 <section id="H86F8E0F715264093AF0EF2A1055243C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Broadband Permitting Efficiency Act of 2018</short-title></quote>.</text> </section><section id="H65188548923741BE9DB8877D2DEBE56F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
 <paragraph id="H70767DD07BE84A40AAE9D1E5768BCE5B"><enum>(1)</enum><header>Broadband project</header><text display-inline="yes-display-inline">The term <quote>broadband project</quote> means an installation by a broadband provider of wireless or broadband infrastructure, including but not limited to, copper lines, fiber optic lines, communications towers, buildings, or other improvements on Federal land.</text>
 </paragraph><paragraph id="H5D2B32925D2C47A4B35B142A58A13071"><enum>(2)</enum><header>Broadband provider</header><text display-inline="yes-display-inline">The term <quote>broadband provider</quote> means a provider of wireless or broadband infrastructure that enables a user to originate and receive high-quality voice, data, graphics, and video telecommunications.</text>
 </paragraph><paragraph id="H4A3E8BB511BD4B32BDBE6582AD078121"><enum>(3)</enum><header>Indian lands</header><text>The term <quote>Indian Lands</quote> means—</text> <subparagraph id="H5AF8000F6AF34FCE9C59A843885CF303"><enum>(A)</enum><text>any land owned by an Indian Tribe, located within the boundaries of an Indian reservation, pueblo, or rancheria; or</text>
 </subparagraph><subparagraph id="HA59F1776819E4DB0BF3317F4620FB750"><enum>(B)</enum><text>any land located within the boundaries of an Indian reservation, pueblo, or rancheria, the title to which is held—</text>
 <clause id="H324E2CA90E0F4F02A70FFD80AF508394"><enum>(i)</enum><text>in trust by the United States for the benefit of an Indian Tribe or an individual Indian;</text> </clause><clause id="H1D1F988ED13E43DF942ADA23A8EE4F49"><enum>(ii)</enum><text>by an Indian Tribe or an individual Indian, subject to restriction against alienation under laws of the United States; or</text>
 </clause><clause id="H9F422BF918664B9DB77F11F721C2406A"><enum>(iii)</enum><text>by a dependent Indian community.</text> </clause></subparagraph></paragraph><paragraph id="HA2AC728B422A4157A439B2A50071EFF7"><enum>(4)</enum><header>Indian tribe</header><text>The term <quote>Indian Tribe</quote> means a federally recognized Indian Tribe.</text>
 </paragraph><paragraph id="HC80A3C29972E42CB846E5A510F29D1C4"><enum>(5)</enum><header>Operational right-of-way</header><text>The term <quote>operational right-of-way</quote> means all real property interests (including easements) acquired for the construction or operation of a project, including the locations of the roadway, bridges, interchanges, culverts, drainage, clear zone, traffic control signage, landscaping, copper and fiber optic lines, utility shelters, and broadband infrastructure as installed by broadband providers, and any rest areas with direct access to a controlled access highway or the National Highway System.</text>
 </paragraph><paragraph id="H9DBE5C8C226D457E87B9FE6312C852C7"><enum>(6)</enum><header>Secretary concerned</header><text>The term <quote>Secretary concerned</quote> means—</text> <subparagraph id="H326BB14BF6804B009B8C21A3EEEAF9EE"><enum>(A)</enum><text>the Secretary of Agriculture (acting through the Chief of the Forest Service), with respect to National Forest System land; and</text>
 </subparagraph><subparagraph id="H0E406BD84C004899B23A318F10C9085D"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, with respect to land managed by the Department of the Interior (including land held in trust for an Indian Tribe).</text>
				</subparagraph></paragraph></section><section id="H2FEFCFCC4FA64A429CEEE5FE2241C828"><enum>3.</enum><header>State or Tribal permitting authority</header>
 <subsection id="H2666B17C9BFA486A9CABF3250D376CBC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned shall establish (or in the case where both Department of the Interior and National Forest System land would be affected, shall jointly establish) a voluntary program under which any State or Indian Tribe may offer, and the Secretary concerned may agree, to enter into a memorandum of understanding to allow for the State or Indian Tribe to prepare environmental analyses required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) for the permitting of broadband projects within an operational right-of-way on National Forest System land, land managed by the Department of the Interior, and Indian Lands. Under such a memorandum of understanding, an Indian Tribe or State may volunteer to cooperate with the signatories to the memorandum in the preparation of the analyses required under the National Environmental Policy Act of 1969.</text>
			</subsection><subsection id="H5BD3EC851C0F4F98A9FC8E2F35ED099F"><enum>(b)</enum><header>Assumption of responsibilities</header>
 <paragraph id="HA5851622A500413B9AA3DBA1245F387D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In entering into a memorandum of understanding under this section, the Secretary concerned may assign to the State or Indian Tribe, and the State or Indian Tribe may agree to assume, all or part of the responsibilities of the Secretary concerned for environmental analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.).</text>
				</paragraph><paragraph id="HD3E31AFA10DD48AE87F6AE5492E0B8E8"><enum>(2)</enum><header>State or Indian Tribe responsibility</header>
 <subparagraph id="HE7DE7A8C9678447ABBD0C7A7AAF59525"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility under paragraph (1) shall be subject to the same procedural and substantive requirements as would apply if the responsibility were carried out by the Secretary concerned.</text>
 </subparagraph><subparagraph id="H48C66F50D0AD414C97E91B1AAE0EC539"><enum>(B)</enum><header>Effect of assumption of responsibility</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility, including financial responsibility, under paragraph (1) shall be solely responsible and solely liable for carrying out, in lieu of the Secretary concerned, the responsibilities assumed under that paragraph until the date on which the program is terminated under subsection (g).</text>
 </subparagraph><subparagraph id="H04C08AAB66EF4F4FBE6D21AF40C2B382"><enum>(C)</enum><header>Environmental review</header><text display-inline="yes-display-inline">A State or Indian Tribe that assumes any responsibility under paragraph (1) shall comply with the environmental review procedures under parts 1500–1508 of title 40, Code of Federal Regulations (or successor regulations), and the regulations of the Secretary concerned.</text>
 </subparagraph></paragraph><paragraph id="H7E886D73431C4980BBF81E8F38D3BCE9"><enum>(3)</enum><header>Federal responsibility</header><text display-inline="yes-display-inline">Any responsibility of the Secretary concerned described in paragraph (1) that is not explicitly assumed by the State or Indian Tribe in the memorandum of understanding shall remain the responsibility of the Secretary concerned.</text>
 </paragraph></subsection><subsection id="H72AB2B634E6B4A6296408A8516212FF7"><enum>(c)</enum><header>Offer and notification</header><text display-inline="yes-display-inline">A State or Indian Tribe that intends to offer to enter into a memorandum of understanding under this section shall provide to the Secretary concerned notice of the intent of the State or Indian Tribe not later than 90 days before the date on which the State or Indian Tribe submits a formal written offer to the Secretary concerned.</text>
 </subsection><subsection id="H6865B79720FE46FEA471709A7F2C35AD"><enum>(d)</enum><header>Tribal consultation</header><text>Within 90 days of entering into any memorandum of understanding with a State, the Secretary concerned shall initiate consultation with relevant Indian Tribes.</text>
 </subsection><subsection id="HA9D485002112416687D27CE8793F6B1D"><enum>(e)</enum><header>Memorandum of understanding</header><text>A memorandum of understanding entered into under this section shall—</text> <paragraph id="HCEC6C03EE1984C19A5BD033D5C299DA8"><enum>(1)</enum><text display-inline="yes-display-inline">be executed by the Governor or the Governor’s designee, or in the case of an Indian Tribe, by an officer designated by the governing body of the Indian Tribe;</text>
 </paragraph><paragraph id="HF9F992221C514E328F5BCDEEE85F8D79"><enum>(2)</enum><text>be for a term not to exceed 10 years;</text> </paragraph><paragraph id="H4207AAD71E1D4AD3A6EECCC8DBAC117E"><enum>(3)</enum><text>be in such form as the Secretary concerned may prescribe;</text>
 </paragraph><paragraph id="H5B4F64E49A1E43E6AE6F9F044C806327"><enum>(4)</enum><text display-inline="yes-display-inline">provide that the State or Indian Tribe—</text> <subparagraph id="HA4FB913168D6480DA4A80303AB6C008E"><enum>(A)</enum><text>agrees to assume all or part of the responsibilities of the Secretary concerned described in subsection (b)(1);</text>
 </subparagraph><subparagraph id="H4A2BF3BDC56243639C1FD02EF9D27568"><enum>(B)</enum><text display-inline="yes-display-inline">expressly consents, including through the adoption of express waivers of sovereign immunity, on behalf of the State or Indian Tribe, to accept the jurisdiction of the Federal courts for the compliance, discharge, and enforcement of any responsibility of the Secretary concerned assumed by the State or Indian Tribe;</text>
 </subparagraph><subparagraph id="H5C5B35D3BE5D44A5A8FBE0A50C1B2612"><enum>(C)</enum><text display-inline="yes-display-inline">certify that State laws and regulations, with respect to States, or Tribal laws and regulations, with respect to Indian Tribes, are in effect that—</text>
 <clause id="H2740B9D29521456C91B9E0C702EC68F1"><enum>(i)</enum><text display-inline="yes-display-inline">authorize the State or Indian Tribe to take the actions necessary to carry out the responsibilities being assumed; and</text>
 </clause><clause id="HDB6DCF6710EB43DC927C0E99F5B0E636"><enum>(ii)</enum><text>are comparable to section 552 of title 5, United States Code, including providing that any decision regarding the public availability of a document under the State laws is reviewable by a court of competent jurisdiction;</text>
 </clause></subparagraph><subparagraph id="H246D16751F0F4290A4217361AD4E8ADF"><enum>(D)</enum><text>agrees to maintain the financial resources necessary to carry out the responsibilities being assumed;</text>
 </subparagraph><subparagraph id="HC119671FDBDE40368213C168BCF33CF4"><enum>(E)</enum><text display-inline="yes-display-inline">agrees to provide to the Secretary concerned any information the Secretary concerned considers necessary to ensure that the State or Indian Tribe is adequately carrying out the responsibilities assigned to and assumed by the State or Indian Tribe;</text>
 </subparagraph><subparagraph id="H5BE5E0C71E4741C083A9F726C4F92D80"><enum>(F)</enum><text>agrees to return revenues generated from the use of public lands authorized under this section to the United States annually, in accordance with the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H31E6B2051D544CE58D56E092C65989E4"><enum>(G)</enum><text>agrees to send a copy of all authorizing documents to the United States for proper notation and recordkeeping;</text>
 </subparagraph></paragraph><paragraph id="H694481191D1C4447870972AE3B656279"><enum>(5)</enum><text>prioritize and expedite any analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) under the memorandum of understanding;</text>
 </paragraph><paragraph id="H963771753DFA4251B6C6D16971E60A87"><enum>(6)</enum><text>not be granted to a State on Indian Lands without the consent of the relevant Indian Tribe; and</text> </paragraph><paragraph id="H23FF3EBB85294D3687648B8FA3DD1EDF"><enum>(7)</enum><text>not be granted to an Indian Tribe on State lands without the consent of the relevant State.</text>
 </paragraph></subsection><subsection id="HD36229D8E8344192ADF99E3F5E86D5E5"><enum>(f)</enum><header>Limitation</header><text>Nothing in this section permits a State or Indian Tribe to assume—</text> <paragraph id="H1F857224E2524B54900E8C15B730D0CC"><enum>(1)</enum><text>any rulemaking authority of the Secretary concerned under any Federal law; and</text>
 </paragraph><paragraph id="H3BC3EC76D9494E88B05AA01A659E0080"><enum>(2)</enum><text>Federal Government responsibilities for government-to-government consultation with Indian Tribes.</text> </paragraph></subsection><subsection id="HED02C103DC5E4AE49052B477328F8302"><enum>(g)</enum><header>Termination</header> <paragraph id="H45CD6067A2A64BD2B55EAAA66C5C317E"><enum>(1)</enum><header>Termination by the Secretary</header><text display-inline="yes-display-inline">The Secretary concerned may terminate the participation of any State or Indian Tribe in the program established under this section if—</text>
 <subparagraph id="HFCE2C8AD75704B59852BA36BA65C2AFE"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary concerned determines that the State or Indian Tribe is not adequately carrying out the responsibilities assigned to and assumed by the State or Indian Tribe;</text>
 </subparagraph><subparagraph id="H132EC058F363487F8A6F286370C7E49D"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary concerned provides to the State or Indian Tribe—</text> <clause id="H67DF868A2B8D4B38927EFAF14B3591DE"><enum>(i)</enum><text>notification of the determination of noncompliance; and</text>
 </clause><clause id="HE793521878A4421E9AE21A4EBA5EC970"><enum>(ii)</enum><text>a period of at least 30 days during which to take such corrective action as the Secretary concerned determines is necessary to comply with the applicable agreement; and</text>
 </clause></subparagraph><subparagraph id="H422EA4988CA54FF2BFEBC9C6AA2BCDA6"><enum>(C)</enum><text display-inline="yes-display-inline">the State or Indian Tribe, after the notification and period provided under subparagraph (B), fails to take satisfactory corrective action, as determined by the Secretary concerned.</text>
 </subparagraph></paragraph><paragraph id="H48758225C7A84540BBF486868B5E49AF"><enum>(2)</enum><header>Termination by the State or Indian Tribe</header><text display-inline="yes-display-inline">A State or Indian Tribe may terminate the participation of the State or Indian Tribe in the program established under this section at any time by providing to the Secretary concerned a notice of intent to terminate by not later than the date that is 90 days before the date of termination.</text>
 </paragraph><paragraph id="H400DD43A70D84382BC73EECF8883761F"><enum>(3)</enum><header>Termination of memorandum of understanding with State or Indian Tribe</header><text>A State or an Indian Tribe may terminate a joint memorandum of understanding under this section at any time by providing to the Secretary concerned a notice of intent to terminate by no later than the date that is 90 days before the date of termination.</text>
				</paragraph></subsection></section><section id="H4AFFC799062C4EFB90717CE5C2D72ECD"><enum>4.</enum><header>Categorical exclusion for projects within operational rights-of-way</header>
 <subsection id="H80E58588CD514791B1DC21ED0B1F9428"><enum>(a)</enum><header>Categorical exclusion established</header><text>Broadband projects carried out in an operational right-of-way are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text>
 </subsection><subsection id="HF2C4B30DBD34468981C30BE76E761C18"><enum>(b)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text>
			</subsection></section><section id="H2F657638C1554D5FAD7AD70F868E71C0"><enum>5.</enum><header>Federal broadband permit coordination</header>
 <subsection id="H3939B82C68F544BE943525D32EA86C2A"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary concerned shall establish a broadband permit streamlining team comprised of qualified staff under subsection (b)(4) in each State or regional office that has been delegated responsibility for issuing permits for broadband projects.</text>
			</subsection><subsection id="H56E846A1235C48AB9D75D1F6599ACE09"><enum>(b)</enum><header>Memorandum of understanding</header>
 <paragraph id="HF841068C8C174F709BF5A75AE52AD9DF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary concerned, in consultation with the National Conference of State Historic Preservation Officers and the National Tribal Historic Preservation Officers Association, shall enter into a memorandum of understanding to carry out this section with—</text>
 <subparagraph id="H2C61CC0B120A4B9DA6B383D92BB5CA5E"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture or of the Interior, as appropriate;</text> </subparagraph><subparagraph id="H6945ACD0B2F640DA847758B27341D63A"><enum>(B)</enum><text display-inline="yes-display-inline">the Director of the Bureau of Indian Affairs; and</text>
 </subparagraph><subparagraph id="HA65501F4BB234F4DAC2438B7C6AA8AB4"><enum>(C)</enum><text>the Director of the United States Fish and Wildlife Service.</text> </subparagraph></paragraph><paragraph id="HBFFA17E0D9F84265923F2981A2C951D2"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the memorandum of understanding under paragraph (1) is to coordinate and expedite permitting decisions for broadband projects.</text>
 </paragraph><paragraph id="HFE67773A2FB9412F930AB67AFCF6AD99"><enum>(3)</enum><header>State or Tribal participation</header><text display-inline="yes-display-inline">The Secretary concerned may request that the Governor of any State or the officer designated by the governing body of the Indian Tribe with one or more broadband projects be a party to the memorandum of understanding under paragraph (1).</text>
				</paragraph><paragraph id="HDB8065F2548143E8AE83F8F0CD5993EE"><enum>(4)</enum><header>Designation of qualified staff</header>
 <subparagraph id="HCC1CBBF4ABA9427D83CB4345F6D81174"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of entrance into the memorandum of understanding under paragraph (1), the head of each Federal agency that is a party to the memorandum of understanding (other than the Secretary concerned) may, if the head of the Federal agency determines it to be appropriate, designate to each State or regional office an employee of that Federal agency with expertise in regulatory issues relating to that Federal agency, including, as applicable, particular expertise in—</text>
 <clause id="H7CE273C6BC37481BAA8ABE6609C34194"><enum>(i)</enum><text display-inline="yes-display-inline">planning under the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600</external-xref> et seq.) and planning under the Federal Land Policy Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.);</text>
 </clause><clause id="HA2424CE3C6C54ECB8F48E03B4C5D321C"><enum>(ii)</enum><text>the preparation of analyses under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); or</text>
 </clause><clause id="H24F4C38E2DF24A1FAFDB9B961D7416BA"><enum>(iii)</enum><text>consultation and the preparation of biological opinions under section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text>
 </clause></subparagraph><subparagraph id="H2D293FD254F645D897E3F26360EEBDF5"><enum>(B)</enum><header>Duties</header><text>Each employee designated under subparagraph (A) shall—</text> <clause id="H9B002BEAC9B944C5BF27442EFFAA6667"><enum>(i)</enum><text display-inline="yes-display-inline">be responsible for any issue relating to any broadband project within the jurisdiction of the State or regional office under the authority of the Federal agency from which the employee is assigned;</text>
 </clause><clause id="HE4040791C2DC47CCBEB0ADFFAC251C06"><enum>(ii)</enum><text>participate as part of the team of personnel working on one or more proposed broadband projects, including planning and environmental analyses; and</text>
 </clause><clause id="H038E4EF66B9846588C4B78551568E44A"><enum>(iii)</enum><text display-inline="yes-display-inline">serve as the designated point of contact with any applicable State or Indian Tribe that assumes any responsibility under section 3(b)(1) relating to any issue described in clause (i).</text>
