			 provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to provide for a new rule regarding the application of the
			 Act to marihuana, and for other purposes.</official-title></form>

 <section id="HFF9C2E19624E4002AF547377358BE0D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marijuana Justice Act of 2018</short-title></quote>.</text> </section><section id="HFE34703BA6E54CAA90BA0206C8C2697B"><enum>2.</enum><header>De-scheduling marihuana</header> <subsection id="H010F81B419A0482AAC00830D044952CF"><enum>(a)</enum><header>Marihuana removed from schedule of controlled substances</header><text>Subsection (c) of schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>) is amended—</text>
 <paragraph id="HCC3C6FAD5AD6472181624BE83867A1C1"><enum>(1)</enum><text>by striking <quote>marihuana</quote>; and</text> </paragraph><paragraph id="H4F3DD144F6A44001B0271BF77C733AA7"><enum>(2)</enum><text>by striking <quote>tetrahydrocannabinols</quote>.</text>
 </paragraph></subsection><subsection id="H221998B783C04F6CBA975C733A95F612"><enum>(b)</enum><header>Removal of Prohibition on Import and Export</header><text>Section 1010(b) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960</external-xref>) is amended—</text> <paragraph id="H03E51D8107B044C39E4924B0ED27B6ED"><enum>(1)</enum><text>in paragraph (1)—</text>
 <subparagraph id="HABB99941EA4C496EA6E5C07F48A2E1E4"><enum>(A)</enum><text>in subparagraph (F), by inserting <quote>or</quote> after the semicolon;</text> </subparagraph><subparagraph id="H9A3D7C98FE6C48CC97D923800AED8F37"><enum>(B)</enum><text>by striking subparagraph (G); and</text>

 </paragraph></subsection><subsection id="H7DC685FCA48B4CF3885BF8872732B7FA"><enum>(c)</enum><header>Conforming amendments to Controlled Substances Act</header><text display-inline="yes-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801</external-xref> et seq.) is amended—</text> <paragraph id="HD924F1CBA38341E5AEA43782440CAC46"><enum>(1)</enum><text>in section 102(44) (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(44)</external-xref>), by striking <quote>marihuana,</quote>;</text>
 </paragraph><paragraph id="H27DB027366044220B1C2DB38B59A2D09"><enum>(2)</enum><text>in section 401(b) (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)</external-xref>)—</text> <subparagraph id="H68F7F87A99A441BEA93DE2BD9E52CE4F"><enum>(A)</enum><text>in paragraph (1)—</text>

 </subparagraph></paragraph><paragraph id="HBEA32DC5C8D049C2818052312F238AAD"><enum>(8)</enum><text>in section 516(d) (<external-xref legal-doc="usc" parsable-cite="usc/21/886">21 U.S.C. 886(d)</external-xref>), by striking <quote>section 401(b)(6)</quote> each place the term appears and inserting <quote>section 401(b)(5)</quote>.</text> </paragraph></subsection><subsection id="H69EF0E1238FF46B1AC58D93B91DEF85A"><enum>(d)</enum><header>Other conforming amendments</header> <paragraph id="H04993B5684E1458AB3D026870D0AF145"><enum>(1)</enum><header>National Forest System Drug Control Act of 1986</header><text>The National Forest System Drug Control Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b</external-xref> et seq.) is amended—</text>
 <subparagraph id="H368F8FD30A664DFC961B9C6EC04BAED1"><enum>(A)</enum><text>in section 15002(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/559b">16 U.S.C. 559b(a)</external-xref>) by striking <quote>marijuana and other</quote>;</text> </subparagraph><subparagraph id="HDCCA4A6404A6458786115F98FA7E700E"><enum>(B)</enum><text>in section 15003(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559c">16 U.S.C. 559c(2)</external-xref>) by striking <quote>marijuana and other</quote>; and</text>
 </subparagraph><subparagraph id="H3AC2A4D531794E61AFB5C2779174FDA8"><enum>(C)</enum><text>in section 15004(2) (<external-xref legal-doc="usc" parsable-cite="usc/16/559d">16 U.S.C. 559d(2)</external-xref>) by striking <quote>marijuana and other</quote>.</text> </subparagraph></paragraph><paragraph id="HCE454F2B516545B4833C4B2F7EFEC90D"><enum>(2)</enum><header>Interception of Communications</header><text>Section 2516 of title 18, United States Code, is amended—</text>
 <subparagraph id="HBA57EAC49E454230AF2B91405D783ECE"><enum>(A)</enum><text>in subsection (1)(e), by striking <quote>marihuana,</quote>; and</text> </subparagraph><subparagraph id="H2B1B1ABE9D1B44449C79E2AEE930BAEE"><enum>(B)</enum><text>in subsection (2) by striking <quote>marihuana,</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H1BC3166CC4EB4EB4BAA45E826FBE4D65"><enum>3.</enum><header>Ineligibility for certain funds</header>
 <subsection id="H3764CB61B5574047B2DFC9C954C85F63"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H6DCE240A17514322B93F380B06AF6ED3"><enum>(1)</enum><text>the term <term>covered State</term> means a State that has not enacted a statute legalizing marijuana in the State;</text>
 </paragraph><paragraph id="H5C301B40027B4B328148D707F5CECE8D"><enum>(2)</enum><text>the term <term>disproportionate arrest rate</term> means—</text> <subparagraph id="HC69FAA42FFD94E10AFF5A35102589A15"><enum>(A)</enum><text>the percentage of minority individuals arrested for a marijuana related offense in a State is higher than the percentage of the non-minority individual population of the State, as determined by the most recent census data; or</text>
 </subparagraph><subparagraph id="HA3F0214E97A042A9A6E568AF8581600A"><enum>(B)</enum><text>the percentage of low-income individuals arrested for a marijuana offense in a State is higher than the percentage of the population of the State that are not low-income individuals, as determined by the most recent census data;</text>
 </subparagraph></paragraph><paragraph id="HA0615A182DA94643B43E06EBCFC3DFE1"><enum>(3)</enum><text>the term <term>disproportionate incarceration rate</term> means the percentage of minority individuals incarcerated for a marijuana related offense in a State is higher than the percentage of the non-minority individual population of the State, as determined by the most recent census data;</text>
 </paragraph><paragraph commented="no" id="H1155911C0FB5489CB7B9ED686C7A1335"><enum>(4)</enum><text>the term <term>low-income individual</term> means an individual whose taxable income (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/63">section 63</external-xref> of the Internal Revenue Code of 1986) is equal to or below the maximum dollar amount for the 15 percent rate bracket applicable to the individual under <external-xref legal-doc="usc" parsable-cite="usc/26/1">section 1</external-xref> of the Internal Revenue Code of 1986;</text>
 </paragraph><paragraph id="H0CA5F7FE489C4631B643FC1FEC2E32EC"><enum>(5)</enum><text>the term <term>marijuana</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); and</text> </paragraph><paragraph id="H4FBE1502620045319687F5424B99AC9C"><enum>(6)</enum><text>the term <term>minority individual</term> means an individual who is a member of a racial or ethnic minority group.</text>
				</paragraph></subsection><subsection id="H1C39B26775A8468B9B4D0363AF37C99E"><enum>(b)</enum><header>Ineligibility for certain funds</header>
 <paragraph id="HF0431418A5D048958FAE54C338AB5FCC"><enum>(1)</enum><header>In general</header><text>For any fiscal year beginning after the date of enactment of this Act in which the Attorney General, acting through the Director of the Bureau of Justice Assistance, determines that a covered State has a disproportionate arrest rate or a disproportionate incarceration rate for marijuana offenses, the covered State—</text>
 <subparagraph id="HD4F86D44CE9E44B8ACF7493BB74F4F99"><enum>(A)</enum><text>shall not be eligible to receive any Federal funds for the construction or staffing of a prison or jail; and</text>
 </subparagraph><subparagraph id="HFC796D88AFC64E8E8E1BAB0A4A23D11F"><enum>(B)</enum><text>shall be subject to not more than a 10-percent reduction of the funds that would otherwise be allocated for that fiscal year to the covered State under subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750</external-xref> et seq.), whether characterized as the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Local Government Law Enforcement Block Grants Program, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise.</text>
 </subparagraph></paragraph><paragraph id="HE5B796191340412DA76BE78EF8170DEC"><enum>(2)</enum><header>Funds for certain programming</header><text>For purposes of paragraph (1)(A), Federal funds for the construction or staffing of a prison or jail shall not include Federal funds used by a prison or jail to carry out recidivism reduction programming or drug addiction treatment.</text>
 </paragraph><paragraph id="HC945A24FB46F4FBFB3AE184E5D3E7276"><enum>(3)</enum><header>Reallocation</header><text>Any amounts not awarded to a covered State because of a determination under paragraph (1) shall be deposited in the Community Reinvestment Fund established under section 4.</text>
 </paragraph></subsection><subsection commented="no" id="HC52BF80F3FB140FF95E5CE043111AC4A"><enum>(c)</enum><header>Expungement of marijuana offense convictions</header><text>Each Federal court shall issue an order expunging each conviction for a marijuana use or possession offense entered by the court before the date of enactment of this Act.</text>
			</subsection><subsection id="HEE6F6CA3FF9C4918A8AF1478271531B7"><enum>(d)</enum><header>Sentencing review</header>
 <paragraph id="HD66C31BCAAB04B49BB2C2B5226991516"><enum>(1)</enum><header>In general</header><text>For any individual who was sentenced to a term of imprisonment for a Federal criminal offense involving marijuana before the date of enactment of this Act and is still serving such term of imprisonment, the court that imposed the sentence, shall, on motion of the individual, the Director of the Bureau of Prisons, the attorney for the Government, or the court, conduct a sentencing hearing.</text>
 </paragraph><paragraph id="HD397E47B6FEA47CAA95AFA8CEBBA42DE"><enum>(2)</enum><header>Potential reduced resentencing</header><text>After a sentencing hearing under paragraph (1), a court may impose a sentence on the individual as if this Act, and the amendments made by this Act, were in effect at the time the offense was committed.</text>
				</paragraph></subsection><subsection commented="no" id="HDC73756406624C04B135F0CD5830A72D"><enum>(e)</enum><header>Right of action</header>
 <paragraph commented="no" id="HADB539750B664D3398F0FA2008B4DE7C"><enum>(1)</enum><header>In general</header><text>An individual who is aggrieved by a disproportionate arrest rate or a disproportionate incarceration rate of a State may bring a civil action in an appropriate district court of the United States.</text>
 </paragraph><paragraph commented="no" id="HD82CDB597F0D435C912676BA1CE8FBE8"><enum>(2)</enum><header>Relief</header><text>In a civil action brought under this subsection in which the plaintiff prevails, the court shall—</text> <subparagraph commented="no" id="H768491C440584AB9BB80C81E26D0A0CD"><enum>(A)</enum><text>grant all necessary equitable and legal relief, including declaratory relief; and</text>
 </subparagraph><subparagraph commented="no" id="HD87B9124457443BD849BD64795E1BD51"><enum>(B)</enum><text>issue an order requiring the Attorney General, acting through the Director of the Bureau of Justice Assistance, to—</text>
 <clause commented="no" id="H1471073BCB4E490C9DA234DDCB75582D"><enum>(i)</enum><text>declare the State to be ineligible to receive any Federal funds for the construction or staffing of a prison or jail in accordance with subsection (b)(1)(A); and</text>
 </clause><clause commented="no" id="HE86C6750AA0044C6BA7EB1D370DB3E7B"><enum>(ii)</enum><text>reduce grant funding of the State in accordance with subsection (b)(1)(B).</text> </clause></subparagraph></paragraph></subsection></section><section commented="no" id="HE6620C2D7FDA46DA91B2A7B06780E885"><enum>4.</enum><header>Community Reinvestment Fund</header> <subsection commented="no" id="HFA84D434A2AB4DB398906E36839471A6"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Community Reinvestment Fund</quote> (referred to in this section as the <quote>Fund</quote>).</text>
 </subsection><subsection id="H42E28372520D45ECAE6702C49C936D94"><enum>(b)</enum><header>Deposits</header><text>The Fund shall consist of—</text> <paragraph id="H19FF9493D22749268C6247B59D42535D"><enum>(1)</enum><text>any amounts not awarded to a covered State because of a determination under section 3(b)(1); and</text>
 </paragraph><paragraph id="H4F22A50941ED458895C316AC2317DFF2"><enum>(2)</enum><text>any amounts otherwise appropriated to the Fund.</text> </paragraph></subsection><subsection id="H89F3F014C3564E21AB0D349EC9CA5614"><enum>(c)</enum><header>Use of Fund amounts</header><text>Amounts in the Fund shall be available to the Secretary of Housing and Urban Development to establish a grant program to reinvest in communities most affected by the war on drugs, which shall include providing grants to impacted communities for programs such as—</text>
 <paragraph id="H71BD55E2AFD641228D3C7EB37A467F34"><enum>(1)</enum><text>job training;</text> </paragraph><paragraph id="H7DDC8C08C0964C2CBA34A41267EC569F"><enum>(2)</enum><text>reentry services;</text>
 </paragraph><paragraph id="H1D96BE047611402A9F1A36951E608D89"><enum>(3)</enum><text>expenses related to the expungement of convictions;</text> </paragraph><paragraph id="H179DA8C033C241F69F7696C04905C41B"><enum>(4)</enum><text>public libraries;</text>
 </paragraph><paragraph id="HCC66F300C4414791A4B5E89C713555C5"><enum>(5)</enum><text>community centers;</text> </paragraph><paragraph id="H66ADBFF7CB814B319B2B486797A2B397"><enum>(6)</enum><text>programs and opportunities dedicated to youth;</text>
