			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To cap the emissions of greenhouse gases through a requirement to purchase carbon permits, to
			 distribute the proceeds of such purchases to eligible individuals, and for
			 other purposes.</official-title></form>
	<legis-body id="H56DE56F26AEF4C0FBB55AE363E6CC300" style="OLC">
 <section id="H3F25DBC10F274775990989BAF9AF864D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Climate and Family Security Act of 2018</short-title></quote>.</text> </section><section id="HD29DB123676C4B0BAB83409089D1293B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
 <paragraph id="H8CF180E9A4E54851BD83F2974D8803A5"><enum>(1)</enum><text display-inline="yes-display-inline">Carbon dioxide and other greenhouse gas emissions continue to rise. In 2013, CO<subscript>2</subscript> levels in the atmosphere reached 400 parts per million for the first time in human history. Ten of the world’s warmest years on record have occurred since 2000, and 2016 was the warmest year ever recorded.</text>
 </paragraph><paragraph id="HF184B004CB2643EE9FAE79D7315AB8CD"><enum>(2)</enum><text>The warming of our planet has led to more frequent, dangerous and expensive extreme weather events, including heat waves, storms, fires, droughts, floods and tornadoes.</text>
 </paragraph><paragraph id="H471248ABECFF48FD982B82DCC2830911"><enum>(3)</enum><text>More than 97 percent of climate scientists agree that our planet is warming, primarily because of the extraction and burning of fossil fuels.</text>
 </paragraph><paragraph id="H34BA378CAB974504A765D2FDE340E354"><enum>(4)</enum><text>The atmosphere is a common resource that belongs equally to all.</text> </paragraph><paragraph id="H0EC3A8285CD04225998BD62477A5F4AA"><enum>(5)</enum><text>Stabilizing the climate can and must be done in a way that supports vibrant economic growth and a thriving middle class.</text>
 </paragraph><paragraph id="HAD07A8D0557C4B8B80937D1FC6808C37"><enum>(6)</enum><text>Legislation to address climate change and accelerate the transition to a clean energy economy must be fair, transparent and built to last.</text>
			</paragraph></section><section id="HDB5D87A17C8B423F975EAD7B9FF808A8"><enum>3.</enum><header>Auction of carbon permits and distribution of Healthy Climate Dividends</header>
 <subsection id="H5DEF86F335704BDF8512A5928C4FB7C1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Internal Revenue Code of 1986 is amended by adding at the end the following new subtitle:</text> <quoted-block display-inline="no-display-inline" id="HAEE372269E1447A6A48F8DCA48508B8D" style="OLC"> <subtitle id="H248EB4EFBDC0440282E2AFAB6C5FC67A"><enum>L</enum><header>Auction of Carbon Permits and Distribution of Healthy Climate Dividends</header> <toc container-level="subtitle-container" idref="H248EB4EFBDC0440282E2AFAB6C5FC67A" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"> <toc-entry idref="H8B61E0E77E5F4D08993557E42415748F" level="section">Chapter 101. Banking and borrowing.</toc-entry></toc> <section id="HAE9B2D03845E488F9C9B634D85C00ABF"><enum>9901.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this subtitle:</text>
 <paragraph id="HF83598697A5045E9B89A552039291EF2"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text> </paragraph><paragraph id="HBC38C9E7C1A245EEA8EC768E0104DDAD"><enum>(2)</enum><header>Carbon permit</header><text>The term <term>carbon permit</term> means a carbon permit established by the Secretary under section 9902(a).</text>
 </paragraph><paragraph id="H4E6406F480F741A89DE5C2E24C418C96"><enum>(3)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text> <subparagraph id="HD2463C1E3A074F6F8170ED5EC4127FCC"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of crude oil—</text>
 <clause id="H174D5834935547BDA1F34D900F0B9739"><enum>(i)</enum><text display-inline="yes-display-inline">a refinery operating in the United States which is designed to serve the primary purpose of processing liquid fuel from crude oil, and</text>
 </clause><clause id="H3ED0D79532F644C29395DAD358F97250"><enum>(ii)</enum><text display-inline="yes-display-inline">any importer of any petroleum or petroleum product (not including crude oil) into the United States,</text>
 </clause></subparagraph><subparagraph id="HE28A2A92C6404DCD89A99705EC3BF50A"><enum>(B)</enum><text>in the case of coal—</text> <clause id="HCD1D3F3F7B7C4540B2F8FAC38DC34381"><enum>(i)</enum><text>any coal mine operating in the United States, and</text>
 </clause><clause id="H46D2E571FE134288A8FCFB90E479107F"><enum>(ii)</enum><text>any importer of coal into the United States, and</text> </clause></subparagraph><subparagraph id="H8B813EAC9BC74E28905339BD886EFF58"><enum>(C)</enum><text>in the case of natural gas—</text>
 <clause id="H42C846FB693E4E1A8724B0533C676F08"><enum>(i)</enum><text>any person required to submit a report to the Energy Information Agency on Form 176 by reason of delivering natural gas to an end user, and</text>
 </clause><clause id="H2420D8289B6544CAAD3A4132B29688BD"><enum>(ii)</enum><text>any natural gas processor not described in clause (i) with respect to sales of natural gas in the United States.</text>
 </clause></subparagraph></paragraph><paragraph id="HF4DF79EB953042E0ACE562E024EFBC3C"><enum>(4)</enum><header>Covered fuel</header><text display-inline="yes-display-inline">The term <term>covered fuel</term> means crude oil, natural gas, coal, or any other product derived therefrom for use as a combustible fuel offered for sale in United States markets.</text>
 </paragraph><paragraph id="H55AE57C17750488C8C58365837C9844F"><enum>(5)</enum><header>Crude oil</header><text display-inline="yes-display-inline">The term <term>crude oil</term> includes crude oil condensates, natural gasoline, shale oil, any bitumen or bituminous mixture, any oil derived from a bitumen or bituminous mixture, and any oil derived from kerogen-bearing sources.</text>
 </paragraph><paragraph id="HD5A8C42F60334C08BDB2B26A4D1F5B11"><enum>(6)</enum><header>Fair market value</header><text>The term <term>fair market value</term> means the average auction price for carbon permits during the 4 quarters immediately preceding a failure to surrender, when required under section 9904, the required number of carbon permits under such section.</text>
 </paragraph><paragraph id="HB99BFC27B4A3400487733DE14A4B5BCC"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other commonwealth, territory, or possession of the United States.</text>
 </paragraph><paragraph id="H5B57F561D58D42F79FA03EA0C6C5C54B"><enum>(8)</enum><header>Vintage year</header><text display-inline="yes-display-inline">The term <term>vintage year</term> means the calendar year for which a carbon permit is established under section 9902.</text> </paragraph></section><section id="HF3FBB703D5554A9A81AB12179257B3BD"><enum>9902.</enum><header>Carbon permits</header> <subsection id="HB9CAAB8AD3D248B59B9685ACACA1D571"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Administrator, shall establish a separate quantity of carbon permits for calendar year 2019 and each calendar year thereafter, as set forth under subsection (b).</text>
								</subsection><subsection id="H0A3E06AD412543C0A6E164CA6DDB2ACE"><enum>(b)</enum><header>Emissions reduction schedule</header>
 <paragraph id="H34216C1C22404F5FB039F71040837F75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The quantity of carbon permits established by the Secretary, in consultation with the Administrator, under subsection (a) for any calendar year before 2050 that is between the nearest target years specified in paragraph (2) preceding and succeeding such calendar year shall be the quantity of such permits that represents an equal, pro rata reduction from the preceding year to the succeeding year.</text>
									</paragraph><paragraph id="H626851BA11ED4E0EA96913C5C2667C5A"><enum>(2)</enum><header>Targets</header>
 <subparagraph id="H0748F476480A4869BCF6016534585461"><enum>(A)</enum><header>Initial target</header><text display-inline="yes-display-inline">The quantity of carbon permits established for 2019 shall be equal to 12.5 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005.</text>
 </subparagraph><subparagraph id="H2399FCC889384B11BCC8F8E446770862"><enum>(B)</enum><header>Decadal targets</header><text>The quantity of carbon permits established for—</text> <clause id="H8660C55338CC483BA364A0916698F3E7"><enum>(i)</enum><text display-inline="yes-display-inline">2020 shall be equal to 20 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005,</text>
 </clause><clause id="H5047180F5ABF4AAAAC497B2D79185A1D"><enum>(ii)</enum><text display-inline="yes-display-inline">2025 shall be equal to 30 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005,</text>
 </clause><clause id="H38F8C5FE709E4B168F9862DAF6047A83"><enum>(iii)</enum><text display-inline="yes-display-inline">2030 shall be equal to 40 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005,</text>
 </clause><clause id="HD5A1477F5B5044F4A819418736FC24C5"><enum>(iv)</enum><text display-inline="yes-display-inline">2035 shall be equal to 50 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005,</text>
 </clause><clause id="H8340D2D632864CD1A9D013BE7CD8F361"><enum>(v)</enum><text>2040 shall be equal to 60 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005,</text>
 </clause><clause id="HC5B2A3A452C9480EBDAF54A0A10B3570"><enum>(vi)</enum><text display-inline="yes-display-inline">2045 shall be equal to 70 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005, and</text>
 </clause><clause id="HAE4168298E2F4850B7E2C3895B3C189B"><enum>(vii)</enum><text>2050 shall be equal to 80 percent less than the number of metric tons of carbon dioxide emitted in the United States in 2005.</text>
											</clause></subparagraph></paragraph><paragraph id="H75C3639E944748C0845647DA67A76087"><enum>(3)</enum><header>Reports</header>
 <subparagraph id="H1F4CDCF395EE49B29BD65818084717FB"><enum>(A)</enum><header>Calendar year 2048</header><text display-inline="yes-display-inline">In 2048 the Secretary, after consultation with the Administrator, will submit a report to Congress making recommendations concerning the program established under this subtitle for years after 2050, including the quantity of carbon permits to be established and any reductions that may be necessary to ensure a healthy climate.</text>
 </subparagraph><subparagraph id="HF564C4C676574A4AA31C7D60E64C82CA"><enum>(B)</enum><header>Averting catastrophic climatic impact</header><text>The Secretary shall report to Congress if the Secretary, after consultation with the Administrator, determines the emissions reductions targets under this subsection should be revised in order to avert catastrophic climate impacts. Such report shall include recommended revisions to the existing emissions reduction schedule and the basis for those recommendations.</text>
 </subparagraph></paragraph></subsection><subsection id="HF1B115AE17DB4D5B8E76AD90975CA040"><enum>(c)</enum><header>Identification numbers</header><text>The Secretary shall assign to each carbon permit established under subsection (a) a unique identification number that includes the vintage year for that carbon permit.</text>
								</subsection><subsection commented="no" id="H9BD6902D2B1A4E19BB8F55FD53B83D7E"><enum>(d)</enum><header>Legal status of carbon permits</header>
 <paragraph commented="no" id="HC05A3DA5A514478AA715EBEE6CA0DC29"><enum>(1)</enum><header>In general</header><text>A carbon permit does not constitute a property right.</text> </paragraph><paragraph commented="no" id="HE4F84B62F0824322992B9B843C71DBA0"><enum>(2)</enum><header>Termination or limitation</header><text>Nothing in this subtitle or any other provision of law shall be construed to limit or alter the authority of the United States, including the Secretary acting pursuant to statutory authority, to terminate or limit a carbon permit.</text>
 </paragraph><paragraph commented="no" id="H3F7C06C524F14249886B79EB42199202"><enum>(3)</enum><header>Other provisions unaffected</header><text display-inline="yes-display-inline">Nothing in this subtitle relating to carbon permits issued under this section shall affect the application of any other provision of law to a covered entity (including the Clean Air Act), or the responsibility for a covered entity to comply with any such provision of law. Regional and State greenhouse gas initiatives are not preempted by this subtitle.</text>
 </paragraph></subsection><subsection id="H1CC2533E96D642F2B47A5F777B1D1BFE"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than December 31, 2018, the Secretary shall promulgate regulations to carry out the provisions of this subtitle.</text>
								</subsection></section><section id="H86B31EF828C140B799A5B3121064451D"><enum>9903.</enum><header>Auctions</header>
 <subsection id="H7319EF24DCC44C9684C1657B910C8D84"><enum>(a)</enum><header>Periodic auctions</header><text display-inline="yes-display-inline">The Secretary shall conduct periodic public auctions of carbon permits established under section 9902(a). The Secretary shall conduct at least 4 such auctions in each year for which carbon permits are established.</text>
 </subsection><subsection id="HF38D35A5098A40D59D0650F7E626F464"><enum>(b)</enum><header>Auction rules</header><text display-inline="yes-display-inline">The Secretary shall—</text> <paragraph id="H69CADB200E234606897DA131700FEA5C"><enum>(1)</enum><text>limit auction participation only to covered entities,</text>
 </paragraph><paragraph id="H4224D7D513484437A8D710B942953BD2"><enum>(2)</enum><text>establish a limit on the amount of carbon permits that can be purchased by a single entity at each auction and an aggregate limit on the total amount of permits that can be held by a single entity at any one time that—</text>
 <subparagraph id="H1B93D60248ED400C95F9DB4CD4066AE6"><enum>(A)</enum><text>reflects anticipated sector and participant demand,</text> </subparagraph><subparagraph id="H3CBD724D81474DC79380B150BA550EE4"><enum>(B)</enum><text>prevents speculation, manipulation, or hoarding of permits, and</text>
 </subparagraph><subparagraph id="H1D3AEBEA47004F59A1B9A08326893EE0"><enum>(C)</enum><text>does not interfere with normal market competition, and</text> </subparagraph></paragraph><paragraph id="H13FA73324CB444949F3AB612576684E7"><enum>(3)</enum><text>have the authority to set a minimum permit price at auction.</text>
 </paragraph></subsection><subsection display-inline="no-display-inline" id="H45759DCA8F994A6288E07562322F5502"><enum>(c)</enum><header>Unsold permits</header><text>Any carbon permit unsold at auction may be offered at the next quarterly auction in the calendar year. Any carbon permit unsold after the last auction for a calendar year shall be transferred to the reserve established under section 9908.</text>
								</subsection></section><section id="HFCC51F32FEF849D8BA3F4EBC028E9130"><enum>9904.</enum><header>Compliance obligation</header>
 <subsection id="HB5459EAF7C984109B067EFD99966E88B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than April 1, 2019, and April 1 of each year thereafter, a covered entity shall surrender to the Secretary a quantity of carbon permits at least as great as the number of metric tons of carbon dioxide that the Secretary, in consultation with the Administrator, determines would be emitted by the combustion of covered fuels with respect to which the covered entity made the first sale in United States markets during the previous calendar year.</text>
 </subsection><subsection id="H5381BABAAC2F4A9384D752492556251C"><enum>(b)</enum><header>Use treated as sale</header><text>For purposes of subsection (a), consumption for an emitting use by the covered entity of covered fuels produced by the covered entity shall be treated as a first sale.</text>
 </subsection><subsection id="H4A7C783486B140E1BA69B039C3E09527"><enum>(c)</enum><header>Exemption</header><text display-inline="yes-display-inline">A covered entity shall not have to surrender a carbon permit for the sale of a covered fuel consumed for a non-emitting use, as defined and verified by the Secretary in consultation with the Administrator, unless such covered fuel is sold to a person issued carbon permits under section 9906.</text>
								</subsection></section><section id="H59941014A16C4B3AA937856E8438B27E"><enum>9905.</enum><header>Penalty for noncompliance</header>
 <subsection id="HE8DEFF20833F48079C9C8AB83B45A4BD"><enum>(a)</enum><header>In general</header><text>Any covered entity that fails for any year to surrender, by the deadline described in section 9904, one or more of the carbon permits due pursuant to such section shall be liable for payment to the Secretary of a penalty in the amount described in subsection (b).</text>
 </subsection><subsection id="HD98DEC5269E34AC18217DCACC8F25F7D"><enum>(b)</enum><header>Amount</header><text>The amount of a penalty required to be paid under subsection (a) shall be equal to the product obtained by multiplying—</text>
 <paragraph id="H13AF93E343D14DC4A0597D50FC6C280B"><enum>(1)</enum><text>the number of carbon permits that the covered entity failed to surrender by the deadline, by</text> </paragraph><paragraph id="HC927D2AA40AC492DA3C520386C93D369"><enum>(2)</enum><text>3 times the fair market value of carbon permits issued for emissions occurring in the calendar year for which the carbon permits were due.</text>
 </paragraph></subsection><subsection id="HA5EC32AA32B24678B22BC75E121BFC88"><enum>(c)</enum><header>Timing</header><text>A penalty required under this section shall be immediately due and payable to the Secretary, without demand, in accordance with regulations promulgated by the Secretary, which shall be issued not later than 1 year after the date of enactment of this subtitle.</text>
 </subsection><subsection id="H381886025D51483D834474433308CB18"><enum>(d)</enum><header>No effect on liability</header><text>A penalty due and payable by the covered entity under this section shall not diminish the liability of the covered entity for any fine, penalty, or assessment against the covered entity for the same violation under any other provision of law.</text>
 </subsection><subsection id="H3864C29196CD4871BEA18E8D0A929A21"><enum>(e)</enum><header>Penalty not deductible</header><text>No deduction shall be allowed under subtitle A for a penalty paid under this section.</text> </subsection></section><section id="H7D16F7B013184413B4123CB7DD10240D"><enum>9906.</enum><header>Carbon capture and sequestration</header> <subsection id="H53EF58AE446645259851E06CC22FD1F2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall issue a carbon permit to any person who the Secretary, in consultation with the Administrator, determines has safely and verifiably captured and sequestered carbon dioxide from the combustion of covered fuels in the United States.</text>
 </subsection><subsection id="H039A50AAEFFA450A92DFB8ECDF915BF3"><enum>(b)</enum><header>Quantity</header><text>The quantity of each permit issued under subsection (a) shall be in the amount equivalent to the number of metric tons of carbon dioxide so captured and sequestered.</text>
 </subsection><subsection id="H605C6B7D68B84D7E838EF8DE1EFA50CB"><enum>(c)</enum><header>Coordination</header><text>The quantity of permits issued under this section shall be in addition to the quantity of permits established under section 9902(a).</text>
								</subsection></section><section id="H4B49F9ADA6FB4CB5AB31C831A26BC386"><enum>9907.</enum><header>Trading</header>
 <subsection id="H8570B5CE1E5C42E38C40F77850737BEE"><enum>(a)</enum><header>Permitted transactions</header><text display-inline="yes-display-inline">The lawful holder of a carbon permit may—</text> <paragraph id="H6A9AAD32F5834B41BA4F2ED3CE25E44E"><enum>(1)</enum><text>hold the carbon permit, subject to the limits established by the Secretary under section 9903(b)(2), or</text>
 </paragraph><paragraph id="H89E31CFA1BBD443FBEC4E643EC496991"><enum>(2)</enum><text>sell, exchange, or transfer the carbon permit to a covered entity consistent with the limits established by the Secretary under section 9903(b)(2).</text>
 </paragraph></subsection><subsection id="HC082E1D4EE92403B8AC14EA12D07BC49"><enum>(b)</enum><header>Effectiveness of carbon permit transfers</header><text>No transfer of a carbon permit shall be effective until a written certification of the transfer, signed by a responsible official of the transferor, is received and recorded by the Secretary in accordance with regulations promulgated under section 9902(e).</text>
 </subsection><subsection id="H95039973C60C4BD4BBF930AFCF1CD779"><enum>(c)</enum><header>Carbon permit tracking system</header><text>The regulations promulgated under section 9902(e) shall include a system for issuing, recording, holding, and tracking carbon permits that shall specify all necessary procedures and requirements for an orderly and competitive functioning of the carbon permit system. Such regulations shall provide for appropriate publication of the information in the system on the Internet.</text>
								</subsection></section><section id="H712A5D428D8244E7982F75D09C90A0E0"><enum>9908.</enum><header>Banking and borrowing</header>
 <subsection id="H09E1528A5E104DFAB58D498A551C0B72"><enum>(a)</enum><header>Banking</header><text>A carbon permit may be used to meet the compliance obligation requirements of section 9904 for emissions in—</text>
 <paragraph id="H5BE0C20F40164291BE597C04042A2439"><enum>(1)</enum><text>the vintage year for the carbon permit, or</text> </paragraph><paragraph id="HC9FD41AE950F4902ADC6B723B7B6C84A"><enum>(2)</enum><text>any calendar year subsequent to the vintage year for the carbon permit in accordance with subsection (b).</text>
 </paragraph></subsection><subsection id="H9F236DFE61B741338BF64716BF34A996"><enum>(b)</enum><header>Reserve</header><text>The Secretary shall establish a reserve for carbon permits. Carbon permits transferred into the reserve shall be available in the manner determined by the Secretary when the Secretary determines that price point for carbon permits determined under subsection (d) is met and additional carbon permit supply is needed to stabilize the auction price. Permits in the reserve shall be used on a first in, first out basis.</text>
 </subsection><subsection id="HD4209BE633544F948B913760B36C9749"><enum>(c)</enum><header>Expiration</header><text>A carbon permit shall not expire unless—</text> <paragraph id="HBC1ED8403CED484C98F54363BF9D10C7"><enum>(1)</enum><text>it is surrendered to the Secretary under section 9904 or section 9907(a)(3),</text>
 </paragraph><paragraph id="H9CF28E52B2B74959854685E6A0EDB290"><enum>(2)</enum><text>it has remained in the reserve for 5 years after being transferred into the reserve, or</text> </paragraph><paragraph id="HA8C9446885524E6CBF1F23F3273B9474"><enum>(3)</enum><text>the Secretary determines by regulation that expiration is necessary to ensure the authenticity and integrity of carbon permits or the carbon permit tracking system.</text>
									</paragraph></subsection><subsection commented="no" id="H0800C7850BE54851838EC98BE558A996"><enum>(d)</enum><header>Borrowing future vintage year carbon permits</header>
 <paragraph id="HA8804C46BCBD4953A8E46675B92D2A31"><enum>(1)</enum><header>In general</header><text>If the auction price for carbon permits increases by more than 50 percent above the average auction price for carbon permits during the preceding two years (or, if before the third year for which auctions are conducted, the average auction price for carbon permits during the preceding auctions), the Secretary shall auction as many additional carbon permits as are necessary to stabilize the auction price.</text>
									</paragraph><paragraph id="H4F42B53111F74013B6BE1D0DB6849A5A"><enum>(2)</enum><header>Special rules</header>
 <subparagraph id="HCDBE02AD40294CFBB5C204DBC15577E9"><enum>(A)</enum><header>Coordination with reserve</header><text display-inline="yes-display-inline">Additional permits may not be auctioned under paragraph (1) until after all available permits in the reserve for carbon permits established under subsection (b) have been used.</text>
 </subparagraph><subparagraph id="H68A4CCF4A75841AB80FF57E693AFB007"><enum>(B)</enum><header>Reduction in vintage year permits</header><text>Any carbon permits made available under this subsection shall result in an equivalent reduction in the aggregate amount of carbon permits made available in vintage years 2030 through 2050 as set forth in section 9902, and the Secretary shall reduce the number of carbon permits by an equal percentage in each of those vintage years.</text>
										</subparagraph></paragraph></subsection></section></chapter><chapter id="H64C7DA3AED1048178EC39AD769A131A2"><enum>102</enum><header>Healthy Climate Dividends</header>

							<section id="H58DCA135024942F6A8FEB7544B60854D"><enum>9911.</enum><header>Healthy Climate Trust Fund</header>
 <subsection display-inline="no-display-inline" id="H90AC698799694E6BBE878878528BDFA1"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Healthy Climate Trust Fund</quote>, consisting of such amounts as may be appropriated to such trust fund as provided for in this section.</text>
								</subsection><subsection id="H2B09EA5E058F4B58987BA2A56D484008"><enum>(b)</enum><header>Transfers</header>
 <paragraph id="H530024EB900141F5AC04E72150D27E8D"><enum>(1)</enum><header>Proceed amounts</header><text>There are appropriated to the Healthy Climate Trust Fund amounts equivalent to funds received as proceeds under section 9903.</text>
 </paragraph><paragraph id="HA232CBCA35EA4239964A9491737E5A86"><enum>(2)</enum><header>Penalty amounts</header><text>There are appropriated to the Healthy Climate Trust Fund amounts equivalent to funds received as penalties under section 9905.</text>
									</paragraph></subsection><subsection id="H80000FCC520A4D2D840FD6BB7B38541C"><enum>(c)</enum><header>Expenditures</header>
 <paragraph id="H87716324A84D49F099184B19ED3C1ED7"><enum>(1)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Such amounts as may be necessary from the Healthy Climate Trust Fund shall be available to pay the administrative expenses necessary to carry out this section for each month, but not exceeding the amount of interest credited to the trust fund under section 9602.</text>
 </paragraph><paragraph id="H9DC4EDF272E3458197B09E3B64B06A25"><enum>(2)</enum><header>Healthy Climate Dividend Payments</header><text>Amounts in the Healthy Climate Trust Fund not used under paragraph (1) for any month shall be available for making Healthy Climate Dividend Payments under section 9912.</text>
									</paragraph></subsection></section><section commented="no" id="H3A26309D664340D88EF5A053863B2B7F"><enum>9912.</enum><header>Healthy Climate Dividend Payments</header>
 <subsection commented="no" display-inline="no-display-inline" id="H754216D2C03749DBAF5010E4EDBF1D28"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section:</text> <paragraph commented="no" id="HFE0959D9B193443F93F9175F01324C20"><enum>(1)</enum><header>Healthy Climate Dividend Payment</header><text>The term <term>Healthy Climate Dividend Payment</term> means the individual pro-rata share, as determined by the Secretary, of amounts available for any quarter in the Healthy Climate Trust Fund under section 9911(c)(2). For purposes of the preceding sentence, the amounts available for any quarter shall be the fraction of the total amount made available from an auction conducted under section 9903—</text>
 <subparagraph id="HFE23CA3270BD436787AAB165A5F409CF"><enum>(A)</enum><text>the numerator of which is 1, and</text> </subparagraph><subparagraph id="H8A1C7A9CA8BB48BCB7C424DBC65E2161"><enum>(B)</enum><text>the denominator of which is the number of quarters in the period beginning with the quarter in which such auction is conducted and ending with the quarter before the quarter in which the next such auction is scheduled to be conducted.</text>
										</subparagraph></paragraph><paragraph commented="no" id="H7E3AEAED333449C797DE0E83F85ADDD9"><enum>(2)</enum><header>Eligible individual</header>
 <subparagraph id="H8DD7067A245E4894BA91D7D1E66EE0AF"><enum>(A)</enum><header>In general</header><text>The term <term>eligible individual</term> means, with respect to any quarter, any individual with a valid social security number (other than a nonresident alien individual) who is lawfully present in the United States for such quarter, as determined and verified by the Secretary in consultation with any other Federal entity the Secretary determines appropriate.</text>
 </subparagraph><subparagraph id="H4080F37198EA41F093A1E757DC6912F7"><enum>(B)</enum><header>Opt out</header><text>An individual may elect not to be treated as an eligible individual.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="HA5BB6985F4714B53B944C567BEBCEE4F"><enum>(b)</enum><header>Payment of Healthy Climate Dividend</header><text display-inline="yes-display-inline">From amounts made available under section 9911(c)(2), the Secretary shall make a Healthy Climate Dividend Payment not later than the end of the calendar quarter following the calendar quarter in which such amounts are appropriated to the Healthy Climate Trust Fund under section 9911 to each individual who is an eligible individual for that quarter. Such payments shall be made by electronic means to the maximum extent practicable.</text>
 </subsection><subsection id="HF5972DA24E6041FDBD5FD776869C7F6A"><enum>(c)</enum><header>Exclusion from gross income</header><text>Gross income shall not include any Healthy Climate Dividend paid under this section.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="H230FDD124A8541CB8FE77BECAA739912"><enum>(d)</enum><header>Regulations</header><text>The Secretary shall prescribe such regulations and other guidance as may be necessary or appropriate to carry out this section.</text>
								</subsection></section><section id="H62DF2EB28FB546B08E927290C05392F1"><enum>9913.</enum><header>Transparency</header>
 <subsection id="H80AFF1E4939F4B1799AE875F0CD0D4A7"><enum>(a)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than June 30, 2019, and at least annually thereafter, the Secretary shall transmit to Congress a report accounting for the disposition of amounts in the Healthy Climate Trust Fund in the previous calendar year.</text>
 </subsection><subsection id="H2F1CC411EBF5486E947FDC120B1D2A57"><enum>(b)</enum><header>Healthy Climate Trust Fund Website</header><text>Not later than 90 days after the date of the enactment of this subtitle, the Secretary shall establish and maintain a website to provide the public with information on the disposition of any amounts in the Healthy Climate Trust Fund.</text>

							<section id="H5402A01A7DC949D79BAD9DCA91188E1D"><enum>9921.</enum><header>Carbon equivalency fee</header>
 <subsection id="H187D77C6641D48F3927E04FED8765E1B"><enum>(a)</enum><header>Imports</header><text display-inline="yes-display-inline">The Secretary shall impose carbon equivalency fees to be collected by the Commissioner responsible for U.S. Customs and Border Control on imports of carbon-intensive goods. The amount of the carbon equivalency fee shall be equal to the cost that domestic producers of a comparable carbon-intensive good incur as a result of—</text>
 <paragraph id="HF54B053F7DAF47F6B98E3979F9D2658C"><enum>(1)</enum><text>prices paid in the acquisition of carbon permits by covered entities under this subtitle, and</text> </paragraph><paragraph id="H509D9903E57446F1BD993595AE3CAD9B"><enum>(2)</enum><text>carbon equivalency fees paid by importers of carbon-intensive goods used in the production of the comparable carbon-intensive good.</text>
 </paragraph></subsection><subsection id="H6B27C409854C46E09D3AED77D7C9BBFB"><enum>(b)</enum><header>Payments to Exporters</header><text>The Secretary shall pay without interest to persons exporting from the United States carbon-intensive goods produced in the United States. The amount of the payment shall be equal to the cost that domestic producers of the carbon-intensive good incur as a result of—</text>
 <paragraph id="H73297287F2D1408FB1279254BB3C3655"><enum>(1)</enum><text display-inline="yes-display-inline">prices paid in the acquisition of carbon permits by covered entities under this subtitle, and</text> </paragraph><paragraph id="H44B381F3E4914D2B92CF54FC87ACA9F3"><enum>(2)</enum><text>carbon equivalency fees paid by importers of carbon-intensive goods used in the production of the comparable carbon-intensive good.</text>
 </paragraph></subsection><subsection id="H0FE6EAD0B46B4768880AC0E1DAAAE8DA"><enum>(c)</enum><header>Expiration</header><text>This section shall cease to have effect at such time as and to the extent that—</text> <paragraph id="H4C251506994A4AFEB1D2989426029A21"><enum>(1)</enum><text>an international agreement requiring countries that emit greenhouse gases and produce carbon-intensive goods for export markets to adopt equivalent measures comes into effect, or</text>
 </paragraph><paragraph id="HACEF9B60661445D0A5B2F8E47874BA3C"><enum>(2)</enum><text>the country of export has implemented equivalent measures, as determined by the Secretary, in consultation with the Secretary of State.</text>
 </paragraph></subsection></section><section id="H698C116418DC4B29905BAC30F21FE462"><enum>9922.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text> <paragraph id="H6647C8A204E64273AC6074D425EAC400"><enum>(1)</enum><header>Carbon-intensive good</header><text display-inline="yes-display-inline">The term <term>carbon-intensive good</term> means a good that, as identified by the Secretary, in consultation with the Administrator, by rule—</text>
 <subparagraph id="H55DAD6A6014F450D8A6182553D68F5BC"><enum>(A)</enum><text>is a primary product, or</text> </subparagraph><subparagraph id="HA4473484824D426B897A629D8C74356A"><enum>(B)</enum><text>is a manufactured item in which one or more primary products are inputs and the cost of production of which in the United States is significantly increased by reason of the requirements under this subtitle.</text>
 </subparagraph></paragraph><paragraph id="H923EB0D8856746BDB3D95B4D3531017E"><enum>(2)</enum><header>Primary product</header><text>The term <term>primary product</term> means—</text> <subparagraph id="H25B3C3BAA4AD4F33A6F3F7F7C2E21F0A"><enum>(A)</enum><text>iron, steel, steel mill products (including pipe and tube), aluminum, cement, glass (including flat, container, and specialty glass and fiberglass), pulp, paper, chemicals, or industrial ceramics, and</text>
 </subparagraph><subparagraph id="H3B34D570BA584E8C86FBD8B16DCC366D"><enum>(B)</enum><text>any other manufactured product that the Secretary, in consultation with the Administrator, determines—</text>
 <clause id="HB689ECC666C142C785CB3BDCE751A253"><enum>(i)</enum><text>is sold for purposes of further manufacture, and</text> </clause><clause id="H5154764E32DE4C16B16E69F0B0EB67FD"><enum>(ii)</enum><text>generates, in the course of the manufacture of the product, direct and indirect greenhouse gas emissions that are comparable (on an emissions-per-dollar of output basis) to emissions generated in the manufacture or production of a primary product identified in subparagraph (A).</text>
 </clause></subparagraph></paragraph><paragraph commented="no" id="H76448280050144E4899C63F4C7D7ACB2"><enum>(3)</enum><header>Equivalent measure</header><text>The term ‘equivalent measure’ means a tax, or other regulatory requirement that imposes a cost, on manufacturers of carbon-intensive goods located outside the United States, by reason of greenhouse gas emissions in the production of such goods by such manufacturers, approximately equal to the cost imposed by this subtitle on manufacturers of comparable carbon-intensive goods located in the United States.</text>
 </paragraph></section><section id="HDB7926B1D27C4BC58482F3B289A583AB"><enum>9923.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the United States should work proactively under the United Nations Framework Convention on Climate Change and in other appropriate fora, to establish binding agreements committing all major greenhouse gas emitting countries and countries with globally competitive producers of carbon-intensive goods to contribute equitably to the reduction of global greenhouse gas emissions on a schedule and order of magnitude necessary to stabilize the climate.</text></section></chapter></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H8B6A6E5313AB4290AF3FBFF976587769"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of subtitles for the Internal Revenue Code of 1986 is amended by adding at the end the following new item:</text>

 <subsection id="H2E008B921D604FD9A82D2605303666CC"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HAA42237025134883AB7642A79ADCEDAE"><enum>(1)</enum><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
 </paragraph><paragraph id="HA5B165FF0F514245AC6CF554B1BAEB15"><enum>(2)</enum><text>The term <term>non-auction greenhouse gas</term> refers to the gases included on the list in effect under subsection (b).</text> </paragraph></subsection><subsection id="H00ACD07D2E1F488FAEE8478B408E302C"><enum>(b)</enum><header>List of non-Auction greenhouse gases</header> <paragraph id="H3E65F1ED214240B3ABE1F9A905E6BBA8"><enum>(1)</enum><header>Initial list</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Administrator, by rule, shall finalize and publish a list that—</text>
 <subparagraph id="H2781F4B85F8B47998C2702EE20A5742F"><enum>(A)</enum><text>consists of the anthropogenically emitted gases that are determined by the Administrator to contribute to global warming; and</text>
 </subparagraph><subparagraph id="HCC35B07558944073A835F03FB7FE662A"><enum>(B)</enum><text>excludes gases to the extent they are—</text> <clause id="H0B849EF2A717415FAFC23DEE904A44F5"><enum>(i)</enum><text>carbon dioxide emitted by the combustion of a covered fuel (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/9901">section 9901</external-xref> of the Internal Revenue Code of 1986, as added by section 3(a) of this Act); or</text>
 </clause><clause id="H94FB4987C4D9497C8150E4C5F2EDD959"><enum>(ii)</enum><text>directly attributable to the production of animals for food or food products.</text> </clause></subparagraph></paragraph><paragraph id="H328BFB28C908440CB2340B8B94682097"><enum>(2)</enum><header>Updates</header><text>The Administrator shall periodically review and, as appropriate, update the list under paragraph (1).</text>
				</paragraph></subsection><subsection id="H5EF6F2013D594682A2EFBD83D6C875D8"><enum>(c)</enum><header>Regulations</header>
 <paragraph id="H939AD77E0B5F45E1AC55BDFEA1551EB8"><enum>(1)</enum><header>In general</header><text>Under the authorities vested in the Administrator by the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.) and any other applicable law (other than this section), the Administrator shall promulgate regulations addressing the contribution of non-auction greenhouse gases to global warming.</text>
 </paragraph><paragraph id="H73F08B2B2A074D68A1BB4083F5182B82"><enum>(2)</enum><header>International competitiveness</header><text>In promulgating regulations under this subsection, the Administrator shall take into consideration the effect of such regulations on the international competitiveness of businesses and industries of the United States.</text>
				</paragraph></subsection><subsection commented="no" id="H41C33E9E02154FD78378E868CEDFE928"><enum>(d)</enum><header>Schedule</header>
 <paragraph id="H771BDA1BE4EC4684867DA3652574313A"><enum>(1)</enum><header>In general</header><text>The regulations under subsection (c) shall ensure that—</text> <subparagraph commented="no" id="HA87D41FEA547458BA3CC295ABFB4DC3D"><enum>(A)</enum><text>not later than 4 years after the date of enactment of this Act, requirements take effect to regulate sources which, collectively, emit not less than 25 percent of non-auction greenhouse gases emitted in the United States;</text>
 </subparagraph><subparagraph id="H5FADAD0F439F4A50BB178E5CD3031491"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 6 years after the date of enactment of this Act, requirements take effect to regulate sources which, collectively, emit not less than 50 percent of non-auction greenhouse gases emitted in the United States;</text>
 </subparagraph><subparagraph id="H240EF62A61854815A2AFFFEB1F3A80D2"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 8 years after the date of enactment of this Act, requirements take effect to regulate sources which, collectively, emit not less than 75 percent of non-auction greenhouse gases emitted in the United States; and</text>
 </subparagraph><subparagraph id="H315CBAFA8BE047F48123E2E7054096EE"><enum>(D)</enum><text display-inline="yes-display-inline">not later than 10 years after the date of enactment of this Act, requirements take effect to regulate sources which, collectively, emit 100 percent of non-auction greenhouse gases emitted in the United States.</text>
 </subparagraph></paragraph><paragraph id="H78D71764413A47F693E1498182398A76"><enum>(2)</enum><header>Baseline</header><text>The percentages specified in paragraph (1) shall be applied relative to the aggregate quantity of non-auction greenhouse gases emitted in the United States during the calendar year in which the initial list under subsection (b)(1) is required to be finalized by such subsection.</text>
 </paragraph></subsection><subsection id="H655341BFC4F24D1D870767C7CB99FEFB"><enum>(e)</enum><header>Priorities</header><text display-inline="yes-display-inline">In determining priorities for regulating the emissions of non-auction greenhouse gases under subsection (c), the Administrator shall consider—</text>
 <paragraph id="HEFF1B0749ED84128A3934A636020A36C"><enum>(1)</enum><text>the degree to which the gases involved contribute to global warming; and</text> </paragraph><paragraph id="H01D14DF0CA5C495F8F7E201FC9E700E2"><enum>(2)</enum><text display-inline="yes-display-inline">the speed with which a given reduction would contribute to stabilizing the climate.</text>
 </paragraph></subsection><subsection id="HB4F2361447F54EA985B32323486BCAC3"><enum>(f)</enum><header>Citizen suits</header><text>The provisions of section 304 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7604">42 U.S.C. 7604</external-xref>) shall apply with respect to a violation of a requirement under this section, or the failure of the Administrator to perform a non-discretionary act or duty under this section, to the same extent and in the same manner as such provisions apply with respect to a violation described in subsection (a) of such section 304 or a failure to perform a non-discretionary act or duty described in such subsection.</text>
 </subsection><subsection id="H7ABDD33F40ED4E73AF43D3CA0FBC27F4"><enum>(g)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Administrator shall submit a report to the Congress identifying any additions or modifications to statutory provisions which are needed for the Administrator to effectively address the contribution of non-auction greenhouse gases to global warming.</text>
			</subsection></section><section id="H11CC4912066043ACA745548954FD8D7B"><enum>5.</enum><header>Disclosure of information</header>
 <subsection id="H45C0575D65C54BB6A0898D2C06D4DD3C"><enum>(a)</enum><header>Limited disclosure of identity</header><text display-inline="yes-display-inline">Subsection (l) of <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HE20873DFCF3E4579BF3236F84D74E405" style="OLC">
					<paragraph id="H335CCDB38B56429E8D8F267EC195EF49"><enum>(23)</enum><header>Limited disclosure of identity information relating to Healthy Climate Dividend Payments</header>
 <subparagraph id="HEF5CEC535E494242B2D15536730FCB38"><enum>(A)</enum><header>Department of the Treasury</header><text>Individual identity information shall, without written request, be open to inspection by or disclosure to officers and employees of the Department of the Treasury whose official duties require such inspection or disclosure for purposes of section 9912.</text>
 </subparagraph><subparagraph id="HADC6574EAD2E4FD1B1B8A144F4A83B0F"><enum>(B)</enum><header>Commissioner of Social Security</header><text>The Commissioner of Social Security shall, on written request, disclose to officers and employees of the Department of the Treasury individual identity information which has been disclosed to the Social Security Administration as provided by paragraph (1) or (5).</text>
 </subparagraph><subparagraph id="H5A46B92E917D4096AF73D554D76C2D5C"><enum>(C)</enum><header>Restriction on disclosure</header><text>Information disclosed under this paragraph shall be disclosed only for purposes of, and to the extent necessary in, carrying out section 9912.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA462B07D540E42C8B2D172054FE32592"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(p)(3)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or (18)</quote> and inserting <quote>, (23), or (21)</quote>.</text> </subsection></section><section display-inline="no-display-inline" id="HFD4ACA39CC1B45B7B5DC50270FC851A6"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date of the enactment of this Act.</text>
