			 established for canned tuna, and for other purposes.</official-title></form>

		<section id="H83E7EF51431444AEB6C0A4C00CA4F4C9" section-type="section-one"><enum>1.</enum><header>Short title and findings</header>
 <subsection id="H81D2BA66D78D4FEC8FA42709F8A584DA"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Re-Establishing Accuracy in Labeling of Tuna Act of 2018</short-title></quote> or the <quote><short-title>REAL Tuna Act of 2018</short-title></quote>.</text> </subsection><subsection id="HDA36D5A4DC4C4EA698AFC3084054A678"><enum>(b)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
 <paragraph id="HC8BCF6D97A614FE583350A9414409F88"><enum>(1)</enum><text display-inline="yes-display-inline">There are no fishery management plans in place for the commercial harvest of the bonito fish known as Auxis thazard and Auxis rochei.</text>
 </paragraph><paragraph id="HD2973DBEC9924C229539CB43FB891A38"><enum>(2)</enum><text display-inline="yes-display-inline">In 2013, Customs and Border Protection ruled that bonito fish of the Auxis species in airtight containers not in oil are dutiable at 4 percent ad valorem which created a dramatic advantage in comparison to tunas which under the Harmonized Tariff Code are dutiable to 35 percent for tuna preserved in oil and 12.5 percent for tuna preserved in water.</text>
 </paragraph><paragraph id="H1BE911FDB18C447B999E467A4DC0B471"><enum>(3)</enum><text display-inline="yes-display-inline">Since 2013 there has been a dramatic increase in the unregulated harvest of these species by foreign fishing fleets for sale into the United States market.</text>
 </paragraph><paragraph id="HAD601501AD94485CA9B50759BEF710AB"><enum>(4)</enum><text display-inline="yes-display-inline">The Food and Drug Administration allows Auxis thazard and Auxis rochei to be labeled and sold as <quote>light tuna</quote> so long as the fish is not darker in coloration than Munsell value 5.3.</text> </paragraph><paragraph id="H22D04AC038FE4D5E9320789D4E5D7240"><enum>(5)</enum><text display-inline="yes-display-inline">The combination of the duty differential and the ability to label Auxis thazard and Auxis rochei as light tuna has caused a flooding of the United States food service and canned tuna markets.</text>
 </paragraph><paragraph id="H84863287FBD44EDB99C628EDC5BF2B13"><enum>(6)</enum><text display-inline="yes-display-inline">Consumers are purchasing Auxis thazard and Auxis rochei under the mistaken belief they are purchasing tuna such as albacore, skipjack, or yel­low­tail.</text>
				</paragraph></subsection></section><section id="HD76705BB0FEC47B9B3229201DB419591"><enum>2.</enum><header>Standard of identity for canned tuna</header>
 <subsection id="HD71287FBCEEB4664B6D047AE14885D54"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The standard of identity for canned tuna, as issued by the Secretary of Health and Human Services pursuant to section 401 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/341">21 U.S.C. 341</external-xref>), is deemed not to include the following species:</text>
 <paragraph id="H34FDBCB0B8A846188D456EF411884D8C"><enum>(1)</enum><text display-inline="yes-display-inline">Auxis rochei (Risso, 1810)—Bullet tuna.</text> </paragraph><paragraph id="H24B401C158B84B0B90FBF92A3D15ECC8"><enum>(2)</enum><text>Auxis thazard (Lacepede, 1800)—Frigate tuna.</text>
 </paragraph></subsection><subsection id="H72A9324C6E9D45D592EAACA4F23917E7"><enum>(b)</enum><header>Regulations</header><text>The Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall amend such regulations as may be necessary to implement subsection (a).</text>
 </subsection><subsection id="HC9D980C53D564E3EAED54F22BA57E7BC"><enum>(c)</enum><header>Effective date</header><text>Subsection (a) takes effect on the date that is 6 months after the date of enactment of this Act.</text> </subsection></section></legis-body></bill>
