<section id="HF39E2E988FD74DE3914581CB32D272DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Embassy Security Authorization Act, Fiscal Year 2019</short-title></quote>.</text></section> <section id="HA4C2974D7B494FBD804FADC9911F7D07"><enum>2.</enum><header>Standard design in capital construction</header> <subsection id="HB9B1BE88B2FA428BBD0499FA87F5B3A5"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Department of State’s Bureau of Overseas Building Operations (OBO) or successor office should give appropriate consideration to standard embassy design, in which each new embassy and new consulate starts with a standard design and keeps customization to a minimum.</text></subsection> 
<subsection id="H0BA2D9A3E69745D794F36C24AA64CF36"><enum>(b)</enum><header>Consultation</header><text>The Secretary of State shall, in consultation with the appropriate congressional committees, carry out any new embassy compound project or new consulate compound project that is in the design phase or pre-design phase as of the date of the enactment of this Act and that utilizes a non-standard design. The Secretary shall provide such committees, for each such project, the following documentation:</text> <paragraph id="H5FEC65864FE342A4BF4BFB95FA29B26C"><enum>(1)</enum><text>A comparison of the estimated full lifecycle costs of the project at issue to the estimated full lifecycle costs of such project if such project were to use a standard embassy design.</text></paragraph> 
<paragraph id="H73D2200D2E9E4B30B262DD805557D0B6"><enum>(2)</enum><text>A comparison of the estimated completion date of such project to the estimated completion date of such project if such project were to use a standard embassy design.</text></paragraph> <paragraph id="HA81ECF57E6F94A70A25218F16B0076A4"><enum>(3)</enum><text>A comparison of the security of such completed project to the security of such completed project if such completed project were to use a standard embassy design.</text></paragraph> 
<paragraph id="H08831D210AC7454EBE626BE04E92F812"><enum>(4)</enum><text>A justification for the Secretary’s selection of a non-standard design over a standard embassy design for such project.</text></paragraph> <paragraph id="HA86EA35ADC8D4A01B85A0AB61263F282"><enum>(5)</enum><text>A written explanation if any of the documentation necessary to support the comparisons and justification, as the case may be, described in paragraphs (1) through (4) cannot be provided.</text></paragraph></subsection></section> 
<section id="H6FFC64AD1BF44EE480240936C37C1957"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States that the Bureau of Overseas Building Operations of the Department of State or its successor office shall continue to balance functionality and security with accessibility as defined by guidelines established by the United States Access Board in constructing embassies and consulates and shall ensure compliance with the Architectural Barriers Act of 1968 to the fullest extent possible.</text></section> <section id="H58C9FDCE9000470BA6FAA8BAD617CA83"><enum>4.</enum><header>Capital construction transparency</header> <subsection id="H2E93351121C8453C88954451CAFAF63E"><enum>(a)</enum><header>In general</header><text>Section 118 of the Department of State Authorities Act, Fiscal Year 2017 (<external-xref legal-doc="usc" parsable-cite="usc/22/304">22 U.S.C. 304</external-xref>) is amended—</text> 
<paragraph id="H96D4F473B947469580471C92EE856DC2"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Annual report on embassy construction costs</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Quarterly report on overseas capital construction projects</header-in-text></quote>; and</text></paragraph> <paragraph id="H80A087E4E9464AC485CC760446E407C1"><enum>(2)</enum><text>by amending subsections (a) and (b) to read as follows:</text> 
<quoted-block id="H5BED952815A848C2859A42D4EF2B7945" style="OLC"> 
<subsection id="H55B1D0921EA54B9992E9D3685F75FB09"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this subsection and every 90 days thereafter, the Secretary shall submit to the appropriate congressional committees a comprehensive report regarding all ongoing overseas capital construction projects and major embassy security upgrade projects.</text></subsection> <subsection id="H69EDC208B81644E7AEA8CE23BC2AA36E"><enum>(b)</enum><header>Contents</header><text>Each report required under subsection (a) shall include the following with respect to each ongoing overseas capital construction project and major embassy security upgrade project:</text> 
<paragraph id="HFDC030EA77CC4DC6B0BF4B6B6A72F8DD"><enum>(1)</enum><text>The initial cost estimate as specified in the proposed allocation of capital construction and maintenance funds required by the Committees on Appropriations for Acts making appropriations for the Department of State, foreign operations, and related programs.</text></paragraph> <paragraph id="HC3322DF49F7F46518910BD139D5C10A4"><enum>(2)</enum><text>The current cost estimate.</text></paragraph> 
<paragraph id="HDF99681740BA434AB1CBC477AD6F0FB6"><enum>(3)</enum><text>The value of each request for equitable adjustment received by the Department of State to date.</text></paragraph> <paragraph id="H9A9DC657660949B9A691ECF56E0A0956"><enum>(4)</enum><text>The value of each certified claim received by the Department of State to date.</text></paragraph> 
<paragraph id="H5BE6FEF168AB49879F1E9389BC09B588"><enum>(5)</enum><text>The value of any usage of the project’s contingency fund to date and the value of the remainder of the project’s contingency fund.</text></paragraph> <paragraph id="H747521B81FED40B583BE3593B9B05869"><enum>(6)</enum><text>An enumerated list of each request for adjustment and certified claim that remains outstanding or unresolved.</text></paragraph> 
<paragraph id="H9254D3F31AF24BBA9E8E5EE652448FEF"><enum>(7)</enum><text>An enumerated list of each request for equitable adjustment and certified claim that has been fully adjudicated or that the Department has settled, and the final dollar amount of each adjudication or settlement.</text></paragraph> <paragraph id="HFB90010A85A44A5F9A8A275B30EE2335"><enum>(8)</enum><text>The date of estimated completion specified in the proposed allocation of capital construction and maintenance funds required by the Committees on Appropriations not later than 45 days after the date of the enactment of an Act making appropriations for the Department of State, foreign operations, and related programs.</text></paragraph> 
<paragraph id="H3808232D049045F1B12286BDED270100"><enum>(9)</enum><text>The current date of estimated completion.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HCFB2CE85807B4F75959E2154E9D640C7"><enum>(b)</enum><header>Initial report</header><text>The first report required under subsection (a) of section 118 of the Department of State Authorities Act, Fiscal Year 2017 (as amended by this section) shall include an annex regarding all overseas capital construction projects and major embassy security upgrade projects completed during the 10-year period ending on December 31, 2018, including, for each such project, the elements specified in subsection (b) of such section 118 (as amended by this section).</text></subsection></section> 
<section id="H88AFA969D53D4A7BA6534322D6E4DEE7"><enum>5.</enum><header>Contractor performance information</header> 
<subsection id="H42696054F7C740F89121A150BC3F0C34"><enum>(a)</enum><header>Deadline for completion</header><text>The Secretary of State shall complete by October 1, 2020, all contractor performance evaluations required by subpart 42.15 of the Federal Acquisition Regulation.</text></subsection> <subsection id="H52B425608268455DBA0972F17B95DC09"><enum>(b)</enum><header>Prioritization system</header> <paragraph id="HE89C14E5D942436D94D375AA8A9CB31C"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall develop a prioritization system for clearing the current backlog of required evaluations referred to in subsection (a).</text></paragraph> 
<paragraph id="HFC7BFCAE874E4137AF11916B6A66C5A5"><enum>(2)</enum><header>Elements</header><text>The system required under paragraph (1) should prioritize such evaluations as follows:</text> <subparagraph id="H1E3F5AEB0BCC4FF7B86225507CBE3E58"><enum>(A)</enum><text>Project completion evaluations should be prioritized over annual evaluations.</text></subparagraph> 
<subparagraph id="HBA10FC60FD1C43D89DBBDC2579A6D0BB"><enum>(B)</enum><text>Evaluations for relatively large contracts should have priority.</text></subparagraph> <subparagraph id="H5574126D76D34D41BE8AEBE8746CC367"><enum>(C)</enum><text>Evaluations that would be particularly informative for the awarding of government contracts should have priority.</text></subparagraph></paragraph></subsection> 
<subsection id="H56017450B75D4719A8A4AF68B6E299A6"><enum>(c)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall brief the appropriate congressional committees on the Department of State’s plan for completing all evaluations by October 1, 2020, and the prioritization system developed pursuant to this section.</text></subsection> <subsection id="H000B2CD0081E4094ACC7EDB1B1FB6DE8"><enum>(d)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text> 
<paragraph id="HB8EA3A5854894238AADC3292C0BFF2C3"><enum>(1)</enum><text>contractors deciding whether to bid on Department of State contracts would benefit from greater understanding of the Department as a client; and</text></paragraph> <paragraph id="H649A7B31D70F4F36B07DF3E7627F5681"><enum>(2)</enum><text>the Department should develop a forum through which contractors can rate the Department’s project management performance.</text></paragraph></subsection></section> 
<section id="H4B1EC00DA89B4E97B658F9698B87148F"><enum>6.</enum><header>Growth projections for new embassies and consulates</header> 
<subsection id="HCEF19B38811747E88A9800D20D9E4DFE"><enum>(a)</enum><header>In general</header><text>For each new embassy compound project (NEC) and new consulate compound project (NCC) in or not yet in the design phase as of the date of the enactment of this Act, the Office of Management Policy, Rightsizing, and Innovation of the Department of State shall project growth over the estimated life of the facility at issue using all available and relevant data, including the following:</text> <paragraph id="HBE628E5DCF2A48FEB8393B3E2E5C42FC"><enum>(1)</enum><text>Relevant historical trends for Department personnel and personnel from other agencies represented at the NEC or NCC that is to be constructed.</text></paragraph> 
<paragraph id="H593D1D8CCEC740E694FDF22C4C8DFDF9"><enum>(2)</enum><text>An analysis of the tradeoffs between risk and the needs of United States Government policy conducted as part of the most recent Vital Presence Validation Process, if applicable.</text></paragraph> <paragraph id="HA904A610FA9B4F9E81D6090350F8F8B0"><enum>(3)</enum><text>Reasonable assumptions about the strategic importance of the NEC or NCC, as the case may be, over the life of the building at issue.</text></paragraph> 
<paragraph id="HD418AC8391DA4A47B6EFBDD1A0259D5B"><enum>(4)</enum><text>Any other data that would be helpful in projecting the future growth of NEC or NCC.</text></paragraph></subsection> <subsection id="H4D0D80549B94404B9CABEC51111A57FC" commented="no"><enum>(b)</enum><header>Other agencies</header><text>Each Federal agency represented at an embassy or consulate shall provide to the Department of State, upon request, growth projections for the personnel of such agency over the estimated life of such embassy or consulate, as the case may be.</text></subsection> 
<subsection id="H13E26EFE7AC04E278A1C03D5C09B1BD4"><enum>(c)</enum><header>Basis for estimates</header><text>The Department of State shall base growth assumption for all NECs and NCCs on the estimates required under subsections (a) and (b).</text></subsection> <subsection id="H2DBDE42F31884F788380B3FF82BAC1CA"><enum>(d)</enum><header>Congressional notification</header><text>Any congressional notification of site selection for a NEC or NCC submitted after the date of the enactment of this Act shall include the growth assumption used pursuant to subsection (c).</text></subsection></section> 
<section id="H63F12B5034004825A9E30310070439BD"><enum>7.</enum><header>Long-range planning process</header> 
<subsection id="H43D115E6323E4D0DAA674F8F1B056E82"><enum>(a)</enum><header>Plans required</header> 
<paragraph id="H34823E01829C410792217FDDAE44036B"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act and annually thereafter for 5 years, the Secretary of State shall develop—</text> <subparagraph id="HE7C111D0C9B2419DA1FFC2E7D4F690D5"><enum>(A)</enum><text>a comprehensive 6-year Long-Range Overseas Buildings Plan (LROBP) documenting the Department of State’s overseas building program for the replacement of overseas diplomatic facilities taking into account security factors under the Secure Embassy Construction and Counterterrorism Act of 1999 and other relevant statutes and regulations, as well as occupational safety and health factors pursuant to the Occupational Safety and Health Act of 1970 and other relevant statutes and regulations, including environmental factors such as indoor air quality that impact employee health and safety; and</text></subparagraph> 
<subparagraph id="HD89B1923AA034A74A5508CD5656B8A99"><enum>(B)</enum><text>a comprehensive 6-year plan detailing the Department’s long-term planning for the maintenance and sustainment of completed facilities, known as a Long-Range Overseas Maintenance Plan (LROMP), which takes into account security factors under the Secure Embassy Construction and Counterterrorism Act of 1999 and other relevant statutes and regulations, as well as occupational safety and health factors pursuant to the Occupational Safety and Health Act of 1970 and other relevant statutes and regulations, including environmental factors such as indoor air quality that impact employee health and safety.</text></subparagraph></paragraph> <paragraph id="HCC15B2609EBC4CD08F54793BD5AF7400"><enum>(2)</enum><header>Initial report</header><text>The first plan developed pursuant to paragraph (1)(A) shall also include a one-time status report on existing small diplomatic posts and a strategy for establishing a physical diplomatic presence in countries in which there is no current physical diplomatic presence. Such report, which may include a classified annex, shall include the following:</text> 
<subparagraph id="HFC2772A176EF4132971419E13C292D7D"><enum>(A)</enum><text>A description of the extent to which each small diplomatic post furthers the national interest of the United States.</text></subparagraph> <subparagraph id="H4FBDA0CFFFD34FA3ABAEB1FF6C45B65F"><enum>(B)</enum><text>A description of how each small diplomatic post provides American Citizen Services, including data on specific services provided and the number of Americans receiving services over the previous year.</text></subparagraph> 
<subparagraph id="H18CDA4C1B4A943C89906D0B1323812C3"><enum>(C)</enum><text>A description of whether each small diplomatic post meets current security requirements.</text></subparagraph> <subparagraph id="HD9A7B38C72224972B31A887C8421A537"><enum>(D)</enum><text>A description of the full financial cost of maintaining each small diplomatic post.</text></subparagraph> 
<subparagraph id="HDE1B552326CE46EAA12071672B856147"><enum>(E)</enum><text>Input from the relevant chiefs of mission on any unique operational or policy value the small diplomatic post provides.</text></subparagraph></paragraph> <paragraph id="HA11D418EAC0647958A25988049A927EB"><enum>(3)</enum><header>Updated information</header><text>The annual updates of the plans developed pursuant to paragraph (1) shall highlight any changes from the previous year’s plan to the ordering of construction and maintenance projects.</text></paragraph></subsection> 
<subsection id="H340BE8D97C2044458D54C18E4DB1A405"><enum>(b)</enum><header>Reporting requirements</header> 
<paragraph id="HD987AE1459094856AC1B3149B2EF1AC5"><enum>(1)</enum><header>Submission of plans to Congress</header><text display-inline="yes-display-inline">Not later than 60 days after the completion of the LROBP and the LROMP, the Secretary of State shall submit such plans to the appropriate congressional committees.</text></paragraph> <paragraph id="H6D42F783C5FC4555B84773B413F96763"><enum>(2)</enum><header>Reference in budget justification materials</header><text display-inline="yes-display-inline">In the budget justification materials submitted to the appropriate congressional committees in support of the Department of State’s budget for any fiscal year (as submitted with the budget of the President under section 1105(a) of title 31, United States Code), the plans specified in the LROBP and LROMP shall be referenced to justify funding requested for building and maintenance projects overseas.</text></paragraph> 
<paragraph id="H84D6FB184F76415AA58C4764A5AD71A3"><enum>(3)</enum><header>Form of report</header><text>The plans required to be submitted under paragraph (1) shall be submitted in unclassified form but may include classified annexes.</text></paragraph></subsection> <subsection id="HE996D1C893154CB2808C62115F3FF814"><enum>(c)</enum><header>Small diplomatic post defined</header><text>In this section, the term <quote>small diplomatic post</quote> means any consulate that has employed five or fewer United States Government employees on average over the 36 months before the date of the enactment of this Act.</text></subsection></section> 
<section id="H3D03F97D1E0640D597EB121B8A2DD574"><enum>8.</enum><header>Value engineering and risk assessment</header> 
<subsection id="HF77A955B4B3E46289AA858E2AE83A487"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text> <paragraph id="HD3375B17D73B41F9813B46DC7C7A766E"><enum>(1)</enum><text>Federal departments and agencies are required to use value engineering (VE) as a management tool, where appropriate, to reduce program and acquisition costs pursuant to OMB Circular A–131, Value Engineering, dated December 31, 2013.</text></paragraph> 
<paragraph id="HE48EA935969445BD998102F571BDEEF0"><enum>(2)</enum><text>OBO has a Policy Directive and Standard Operation Procedure, dated May 24, 2017, on conducting risk management studies on all international construction projects.</text></paragraph></subsection> <subsection id="HF23F7EF58DAA4F938CDA416FD6B9C3B0"><enum>(b)</enum><header>Notification requirements</header> <paragraph id="HEB4895CEA6F64C8AB91E11133B7DE4C6"><enum>(1)</enum><header>Submission to authorizing committees</header><text display-inline="yes-display-inline">The proposed allocation of capital construction and maintenance funds that is required by the Committees on Appropriations of the House of Representatives and the Senate not later than 45 days after the date of the enactment of an Act making appropriations for the Department of State, foreign operations, and related programs shall also be submitted to the appropriate congressional committees.</text></paragraph> 
<paragraph id="H37D203B3A8DA41B6BDA71927BCEFDF27"><enum>(2)</enum><header>Requirement to confirm completion of value engineering and risk assessment studies</header><text>The notifications required under paragraph (1) shall include confirmation that the Department of State has completed the requisite VE and risk management studies described in subsection (a).</text></paragraph></subsection> <subsection id="H80D2B720668341B195FA0E8C4DE9A191"><enum>(c)</enum><header>Reporting and briefing requirements</header><text display-inline="yes-display-inline">The Secretary of State shall provide to the appropriate congressional committees upon request—</text> 
<paragraph id="H4F23E370B1074DE5BD1A251CE564D7EF"><enum>(1)</enum><text>a description of each recommendation from each study described in subsection (a) and a table detailing which recommendations were accepted and which were rejected; and</text></paragraph> <paragraph id="H099AE85CFDA348AABAAE1FA1456BCB90"><enum>(2)</enum><text>a report or briefing detailing the rationale for not implementing recommendations made by VE studies that may yield significant cost savings to the Department of State, if implemented.</text></paragraph></subsection></section> 
<section id="H69405CAFD059486489650B7EE181395B"><enum>9.</enum><header>Business volume</header><text display-inline="no-display-inline">Subparagraph (E) of section 402(c)(2) of the Omnibus Diplomatic Security and Antiterrorism Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/22/4852">22 U.S.C. 4852(c)(2)</external-xref>) is amended by striking <quote>in 3 years</quote> and inserting <quote>cumulatively over 3 years</quote>.</text></section> <section id="H7FD413C1F01E407E83C60BF7019AA651"><enum>10.</enum><header>Embassy security requests and deficiencies</header><text display-inline="no-display-inline">The Secretary of State shall provide to the appropriate congressional committees, upon request, information on security deficiencies at United States diplomatic posts, including—</text> 
<paragraph id="H35A3CB61A746418EA23BBB7B7ED451E3"><enum>(1)</enum><text>requests made over the previous year by United States diplomatic posts for security upgrades; and</text></paragraph> <paragraph id="HBE84E3D0A190431F94F9937DE9A139E1"><enum>(2)</enum><text>significant security deficiencies at United States diplomatic posts that are not operating out of a new embassy compound or new consulate compound.</text></paragraph></section> 
<section id="H7433445AB2D244079F0574CBD7F7C299"><enum>11.</enum><header>Overseas security briefings</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of State shall revise the Foreign Affairs Manual to stipulate that the Bureau of Diplomatic Security of the Department of State shall provide a security briefing or written materials with up-to-date information on the current threat environment in writing or orally to all United States Government employees traveling to a foreign country on official business. To the extent practicable, such briefing or written materials shall be provided to traveling Department employees via teleconference prior to their arrival at a post.</text></section> <section id="H0B7157A102EA4470B85D29F1FE7B3800"><enum>12.</enum><header>Contracting methods in capital construction</header> <subsection id="H7DE0AA23E9E54ED29DD6C85BAE8752E5"><enum>(a)</enum><header>Delivery</header><text>Except in cases in which the Secretary of State determines that such would not be appropriate, the Secretary shall make use of the design-build project delivery system at diplomatic posts that have not yet received design or capital construction contracts as of the date of the enactment of this Act.</text></subsection> 
<subsection id="HA4D5D2D37DD445239F260706F2D03A21"><enum>(b)</enum><header>Notification</header><text>Not later than 15 days after any determination to make use of a delivery system other than design-build in accordance with subsection (a), the Secretary of State shall notify the appropriate congressional committees in writing of such determination, including the reasons therefor.</text></subsection> <subsection id="H0EDCB9DBB3444061ADD95AD27A6B3C9E"><enum>(c)</enum><header>Performance evaluation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary shall report to the appropriate congressional committees regarding performance evaluation measures in line with GAO’s <quote>Standards for Internal Control in the Federal Government</quote> that will be applicable to design and construction, lifecycle cost, and building maintenance programs of the Bureau of Overseas Building Operations of the Department of State.</text></subsection></section> 
<section id="HD91B6A1DF4E2453A806E0D575E8139C6"><enum>13.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $2,314,474,000 for fiscal year 2019 for the purposes of the <quote>Embassy Security, Construction, and Maintenance</quote> account of the Department of State, of which $1,549,015,000 is authorized to be appropriated for the costs of worldwide security upgrades.</text></section> <section id="HDACE8CB475CB404898CA14540C93068C"><enum>14.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HE26A9B75EE8942D484FEBC82B391D2A1"><enum>(1)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <quote>appropriate congressional committees</quote> means—</text> <subparagraph id="H910F528E397F4003B95A6F18DA68FB31"><enum>(A)</enum><text>in the House of Representatives—</text> 
<clause id="HBC3F36E370A64554BC4A0A48BD3C756F"><enum>(i)</enum><text>the Committee on Foreign Affairs; and</text></clause> <clause id="H791BEBEB77194E00A7BFB4AB14F19FDD"><enum>(ii)</enum><text>the Committee on Appropriations; and</text></clause></subparagraph> 
<subparagraph id="HAB1D2DE65696400091226908E5C58192"><enum>(B)</enum><text>in the Senate—</text> <clause id="HB5F45C63C4AF4A338ECE294AADF3F38D"><enum>(i)</enum><text>the Committee on Foreign Relations; and</text></clause> 
<clause id="H811E73FAED58421A94D3F669BBED766E"><enum>(ii)</enum><text>the Committee on Appropriations.</text></clause></subparagraph></paragraph> <paragraph id="HBAE38C5C1944406285536CC1459EB0A5"><enum>(1)</enum><header>Design-build</header><text display-inline="yes-display-inline">The term <quote>design-build</quote> means a method of project delivery in which one entity works under a single contract with the Department of State to provide design and construction services.</text></paragraph> 
<paragraph id="HA76F837B5B5E488D8D74F7B758A49ADE"><enum>(2)</enum><header>Non-standard design</header><text>The term <quote>non-standard design</quote> means—</text> <subparagraph id="H93ACA8D231644D8BB8FA281EDB52B8D9"><enum>(A)</enum><text>a design for a new embassy compound project or new consulate compound project that does not utilize a standardized embassy design for the structural, spatial, or security requirements of such embassy compound or consulate compound, as the case may be; or</text></subparagraph>
