 <subsection id="H52706AB6BE46456EA34085AAFF3433EF"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Congressional Accountability Act of 1995 Reform Act</short-title></quote>.</text> </subsection><subsection id="H240053848254432294FD514DD1BC414A"><enum>(b)</enum><header>References in Act</header><text display-inline="yes-display-inline">Except as otherwise expressly provided, whenever in this Act an amendment is expressed in terms of an amendment to or repeal of a section or other provision, the reference shall be considered to be made to that section or other provision of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref> et seq.).</text>

						<quoted-block display-inline="no-display-inline" id="HBDC8FA30D7F54450875FBBF9BB81884F" style="OLC">
							<section id="H4D6B5B8903B44EC6B3FE6175D0A7C9D5"><enum>401.</enum><header>Procedure for consideration of alleged violations</header>
 <subsection id="H589C88600EB34F72863EE8A39A0A2E71"><enum>(a)</enum><header>Filing and investigation of claims</header><text display-inline="yes-display-inline">Except as otherwise provided, the procedure for consideration of an alleged violation of part A of title II consists of—</text>
 <paragraph id="HF4E2B4427BC9475182A8DE7FD6D0DDE2"><enum>(1)</enum><text>the filing of a claim by the covered employee alleging the violation, as provided in section 402;</text> </paragraph><paragraph id="HF395EDFFA28B4A1388ED46F95CEE5483"><enum>(2)</enum><text>an investigation of the claim, to be conducted by the General Counsel as provided in section 403; and</text>
 </paragraph><paragraph id="H49083B045C8E49FCACC6EF7754795074"><enum>(3)</enum><text display-inline="yes-display-inline">a formal hearing as provided in section 405, subject to Board review as provided in section 406, and judicial review in the United States Court of Appeals for the Federal Circuit as provided in section 407, but only if, pursuant to an investigation conducted by the General Counsel as provided in section 403, the General Counsel finds either—</text>
 <subparagraph id="H57E54284F40148AD8157A870872C9E3E"><enum>(A)</enum><text>that there is reasonable cause to believe that the employing office involved committed a violation of part A of title II as alleged in the covered employee’s claim; or</text>
 </subparagraph><subparagraph id="H4709087E94644147AA802785215EA158"><enum>(B)</enum><text>that the General Counsel cannot determine whether or not there is reasonable cause to believe that the employing office committed a violation of part A of title II as alleged in the covered employee’s claim.</text>
										</subparagraph></paragraph></subsection><subsection id="HF7787BBF7E114157AD93F8E3294AF1EC"><enum>(b)</enum><header>Right of employee To file civil action</header>
 <paragraph id="HB5BF9534EC8244B691B141AD762387E0"><enum>(1)</enum><header>Civil action</header><text display-inline="yes-display-inline">A covered employee who files a claim as provided in section 402 may, during the period described in paragraph (3), file a civil action in a District Court of the United States with respect to the alleged violation involved, as provided in section 408.</text>
 </paragraph><paragraph id="HBD441A86AEF7458B9E607D796C2ED578"><enum>(2)</enum><header>Effect of filing civil action</header><text>Notwithstanding paragraph (2) or paragraph (3) of subsection (a), if the covered employee files such a civil action—</text>
 <subparagraph id="H1268CF04AE684277B808A28B66C06C26"><enum>(A)</enum><text>the investigation of the claim by the General Counsel as provided in section 403, or any subsequent formal hearing as provided in section 405, shall terminate upon the filing of the action by the covered employee; and</text>
 </subparagraph><subparagraph id="HD87D3EB2427C4205BB09D3FE28EFF30E"><enum>(B)</enum><text>the procedure for consideration of the alleged violation shall not include any further investigation of the claim by the General Counsel as provided in section 403 or any subsequent formal hearing as provided in section 405.</text>
 </subparagraph></paragraph><paragraph id="HC0E031B439B04A56A6B309A98C6BB161"><enum>(3)</enum><header>Period for filing civil action</header><text display-inline="yes-display-inline">The period described in this paragraph with respect to a claim is the 45-day period which begins on the date the covered employee files the claim under section 402.</text>
									</paragraph><paragraph id="HC188F32B269242BAB3B0A3F3B0FB106B"><enum>(4)</enum><header>Special rule for employees receiving finding of no reasonable cause under investigation by General
 Counsel</header><text>Notwithstanding paragraph (3), if a covered employee receives a written notice from the General Counsel under section 403(c)(3) that the employee has the right to file a civil action with respect to the claim in accordance with section 408, the covered employee may file the civil action not later than 90 days after receiving such written notice.</text>
 </paragraph></subsection><subsection id="H0975CC508800497FAABC1C0AAB604EEF"><enum>(c)</enum><header>Special rule for Architect of the Capitol and Capitol Police</header><text display-inline="yes-display-inline">In the case of an employee of the Office of the Architect of the Capitol or of the Capitol Police, the Office, after receiving a claim filed under section 402, may recommend that the employee use the grievance procedures of the Architect of the Capitol or the Capitol Police for resolution of the employee’s grievance for a specific period of time.</text>
 </subsection><subsection id="H87451B0CFF424AD8B751074AE05E6882"><enum>(d)</enum><header>Rights of parties To retain private counsel</header><text>Nothing in this title may be construed to limit the authority of any individual, including a covered employee, the head of an employing office, or an individual who is alleged to have personally committed an act which consists of a violation of part A of title II to retain counsel to protect the interests of the individual at any point during any of the procedures provided under this title for the consideration of an alleged violation of part A of title II, including as provided under section 415(d)(7) with respect to Members of the House of Representatives and Senators.</text>
 </subsection><subsection id="H65395CCAE64E4944ACCCDE0A22D0F427"><enum>(e)</enum><header>Standards for counsel providing representation</header><text>Any counsel who represents a party in any of the procedures provided under this title shall have an obligation to ensure that, to the best of the counsel’s knowledge, information, and belief, as formed after an inquiry which is reasonable under the circumstances, each of the following is correct:</text>
 <paragraph id="HB9DFB774E4624B949A0D2B11AF32D0F4"><enum>(1)</enum><text display-inline="yes-display-inline">No pleading, written motion, or other paper is presented for any improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of resolution of the matter.</text>
 </paragraph><paragraph id="H2E2B0D706B0D4BA397E978A9B2BFFD1E"><enum>(2)</enum><text>The claims, defenses, and other legal contentions the counsel advocates are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law.</text>
 </paragraph><paragraph id="H7197E56273434BE582178A5B1EF7B38B"><enum>(3)</enum><text>The factual contentions have evidentiary support or, if specifically so identified, will likely have evidentiary support after a reasonable opportunity for further investigation or discovery.</text>
 </paragraph><paragraph id="H564E2B71EEA64BD29A9332AAA340B448"><enum>(4)</enum><text>The denials of factual contentions are warranted on the evidence or, if specifically so identified, are reasonably based on belief or a lack of information.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC6121369BF3548E0B5C0CD0E4B55D0F4"><enum>(b)</enum><header>Conforming amendment relating to civil action</header><text>Section 408 (<external-xref legal-doc="usc" parsable-cite="usc/2/1408">2 U.S.C. 1408</external-xref>) is amended—</text> <paragraph id="H06E5D1BCFE5641F999C431CDFE8185F1"><enum>(1)</enum><text>by striking <quote>section 404</quote> and inserting <quote>section 401</quote>;</text>
 </paragraph><paragraph id="H39BB9D4D8DDA484BAB3100778C86CE8F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>who has completed counseling under section 402 and mediation under section 403</quote>; and</text> </paragraph><paragraph id="HAE44B22660DB43F3B53D3FC285027426"><enum>(3)</enum><text>by striking the second sentence.</text>
 </paragraph></subsection><subsection id="HC31EFA32DDCC464A802641D83997334E"><enum>(c)</enum><header>Other conforming amendments</header><text>Title IV is amended—</text> <paragraph id="HDC44671F6AEE41F7AF36A60ED88E0DAD"><enum>(1)</enum><text>by striking section 404 (<external-xref legal-doc="usc" parsable-cite="usc/2/1404">2 U.S.C. 1404</external-xref>); and</text>
 </paragraph><paragraph id="H3AFED7A3B0944126AF5D52BEBF76A353"><enum>(2)</enum><text>by redesignating section 403 (<external-xref legal-doc="usc" parsable-cite="usc/2/1403">2 U.S.C. 1403</external-xref>) as section 404.</text> </paragraph></subsection><subsection id="H8DEB508E024440919B7C32FF424123D6"><enum>(d)</enum><header>Clerical amendments</header><text>The table of contents is amended—</text>
 <paragraph id="H4E18017F2E234883BAE8807D1A948B75"><enum>(1)</enum><text>by striking the item relating to section 404; and</text> </paragraph><paragraph id="H1E24548998EF445084A173D1BFAACDE9"><enum>(2)</enum><text>by redesignating the item relating to section 403 as relating to section 404.</text>
						</paragraph></subsection></section><section id="HEBCDBABD803F49AC96BB7B09C8377875"><enum>102.</enum><header>Reform of process for initiation of procedures</header>
 <subsection id="HECC84E981D3849E799C5EA0AA5F572C7"><enum>(a)</enum><header>Initiation of procedures</header><text>Section 402 (<external-xref legal-doc="usc" parsable-cite="usc/2/1402">2 U.S.C. 1402</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H889626972EDD4E5DB1E55F22D4FAFEDE" style="OLC"> <section id="H650CC0DB5B2C48EF9137DA3530BDB20C"><enum>402.</enum><header>Initiation of procedures</header> <subsection id="HA72C07D8DB4C42179B819654B11E5286"><enum>(a)</enum><header>Intake of claim by Office</header><text display-inline="yes-display-inline">To commence a proceeding under this title, a covered employee alleging a violation of law made applicable under part A of title II shall file a claim with the Office. The claim shall be made in writing under oath or affirmation, and shall be in such form as the Office requires.</text>
								</subsection><subsection id="H591603FFEC344EE1BE51ABA306D3FE09"><enum>(b)</enum><header>Initial processing of claim</header>
 <paragraph id="HF2FC3AAA537345079AA56DE00353B2F8"><enum>(1)</enum><header>Intake and recording; notification to employing office</header><text>Upon the filing of a claim by a covered employee under subsection (a), the Office shall take such steps as may be necessary for the initial intake and recording of the claim, including providing the employee with all relevant information with respect to the rights of the employee under this title, and shall notify the head of the employing office of the claim.</text>
									</paragraph><paragraph id="HE49DD0E55A584B76AE53A87CD1CBDF9D"><enum>(2)</enum><header>Special notification requirements for claims based on acts committed personally by Members of
			 Congress</header>
 <subparagraph id="H6123CFD78E2D40E8950D50356BD56724"><enum>(A)</enum><header>In general</header><text>In the case of a claim alleging a violation described in subparagraph (B) which consists of an act committed personally by an individual who, at the time of committing the act, was a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a Senator, upon the filing of the claim under subsection (a), the Office shall notify such individual of the claim, the possibility that the individual may be required to reimburse the account described in section 415(a) for the amount of any award or settlement in connection with the claim, and the right of the individual under section 415(d)(7) to intervene in any mediation, hearing, or civil action under this title with respect to the claim.</text>
 </subparagraph><subparagraph id="H401F9853B0FA480296B54B760131FA39"><enum>(B)</enum><header>Violations described</header><text>A violation described in this subparagraph is—</text> <clause id="HCBFE5629AE5244DC8AE7D4A48351F5A1"><enum>(i)</enum><text>a violation of section 201(a); or</text>
 </clause><clause id="HE89C96D4E48B46A6B930FB9C8075F802"><enum>(ii)</enum><text>a violation of section 207 which consists of intimidating, taking reprisal against, or otherwise discriminating against any covered employee because the covered employee has opposed any practice made unlawful by section 201(a).</text>
											</clause></subparagraph></paragraph></subsection><subsection id="H1769862D69CD49899F5792A3F714A079"><enum>(c)</enum><header>Use of electronic reporting and tracking system</header>
 <paragraph id="HA963A6C4C87B4A99BAB58A170C8DA1F4"><enum>(1)</enum><header>Establishment and operation of system</header><text>The Office shall establish and operate an electronic reporting system through which a covered employee may initiate a proceeding under this title, and which will keep an electronic record of the date and time at which the proceeding is initiated and will track all subsequent actions or proceedings occurring with respect to the proceeding under this title.</text>
 </paragraph><paragraph id="H1E88CF30251B4F8D9E88E7971CB38BD3"><enum>(2)</enum><header>Accessibility to all parties</header><text>The system shall be accessible to all parties to such actions or proceedings, but only until the completion of such actions or proceedings.</text>
 </paragraph><paragraph id="HF1B471221A624294A133420F8C82A480"><enum>(3)</enum><header>Assessment of effectiveness of procedures</header><text>The Office shall use the information contained in the system to make regular assessments of the effectiveness of the procedures under this title in providing for the timely resolution of claims, and shall submit semi-annual reports on such assessments each year to the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate.</text>
 </paragraph></subsection><subsection id="HD7E0CBD7C2ED4B90B8F8CF6E7B0B53E7"><enum>(d)</enum><header>Deadline</header><text>A covered employee may not file a claim under this section with respect to an allegation of a violation of law after the expiration of the 180-day period which begins on the date of the alleged violation.</text>
 </subsection><subsection id="H7AB9A8F7CF1C499BBAA0DE664A4EBEF0"><enum>(e)</enum><header>No effect on ability of covered employee To seek information from Office or pursue relief</header><text>Nothing in this section may be construed to limit the ability of a covered employee—</text> <paragraph id="H2829A1E7316A487389B16DC7F6688886"><enum>(1)</enum><text>to contact the Office or any other appropriate office prior to filing a claim under this section to seek information regarding the employee’s rights under this Act and the procedures available under this title;</text>
 </paragraph><paragraph id="HB8CFE54165714224B0BA4A5CADEEF7F1"><enum>(2)</enum><text>in the case of a covered employee of an employing office of the House of Representatives or Senate, to refer information regarding an alleged violation of part A of title II to the Committee on Ethics of the House of Representatives or the Select Committee on Ethics of the Senate (as the case may be); or</text>
 </paragraph><paragraph id="HF4E457A91AFC4917BE0B552346F7E9BF"><enum>(3)</enum><text>to file a civil action in accordance with section 401(b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H6B62B35BD8004637823999FFB7135223"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents is amended by amending the item relating to section 402 to read as follows:</text>

 <subsection id="HC7EAF9E92AF440529631C7B1AA70691D"><enum>(a)</enum><header>Investigations described</header><text>Title IV (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401</external-xref> et seq.), as amended by section 101(b), is further amended by inserting after section 402 the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="H0E9D359C56D24864A71BB57BB0B1F0BC" style="OLC">
							<section id="HA172A4B28DAC425A95BFD574BFF79668"><enum>403.</enum><header>Investigation of claims</header>
 <subsection id="HC4C0D679F74A4D71930AD2590F495812"><enum>(a)</enum><header>Investigation</header><text display-inline="yes-display-inline">Upon the completion of the initial processing of a claim under section 402(b), the General Counsel shall conduct an investigation of the claim involved.</text>
 </subsection><subsection id="H8F5E7E3E8A344AFCAF56EA228D679F6F"><enum>(b)</enum><header>Subpoenas</header><text display-inline="yes-display-inline">To carry out an investigation under this section, the General Counsel may issue subpoenas in the same manner, and subject to the same terms and conditions, as a hearing officer may issue subpoenas to carry out discovery with respect to a hearing under section 405, except that the General Counsel may issue such a subpoena on the General Counsel’s own initiative, without regard to whether or not a party requests that the General Counsel issue the subpoena. It is the sense of Congress that the General Counsel should issue subpoenas under this subsection only to the extent that other methods of obtaining information with respect to an investigation are insufficient to enable the General Counsel to conclude the investigation within the deadline described in subsection (e).</text>
								</subsection><subsection id="H93C73335EFC34F51A596EBDDA5178286"><enum>(c)</enum><header>Report; findings</header>
 <paragraph id="H4295EB7524734AE69B3E016FD66BD73C"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Upon concluding an investigation of a claim under this section, the General Counsel shall transmit a written report on the results of the investigation to the covered employee and the employing office involved.</text>
 </paragraph><paragraph id="H8D69B814715645CA894902BE098C9CD6"><enum>(2)</enum><header>Inclusion of findings</header><text>The General Counsel shall include in the report transmitted under paragraph (1) one of the following findings:</text>
 <subparagraph id="HAE3756CBD4A04FE3A4FF155C806186BE"><enum>(A)</enum><text>A finding that there is reasonable cause to believe that the employing office committed a violation of part A of title II, as alleged in the covered employee’s claim.</text>
 </subparagraph><subparagraph id="H7B1DEE0E38964E3CAA83A7B496B6C5E9"><enum>(B)</enum><text>A finding that there is no reasonable cause to believe that the employing office committed a violation of part A of title II, as alleged in the covered employee’s claim.</text>
 </subparagraph><subparagraph id="H777FDFFF0D5F4DC7B80ADDD55F8BB529"><enum>(C)</enum><text display-inline="yes-display-inline">A finding that the General Counsel cannot determine whether or not there is reasonable cause to believe that the employing office committed a violation of part A of title II, as alleged in the covered employee’s claim.</text>
 </subparagraph></paragraph><paragraph id="H2E4F8FCD424D468294087B73099CB335"><enum>(3)</enum><header>Notice of right to file civil action</header><text>If the General Counsel transmits a finding under subparagraph (B) of paragraph (2), the General Counsel shall also transmit to the covered employee a written notice that the employee has the right to file a civil action with respect to the claim under section 408.</text>
 </paragraph><paragraph id="H705B77B137E840F282A781E080AE0F65"><enum>(4)</enum><header>Transmission to Executive Director</header><text>If the General Counsel transmits a finding under subparagraph (A) or subparagraph (C) of paragraph (2), the General Counsel shall also transmit the report to the Executive Director.</text>
									</paragraph><paragraph id="H797E5260C7CE48F693F53F004A314B32"><enum>(5)</enum><header>Transmission of report on investigation of certain claims to Congressional ethics committees</header>
 <subparagraph id="H9DEFB5C426BC4170B39640C0D6CFB458"><enum>(A)</enum><header>In general</header><text>In the case of a report furnished by the General Counsel under paragraph (1) on the results of an investigation of a claim alleging a violation described in subparagraph (B) which consists of an act committed personally by a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a Senator, the General Counsel shall transmit the report to—</text>
 <clause id="HD7805A6CBE8F48AEB419503EE949AF21"><enum>(i)</enum><text>the Committee on Ethics of the House of Representatives, in the case of a Member of the House (including a Delegate or Resident Commissioner to the Congress); or</text>
 </clause><clause id="HFDA8948DA8BB4E1E876A88DF012E93B4"><enum>(ii)</enum><text>the Select Committee on Ethics of the Senate, in the case of a Senator.</text> </clause></subparagraph><subparagraph id="H9B4062124BC24423AFF6A5A1273E224B"><enum>(B)</enum><header>Violations described</header><text>A violation described in this subparagraph is—</text>
 <clause id="HE3AAFB5453C34DC2836796A8F7D31E02"><enum>(i)</enum><text>a violation of section 201(a); or</text> </clause><clause id="H20779212BD1D40CCBCF9AADD920C5E48"><enum>(ii)</enum><text>a violation of section 207 which consists of intimidating, taking reprisal against, or otherwise discriminating against any covered employee because the covered employee has opposed any practice made unlawful by section 201(a).</text>
 </clause></subparagraph></paragraph></subsection><subsection id="H69832ED41C63496EAB278DEEB434F3D5"><enum>(d)</enum><header>Recommendation of mediation</header><text>At any time during the investigation of a claim under this section, the General Counsel may make a recommendation that the covered employee and the employing office pursue mediation under section 404 with respect to the claim.</text>
 </subsection><subsection id="H29EB3BFB6B6F471AB3A9B2ABC793317D"><enum>(e)</enum><header>Deadline for concluding investigation</header><text display-inline="yes-display-inline">The General Counsel shall conclude the investigation of a claim under this subsection, and transmit the report on the results of the investigation, not later than 90 days after the claim is filed under section 402, except that the General Counsel may (upon notice to the parties to the investigation) use an additional period of not to exceed 30 days to conclude the investigation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H356B849546AB402B82AD354193187004"><enum>(b)</enum><header>Conforming amendments relating to hearings conducted by Office of Compliance</header><text>Section 405 (<external-xref legal-doc="usc" parsable-cite="usc/2/1405">2 U.S.C. 1405</external-xref>) is amended as follows:</text> <paragraph id="H4E2001D9159B4A2EB2080F8772582643"><enum>(1)</enum><text>In the heading, by striking <quote><header-in-text level="section" style="OLC">Complaint and</header-in-text></quote>.</text>

				<section id="HAD3FE9A2481842EFA93AB073594B17E8"><enum>111.</enum><header>Requiring Members of Congress to reimburse Treasury for amounts paid as settlements and awards in
			 cases of acts committed personally by Members</header>
 <subsection id="H160C11AE3B2E4E6E81091663C929BF50"><enum>(a)</enum><header>Mandating reimbursement of amounts paid</header><text>Section 415 (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H5AA27A4E2F154A6B85BF70C2FF633272" style="OLC"> <subsection id="HBFDD5BF659174411833588BD1A2E40C1"><enum>(d)</enum><header>Reimbursement by Members of Congress of amounts paid as settlements and awards</header> <paragraph id="HFAC2BD2F18C94F55A75A992B503FDF59"><enum>(1)</enum><header>Reimbursement required for certain violations</header> <subparagraph id="H84916459EEA845F4995392FB682B9A14"><enum>(A)</enum><header>In general</header><text>If a payment is made from the account described in subsection (a) for an award or settlement in connection with a claim alleging a violation described in subparagraph (B) which consists of an act committed personally by an individual who, at the time of committing the act, was a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a Senator, the individual shall reimburse the account for the amount of the award or settlement.</text>
 </subparagraph><subparagraph id="H81763FB13EBF421E91C88CE9116C384F"><enum>(B)</enum><header>Violations described</header><text>A violation described in this subparagraph is—</text> <clause id="H8FEC2318A81B4E3D9B83B02ABF9CB148"><enum>(i)</enum><text>a violation of section 201(a); or</text>
 </clause><clause id="H857ADF374F274DA698A8E60CE3429897"><enum>(ii)</enum><text display-inline="yes-display-inline">a violation of section 207 which consists of intimidating, taking reprisal against, or otherwise discriminating against any covered employee because the covered employee has opposed any practice made unlawful by section 201(a).</text>
										</clause></subparagraph></paragraph><paragraph id="H14B89CD898B44BFB9EB212E9FA8E3B8B"><enum>(2)</enum><header>Withholding amounts from salary</header>
 <subparagraph id="HE84FB525A06A4CFFB9A3591C0E5813EE"><enum>(A)</enum><header>Establishment of timetable and procedures by Committees</header><text>For purposes of carrying out subparagraph (B), the applicable Committee shall establish a timetable and procedures for the withholding of amounts from the compensation of an individual who is a Member of the House of Representatives or a Senator.</text>
 </subparagraph><subparagraph id="HA272686966314123BEE3665357BA174D"><enum>(B)</enum><header>Deadline</header><text display-inline="yes-display-inline">The payroll administrator shall withhold from an individual’s compensation and transfer to the account described in subsection (a) (after transferring any amounts to the account of the individual in the Thrift Savings Fund) such amounts as may be necessary to reimburse the account for the payment of an award or settlement described in paragraph (1) if the individual has not reimbursed the account as required under paragraph (1) prior to the expiration of the 90-day period which begins on the date a payment is made from the account for such an award or settlement.</text>
 </subparagraph><subparagraph id="H1BE0C25E72E8454D906AAEC41990DA00"><enum>(C)</enum><header>Applicable committee defined</header><text>In this paragraph, the <quote>applicable Committee</quote> means—</text> <clause id="H93DF75FE5AA9419798C0FBEB25E65B59"><enum>(i)</enum><text>the Committee on House Administration of the House of Representatives, in the case of an individual who, at the time of the withholding, is a Member of the House; or</text>
 </clause><clause id="HA4BC92CD964E4391AFCE7A118B5076EC"><enum>(ii)</enum><text>the Committee on Rules and Administration of the Senate, in the case of an individual who, at the time of the withholding, is a Senator.</text>
										</clause></subparagraph></paragraph><paragraph id="H752DE66E92974221B8EE6215DF7E7E5E"><enum>(3)</enum><header>Use of amounts in Thrift Savings Fund as source of reimbursement</header>
 <subparagraph id="HDED39626E03343D892ADB568C672995B"><enum>(A)</enum><header>In general</header><text>If, by the expiration of the 180-day period which begins on the date a payment is made from the account described in subsection (a) for an award or settlement described in paragraph (1), an individual who is a Member of the House of Representatives or a Senator has not reimbursed the account as required under paragraph (1), the Executive Director of the Federal Retirement Thrift Investment Board shall make a transfer, from the account of the individual in the Thrift Savings Fund to the account described in subsection (a), of an amount equal to the award or settlement (reduced by any amount the individual has reimbursed, taking into account any amounts withheld under paragraph (2)).</text>
 </subparagraph><subparagraph id="H7FF1D21BE8924491B63076301AD32F0A"><enum>(B)</enum><header>Initiation of transfer</header><text display-inline="yes-display-inline">Notwithstanding section 8435 of title 5, United States Code, the Executive Director shall make the transfer under subparagraph (A) upon receipt of a written request to the Executive Director from the Secretary of the Treasury, in the form and manner required by the Executive Director, without the consent of the individual or the individual’s spouse or former spouse (as the case may be).</text>
 </subparagraph></paragraph><paragraph id="H22B5A56B91E94BCD87FF4C23C5C17511"><enum>(4)</enum><header>Notification to Office of Personnel Management and Secretary of the Treasury</header><text>If, at the time an individual is first no longer receiving compensation as a Member or a Senator, the amounts withheld under this subsection have not been sufficient to reimburse the account described in subsection (a) for an award or settlement described in paragraph (1), the payroll administrator—</text>
 <subparagraph id="H4F7F7FE60771478880214A6251857AD0"><enum>(A)</enum><text>shall notify the Director of the Office of Personnel Management, who shall take such actions as the Director considers appropriate to withhold from any annuity payable to the individual under chapter 83 or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, and transfer to the account described in subsection (a), such amounts as may be necessary to reimburse the account for the payment; and</text>
 </subparagraph><subparagraph id="H9E2C57D6911C43C59EA1A941D20FED32"><enum>(B)</enum><text>shall notify the Secretary of the Treasury, who (if necessary), notwithstanding section 207 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/407">42 U.S.C. 407</external-xref>), shall take such actions as the Secretary of the Treasury considers appropriate to withhold from any payment to the individual under title II of the Social Security Act and transfer to the account described in subsection (a), such amounts as may be necessary to reimburse the account for the payment.</text>
 </subparagraph></paragraph><paragraph id="H7B262390F5C040309D5E961E86B1D1FA"><enum>(5)</enum><header>Coordination between OPM and Treasury</header><text>The Director of the Office of Personnel Management and the Secretary of the Treasury shall carry out paragraph (4) in a manner that ensures the coordination of the withholding and transferring of amounts under such paragraph, in accordance with regulations promulgated by the Director and the Secretary.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="HC667977ABBA648F4910EFBAD3EF1531E"><enum>(6)</enum><header>Payroll administrator defined</header><text>In this section, the term <term>payroll administrator</term> means—</text> <subparagraph id="H3508FB0BBCDF4C7587FEE798C7DF7B0B"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an individual who is a Member of the House of Representatives, the Chief Administrative Officer of the House of Representatives, or an employee of the Office of the Chief Administrative Officer who is designated by the Chief Administrative Officer to carry out this subsection; or</text>
 </subparagraph><subparagraph id="H2CD0F5FD4708446D932F34FB60BFD243"><enum>(B)</enum><text>in the case of an individual who is a Senator, the Secretary of the Senate, or an employee of the Office of the Secretary of the Senate who is designated by the Secretary to carry out this subsection.</text>
 </subparagraph></paragraph><paragraph id="HB90980DD942A4018B04C705726EA28D7"><enum>(7)</enum><header>Right to intervene</header><text display-inline="yes-display-inline">An individual who is subject to the reimbursement requirement of this subsection shall have the right to intervene in any mediation, hearing, or civil action under this title to the extent necessary to protect the interests of the individual in the determination of whether an award or settlement described in paragraph (1) should be made, and the amount of any such award or settlement, except that nothing in this paragraph may be construed to require the covered employee who filed the claim to be deposed by counsel for the individual in a deposition which is separate from any other deposition taken from the employee in connection with the hearing or civil action.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H48C80BD928AF4B51BB2CCB6E754977E7"><enum>(b)</enum><header>Conforming amendment relating to Thrift Savings Fund</header><text>Section 8437(e) of title 5, United States Code, is amended by striking <quote>or an obligation</quote> and inserting the following: <quote>an obligation of the Executive Director to make a transfer under section 415(d)(3) of the Congressional Accountability Act of 1995, or an obligation</quote>.</text>
 </subsection><subsection id="HD0FF3CCEE5354CCCBBFCA3E7E0674AC0"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to payments made on or after the date of the enactment of this Act.</text>
					</subsection></section><section id="H00AD2F0CC7874DC68BC59A5B51D7C93D" section-type="subsequent-section"><enum>112.</enum><header>Automatic referral to congressional ethics committees of disposition of certain claims alleging
			 violations of Congressional Accountability Act of 1995 involving Members
 of Congress and senior staff</header><text display-inline="no-display-inline">Section 416(e) (<external-xref legal-doc="usc" parsable-cite="usc/2/1416">2 U.S.C. 1416(d)</external-xref>) is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="H9C3DA9C65C7F43C8AA2B386943D591A1" style="OLC"> <subsection id="H14E1FCC00E564B81A81C3B5CD110A56D"><enum>(e)</enum><header>Automatic referrals to Congressional Ethics Committees of dispositions of claims involving Members of Congress and senior staff</header> <paragraph id="H39F8C97241F1470E9231349E8779BEFC"><enum>(1)</enum><header>Referral</header><text display-inline="yes-display-inline">Upon the final disposition under this title (as described in paragraph (4)) of a claim alleging a violation described in section 415(d)(1)(B) which consists of an act committed personally by a Member of the House of Representatives (including a Delegate or Resident Commissioner to the Congress) or a Senator, or by a senior staff of an employing office of the House of Representatives or Senate, the Executive Director shall refer the claim to—</text>
 <subparagraph id="H0C40301A780A4CED91A40621BD49B1A5"><enum>(A)</enum><text>the Committee on Ethics of the House of Representatives, in the case of a Member or senior staff of the House (including a Delegate or Resident Commissioner to the Congress); or</text>
 </subparagraph><subparagraph id="HDC271F461DA04FFC88FB2972B3945424"><enum>(B)</enum><text>the Select Committee on Ethics of the Senate, in the case of a Senator or senior staff of the Senate.</text>
 </subparagraph></paragraph><paragraph id="H8838B6375A0541AB8102BB1762B94282"><enum>(2)</enum><header>Access to records and information</header><text display-inline="yes-display-inline">If the Executive Director refers a claim to a Committee under paragraph (1), the Executive Director shall provide the Committee with access to the records of any investigations, hearings, or decisions of the hearing officers and the Board under this title, and any information relating to an award or settlement paid, in response to such claim.</text>
 </paragraph><paragraph id="H8309D87E23B843D583CC8AE670EAD016"><enum>(3)</enum><header>Protection of personally identifiable information</header><text>If a Committee to which a claim is referred under paragraph (1) issues a report with respect to the claim, the Committee shall ensure that the report does not directly disclose the identity or position of the individual who filed the claim.</text>

 <subsection id="H4DEEC27DCEFB4B23B9480FB73034EC6B"><enum>(a)</enum><header>In general</header><text>Title IV (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401</external-xref> et seq.) is amended by adding at the end the following new section:</text> <quoted-block display-inline="no-display-inline" id="HB124476765B9443B93CA75FFD7A6B9EB" style="OLC"> <section id="HBE085C5576674AA2B84C820D33C35A37"><enum>417.</enum><header>Availability of remote work assignment or paid leave of absence during pendency of procedures</header> <subsection id="HF350746C5C0E42BCB9606E940359241A"><enum>(a)</enum><header>Options for employees</header> <paragraph id="H67AEC309583A43D9A66326A22A4A2B24"><enum>(1)</enum><header>Remote work assignment</header><text>At the request of a covered employee who files a claim alleging a violation of part A of title II by the covered employee’s employing office, during the pendency of any of the procedures available under this title for consideration of the claim, the employing office may permit the covered employee to carry out the employee’s responsibilities from a remote location instead of from the location of the employing office.</text>
 </paragraph><paragraph id="H620617DE187C46ECBBFF4A054509508E"><enum>(2)</enum><header>Exception for work assignments required to be carried out onsite</header><text display-inline="yes-display-inline">If, in the determination of the covered employee’s employing office, a covered employee who makes a request under this subsection cannot carry out the employee’s responsibilities from a remote location, the employing office may grant paid leave of absence to a covered employee during the pendency of the procedures available under this title for the covered employee.</text>
 </paragraph><paragraph id="H5DE9C829745A4FAAA6B677562002C523"><enum>(3)</enum><header>Ensuring no retaliation</header><text>An employing office may not grant a covered employee’s request under this subsection in a manner which would constitute reprisal or retaliation under section 207.</text>
 </paragraph></subsection><subsection id="H046145CA884A4680A3C24E1291B56528"><enum>(b)</enum><header>Exception for arrangements subject to collective bargaining agreements</header><text>Subsection (a) does not apply to the extent that it is inconsistent with the terms and conditions of any collective bargaining agreement which is in effect with respect to an employing office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

Nothing in this subsection may be construed to prohibit a covered employee or an employing office from disclosing any information related to the claim (including information related to the defense of the claim) in the course of any proceeding under this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HF66483C1CB924CC1B5F729E36FA4ECC7"><enum>(b)</enum><header>Mediation</header><text>Section 416(b) (<external-xref legal-doc="usc" parsable-cite="usc/2/1416">2 U.S.C. 1416(b)</external-xref>) is amended by striking <quote>All mediation</quote> and inserting <quote>All information discussed or disclosed in the course of any mediation</quote>.</text> </subsection></section><section id="H200530093B5D49B2809F9447DF69E28F"><enum>115.</enum><header>Reimbursement by other employing offices of legislative branch of payments of certain awards and settlements</header> <subsection id="H572E3BA357E3409D98FFF33262D2E750"><enum>(a)</enum><header>Requiring reimbursement</header><text display-inline="yes-display-inline">Section 415 (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415</external-xref>), as amended by section 111, is further amended by adding at the end the following new subsection:</text>

 <paragraph id="H8B32AE79530D45F4898BE43F73AE492F"><enum>(1)</enum><header>Notification of payments made from account</header><text display-inline="yes-display-inline">As soon as practicable after the Executive Director is made aware that a payment of an award or settlement under this chapter has been made from the account described in subsection (a) in connection with a claim alleging a violation of section 201(a) by an employing office (other than an employing office of the House of Representatives or an employing office of the Senate), the Executive Director shall notify the head of the employing office that the payment has been made, and shall include in the notification a statement of the amount of the payment.</text>
 </paragraph><paragraph id="H4AC3A17FDC40400F8262815A6B4D8FD5"><enum>(2)</enum><header>Reimbursement by office</header><text display-inline="yes-display-inline">Not later than 180 days after receiving a notification from the Executive Director under paragraph (1), the head of the employing office involved shall transfer to the account described in subsection (a), out of any funds available for operating expenses of the office, a payment equal to the amount specified in the notification.</text>
 </paragraph><paragraph id="H6BE5F548644F4AB3A3C47F96F04EC0B1"><enum>(3)</enum><header>Timetable and procedures for reimbursement</header><text>The head of an employing office shall transfer a payment under paragraph (2) in accordance with such timetable and procedures as may be established under regulations promulgated by the Office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H7D9AEF78FC1943C08A7AA79EEE71406C"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to payments made under section 415 of the Congressional Accountability Act of 1995 on or after the date of the enactment of this Act.</text>
					</subsection></section></subtitle></title><title id="H86B69650346F4315903A66184B14BE6B"><enum>II</enum><header>Improving Operations of Office of Compliance</header>
			<section id="HBD4A345697114DC69B3A2B872BA99AF1" section-type="subsequent-section"><enum>201.</enum><header>Reports on claims, awards, and settlements</header>
				<subsection id="H59F1C5EE80F2498B8A084A0B8A1DF36D"><enum>(a)</enum><header>Semiannual reports on claims, awards, and settlements</header>
 <paragraph id="H0EDD54F24092467E9B84FB07476F75EB"><enum>(1)</enum><header>Requiring submission and publication of reports</header><text>Section 301 (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381</external-xref>) is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HB537A304793E4C0F8CC9C1013275D118" style="OLC"> <subsection id="H1036CFE83EB14283B02CEFD710413802"><enum>(l)</enum><header>Semiannual reports on claims, awards, and settlements</header> <paragraph id="HA56B63584B33453DA8D02FCA07646344"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 45 days after the first 6-month period of each calendar year, and not later than 45 days after the next 6-month period of each calendar year, the Office shall submit to Congress and publish on the Office’s public website a report listing each award or settlement which was paid during the previous year from the account described in section 415(a) as the result of a claim alleging a violation of part A of title II, including the employing office involved, the amount of the award or settlement, the provision of part A of title II which was the subject of the claim, and (in the case of an award or settlement resulting from a violation described in section 415(d)(1)(B) which was committed personally by a Member or former Member of Congress), whether the Member or former Member is in compliance with the requirement of section 415(d) to reimburse the account for the amount of the award or settlement.</text>
 </paragraph><paragraph id="H685C28540E72423EA463ECCAF75EB929"><enum>(2)</enum><header>Protection of identity of individuals receiving awards and settlements</header><text>In preparing and submitting the reports required under paragraph (1), the Office shall ensure that the identity or position of any individual who received an award or settlement, or who made an allegation of a violation against an employing office, is not disclosed.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="HAD199FCC7B804D00BAEA495CF6998C6C"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply with respect to 2018 and each succeeding year.</text> </paragraph></subsection><subsection id="H9C4D88218547449195D434E28EC4BB9C"><enum>(b)</enum><header>Report on amounts previously paid</header> <paragraph id="HE4AA3BEE49ED4F44859A479063DF0A5E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Office of Compliance shall submit to Congress and make available to the public on the Office’s public website a report on all payments made with public funds prior to the date of the enactment of this Act for awards and settlements in connection with violations of section 201(a)(1) of the Congressional Accountability Act of 1995, and shall include in the report the following information:</text>
 <subparagraph id="H36A6E98514CF4808AE0768E39949F768"><enum>(A)</enum><text>The amount paid for each such award or settlement.</text> </subparagraph><subparagraph id="HEA35683A59FA40B08ABB035A3FC9696B"><enum>(B)</enum><text>The source of the public funds used for the award or settlement, without regard to whether the funds were paid from the account described in section 415(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1415">2 U.S.C. 1415(a)</external-xref>), an account of the House of Representatives or Senate, or any other account of the Federal Government.</text>
 </subparagraph></paragraph><paragraph id="H6FCFCAAC9DFE446EB16B98C910FDEC79"><enum>(2)</enum><header>Rule of construction regarding identification of House and Senate accounts</header><text display-inline="yes-display-inline">Nothing in paragraph (1)(B) may be construed to require or permit the Office to report the account of any specific office of the House of Representatives or Senate as the source of funds used for an award or settlement.</text>
					</paragraph></subsection></section><section id="HBCF346F4596D475788AEC160064EB4EC"><enum>202.</enum><header>Workplace climate surveys of employing offices</header>
 <subsection id="H3D58B8DF94F54BE2A5474A557C347DDA"><enum>(a)</enum><header>Requiring surveys</header><text display-inline="yes-display-inline">Title III (<external-xref legal-doc="usc" parsable-cite="usc/2/1381">2 U.S.C. 1381</external-xref> et seq.) is amended by adding at the end the following new section:</text> <quoted-block display-inline="no-display-inline" id="HC41E05BEF6B4488A939DCC673372E547" style="OLC"> <section id="H590F83CE95A941E7957859671D266208"><enum>307.</enum><header>Workplace climate surveys of employing offices</header> <subsection id="HA4768E50F7A34796AE8FB781899E4839"><enum>(a)</enum><header>Requirement To conduct surveys</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and every 2 years thereafter, the Office shall conduct a survey of employing offices under this Act regarding the workplace environment of such offices.</text>
 </subsection><subsection id="H3796D94F2A7845FABE0898D198673C4A"><enum>(b)</enum><header>Special inclusion of information on sexual harassment</header><text>In each survey conducted under this section, the Office shall survey respondents on attitudes regarding sexual harassment.</text>
							</subsection><subsection id="H61186C0A9FCE4B40976BED3C75E2F621"><enum>(c)</enum><header>Methodology</header>
 <paragraph id="H5D6645B4A56042C392A688284C1D4BE6"><enum>(1)</enum><header>In general</header><text>The Office shall conduct each survey under this section in accordance with methodologies established by the Office.</text>
 </paragraph><paragraph id="HC30BA5C70EE24E5BBB6B74300EC58956"><enum>(2)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Under the methodologies established under paragraph (1), all responses to all portions of the survey shall be anonymous and confidential, and each respondent shall be told throughout the survey that all responses shall be anonymous and confidential.</text>
 </paragraph></subsection><subsection id="H3F709D1ECBFF45D388D89EF490FFF374"><enum>(d)</enum><header>Use of results of surveys</header><text display-inline="yes-display-inline">The Office shall furnish the information obtained from the surveys conducted under this section to the Committee on House Administration of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text>
 </subsection><subsection id="H4F5CF47563764F5EBC0825E27E09EEF2"><enum>(e)</enum><header>Consultation with Committees</header><text display-inline="yes-display-inline">The Office shall carry out this section, including establishment of methodologies and procedures under subsection (c), in consultation with the Committee on House Administration of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text>
 </subsection><subsection id="H14CE83ACB1994740BFC5559BC44B2AD8"><enum>(f)</enum><header>Inclusion of Library of Congress</header><text>For purposes of this section, the Library of Congress shall be considered an employing office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H92F6E97199FC41E88570AA2B6263166D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents is amended by adding at the end of the items relating to title III the following new item:</text>

 <subsection id="HE5800DBDB2EF4F3B8A67A570792D9F78"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study of the management practices of the Office of Compliance.</text>
 </subsection><subsection id="HBF706198C0E84E4AAC65A837B9E7ECC4"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the study conducted under subsection (a), and shall include in the report such recommendations as the Comptroller General considers appropriate for improvements to the management practices of the Office of Compliance.</text>
				</subsection></section><section id="H886371E990C3474892E2605B32ED1A60"><enum>205.</enum><header>GAO audit of cybersecurity</header>
 <subsection id="H6160A248CC6D40B3AAEE5B102BD84C58"><enum>(a)</enum><header>Audit</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct an audit of the cybersecurity systems and practices of the Office of Compliance.</text>
 </subsection><subsection id="HDC758C92B27E41209F1BF7ECA4473222"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the audit conducted under subsection (a), and shall include in the report such recommendations as the Comptroller General considers appropriate for improvements to the cybersecurity systems and practices of the Office of Compliance.</text>
				</subsection></section></title><title id="H8B8B8FF4AF06475180F9B22F4B6DD8FF"><enum>III</enum><header>Miscellaneous Reforms</header>
			<section id="HECBAABB55C1B4E0C9D8D0C1BE180924C"><enum>301.</enum><header>Extension to unpaid staff of rights and protections against employment discrimination</header>
 <subsection id="H3EF9B76B22B74F0F82774E4F168D93E3"><enum>(a)</enum><header>Extension</header><text display-inline="yes-display-inline">Section 201 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311</external-xref>) is amended—</text> <paragraph id="H3E6E755619114F89B67E28CDC7103AF0"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text>
 </paragraph><paragraph id="H7F170F832BDF44E493BF0119ED86FC96"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="HEE3066DD3F3441D4BC5AB6A146D7D820" style="OLC"> <subsection id="H96D0642E27BA4BF19631908E7B5C0EA1"><enum>(d)</enum><header>Application to unpaid staff</header> <paragraph id="HC9227167E0074245B54FC54A2216D887"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsections (a) and (b) shall apply with respect to any staff of an employing office who carry out official duties of the employing office but who are not paid by the employing office for carrying out such duties, including an intern (including an applicant for an internship and a former intern), an individual detailed to an employing office, and an individual participating in a fellowship program, in the same manner and to the same extent as such subsections apply with respect to an employee.</text>
 </paragraph><paragraph id="HBD3A1E64581A4FF3981672B7DF1C1625"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in paragraph (1) may be construed to extend liability for a violation of subsection (a) to an employing office on the basis of an action taken by any person who is not under the supervision or control of the employing office.</text>
 </paragraph><paragraph id="H603C4842E19E483E9E176D9F45A9752C"><enum>(3)</enum><header>Intern defined</header><text>The term <term>intern</term> means an individual who performs service for an employing office which is uncompensated by the United States to earn credit awarded by an educational institution or to learn a trade or occupation, and includes any individual participating in a page program operated by any House of Congress.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H63B508E881644D1EB9BE431049251E06"><enum>(b)</enum><header>Technical correction relating to office responsible for disbursement of pay to House employees</header><text>Section 101(7) (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(7)</external-xref>) is amended by striking <quote>disbursed by the Clerk of the House of Representatives</quote> and inserting <quote>disbursed by the Chief Administrative Officer of the House of Representatives</quote>.</text> </subsection></section><section id="H0CC69DF6DBF644AFA3CF3D653B8F1F20"><enum>302.</enum><header>Coverage of employees of Library of Congress</header> <subsection id="HE7789BB300934AC7B30351B855F3E6B1"><enum>(a)</enum><header>Coverage for purposes of protections against workplace discrimination</header><text display-inline="yes-display-inline">Section 201 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311</external-xref>), as amended by section 301(a), is further amended—</text>

 <subsection id="H3283E98DFC8D4FE5A8406243A7038F16"><enum>(d)</enum><header>Special rule for Library of Congress</header><text display-inline="yes-display-inline">In the case of an employee of the Library of Congress, the employee may use the alternative grievance procedures of the Library of Congress instead of the procedures under this title for consideration and resolution of an alleged violation of part A of title II, except that if the employee files a claim as provided in section 402 with respect to the alleged violation, the employee may not use any of such alternative grievance procedures for consideration and resolution of the alleged violation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

 </paragraph><paragraph id="H11FC1515D2DA46B78426239D2FC2B83C"><enum>(2)</enum><header>Treatment of pending claims under existing procedures</header><text display-inline="yes-display-inline">If, as of the date of the enactment of this Act, an employee of the Library of Congress has or could have filed a charge or complaint pursuant to procedures of the Library of Congress which were available to the employee prior to such date for the resolution of a claim alleging a violation of a provision of law made applicable to the Library under section 201(a) of the Congressional Accountability Act of 1995 (including procedures applicable pursuant to a collective bargaining agreement), the employee may complete, or initiate and complete, all such procedures, and such procedures shall remain in effect with respect to, and provide the exclusive procedures for, that charge or complaint until the completion of all such procedures.</text>
					</paragraph></subsection></section><section id="H4CA3AFDA84E34E0A965F51EBA39E16B5" section-type="subsequent-section"><enum>303.</enum><header>Clarification of coverage of employees of Helsinki and China Commissions</header>
 <subsection id="H00DF1E280DBC4DBCB0C29D677EAF28E2"><enum>(a)</enum><header>Clarification of Coverage</header><text display-inline="yes-display-inline">Section 101 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301</external-xref>) is amended—</text> <paragraph id="H3976601B777240A6BEF25B0CF8537FE8"><enum>(1)</enum><text>by striking <quote>Except as otherwise</quote> and inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—Except as otherwise</quote>; and</text>
 </paragraph><paragraph id="H66C7BE627A7347E1AAFF2F7100DEF984"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H24D833FADAAB421DBDDDDE99A9219030" style="OLC"> <subsection id="HB2D21AB12DA840CE86BF1BB31FED7C4E"><enum>(b)</enum><header>Clarification of coverage of employees of certain commissions</header> <paragraph id="H44B8D6E5F7B44EB8B3CB31F5CDD392A0"><enum>(1)</enum><header>Coverage</header><text>With respect to the China Review Commission, the Congressional-Executive China Commission, and the Helsinki Commission—</text>
 <subparagraph id="HA4014D7E2B48469B90C46E5B1D4D57BB"><enum>(A)</enum><text>any individual who is an employee of such Commission shall be considered a covered employee for purposes of this Act; and</text>
 </subparagraph><subparagraph id="HD9B4B4827FA44E95A9E2D6D16EFD0895"><enum>(B)</enum><text>the Commission shall be considered an employing office for purposes of this Act.</text> </subparagraph></paragraph><paragraph id="HB4D70C159D8D46A2A26ED2B625B6BC27"><enum>(2)</enum><header>Authority to provide legal assistance and representation</header><text>Subject to paragraph (3), legal assistance and representation under this Act, including assistance and representation with respect to the proposal or acceptance of the disposition of a claim under this Act, shall be provided to the China Review Commission, the Congressional-Executive China Commission, and the Helsinki Commission—</text>
 <subparagraph id="H204BE535CB2247ED8F1EC0F949BA1689"><enum>(A)</enum><text>by the House Employment Counsel of the House of Representatives, in the case of assistance and representation in connection with a claim filed under title IV (including all subsequent proceedings under such title in connection with the claim) at a time when the chair of the Commission is a Member of the House; or</text>
 </subparagraph><subparagraph id="H0E66AB7DD0E44BD398EAA51998DF705C"><enum>(B)</enum><text display-inline="yes-display-inline">by the Senate Chief Counsel for Employment of the Senate, in the case of assistance and representation in connection with a claim filed under title IV (including all subsequent proceedings under such title in connection with the claim) at a time when the chair of the Commission is a Senator.</text>
 </subparagraph></paragraph><paragraph id="HC05B05A10BCA4692802BC1D459572243"><enum>(3)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="H4CDB57139CB2430F827270FBA3D114D0"><enum>(A)</enum><text>the term <term>China Review Commission</term> means the United States-China Economic and Security Review Commission established under section 1238 of the Floyd D. Spence National Defense Authorization Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/398">Public Law 106–398</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/7002">22 U.S.C. 7002</external-xref>);</text>
 </subparagraph><subparagraph id="H8ECCD91FBE0B47B1A6A65654165750AB"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>Congressional-Executive China Commission</term> means the Congressional-Executive Commission on the People’s Republic of China established under title III of the U.S.–China Relations Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/286">Public Law 106–286</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6911">22 U.S.C. 6911</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H917CE24BC2314BC0ACF744F5764872E0"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>Helsinki Commission</term> means the Commission on Security and Cooperation in Europe established under the Act entitled <quote>An Act to establish a Commission on Security and Cooperation in Europe</quote> (<external-xref legal-doc="public-law" parsable-cite="pl/94/304">Public Law 94–304</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/3001">22 U.S.C. 3001</external-xref> et seq.).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H46EF8774D6E74AFBA8018FD9F6E421C7"><enum>(b)</enum><header>Coverage of Stennis Center</header> <paragraph id="HA78BEACF2167477087EF36A83F8BA6FF"><enum>(1)</enum><header>Treatment of employees as covered employees</header><text display-inline="yes-display-inline">Section 101(3) (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(3)</external-xref>) is amended—</text>

 </paragraph></subsection><subsection id="H1998513079684B4DA1626C27BC1B2295"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as if included in the enactment of the Congressional Accountability Act of 1995.</text>

 </paragraph><paragraph id="H11153C0A45A74EF599F7920CB20318C1"><enum>(2)</enum><text>by inserting after section 508 the following new section:</text> <quoted-block display-inline="no-display-inline" id="HCEE29C887DDF4B69A5B89C927FB2131C" style="OLC"> <section id="HF8ADEB0108814B1B9A6771610BC0C317"><enum>509.</enum><header>Training and education programs of employing offices</header> <subsection id="HDA52E1E6A9564FE4BE00FF4107AE6EDB"><enum>(a)</enum><header>Requiring offices To develop and implement programs</header><text display-inline="yes-display-inline">Each employing office shall develop and implement a program to train and educate covered employees of the office in the rights and protections provided under this Act, including the procedures available under title IV to consider alleged violations of this Act.</text>
								</subsection><subsection id="H94AC76F8D24F4C438F60C42909C4126F"><enum>(b)</enum><header>Report to committees</header>
 <paragraph id="HA4FC2861100E4A16838FE9CAB2DAE1DB"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the beginning of each Congress (beginning with the One Hundred Sixteenth Congress), each employing office shall submit a report to the Committee on House Administration of the House of Representatives and the Committee on Rules and Administration of the Senate on the implementation of the program required under subsection (a).</text>
 </paragraph><paragraph id="HA650FB2AB3ED49DF985554CB6B2CAF3E"><enum>(2)</enum><header>Special rule for first report</header><text>Not later than 180 days after the date of the enactment of the Congressional Accountability Act of 1995 Reform Act, each employing office shall submit the report described in paragraph (1) to the Committees described in such paragraph.</text>
 </paragraph></subsection><subsection id="HCA03D9865F5E447390C5B74440D56E24"><enum>(c)</enum><header>Exception for offices of Congress</header><text>This section does not apply to an employing office of the House of Representatives or an employing office of the Senate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 </subsection><subsection id="H247FCE5EE7DD44539EEEA11569971067"><enum>(b)</enum><header>No effect on pending proceedings</header><text>Nothing in this Act or the amendments made by this Act may be construed to affect any proceeding under title IV of the Congressional Accountability Act of 1995 which is pending as of the date of the enactment of this Act.</text>
