 <section id="H37996CDCCCA140EFA63703DE1DE22653" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Indian Community Economic Enhancement Act of 2018</quote>.</text> </section><section id="HB77D2D6123D741B0A778ABAB64F3CE27"><enum>102.</enum><header>Native American Business Development, Trade Promotion, and Tourism Act of 2000</header> <subsection id="H88D2675780534F7FA6E68D236C4B61A2"><enum>(a)</enum><header>Findings; purposes</header><text display-inline="yes-display-inline">Section 2 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HC0FD68DE8B374A43AEF07FF7B1EC6355" reported-display-style="italic" style="OLC">
 <subsection commented="no" display-inline="no-display-inline" id="H35E5995693AF405183F8A93237DD96B0"><enum>(c)</enum><header>Applicability to Indian-Owned businesses</header><text display-inline="yes-display-inline">The findings and purposes in subsections (a) and (b) shall apply to any Indian-owned business governed—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="H2E938A6B24AD4FE1822B748801B25534"><enum>(1)</enum><text display-inline="yes-display-inline">by tribal laws regulating trade or commerce on Indian lands; or</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H695525EA15904ED1BFCF990B0E76A26B"><enum>(2)</enum><text display-inline="yes-display-inline">pursuant to section 5 of the Act of August 15, 1876 (19 Stat. 200, chapter 289; <external-xref legal-doc="usc" parsable-cite="usc/25/261">25 U.S.C. 261</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H6E2953ED17F74E668944A606DDB02690"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Native American Business Development, Trade Promotion, and Tourism Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4302">25 U.S.C. 4302</external-xref>) is amended—</text>
 <paragraph commented="no" id="H0F10BEC9391C4870BE2D3E6448FE3D82"><enum>(1)</enum><text>by redesignating paragraphs (1) through (6) and paragraphs (7) through (9), as paragraphs (2) through (7) and paragraphs (9) through (11), respectively;</text>

 <paragraph id="H97F324B3D5A946779BCE555724CD488D"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="H1D97BA7E9CC84B74A7B1F0FE72810353"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="H8E0B4572D2824753BF976AD289492DD8"><enum>(i)</enum><text>by striking <quote>Department of Commerce</quote> and inserting <quote>Office of the Secretary</quote>; and</text> </clause><clause id="HF7BCAF81CF0843B89FC712BC683A28A8"><enum>(ii)</enum><text>by striking <quote>(referred to in this Act as the <term>Office</term>)</quote>; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42A62866E15F4DAC92F209096B6F0F1B"><enum>(B)</enum><text>in paragraph (2), in the first sentence, by striking <quote>(referred to in this Act as the <term>Director</term>)</quote>; and</text> </subparagraph></paragraph><paragraph id="H309BDC6E0F864D2BB65DED4C7431C214"><enum>(2)</enum><text>by adding at the end the following:</text>

							<subsection id="HA193749BA7B14C60BE222EA84C2B35A0"><enum>(c)</enum><header>Duties of Director</header>
 <paragraph id="HB94CB9DA29364C91B92D4F341FAEB9C2"><enum>(1)</enum><header>In general</header><text>The Director shall serve as—</text> <subparagraph id="HC250FFAD4E5847148B54AED1B3E6FC5F"><enum>(A)</enum><text>the program and policy advisor to the Secretary with respect to the trust and governmental relationship between the United States and Indian tribes; and</text>
 </subparagraph><subparagraph id="H3581382C220B418584241B3164544E9F"><enum>(B)</enum><text>the point of contact for Indian tribes, tribal organizations, and Indians regarding—</text> <clause id="H6D0A19F935B34A269D99535BAB817820"><enum>(i)</enum><text>policies and programs of the Department of Commerce; and</text>
 </clause><clause id="H7980A0C14AE14E37B45EFA9A77F82BE4"><enum>(ii)</enum><text>other matters relating to economic development and doing business in Indian lands.</text> </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E6EFA2A07CE4AFA8800FA483F868774"><enum>(2)</enum><header>Departmental coordination</header><text>The Director shall coordinate with all offices and agencies within the Department of Commerce to ensure that each office and agency has an accountable process to ensure—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="HD46B13318D9E4947B5C4F5CEE289493E"><enum>(A)</enum><text>meaningful and timely coordination and assistance, as required by this Act; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEC107A8574A3403DACCE57CFA7462090"><enum>(B)</enum><text>consultation with Indian tribes regarding the policies, programs, assistance, and activities of the offices and agencies.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H2FDB3D5986DF4188A39A19D2A878868B"><enum>(d)</enum><header>Indian community development initiatives</header><text display-inline="yes-display-inline">The Native American Business Development, Trade Promotion, and Tourism Act of 2000 is amended—</text> <paragraph id="H7147494342DB4367B699F5CC45AEC55F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 8 (<external-xref legal-doc="usc" parsable-cite="usc/25/4307">25 U.S.C. 4307</external-xref>) as section 9; and</text>
 </paragraph><paragraph id="H4778BAC3F53A4886A75E1C64ED66BF60"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 7 (<external-xref legal-doc="usc" parsable-cite="usc/25/4306">25 U.S.C. 4306</external-xref>) the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HE85CE04A84DE4D6A91C0DB0E08A4BF80" reported-display-style="italic" style="OLC"> <section id="H9375C7C7FAB24CF6BC15D098294460F3"><enum>8.</enum><header>Indian community development initiatives</header> <subsection id="H885EC385AE424FCE8819AE9CAC800FC4"><enum>(a)</enum><header>Interagency coordination</header><text>Not later than 1 year after the enactment of this section, the Secretary, the Secretary of the Interior, and the Secretary of the Treasury shall coordinate—</text>
 <paragraph id="HB857A94E704A4B4F83D4BF3AB346C88F"><enum>(1)</enum><text>to develop initiatives that—</text> <subparagraph id="H677A52ABA1AD46FE875BEC0426A81560"><enum>(A)</enum><text>encourage, promote, and provide education regarding investments in Indian communities through—</text>
 <clause id="H9277FF273AF34825B344C413129753AB"><enum>(i)</enum><text>the loan guarantee program of Bureau of Indian Affairs under section 201 of the Indian Financing Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/25/1481">25 U.S.C. 1481</external-xref>);</text>
 </clause><clause id="H9A4583614A8347ABB1D71857F9A60EDD"><enum>(ii)</enum><text>programs carried out using amounts in the Community Development Financial Institutions Fund established under section 104(a) of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703(a)</external-xref>); and</text>
 </clause><clause id="H55C81758E2474A129B7D70D18A4C5551"><enum>(iii)</enum><text>other capital development programs;</text> </clause></subparagraph><subparagraph id="H52D731BD17894128A697DDEB87E69D5B"><enum>(B)</enum><text>examine and develop alternatives that would qualify as collateral for financing in Indian communities; and</text>
 </subparagraph><subparagraph id="HB7661314EA60411FA955EEB91FD861EB"><enum>(C)</enum><text>provide entrepreneur and other training relating to economic development through tribally controlled colleges and universities and other Indian organizations with experience in providing such training;</text>
 </subparagraph></paragraph><paragraph id="H2E6C0389413E4B8B80A94447247E9FD7"><enum>(2)</enum><text display-inline="yes-display-inline">to consult with Indian tribes and with the Securities and Exchange Commission to study, and collaborate to establish, regulatory changes necessary to qualify an Indian tribe as an accredited investor for the purposes of sections 230.500 through 230.508 of title 17, Code of Federal Regulations (or successor regulations), consistent with the goals of promoting capital formation and ensuring qualifying Indian tribes have the ability to withstand investment loss, on a basis comparable to other legal entities that qualify as accredited investors who are not natural persons;</text>
 </paragraph><paragraph id="HBB9779873AF64E37AFB0DB0C3D6CBB89"><enum>(3)</enum><text>to identify regulatory, legal, or other barriers to increasing investment, business, and economic development, including qualifying or approving collateral structures, measurements of economic strength, and contributions of Indian economies in Indian communities through the Authority established under section 4 of the Indian Tribal Regulatory Reform and Business Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/25/4301">25 U.S.C. 4301</external-xref> note);</text>
 </paragraph><paragraph id="HA01E63FBC1A346A2BD37EC459AAB0C52"><enum>(4)</enum><text>to ensure consultation with Indian tribes regarding increasing investment in Indian communities and the development of the report required in paragraph (5); and</text>
 </paragraph><paragraph id="H3A2F4E0C216749249E8F20E3B3EADA8A"><enum>(5)</enum><text>to provide a report to Congress regarding improvements to Indian communities resulting from such initiatives and recommendations for promoting sustained growth of the tribal economies.</text>
 </paragraph></subsection><subsection id="HC5BD71FEFF0F447BB5E585D7042968B1"><enum>(b)</enum><header>Waiver</header><text>For assistance provided pursuant to section 108 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4707">12 U.S.C. 4707</external-xref>) to benefit Native Community Development Financial Institutions, as defined by the Secretary of the Treasury, section 108(e) of such Act shall not apply.</text>
								</subsection><subsection id="HAC58105443854C5E9AA3C12565A54747"><enum>(c)</enum><header>Indian economic development feasibility study</header>
 <paragraph id="HF7FAEAEDF7BB47A893649D86139C4BE6"><enum>(1)</enum><header>In general</header><text>The Government Accountability Office shall conduct a study and, not later than 18 months after the date of enactment of this subsection, submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report on the findings of the study and recommendations.</text>
 </paragraph><paragraph id="H553C5696AE224C79A16491B31742E506"><enum>(2)</enum><header>Contents</header><text>The study shall include an assessment of each of the following:</text> <subparagraph id="HD2D2B816F1A04CE7AA4F8776085285CA"><enum>(A)</enum><header>In general</header><text>The study shall assess current Federal capitalization and related programs and services that are available to assist Indian communities with business and economic development, including manufacturing, physical infrastructure (such as telecommunications and broadband), community development, and facilities construction for such purposes. For each of the Federal programs and services identified, the study shall assess the current use and demand by Indian tribes, individuals, businesses, and communities of the programs, the capital needs of Indian tribes, businesses, and communities related to economic development, and the extent that similar programs have been used to assist non-Indian communities compared to the extent used for Indian communities.</text>
 </subparagraph><subparagraph id="H1A4A749B9DF24A67999F39C04702A409"><enum>(B)</enum><header>Financing assistance</header><text display-inline="yes-display-inline">The study shall assess and quantify the extent of assistance provided to non-Indian borrowers and to Indian (both tribal and individual) borrowers (including information about such assistance as a percentage of need for Indian borrowers and for non-Indian borrowers, assistance to Indian borrowers and to non-Indian borrowers as a percentage of total applicants, and such assistance to Indian borrowers as individuals as compared to such assistance to Indian tribes) through the loan programs, the loan guarantee programs, or bond guarantee programs of the—</text>
 <clause id="H81F4958959E841B6B7D583FB8370BA23"><enum>(i)</enum><text>Department of the Interior;</text> </clause><clause id="HBD630D21C71B465F95156A474A5738C1"><enum>(ii)</enum><text>Department of Agriculture;</text>
 </clause><clause id="HCC1BFD342D43400EB44A24FBAEE46A93"><enum>(iii)</enum><text>Department of Housing and Urban Development;</text> </clause><clause id="HC09EA85E7C464522B3D8328DCF3BBC57"><enum>(iv)</enum><text>Department of Energy;</text>
 </clause><clause id="HF04141B572674347AEC5CAB270ECFB86"><enum>(v)</enum><text>Small Business Administration; and</text> </clause><clause id="H39BACFEF6F584D0A93D2A45CB1A06C30"><enum>(vi)</enum><text>Community Development Financial Institutions Fund of the Department of the Treasury.</text>
 </clause></subparagraph><subparagraph id="HEFE2376E32F74052AB86FF5837FE7FEF"><enum>(C)</enum><header>Tax incentives</header><text>The study shall assess and quantify the extent of the assistance and allocations afforded for non-Indian projects and for Indian projects pursuant to each of the following tax incentive programs:</text>

 </clause><clause id="H4CE5FCF993E84D8C80DFF00B8639C974"><enum>(v)</enum><text>Accelerated depreciation.</text> </clause></subparagraph><subparagraph id="H7307356DEB424F7DA0284E0AB52C4798"><enum>(D)</enum><header>Tribal investment incentive</header><text>The study shall assess various alternative incentives that could be provided to enable and encourage tribal governments to invest in an Indian community development investment fund or bank.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HDD11D32087994636A2F742A46044325F"><enum>103.</enum><header>Buy Indian Act</header><text display-inline="no-display-inline">Section 23 of the Act of June 25, 1910 (commonly known as the <quote>Buy Indian Act</quote>) (36 Stat. 861, chapter 431; <external-xref legal-doc="usc" parsable-cite="usc/25/47">25 U.S.C. 47</external-xref>), is amended to read as follows:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H6E930889B34A46B892BEC6A6B4F5AAFE" reported-display-style="italic" style="OLC"> <section id="H1D734056253B49249EA0C9126FC0BBCB"><enum>23.</enum><header>Employment of Indian labor and purchase of products of Indian industry; participation in Mentor-Protege Program</header> <subsection id="H232016E804AA4728BB0C808D04C71AC8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph commented="no" id="H9CCC56CC9001422E920D19E65901BDA9"><enum>(1)</enum><header>Indian economic enterprise</header><text>The term <term>Indian economic enterprise</term> has the meaning given the term in section 1480.201 of title 48, Code of Federal Regulations (or successor regulations).</text>
 </paragraph><paragraph id="H1EADECCB0A2846989ACD0B81BC8D993E"><enum>(2)</enum><header>Mentor firm; protege firm</header><text>The terms <term>mentor firm</term> and <term>protege firm</term> have the meanings given those terms in section 831(c) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>).</text>
 </paragraph><paragraph id="H628F925CB4F84154B35797C9BB866474"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text> <subparagraph id="H5C208888540940D9B560679A8F40D70D"><enum>(A)</enum><text>the Secretary of the Interior; and</text>
 </subparagraph><subparagraph id="H534EE66854CE4F08BF444F01FFD5ED41"><enum>(B)</enum><text>the Secretary of Health and Human Services.</text> </subparagraph></paragraph></subsection><subsection id="H6889F34F9CA047D992C5B0599146FBF0"><enum>(b)</enum><header>Enterprise development</header> <paragraph id="H4A296CD7FD2043E39F747CECA75C68AC"><enum>(1)</enum><header>In general</header><text>Unless determined by one of the Secretaries to be impracticable and unreasonable—</text>
 <subparagraph id="H3E3C943CCC8D4DCE94399C1D5A4EDBC0"><enum>(A)</enum><text>Indian labor shall be employed; and</text> </subparagraph><subparagraph id="HD1CD95D0692C43D08584A1C1925598D8"><enum>(B)</enum><text>purchases of Indian industry products (including printing and facilities construction, notwithstanding any other provision of law) may be made in open market by the Secretaries.</text>
								</subparagraph></paragraph><paragraph id="H68121F36E87E464092350F50522F03F5"><enum>(2)</enum><header>Mentor-Protege Program</header>
 <subparagraph id="HBCBF90FA3ACB460F84A3168E56BFCEFF"><enum>(A)</enum><header>In general</header><text>Participation in the Mentor-Protege Program established under section 831(a) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>) or receipt of assistance under a developmental assistance agreement under that program shall not render any individual or entity involved in the provision of Indian labor or an Indian industry product ineligible to receive assistance under this section.</text>
 </subparagraph><subparagraph id="H32C7892DD95F46C6A46369425AA11DFA"><enum>(B)</enum><header>Treatment</header><text>For purposes of this section, no determination of affiliation or control (whether direct or indirect) may be found between a protege firm and a mentor firm on the basis that the mentor firm has provided, or agreed to provide, to the protege firm, pursuant to a mentor-protege agreement, any form of developmental assistance described in section 831(f) of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="usc" parsable-cite="usc/10/2302">10 U.S.C. 2302</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>).</text>
 </subparagraph></paragraph></subsection><subsection id="HF6B73055C3734B81AE66E1190BB67EEF"><enum>(c)</enum><header>Implementation</header><text>In carrying out this section, the Secretaries shall—</text> <paragraph id="H268B4A67FC1340D0BCB3862FE5C6E87C"><enum>(1)</enum><text>conduct outreach to Indian industrial entities;</text>
 </paragraph><paragraph id="H2371F66BF9F543A8858B0C305532D6D5"><enum>(2)</enum><text>provide training;</text> </paragraph><paragraph id="HB023EA8FCCD04686A8E0784C59F064D8"><enum>(3)</enum><text>promulgate regulations in accordance with this section and with the regulations under part 1480 of title 48, Code of Federal Regulations (or successor regulations), to harmonize the procurement procedures of the Department of the Interior and the Department of Health and Human Services, to the maximum extent practicable; and</text>
 </paragraph><paragraph id="H713114D09A624AFAAA93203E15EC49F2"><enum>(4)</enum><text>require procurement management reviews by their respective Departments to include a review of the implementation of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HAF512223E80C481698F53BCA4A07A447"><enum>104.</enum><header>Native American Programs Act of 1974</header>
 <subsection id="H60575BCFB09B47A79C28B9AC237E0B66"><enum>(a)</enum><header>Financial assistance for Native American projects</header><text display-inline="yes-display-inline">Section 803 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991b">42 U.S.C. 2991b</external-xref>) is amended—</text> <paragraph id="H1DDF6206A31945769E3162541D5DE6B9"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b) through (d) as subsections (c) through (e), respectively; and</text>
 </paragraph><paragraph id="H01A668CBCB0441738B7047CA9E29B7C6"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H103CE33698F143EBBCFC29CD62F75330" reported-display-style="italic" style="OLC"> <subsection id="H2B5FF46ADB2A44C39002ACC51D8E8697"><enum>(b)</enum><header>Economic development</header> <paragraph id="H7F25689492274359892DE2A068A6F59A"><enum>(1)</enum><header>In general</header><text>The Commissioner may provide assistance under subsection (a) for projects relating to the purposes of this title to a Native community development financial institution, as defined by the Secretary of the Treasury.</text>
 </paragraph><paragraph id="H2ADF030616884770BBECF7CDA7C35622"><enum>(2)</enum><header>Priority</header><text>With regard to not less than 50 percent of the total amount available for assistance under this section, the Commissioner shall give priority to any application seeking assistance for—</text>
 <subparagraph id="HAE3E0B1E2C1249A59A8314E7DA51A16C"><enum>(A)</enum><text>the development of a tribal code or court system for purposes of economic development, including commercial codes, training for court personnel, regulation pursuant to section 5 of the Act of August 15, 1876 (19 Stat. 200, chapter 289; <external-xref legal-doc="usc" parsable-cite="usc/25/261">25 U.S.C. 261</external-xref>), and the development of nonprofit subsidiaries or other tribal business structures;</text>
 </subparagraph><subparagraph id="H45948348C6914B6295D77233AF028FBE"><enum>(B)</enum><text>the development of a community development financial institution, including training and administrative expenses; or</text>
 </subparagraph><subparagraph id="HF10EB014DD6F45FDB6422F3D3799505B"><enum>(C)</enum><text>the development of a tribal master plan for community and economic development and infrastructure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H0D287E3B8A4B47229762E8FDEC4B28F7"><enum>(b)</enum><header>Technical assistance and training</header><text>Section 804 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2991c">42 U.S.C. 2991c</external-xref>) is amended—</text>
 <paragraph id="HF4C4B836CAE449E2B06E91C18CC3F20B"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>The Commissioner</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H2ABC710F770F45FB9E99373187246993" reported-display-style="italic" style="OLC"> <subsection id="HD3DA5527FBF047F492D0328D9A275C3D"><enum>(a)</enum><header>In general</header><text>The Commissioner</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>

 </paragraph></subsection><subsection id="HC339A92CEF49458C86ABFA72F12D69ED"><enum>(c)</enum><header>Authorization of appropriations</header><text>Section 816 of the Native American Programs Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/2992d">42 U.S.C. 2992d</external-xref>) is amended by striking <quote>803(d)</quote> each place it appears and inserting <quote>803(e)</quote>.</text> </subsection></section></title><title id="H57FD6EF42B63428F94AC9D0AF460660B"><enum>II</enum><header>Native American Business Incubators Program Act</header> <section id="HF0859DA1509543EAAA87A2018DA9AFCC" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Native American Business Incubators Program Act</quote>.</text>
 </section><section id="H8A76D2D36A5B4C76B6A010CD456D3CBC"><enum>202.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="HAD4493EBA5AF4A80ABCC2A95C3410038"><enum>(1)</enum><header>Business incubator</header><text>The term <term>business incubator</term> means an organization that—</text>
 <subparagraph id="H12DC1EA0A63C449494211BD19C225C3D"><enum>(A)</enum><text>provides physical workspace and facilities resources to startups and established businesses; and</text> </subparagraph><subparagraph id="H4843E3D238424F6DA16887EE8987FD92"><enum>(B)</enum><text>is designed to accelerate the growth and success of businesses through a variety of business support resources and services, including—</text>
 <clause id="H7F7CA1CA43CF458883D008876B2DA24C"><enum>(i)</enum><text>access to capital, business education, and counseling;</text> </clause><clause id="H48431C1F9C8B4C4797149B6D47EAD897"><enum>(ii)</enum><text>networking opportunities;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H44789BC09B284B59BD94F8471C815FF0"><enum>(iii)</enum><text>mentorship opportunities; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="H6D7F5EC755284FFBB784F8ED7ECE1FAA"><enum>(iv)</enum><text>other services intended to aid in developing a business.</text>
 </clause></subparagraph></paragraph><paragraph id="H96527BF6F2F54145A1979C46908D0493"><enum>(2)</enum><header>Eligible applicant</header><text>The term <term>eligible applicant</term> means an applicant eligible to apply for a grant under section 203(b).</text> </paragraph><paragraph id="H306C7A1784B24DE886999779361427CD"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text>
 </paragraph><paragraph id="H43007B8AE8FC4BFA8FE9B6BC89F7B20E"><enum>(4)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text>
 </paragraph><paragraph id="H83F745DB04F44CF0B3FF283723D8B76E"><enum>(5)</enum><header>Native American; Native</header><text>The terms <term>Native American</term> and <term>Native</term> have the meaning given the term <term>Indian</term> in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text> </paragraph><paragraph id="H9D57806E210A4792BF554FE03ECB2D82"><enum>(6)</enum><header>Native business</header><text>The term <term>Native business</term> means a business concern that is at least 51-percent owned and controlled by one or more Native Americans.</text>
 </paragraph><paragraph id="HB6FCC4DEA5EF4EC881575163C0B75A34"><enum>(7)</enum><header>Native entrepreneur</header><text>The term <term>Native entrepreneur</term> means an entrepreneur who is a Native American.</text> </paragraph><paragraph id="H9F632FAB24AF49618C864CE1D8DD9D83"><enum>(8)</enum><header>Program</header><text>The term <term>program</term> means the program established under section 203(a).</text>
 </paragraph><paragraph id="H4C811A45F09E458495772EE264F33B2F"><enum>(9)</enum><header>Reservation</header><text>The term <term>reservation</term> has the meaning given the term in section 3 of the Indian Financing Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/25/1452">25 U.S.C. 1452</external-xref>).</text> </paragraph><paragraph id="HE9630F13E2454AAD8151C28B05F096A4"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
 </paragraph><paragraph id="H15DEF1C57B6248808E7D5BAD3622C220"><enum>(11)</enum><header>Tribal college or university</header><text>The term <term>tribal college or university</term> has the meaning given the term <term>Tribal College or University</term> in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>).</text> </paragraph></section><section id="H8D0AE13EB93A494DA946E2DBD6A84D02"><enum>203.</enum><header>Establishment of program</header> <subsection id="HCF12B54D0E504832BC25262EDC9295E4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a program in the Office of Indian Energy and Economic Development’s Division of Economic Development under which the Secretary shall provide financial assistance in the form of competitive grants to eligible applicants for the establishment and operation of business incubators that serve reservation communities by providing business incubation and other business services to Native businesses and Native entrepreneurs.</text>
				</subsection><subsection id="H997FBBD010B549EFBBE1D2422BFA1409"><enum>(b)</enum><header>Eligible applicants</header>
 <paragraph id="H2D589C0FA08B454CBB63202E84420145"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under the program, an applicant shall—</text> <subparagraph id="H5047F18C687247108C0AFEC80C4A1CA6"><enum>(A)</enum><text>be—</text>
 <clause id="HA3FB14CB6B6C419BA9FFC58DCF1811CA"><enum>(i)</enum><text>an Indian tribe;</text> </clause><clause id="H93642E5A831F41F387B144A05A99B46F"><enum>(ii)</enum><text>a tribal college or university;</text>
 </clause><clause id="H31DFF9EB6ABF4CB8A56A17DD28927FAA"><enum>(iii)</enum><text>an institution of higher education; or</text> </clause><clause id="H263B7A6F886744AAB36B3551B0B0946F"><enum>(iv)</enum><text>a private nonprofit organization or tribal nonprofit organization that—</text>
 <subclause id="HF2E4D67A8476437398AFA8781C2A92D9"><enum>(I)</enum><text>provides business and financial technical assistance; and</text> </subclause><subclause id="H912ACAF16CF94BFBB4537036E8D11C95"><enum>(II)</enum><text>will commit to serving one or more reservation communities;</text>
 </subclause></clause></subparagraph><subparagraph id="H8788D669B67048A78973EE756F2509AD"><enum>(B)</enum><text>be able to provide the physical workspace, equipment, and connectivity necessary for Native businesses and Native entrepreneurs to collaborate and conduct business on a local, regional, national, and international level; and</text>
 </subparagraph><subparagraph id="HED20E1C99D1A43DCA817FB4F06F509D9"><enum>(C)</enum><text>in the case of an entity described in clauses (ii) through (iv) of subparagraph (A), have been operational for not less than 1 year before receiving a grant under the program.</text>
						</subparagraph></paragraph><paragraph id="HFAE335E9CF934343ADEA0FB51EE18F9D"><enum>(2)</enum><header>Joint project</header>
 <subparagraph id="HD68C37DD8730488FAF4AEDA06A7C75D3"><enum>(A)</enum><header>In general</header><text>Two or more entities may submit a joint application for a project that combines the resources and expertise of those entities at a physical location dedicated to assisting Native businesses and Native entrepreneurs under the program.</text>
 </subparagraph><subparagraph id="H8B8AB19DB7104435BDF4ED218BF93EB5"><enum>(B)</enum><header>Contents</header><text>A joint application submitted under subparagraph (A) shall—</text> <clause id="H3524DD2DE4734FCEBC649B91BC2FBA5C"><enum>(i)</enum><text>contain a certification that each participant of the joint project is one of the eligible entities described in paragraph (1)(A); and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="H212114D434FC4D69A46422FC37F104BB"><enum>(ii)</enum><text>demonstrate that together the participants meet the requirements of subparagraphs (B) and (C) of paragraph (1).</text>
							</clause></subparagraph></paragraph></subsection><subsection id="H81E92A39B5CC4455B5E06FF8E42894DA"><enum>(c)</enum><header>Application and selection process</header>
 <paragraph id="H11FA274D373A4E40B2C12A5D1B1C9207"><enum>(1)</enum><header>Application requirements</header><text>Each eligible applicant desiring a grant under the program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text>
 <subparagraph id="HD0F86718883048EB9A2658868F4E929F"><enum>(A)</enum><text>a certification that the applicant—</text> <clause id="H97309693C7194AAFA900AFD32D2A1F3F"><enum>(i)</enum><text>is an eligible applicant;</text>
 </clause><clause id="H761E908A03D64DAF9E14B7C045D0AF3A"><enum>(ii)</enum><text>will designate an executive director or program manager, if such director or manager has not been designated, to manage the business incubator; and</text>
 </clause><clause id="HBB2DB4DC0CAD45968DC87FE0A9BC9370"><enum>(iii)</enum><text>agrees—</text> <subclause id="H20C21A5AA0E04FE69DA5762748BB93C3"><enum>(I)</enum><text>to a site evaluation by the Secretary as part of the final selection process;</text>
 </subclause><subclause id="H959F118EE0E74CF3A607798665D6D1C6"><enum>(II)</enum><text>to an annual programmatic and financial examination for the duration of the grant; and</text> </subclause><subclause id="HF8C20C951B5F40839D199D109421EF98"><enum>(III)</enum><text>to the maximum extent practicable, to remedy any problems identified pursuant to the site evaluation under subclause (I) or an examination under subclause (II);</text>
 </subclause></clause></subparagraph><subparagraph id="H80ACDBD971104E9988CA8BB72B073682"><enum>(B)</enum><text>a description of the one or more reservation communities to be served by the business incubator;</text> </subparagraph><subparagraph id="H79856BF9FB1A4ACAA3E60AF36DC496DB"><enum>(C)</enum><text>a 3-year plan that describes—</text>
 <clause id="H49B123E8B904413C9B36B2592BF44494"><enum>(i)</enum><text>the number of Native businesses and Native entrepreneurs to be participating in the business incubator;</text>
 </clause><clause id="HCE5E28472C0E4D41944DEBC91F8EBD92"><enum>(ii)</enum><text>whether the business incubator will focus on a particular type of business or industry;</text> </clause><clause id="HC67EB2EADBD849E3999F84BAEB58C0F5"><enum>(iii)</enum><text>a detailed breakdown of the services to be offered to Native businesses and Native entrepreneurs participating in the business incubator; and</text>
 </clause><clause id="H33FD66350EED47C5ABE34A2B96C11B2F"><enum>(iv)</enum><text>a detailed breakdown of the services, if any, to be offered to Native businesses and Native entrepreneurs not participating in the business incubator;</text>
 </clause></subparagraph><subparagraph id="H3343D43981C24DEBB9A44A0B232CE63F"><enum>(D)</enum><text>information demonstrating the effectiveness and experience of the eligible applicant in—</text> <clause id="H565F843F3F8B4CE0A581226DAE1C6BE0"><enum>(i)</enum><text>conducting financial, management, and marketing assistance programs designed to educate or improve the business skills of current or prospective businesses;</text>
 </clause><clause id="HB639B902C25B4829AD20947C5D2D8203"><enum>(ii)</enum><text>working in and providing services to Native American communities;</text> </clause><clause id="H4AC6C9977BCC4BBF9780C4B8E55C82B5"><enum>(iii)</enum><text>providing assistance to entities conducting business in reservation communities;</text>
 </clause><clause id="HBAD37C3F4F194F579B7DA5B06FB36336"><enum>(iv)</enum><text>providing technical assistance under Federal business and entrepreneurial development programs for which Native businesses and Native entrepreneurs are eligible; and</text>
 </clause><clause id="HCC83132FD8DD4B418B63B949079DFAA5"><enum>(v)</enum><text>managing finances and staff effectively; and</text> </clause></subparagraph><subparagraph id="HD26C7842E98E4287BC5416CF66432E3D"><enum>(E)</enum><text>a site description of the location at which the eligible applicant will provide physical workspace, including a description of the technologies, equipment, and other resources that will be available to Native businesses and Native entrepreneurs participating in the business incubator.</text>
						</subparagraph></paragraph><paragraph id="H64243C9A5DF84C74BBDF3312BB28F1F3"><enum>(2)</enum><header>Evaluation considerations</header>
 <subparagraph id="HF5B0A261268445A19923231F4D43E7B1"><enum>(A)</enum><header>In general</header><text>In evaluating each application, the Secretary shall consider—</text> <clause id="H37DCF6AEA6884F64A41A07C114700B69"><enum>(i)</enum><text>the ability of the eligible applicant—</text>
 <subclause id="H2E791FBB5EB146918B613FA8E0CA8F9D"><enum>(I)</enum><text>to operate a business incubator that effectively imparts entrepreneurship and business skills to Native businesses and Native entrepreneurs, as demonstrated by the experience and qualifications of the eligible applicant;</text>
 </subclause><subclause id="H45561EEB67F1467683401F2D5868CE0F"><enum>(II)</enum><text>to commence providing services within a minimum period of time, to be determined by the Secretary; and</text>
 </subclause><subclause id="H88CF78AC1D2D48F1BF88069B02C295A0"><enum>(III)</enum><text>to provide quality incubation services to a significant number of Native businesses and Native entrepreneurs;</text>
 </subclause></clause><clause id="HEA1DD098C1C343C581BB1D02AAF9F085"><enum>(ii)</enum><text>the experience of the eligible applicant in providing services in Native American communities, including in the one or more reservation communities described in the application; and</text>
 </clause><clause id="H609F57C9ACC74AE7A6CA3A088BBF0FCF"><enum>(iii)</enum><text>the proposed location of the business incubator.</text> </clause></subparagraph><subparagraph id="H78645D983DDC427889C5B818C58ECF6D"><enum>(B)</enum><header>Priority</header> <clause id="H12DFF4BDF0854310A07AA72C818C2570"><enum>(i)</enum><header>In general</header><text>In evaluating the proposed location of the business incubator under subparagraph (A)(iii), the Secretary shall—</text>
 <subclause id="HFBE4979BBB914FACA1CE4EE901AFA5E3"><enum>(I)</enum><text>consider the program goal of achieving broad geographic distribution of business incubators; and</text> </subclause><subclause id="H9079AD7FD6F34AF7924182573E191E5D"><enum>(II)</enum><text>except as provided in clause (ii), give priority to eligible applicants that will provide business incubation services on or near the reservation of the one or more communities that were described in the application.</text>
 </subclause></clause><clause id="H246A130212D04C619F6BF52F20EB75CF"><enum>(ii)</enum><header>Exception</header><text>The Secretary may give priority to an eligible applicant that is not located on or near the reservation of the one or more communities that were described in the application if the Secretary determines that—</text>
 <subclause id="H7322F3DC9CA447929868A3A820A31742"><enum>(I)</enum><text>the location of the business incubator will not prevent the eligible applicant from providing quality business incubation services to Native businesses and Native entrepreneurs from the one or more reservation communities to be served; and</text>
 </subclause><subclause id="H840D76A838B143E381A97C55B07E77E8"><enum>(II)</enum><text>siting the business incubator in the identified location will serve the interests of the one or more reservation communities to be served.</text>
								</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C4C4D00E5414BD080CAD6755576A715"><enum>(3)</enum><header>Site evaluation</header>
 <subparagraph id="H1CCA87FD3E32447399F8E1913C8536B3"><enum>(A)</enum><header>In general</header><text>Before making a grant to an eligible applicant, the Secretary shall conduct a site visit, evaluate a video submission, or evaluate a written site proposal (if the applicant is not yet in possession of the site) of the proposed site to ensure the proposed site will permit the eligible applicant to meet the requirements of the program.</text>
 </subparagraph><subparagraph id="H2C8BD637F1824F188DCA9F3B373F04C7"><enum>(B)</enum><header>Written site proposal</header><text>A written site proposal shall meet the requirements described in paragraph (1)(E) and contain—</text> <clause id="H77A2E35F13EB455893AA6051BEFF15B6"><enum>(i)</enum><text>sufficient detail for the Secretary to ensure in the absence of a site visit or video submission that the proposed site will permit the eligible applicant to meet the requirements of the program; and</text>
 </clause><clause id="H7E9884BD506B40189DC6D3EA1C273F43"><enum>(ii)</enum><text>a timeline describing when the eligible applicant will be—</text> <subclause id="HF19D472B06644D02841F1646E59C22CC"><enum>(I)</enum><text>in possession of the proposed site; and</text>
 </subclause><subclause id="H53315661571E409F84DD102657BCDEC8"><enum>(II)</enum><text>operating the business incubator at the proposed site.</text> </subclause></clause></subparagraph><subparagraph id="H017A85B9AFD341DFA3F7EC7F6C1246F7"><enum>(C)</enum><header>Followup</header><text>Not later than 1 year after awarding a grant to an eligible applicant that submits an application with a written site proposal, the Secretary shall conduct a site visit or evaluate a video submission of the site to ensure the site is consistent with the written site proposal.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA5976D1F89FC4EBF8C9A7D0954FA30AB"><enum>(d)</enum><header>Administration</header>
 <paragraph id="H04095A1E78AA492C9CB7F865B929C8B4"><enum>(1)</enum><header>Duration</header><text>Each grant awarded under the program shall be for a term of 3 years.</text> </paragraph><paragraph id="H6207490D957A478F9FAA9A967726C4C8"><enum>(2)</enum><header>Payment</header> <subparagraph id="HF870728137994D719353B49BDD3A987D"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), the Secretary shall disburse grant funds awarded to an eligible applicant in annual installments.</text>
 </subparagraph><subparagraph id="H00CC07200CA9459B8AFC8F20AF1E2686"><enum>(B)</enum><header>More frequent disbursements</header><text>On request by the applicant, the Secretary may make disbursements of grant funds more frequently than annually, on the condition that disbursements shall be made not more frequently than quarterly.</text>
						</subparagraph></paragraph><paragraph id="H0E9962F8837A4B1FBC081068F9477BF0"><enum>(3)</enum><header>Non-Federal contributions for initial assistance</header>
 <subparagraph id="H6A9589C4263147AE80BEA0F5A6A69099"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an eligible applicant that receives a grant under the program shall provide non-Federal contributions in an amount equal to not less than 25 percent of the grant amount disbursed each year.</text>
 </subparagraph><subparagraph id="H8DF81E316C8E48E4A9FC49219912392E"><enum>(B)</enum><header>Waiver</header><text>The Secretary may waive, in whole or in part, the requirements of subparagraph (A) with respect to an eligible applicant if, after considering the ability of the eligible applicant to provide non-Federal contributions, the Secretary determines that—</text>
 <clause id="HEC03A5B341B04805ACE9EB712431C8DC"><enum>(i)</enum><text>the proposed business incubator will provide quality business incubation services; and</text> </clause><clause id="H73FA99FE2AE24DDB872382FD99251783"><enum>(ii)</enum><text>the one or more reservation communities to be served are unlikely to receive similar services because of remoteness or other reasons that inhibit the provision of business and entrepreneurial development services.</text>
							</clause></subparagraph></paragraph><paragraph id="H840A610E2901402B9599061A29583EF1"><enum>(4)</enum><header>Renewals</header>
 <subparagraph id="H773729D8D83542968D724495D61E788D"><enum>(A)</enum><header>In general</header><text>The Secretary may renew a grant award under the program for a term not to exceed 3 years.</text> </subparagraph><subparagraph id="H26187C47006540FDBF21BC097776FEF1"><enum>(B)</enum><header>Considerations</header><text>In determining whether to renew a grant award, the Secretary shall consider with respect to the eligible applicant—</text>
 <clause id="HF038E229746A4EEEA6A2AE0DD5B325AD"><enum>(i)</enum><text>the results of the annual evaluations of the eligible applicant under subsection (f)(1);</text> </clause><clause id="H4FC26C65AD934107821E99B25304644D"><enum>(ii)</enum><text>the performance of the business incubator of the eligible applicant, as compared to the performance of other business incubators receiving assistance under the program;</text>
 </clause><clause id="HEFE35B2B10134A45AFA880DD3E89CF50"><enum>(iii)</enum><text>whether the eligible applicant continues to be eligible for the program; and</text> </clause><clause id="HEBC0E30CA0664DCB94757A42331F4FAC"><enum>(iv)</enum><text>the evaluation considerations for initial awards under subsection (c)(2).</text>
 </clause></subparagraph><subparagraph id="HF06EBD99CC3E49A2A077F7C1AC9EF582"><enum>(C)</enum><header>Non-Federal contributions for renewals</header><text>An eligible applicant that receives a grant renewal under subparagraph (A) shall provide non-Federal contributions in an amount equal to not less than 33 percent of the total amount of the grant.</text>
 </subparagraph></paragraph><paragraph id="H09650334DE5D408E9CC581245D22EEB6"><enum>(5)</enum><header>No duplicative grants</header><text>An eligible applicant shall not be awarded a grant under the program that is duplicative of existing Federal funding from another source.</text>
					</paragraph></subsection><subsection id="H1FCBE9937EAF473483F6A811D6F8CD57"><enum>(e)</enum><header>Program requirements</header>
 <paragraph id="HE29DD904CBD74AA0B9F649E9C860A689"><enum>(1)</enum><header>Use of funds</header><text>An eligible applicant receiving a grant under the program may use grant amounts—</text> <subparagraph id="H91E5A765CBCE4B4DBF568F7E37A72D12"><enum>(A)</enum><text>to provide physical workspace and facilities for Native businesses and Native entrepreneurs participating in the business incubator;</text>
 </subparagraph><subparagraph id="HD34B7066F7954ADE9291616D7F61D63D"><enum>(B)</enum><text>to establish partnerships with other institutions and entities to provide comprehensive business incubation services to Native businesses and Native entrepreneurs participating in the business incubator; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7DC86C8F19349E4A2479DE7521353CC"><enum>(C)</enum><text>for any other uses typically associated with business incubators that the Secretary determines to be appropriate and consistent with the purposes of the program.</text>
 </subparagraph></paragraph><paragraph id="H7ECADCC38163464F9F776332A254758F"><enum>(2)</enum><header>Minimum requirements</header><text>Each eligible applicant receiving a grant under the program shall—</text> <subparagraph id="H20B631AAB2F3437099B1CE8D15FF0086"><enum>(A)</enum><text>offer culturally tailored incubation services to Native businesses and Native entrepreneurs;</text>
 </subparagraph><subparagraph id="H263567C43A67418E98967018FCE43F7F"><enum>(B)</enum><text>use a competitive process for selecting Native businesses and Native entrepreneurs to participate in the business incubator;</text>
 </subparagraph><subparagraph id="H10C35FFDBD24452D889F2A3C3BCAAA02"><enum>(C)</enum><text>provide physical workspace that permits Native businesses and Native entrepreneurs to conduct business and collaborate with other Native businesses and Native entrepreneurs;</text>
 </subparagraph><subparagraph id="H451D2CCF787B433595FC21563F7630D7"><enum>(D)</enum><text>provide entrepreneurship and business skills training and education to Native businesses and Native entrepreneurs including—</text>
 <clause id="HDAEFFBF4B56A4309B5888A5E28A27961"><enum>(i)</enum><text>financial education, including training and counseling in—</text> <subclause id="H16BEA5BDF19B40A88B86CE3DC4A970E7"><enum>(I)</enum><text>applying for and securing business credit and investment capital;</text>
 </subclause><subclause id="H589E75D6883C430284260FC462D49DEE"><enum>(II)</enum><text>preparing and presenting financial statements; and</text> </subclause><subclause id="H6D84B81C3DE543A59E4AF47C75327E7B"><enum>(III)</enum><text>managing cash flow and other financial operations of a business;</text>
 </subclause></clause><clause id="H0FDD22C95733485B937EBE14581EE7F8"><enum>(ii)</enum><text>management education, including training and counseling in planning, organization, staffing, directing, and controlling each major activity or function of a business or startup; and</text>
 </clause><clause id="H0FAA163149E5497D99741F4952D9C8C3"><enum>(iii)</enum><text>marketing education, including training and counseling in—</text> <subclause id="HD6B7DA8F88074831AF32A4C5307DA883"><enum>(I)</enum><text>identifying and segmenting domestic and international market opportunities;</text>
 </subclause><subclause id="H969ED6CA3F784AEEA38C61957FE3EB2A"><enum>(II)</enum><text>preparing and executing marketing plans;</text> </subclause><subclause id="H64295F847B4C4B7A98D5596C0793D1E7"><enum>(III)</enum><text>locating contract opportunities;</text>
 </subclause><subclause id="HB7DAADA4303A4CAC9F26129F043D1E26"><enum>(IV)</enum><text>negotiating contracts; and</text> </subclause><subclause id="H4A495DEF756B4EB1B740C163602F7270"><enum>(V)</enum><text>using varying public relations and advertising techniques;</text>
 </subclause></clause></subparagraph><subparagraph id="HE2C6CD89880F4ED0B7B36237351C7EF8"><enum>(E)</enum><text>provide direct mentorship or assistance finding mentors in the industry in which the Native business or Native entrepreneur operates or intends to operate; and</text>
 </subparagraph><subparagraph id="H58840872571E4D6EBCCC3DA3571EE47B"><enum>(F)</enum><text>provide access to networks of potential investors, professionals in the same or similar fields, and other business owners with similar businesses.</text>
 </subparagraph></paragraph><paragraph id="H18DBEDC1D67747A2B4F159E7C2BE4964"><enum>(3)</enum><header>Technology</header><text>Each eligible applicant shall leverage technology to the maximum extent practicable to provide Native businesses and Native entrepreneurs with access to the connectivity tools needed to compete and thrive in 21st-century markets.</text>
					</paragraph></subsection><subsection id="H0A875EDA543149DE867C773DEE2F4F2A"><enum>(f)</enum><header>Oversight</header>
 <paragraph id="HF74500E83C2244B593C1BD004D566191"><enum>(1)</enum><header>Annual evaluations</header><text>Not later than 1 year after the date on which the Secretary awards a grant to an eligible applicant under the program, and annually thereafter for the duration of the grant, the Secretary shall conduct an evaluation of the eligible applicant, which shall—</text>
 <subparagraph id="HE51B8524DD0845C798A63EA507809EA0"><enum>(A)</enum><text>describe the performance of the eligible applicant; and</text> </subparagraph><subparagraph id="H838312CA21D248AD85C8DB70A1D3A41B"><enum>(B)</enum><text>be used in determining the ongoing eligibility of the eligible applicant.</text>
						</subparagraph></paragraph><paragraph id="HA827C0749E9A45C89FAB25E5B70155C4"><enum>(2)</enum><header>Annual report</header>
 <subparagraph id="H3D4C97A5419544239D73048A647D8DEF"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date on which the Secretary awards a grant to an eligible applicant under the program, and annually thereafter for the duration of the grant, each eligible applicant receiving an award under the program shall submit to the Secretary a report describing the services the eligible applicant provided under the program during the preceding year.</text>
 </subparagraph><subparagraph id="HB6B1530A6ABA4AD6BE1BD66E800777BD"><enum>(B)</enum><header>Report content</header><text>The report described in subparagraph (A) shall include—</text> <clause id="HA13B0D01CBBF4C01BFD0E963D7247B3D"><enum>(i)</enum><text>a detailed breakdown of the Native businesses and Native entrepreneurs receiving services from the business incubator, including, for the year covered by the report—</text>
 <subclause id="HD78502AB6C274E99A37A9EF9336A1C71"><enum>(I)</enum><text>the number of Native businesses and Native entrepreneurs participating in or receiving services from the business incubator and the types of services provided to those Native businesses and Native entrepreneurs;</text>
 </subclause><subclause id="HBEE195CFD14A416B9F31B73CE520E746"><enum>(II)</enum><text>the number of Native businesses and Native entrepreneurs established and jobs created or maintained; and</text>
 </subclause><subclause id="H232225B94052428485217E93B0207167"><enum>(III)</enum><text>the performance of Native businesses and Native entrepreneurs while participating in the business incubator and after graduation or departure from the business incubator; and</text>
 </subclause></clause><clause id="HC957AF9C64FC4CA49BA5AF1074355E5C"><enum>(ii)</enum><text>any other information the Secretary may require to evaluate the performance of a business incubator to ensure appropriate implementation of the program.</text>
 </clause></subparagraph><subparagraph id="H8CDFC9539A46482B9673117892254435"><enum>(C)</enum><header>Limitations</header><text>To the maximum extent practicable, the Secretary shall not require an eligible applicant to report under subparagraph (A) information provided to the Secretary by the eligible applicant under other programs.</text>
 </subparagraph><subparagraph id="H3FAE4740C3AD48D287D8C38F4FDE36B5"><enum>(D)</enum><header>Coordination</header><text>The Secretary shall coordinate with the heads of other Federal agencies to ensure that, to the maximum extent practicable, the report content and form under subparagraphs (A) and (B) are consistent with other reporting requirements for Federal programs that provide business and entrepreneurial assistance.</text>
 </subparagraph></paragraph></subsection></section><section id="H0A0D81ED1E814F33AB06D3D84EE7BAA8"><enum>204.</enum><header>Schools to business incubator pipeline</header><text display-inline="no-display-inline">The Secretary shall facilitate the establishment of relationships between eligible applicants receiving funds through the program and educational institutions serving Native American communities, including tribal colleges and universities.</text>
 </section><section id="HC5BFCC0080C74377B0ABC1949F4CD385"><enum>205.</enum><header>Agency partnerships</header><text display-inline="no-display-inline">The Secretary shall coordinate with the Secretary of Agriculture, the Secretary of Commerce, the Secretary of the Treasury, and the Administrator of the Small Business Administration to ensure, to the maximum extent practicable, that business incubators receiving grant funds under the program have the information and materials needed to provide Native businesses and Native entrepreneurs with the information and assistance necessary to apply for business and entrepreneurial development programs administered by the Department of Agriculture, the Department of Commerce, the Department of the Treasury, and the Small Business Administration.</text>
			</section></title><title id="HBE2808D9DABD45949E5219FDB64752F0"><enum>III</enum><header>Indigenous Peoples Exchange and Economic Cooperation Act</header>
 <section id="H33DB3EEDC3C7414B96656F940CEA7F36" section-type="subsequent-section"><enum>301.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote>Indigenous Peoples Exchange and Economic Cooperation Act</quote>.</text> </section><section id="H60D5CC327D4540B4981B3D2C25333D7F"><enum>302.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States to facilitate contacts and cooperation, including commercial relationships, between Native American tribes and indigenous peoples in the Western Hemisphere.</text>
 </section><section id="H7E1A8111273F41649B064AB9BECEE47C"><enum>303.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="H04D096D82F824E089078832A12EDD441"><enum>(1)</enum><header>Native American tribes</header><text>The term <term>Native American tribe</term> means any federally recognized tribe.</text>
 </paragraph><paragraph id="H8DF3C7E7EFE944318CFC17949BC9B556"><enum>(2)</enum><header>Indigenous peoples</header><text display-inline="yes-display-inline">The term <term>indigenous peoples</term> means peoples residing in foreign countries in the Western Hemisphere who have historical ties to a particular territory and are culturally or historically distinct from the politically dominant population.</text>
				</paragraph></section><section id="H95CBF7EFF7EA493988744E5D3C59FDAD"><enum>304.</enum><header>Strategy</header>
 <subsection id="H1A7CE8E749DA45A5BF20F6E088EBA595"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall submit to the appropriate congressional committees a strategy, in consultation with the individuals listed in <internal-xref idref="H11FD90D08D4149FA89A0BF1C0C3B4B6B" legis-path="3.(b)">subsection (b)</internal-xref>, to promote and facilitate—</text>
 <paragraph id="HA9D01B59E824468985E8C484229525CC"><enum>(1)</enum><text>cross-investments between Native American tribes and indigenous peoples in tribal businesses and commercial enterprises that involve indigenous peoples, such as sustainable natural resource management, agricultural development, or handicraft production; and</text>
 </paragraph><paragraph id="H2E73BC54D9204A439E9B637C30C6EA58"><enum>(2)</enum><text>the development of supply chains for United States entities that include products produced by Native American tribes and indigenous peoples.</text>
 </paragraph></subsection><subsection id="H11FD90D08D4149FA89A0BF1C0C3B4B6B"><enum>(b)</enum><header>Consultation required</header><text>The individuals listed in this subsection are the following:</text> <paragraph id="H8EA2FFEF1B354162A249595BC776D140"><enum>(1)</enum><text>The Secretary of Commerce.</text>
 </paragraph><paragraph id="H2C2414E4A08A4AF289A4BE2FDEABA60E"><enum>(2)</enum><text>The Secretary of State.</text> </paragraph><paragraph id="HFF1B0B7C1EEB45218B4CA5F2B9F94589"><enum>(3)</enum><text>The Secretary of the Interior.</text>
 </paragraph><paragraph id="HBAA3717CC4E648F3AF791F93FBEDB1C3"><enum>(4)</enum><text>The United States Trade Representative.</text> </paragraph><paragraph id="HB5DC021E32984F598F90A99A9A205159"><enum>(5)</enum><text>The Administrator and the Advisor for Indigenous Peoples Issues of the United States Agency for International Development.</text>
 </paragraph><paragraph id="H113CD818D96545E4977125CE10993A9B"><enum>(6)</enum><text>The President of the Overseas Private Investment Corporation.</text> </paragraph><paragraph id="HFD42B724E08A48ECA0DFA05413424463"><enum>(7)</enum><text>The Chief Executive Officer of the Millennium Challenge Corporation.</text>
 </paragraph><paragraph id="H81F71C71D8C844D281EAF8C9B6E36CA3"><enum>(8)</enum><text>The President of the Inter-American Foundation.</text> </paragraph><paragraph id="HB4C7D827E52944E3ADE31848A6DEC55C"><enum>(9)</enum><text>Representatives of Native American tribes.</text>
 </paragraph><paragraph id="H1FF2FDF6004B407890BC2FA9D034C9BB"><enum>(10)</enum><text>Representatives of civil society organizations advocating for the rights or interests of indigenous peoples.</text>
 </paragraph></subsection><subsection id="HD02543E9487B4FE5934CAFB5160E9B01"><enum>(c)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">In this section, the term <term>appropriate congressional committees</term> means—</text> <paragraph id="H6DCFC478D4994E118CB6D0FCB33FED97"><enum>(1)</enum><text>the Committee on Foreign Affairs and the Committee on Natural Resources of the House of Representatives; and</text>
 </paragraph><paragraph id="HA02BC07BE9064E55A4291BE050B98545"><enum>(2)</enum><text display-inline="yes-display-inline">the Committee on Foreign Relations, the Committee on Energy and Natural Resources, and the Committee on Indian Affairs of the Senate.</text>
 </paragraph></subsection></section><section id="H694512359F804458A7FEEA8B140F04C9"><enum>305.</enum><header>United States assistance to support indigenous peoples</header><text display-inline="no-display-inline">In order to improve the capacity of indigenous peoples to engage in and benefit from increased trade and investment relationships, the Secretary of State shall—</text>
 <paragraph id="H4A6CAFED18D545E59A2BCB46C5CE333C"><enum>(1)</enum><text>consult with—</text> <subparagraph id="H3C43DD6888DA4FBD83CED9D1086BEFCA"><enum>(A)</enum><text>the Administrator of the United States Agency for International Development; and</text>
 </subparagraph><subparagraph id="H5B5535E5A925431C89AFDD3F80DC04C0"><enum>(B)</enum><text>representatives of civil society organizations, especially organizations comprised of or representing the interests of indigenous peoples; and</text>
 </subparagraph></paragraph><paragraph id="HE6893B229C6B4F1E8D9EFC5B215979B5"><enum>(2)</enum><text display-inline="yes-display-inline">provide assistance to countries in the Western Hemisphere in a manner that promotes and facilitates entrepreneurship among indigenous peoples—</text>
