			 visas, to require the Secretary of Homeland Security to grant work
			 authorization to aliens with a pending application for nonimmigrant status
			 under subparagraph (U) or (T) of section 101(a)(15) of such Act, and for
			 other purposes.</official-title></form>
	<legis-body id="HBD8DAF8490C746EF8BF90212272E0248" style="OLC">
 <section id="H63045455423546B7AA6CEE3AD25B20EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immigrant Witness and Victim Protection Act of 2018</short-title></quote>.</text> </section><section id="H589E533F698F433BAF0EC432D90921F6"><enum>2.</enum><header>Elimination of annual numerical limitation on U visas</header><text display-inline="no-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended by striking paragraph (2).</text>
		</section><section commented="no" display-inline="no-display-inline" id="H5B6A88B6995947A4B6D9C4254002E2F0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Work authorization while applications for U and T visas are pending</header>
 <subsection commented="no" display-inline="no-display-inline" id="HC2F5D6B3CDDF4B02A0D686671571A1B9"><enum>(a)</enum><header display-inline="yes-display-inline">U visas</header><text display-inline="yes-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H8DBD3E2576F14A21A2507032030109BA"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking the last sentence; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAF0F6E7BFBA46128D001BCAC6A3CD8B"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H9F208BF7C5EC4360B7EFA9B4E5B7D753" style="OLC"> <paragraph commented="no" display-inline="no-display-inline" id="HEE43C1C931A34DE6871B1658C76F9FA1"><enum>(8)</enum><header display-inline="yes-display-inline">Work authorization</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for nonimmigrant status under section 101(a)(15)(U) on the date that is the earlier of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="H12FC69BF05FA400A80573AAFA2EA0C76"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the alien’s application for such status is approved; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE88D3AE42DDC4B2DB30EC3EE5CD21097"><enum>(B)</enum><text display-inline="yes-display-inline">a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the application.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1438884C39E545DABD53FF09665E9E52"><enum>(b)</enum><header display-inline="yes-display-inline">T visas</header><text display-inline="yes-display-inline">Section 214(o) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(o)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H28EFF49BB1B7438EB4DB2B5E953EE857" style="traditional">
 <paragraph commented="no" display-inline="no-display-inline" id="HB25ACD44928C43CA861CC9A26E744428" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for nonimmigrant status under section 101(a)(15)(T) on the date that is the earlier of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HC31EA323C15D43FA851F8D7FA750BF0B"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the alien’s application for such status is approved; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71CFA368045D460F832B026B419311AE"><enum>(B)</enum><text display-inline="yes-display-inline">a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the application.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H383931E0243E4CE19DF3B439DC858590"><enum>4.</enum><header>Prohibition on removal of certain victims with pending petitions and applications</header>
 <subsection id="H2E6C9ED312BC4852947626895F45A7F5"><enum>(a)</enum><header>Expedited removal of inadmissible arriving aliens</header><text>Section 235 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="H92FC7AFAE094460298147A3CF1D89919" style="OLC">
					<subsection id="H51FE1669FD6A4852BC3B0D1C9DDBB278"><enum>(e)</enum><header>Prohibition on removal of certain victims with pending petitions and applications</header>
 <paragraph id="H2C1B9951F25F421A91B28896CB646B7D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An alien described in paragraph (2) shall not be ordered removed under this section until there is a final administrative denial of the application for such status after the exhaustion of administrative appeals.</text>
 </paragraph><paragraph id="H592BF7D80A0C48BAB9C534846A87F9BA"><enum>(2)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien—</text> <subparagraph id="HA501E9CF2F14464BA89FFBD014A9FF2D"><enum>(A)</enum><text>has a pending application under section 101(a)(15)(T), 101(a)(15)(U), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997); or</text>
 </subparagraph><subparagraph id="HC3F05DD9FFE94E76ADDE7183B8366FB3"><enum>(B)</enum><text>is a VAWA self-petitioner, as defined in section 101(a)(51), with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of such section.</text>
 </subparagraph></paragraph><paragraph id="H94857202AAAC4900AD8507DAC5183CC6"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply in a case in which the Director of U.S. Citizenship and Immigration Services determines that the alien is prima facie ineligible for admission due to any of the circumstances described in section 241(b)(3)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection commented="no" id="H4429338E0B5B42A5BE9AD89B95305D61"><enum>(b)</enum><header>General classes of deportable aliens</header><text>Section 237(d)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(d)(1)</external-xref>) is amended to read as follows:</text>

					<subsection commented="no" id="HCC5A5DB81F7045B4B7148CD8A756096F"><enum>(d)</enum>
 <paragraph commented="no" display-inline="yes-display-inline" id="H83308383CD5E48C8BE75F4BA5AB7F17D"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of U.S. Citizenship and Immigration Services shall make a determination whether an application for nonimmigrant status under subparagraph (T) or (U) of section 101(a)(15) filed for an alien in the United States sets forth a prima facie case for approval, and, if so, the Secretary shall grant the alien an administrative stay of a final order of removal under section 241(c)(2) until—</text>
 <subparagraph commented="no" id="H685AC115EC3841388C2A5EFB42F6FDA8" indent="up1"><enum>(A)</enum><text>the application for nonimmigrant status under such subparagraph (T) or (U) is approved; or</text> </subparagraph><subparagraph commented="no" id="H412F5EB99FE2492B9057442B2CCCB803" indent="up1"><enum>(B)</enum><text>there is a final administrative denial of the application for such nonimmigrant status after the exhaustion of administrative appeals.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HEAD2003830AB44DD853AB89300A6EE0B"><enum>(c)</enum><header>Expedited removal of aliens convicted of committing aggravated felonies</header><text>Section 238 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1228">8 U.S.C. 1228</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block id="HE97B9D8D86B14D32B20F73C48DEADD2E" style="OLC">
					<subsection id="HBA47EFCC1BF642958C99F64B079CE49D"><enum>(d)</enum><header>Prohibition on removal of certain victims with pending petitions and applications</header>
 <paragraph id="HA734AEC784A349A5BDD44F0EA47F3212"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An alien described in paragraph (2) shall not be ordered removed under this section until there is a final administrative denial of the application for such status after the exhaustion of administrative appeals.</text>
 </paragraph><paragraph id="H5676107FE46546628DD90B2A42BFFDAB"><enum>(2)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien—</text> <subparagraph id="H0878B8A12C534DC69C0C788C061A4BE1"><enum>(A)</enum><text display-inline="yes-display-inline">has a pending application under section 101(a)(15)(T), 101(a)(15)(U), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997); or</text>
 </subparagraph><subparagraph id="H5D76DFFE3EF54844AA6DF1A65FFE1784"><enum>(B)</enum><text>is a VAWA self-petitioner, as defined in section 101(a)(51), with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of such section.</text>
 </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H283E415E8E774E33925E226784B99FA4"><enum>(3)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply in a case in which the Director of U.S. Citizenship and Immigration Services determines that any of the circumstances described in section 241(b)(3)(B) apply.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE1211475A15E4D85A2BEA1AB43A0CAEB"><enum>(d)</enum><header>Detention and removal of aliens ordered removed</header><text>Section 241(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(a)</external-xref>) is amended by adding at the end the following:</text>

					<paragraph id="HD535DE87F391451C91B1BA712E394DC2"><enum>(8)</enum><header>Prohibition on removal of certain victims with pending petitions and applications</header>
 <subparagraph id="H69D457A1C2434FA7A1B9FC2E54637BA8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An alien described in subparagraph (B) shall not be removed under this section until there is a final administrative denial of the application for such status after the exhaustion of administrative appeals.</text>
 </subparagraph><subparagraph id="H0638A06AEC0644B8A1B96FDE87A7BE5F"><enum>(B)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien—</text> <clause id="H43E9D14FA2094DF3BA0CBE7B5E20FAB3"><enum>(i)</enum><text display-inline="yes-display-inline">has a pending application under section 101(a)(15)(T), 101(a)(15)(U), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997); or</text>
 </clause><clause id="HA07520B7FE074DE7907B601233653FEF"><enum>(ii)</enum><text>is a VAWA self-petitioner, as defined in section 101(a)(51), with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of such section.</text>
 </clause></subparagraph><subparagraph display-inline="no-display-inline" id="HDECA82FB710B44F19E1916484F72D74A"><enum>(C)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply in a case in which the Director of U.S. Citizenship and Immigration Services determines that any of the circumstances described in section 241(b)(3)(B) apply.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
