 <section id="HD0EE84779B104E0B9942F0A3BD623C55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Office of Biometric Identity Management Authorization Act of 2018</short-title></quote> or the <quote><short-title>OBIM Authorization Act of 2018</short-title></quote>.</text> </section><section id="HABB1D4E02F084B019F0C8FF32DB2E484"><enum>2.</enum><header>Establishment of the Office of Biometric Identity Management</header> <subsection id="HF27A49D690DA41C69793C32FB0C96A87"><enum>(a)</enum><header>In general</header><text>Title VII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/341">6 U.S.C. 341</external-xref> et seq.) is amended by adding at the end the following new section:</text>

					<section id="H1AACE212DC3B4A0E9CA3EDEF38F4EC5F"><enum>710.</enum><header>Office of Biometric Identity Management</header>
 <subsection id="H627FADF80E71406F9BA110E5397F2355"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Office of Biometric Identity Management is established within the Management Directorate of the Department.</text>
						</subsection><subsection id="H6139C63DE99E47FFB49575234F6D0B2F"><enum>(b)</enum><header>Director</header>
 <paragraph id="HB4FB9ADAC6BB45A2B87C74AF761B6FC3"><enum>(1)</enum><header>In general</header><text>The Office of Biometric Identity Management shall be administered by the Director of the Office of Biometric Identity Management (in this section referred to as the <quote>Director</quote>) who shall report to the Secretary, or to another official of the Department, as the Secretary may direct.</text>
 </paragraph><paragraph id="H0FA404F7E6E240EFA177FB76EF5871A5"><enum>(2)</enum><header>Qualifications and duties</header><text>The Director shall—</text> <subparagraph id="H38C1C161F34449C9BD56F7A1518FD07C"><enum>(A)</enum><text>have significant professional management experience, as well as experience in the field of biometrics and identity management;</text>
 </subparagraph><subparagraph id="HE967B83E3D1541ACA69FC61EDA0E5C8B"><enum>(B)</enum><text>lead the Department’s biometric identity services to support anti-terrorism, counter-terrorism, border security, credentialing, national security, and public safety;</text>
 </subparagraph><subparagraph id="HF3794CE694EF402DA50B18AF7B7B3423"><enum>(C)</enum><text display-inline="yes-display-inline">enable operational missions across the Department by receiving, matching, storing, sharing, and analyzing biometric and associated biographic and encounter data;</text>
 </subparagraph><subparagraph id="H96313B870FDB471CBB20DFF8979E5E07"><enum>(D)</enum><text>deliver biometric identity information and analysis capabilities to—</text> <clause id="HEB377F3AB57B4C6BBBC91E3C35E52F95"><enum>(i)</enum><text>the Department and its components;</text>
 </clause><clause id="H33BF647800A442C5AB676DD3CDE55E73"><enum>(ii)</enum><text>appropriate Federal, State, local, and tribal agencies;</text> </clause><clause id="H470CAE3F3C8340BB8970B10F81780E6C"><enum>(iii)</enum><text>appropriate foreign governments; and</text>
 </clause><clause id="H9882F189B7A64F7D9E4E36734DB9E579"><enum>(iv)</enum><text>appropriate private sector entities;</text> </clause></subparagraph><subparagraph id="H63038E938F8A49FAAF46E2445B62E803"><enum>(E)</enum><text>support the law enforcement, public safety, national security, and homeland security missions of other Federal, State, local, and tribal agencies, as appropriate;</text>
 </subparagraph><subparagraph id="H2F9108AE096245AA8960BB7CD8BDA295"><enum>(F)</enum><text>manage the operation of the Department’s primary biometric repository and identification system;</text> </subparagraph><subparagraph id="HBB3F34FD70C446998CE0A76833E8C40F"><enum>(G)</enum><text>manage Biometric Support Centers to provide biometric identification and verification analysis and services to the Department, appropriate Federal, State, local, and tribal agencies, appropriate foreign governments, and appropriate private sector entities;</text>
 </subparagraph><subparagraph id="H0D492816F3A64E96918C53812EB8BB64"><enum>(H)</enum><text>oversee the implementation of Department-wide standards for biometric conformity, and work to make such standards Government-wide;</text>
 </subparagraph><subparagraph id="H011D77D583FF4C709F56BBABD95F7ACD"><enum>(I)</enum><text>in coordination with the Department’s Office of <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">Policy</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">Strategy, Policy, and Plans</added-phrase>, and in consultation with relevant component offices and headquarters offices, enter into data sharing agreements with appropriate Federal, State, local, and foreign agencies to support immigration, law enforcement, national security, and public safety missions;</text>
 </subparagraph><subparagraph id="H1E1029D630294CDA9C391F2694EF6A4D"><enum>(J)</enum><text>maximize interoperability with other Federal, State, local, and foreign biometric systems, as appropriate;</text>
 </subparagraph><subparagraph id="H020D3D4CCFDF4B3E8272BF3C152E478D"><enum>(K)</enum><text display-inline="yes-display-inline">ensure the activities of the Office of Biometric Identity Management are carried out in compliance with the policies and procedures established by the Privacy Officer appointed under section 222; <deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">and</deleted-phrase></text>
 </subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id6DA36C4134D9447C900A0A7AF0A1429B" reported-display-style="italic"><enum>(L)</enum><text>consult with the Office for Civil Rights and Civil Liberties of the Department about biometric technologies that may result in disparities in the treatment of individuals on the basis of their race or ethnicity; and</text>
 </subparagraph><subparagraph id="HF87BD982E4FC4E48982A3465A53B66F7"><enum><deleted-phrase committee-id="SSGA00" reported-display-style="strikethrough">(L)</deleted-phrase><added-phrase committee-id="SSGA00" reported-display-style="italic">(M)</added-phrase></enum><text>carry out other duties and powers prescribed by law or delegated by the Secretary.</text> </subparagraph></paragraph></subsection><subsection id="H0DA46126D5DD4E9F9C714A6B1165CCB5"><enum>(c)</enum><header>Deputy Director</header><text>There shall be in the Office of Biometric Identity Management a Deputy Director, who shall assist the Director in the management of the Office.</text>
						</subsection><subsection id="HB040B1EA3E0D484686A3CAE8C71BD523"><enum>(d)</enum><header>Other authorities</header>
 <paragraph id="HA8A0957967F94C82936904ED0CF4D140"><enum>(1)</enum><header>In general</header><text>The Director may establish such other offices within the Office of Biometric Identity Management as the Director determines necessary to carry out the missions, duties, functions, and authorities of the Office.</text>
 </paragraph><paragraph id="H3297EEFCE0D54690AEE5725EBFC43BD6"><enum>(2)</enum><header>Notification</header><text>If the Director exercises the authority provided by paragraph (1), the Director shall notify the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate not later than 30 days before exercising such authority.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HBFBDEA777A7C45EEB1DE31D8C86BA90A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by adding after the item relating to section 709 the following new item:</text>
