<section id="H8267F87B19004C74B9480E1D80134D74" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CO<subscript>2</subscript> Regulatory Certainty Act</short-title></quote>.</text></section> <section id="HC31F09075FFD444696728FEB035F6A60"><enum>2.</enum><header>Secure geological storage of carbon dioxide</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45Q">Section 45Q(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text>

<paragraph id="H05C92FC0279441E89F55A7362AF2BD6E"><enum>(2)</enum><header>Secure geological storage</header> 
<subparagraph id="H617123597D004BFE9CDF956B458D610E"><enum>(A)</enum><header>In general</header><text>Not later than December 31, 2018, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, the Secretary of Energy, and the Secretary of the Interior, shall establish regulations for determining adequate security measures for the geological storage of carbon dioxide under paragraph (1)(B) or (2)(C) of subsection (a) such that the carbon dioxide does not escape into the atmosphere.</text></subparagraph> <subparagraph id="H67E3E344AA854FC08E6A2E7A1A44310F"><enum>(B)</enum><header>Requirements</header><text>The regulations established pursuant to subparagraph (A) shall provide that—</text> 
<clause id="H10D206EC2B7A425386166DDA73DEB759"><enum>(i)</enum><text>for purposes of paragraph (1)(B) of subsection (a), carbon dioxide shall be considered disposed of in secure geological storage if such carbon dioxide is stored in compliance with rules promulgated by the Environmental Protection Agency under subpart RR of part 98 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph) under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401</external-xref> et seq.), and rules under the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref> et seq.), which are applicable to carbon dioxide disposed of in secure geological storage and not used as a tertiary injectant in a qualified enhanced oil or natural gas recovery project, and</text></clause> <clause id="HED5F6405722D468CA6E738163C487142"><enum>(ii)</enum><text>for purposes of paragraph (2)(C) of subsection (a), carbon dioxide shall be considered disposed of in secure geological storage if such carbon dioxide is stored in compliance with rules promulgated by the Environmental Protection Agency which are applicable to carbon dioxide used as a tertiary injectant in a qualified enhanced oil or natural gas recovery project under—</text> 
<subclause id="H9F9DCB2387A34D1B9C2DC63FC2734B65"><enum>(I)</enum><text>subpart UU of part 98 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph) under the Clean Air Act, and</text></subclause> <subclause id="H61EFB77B2D17464EB6BFDF31A0C014D1"><enum>(II)</enum><text>subpart C of part 146 of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph) under the Safe Drinking Water Act, to the extent such rules are applicable to Class II wells.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HED7853101AF94888A7E1EA54DB1B51F3"><enum>3.</enum><header>Qualified enhanced oil or natural gas recovery project</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45Q">Section 45Q(d)(4)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> <paragraph id="H128483AD7D8E4C3DAA71752F87DDC192"><enum>(1)</enum><text>by striking <quote>by substituting</quote> and inserting </text> 
<quoted-block id="HCDFDA9596B2D48BD975DA97CA2C28096" style="OLC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">determined—</text> <subparagraph id="H7877319A408245FBA9DE7413A1EB2DF0"><enum>(A)</enum><text>by substituting—</text></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5A20B67B4E5D4CEBB964B5D945548330"><enum>(2)</enum><text>by striking the period and inserting <quote>, and</quote>, and</text></paragraph> <paragraph id="HE14CEE3552FC4A5ABCFAC928748E0487"><enum>(3)</enum><text>by inserting at the end the following:</text>
