			 which a licensed hydropower facility is located, and for other purposes.</official-title></form>

 <section id="H1708A34022C74F90A0D8BFC5E344D6AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Taxpayer Protection Act of 2018</short-title></quote>.</text> </section><section id="H0B8FB3E60B1740E0A56E28B0A2151034"><enum>2.</enum><header>Payment of fees by certain hydropower facility license holders</header> <subsection display-inline="no-display-inline" id="HFC850EE431EF4E2E8C4676FAEBE56906"><enum>(a)</enum><header>Initial payment</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter for the duration of the applicable license and any subsequent license received for the same facility and related operations, a covered licensee shall make an annual payment to the county in which the applicable licensed project is located beginning in the amount of $1,800,000.</text>
 </subsection><subsection id="H2472465464184FA28DDC8381DDAB1C90"><enum>(b)</enum><header>Increase in subsequent payments</header><text>The amount of each annual payment occurring after the first annual payment shall increase by 2 percent of the preceding annual payment.</text>
 </subsection><subsection id="H417524AF131E47148846D7B2377102D8"><enum>(c)</enum><header>Remaining obligations</header><text>The payment of funds under this section shall not affect the obligation of the covered licensee to pay any other funds required to be paid to a county under the terms of a judicial decree or settlement of an action brought by one or more counties against the covered licensee.</text>
 </subsection><subsection id="H7B7E7FCBA9AC40BCBBB73A224745AF00"><enum>(d)</enum><header>Statutory construction</header><text>Nothing in this section shall be construed to authorize an increase in the rates and charges for electric energy of a covered licensee.</text>
 </subsection><subsection id="H3761DF9065F9496ABEE0E63F553A83D1"><enum>(e)</enum><header>Covered licensee defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered licensee</quote> means a State, or any subdivision thereof, that—</text> <paragraph id="H0D38CA66A5544E7C91CF29E2BB9EEA10"><enum>(1)</enum><text>received a license under section 10 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/803">16 U.S.C. 803</external-xref>) for a pumped-storage facility; and</text>
 </paragraph><paragraph id="HF114730182164350AFFF7A34EDABDD7E"><enum>(2)</enum><text>filed for such license in April of 2017.</text> </paragraph></subsection></section></legis-body></bill>
