<section id="H5288F744F5EA462BA9AE75964603173A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surface Transportation Security and Technology Accountability Act of 2018</short-title></quote>.</text> </section> <section id="H7A32C9ADF3894FC2964C3F213088C0B3"><enum>2.</enum><header>Surface Transportation Security Advisory Committee</header> <subsection id="H9E66C241CF8D43F788406733D9232D9D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title XVI of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/561">6 U.S.C. 561</external-xref> et seq.) is amended by adding at the end the following new subtitle:</text>

<subtitle id="HEA61CDCB004B4E0D89012537AE160496"><enum>C</enum><header>Surface Transportation Security</header> 
<section id="HD65D433C5128442FA8B527EE4FC68247"><enum>1621.</enum><header>Surface Transportation Security Advisory Committee</header> 
<subsection id="HFFE2772C9CFD4C1FA26FB565DFD4A85D"><enum>(a)</enum><header>Establishment</header><text>The Administrator of the Transportation Security Administration (referred to in this section as the <quote>Administrator</quote>) shall establish within the Transportation Security Administration the Surface Transportation Security Advisory Committee (referred to in this section as the <quote>Advisory Committee</quote>).</text> </subsection> <subsection id="HF98A4DBD8908472FB39264D799012D7D"><enum>(b)</enum><header>Duties</header> <paragraph id="H0A6996116375423B9FBC89E9221549D1"><enum>(1)</enum><header>In general</header><text>The Advisory Committee may advise, consult with, report to, and make recommendations to the Administrator on surface transportation security matters, including the development, refinement, and implementation of policies, programs, initiatives, rulemakings, and security directives pertaining to surface transportation security.</text> </paragraph>
<paragraph id="H9DA5E297790F40E1ACCE78E6FD89AD13"><enum>(2)</enum><header>Risk-based security</header><text>The Advisory Committee shall consider risk-based security approaches in the performance of its duties.</text> </paragraph></subsection> <subsection id="H6048449E03E64E909548BC2A6B4471F9"><enum>(c)</enum><header>Membership</header> <paragraph id="H815C3F8D40244B098C21B5B6E20D0E61"><enum>(1)</enum><header>Composition</header><text>The Advisory Committee shall be composed of—</text> 
<subparagraph id="HE2A4A5575E3643B09EE25179F0E60C44"><enum>(A)</enum><text>voting members appointed by the Administrator under paragraph (2); and</text> </subparagraph> <subparagraph id="HC563FDC298D047A991FFE915D4DC0386"><enum>(B)</enum><text>nonvoting members, serving in an advisory capacity, who shall be designated by—</text> 
<clause id="H8959957B87B14E22B108A9F742C1FDDF"><enum>(i)</enum><text>the Transportation Security Administration;</text> </clause> <clause id="HF86A28105A0A47B08F28739793472499"><enum>(ii)</enum><text>the Department of Transportation; and</text> </clause>
<clause id="H0624F8D5E3994ED89B2EDA97D475CF1F"><enum>(iii)</enum><text>such other Federal department or agency as the Administrator considers appropriate.</text> </clause></subparagraph></paragraph> <paragraph id="HA04C7DE5B0774B8F9621246F586831E8"><enum>(2)</enum><header>Appointment</header><text>The Administrator shall appoint voting members from among stakeholders representing each mode of surface transportation, such as passenger rail, freight rail, mass transit, pipelines, highways, over-the-road bus, and trucking, including representatives from—</text> 
<subparagraph id="H900CE786F8DE467B905E8C39FBE65DE4"><enum>(A)</enum><text>associations representing such modes of surface transportation;</text> </subparagraph> <subparagraph id="H7F17E30B26124A0C88ABA6A8C831EDAA"><enum>(B)</enum><text>labor organizations representing such modes of surface transportation;</text> </subparagraph>
<subparagraph id="H24D8A391EAEF4ED7A3587D3E1BC06BB6"><enum>(C)</enum><text>groups representing the users of such modes of surface transportation, including asset manufacturers, as appropriate;</text> </subparagraph> <subparagraph id="HAADB108847E645B3B3FF57870719367B"><enum>(D)</enum><text>relevant law enforcement, first responders, and security experts; and</text> </subparagraph>
<subparagraph id="H18C0AC41DE544DFD8FB0F3B66AEB4B89"><enum>(E)</enum><text>such other groups as the Administrator considers appropriate.</text> </subparagraph></paragraph> <paragraph id="HF68FECA7293F40A59B3163B9F16578B5"><enum>(3)</enum><header>Chairperson</header><text>The Advisory Committee shall select a chairperson from among its voting members.</text> </paragraph>
<paragraph id="H4AA0F74E75874D2A80BE7813A2141708"><enum>(4)</enum><header>Term of office</header> 
<subparagraph id="H38E2C413B710439FB773B4AF5E4D198A"><enum>(A)</enum><header>Terms</header> 
<clause id="H4486F1A38F3B4CE9B68FAD0EB0935592"><enum>(i)</enum><header>In general</header><text>The term of each voting member of the Advisory Committee shall be 2 years, but a voting member may continue to serve until the Administrator appoints a successor.</text> </clause> <clause id="HBF565D8367894E2ABCFD40C712C8F2AE"><enum>(ii)</enum><header>Reappointment</header><text>A voting member of the Advisory Committee may be reappointed.</text> </clause></subparagraph>
<subparagraph id="H78126C473D0C402493CFF2F2FE2E438B"><enum>(B)</enum><header>Removal</header> 
<clause id="HED73436EAA9B4E4DBAB5998090D5F2B5"><enum>(i)</enum><header>In general</header><text>The Administrator may review the participation of a member of the Advisory Committee and remove such member for cause at any time.</text> </clause> <clause id="HDA878C05627C44A995C940C66C2EC002"><enum>(ii)</enum><header>Access to certain information</header><text>The Administrator may remove any member of the Advisory Committee who the Administrator determines should be restricted from reviewing, discussing, or possessing classified information or sensitive security information.</text> </clause></subparagraph></paragraph>
<paragraph id="H6831C0B4CC294E4493BFAD574B25A33A"><enum>(5)</enum><header>Prohibition on compensation</header><text>The members of the Advisory Committee may not receive any compensation from the Government by reason of their service on the Advisory Committee.</text> </paragraph> <paragraph id="H043A513C2FF04833B0423E2B2A1D79EE"><enum>(6)</enum><header>Meetings</header> <subparagraph id="H56EBEB68D0BC46998CEEAF3F0341816A"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall meet at least semiannually in person or through web conferencing, and may convene additional meetings as necessary.</text> </subparagraph>
<subparagraph id="H7AB22BC64DDC4C1C91B1FC1344A5DD48"><enum>(B)</enum><header>Public meetings</header><text>At least one of the meetings of the Advisory Committee each year shall be—</text> <clause id="HE27769DFE524406BAD1E13056FD7BEB2"><enum>(i)</enum><text>announced in the Federal Register;</text> </clause>
<clause id="HF191BAECD0BB42358FB7530E7A027411"><enum>(ii)</enum><text>announced on a public website; and</text> </clause> <clause id="H40EA1DC2988D4AF4A4B551A6A356AFE1"><enum>(iii)</enum><text>open to the public.</text> </clause></subparagraph>
<subparagraph id="HC400925724B141148E248B7F6E5AAD30"><enum>(C)</enum><header>Attendance</header><text>The Advisory Committee shall maintain a record of the persons present at each meeting.</text> </subparagraph> <subparagraph id="H07C7D55614E34B79A9E61670EE9903FB"><enum>(D)</enum><header>Minutes</header> <clause id="HB0C707B348444896BABF62D6F77947A7"><enum>(i)</enum><header>In general</header><text>Unless otherwise prohibited by Federal law, minutes of the meetings of the Advisory Committee shall be published on the public website under subsection (e)(5).</text> </clause>
<clause id="HD3BE91F8C79845A5A999C949FDEFF116"><enum>(ii)</enum><header>Protection of classified and sensitive information</header><text>The Advisory Committee may redact or summarize, as necessary, minutes of the meetings to protect classified information or sensitive security information in accordance with law.</text> </clause></subparagraph></paragraph> <paragraph id="H5E898BA55719493EB4D3DF4BC25647AD"><enum>(7)</enum><header>Voting member access to classified information and sensitive security information</header> <subparagraph id="H8A49004AE28B4E15AF4BE6870334218F"><enum>(A)</enum><header>Determinations</header><text>Not later than 60 days after the date on which a voting member is appointed to the Advisory Committee but before such voting member may be granted any access to classified information or sensitive security information, the Administrator shall determine if such voting member should be restricted from reviewing, discussing, or possessing classified information or sensitive security information.</text> </subparagraph>
<subparagraph id="H364D5B3590E540B6A9CF41A098BD4101"><enum>(B)</enum><header>Access</header> 
<clause id="H638AB34C4C8E4D2FAFCBC7F08AD62AF2"><enum>(i)</enum><header>Sensitive security information</header><text>If a voting member is not restricted from reviewing, discussing, or possessing sensitive security information under subparagraph (A) and voluntarily signs a nondisclosure agreement, such voting member may be granted access to sensitive security information that is relevant to such voting member’s service on the Advisory Committee.</text> </clause> <clause id="H3F6F30C352DD4F89B74956C5F73F05C5"><enum>(ii)</enum><header>Classified information</header><text>Access to classified materials shall be managed in accordance with Executive Order No. 13526 of December 29, 2009 (75 Fed. Reg. 707), or any subsequent corresponding Executive order.</text> </clause></subparagraph>
<subparagraph id="H3B45DB38B1A34C14B9AD14571C772129"><enum>(C)</enum><header>Protections</header> 
<clause id="HC28A07CAB3EC4311820BD6952A305449"><enum>(i)</enum><header>Sensitive security information</header><text>Voting members shall protect sensitive security information in accordance with part 1520 of title 49, Code of Federal Regulations.</text> </clause> <clause id="H9ED353307F524978A644D41DB4EDF2AC"><enum>(ii)</enum><header>Classified information</header><text>Voting members shall protect classified information in accordance with the applicable requirements for the particular level of classification of such information.</text> </clause></subparagraph></paragraph>
<paragraph id="H4DCAA36B64494059AD2BEAA2E0C88BF0"><enum>(8)</enum><header>Joint committee meetings</header><text>The Advisory Committee may meet with one or more of the following advisory committees to discuss multimodal security issues and other security-related issues of common concern:</text> <subparagraph id="H7F77C97EA86B4BD3B469281E1FB77C17"><enum>(A)</enum><text>Aviation Security Advisory Committee, established under section 44946 of title 49, United States Code.</text> </subparagraph>
<subparagraph id="H413004B2E557435590B37B480FAA41FA"><enum>(B)</enum><text>Maritime Security Advisory Committee, established under section 70112 of title 46, United States Code.</text> </subparagraph> <subparagraph id="H9707D6C8E8B241FC9405003598202610"><enum>(C)</enum><text>Railroad Safety Advisory Committee, established by the Federal Railroad Administration.</text> </subparagraph></paragraph>
<paragraph id="H7A8D0E7044BF402BB4E3C5115C6A4AEE"><enum>(9)</enum><header>Subject matter experts</header><text>The Advisory Committee may request the assistance of subject matter experts with expertise related to the jurisdiction of the Advisory Committee.</text> </paragraph></subsection> <subsection id="HDFCA8655F8834992BE7DC26280AC4283"><enum>(d)</enum><header>Reports</header> <paragraph id="H94D7A928AF0D46CD839310DFF78ED4E0"><enum>(1)</enum><header>Periodic reports</header><text>The Advisory Committee shall periodically submit to the Administrator reports on matters requested by the Administrator or by a majority of the members of the Advisory Committee.</text> </paragraph>
<paragraph id="HBE35D9B4601C4F648FE34D27A82188A2"><enum>(2)</enum><header>Annual report</header> 
<subparagraph id="H8106856326F743888AA99620407449E2"><enum>(A)</enum><header>Submission</header><text>The Advisory Committee shall submit to the Administrator and the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate an annual report that provides information on the activities, findings, and recommendations of the Advisory Committee during the preceding year.</text> </subparagraph> <subparagraph id="HFF0B996CC0114AB1B56F55EBBD7BA157"><enum>(B)</enum><header>Publication</header><text>Not later than 6 months after the date that the Administrator receives an annual report under subparagraph (A), the Administrator shall publish a public version of such report, in accordance with section 552a(b) of title 5, United States Code.</text> </subparagraph></paragraph></subsection>
<subsection id="HF00516FDF8554732BB06669626D36B12"><enum>(e)</enum><header>Administration response</header> 
<paragraph id="H964144F4945D494AB35FD225A79AF570"><enum>(1)</enum><header>Consideration</header><text>The Administrator shall consider the information, advice, and recommendations of the Advisory Committee in formulating policies, programs, initiatives, rulemakings, and security directives pertaining to surface transportation security efforts.</text> </paragraph> <paragraph id="HD0A27ED6CAF848F4ABA738E686D25EB5"><enum>(2)</enum><header>Feedback</header><text>Not later than 90 days after the date that the Administrator receives a recommendation from the Advisory Committee under subsection (d)(2), the Administrator shall submit to the Advisory Committee written feedback on such recommendation, including—</text> 
<subparagraph id="H40AC9DDA292043EFAA9B5C9732EFA9EA"><enum>(A)</enum><text>if the Administrator agrees with such recommendation, a plan describing the actions that the Administrator has taken, will take, or recommends that the head of another Federal department or agency take to implement such recommendation; or</text> </subparagraph> <subparagraph id="HFF31C275268347EDB85530A23CE024FC"><enum>(B)</enum><text>if the Administrator disagrees with such recommendation, a justification for such disagreement.</text> </subparagraph></paragraph>
<paragraph id="H44B6223EB6FF48A4B628B5902BC29FD2"><enum>(3)</enum><header>Notices</header><text>Not later than 30 days after the date the Administrator submits feedback under paragraph (2), the Administrator shall—</text> <subparagraph id="H0C5DFDDBAF104029AFDD5E4BD8CA6062"><enum>(A)</enum><text>notify the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate of such feedback, including the agreement or disagreement under subparagraph (A) or (B) of such paragraph, as applicable; and</text> </subparagraph>
<subparagraph id="H9573AAA46AB54C65B4F64D26509E247C"><enum>(B)</enum><text>provide the committees specified in subparagraph (A) with a briefing upon request.</text> </subparagraph></paragraph> <paragraph id="HE693D1F9E19D4B2C9E1810197CDC74E8"><enum>(4)</enum><header>Updates</header><text>Not later than 90 days after the date the Administrator receives a recommendation from the Advisory Committee under subsection (d)(2) that the Administrator agrees with, and quarterly thereafter until such recommendation is fully implemented, the Administrator shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report or post on the public website under paragraph (5) an update on the status of such recommendation.</text> </paragraph>
<paragraph id="H850AB35BF7554882814E7287567F24BF"><enum>(5)</enum><header>Website</header><text>The Administrator shall maintain a public website that—</text> <subparagraph id="HD3805EE19ECB4F71A01A9E3708E244A1"><enum>(A)</enum><text>lists the members of the Advisory Committee;</text> </subparagraph>
<subparagraph id="H5CA3F1F27A5E45A2B900EE265785CDFE"><enum>(B)</enum><text>provides the contact information for the Advisory Committee; and</text> </subparagraph> <subparagraph id="H03C8DF9C8E6A4D8584B3283B8A2970C2"><enum>(C)</enum><text>information relating to meetings, minutes, annual reports, and the implementation of recommendations under this section.</text> </subparagraph></paragraph></subsection>
<subsection id="HD5090227E8474AFC9C946EC5C499FC72"><enum>(f)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee or any subcommittee established under this section.</text> </subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H7425C7665BA24DB992505216A332ABB4"><enum>(b)</enum><header>Advisory committee members</header> <paragraph id="H7F844E2684F04B39BF781E2C5F8C23C6"><enum>(1)</enum><header>Voting members</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of the Transportation Security Administration shall appoint the voting members of the Surface Transportation Security Advisory Committee established under section 1621 of the Homeland Security Act of 2002, as added by subsection (a) of this section.</text> </paragraph>
<paragraph id="HEAA61C21974C43B4A2A8ABA1F5C3C8BB"><enum>(2)</enum><header>Nonvoting members</header><text>Not later than 90 days after the date of the enactment of this Act, each Federal department and agency with regulatory authority over a mode of surface transportation, as the Administrator of the Transportation Security Administration considers appropriate, shall designate an appropriate representative to serve as a nonvoting member of the Surface Transportation Security Advisory Committee.</text> </paragraph></subsection> <subsection id="H8AA5C198CB434AA1A58D25A180CE4687"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 1616 the following new items:</text>

<toc-entry level="subtitle">Subtitle C—Surface Transportation Security</toc-entry> 
<toc-entry level="section">Sec. 1621. Surface Transportation Security Advisory Committee.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="H1215258364064EE59825845CAAD111A3"><enum>3.</enum><header>Technology investment plan</header> 
<subsection id="H60FDB848066440419709E91019FC9FC8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1611 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/563">6 U.S.C. 563</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HCD1B6D647D774AA99AB2E347BA0569F7" style="OLC"> <subsection id="H6978489A7B1B4C588E652B220ECFDE52"><enum>(h)</enum><header>Additional update requirements</header><text display-inline="yes-display-inline">Updates and reports required pursuant to subsection (g) shall—</text> 
<paragraph id="H3B3EA4EDC1224A92A5B1B03A329EF87C"><enum>(1)</enum><text>be prepared in consultation with individuals and entity specified in subsection (b), as well as the Surface Transportation Security Advisory Committee established by the Administrator pursuant to section 1621;</text> </paragraph> <paragraph id="H463EAB4CC56148C6AD8D20514A1CA377"><enum>(2)</enum><text>include information relating to technology investments by the Transportation Security Administration and the private sector that the Department supports with research, development, testing, and evaluation for aviation, air cargo, and surface transportation security; and</text> </paragraph>
<paragraph id="H4D719CAF61654B08AC38DDFDCAECE4A5"><enum>(3)</enum><text>to the extent practicable, include a classified addendum to report sensitive transportation security risks and associated capability gaps that would be best addressed by security-related technology described in paragraph (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="H0AFE773BD4C34AB7BC9FF36C86DBA1F5"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act and apply beginning with the first update and report required under subsection (g) of section 1611 of the Homeland Security Act of 2002 that is required after such date.</text> </subsection></section>
