 <section id="HBE4ECE8B53C447D68BB7A365B3190D71" section-type="section-one"><enum>1.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> <paragraph id="H9EBCC48247B1432998000C7BF32ACF20"><enum>(1)</enum><text>as noncontiguous States, Alaska and Hawaii are burdened with unique transportation challenges without viable alternatives;</text>
 </paragraph><paragraph id="HF2E8817F17E64DC08CBA3C0AA785C401"><enum>(2)</enum><text>communities in Alaska and Hawaii are reliant on air transportation, making it an essential lifeline for conducting business, receiving healthcare, and obtaining an education;</text>
 </paragraph><paragraph id="HE4624BB65C4D4FE1A6D9495675ACE0D1"><enum>(3)</enum><text>the people of Alaska and Hawaii historically have been exempt from essential air service eligibility requirements under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/417">chapter 417</external-xref> of title 49, United States Code, due to the necessity of air transportation; and</text>
 </paragraph><paragraph id="HC39CA1F107EB4EC9A3B95B8521BA27AD"><enum>(4)</enum><text>proposed changes to the essential air service program must consider this historical exemption for Alaska and Hawaii and recognize their reliance on air transportation.</text>
 </paragraph></section><section id="H658864F464174DA78A286B63B9CEF4EA" section-type="subsequent-section"><enum>2.</enum><header>EAS exemption for noncontiguous States</header><text display-inline="no-display-inline">The matter under the heading <quote>Department of Transportation—Office of the Secretary—Payments to Air Carriers</quote> in title I of the Transportation, Housing, and Urban Development, and Related Agencies Appropriations Act, 2017 (division K of <external-xref legal-doc="public-law" parsable-cite="pl/115/31">Public Law 115–31</external-xref>) is amended by inserting <quote>, excluding a community located in a noncontiguous State,” after “small hub airport</quote>.</text>
