<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend title 5, United States Code, to provide for interest payments by agencies in the case of administrative error in processing certain annuity deposits for prior military service or certain volunteer service, and for other purposes.</official-title>

<section id="H60445E104BAE43828B622703A6389F5E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Correcting Miscalculations in Veterans’ Pensions Act</short-title></quote>.</text> </section> <section id="HB66D6723BCDC4A9A922AE5A4FC028554" section-type="subsequent-section"><enum>2.</enum><header>Error in processing of annuity deposit for former members of the uniformed services</header> <subsection id="H5106D8C28171403EA37E72DB333B938D"><enum>(a)</enum><header>CSRS</header><text display-inline="yes-display-inline">Section 8334(j) of title 5, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H22F9E17559924399A9B7E4ECB7C7DD0F" indent="up1"><enum>(6)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H5345CA652D434598B4FD389DEA396A5A"><enum>(A)</enum><text display-inline="yes-display-inline">In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if the employing agency of such employee, Member, or annuitant makes an administrative error, such employing agency may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text> </subparagraph> <subparagraph id="H38A6FACB77FB4448B7CF1CBD7ABD5D14" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A), the Secretary of the Senate or the Chief Administrative Officer of the House of Representatives, as appropriate, shall be considered the employing agency of a Member or Congressional employee.</text> </subparagraph> 
<subparagraph id="H8F2F9DBD2D724638A4126C35DAB3E590" indent="up1"><enum>(C)</enum><text>The Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> <subsection id="HDA0253F18C73413B87C4E052184594B6"><enum>(b)</enum><header>FERS</header><text display-inline="yes-display-inline">Section 8422(e) of title 5, United States Code, is amended by adding at the end the following:</text>

<subparagraph commented="no" display-inline="yes-display-inline" id="HFC7E6A09918342AFA39B5759CEB190FC"><enum>(A)</enum><text display-inline="yes-display-inline">In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if the employing agency of such employee, Member, or annuitant makes an administrative error, such employing agency may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text> </subparagraph> <subparagraph id="H9C7209BC4346426FAD8C31B6D2EC1C4E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A), the Secretary of the Senate or the Chief Administrative Officer of the House of Representatives, as appropriate, shall be considered the employing agency of a Member or Congressional employee.</text> </subparagraph> 
<subparagraph id="H9129E5A2A8534DC1989969F993F6CD72" indent="up1"><enum>(C)</enum><text>The Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H754162DD87A742469E43A93D70D98F42"><enum>3.</enum><header>Error in processing of annuity deposit for certain volunteers</header> <subsection id="HE6EE55AF25C64FF38A08ADD68B7F5665"><enum>(a)</enum><header>CSRS</header><text>Section 8334(l) of title 5, United States Code, is amended by adding at the end of the following:</text>

<subparagraph id="H0F3B00DD7F614DF98469A3F98A84F29C" display-inline="yes-display-inline"><enum>(A)</enum><text>In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if an employing agency of such employee, Member, or annuitant makes an administrative error that causes additional interest assessed to accrue on the deposit, the employing agency may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text></subparagraph> <subparagraph id="HFFF1052A0FF74086B1C525EB4B9841D4" indent="up1"><enum>(B)</enum><text>In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if the Office of Personnel Management makes an administrative error that causes additional interest assessed to accrue on the deposit, the Office of Personnel Management may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text></subparagraph> 
<subparagraph id="H966F078BEA81437294FAF74AAD4E10CA" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), the Secretary of the Senate or the Chief Administrative Officer of the House of Representatives, as appropriate, shall be considered the employing agency of a Member or congressional employee.</text></subparagraph> <subparagraph id="HAB4435600ED34ABF84FAE7F589B2BA9D" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H287D3C8C766E4725AC65BD763E529D52"><enum>(b)</enum><header>FERS</header><text>Section 8422(f) of title 5, United States Code, is amended by adding at the end of the following:</text> <quoted-block id="H632B19022E1148DCA260698CD4AE0A1F" style="OLC"> <paragraph id="H47EAD11D6D0F436EAA1E8128D8186908" indent="up1"><enum>(5)</enum> <subparagraph id="H84A3E351394040EEBFDE86280F0EC5CC" display-inline="yes-display-inline"><enum>(A)</enum><text>In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if an employing agency of such employee, Member, or annuitant makes an administrative error that causes additional interest assessed to accrue on the deposit, the employee, Member, or annuitant’s employing agency may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text></subparagraph> 
<subparagraph id="HA107A44980134958A929F1298214B679" indent="up1"><enum>(B)</enum><text>In calculating and processing the deposit under paragraph (1) with respect to an employee, Member, or annuitant, if the Office of Personnel Management makes an administrative error that causes additional interest assessed to accrue on the deposit, the Office of Personnel Management may pay, on behalf of the employee, Member, or annuitant, any additional interest assessed due to the administrative error.</text></subparagraph> <subparagraph id="H884CD5A2714145A689565AE3DEDACB8A" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), the Secretary of the Senate or the Chief Administrative Officer of the House of Representatives, as appropriate, shall be considered the employing agency of a Member or congressional employee.</text></subparagraph> 
<subparagraph id="H95EBF5B10A4849B6915997F6D33EB003" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall issue such regulations as are necessary to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H2CB2A839FD564BB187B767027F140A11"><enum>(c)</enum><header>Authorization of payments</header><text display-inline="yes-display-inline">All payments from the Office of Personnel Management authorized by subsections (a) and (b) shall be paid from the Civil Service Retirement and Disability Fund, and together with administrative expenses incurred by the Office in administering these subsections, shall be deemed to have been authorized to be paid from that Fund, which is appropriated for the payment thereof.</text></subsection></section>
