<official-title display="yes">To require the Federal Communications Commission to establish a task force for reviewing the connectivity and technology needs of precision agriculture in the United States.</official-title>

<section id="H09EAF19B85F14E6CBCE3DDA10C7E85DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Precision Agriculture Connectivity Act of 2018</short-title></quote>.</text> </section> <section id="H51954EDAD3F4421A8F1FE4D1D3E7B195"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H9712674CC85B4CD888FB5EBDF758F931"><enum>(1)</enum><text>Precision agriculture technologies and practices allow farmers to significantly increase crop yields, eliminate overlap in operations, and reduce inputs such as seed, fertilizer, pesticides, water, and fuel.</text> </paragraph> <paragraph id="HC4CB0FA5A6414BC9AE534D7D1901021E"><enum>(2)</enum><text>These technologies allow farmers to collect data in real time about their fields, automate field management, and maximize resources.</text> </paragraph> 
<paragraph id="H1B5778A969A1499AB8261B84A538767D"><enum>(3)</enum><text>Studies estimate that precision agriculture technologies can reduce agricultural operation costs by up to 25 dollars per acre and increase farm yields by up to 70 percent by 2050.</text> </paragraph> <paragraph id="HA16351A2B3FF4CB6BA27CCD481F48059"><enum>(4)</enum><text>The critical cost savings and productivity benefits of precision agriculture cannot be realized without the availability of reliable broadband Internet access service delivered to the agricultural land of the United States.</text> </paragraph> 
<paragraph id="H83A082C3B6D041D780AA253A8431105C"><enum>(5)</enum><text>The deployment of broadband Internet access service to unserved agricultural land is critical to the United States economy and to the continued leadership of the United States in global food production.</text> </paragraph> <paragraph id="H836E5F2773F54706BDC577D3C3404133"><enum>(6)</enum><text>Despite the growing demand for broadband Internet access service on agricultural land, broadband Internet access service is not consistently available where needed for agricultural operations.</text> </paragraph> 
<paragraph id="HC52034693C6842FAB35C6A4ECD6817E8"><enum>(7)</enum><text>The Federal Communications Commission has an important role to play in the deployment of broadband Internet access service on unserved agricultural land to promote precision agriculture.</text> </paragraph></section> <section id="HF582A456739146FB97DD91063EB3186C"><enum>3.</enum><header>Task force</header> <subsection id="H86395E76331149CD82BA424DF3D2E8E3"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="HBC78B09ACBF64A36A096AF01D918CE53"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>broadband Internet access service</quote>—</text> <subparagraph id="H0490478FE3E3472F855CFF72DA0A374D"><enum>(A)</enum><text>means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all Internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up Internet access service; and</text> </subparagraph> 
<subparagraph id="H3E2DD4FF048840698A3734E42ACCBE40"><enum>(B)</enum><text>also encompasses any service that the Commission finds to be providing a functional equivalent of the service described in subparagraph (A);</text> </subparagraph></paragraph> <paragraph id="H727FCC8EC04F46DFB09A56DC3E3CC367"><enum>(2)</enum><text>the term <term>Commission</term> means the Federal Communications Commission;</text> </paragraph> 
<paragraph id="H9511F78D918844B1B74CCC75C46DA70E"><enum>(3)</enum><text>the term <term>Department</term> means the Department of Agriculture;</text> </paragraph> <paragraph id="H56FC708D574649F0BA3D4D2A01B5F7D8"><enum>(4)</enum><text>the term <term>Secretary</term> means the Secretary of Agriculture; and</text> </paragraph> 
<paragraph id="H71CB92F44FAF42E7B6728DCEBDE03CB5"><enum>(5)</enum><text>the term <term>Task Force</term> means the Task Force for Reviewing the Connectivity and Technology Needs of Precision Agriculture in the United States established under subsection (b).</text> </paragraph></subsection> <subsection id="HB5A063D413824C1BAE7E3AC8C59A495D"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall establish the Task Force for Reviewing the Connectivity and Technology Needs of Precision Agriculture in the United States.</text> </subsection> 
<subsection id="H6350987B890E46CB9CDD66BE6DB96F10"><enum>(c)</enum><header>Duties</header> 
<paragraph id="HF6C9A939A1314B12940AE2C1E5164D81"><enum>(1)</enum><header>In general</header><text>The Task Force shall consult with the Secretary, or a designee of the Secretary, and collaborate with public and private stakeholders in the agriculture and technology fields to—</text> <subparagraph id="HD2CAA522A70F4D829BC52F664C570817"><enum>(A)</enum><text>identify and measure current gaps in the availability of broadband Internet access service on agricultural land;</text> </subparagraph> 
<subparagraph id="HE03C76936AF24A66A0761488C5430948"><enum>(B)</enum><text>develop policy recommendations to promote the rapid, expanded deployment of broadband Internet access service on unserved agricultural land, with a goal of achieving reliable capabilities on 95 percent of agricultural land in the United States by 2025;</text> </subparagraph> <subparagraph id="HEE2F2248A8A14921B91C6918BF0E011B"><enum>(C)</enum><text>promote effective policy and regulatory solutions that encourage the adoption of broadband Internet access service on farms and ranches and promote precision agriculture;</text> </subparagraph> 
<subparagraph id="H58F6DBC37534484580614E9279B02FA2"><enum>(D)</enum><text>recommend specific new rules or amendments to existing rules of the Commission that the Commission should issue to achieve the goals and purposes of the policy recommendations described in subparagraph (B);</text> </subparagraph> <subparagraph id="H8EA0FC0A1F1242EA9E5FDE1A4DAB0212"><enum>(E)</enum><text>recommend specific steps that the Commission should take to obtain reliable and standardized data measurements of the availability of broadband Internet access service as may be necessary to target funding support, from future programs of the Commission dedicated to the deployment of broadband Internet access service, to unserved agricultural land in need of broadband Internet access service; and</text> </subparagraph> 
<subparagraph id="HED337DAA184C43399074E5C71907B1A0"><enum>(F)</enum><text>recommend specific steps that the Commission should consider to ensure that the expertise of the Secretary and available farm data are reflected in future programs of the Commission dedicated to the infrastructure deployment of broadband Internet access service and to direct available funding to unserved agricultural land where needed.</text> </subparagraph></paragraph> <paragraph id="HA07A49CB1D2C4072BEA8B8F91602EDBE"><enum>(2)</enum><header>No duplicate data reporting</header><text>In performing the duties of the Commission under paragraph (1), the Commission shall ensure that no provider of broadband Internet access service is required to report data to the Commission that is, on the day before the date of enactment of this Act, required to be reported by the provider of broadband Internet access service.</text> </paragraph> 
<paragraph id="H5136EB9B9D3F442C8FD7EECEB9F17EED"><enum>(3)</enum><header>Hold harmless</header><text>The Task Force and the Commission shall not interpret the phrase <quote>future programs of the Commission</quote>, as used in subparagraphs (E) and (F) of paragraph (1), to include the universal service programs of the Commission established under section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>).</text> </paragraph> <paragraph id="HC7D2D0A73E1E4DC596AF4F5A032B5711"><enum>(4)</enum><header>Consultation</header><text>The Secretary, or a designee of the Secretary, shall explain and make available to the Task Force the expertise, data mapping information, and resources of the Department that the Department uses to identify cropland, ranchland, and other areas with agricultural operations that may be helpful in developing the recommendations required under paragraph (1).</text> </paragraph> 
<paragraph id="H91885ACC425848B09684025B34CBC05C"><enum>(5)</enum><header>List of available Federal programs and resources</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary and the Commission shall jointly submit to the Task Force a list of all Federal programs or resources available for the expansion of broadband Internet access service on unserved agricultural land to assist the Task Force in carrying out the duties of the Task Force.</text> </paragraph></subsection> <subsection commented="no" id="HCDB2614C1A494F2183E0BB114AE92700"><enum>(d)</enum><header>Membership</header> <paragraph commented="no" id="H819A073FC2074297A66358B255664F4D"><enum>(1)</enum><header>In general</header><text>The Task Force shall be—</text> 
<subparagraph commented="no" id="H00D3E8076EF144AA90576E00B1D3894E"><enum>(A)</enum><text>composed of not more than 15 voting members who shall—</text> <clause commented="no" id="HFBE24AA5AFB144BDA1EF39795C4221EC"><enum>(i)</enum><text>be selected by the Chairman of the Commission, in consultation with the Secretary; and</text> </clause> 
<clause commented="no" id="HEF53482A73A24CCBB374694EC9AE6CCD"><enum>(ii)</enum><text>include—</text> <subclause commented="no" id="HE8415D0F1532490596399D8DFE7C6584"><enum>(I)</enum><text>agricultural producers representing diverse geographic regions and farm sizes, including owners and operators of farms of less than 100 acres;</text> </subclause> 
<subclause commented="no" id="H516DCF175CE141EDA8E15DB8D34F3AA5"><enum>(II)</enum><text>an agricultural producer representing tribal agriculture;</text> </subclause> <subclause id="H53B9FA1779224F30AC3A44E9559D832B"><enum>(III)</enum><text>Internet service providers, including regional or rural fixed and mobile broadband Internet access service providers and telecommunications infrastructure providers;</text> </subclause> 
<subclause id="HABAB72F1288048BF856EB90105B57003"><enum>(IV)</enum><text>representatives from the electric cooperative industry;</text> </subclause> <subclause id="HE1329D82D2B447B78848DF79EBAE111D"><enum>(V)</enum><text>representatives from the satellite industry;</text> </subclause> 
<subclause id="H78C413EBB9374F77BA35B616FAEAEEBB"><enum>(VI)</enum><text>representatives from precision agriculture equipment manufacturers, including drone manufacturers, manufacturers of autonomous agricultural machinery, and manufacturers of farming robotics technologies;</text> </subclause> <subclause id="H92FDDBE3C29C4572AA3E19E27EDCDEA3"><enum>(VII)</enum><text>representatives from State and local governments; and</text> </subclause> 
<subclause id="HB31FDB823A1C41758B21B5F645712569"><enum>(VIII)</enum><text display-inline="yes-display-inline">representatives with relevant expertise in broadband network data collection, geospatial analysis, and coverage mapping; and</text> </subclause></clause></subparagraph> <subparagraph commented="no" id="HD011AC5C53704D43BA1080DBE9AD418D"><enum>(B)</enum><text>fairly balanced in terms of technologies, points of view, and fields represented on the Task Force.</text> </subparagraph></paragraph> 
<paragraph id="H66FB4241ED4D49F285685F6410C80D01"><enum>(2)</enum><header>Period of appointment; vacancies</header> 
<subparagraph id="H6DD54D1A26F540F2B7F0C6A3353AA423"><enum>(A)</enum><header>In general</header><text>A member of the Task Force appointed under paragraph (1)(A) shall serve for a single term of 2 years.</text> </subparagraph> <subparagraph id="H7CAD550F5AD74DF6994AFC2FAC8E4F63"><enum>(B)</enum><header>Vacancies</header><text>Any vacancy in the Task Force—</text> 
<clause id="HA568923FFAAF4428AAD336A9D4C6AF35"><enum>(i)</enum><text>shall not affect the powers of the Task Force; and</text> </clause> <clause id="H7D016AE1C2124B76B3BA25AEB1759416"><enum>(ii)</enum><text>shall be filled in the same manner as the original appointment.</text> </clause></subparagraph></paragraph> 
<paragraph commented="no" id="H2BEF6026C1304DDA935D40A1DFC3E98A"><enum>(3)</enum><header>Ex-officio member</header><text>The Secretary, or a designee of the Secretary, shall serve as an ex-officio, nonvoting member of the Task Force.</text> </paragraph></subsection> <subsection id="H8F2DBB9FBF4F4E899846F6808EF99D25"><enum>(e)</enum><header>Reports</header><text>Not later than 1 year after the date on which the Commission establishes the Task Force, and annually thereafter, the Task Force shall submit to the Chairman of the Commission a report, which shall be made public not later than 30 days after the date on which the Chairman receives the report, that details—</text> 
<paragraph id="H500839A895C643B9A772B819EC9D982E"><enum>(1)</enum><text>the status of fixed and mobile broadband Internet access service coverage of agricultural land;</text> </paragraph> <paragraph id="H74CF6F8212BD49A2B1D47E0909B3528E"><enum>(2)</enum><text>the projected future connectivity needs of agricultural operations, farmers, and ranchers; and</text> </paragraph> 
<paragraph id="HB102D0305404438B8BC0C3EB99377925"><enum>(3)</enum><text>the steps being taken to accurately measure the availability of broadband Internet access service on agricultural land and the limitations of current, as of the date of the report, measurement processes.</text> </paragraph></subsection> <subsection id="H6CE1AB5B4E6849A9913B456C637DBE47"><enum>(f)</enum><header>Termination</header><text>The Commission shall renew the Task Force every 2 years until the Task Force terminates on January 1, 2025.</text></subsection></section> 
<section id="HE98420A4C14343439BABAF20C5FD35DE"><enum>4.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out this Act.
