8E42E9B0E2F6C4832B1F69"><enum>(2)</enum><text>country-specific information on the anticipated homeland security benefits associated with such agreement;</text>
 </paragraph><paragraph id="HFE638AB54E804E6F8BEE82D5BF2E7DBA"><enum>(3)</enum><text>an assessment of the impacts such agreement will have on U.S. Customs and Border Protection domestic port of entry staffing;</text>
 </paragraph><paragraph id="HAB698CB602D44A808BFCE8034CE65611"><enum>(4)</enum><text>information on the anticipated costs over the five fiscal years after such agreement enters into force associated with carrying out such agreement;</text>
 </paragraph><paragraph id="H396AEC773F714A3283E9510757CEABBC"><enum>(5)</enum><text>details on information sharing mechanisms to ensure that U.S. Customs and Border Protection has current information to prevent terrorist and criminal travel; and</text>
 </paragraph><paragraph id="H994571B117F54EF8A1B5EEC15D8E0078"><enum>(6)</enum><text>other factors that the Commissioner determines necessary for Congress to comprehensively assess the appropriateness of carrying out the program.</text>
 </paragraph></subsection><subsection id="HE04500CEE1804FDF9A39634D836E0212"><enum>(d)</enum><header>Amendment of existing agreements</header><text display-inline="yes-display-inline">Not later than 30 days before a substantially amended program agreement with the government of a host country in effect as of the date of the enactment of this section enters into force, the Commissioner of U.S. Customs and Border Protection shall provide to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate—</text>
 <paragraph id="HF5E9E0FEBE1D49C98DB78A8382B00989"><enum>(1)</enum><text>a copy of such agreement, as amended; and</text> </paragraph><paragraph id="HB333B101BD1243EA8DD474D68B8B5C77"><enum>(2)</enum><text>the justification for such amendment.</text>
 </paragraph></subsection><subsection id="H976256A93F664FEF98D2658A516C3771"><enum>(e)</enum><header>Definitions</header><text>In this section, the terms <quote>air carrier</quote> and <quote>foreign air carrier</quote> have the meanings given such terms in section 40102 of title 49, United States Code.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H49E5DE7935C248F196FE4AACC2C3380A"><enum>(b)</enum><header>Conforming amendment</header><text>Subsection (c) of section 411 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/211">6 U.S.C. 211</external-xref>) is amended—</text>
 <paragraph id="H5684A7A3DE1A4F8983494AFA58ECF565"><enum>(1)</enum><text>in paragraph (18), by striking <quote>and</quote> after the semicolon at the end;</text> </paragraph><paragraph id="H0AEAE63D0E7F4F44AE4C81CA4BB4E922"><enum>(2)</enum><text>by redesignating paragraph (19) as paragraph (20); and</text>
 </paragraph><paragraph id="HE33B3B8FE9644A7B940E1E9257F3A266"><enum>(3)</enum><text>by inserting after paragraph (18) the following new paragraph:</text> <quoted-block changed="added" committee-id="HHM00" display-inline="no-display-inline" id="H0EB6ECF18A65492EA38A763C56D8A88A" reported-display-style="italic" style="OLC"> <paragraph id="H024212A973F54408A9B73B011E27BD36"><enum>(19)</enum><text display-inline="yes-display-inline">carry out section 420, relating to the immigration advisory program; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H44F3265B3FC54CEF9EA1B13460E2BFA1"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 419 the following new item:</text>
