 <section id="H27A4AA30A33C43AF8240591E4BEB56B4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title></quote>.</text> </section><section id="HE01379767BBC4D6784DB49D284839122"><enum>2.</enum><header>Reauthorization of Healthy Food Financing Initiative</header><text display-inline="no-display-inline">Section 243 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6953">7 U.S.C. 6953</external-xref>) is amended to read as follows:</text>

				<section id="H611331BE8A754B118139DC790ABBA243"><enum>243.</enum><header>Healthy Food Financing Initiative</header>
 <subsection id="HC77C40746C4E41F3888F579B2665B9BC"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to establish an initiative to provide financial and technical assistance to healthy food producers and retailers, food hubs, and mid-tier value chains that serve healthy food retailers and other healthy food business enterprises—</text>
 <paragraph id="H4B6B772E558A4E60892FA6600560E5CB"><enum>(1)</enum><text>to improve access to, and expand the supply of, healthy food in low-income, underserved communities;</text>
 </paragraph><paragraph id="HE6443B6718BB471B8646036ACFD2279F"><enum>(2)</enum><text>to create and preserve quality jobs and businesses;</text> </paragraph><paragraph id="HB43B306C01204292B8D4CB862567BEE2"><enum>(3)</enum><text>to revitalize distressed rural, urban, and small town economies;</text>
 </paragraph><paragraph id="HC6C2ED45047940FCA3DB6851394C9F90"><enum>(4)</enum><text>to support the development of local and regional food systems;</text> </paragraph><paragraph id="H85B44C05CD074D3D8ED2878600169C45"><enum>(5)</enum><text>to increase the distribution of locally produced agricultural products; and</text>
 </paragraph><paragraph id="HF2C022087BA44C36AD335895942710CB"><enum>(6)</enum><text>to strengthen farm-to-consumer relationships.</text> </paragraph></subsection><subsection id="HC230630EBAF749DDAAB4F5A2A930B910"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="H749036BCFAFD4BE7A0EB68B3D6A27501"><enum>(1)</enum><header>Community development financial institution</header><text>The term <term>community development financial institution</term> has the meaning given the term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text>
 </paragraph><paragraph id="H7893BDE17F4046E78835559FDA9C5BD2"><enum>(2)</enum><header>Disadvantaged business enterprise</header><text>The term <term>disadvantaged business enterprise</term> has the meaning given the term in section 26.5 of title 49, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title>).</text>
 </paragraph><paragraph id="HC74E5F56833345E5AA944A54712C5F37"><enum>(3)</enum><header>Farmers market</header><text>The term <term>farmers market</term> means a common facility or area where several agricultural producers gather on a regular, recurring basis to sell a variety of fresh fruits and vegetables and other locally grown farm products directly to consumers.</text>
 </paragraph><paragraph id="HA71FAC9E6A3B4FE2A7DF761B5E45EFE7"><enum>(4)</enum><header>Food access organization</header><text>The term <term>food access organization</term> means a nonprofit organization with expertise in improving access to healthy food in underserved communities.</text>
 </paragraph><paragraph id="H47AA2607CF7E4C51961E610FEADAC397"><enum>(5)</enum><header>Food hub</header><text>The term <term>food hub</term> means a commercial, cooperatively owned, or nonprofit enterprise that actively manages the aggregation, distribution, and marketing of source-identified food products primarily from local and regional producers to strengthen the ability of the producers to satisfy wholesale, retail, and institutional demand.</text>
 </paragraph><paragraph id="H43C58C2892A74BB08B90872DACC2F808"><enum>(6)</enum><header>Healthy food</header><text>The term <term>healthy food</term> means a food or beverage that improves and maintains overall human health and reduces the risk of chronic disease, as described in the 2015–2020 Dietary Guidelines for Americans of the Secretary of Health and Human Services and the Secretary.</text>
 </paragraph><paragraph id="H2C446F76F0F54FA989C7AEDDA30FCFA2"><enum>(7)</enum><header>Healthy food business enterprise</header><text>The term <term>healthy food business enterprise</term> means an entrepreneurial activity that improves access to healthy food in low-income and underserved communities, such as a commercial kitchen or food business incubator.</text>
 </paragraph><paragraph id="HDD89DE62FFBE44DCBBBCB6D58EF6191C"><enum>(8)</enum><header>Healthy food producer</header><text>The term <term>healthy food producer</term> means a commercial, cooperatively owned, or nonprofit enterprise that produces agricultural commodities or adds value to agricultural commodity products to create healthy food products.</text>
						</paragraph><paragraph id="H3D97AFA4D6AC45D7B1C6721A9CA63610"><enum>(9)</enum><header>Healthy food retailer</header>
 <subparagraph id="HEF2A79DA66F64B65AACED0C60EEE00E0"><enum>(A)</enum><header>In general</header><text>The term <term>healthy food retailer</term> means a commercial, cooperatively owned, or nonprofit seller of a healthy food, including—</text> <clause id="H4C67DC1D4AB54F9CA966E60049BD9B0E"><enum>(i)</enum><text>a grocery store;</text>
 </clause><clause id="H3A0EE7AA765B4287987F19143A0050FC"><enum>(ii)</enum><text>a mobile food retailer;</text> </clause><clause id="HA5E7418D2CC043D99E95EFD97DE30772"><enum>(iii)</enum><text>a farmers market;</text>
 </clause><clause id="H2778360D78BA459E8EEC0A207EC2CDD2"><enum>(iv)</enum><text>a cooperative;</text> </clause><clause id="H935F9B543A3346A58CA70733546E00C8"><enum>(v)</enum><text>a corner store;</text>
 </clause><clause id="HE7EF09A3BFC342F083096160A34CF6A8"><enum>(vi)</enum><text>a bodega; and</text> </clause><clause id="H6334168B4A1D4F078A2BF6CDBF4F81CC"><enum>(vii)</enum><text>any other store that sells a full range of fresh and healthy foods, including any such store that sells nonhealthy foods.</text>
 </clause></subparagraph><subparagraph id="HA3FD57D8AFE84C72A2EFA33DCF95AA86"><enum>(B)</enum><header>Inclusion</header><text>The term <term>healthy food retailer</term> includes a retail store in existence on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title> that upgrades to sell a full range of healthy foods after that date of enactment.</text> </subparagraph></paragraph><paragraph id="HAA75FF10F5574233BD89086CC1F1B3D4"><enum>(10)</enum><header>Historically underserved producer</header><text>The term <term>historically underserved producer</term> means a beginning, limited resource, urban, or socially disadvantaged farmer or rancher, as determined by the Secretary.</text>
 </paragraph><paragraph id="H683AB5D60F0242F5A8ADD211B527F4EA"><enum>(11)</enum><header>Incubator</header><text>The term <term>incubator</term> means a commercial, cooperatively owned, or nonprofit enterprise that assists start-up businesses by providing support, resources, and business services and advice, normally in 1 physical location.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA43D23A986CE41778430B5E0B31A6BDC"><enum>(12)</enum><header display-inline="yes-display-inline">Initiative</header><text display-inline="yes-display-inline">The term <term>Initiative</term> means the Healthy Food Financing Initiative established under subsection (c).</text> </paragraph><paragraph id="H1C5647A5C1E541149ECA11E95DE4A2C6"><enum>(13)</enum><header>Initiative funds</header><text>The term <term>Initiative funds</term> means—</text>
 <subparagraph id="HA37C5D5CC6EE437486B963AF50DF1A6F"><enum>(A)</enum><text>any Federal amounts that are made available to carry out this section; and</text> </subparagraph><subparagraph id="HF13B149765D14161AE7160D5A121D317"><enum>(B)</enum><text>any other forms of financial assistance (including grants, loans, and equity investments) that are raised by the National Fund Manager under this section.</text>
 </subparagraph></paragraph><paragraph id="H2DC5CAE83B344D3D927F83316985BB89"><enum>(14)</enum><header>Low-income</header><text>The term <term>low-income</term> has the meaning given the term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text>
						</paragraph><paragraph id="H64DEDAC49180424EB0155D5B5ADF71A1"><enum>(15)</enum><header>Mid-tier value chain</header>
 <subparagraph id="H9DFEBB85A5424A3C92EA263A920D5F7D"><enum>(A)</enum><header>In general</header><text>The term <term>mid-tier value chain</term> has the meaning given the term in section 231(a) of the Agricultural Risk Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/7/1632a">7 U.S.C. 1632a(a)</external-xref>).</text>
 </subparagraph><subparagraph id="HEDFC011538AE4B8591009E62D3572DFD"><enum>(B)</enum><header>Inclusions</header><text>The term <term>mid-tier value chain</term> includes strategic business relationships with respect to production, aggregation, processing, storage, distribution, or marketing.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H2CE74649157B434691EFCF3AB49458C4"><enum>(16)</enum><header>Moderate-income</header><text>The term <term>moderate-income</term> has the meaning given the term by the Bureau of the Census.</text> </paragraph><paragraph id="HA598115518B447F6A8D7E789510BBB8D"><enum>(17)</enum><header>National Fund Manager</header><text>The term <term>National Fund Manager</term> means a community development financial institution that is—</text>
 <subparagraph id="H6C337A1B7499481FB3247FBEE09EEC1A"><enum>(A)</enum><text>in existence on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title>;</text> </subparagraph><subparagraph id="HAA1BFA99E5C14415A3AEB1DA59D36EE5"><enum>(B)</enum><text>certified by the Community Development Financial Institutions Fund of the Department of the Treasury to manage the Initiative; and</text>
 </subparagraph><subparagraph id="HCB0B0772C6A24DBCAD8D9FC983D70D1E"><enum>(C)</enum><text>designated by the Secretary under subsection (d)(1) to manage the Initiative.</text> </subparagraph></paragraph><paragraph id="H695219EB3ABE49A7ABCB8DED3AE760AE"><enum>(18)</enum><header>Partnership</header><text>The term <term>partnership</term> means a regional, State, or local collaborative entity that is organized to improve access to healthy foods by providing financial and technical assistance to projects.</text>
 </paragraph><paragraph id="H2CECB93013F14157AD36627C20B99D4D"><enum>(19)</enum><header>Project</header><text>The term <term>project</term> means a healthy food retailer, a food hub, a healthy food producer, or a healthy food business enterprise under a commercial, cooperatively owned, or nonprofit enterprise that satisfies eligibility criteria for assistance under the Initiative established by the National Fund Manager in accordance with subsection (g)(1).</text>
 </paragraph><paragraph id="H26D3607DAA8E4C50B34AD1F06EB302E7"><enum>(20)</enum><header>Quality job</header><text>The term <term>quality job</term> means a job that includes three or more of the following characteristics:</text> <subparagraph id="H232AEB9BF42C40DE8A200DFA646DFEE5"><enum>(A)</enum><text>A living wage that—</text>
 <clause id="H29339B9ECC3949748C33DE48D64BD00B"><enum>(i)</enum><text>is sufficient to support a decent standard of living; or</text> </clause><clause id="H8200FE4CE2864C0292E69FC7C431B229"><enum>(ii)</enum><text>exceeds the median wage offered within the applicable industry.</text>
 </clause></subparagraph><subparagraph id="H712A3E97626E40459C0E2DE3A031B199"><enum>(B)</enum><text>Basic benefits that increase economic security, improve health, and promote work-life balance for employees, including—</text>
 <clause id="H0B241BCBD7AB43D4BEB590FCD9BB44B4"><enum>(i)</enum><text>paid leave;</text> </clause><clause id="HE9AEA900D29A4023B49BCAAD8EC67872"><enum>(ii)</enum><text>health insurance; and</text>
 </clause><clause id="H6E63E2D09BEE4BD38DAAE9B327930491"><enum>(iii)</enum><text>a retirement savings plan, including the use of an employee stock ownership plan.</text> </clause></subparagraph><subparagraph id="H41A3AC0CF4AC4E9FAF0104EB789926A2"><enum>(C)</enum><text>Career-building opportunities that help employees develop the skills, networks, and experiences necessary to launch a career or advance along a career path, including—</text>
 <clause id="H2F541EEC71874728BF62D253648F27AE"><enum>(i)</enum><text>formal and informal training and mentorship; and</text> </clause><clause id="H5F0CBDB99AEF4DDC94B1F2C4304BE8EB"><enum>(ii)</enum><text>avenues for advancement within the company.</text>
 </clause></subparagraph><subparagraph id="HF63E58D83A394298BFBE3391AAB8FEC7"><enum>(D)</enum><text>Wealth-building opportunities that enable and provide incentives for an employee to build the assets that the employee needs to manage financial emergencies and achieve long-term financial security for the employee and the family of the employee, including through employee ownership, such as an employee stock ownership plan or a cooperative.</text>
 </subparagraph><subparagraph id="HF83FC483D4EC495991A7A7F38A48431E"><enum>(E)</enum><text>A fair and engaging workplace that balances the priorities and well-being of employees with the needs of the business, including—</text>
 <clause id="H7F3B41194CB6451896EB5354BD33C49C"><enum>(i)</enum><text>flexible and predictable schedules;</text> </clause><clause id="H4AACB70CA9544527B05BBBF4CA16191D"><enum>(ii)</enum><text>treating employees with respect and dignity;</text>
 </clause><clause id="HB9F82386CF5043CDA5A2974B99546882"><enum>(iii)</enum><text>actively soliciting ideas from employees to improve the business; and</text> </clause><clause id="H0D20D628131D48E2B5307754414C3C05"><enum>(iv)</enum><text>helping employees understand how their work contributes to the success of the business.</text>
 </clause></subparagraph></paragraph><paragraph id="H244CFDCC88E34792972EA82081EB633B"><enum>(21)</enum><header>Rural; rural area</header><text>The terms <term>rural</term> and <term>rural area</term> have the meanings given those terms in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>).</text>
						</paragraph><paragraph id="H4D36CB24E20A4714A6E6800C2EAE49ED"><enum>(22)</enum><header>Staple Food</header>
 <subparagraph id="H89DD0B4986C84064A3FD1AE4BAC7A17F"><enum>(A)</enum><header>In general</header><text>The term <term>staple food</term> means food that is a basic dietary item.</text> </subparagraph><subparagraph id="H2A072C05D1A745E6B9B7F5A5D15CE892"><enum>(B)</enum><header>Inclusions</header><text>The term <term>staple food</term> includes—</text>
 <clause id="H71D3901544AF4D27A2975D670B525B10"><enum>(i)</enum><text>bread;</text> </clause><clause id="H2259C88551BB4A50AFA8D1282EB1FACC"><enum>(ii)</enum><text>cereal;</text>
 </clause><clause id="H1F9C0F84196348239F201E08105DCD2A"><enum>(iii)</enum><text>flour;</text> </clause><clause id="HA8ECA5A769A341FF91124D5B1DFCBB3A"><enum>(iv)</enum><text>fruit;</text>
 </clause><clause id="H2D527C1188E54891AE30A200A128CBA2"><enum>(v)</enum><text>vegetables;</text> </clause><clause id="HD78FE1B5AC0644859FF3F449432FB917"><enum>(vi)</enum><text>meat; and</text>
 </clause><clause id="H77E5B85F374545C8A66921580B25983C"><enum>(vii)</enum><text>dairy products.</text> </clause></subparagraph></paragraph><paragraph id="H6DCD585254B34B69A056DDA86ADB9DD9"><enum>(23)</enum><header>Underserved community</header> <subparagraph id="HE29A509BC9634433A19DA08BFA735A3F"><enum>(A)</enum><header>In general</header><text>The term <term>underserved community</term> means a food desert, as defined by the Community Development Financial Institutions Fund of the Department of the Treasury, including a distressed geographical area described in subparagraph (B), that is—</text>
 <clause id="HF737129F267E4BBDBFC9AA82F29A6AAC"><enum>(i)</enum><text>within a census tract that is described as a food desert on the food access research atlas of the Secretary;</text>
 </clause><clause id="H28FDD1BBE1C94E8EB8F6846CDFF812DE"><enum>(ii)</enum><text>within a census tract that—</text> <subclause id="H565B0108931F47CF86D47D537D31C532"><enum>(I)</enum><text>is adjacent to a census tract described in clause (i); and</text>
 </subclause><subclause id="H97FB9F984DB64110A6BBF4BBCCABA5EA"><enum>(II)</enum><text>has a median family income that is less than or equal to 120 percent of the applicable area median family income; or</text>
 </subclause></clause><clause id="H5F4083CE26694F24B10FF2292A27BD52"><enum>(iii)</enum><text>a geographic unit (as described in section 1805.201(b)(3)(ii)(B) of title 12, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title>)) that—</text>
 <subclause id="H377409DC724E407EB538198BF13C12F9"><enum>(I)</enum><text>individually meets at least one of the criteria described in section 1805.201(b)(3)(ii)(D) of title 12, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title>); and</text>
 </subclause><subclause id="H1C0F7070EE604B6BA472E40F20FBA10F"><enum>(II)</enum><text>meets the criteria for having low access to a supermarket or grocery store through a methodology that has been adopted for use by a State or unit of local government or philanthropic healthy food initiative.</text>
 </subclause></clause></subparagraph><subparagraph id="H657F9C7D958D48109EFCB596210CB121"><enum>(B)</enum><header>Distressed geographical area described</header><text>A distressed geographical area referred to in subparagraph (A) is a geographical area where a substantial number or share of residents has low access to a supermarket or large grocery store.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAD02348B665B45A0B4C4B5E50F420295"><enum>(c)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish within the Department an initiative, to be known as the <quote>Healthy Food Financing Initiative</quote>, to achieve the purpose described in subsection (a) in accordance with this section.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="HF69313C9F3AB4C96A21C5C8E91DAA7DC"><enum>(d)</enum><header>Duties of the Secretary</header><text>The Secretary shall—</text>
 <paragraph id="H95F5DB2A3F4240DABEC8DC32311E70AA"><enum>(1)</enum><text>once every 5 years, designate a National Fund Manager through a competitive process from among community development financial institutions that have qualifications and a demonstrated record of success and effectiveness in—</text>
 <subparagraph id="HCB84E03DB8DC4351955016EACA13C59B"><enum>(A)</enum><text>raising significant amounts of private funds and managing healthy food financing programs that provide grants, loans, and tax credits to improve access to, and the supply of, healthy foods in low-income, underserved communities;</text>
 </subparagraph><subparagraph id="HFF13081279EC4FB78F3A2F3C4FCE6F14"><enum>(B)</enum><text>developing and managing programs that provide financial and technical assistance to healthy food retailers, healthy food producers, food hubs, farmers markets, and other healthy food business enterprises that serve low-income, underserved communities;</text>
 </subparagraph><subparagraph id="HFFE187CF9DA14A708BF36F318EC6DA10"><enum>(C)</enum><text>partnering with food access organizations or other nonprofit organizations with expertise in improving food access in low-income, underserved communities in the implementation of healthy food financing programs;</text>
 </subparagraph><subparagraph id="HDD00324721FF463AAD3027EE1257F3C6"><enum>(D)</enum><text>investing in rural communities directly or in partnership with other rural economic development organizations;</text>
 </subparagraph><subparagraph id="H2B58F2AF02F54956947E39BD72E38BE0"><enum>(E)</enum><text>building the capacities of other community development financial institutions and building a network of collaboration across food access programs and food systems programs;</text>
 </subparagraph><subparagraph id="HA5F1D0C4E3E144D299FCD81507296340"><enum>(F)</enum><text>engaging—</text> <clause id="HFDE00AE2DF2C49C8BBC55A75F2AFE9A9"><enum>(i)</enum><text>rural, Tribal, and disadvantaged business enterprises; and</text>
 </clause><clause id="HF2DD751457294AEEA21B60C9CC1ED66F"><enum>(ii)</enum><text>businesses that serve low-income populations and support local or regional food systems and supply chains;</text>
 </clause></subparagraph><subparagraph id="H5DCAB745C74C40F18C63E7029E646122"><enum>(G)</enum><text>developing performance goals and metrics to track and report the impact of healthy food financing programs;</text>
 </subparagraph><subparagraph id="H4003014C772B4D398F9A45383D7BFFFF"><enum>(H)</enum><text>making and servicing grants, loans, loan loss reserves, tax credits, and other financing tools that are needed to effectively implement the Initiative;</text>
 </subparagraph><subparagraph id="HEEF24C588F7C46A9869CEB81F0F296E6"><enum>(I)</enum><text>financing and investing public and private funds in projects to improve access in low-income urban and rural communities;</text>
 </subparagraph><subparagraph id="HEED992B4DA29451D8470DE6CF1349CBB"><enum>(J)</enum><text>administering multiple contracts and subcontractors;</text> </subparagraph><subparagraph id="HB7D0667CE1604AEDB05234688D7B29FE"><enum>(K)</enum><text>providing or contracting for the provision of technical assistance; and</text>
 </subparagraph><subparagraph id="HDE30758C2A414D54B47CE8004ABC8437"><enum>(L)</enum><text>managing large capital pools;</text> </subparagraph></paragraph><paragraph id="H33E3E69390FD4872925819A41EDFB9D0"><enum>(2)</enum><text>determine whether to approve—</text>
 <subparagraph id="H4143C48317914062A0F186ACCA881452"><enum>(A)</enum><text>the eligibility criteria developed by the National Fund Manager under subsection (e)(2)(A);</text> </subparagraph><subparagraph id="H0185E002214549A4A56BEF267EF51632"><enum>(B)</enum><text>the program strategy and budget for the Initiative submitted by the National Fund Manager under subsection (e)(1)(E); and</text>
 </subparagraph><subparagraph id="HE940678A56804DD2A83539E086BD1043"><enum>(C)</enum><text>the outcome metrics developed by the National Fund Manager under subsection (e)(3)(A);</text> </subparagraph></paragraph><paragraph id="H4124F2DF38AA41E78E6049EC90BB35A6"><enum>(3)</enum><text>develop and make publically available annual progress reports and financial audits of the Initiative to determine the effectiveness and impact of the Initiative; and</text>
 </paragraph><paragraph id="H00D4461715254141AC095438E86A8D43"><enum>(4)</enum><text>ensure that Initiative funds are used appropriately and efficiently.</text> </paragraph></subsection><subsection id="H96D8D83CE36B426FA23244F0CFDD9BD6"><enum>(e)</enum><header>Duties of the National Fund Manager</header><text>The National Fund Manager shall carry out the following duties under the Initiative:</text>
 <paragraph id="H0C92618530B44C3E970678D56BBCC53E"><enum>(1)</enum><header>Assistance</header><text>The National Fund Manager shall—</text> <subparagraph id="HBA28F28236324797B60BE4194C497DBE"><enum>(A)</enum><text>raise private funds to be used under the Initiative;</text>
 </subparagraph><subparagraph id="HA949086366CC432B882E4EB3C0C05293"><enum>(B)</enum><text>leverage and encourage the use of other Federal funds from the Department and other Federal agencies;</text>
 </subparagraph><subparagraph id="H19D1A79A4A994AA9ABC1EEFABEE5131E"><enum>(C)</enum><text>provide loan and grant awards to partnerships and projects in accordance with paragraph (2);</text> </subparagraph><subparagraph commented="no" id="HF9E2B5513EA241708D0AF5B3A04DB0C6"><enum>(D)</enum><text>consider providing to partnerships and projects financial assistance other than awards described in subparagraph (C), subject to the conditions that the financial assistance shall—</text>
 <clause commented="no" id="HD543EC0391AC4325AED0E9DEFD9CC8F5"><enum>(i)</enum><text>conform to all applicable laws (including regulations) and best industry practices; and</text> </clause><clause commented="no" id="H9E4CDC8BB329419089725A0DBB1CE13B"><enum>(ii)</enum><text>be approved by the Secretary before the financial assistance is provided;</text>
 </clause></subparagraph><subparagraph commented="no" id="H94C6186131F3450AA509B174A7E8AD89"><enum>(E)</enum><text>submit to the Secretary a program strategy and budget for the Initiative for approval under subsection (d)(2)(B); and</text>
 </subparagraph><subparagraph id="HABBBEBDC6C04472D90F87C7360DB8A3A"><enum>(F)</enum><text>provide appropriate technical assistance to partnerships and projects that are seeking or have received funding under the Initiative, such as—</text>
 <clause id="H7A603059C6AA4E068C98CA6181F84AA9"><enum>(i)</enum><text>business planning;</text> </clause><clause id="H21C595052E8E41EB934D59B5966F1F04"><enum>(ii)</enum><text>project feasibility analysis;</text>
 </clause><clause id="H1883F31DCD9A4726819D59159B2C0B80"><enum>(iii)</enum><text>market studies;</text> </clause><clause id="HAF638A03B9F143F69774A25696594797"><enum>(iv)</enum><text>pipeline development;</text>
 </clause><clause id="H4BEE6D5BC247425C8E55F947B5FBBFCC"><enum>(v)</enum><text>community engagement; and</text> </clause><clause id="HAAFF765FE97E43B5A0B170025BE1B4CD"><enum>(vi)</enum><text>local hiring practices.</text>
 </clause></subparagraph></paragraph><paragraph id="H2ECC53AA45B644D3910C3153D4AAFB03"><enum>(2)</enum><header>Awards process</header><text>The National Fund Manager shall—</text> <subparagraph id="H3B937BA5231149518794CDFEDF7DE4B2"><enum>(A)</enum><text>with respect to partnerships—</text>
 <clause id="HFFEFF362EE2A47E48CF6A7388082799D"><enum>(i)</enum><text>establish eligibility criteria for assistance under the Initiative;</text> </clause><clause id="H7B4AB34343974CB5A485B4FDDA144A80"><enum>(ii)</enum><text>review each partnership application to ensure that the application is complete and the partnership is eligible to be considered for an award;</text>
 </clause><clause id="H5AEEF32470844540AD6C2D62945E2FF6"><enum>(iii)</enum><text>establish a competitive award process that considers—</text> <subclause id="H84E87EEB5E1647B58885E7E56CD65683"><enum>(I)</enum><text>the lack of access to healthy food items in the community of a partnership;</text>
 </subclause><subclause id="H61C65828F91E460C86C2810E0ED03E8D"><enum>(II)</enum><text>the amount of local funds and other resources pledged by a partnership to match or leverage Initiative funds;</text>
 </subclause><subclause id="H34F875B4136E479FAB9E3FA73391E42C"><enum>(III)</enum><text>the degree of State, local, or Tribal government support of the partnership;</text> </subclause><subclause id="HF63C0D438A834218AA5EDD9008BA58AE"><enum>(IV)</enum><text>the capacity of the partnership to successfully develop and manage loan and grant programs;</text>
 </subclause><subclause id="H7C17379FA3944AFB9DC36BAF5FCE1D63"><enum>(V)</enum><text>the capacity of the partnership to successfully develop, provide, or contract for technical assistance and business development services for healthy food retailers, healthy food producers, food hubs, or other healthy food business enterprises;</text>
 </subclause><subclause id="H2EE4544DC18D466DB3E839C4F13B2DC2"><enum>(VI)</enum><text>the capacity of the partnership—</text> <item id="H20CE197D391D4922A093CA7F8A86B9F9"><enum>(aa)</enum><text>to market and promote the Initiative; and</text>
 </item><item id="H59D8082901B04DE9B3EADA0AC649EABC"><enum>(bb)</enum><text>to support disadvantaged business enterprises or historically underserved producers;</text> </item></subclause><subclause id="H75F07502DDC14DF49137EC68CDF53213"><enum>(VII)</enum><text>the capacity of the partnership to collect data and monitor and track program outcomes;</text>
 </subclause><subclause id="H14E5DB76D32E4740B7C2F03F04BC02E1"><enum>(VIII)</enum><text>the degree of community engagement and participation in, or benefits from, projects to be financed by the partnership; and</text>
 </subclause><subclause id="H7507E2AEDD42448EB4D62B003DBBFBA2"><enum>(IX)</enum><text>the contribution of the partnership to the overall geographical diversity of the Initiative;</text> </subclause></clause><clause id="H45878F0A092D47B783AEF6F34E83FF38"><enum>(iv)</enum><text>provide awards to each of—</text>
 <subclause id="H9CE2CB1629604CA68833FC231B8651C7"><enum>(I)</enum><text>a State, Tribal, or unit of local government or a quasi-public State or local government agency;</text> </subclause><subclause id="H205AA2A222154086BD705A80C8871256"><enum>(II)</enum><text>a food access organization or an organization similarly committed to improving access to healthy foods; and</text>
 </subclause><subclause id="HEA5710C42D0E427FA935D692FAD1F5A6"><enum>(III)</enum><text>a community development financial institution or other organization that can administer a loan and grant program in accordance with this section; and</text>
 </subclause></clause><clause id="H43E89BF027C54648ACEA5473C5F7A5D6"><enum>(v)</enum><text>enter into a loan or grant agreement, as applicable, with each partnership to which the National Fund Manager provides an award; and</text>
 </clause></subparagraph><subparagraph id="HC969E3DD610F49069E9351754FACCFCA"><enum>(B)</enum><text>with respect to projects—</text> <clause id="HDC2F13FF444E41AF91C34F2F6A50405F"><enum>(i)</enum><text>establish eligibility criteria for assistance under the Initiative in accordance with subsection (g)(1);</text>
 </clause><clause id="H4342125B146B4AB0A71851ECC06BA29A"><enum>(ii)</enum><text>review each application to ensure that the application is complete and the project is eligible to be considered for an award;</text>
 </clause><clause id="H9FC1109405F34A36A1C70969CD84B096"><enum>(iii)</enum><text>evaluate each application and provide awards to projects in accordance with the priorities described in subsection (g)(2), on a rolling basis, that—</text>
 <subclause id="H33D8C996B1204538A821E8F44B51CD90"><enum>(I)</enum><text>are consistent with this section; and</text> </subclause><subclause id="H786111C10F514E4EA65F51EF4C9BC138"><enum>(II)</enum><text>demonstrate the need for assistance under the Initiative; and</text>
 </subclause></clause><clause id="H4588BFA7CFCE41C9B387B3690B812DFD"><enum>(iv)</enum><text>based on a review of the use of Initiative funds described in paragraph (3)(C)(v)(II), ensure that a reasonable amount of Initiative funds are used to support nonretail projects.</text>
 </clause></subparagraph></paragraph><paragraph id="HF49FCAC1CEF94AF19C0349EF7A7E57E7"><enum>(3)</enum><header>Post-award activities</header><text>The National Fund Manager shall—</text> <subparagraph id="HCA9777AAFE6240E7AAF025D6A03D8B66"><enum>(A)</enum><text>recommend to the Secretary for approval under subsection (d)(2)(C) outcome metrics for evaluating the effectiveness and impact of the Initiative, including—</text>
 <clause id="H1BE7A457FEC14589B2F0181B76506233"><enum>(i)</enum><text>the location, type, and number of—</text> <subclause id="H8347B33972964E8399623A0B2492B711"><enum>(I)</enum><text>businesses assisted by the Initiative;</text>
 </subclause><subclause id="HB64A32B53F054D3BAF0CD3ED30C6CB42"><enum>(II)</enum><text>businesses created or expanded by the Initiative;</text> </subclause><subclause id="H221920297FDD4254BD4B31BEA26890FB"><enum>(III)</enum><text>rural businesses assisted by the Initiative; and</text>
 </subclause><subclause id="H773416594A41410493270D06424E42E3"><enum>(IV)</enum><text>disadvantaged businesses assisted by the Initiative;</text> </subclause></clause><clause id="HD5D7D2EDFA8B439091C89338235564D3"><enum>(ii)</enum><text>demographic characteristics of the populations and communities served by the Initiative, such as income, race, and ethnicity;</text>
 </clause><clause id="HC84463E101174E509F9EA4A521C25739"><enum>(iii)</enum><text>jobs created and retained by very low- and low-income persons as a result of the Initiative;</text> </clause><clause id="HE9213E11C8794A949842C67EAAE046C8"><enum>(iv)</enum><text>the job quality of jobs created by the Initiative;</text>
 </clause><clause id="H52699AA6392848C4AC160E2DC9A1621C"><enum>(v)</enum><text>funds leveraged by the Initiative;</text> </clause><clause id="H28FA63BEFD154C9AA23A3C1874ED2BE7"><enum>(vi)</enum><text>project participation in—</text>
 <subclause id="HB8BB680E98CE4085A812DE9C744DE128"><enum>(I)</enum><text>the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.);</text> </subclause><subclause id="H31653A764DE448AA8ACD497F6F411C92"><enum>(II)</enum><text>the special supplemental nutrition program for women, infants, and children established by section 17 of the <act-name parsable-cite="CNA66">Child Nutrition Act of 1966</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>); and</text>
 </subclause><subclause id="HAD270B21B3C648D296B6DAC267F2624F"><enum>(III)</enum><text>other nutrition benefit programs;</text> </subclause></clause><clause id="H487346438C99435D8CB91631863911D4"><enum>(vii)</enum><text>project participation in, and offering of, job training programs targeting low-income populations;</text>
 </clause><clause id="H991E62E7B27E406CA94C7B7C9834B90A"><enum>(viii)</enum><text>project participation in programs to promote healthy food choices and increase the affordability of healthy food by low-income populations, such as—</text>
 <subclause id="H1E38FACF7D9847ACB87665DFEE1BA6E8"><enum>(I)</enum><text>nutrition education under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.); and</text> </subclause><subclause id="H8B025BE69AC04246BAB7AAD2C2B4B9AC"><enum>(II)</enum><text>the food insecurity nutrition incentive program under section 4405 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/7517">7 U.S.C. 7517</external-xref>); and</text>
 </subclause></clause><clause id="H8714279CC3E94ED1B7B32943FBECF716"><enum>(ix)</enum><text>the degree of collaboration among local partners;</text> </clause></subparagraph><subparagraph id="HF460522AB7D94DB8B3A2653646067B29"><enum>(B)</enum> <clause commented="no" display-inline="yes-display-inline" id="H5D4F997B18E24080B9D33BC1DDE7C6DA"><enum>(i)</enum><text>collect data from partnerships and projects awarded funding under the Initiative; and</text>
 </clause><clause id="HE84CDFE86D734881B598638617377D18" indent="up1"><enum>(ii)</enum><text>compile the data for the approved outcome metrics described in subparagraph (A); and</text> </clause></subparagraph><subparagraph id="H8F66FF9EAFE94FE3AF6075766036DEF7"><enum>(C)</enum><text>submit to the Secretary—</text>
 <clause id="HCF4C2356B95245DCA2F0839E5907728C"><enum>(i)</enum><text>with respect to partnerships and projects awarded funding under the Initiative, periodic reports on approved outcome metrics described in subparagraph (A) using data collected and compiled under subparagraph (B);</text>
 </clause><clause id="H515133B96350457CA7D4EE87F85D896C"><enum>(ii)</enum><text>the percentage of the number of partnerships and projects funded for each fiscal year that are located in a rural area;</text>
 </clause><clause id="H0514223E68CB4313AE6B16816C87EC1A"><enum>(iii)</enum><text>the percentage of the number of partnerships and projects funded for each fiscal year that are located in—</text>
 <subclause id="H4D8A3FE397B44D278502C2E78BF44F7D"><enum>(I)</enum><text>low-income communities; and</text> </subclause><subclause id="H3FC2A2826D7B4CDC8A9FD2C967401384"><enum>(II)</enum><text>moderate-income communities;</text>
 </subclause></clause><clause id="HC080CEC868FF4B479B853437FF12C93A"><enum>(iv)</enum><text>a copy of—</text> <subclause id="H501B94B4027C40F394B03686DD2DB181"><enum>(I)</enum><text>the Community Development Financial Institutions Fund annual certification for the National Fund Manager; and</text>
 </subclause><subclause id="H16B5786676194B6B8515E143EB0F9C99"><enum>(II)</enum><text>the data collection report form submitted to the Department of the Treasury by the National Fund Manager; and</text>
 </subclause></clause><clause id="HE36CF6BF885F4B85852B4A073BE9DF6D"><enum>(v)</enum><text>an annual report that includes—</text> <subclause id="HC34537C5EF724C948DA15432B916006E"><enum>(I)</enum><text>a synopsis of each partnership and project receiving funding under the Initiative; and</text>
 </subclause><subclause id="H7BCF1D4EF8514DCA9A14248C6259F771"><enum>(II)</enum><text>a description of the use of Initiative funds for the applicable year.</text> </subclause></clause></subparagraph></paragraph><paragraph id="H395FA846518C4CA18CAE868FF27FD9AD"><enum>(4)</enum><header>Outreach</header><text>The National Fund Manager shall contract with a national food access organization (and may contract with regional or local food access organizations)—</text>
 <subparagraph id="HEB62DE90C4FD426C94080BD0706979D5"><enum>(A)</enum><text>to publicize the Initiative to target communities and priority populations; and</text> </subparagraph><subparagraph id="H628E28E13D2D4106A7D4F76DC4A5CEB6"><enum>(B)</enum><text>to organize and build the capacities of partnerships, potential applicants for funding under the Initiative, and peer organizations to ensure that resources are directed to communities most in need of funding under the Initiative.</text>
 </subparagraph></paragraph><paragraph id="H3FD2049AC01E43A9BE62A496D4BF4369"><enum>(5)</enum><header>Alignment</header><text>To maximize the impact of the Initiative, the National Fund Manager shall seek to align the Initiative with—</text>
 <subparagraph id="HFC7B701AD17F47F2897D9E53C8F06C11"><enum>(A)</enum><text>other programs of the Department, such as—</text> <clause id="H38EBE9635EC84539AE5DDC8E6638DA31"><enum>(i)</enum><text>the food insecurity nutrition incentive program under section 4405 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/7517">7 U.S.C. 7517</external-xref>); and</text>
 </clause><clause id="HBB93C8C679064B05A17DDAA4D845864A"><enum>(ii)</enum><text>the Farmers' Market and Local Food Promotion Program under section 6 of the Farmer-to-Consumer Direct Marketing Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/7/3005">7 U.S.C. 3005</external-xref>); and</text>
 </clause></subparagraph><subparagraph id="H23BDD98A0AB34CA0A75619E5BDC721C0"><enum>(B)</enum><text>other Federal nutrition programs.</text> </subparagraph></paragraph></subsection><subsection id="H42837CB4D7E14E41B748ACBD9DED78CE"><enum>(f)</enum><header>Duties of partnerships</header><text>A partnership that receives an award from the National Fund Manager shall carry out financing and other activities to implement and maximize the effectiveness of the Initiative, as described in the grant or loan agreement, as applicable, with the National Fund Manager under subsection (e)(2)(A)(v), including—</text>
 <paragraph id="H0C74476C12FC482087A008D279F11B22"><enum>(1)</enum><text>conducting marketing and outreach to communities, the grocery industry, and others—</text> <subparagraph id="H9877E4B3D8854B848F2B902AA7B402A2"><enum>(A)</enum><text>to solicit applications from projects in underserved communities;</text>
 </subparagraph><subparagraph id="H5F26517DE2794F338C741C9917CAD1AD"><enum>(B)</enum><text>to build an understanding of the economics of the local food retail market; and</text> </subparagraph><subparagraph id="H5164D6F44C97455AA43C15A5E4A118FF"><enum>(C)</enum><text>to identify opportunities in the target area;</text>
 </subparagraph></paragraph><paragraph id="H644B137E6D8642FFA6506BF5D3EF5A59"><enum>(2)</enum><text>reviewing applications from projects for funding under the Initiative;</text> </paragraph><paragraph id="H1917BF3D3142466488BC09E38246023E"><enum>(3)</enum><text>underwriting and disbursing Initiative funds to projects;</text>
 </paragraph><paragraph id="HF6A1501E98204FE3AC927209686867A0"><enum>(4)</enum><text>providing technical assistance and business development services to projects;</text> </paragraph><paragraph id="H66FA29FFD0E44C3197ED4F6B95326BD8"><enum>(5)</enum><text>submitting an annual financial and program report to the National Fund Manager that describes—</text>
 <subparagraph id="H36F67FA2AF3A46FDA20D8FF730BB3C78"><enum>(A)</enum><text>the activities of the partnership;</text> </subparagraph><subparagraph id="H5B5F986642E1479EB00E67057C4B9518"><enum>(B)</enum><text>the expenditure of Initiative funds; and</text>
 </subparagraph><subparagraph id="HD13D44F0E6944F2FAEC4A077F9DC319F"><enum>(C)</enum><text>any success in meeting approved outcome metrics described in subsection (e)(3)(A) and satisfying such other terms and conditions as are specified in the grant or loan agreement; and</text>
 </subparagraph></paragraph><paragraph id="HEB1F909460A14AAB8A25AF0DE4BB2864"><enum>(6)</enum><text>expending reasonable administrative costs, which shall not exceed 10 percent of the amounts provided to the partnership under the Initiative.</text>
						</paragraph></subsection><subsection id="H8323AFB692B14C2EB2C1FDB524B22EE1"><enum>(g)</enum><header>Projects</header>
 <paragraph id="H16D35E40D7CB401E9ED25B6537166896"><enum>(1)</enum><header>Eligibility</header><text>To be eligible to receive an award under the Initiative, a project shall—</text> <subparagraph id="H339F6F6B15B84C029C7B5801CCDC46D6"><enum>(A)</enum><text>be located in a low-income area or a moderate-income area;</text>
 </subparagraph><subparagraph id="HD0DF88D5831041769B7A5CF6F3008522"><enum>(B)</enum><text>be located in or serve an underserved community;</text> </subparagraph><subparagraph id="H61A78B6C6CA143B8AA8FEA096BE163E0"><enum>(C)</enum><text>expand or preserve the availability of staple food;</text>
 </subparagraph><subparagraph id="H37BD8BDA46DC490DAE2CFBE10028528F"><enum>(D)</enum><text>demonstrate the need for funding under the Initiative;</text> </subparagraph><subparagraph id="H27A301BDDE9A4001B32BBE20CD1F2FFA"><enum>(E)</enum><text>in the case of a healthy food retailer—</text>
 <clause id="H94321F70003D44E0A700DCA86B6D1EEE"><enum>(i)</enum><text>accept benefits under the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.); or</text> </clause><clause id="HA531B37760A54E1C9CD3BD5AFF365B1E"><enum>(ii)</enum><text>develop mid-tier value chains that expand the availability of healthy food in underserved communities;</text>
 </clause></subparagraph><subparagraph id="H48728BE1AB4E4053B9A30BE770B70C76"><enum>(F)</enum><text>in the case of a food hub or healthy food producer—</text> <clause id="HE67CA441D6E34347B09240AE281AAF12"><enum>(i)</enum> <subclause commented="no" display-inline="yes-display-inline" id="HD237D39F39824A4C8C817AD6282D72E4"><enum>(I)</enum><text>sell healthy food items to food retailers that serve an underserved area; and</text>
 </subclause><subclause id="H3299A6C56A96490B885D259E139BC20D" indent="up1"><enum>(II)</enum><text>accept benefits under the supplemental nutrition assistance program established under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.); or</text> </subclause></clause><clause id="HC342582C1B0A4B06965D1BCDBAAD106A"><enum>(ii)</enum><text>sell or donate healthy food items to an institution, such as a hospital, school, food bank or pantry, social service agency, community center, or religious organization, that serves low-income, underserved communities; and</text>
 </clause></subparagraph><subparagraph id="H932F1AD9DCCA4DF0992C49FBA07D0CF9"><enum>(G)</enum><text>in the case of a healthy food business enterprise, train or employ individuals from low-income, underserved communities.</text>
 </subparagraph></paragraph><paragraph id="H263AA966A81549AA9FFFA8C68C59C60E"><enum>(2)</enum><header>Priorities</header><text>In making awards to projects under the Initiative, priority shall be given to a project that—</text> <subparagraph id="H95ECBD6A64B74E86A5369C52F838FBB9"><enum>(A)</enum><text>is located in an area that meets at least one of the criteria described in section 1805.201(b)(3)(ii)(D) of title 12, Code of Federal Regulations (as in effect on the date of enactment of the <short-title>Healthy Food Financing Initiative Reauthorization Act of 2018</short-title>); and</text>
							</subparagraph><subparagraph id="HB337B23FFEC142F49668EE6B08E83742"><enum>(B)</enum>
 <clause commented="no" display-inline="yes-display-inline" id="H8F8CBD35CF554FD2ACF96DCAB30F2FE3"><enum>(i)</enum><text>is located in or serves a rural area;</text> </clause><clause id="H3E0445664D604190976458353246796B" indent="up1"><enum>(ii)</enum><text>supports rural economic development;</text>
 </clause><clause id="HBCFD6E7D2D694591BED147ACDD972BDA" indent="up1"><enum>(iii)</enum><text>includes mid-tier value chains that use agricultural producer business and cooperative ownership models;</text>
 </clause><clause id="HAC47CBF18D4C493AB79EABE754F7651C" indent="up1"><enum>(iv)</enum><text>involves a disadvantaged business enterprise or historically underserved producer;</text> </clause><clause id="HD3E0536EE0FA4D95A91FE2BCB8370D3D" indent="up1"><enum>(v)</enum><text>participates in a job training or workforce development program that targets low-income individuals and underserved communities;</text>
 </clause><clause id="HF11731AD1D7F475D93E455315E428306" indent="up1"><enum>(vi)</enum><text>commits to hiring low-income residents from the community that the project serves;</text> </clause><clause id="H03E60E83E5ED4DFA83B212BA9AA30CC6" indent="up1"><enum>(vii)</enum><text>will create or retain quality jobs in the community that the project serves;</text>
 </clause><clause id="H48C4D17E8B9A4B34AB12D1537A0CC35B" indent="up1"><enum>(viii)</enum><text>is supported by the community served by the project, based on the factors of store quality, affordability, site location, and coordination with local community plans or other programs promoting community and economic development;</text>
 </clause><clause id="HEB52146897B34794B2E89B49E51C485C" indent="up1"><enum>(ix)</enum><text>supports regional food systems and locally grown foods;</text> </clause><clause id="H6B04FD615BA540BA8E30B9A250729417" indent="up1"><enum>(x)</enum><text>is associated with a transit-oriented development project;</text>
 </clause><clause id="H323346A9A1054D25BAE38C1643BD0EA9" indent="up1"><enum>(xi)</enum><text>is accessible by public transit, if public transit is available in the area;</text> </clause><clause id="HB212DF33938A4C81A8A93EE241F30D87" indent="up1"><enum>(xii)</enum><text>receives funding from other Federal agencies or is part of another Federal program or initiative;</text>
 </clause><clause id="HF136928DB8CE454AA89B70E86C8C593E" indent="up1"><enum>(xiii)</enum><text>involves veteran-owned businesses or veteran farmers and ranchers (as defined in section 2501(e) of the Food, Agriculture, Conservation and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(e)</external-xref>)); or</text>
 </clause><clause id="HEEC66BD7019F4357878C08120A6710CD" indent="up1"><enum>(xiv)</enum><text>participates in other food assistance and nutrition education programs of the Department.</text> </clause></subparagraph></paragraph></subsection><subsection id="H0A476F9CAE92491EBF4184205577C652"><enum>(h)</enum><header>Funding</header> <paragraph id="HE5180B071B1B43D291D8A7A3614FE4F4"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $125,000,000, to remain available until expended.</text>
 </paragraph><paragraph id="H5237B85B52D54CA083A5B4522DBA4770"><enum>(2)</enum><header>Allocation</header><text>Of amounts appropriated under paragraph (1)—</text> <subparagraph id="H1DCE7E9F030842C8BC6D663ABAADAB89"><enum>(A)</enum><text>not less than 75 percent shall be used to fund projects of healthy food retailers; and</text>
 </subparagraph><subparagraph id="H750A007C861F4FCFA48BC8D3209A6290"><enum>(B)</enum><text>not more than 25 percent shall be used to fund projects of food hubs, healthy food producers, and healthy food business enterprises.</text>
 </subparagraph></paragraph><paragraph id="HAFD1C2DF713740D0812B65706A46F43F"><enum>(3)</enum><header>Administrative costs</header><text>Not more than 10 percent of amounts appropriated under paragraph (1) shall be used for administrative costs.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
