			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To standardize and extend certain Buy America provisions.</official-title></form>
	<legis-body id="HEE24DD14349547338E878A410B690F30" style="OLC">
 <section id="HF3564E030E344FF2B2CC0AA8E10493FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buy America 2.0 Act</short-title></quote>.</text> </section><section id="H899119059B10461FA542FFEA3433E12E"><enum>2.</enum><header>Use of American iron, steel, and manufactured goods</header> <subsection id="H7F8AF8FCAE3346F5949C7AE8B7A9FD3E"><enum>(a)</enum><header>In general</header><text>Funds made available to carry out a transportation or infrastructure project using Federal funds may not be obligated for a project unless the steel, iron, and manufactured goods used for the project are produced in the United States.</text>
 </subsection><subsection id="HBBB96F38C98345DAA642DCE0C5B8E7E3"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) shall not apply in any case or category of cases in which the head of the Federal department or agency overseeing a project finds that—</text>
 <paragraph id="H150A3827B33940CA91C3722C6C9BA806"><enum>(1)</enum><text>applying subsection (a) would be inconsistent with the public interest;</text> </paragraph><paragraph id="H480DD62505A547B385CF84AF454B30BF"><enum>(2)</enum><text>iron, steel, and the relevant manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or</text>
 </paragraph><paragraph id="H8F53B690138D4FAF8ECFDA33DDD12551"><enum>(3)</enum><text>inclusion of iron, steel, and manufactured goods produced in the United States will increase the cost of the overall project by more than 25 percent.</text>
 </paragraph></subsection><subsection id="H5DDDDE2AC0CB493B978B8EA4DF0797DD"><enum>(c)</enum><header>Waiver</header><text>If the head of a Federal department or agency receives a request for a waiver under this section, the head of such department or agency shall make available to the public a copy of the request and information available to the head of such department or agency concerning the request, and shall allow for public input on the request for at least 15 days prior to making a finding based on the request. The head of such department or agency shall make the request and accompanying information available by electronic means, including on the official public Internet site of such department or agency.</text>
 </subsection><subsection id="H8B2C3916102E4D3286E1B545A37B4459"><enum>(d)</enum><header>Application</header><text>This section shall be applied in a manner consistent with United States obligations under international agreements.</text>
 </subsection><subsection id="H0263343707D24539B07EEFB10F34607B"><enum>(e)</enum><header>Applicability</header><text>Nothing in this section shall supercede or preempt any existing Buy America provision to the extent such provision conflicts with this section.</text>
 </subsection></section><section id="HC343E92777CC49B9ABC4AE4BE7186214"><enum>3.</enum><header>Public transportation Buy America provisions</header><text display-inline="no-display-inline">Section 5323(j)(2)(C)(i) of title 49, United States Code, is amended—</text> <paragraph id="H76CA6FEEA6054B1E9B57DCC621F0C489"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subclause II;</text>
 </paragraph><paragraph id="H598D762BEAF544EFA84CE987178EE0C9"><enum>(2)</enum><text>in subclause (III)—</text> <subparagraph id="H39B872C438164AB780DE618AD1D8194D"><enum>(A)</enum><text>by striking <quote>and each fiscal year thereafter</quote>; and</text>
 </subparagraph><subparagraph id="H56993BBC0FDA4675B52B03350F2C5B01"><enum>(B)</enum><text>by striking <quote>and</quote> at the end of the subclause; and</text> </subparagraph></paragraph><paragraph id="H05C4A6F843A747E4AEE652F0E4772545"><enum>(3)</enum><text>inserting after subclause (III) the following:</text>
				<quoted-block id="H6D4F28CC1DF74241B06374E1F309FF88" style="OLC">
 <subclause id="H543DC77F68A744F08779612725389A83"><enum>(IV)</enum><text>for fiscal year 2021 is more than 75 percent of the cost of all components of the rolling stock;</text> </subclause><subclause id="HFB4DE29070354C40B17D4CD718F3C463"><enum>(V)</enum><text>for fiscal year 2022 is more than 80 percent of the cost of all components of the rolling stock;</text>
 </subclause><subclause id="H15C6B7FB2A1646EE910DF6C141DF212B"><enum>(VI)</enum><text>for fiscal year 2023 is more than 85 percent of the cost of all components of the rolling stock;</text> </subclause><subclause id="H0039610402964D839EC8741B1ED42A3B"><enum>(VII)</enum><text>for fiscal year 2024 is more than 90 percent of the cost of all components of the rolling stock;</text>
 </subclause><subclause id="H06A456750E1F479E809D48DF7A3EAE00"><enum>(VIII)</enum><text>for fiscal year 2025 is more than 95 percent of the cost of all components of the rolling stock; and</text>
 </subclause><subclause id="H0E0C383AD5594E1F816D10F73FDF00CF"><enum>(IX)</enum><text>for fiscal year 2026 and each fiscal year thereafter is 100 percent of the cost of all components of the rolling stock; and</text></subclause><after-quoted-block>. </after-quoted-block></quoted-block>
 </paragraph></section><section id="H99CAEDD5C80D4569A35839C7A64EB422"><enum>4.</enum><header>Rail loan and loan guarantee Buy America provisions</header><text display-inline="no-display-inline">Section 502(h)(3) of the Railroad Revitalization and Regulatory Reform Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/45/822">45 U.S.C. 822(h)(3)</external-xref>) is amended—</text>
 <paragraph id="H5EF3FCB25E314B79800DFFF625C4182D"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of subparagraph (A);</text> </paragraph><paragraph id="HF73A0CB6F6F44043B64B9B95846416C5"><enum>(2)</enum><text>by striking the period at the end of subparagraph (B) and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H15EEF811500A4CC88A7A0A0DD8941EF1"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HDECC61C008694B5FB3225FEC6137F400" style="OLC"> <subparagraph id="H0C5D10B18E30401F974BF0CBD19EB1EA" indent="up1"><enum>(C)</enum><text>the requirements of section 24405(a) of title 49, United States Code.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H1D5E0B5B2BCE4FA4B0957FB6B09F7F62"><enum>5.</enum><header>Aviation Buy America provisions</header><text display-inline="no-display-inline">Section 50101 of title 49, United States Code, is amended—</text> <paragraph id="HC00088BE2A0A4E7F928081A5C1485D62"><enum>(1)</enum><text>in subsection (a) by inserting <quote>, iron,</quote> after <quote>steel</quote>; and</text>
 </paragraph><paragraph id="HACFEFFD9981A4A6A8BF371B41185105D"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H87E8132C4CD84254B90C22C00C880E73"><enum>(A)</enum><text>in paragraph (2), by inserting <quote>, iron,</quote> after <quote>steel</quote>; and</text>
 </subparagraph><subparagraph id="H74E7B5A812A44102B61B240608FE7881"><enum>(B)</enum><text>in paragraph (3), by striking subparagraph (A) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="HC3E75F5E3C4D40A186EAD3EA23039E4D" style="OLC"> <subparagraph id="HC8CDEC102A0B4940B34979C7367FCB5B"><enum>(A)</enum><text>the cost of components and subcomponents produced in the United States—</text>
 <clause id="HEC1B4956CCC646D5A21C9181F217D300"><enum>(i)</enum><text>for fiscal year 2018 is more than 60 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H85BC6C2064834951A87F4FCC0FD3E715"><enum>(ii)</enum><text>for fiscal year 2019 is more than 65 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H9124F0711D0849AEA6FE5C869D4B34A7"><enum>(iii)</enum><text>for fiscal year 2020 is more than 70 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H2868EDD416794739A5B75E5A402C9986"><enum>(iv)</enum><text>for fiscal year 2021 is more than 75 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="HD5FE2D085C144214B078E566A3A42A00"><enum>(v)</enum><text>for fiscal year 2022 is more than 80 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H904EE2F777894DC59813FF5CE8BE2048"><enum>(vi)</enum><text>for fiscal year 2023 is more than 85 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H7BBB2AB43B014E3294A7F0900B21E1BB"><enum>(vii)</enum><text>for fiscal year 2024 is more than 90 percent of the cost of all components of the facility or equipment;</text>
 </clause><clause id="H053FFC0CCCBD4941B7A5381F5B2442B7"><enum>(viii)</enum><text>for fiscal year 2025 is more than 95 percent of the cost of all components of the facility or equipment; and</text>
 </clause><clause id="H2430901F35E74BBF83AF7607E75A0910"><enum>(ix)</enum><text>for fiscal year 2026, and each fiscal year thereafter, is 100 percent of the cost of all components of the facility or equipment; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></section><section id="HEEA38AA71C8F4172B8D430E26FE2B2A3"><enum>6.</enum><header>Safe drinking water buy America provision</header><text display-inline="no-display-inline">Section 1452(a)(4)(A) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(a)</external-xref>) is amended by striking <quote>During fiscal year 2017, funds</quote> and inserting <quote>Funds</quote>.</text> </section></legis-body></bill>
