<official-title display="yes">To amend the Fair Credit Reporting Act to clarify Federal law with respect to reporting certain positive consumer credit information to consumer reporting agencies, and for other purposes.</official-title>

<section id="HDA99DDA95188443DB1DB70146E7FA9A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>The Credit Access and Inclusion Act of 2017</short-title></quote>.</text> </section> <section id="H95CD18D5699B4E8CBB72A09E4DFBDA93"><enum>2.</enum><header>Positive credit reporting permitted</header> <subsection id="H10F200DAB625420881E9B0E6D0E896E9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H635D639B65D34622AD3B86C1B6B1E5DB" style="OLC"> 
<subsection id="H904199774CDF45F1971DF72D590B6552"><enum>(f)</enum><header>Full-File credit reporting</header> 
<paragraph id="H3293E3C071B1496F99717E0E65FB3DD7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the limitation in paragraph (2) and notwithstanding any other provision of law, a person or the Secretary of Housing and Urban Development may furnish to a consumer reporting agency information relating to the performance of a consumer in making payments—</text> <subparagraph id="H6C57EA887C874289B65AE9ADCAC11253"><enum>(A)</enum><text>under a lease agreement with respect to a dwelling, including such a lease in which the Department of Housing and Urban Development provides subsidized payments for occupancy in a dwelling; or</text> </subparagraph>
<subparagraph id="HB8926A1BD6FD4888B7260D09B73C748E"><enum>(B)</enum><text>pursuant to a contract for a utility or telecommunications service.</text> </subparagraph></paragraph> <paragraph id="HF9A816B3C566413ABCDE1EB957A471FA"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Information about a consumer’s usage of any utility services provided by a utility or telecommunication firm may be furnished to a consumer reporting agency only to the extent that such information relates to payment by the consumer for the services of such utility or telecommunication service or other terms of the provision of the services to the consumer, including any deposit, discount, or conditions for interruption or termination of the services.</text> </paragraph>
<paragraph id="HE53C8EA00A274C5DBCB76E1272A1AFB9"><enum>(3)</enum><header>Payment plan</header><text display-inline="yes-display-inline">An energy utility firm may not report payment information to a consumer reporting agency with respect to an outstanding balance of a consumer as late if—</text> <subparagraph id="H0ACE13D99D83412BA316077F706D66AD"><enum>(A)</enum><text>the energy utility firm and the consumer have entered into a payment plan (including a deferred payment agreement, an arrearage management program, or a debt forgiveness program) with respect to such outstanding balance; and</text> </subparagraph>
<subparagraph id="HB7E0F4D1AB8744C3898C63CF0D326846"><enum>(B)</enum><text display-inline="yes-display-inline">the consumer is meeting the obligations of the payment plan, as determined by the energy utility firm.</text> </subparagraph></paragraph> <paragraph id="H9FE0211670654DD18BC84CFCB555EBF7"><enum>(4)</enum><header>Definitions</header><text>In this subsection, the following definitions shall apply:</text> 
<subparagraph id="H24E1BE62A63E45B8ABD153EBAF900ED3"><enum>(A)</enum><header>Energy utility firm</header><text display-inline="yes-display-inline">The term <term>energy utility firm</term> means an entity that provides gas or electric utility services to the public.</text> </subparagraph> <subparagraph id="H5ECD90FDA2F74E8AA86069A0557B3988"><enum>(B)</enum><header>Utility or telecommunication firm</header><text>The term <term>utility or telecommunication firm</term> means an entity that provides utility services to the public through pipe, wire, landline, wireless, cable, or other connected facilities, or radio, electronic, or similar transmission (including the extension of such facilities).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HC51F44C77AAF4101A7C5D68046C56530"><enum>(b)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">Section 623(c) of the Consumer Credit Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2(c)</external-xref>) is amended—</text> <paragraph id="HCBE59432E2E1478AB09CE99D7DFEECB6"><enum>(1)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text> </paragraph>
<paragraph id="H897C9394E4464D41B6645C4DBA522043"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text> </paragraph> <paragraph id="HAB1D18E2015E4E53B99BB48D178D0E7E"><enum>(3)</enum><text>by inserting after paragraph (2) the following new paragraph:</text>

<paragraph id="H6450920DFCE045FAA5233BB5E1E501E2"><enum>(3)</enum><text display-inline="yes-display-inline">subsection (f) of this section, including any regulations issued thereunder; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="HD84D09EF70FE49BC9748FF822A698601"><enum>(c)</enum><header>GAO study and report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the impact of furnishing information pursuant to subsection (f) of section 623 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681s-2">15 U.S.C. 1681s–2</external-xref>) (as added by this Act) on consumers.</text> </subsection></section>
