			 to a person under 21 years of age, and to prohibit the possession or
			 ownership of a semiautomatic assault weapon by such a person, with
			 exceptions for active duty military personnel and full-time law
			 enforcement employees.</official-title></form>
	<legis-body id="H90F5F74EFF6B49F4949C4A6B340E16D0" style="OLC">
 <section id="H38BA890A1F9847F499EF12ABD07FCB42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No More Atrocities with Guns Act</short-title></quote> or the <quote><short-title>No MAGA Act</short-title></quote>.</text> </section><section id="H196E47C43B764E1FBA08218E90E12ADA"><enum>2.</enum><header>Increase in minimum age at which a person may be transferred, or possess or own, a semiautomatic assault weapon, with exceptions</header> <subsection id="H48C8DA120DFE4393BF55060869B00B3E"><enum>(a)</enum><header>Prohibition on transfer by Federal firearms licensee</header> <paragraph id="H1C63628A75A2483D830A4205E1411E39"><enum>(1)</enum><header>In general</header><text>Section 922(b)(1) of title 18, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H40A55C98087D4C58B35AC8105BF17EE0" style="OLC">
						<paragraph id="H5DC3D7573D5C470CB45C83620A65CDCD"><enum>(1)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H33BDC7DF7F144C2E88F0D96359A13B56"><enum>(A)</enum><text display-inline="yes-display-inline">any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe has not attained 18 years of age;</text>
 </subparagraph><subparagraph id="H3A368494DAEE4CA195CED5BEBE7E7715" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">any semiautomatic assault weapon to any individual who the licensee knows or has reasonable cause to believe has not attained 21 years of age and is not a qualified individual; or</text>
 </subparagraph><subparagraph id="HF0B04B435C5C4DD1880F8BB5578D02DD" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">if the firearm or ammunition is not a semiautomatic assault weapon and is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe has not attained 21 years of age;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H7F561E9765EB47F1892B7D9FA6B7254C"><enum>(2)</enum><header>Sworn statement</header><text>Section 922(c)(1) of such title is amended by striking <quote>in the case of any firearm</quote> and all that follows through <quote>eighteen years or more of age</quote> and inserting <quote>in the case of a semiautomatic assault weapon, I am at least 21 years of age or a qualified individual (as defined in section 921(a)(31) of title 18, United States Code), in the case of a firearm other than a semiautomatic assault weapon, a shotgun or a rifle, I am at least 21 years of age, or that, in the case of a shotgun or a rifle, I am at least 18 years of age</quote>.</text>
				</paragraph></subsection><subsection id="HCF569A41928E4B4ABBA9CA9A894BD6E5"><enum>(b)</enum><header>Prohibition on transfer by others; prohibition on possession or ownership</header>
 <paragraph id="H179A23573BD946A8958811617791845E"><enum>(1)</enum><header>In general</header><text>Section 922 of such title is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HC45F11331A29459CBDA77CEFCF3E547E" style="OLC"> <subsection display-inline="no-display-inline" id="HFE676E0C8CA84348937CE1F011BCA156"><enum>(aa)</enum><text display-inline="yes-display-inline">It shall be unlawful—</text>
 <paragraph id="H02C1ECBDEA244757846D32A3FE0E026D"><enum>(1)</enum><text>for any person not licensed under section 923, in or affecting interstate or foreign commerce, to transfer a semiautomatic assault weapon to an individual who has not attained 21 years of age and is not a qualified individual; or</text>
 </paragraph><paragraph id="H26140A50C2BB4297964D99D377F6FD0B"><enum>(2)</enum><text display-inline="yes-display-inline">for an individual who has not attained 21 years of age and is not a qualified individual to possess or own a semiautomatic assault weapon in or affecting interstate or foreign commerce.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HBAC83864A68F42C291A5146A7963AD41"><enum>(2)</enum><header>Penalties</header><text>Section 924 of such title is amended—</text> <subparagraph id="H2AFBD270FAD947D298CE0BC000FD2E22"><enum>(A)</enum><text>in subsection (a), by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF2157F7702ED4EC78B7B5221C5FF4685" style="OLC">
							<paragraph id="H8085813CE14C4773BEEA96C4AD13A31D" indent="up1"><enum>(8)</enum>
 <subparagraph commented="no" display-inline="yes-display-inline" id="H61CC1F6877464505A0B4C643DFA2C26A"><enum>(A)</enum><text>Whoever knowingly violates section 922(aa)(1) shall be fined not more than $50,000 (or, in the case of the second or a subsequent such offense, not more than $250,000), imprisoned not more than 5 years, or both.</text>
 </subparagraph><subparagraph id="H7B743B41B531414D8B6E9F577FB09436" indent="up1"><enum>(B)</enum><text>Whoever knowingly violates section 922(aa)(2) shall be fined not more than $5,000, imprisoned not more than 5 years, or both.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="H5CA314DD6284457394125D38B3949BB9"><enum>(B)</enum><text>in subsection (d)(1), by striking <quote>or (k)</quote> and inserting <quote>(k), or (aa)</quote>.</text> </subparagraph></paragraph></subsection><subsection id="H038E2AA5CD5542CC83DA49D08E502B85"><enum>(c)</enum><header>Definitions</header> <paragraph id="HFEEC7BFBEF7549E9870098EA6834314D"><enum>(1)</enum><header>Semiautomatic assault weapon</header><text display-inline="yes-display-inline">Section 921(a) of such title is amended by inserting after paragraph (29) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H9EE837B93EEB42B88F0E5839BE59CF16" style="OLC">
 <paragraph id="H5D239E2E41F84BDC9D83DE14A2C821FD" indent="up1"><enum>(30)</enum><text display-inline="yes-display-inline">The term ‘semiautomatic assault weapon’ means any semiautomatic assault weapon, as defined in section 921(a)(30) of this title, as included in the enactment of the Public Safety and Recreational Firearms Use Protection Act without regard to the repeal of such Act.</text>
 </paragraph><paragraph id="HB7FE5A51519340258D6204DF7CAE5451" indent="up1"><enum>(31)</enum><text display-inline="yes-display-inline">The term <quote>qualified individual</quote> means—</text> <subparagraph id="HB159D4FCFD114078B6F7971812CC49F7"><enum>(A)</enum><text>a member of the Armed Forces on active duty; and</text>
 </subparagraph><subparagraph id="H7699D4C4E43A449C8392487ABCE55552"><enum>(B)</enum><text>a qualified law enforcement officer (as defined in section 926B(c)(1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="HC049A04E546B433AA2086DA0B71BE8F6"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to conduct engaged in after the 90-day period that begins with the date of the enactment of this Act.</text>
