			 emission fees, reduce the rate of the corporate income tax, provide tax
			 credits to workers, deliver additional benefits to retired and disabled

 <section id="H112C4578CD874CC7ACD581CACA37B379" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Opportunity Carbon Fee Act of 2018</short-title></quote>.</text> </section><title id="H3B855184F05B4013A1BE784F38375A71" style="OLC"><enum>I</enum><header>Carbon dioxide and other greenhouse gas emission fees</header> <section id="HE6F14B3B9D8342BDBC1BDA84F2C6B167"><enum>101.</enum><header>Carbon dioxide and other greenhouse gas emission fees</header> <subsection id="H0EAD5B39319145BC96BC332FADA662D9"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/38">Chapter 38</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end thereof the following new subchapter:</text>

							<section id="H97AB5E0C08604609ADC7ECCBA8ED2593"><enum>4691.</enum><header>Fee for carbon dioxide emissions</header>
								<subsection id="H5FF99831E32243B18B522D4D4650A437"><enum>(a)</enum><header>In general</header>
									<paragraph id="HA7233E727B9B4152863C0E2E773466CF"><enum>(1)</enum><header>Fossil fuel products producing carbon emissions</header>
 <subparagraph id="H32431FECBA7D46AFB2264CC89FC3E1E1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There is hereby imposed a fee in an amount equal to the applicable amount at the rate specified in subparagraph (B) on—</text>
 <clause id="HA78723B8D43A4EE79729E697B561CCDD"><enum>(i)</enum><text display-inline="yes-display-inline">coal—</text> <subclause id="H9CFE1853827C4B2395124F2E91B04B6B"><enum>(I)</enum><text display-inline="yes-display-inline">removed from any mine in the United States, or</text>
 </subclause><subclause id="H9EFEFDB59345408AA4DEA3BA74BB37AA"><enum>(II)</enum><text>entered into the United States for consumption, use, or warehousing,</text> </subclause></clause><clause id="H65B57771FE8948EDBD66E45D17BE42FC"><enum>(ii)</enum><text>petroleum products—</text>
 <subclause id="H9EA68EB467E34135BE586C50E46B923F"><enum>(I)</enum><text>removed from any refinery,</text> </subclause><subclause id="H060DE92D96714C55A88F469D67E08D6F"><enum>(II)</enum><text>removed from any terminal, or</text>
 </subclause><subclause id="HEB86C3D7A09B4CEA9EDEB79A636ADF9D"><enum>(III)</enum><text>entered into the United States for consumption, use, or warehousing, and</text> </subclause></clause><clause id="HD421901F25F047AB85946E81BBE822E5"><enum>(iii)</enum><text>natural gas—</text>
 <subclause id="H0B790945E46F4D6D8F802FFB2B3CAA56"><enum>(I)</enum><text>entered into any processor, or</text> </subclause><subclause id="H834F8440A9E84CFD9EF58BD5A10C0D61"><enum>(II)</enum><text>entered into the United States for consumption, use, or warehousing.</text>
 </subclause></clause></subparagraph><subparagraph id="H8BBB3AD481C248EA81CDEA9AED7E528B"><enum>(B)</enum><header>Rate</header><text>The rate specified in this subparagraph with respect to any product described in subparagraph (A) is an amount equal to the applicable amount per ton of carbon dioxide that would be emitted through the combustion of such product (as determined by the Secretary, in consultation with the Secretary of Energy and the Administrator of the Environmental Protection Agency).</text>
 </subparagraph></paragraph><paragraph id="H91A9D1A6D3E04997A0FFC949F3521F70"><enum>(2)</enum><header>Emissions attributable to other substances</header><text>There is hereby imposed a fee in an amount equal to the applicable amount per ton of carbon dioxide emitted—</text>
 <subparagraph id="H320C520BC64340EC9B9CE054248B91AF"><enum>(A)</enum><text>from any facility which—</text> <clause id="H085242F9A1F2453CB3033473BE68D5FC"><enum>(i)</enum><text>is required to report emissions, or to which emissions are attributed, under subpart A of part 98 of title 40, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>, and</text>
 </clause><clause id="H10237EC980B74D718E18B022EB76293E"><enum>(ii)</enum><text>emitted not less than 25,000 tons of carbon dioxide emissions during the previous calendar year, and</text>
 </clause></subparagraph><subparagraph id="HEE4D3016EE1C4B4D9D1C70E40B1078BF"><enum>(B)</enum><text>by reason of the combustion or processing of any product other than coal, petroleum products, and natural gas.</text>
										</subparagraph></paragraph></subsection><subsection id="HDBB17ACDF80C4815AFA9B05FFF1FD15D"><enum>(b)</enum><header>Applicable amount</header>
 <paragraph id="H8DFB65F1310646F1BF79CA0861D8FC6C"><enum>(1)</enum><header>In general</header><text>For purposes of this part, the applicable amount is—</text> <subparagraph id="HD49EF7D5AACE4E0F8B4C305EF6B8C07D"><enum>(A)</enum><text>for calendar year 2019, $50,</text>
 </subparagraph><subparagraph id="HB25E03DA3CA548ADA1E0DC69EDC34EB8"><enum>(B)</enum><text>for any calendar year following a year which is not a national emissions target attainment year, the sum of—</text>
 <clause id="H0CD35BAE4A764313BCB1B9DE33938E09"><enum>(i)</enum><text display-inline="yes-display-inline">the product of the amount in effect under this subparagraph for the preceding calendar year and 102 percent, and</text>
 </clause><clause id="H064D9C64365B45C2AF5892DEB3BA4258"><enum>(ii)</enum><text>the inflation adjustment amount determined under paragraph (2), and</text> </clause></subparagraph><subparagraph id="H961F8BB1BADF46C9A5037F00D30C436A"><enum>(C)</enum><text>for any calendar year following a year which is a national emissions target attainment year, the sum of—</text>
 <clause id="HD7AEBD1B6EA84E44A747382F0143D3F6"><enum>(i)</enum><text>the amount in effect under this subparagraph for the preceding calendar year, and</text> </clause><clause id="H521D50EA141649CBB1FDCF229700E06A"><enum>(ii)</enum><text>the inflation adjustment amount determined under paragraph (2).</text>
											</clause></subparagraph></paragraph><paragraph commented="no" id="HA897C11AD1A64E4C81A5ED100F0CAB13"><enum>(2)</enum><header>Inflation adjustment amount</header>
 <subparagraph commented="no" id="H29046F47AD964FC5B263363226D8E58B"><enum>(A)</enum><header>In general</header><text>The inflation adjustment amount for any calendar year shall be an amount (not less than zero) equal to the product of—</text>
 <clause commented="no" id="H9D7731AFB9D841CD91B24DD7886F070E"><enum>(i)</enum><text>the amount determined under paragraph (1)(B)(i) or (1)(C)(i), as applicable, for such year, and</text> </clause><clause commented="no" id="H65C3482097374371A547459930623F22"><enum>(ii)</enum><text>the percentage by which the CPI for the preceding calendar year exceeds the CPI for the second preceding calendar year.</text>
 </clause></subparagraph><subparagraph commented="no" id="H201E69845B424D76AC3D57036C0ADF20"><enum>(B)</enum><header>CPI</header><text>Rules similar to the rules of paragraphs (4) and (5) of section 1(f) shall apply for purposes of this paragraph.</text>
 </subparagraph></paragraph><paragraph commented="no" id="H0EAE18FE51C4454EA76256679FA3DBAE"><enum>(3)</enum><header>Rounding</header><text>The applicable amount under this subsection shall be rounded up to the next whole dollar amount.</text> </paragraph><paragraph commented="no" id="H3CE806BD96A84800A9C9F2A3BF236454"><enum>(4)</enum><header>National emissions target attainment year</header><text>For purposes of paragraph (1), a calendar year is a national emissions target attainment year if the level of greenhouse gas emissions in the United States for the calendar year does not exceed 20 percent of the level of greenhouse gas emissions in the United States for calendar year 2005 as determined by the Secretary in consultation with the Administrator of the Environmental Protection Agency.</text>
									</paragraph></subsection><subsection id="HF3450523FFEC474BA52406D9571C2FD8"><enum>(c)</enum><header>Refunds for capturing carbon dioxide and production of certain goods</header>
									<paragraph commented="no" id="H91974161AB9C458592306A737BF71C17"><enum>(1)</enum><header>Carbon dioxide capture, utilization, and storage</header>
 <subparagraph commented="no" id="HC3A8C01A047D43799577CC2D4CBBE29B"><enum>(A)</enum><header>In general</header><text>In the case of a person who—</text> <clause commented="no" id="H769D19D86391451EA4B312D9DE80AE4F"><enum>(i)</enum><text>uses any coal, petroleum product, or natural gas for which a fee has been imposed under subsection (a)(1) in a manner which results in the emission of qualified carbon dioxide,</text>
 </clause><clause commented="no" id="H980429CFF38E45ED928E9B87EEA9C5C6"><enum>(ii)</enum><text>captures the resulting emitted qualified carbon dioxide at a qualified facility, and</text> </clause><clause commented="no" id="HD16304CAC8944AE19D9971030E084050"><enum>(iii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H640ED413AA354A038303D831423151B2"><enum>(I)</enum><text>disposes of such qualified carbon dioxide in secure storage, or</text>
 </subclause><subclause commented="no" id="HEED41202C4AD4CA99AC5C2612E225E20" indent="up1"><enum>(II)</enum><text>utilizes such qualified carbon dioxide in a manner provided in subparagraph (D),</text> </subclause></clause><continuation-text continuation-text-level="subparagraph">there shall be allowed a refund, in the same manner as if it were an overpayment of the fee imposed by such subsection, to such person in the amount determined under subparagraph (B).</continuation-text></subparagraph><subparagraph id="H30E515478D544B3BA87CD9D47AB67C4C"><enum>(B)</enum><header>Amount of refund</header><text>The amount of the refund under this subparagraph is an amount equal to the product of—</text>
 <clause commented="no" id="H2C6D42D8767A40CEBA6FBCF3D94661D0"><enum>(i)</enum><text>the applicable amount under subsection (b) for the calendar year in which such qualified carbon dioxide was captured and disposed or utilized, and</text>
 </clause><clause commented="no" id="HB9BEF4D33A6148399F3645A2C5EB03F2"><enum>(ii)</enum><text>the adjusted tons of qualified carbon dioxide captured and disposed or utilized.</text> </clause></subparagraph><subparagraph commented="no" id="H43629267EB5F46C1B5A9733A0AD54A05"><enum>(C)</enum><header>Adjusted total tons</header><text>For purposes of subparagraph (B), the adjusted tons of qualified carbon dioxide captured and disposed or utilized shall be the total tons of qualified carbon dioxide captured and disposed or utilized reduced by the amount of any anticipated leakage of carbon dioxide into the atmosphere due to imperfect storage technology or otherwise, as determined by the Secretary in consultation with the Administrator of the Environmental Protection Agency.</text>
										</subparagraph><subparagraph commented="no" id="H26073267AE934B66BDD9717D569786FD"><enum>(D)</enum><header>Requirements</header>
 <clause commented="no" id="HED174D606AA04181919D443A8371D63A"><enum>(i)</enum><header>In general</header><text>Any refund under subparagraph (A) shall apply only with respect to qualified carbon dioxide that has been captured and disposed or utilized within the United States.</text>
											</clause><clause commented="no" id="HDA3CE6A6D91E4B65B5467DC26FE24923"><enum>(ii)</enum><header>Disposal and secure storage</header>
 <subclause commented="no" id="H829E356D51F54AE48731A0A38197C207"><enum>(I)</enum><header>Secure storage</header><text>The Secretary, in consultation with the Administrator of the Environmental Protection Agency and the Secretary of Energy, shall establish regulations similar to the regulations under section 45Q(d)(2) for determining adequate security measures for the secure storage of qualified carbon dioxide for purposes of subparagraph (A)(iii)(I) such that the carbon dioxide does not escape into the atmosphere. Such regulations shall ensure the stored carbon dioxide may not be sold, transferred, or exported for any purpose that results in the emission of carbon dioxide.</text>
 </subclause><subclause commented="no" id="H83910FBAC78542B1B19EE5DB643494B7"><enum>(II)</enum><header>Recapture</header><text>The Secretary shall, by regulations, provide for recapturing the benefit of any refund made under subparagraph (A) with respect to any qualified carbon dioxide which is disposed in secure storage and ceases to be stored in a manner consistent with the requirements of this section.</text>
 </subclause></clause><clause commented="no" id="H397EF063B29B428189345F6648506CAB"><enum>(iii)</enum><header>Utilization</header><text>The Secretary, in consultation with the Administrator of the Environmental Protection Agency, shall establish regulations providing for the appropriate methods and manners for the utilization of qualified carbon dioxide under subparagraph (A)(iii)(II), including the utilization of captured carbon dioxide for enhanced oil or gas recovery and the production of substances such as plastics, biofuels, algae, and chemicals. Such regulations shall provide for the minimization of the escape or further emission of the qualified carbon dioxide into the atmosphere.</text>
 </clause></subparagraph><subparagraph commented="no" id="HA5FE7FE97BCA4A03A1A3E7AAB3D1B99E"><enum>(E)</enum><header>Qualified carbon dioxide; qualified facility</header><text>For purposes of this paragraph—</text> <clause commented="no" id="H5190DD7CDE2443B689F1C71C5B14A88E"><enum>(i)</enum><header>Qualified carbon dioxide</header><text>The term <term>qualified carbon dioxide</term> has the same meaning given that term under section 45Q(b).</text>
 </clause><clause commented="no" id="HC39D18CA65F14401AC7188AE784C58E8"><enum>(ii)</enum><header>Qualified facility</header><text>The term <term>qualified facility</term> has the same meaning given that term under section 45Q(c), determined without regard to paragraph (3) thereof.</text>
 </clause></subparagraph></paragraph><paragraph id="HA5F74E0EC7944F498786A907277E139B"><enum>(2)</enum><header>Manufacture of certain goods</header><text>In the case of a person who uses any coal, petroleum product, or natural gas for which a fee has been imposed under subsection (a)(1) as an input for a manufactured good that encapsulates carbon dioxide in a manner such that it does not result in the direct emission of carbon dioxide in the manufacturing or subsequent use of such good, a refund shall be allowed to such person in the same manner as if it were an overpayment of the fee imposed by such section in an amount that is equal to the product of—</text>
 <subparagraph id="H943AD0657C014627A3DFF84369BF3844"><enum>(A)</enum><text>an amount equal to the applicable amount under subsection (b) for the calendar year in which such product was used, and</text>
 </subparagraph><subparagraph id="HB5DE34B5930A4CDA94E8A0B0723F9DF0"><enum>(B)</enum><text>the total tons of carbon dioxide that would have otherwise been emitted through the combustion of such product.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HAB99B8133EF949FE8B42CCA0D754A36A"><enum>(3)</enum><header>Exports</header><text>In the case of a person who exports any coal, petroleum product, or natural gas from the United States for which a fee has been imposed under subsection (a)(1), a refund shall be allowed to such person in the same manner as if it were an overpayment of the fee imposed by such section in an amount that is equal to the fee previously imposed under such subsection with respect to such product (determined without regard to any increase under section 4694).</text>
									</paragraph></subsection></section><section commented="no" id="H8AA086A246E44A17A08E9062CF33A22F"><enum>4692.</enum><header>Fee on fluorinated greenhouse gases</header>
 <subsection commented="no" id="H6C010D1A11CE4F77B747F564E0FAD7C7"><enum>(a)</enum><header>In general</header><text>There is hereby imposed a fee in an amount determined under subsection (b) on fluorinated greenhouse gases—</text>
 <paragraph commented="no" id="H567CD9F32ED943A9B9361BC47C30AA04"><enum>(1)</enum><text>produced at a fluorinated greenhouse gas production facility,</text> </paragraph><paragraph commented="no" id="H4D193D7743814060BC1D7141EACC6DD5"><enum>(2)</enum><text>imported into the United States by a fluorinated greenhouse gas importer, or</text>
 </paragraph><paragraph commented="no" id="HC5CFB3E75C694B28B3954C0A2B971903"><enum>(3)</enum><text>emitted by an industrial fluorinated greenhouse gas facility.</text> </paragraph></subsection><subsection commented="no" id="HA90AC1626BB4448CA7492B757CE81E82"><enum>(b)</enum><header>Amount of fee</header><text display-inline="yes-display-inline">The amount of fee imposed by subsection (a) shall be equal to the applicable percentage (as defined in subsection (c)(5)) of the applicable amount determined under section 4691(b) per ton of carbon dioxide equivalent produced or imported.</text>
 </subsection><subsection commented="no" id="H25F78E15280D4CEDB3D4671DAD458232"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text> <paragraph id="H97C6D4FA0EC54B95A3F7722BF709891A"><enum>(1)</enum><header>Fluorinated greenhouse gases</header><text display-inline="yes-display-inline">The term <quote>fluorinated greenhouse gases</quote> means sulfur hexafluoride (SF6), nitrogen trifluoride (NF3), any hydrofluorocarbon, any perfluorocarbon, any fully fluorinated linear, branched or cyclic alkane, ether, tertiary amine or aminoether, any perfluoropolyether, any hydrofluoropolyether, and any other fluorocarbon except for substances with vapor pressures of less than 1 mm of Hg absolute at 25 degrees Celsius.</text>
 </paragraph><paragraph commented="no" id="H680D84066D134DF5A7B84C4DBBC52046"><enum>(2)</enum><header>Fluorinated greenhouse gas production facility</header><text>The term <term>fluorinated greenhouse gas production facility</term> means any facility which is included under the industrial gas supplier source category under subpart OO of part 98 of title 40, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>.</text>
 </paragraph><paragraph commented="no" id="H1B9798A80CF6447EA73DA4CF04ECE7A9"><enum>(3)</enum><header>Fluorinated greenhouse gas importer</header><text>The term <term>fluorinated greenhouse gas importer</term> means any importer who is included under—</text> <subparagraph commented="no" id="H949F826030424E77960F3A40B102DEA1"><enum>(A)</enum><text>the industrial gas supplier source category under subpart OO of part 98 of title 40, Code of Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>, or</text>
 </subparagraph><subparagraph commented="no" id="HE1AFF8FF4200457595B51F883240BCF0"><enum>(B)</enum><text>the source category under subpart QQ of such part (as so in effect).</text> </subparagraph></paragraph><paragraph commented="no" id="HBCC2752AED2D4E7589227DC7278CF6B4"><enum>(4)</enum><header>Industrial fluorinated greenhouse gas facility</header><text>The term <term>industrial greenhouse gas facility</term> means any facility which—</text>
 <subparagraph commented="no" id="HA7C7166DB6894287A799C6703DB3C159"><enum>(A)</enum><text>is included under—</text> <clause commented="no" id="H8722E8D297204E90AE1602957C13806C"><enum>(i)</enum><text>the aluminum production source category under subpart F of part 98 of title 40, Code of Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>,</text>
 </clause><clause commented="no" id="HCFF4A7D014184351B7E116DB26DEE828"><enum>(ii)</enum><text>the HCFC–22 production and HFC–23 destruction source category under subpart O of such part (as so in effect), or</text>
 </clause><clause commented="no" id="H40A0F1B72EBC4B098023DBF08F8AEA61"><enum>(iii)</enum><text>the fluorinated gas production source category under subpart L of such part (as so in effect), and</text> </clause></subparagraph><subparagraph commented="no" id="HE32CF788262B41DE8C321AD33B79B225"><enum>(B)</enum><text>emitted during the previous calendar year fluorinated greenhouse gases with a total carbon dioxide equivalent of not less than 25,000 tons.</text>

 </subsection><subsection id="H5D8EF230AB794692BBCE9CBA7BDB0FC0"><enum>(e)</enum><header>Refund for consumptive uses and destruction</header><text>In the case of a person who uses any fluorinated greenhouse gas for which a fee has been imposed under paragraph (1) or (2) of subsection (a) as an input for a manufactured good that transforms the fluorinated greenhouse gas such that it cannot later be emitted or otherwise destroys the gas (without emissions), a refund shall be allowed to such person in the same manner as if it were an overpayment of the fee imposed by such subsection in an amount that is equal to the product of—</text>
 <paragraph id="HAE181DDC3FFC4C75B8242BC97EA7BCCE"><enum>(1)</enum><text>an amount equal to the applicable percentage (as defined in subsection (c)(5)) of the applicable amount under section 4691(b), for the calendar year in which such fluorinated greenhouse gas was used or destroyed, and</text>
 </paragraph><paragraph id="HA69BB8CFFCEB473BB017D9107B2160EE"><enum>(2)</enum><text>the excess (if any) of—</text> <subparagraph id="H27A2F212E16A41C2868FC65D000D3BFE"><enum>(A)</enum><text>the total carbon dioxide equivalent of the fluorinated greenhouse gases used or destroyed, over</text>
 </subparagraph><subparagraph id="H3F7284762ED24AEBAA82A8A36F97B031"><enum>(B)</enum><text>the total carbon dioxide equivalent of any fluorinated greenhouse gases created as the result of the transformation or destruction process.</text>
										</subparagraph></paragraph></subsection></section><section commented="no" id="HFA249E96DD9B43DC8BA0807D94DBA09E"><enum>4693.</enum><header>Fee for other greenhouse gas emissions</header>
 <subsection commented="no" id="H281B541742B64D5ABD070EE874393584"><enum>(a)</enum><header>In general</header><text>There is hereby imposed a fee in an amount determined under subsection (b) on the emission (including attributed emissions) of any greenhouse gas (other than carbon dioxide or fluorinated greenhouse gases) from any greenhouse gas emissions source.</text>
 </subsection><subsection commented="no" id="H2FC9977CB89A4E38B28C88BAA627CEEF"><enum>(b)</enum><header>Amount of fee</header><text>The amount of fee imposed by subsection (a) shall be equal to the applicable amount determined under section 4691(b) per ton of carbon dioxide equivalent emitted by the greenhouse gas emissions source.</text>
 </subsection><subsection id="HF8B7D0EEDE8844889D340967A5139D22"><enum>(c)</enum><header>Greenhouse gas emissions source</header><text>The term <term>greenhouse gas emissions source</term> means any facility which—</text> <paragraph id="H3A882DED776C4FDFA6695B34C7A8CD61"><enum>(1)</enum><text>is required to report emissions (or which would be required to report emissions notwithstanding any other provision of law prohibiting the implementation of or use of funds for such requirements), or to which emissions are attributed, under part 98 of title 40, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>, and</text>
 </paragraph><paragraph id="H2B0EE6680BD1420BB66FFA1C819C70CD"><enum>(2)</enum><text>emitted during the previous calendar year greenhouse gases (not including carbon dioxide or fluorinated greenhouse gases) at a rate equal to the carbon dioxide equivalent of not less than 25,000 tons.</text>
									</paragraph></subsection></section><section commented="no" id="HC418132828194CDE815DC88471B44F1C"><enum>4694.</enum><header>Associated emissions</header>
								<subsection commented="no" id="HD568A55032AD46D4A08AF3DF12EE6733"><enum>(a)</enum><header>Reporting program</header>
 <paragraph commented="no" id="H35E4279DDA7A4662A662DB6BCF65C5E1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than January 1, 2021, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Secretary of the Interior, the Administrator of the Energy Information Administration, and the Administrator of the Pipeline and Hazardous Materials Safety Administration, shall establish and implement a program to identify all major source categories of associated emissions and collect data on associated emissions from the coal, petroleum products, and natural gas supply chains.</text>
 </paragraph><paragraph commented="no" id="HA707A09E7E294769B029386642BDB552"><enum>(2)</enum><header>Annual report</header><text>Not later than 12 months after the date that the Secretary implements the program described in paragraph (1), and annually thereafter, the Secretary shall issue a report, to be made available to the public and the appropriate committees of Congress, on associated emissions, including—</text>
 <subparagraph commented="no" id="H86873F18DF07421580564605D742BA5E"><enum>(A)</enum><text>identification of all major source categories of associated emissions, and</text> </subparagraph><subparagraph commented="no" id="H68E6046F24F64DB8A53CFE2EA3C65301"><enum>(B)</enum><text>the total amount, expressed in tons of carbon dioxide equivalent, of—</text>
 <clause commented="no" id="HC2FAEF689F5543E3A9AB54414B4729E1"><enum>(i)</enum><text>methane and other greenhouse gases emitted across the coal supply chain within the United States during the preceding calendar year,</text>
 </clause><clause commented="no" id="H07C9E48FCB0A4A6A9E4C39BBD06EF4EC"><enum>(ii)</enum><text>methane and other greenhouse gases emitted across the petroleum products supply chain within the United States during the preceding calendar year, and</text>
 </clause><clause commented="no" id="HAF092BEFD01D46A382FD090CAF18AAC3"><enum>(iii)</enum><text>methane and other greenhouse gases emitted across the natural gas supply chain within the United States during the preceding calendar year.</text>
											</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HCABE3A12E98D4DFCB29F14D9C7B18A7D"><enum>(b)</enum><header>Supplementary fee for associated emissions</header>
 <paragraph commented="no" id="H45E6808D7AD3419B8BDD02A21FBAED82"><enum>(1)</enum><header>Coal</header><text>In the case of any calendar year beginning after 2021, the fee imposed under section 4691(a)(1) with respect to coal shall be increased by the amount determined by the Secretary (in consultation with the Administrator of the Environmental Protection Agency) necessary to ensure that the total fees collected under such section with respect to coal are equal to the total amount of such fees that would be collected on coal if the fee imposed under section 4691(a)(1) also applied to the carbon-dioxide equivalent of greenhouse gas emissions reported under subsection (a)(2)(B)(i).</text>
 </paragraph><paragraph commented="no" id="HD200C036A59E47858F8A4B6F87EF3ECD"><enum>(2)</enum><header>Petroleum products</header><text>In the case of any calendar year beginning after 2021, the fee imposed under section 4691(a)(1) with respect to petroleum products shall be increased by the amount determined by the Secretary (in consultation with the Administrator of the Environmental Protection Agency) necessary to ensure that the total fees collected under such section with respect to petroleum products are equal to the total amount of such fees that would be collected on petroleum products if the fee imposed under section 4691(a)(1) also applied to the carbon-dioxide equivalent of greenhouse gas emissions reported under subsection (a)(2)(B)(ii).</text>
 </paragraph><paragraph commented="no" id="H17A01CA4EFD04C4894DFE393839BB81A"><enum>(3)</enum><header>Natural gas</header><text>In the case of any calendar year beginning after 2021, the fee imposed under section 4691(a)(1) with respect to natural gas shall be increased by the amount determined by the Secretary (in consultation with the Administrator of the Environmental Protection Agency) necessary to ensure that the total fees collected under such section with respect to natural gas are equal to the total amount of such fees that would be collected on natural gas if the fee imposed under section 4691(a)(1) also applied to the carbon-dioxide equivalent of greenhouse gas emissions reported under subsection (a)(2)(B)(iii).</text>
									</paragraph></subsection></section><section commented="no" id="HE2E63F3A9B9947689AE24F5F4E7B73BE"><enum>4695.</enum><header>Border adjustments for energy-intensive manufactured goods</header>
 <subsection commented="no" id="H97E45B21E2A94299A16E8A50D10B2132"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to ensure the environmental effectiveness of this subchapter.</text> </subsection><subsection commented="no" id="HF72AD1B12ED448A6B6DE8F7AA314B643"><enum>(b)</enum><header>Exports</header> <paragraph commented="no" id="H88099194223941A5B34883B96DCFB703"><enum>(1)</enum><header>In general</header><text>In the case of any energy-intensive manufactured good which is exported from the United States, the Secretary shall pay to the person exporting such good a refund equal to the amount of the cost of such good attributable to any fees imposed under this subchapter on inputs used in the manufacturing of such energy-intensive manufactured good (as determined under regulations established by the Secretary).</text>
 </paragraph><paragraph commented="no" id="H7432C852CF144105AF0AE129FBD4D6B5"><enum>(2)</enum><header>Reduction in refund</header><text>The amount of the refund under paragraph (1) shall be reduced by the amount, if any, of fees imposed on such goods or comparable domestically produced energy-intensive manufactured goods by the foreign nation or governmental unit to which such good is exported.</text>
									</paragraph></subsection><subsection id="HF06D49D11A014FAE83A41B2D763C12FF"><enum>(c)</enum><header>Imports</header>
 <paragraph commented="no" id="H47AE0F82D3EA48E8AE821D1A120BCCD7"><enum>(1)</enum><header>Imposition of equivalency fee</header><text display-inline="yes-display-inline">In the case of any energy-intensive manufactured good imported into the United States, there is imposed an equivalency fee on the person importing such good in an amount equal to the cost of such good which would be attributable to any fees imposed under this subchapter on inputs used in the manufacturing of such good if the inputs used in manufacturing such good were subject to such fees (as determined under regulations established by the Secretary).</text>
 </paragraph><paragraph commented="no" id="HE572FEE4D81D4D5382ADC42EC55F08CC"><enum>(2)</enum><header>Reduction in fee</header><text display-inline="yes-display-inline">The amount of the equivalency fee under paragraph (1) shall be reduced by the amount, if any, of any fees imposed on such energy-intensive manufactured goods by the foreign nation or governmental units from which such good was imported.</text>
 </paragraph></subsection><subsection commented="no" id="HC1F1D31EA4754630A8AEEE6C22C54EC0"><enum>(d)</enum><header>Treatment of alternative policies as fees</header><text>Under regulations established by the Secretary, foreign policies that have substantially the same effect in reducing emissions of greenhouse gases as fees shall be treated as fees for purposes of subsections (b)(2) and (c)(2).</text>
								</subsection><subsection id="HE4FCF548654344D79CC94B459E31F7F8"><enum>(e)</enum><header>Regulatory authority</header>
 <paragraph id="H5013F2BFD0AF4FF5862E71E40A6A1A34"><enum>(1)</enum><header>In general</header><text>The Secretary shall consult with the Administrator of the Environmental Protection Agency and the Secretary of Energy in establishing rules and regulations implementing the purposes of this section.</text>
 </paragraph><paragraph id="H301588DCBB0C413BB90B0F8CFE184F85"><enum>(2)</enum><header>Treaties</header><text>The Secretary, in consultation with the Secretary of State, may adjust the applicable amounts of the refunds and equivalency fees under this section in a manner that is consistent with any obligations of the United States under an international agreement.</text>
									</paragraph></subsection></section><section id="H11A604C35C9B4C0CB516C78EBBBB5D7B"><enum>4696.</enum><header>Definitions and other rules</header>
 <subsection id="H74A16967E51E4FDAA9ED672720255CAB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subchapter:</text> <paragraph id="HDFEE7FAECB6A4D02B556D1484829F2E7"><enum>(1)</enum><header>Carbon dioxide equivalent</header><text>The term <term>carbon dioxide equivalent</term> means, with respect to a greenhouse gas, the quantity of such gas that has a global warming potential equivalent to 1 metric ton of carbon dioxide, as determined pursuant to table A–1 of subpart A of part 98 of title 40, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>.</text>
 </paragraph><paragraph commented="no" id="H73B4D09DB06541D2A205138FC45D925C"><enum>(2)</enum><header>Greenhouse gas</header><text>The term <term>greenhouse gas</term> has the meaning given such term under section 211(o)(1)(G) of the Clean Air Act, as in effect on the date of the enactment of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>.</text>
 </paragraph><paragraph commented="no" id="H70C960A66026418FBDE4BF6DDF94FE49"><enum>(3)</enum><header>Coal</header><text>The term <term>coal</term> has the same meaning given such term under section 48A(c)(4).</text> </paragraph><paragraph commented="no" id="H47A86C0F9F9C43FBAFDE8F7B19886493"><enum>(4)</enum><header>Petroleum product</header><text>The term <term>petroleum product</term> has the same meaning given such product under section 4612(a)(3).</text>
 </paragraph><paragraph id="HC1B3D1274AC24B159FC37C95E7610D07"><enum>(5)</enum><header>Associated emissions</header><text>The term <quote>associated emissions</quote> means greenhouse gas emissions attributable to venting, flaring, and leakage across the supply chain.</text>
 </paragraph><paragraph id="H951C6CEE4B7A448E90D4C4EFD5EFE54D"><enum>(6)</enum><header>Supply chain</header><text>The term <quote>supply chain</quote> means extraction and processing of coal and natural gas, extraction and refining of petroleum products, and the transmission, transport, storage, distribution, import, export, and other activities related to supplying coal, petroleum products, and natural gas to a consumer, not otherwise covered elsewhere in this subchapter as determined by the Administrator of the Environmental Protection Agency.</text>
									</paragraph><paragraph commented="no" id="H8C71117179DB4FA7B35497946C3D0BFD"><enum>(7)</enum><header>Energy-intensive manufactured good</header>
 <subparagraph commented="no" id="HEE2EF38D898A4BE19A1B3C5D53CC0574"><enum>(A)</enum><header>In general</header><text>The term <term>energy-intensive manufactured good</term> means any manufactured good (other than any petroleum product or fossil fuel) for which not less than 5 percent of the cost of which is attributable to energy costs, as determined by the Secretary.</text>
										</subparagraph><subparagraph commented="no" id="H65344AA19BA74038BA8817D4F82FC221"><enum>(B)</enum><header>List of energy-intensive manufactured goods</header>
 <clause commented="no" id="HC5081E34693643AF8A1E12F3B5E03364"><enum>(i)</enum><header>Initial list</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall publish a list of goods which qualify as energy-intensive manufactured goods.</text>
 </clause><clause commented="no" id="H65BD378B2817469F8641C9146CAF941C"><enum>(ii)</enum><header>Updates</header><text>Not less frequently than annually, the Secretary shall update the list published under this subparagraph.</text>
											</clause></subparagraph></paragraph><paragraph id="H4ACCD962A66341E987207137ED2D534F"><enum>(8)</enum><header>Ton</header>
 <subparagraph id="HA3CCB8DAA58E4C7E86439560FDE449B1"><enum>(A)</enum><header>In general</header><text>The term <term>ton</term> means 1,000 kilograms. In the case of any greenhouse gas which is a gas, the term <term>ton</term> means the amount of such gas in cubic meters which is the equivalent of 1,000 kilograms on a molecular weight basis.</text>
 </subparagraph><subparagraph id="HA4C4157BB86A43548C35B28AFD3A80D4"><enum>(B)</enum><header>Fractional part of ton</header><text>In the case of a fraction of a ton, any fee imposed by this subchapter on such fraction shall be the same fraction of the amount of such fee imposed on a whole ton.</text>
 </subparagraph></paragraph><paragraph id="H2A0130440788472DA3F1FDE1A7B06402"><enum>(9)</enum><header>United States</header><text>The term <term>United States</term> has the meaning given such term by section 4612(a)(4).</text> </paragraph></subsection><subsection id="H4C0E27E1C5CD4CD9A2102611E2BB8C96"><enum>(b)</enum><header>Other rules</header> <paragraph commented="no" display-inline="no-display-inline" id="H00ACD1BB99844AFEB80F45F11E2F4022"><enum>(1)</enum><header display-inline="yes-display-inline">Assessment and collection</header><text display-inline="yes-display-inline">Payment of the fee imposed by sections 4691, 4692, and 4693 shall be assessed and collected in the same manner as taxes under this subtitle.</text>
 </paragraph><paragraph id="H42E61A0F87DC484B8303D9A0E7B6722E"><enum>(2)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations as may be necessary to carry out the provisions of this subchapter.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA65BEA2978094F66AEE145961A52B301"><enum>(b)</enum><header>Clerical amendment</header><text>The table of subchapters for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/38">chapter 38</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text>

 </subsection><subsection id="H8047AA448B3447B09A165B2390556495"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2018.</text> </subsection></section></title><title id="H5B8493F57EF44A7CA4DE2DAA36B3F5BA" style="OLC"><enum>II</enum><header>Returning fee revenue to the American people</header> <section id="HB80B3145DF7F4817972380A7978BFA52"><enum>201.</enum><header>Establishment of refundable credit for workers</header> <subsection id="H3D050AD9DFB64005903142B0C69B293B"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 36 the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H4CE19DE85DBE4E7DA2A81DB948065454" style="OLC">
						<section id="H890D5F533AB8469BA311F90758A947A0"><enum>36A.</enum><header>Carbon fee offset credit</header>
 <subsection id="HBF3A4B01310F4A2F964143D98B2FCDB6"><enum>(a)</enum><header>In general</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to the lesser of—</text>
 <paragraph id="H1ED81EF2D8F84EF2AC1416629E2F95BD"><enum>(1)</enum><text>6.2 percent of the earned income of the taxpayer, or</text> </paragraph><paragraph id="H5F17A4F7B0CD49EEB4F852D29C9F9872"><enum>(2)</enum><text>$800 (twice such amount in the case of a joint return).</text>
 </paragraph></subsection><subsection id="HA6FFF06C8FA647E8A281C18262680B53"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of this section, the term <term>eligible individual</term> means any individual other than—</text> <paragraph id="H59ABC1170DC8475E8741799024292574"><enum>(1)</enum><text>any nonresident alien individual,</text>
 </paragraph><paragraph id="H3F307E51B65E4FF1AA13DEB197A8F2D6"><enum>(2)</enum><text>any individual with respect to whom a deduction under section 151 is allowable to another taxpayer for a taxable year beginning in the calendar year in which the individual's taxable year begins, and</text>
 </paragraph><paragraph id="H193C3C3B72F6449D8DBDE9D133819270"><enum>(3)</enum><text>any individual who, for the month of December of the taxable year, was entitled to or eligible for a benefit payment described in paragraph (1) or (2) of section 202(b) of the <short-title>American Opportunity Carbon Fee Act of 2018</short-title>.</text>
								</paragraph></subsection><subsection commented="no" id="H9920AD010BF64CA0ACA8B09FE606564E"><enum>(c)</enum><header>Earned income</header>
 <paragraph commented="no" id="H49B1ACBB6FA64083BBDA11A4904D5AC7"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the term <term>earned income</term> has the meaning given such term by section 32(c)(2), except that such term shall not include net earnings from self-employment which are not taken into account in computing taxable income.</text>
 </paragraph><paragraph commented="no" id="HE0332D6590504DEB93598C3ABD9333DD"><enum>(2)</enum><header>Certain combat zone compensation</header><text>For purposes of paragraph (1), any amount excluded from gross income by reason of section 112 shall be treated as earned income which is taken into account in computing taxable income for the taxable year.</text>
								</paragraph></subsection><subsection commented="no" id="H44C7C4CA740C40EC93306FAA85D4D921"><enum>(d)</enum><header>Inflation adjustment</header>
 <paragraph id="H60C098C08E5545659921E00C6AEA3B57"><enum>(1)</enum><header>In general</header><text>In the case of a taxable year beginning after 2019, the $800 amount in subsection (a)(2) shall be increased by an amount equal to—</text>
 <subparagraph id="H543F1B917F484887BAE812CA928DAAA0"><enum>(A)</enum><text>such dollar amount, multiplied by</text> </subparagraph><subparagraph commented="no" id="HF78534B4AC844B8C8FF65F393EDFB003"><enum>(B)</enum><text>the percentage (if any) by which—</text>
 <clause commented="no" id="HC0C51ACD4FB042A2BAA2813F973A1C9C"><enum>(i)</enum><text>the CPI for the preceding calendar year, exceeds</text> </clause><clause commented="no" id="H49F3CC48E203476EB6F78CA19BB5B343"><enum>(ii)</enum><text>the CPI for calendar year 2018.</text>
 </clause></subparagraph></paragraph><paragraph id="H13894047C6FE4D4989B45B29900E7C1E"><enum>(2)</enum><header>CPI</header><text>Rules similar to the rules of paragraphs (4) and (5) of section 1(f) shall apply for purposes of this subsection.</text>
 </paragraph><paragraph id="H3E2FFE9206774689B12C31E6B3E650AE"><enum>(3)</enum><header>Rounding</header><text>If any dollar amount, after being increased under paragraph (1), is not a multiple of $10, such dollar amount shall be rounded to the next lowest multiple of $10.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HE36EF384E31540E0B42BB3B04AB65F96"><enum>(b)</enum><header>Refunds disregarded in the administration of Federal programs and federally assisted programs</header><text>Any credit or refund allowed or made to any individual by reason of <external-xref legal-doc="usc" parsable-cite="usc/26/36A">section 36A</external-xref> of the Internal Revenue Code of 1986 (as added by this section) shall not be taken into account as income and shall not be taken into account as resources for purposes of determining the eligibility of such individual or any other individual for benefits or assistance, or the amount or extent of benefits or assistance, under any Federal program or under any State or local program financed in whole or in part with Federal funds.</text>
				</subsection><subsection id="HC45B9BA27D4B46C98DADAE3927AE6EFD"><enum>(c)</enum><header>Conforming amendments</header>
 <paragraph id="HFC6B7A6E15C34F95AA2E25A0935BDD21"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/6211">Section 6211(b)(4)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>36A,</quote> after <quote>36,</quote>.</text> </paragraph><paragraph id="H03C4DD5F6D5C415B887DE78E081819DD"><enum>(2)</enum><text>The table of sections for subpart C of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 36 the following new item:</text>

								<toc-entry level="section">Sec. 36A. Carbon fee offset credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HFDAA935472BC4526B55CCCC5AE66B3F0"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2018.</text> </subsection></section><section id="H8216EC2F96DF4B768996D67FC6B8FE3C"><enum>202.</enum><header>Establishment of payments to Social Security beneficiaries and other retired and disabled Americans</header> <subsection id="H19F5E6687E504112A97C11844223175D"><enum>(a)</enum><header>Authority To make payments</header><text>The Secretary of the Treasury or the Secretary of the Treasury's delegate (referred to in this section as the <term>Secretary</term>) shall, during the period between April 1 and May 15 of calendar year 2020 and each year thereafter, disburse a payment to each eligible beneficiary in an amount equal to the amount in effect for taxable years beginning in the preceding calendar year under <external-xref legal-doc="usc" parsable-cite="usc/26/36A">section 36A(a)(2)</external-xref> of the Internal Revenue Code of 1986.</text>
 </subsection><subsection id="HB20CCC6C0D314B90B1EF8274F700C208"><enum>(b)</enum><header>Eligible beneficiary</header><text>For purposes of this section, the term <term>eligible beneficiary</term> means an individual who, for the month of December of the preceding year, was—</text> <paragraph id="H70687CB96EA54CD7A8D12BA61007D106"><enum>(1)</enum><text>entitled to any benefit payment described in subparagraph (B) of section 2201(a)(1) of the American Recovery and Reinvestment Act of 2009; or</text>
 </paragraph><paragraph id="H1E36F219F52A44969142BF1F9D162D24"><enum>(2)</enum><text>eligible for a benefit payment described in subparagraph (C) of such section.</text> </paragraph></subsection><subsection id="H5BFD3BCFE61A4CC987D542A91BE2F447"><enum>(c)</enum><header>Residency requirement</header><text>A payment may be made under this section only to an eligible beneficiary who resides in any State (as defined in section 204(f)), as determined based on the current address of record for such beneficiary under the applicable program for payment of benefits described in subsection (b).</text>
 </subsection><subsection id="H9295D15771B54626B12F1A1D93792BA9"><enum>(d)</enum><header>No double payments</header><text>An eligible beneficiary may not receive more than 1 payment per calendar year under this section, regardless of whether such beneficiary is entitled to or eligible for more than 1 benefit payment described in paragraph (1) or (2) of subsection (b).</text>
 </subsection><subsection id="H40572F1007844E8CA83C9DCF6AEAB890"><enum>(e)</enum><header>Identification of recipients</header><text>The Commissioner of Social Security, the Railroad Retirement Board, and the Secretary of Veterans Affairs shall certify the eligible beneficiaries entitled to receive payments under this section and provide the Secretary with any information necessary to disburse such payments.</text>
 </subsection><subsection id="HD2AE4A25894544FC8D0EDDAC4AB981E5"><enum>(f)</enum><header>Application of additional rules</header><text>Rules similar to the rules of subsections (a)(4), (c), and (d) of section 2201 of the American Recovery and Reinvestment Act of 2009 shall apply for purposes of payments under this section.</text>
				</subsection></section><section id="H4845E853D08E47B0B94B32FB7CC8BF39"><enum>203.</enum><header>State-based cost mitigation grant program</header>
 <subsection id="H130BC8774EFC4E8594E4B10F4E60E4E9"><enum>(a)</enum><header>In general</header><text>The Secretary of the Treasury shall provide to each State which meets the requirements of subsection (d) a cost mitigation grant for each calendar year after 2018 in an amount determined under subsection (c).</text>
 </subsection><subsection id="H3FE6341CDD514A8E877D5F797D189946"><enum>(b)</enum><header>Use of funds</header><text>A State receiving a cost mitigation grant under this section may use the grant only—</text> <paragraph id="H76C66EDEFCE34026ADC1DF2700D3F1C7"><enum>(1)</enum><text>to assist low-income households in reducing energy expenses and meeting cost increases attributable to the fees imposed under subchapter E of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/38">chapter 38</external-xref> of the Internal Revenue Code of 1986 (as added by this Act);</text>
 </paragraph><paragraph id="H319B4AAC986C4CEFB41AD0DCE241EC30"><enum>(2)</enum><text>to assist rural households in reducing energy expenses and meeting such increases attributable to such fees; and</text>
 </paragraph><paragraph id="H6B970018DA8F44D59B72E95114A795D8"><enum>(3)</enum><text>to provide job training and worker transition assistance, with priority given to workers and former workers in fossil-fuel related industries.</text>
					</paragraph></subsection><subsection id="HC8925B0B95514083B124AB30D8896074"><enum>(c)</enum><header>Amount of grant</header>
 <paragraph id="H81F21F1C71D140E3ADCDFDF7FBA23CAD"><enum>(1)</enum><header>In general</header><text>The amount of the cost mitigation grant made to any State for any calendar year shall be equal to the product of—</text>
 <subparagraph id="HD4507990A5E14DBBBB547E56E1A966FC"><enum>(A)</enum><text>the annual grant limitation determined under paragraph (3) for such calendar year; and</text> </subparagraph><subparagraph id="H3D609EFA757C4A24A687E84F0C28F8BB"><enum>(B)</enum><text>the State allocation percentage for the State (determined under paragraph (2)).</text>
 </subparagraph></paragraph><paragraph id="HDD2B1ED9D8674B9980ADB708D563D6F1"><enum>(2)</enum><header>State allocation percentage</header><text>The <term>State allocation percentage</term> for a State is the amount (expressed as a percentage) equal to the quotient of—</text> <subparagraph id="H7098772071E14B65830CBCE2E56662A6"><enum>(A)</enum><text>the population of such State (as reported in the most recent decennial census); and</text>
 </subparagraph><subparagraph id="H691D15A08A0E431B9086C728B43D7791"><enum>(B)</enum><text>the population of all States (as reported in the most recent decennial census).</text> </subparagraph></paragraph><paragraph id="HFC06E99B487D4D8BB076EE60799F3AB6"><enum>(3)</enum><header>Annual appropriation for grants</header> <subparagraph id="H74D4C9DF2F664F028ACA74AFDFC42D7B"><enum>(A)</enum><header>In general</header><text>The annual grant limitation is $10,000,000,000.</text>
						</subparagraph><subparagraph id="H1329B39873B84C08B23980EC743D7401"><enum>(B)</enum><header>Inflation adjustment</header>
 <clause id="H3B5CAD0E37BE455DAE7BB4AC2A8B35B6"><enum>(i)</enum><header>In general</header><text>In the case of any calendar year after 2019, the $10,000,000,000 amount in subparagraph (A) shall be increased by an amount equal to—</text>
 <subclause id="H9CD034E9988E4E5992ABAE0B567AFC63"><enum>(I)</enum><text>such dollar amount; multiplied by</text> </subclause><subclause commented="no" id="H56FBB9784CE141149A0D4E3CC11D241E"><enum>(II)</enum><text>the percentage (if any) by which—</text>
 <item commented="no" id="HFDC527E8D67C4225B6202F4E084754B2"><enum>(aa)</enum><text>the CPI for the preceding calendar year; exceeds</text> </item><item commented="no" id="H8B0E57BCF3494E3A8E0ED0282295AAC2"><enum>(bb)</enum><text>the CPI for calendar year 2018.</text>
 </item></subclause></clause><clause id="H09EB16381D6F413887F95B99D1ADFA75"><enum>(ii)</enum><header>CPI</header><text>Rules similar to the rules of paragraphs (4) and (5) of <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1(f)</external-xref> of the Internal Revenue Code of 1986 shall apply for purposes of this subparagraph.</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="HA5F8C62FD12C44E191B6887108DD9D16"><enum>(4)</enum><header>Redistribution</header><text>In any case in which one or more States do not meet the requirements described in subsection (d) for a calendar year, an amount equal to the State allocation percentage for such State or States shall be distributed to each State which did meet such conditions in an amount equal to the product of—</text>
 <subparagraph commented="no" id="HAC26ED384EE84F19BF9B05614E4EE25C"><enum>(A)</enum><text>such amount; and</text> </subparagraph><subparagraph commented="no" id="HC0AFD8BE881E4C31B4F13C5C0C1ECBAE"><enum>(B)</enum><text>the State allocation percentage of such State (determined by not taking into account under paragraph (2)(B) the population of any State which did not meet the requirements of subsection (d) for such calendar year).</text>
						</subparagraph></paragraph></subsection><subsection id="H8B7BE3056ACE441A8D25A76C7AC8467D"><enum>(d)</enum><header>Requirements for receipt of grant</header>
 <paragraph id="HE3EEC32A6805459B9EAF9CC50A92D08A"><enum>(1)</enum><header>In general</header><text>A State is eligible to receive a cost mitigation grant for any calendar year if—</text> <subparagraph id="H188C8631E0DA4FD9AA6547DC8AEC6AD5"><enum>(A)</enum><text>the chief executive officer of the State certifies that the State will use such grant as needed to deliver benefits to all eligible low-income individuals through a household rebate program;</text>
 </subparagraph><subparagraph id="H24B10E2C76E247D4A54C1711CC5EF3C9"><enum>(B)</enum><text>the State has filed with the Secretary of the Treasury a State plan covering the calendar year which details the use of the funds received under the grant;</text>
 </subparagraph><subparagraph id="H9EA3EA9BE9EC49719654BF50271A3763"><enum>(C)</enum><text>the State agrees to comply with any audit requirements under subsection (d); and</text> </subparagraph><subparagraph id="HB81276AA1D8641ED937BD4D3E4A8059F"><enum>(D)</enum><text>the State has complied with the requirements of this section for all preceding years or the State has remedied all prior noncompliance to the satisfaction of the Secretary of the Treasury.</text>
 </subparagraph></paragraph><paragraph id="HA852865A0D004BC383629CA79BF2558C"><enum>(2)</enum><header>Household rebate program</header><text>For purposes of paragraph (1)(A)—</text> <subparagraph id="HEE632F83CA5940D8AB3269F7A254E4B2"><enum>(A)</enum><header>In general</header><text>The term <term>household rebate program</term> means a program for delivering to monthly benefits in an aggregate annual amount equal to the applicable amount to all eligible low-income individuals through a State-administered electronic benefit transfer system.</text>
 </subparagraph><subparagraph id="HB877DA8E0B57416A9F7636AD0368EE52"><enum>(B)</enum><header>Applicable amount</header><text>The term <term>applicable amount</term> means, with respect to any eligible low-income individual for any calendar year, an amount equal to the excess of—</text>
 <clause id="HD53C1272EAE34DCA96D7457022A1B56F"><enum>(i)</enum><text>the amount in effect for taxable years ending with or within the preceding calendar year under <external-xref legal-doc="usc" parsable-cite="usc/26/36A">section 36A(a)(2)</external-xref> of the Internal Revenue Code of 1986; over</text>
 </clause><clause id="H6608CF20160C41C39DE8F1A98966C6F6"><enum>(ii)</enum><text>any amount allowed or claimed as a credit by such individual under such section for the taxable year ending with or within the preceding calendar year.</text>
 </clause></subparagraph><subparagraph id="H3077B7F913F145D5A11BB89111F8ED78"><enum>(C)</enum><header>Eligible low-income individual</header><text>The term <term>eligible low-income individual</term> means, with respect to any calendar year, any individual who—</text> <clause id="H31AD5EC0350242309BAA647A6658D57E"><enum>(i)</enum><text>has attained the age of 18 before the end of the calendar year;</text>
 </clause><clause id="H6D178203F6914CEEA67DFCF16D55F14D"><enum>(ii)</enum><text>lives in a household that has a gross income that does not exceed 150 percent of the poverty line as defined by section 673(2) of the Community Services Block Grant Act;</text>
 </clause><clause id="HC3C1B36C72934A7BA7DE7D6A0EA26526"><enum>(iii)</enum><text>participates in a federally funded State administered assistance program or otherwise applies for such benefits under such a program; and</text>
 </clause><clause id="H192D97EB2FA74DEAA6966B79FA4835C2"><enum>(iv)</enum><text>for the month of December of the preceding calendar year, was not entitled to or eligible for a benefit payment described in section 202(b).</text>
 </clause></subparagraph><subparagraph id="H4A87A97C18374F0DB672F1FE5A0B972F"><enum>(D)</enum><header>Coordination rules</header><text>The Secretary of the Treasury shall coordinate with the States and other applicable Federal agencies to identify eligible low-income individuals.</text>
 </subparagraph></paragraph></subsection><subsection id="HECC9613739AD4556AF3CF71A229AA83E"><enum>(e)</enum><header>Audits</header><text>The Secretary of the Treasury shall audit the State use of grants under this section to ensure such uses comply with the requirements of this section and with the uses identified by the State under subsection (d)(1)(B). The Secretary may withhold a grant under this section if the Secretary determines that a State has not complied with such requirements.</text>
 </subsection><subsection id="H528EB2F04EC44EC79D660458E58B9442"><enum>(f)</enum><header>State</header><text>For purposes of this section, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text>
 </subsection><subsection id="H43A3195ABDCB4C2298E689B53471341B"><enum>(g)</enum><header>Appropriations</header><text>For any fiscal year, there is hereby appropriated an amount equal to the annual grant limitation determined under subsection (c)(3) for the calendar year in which such fiscal year begins.</text>
				</subsection></section></title><title id="HE8D6BF2136BA4899BC6C77BA3C714A8C" style="OLC"><enum>III</enum><header>Other provisions</header>
			<section commented="no" id="HF5F33CCF688D4EA9ABDA74D1488C0AEC"><enum>301.</enum><header>Public disclosure of revenues and expenditures</header>
 <subsection commented="no" id="H76EF23FA10274B469BCAB9F6F103D8E2"><enum>(a)</enum><header>Establishment of website</header><text>The Secretary of the Treasury, or the Secretary's designee, shall establish a website for purposes of making the disclosures described in subsection (b).</text>
 </subsection><subsection commented="no" id="H83E84873223E431EA788483367ED2AFF"><enum>(b)</enum><header>Disclosures</header><text>The Secretary shall make publicly available, on an ongoing basis and as frequently as possible, the following information:</text>
 <paragraph commented="no" id="H9B9C356E37154427836AFDAC4FD74D8F"><enum>(1)</enum><text>The amount and sources of revenue attributable to this Act and the amendments made by this Act.</text> </paragraph><paragraph commented="no" id="HFF0CAAEE81E84416B4B989203754E4E5"><enum>(2)</enum><text>The amount of tax savings and benefits received as a result of title II of this Act.</text>
 </paragraph></subsection></section><section id="H64D8279721554829B0B836936F26E566"><enum>302.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or amendment made by this Act, or the application of a provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act and amendments made by this Act, and the application of the provisions and amendment to any person or circumstance, shall not be affected by the holding.</text>
