 <section id="H90C14D8F665843F59B6B9E7E3193538A" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Accessing Strategic Resources Offshore Act</short-title></quote> or the <quote>ASTRO</quote> Act.</text> </section><section id="H5AFB9239A37B4B78B81FECA22C7D91FC" section-type="subsequent-section"><enum>102.</enum><header>Disposition of revenues from oil and gas leasing on the outer Continental Shelf to producing States</header><text display-inline="no-display-inline">Section 9 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1338">43 U.S.C. 1338</external-xref>) is amended—</text>
 <paragraph id="H7D0D034893A147F0BD24E670EF938BAA"><enum>(1)</enum><text>by striking <quote>All rentals</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H70DA987B96F148468627C4EC6DDE933E" reported-display-style="italic" style="OLC"> <subsection id="HEFA591F3E1A1404EBDC5AA139E60DF51"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, all rentals</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="H8557545E0AAF4F06AAF5614765F7E54F"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" id="H5DE3203E021B4DA684A10D1C9C09445F" reported-display-style="italic" style="OLC"> <subsection id="H100F78731C3A4C5F8F133B276EAB7136"><enum>(b)</enum><header>Distribution of revenue to producing States</header> <paragraph id="HB0B577A7B9794DA6861C6FAEAB582AC5"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
								<subparagraph id="HE814A87B67CA44C3BE1F3C73C03AFC93"><enum>(A)</enum><header>Covered planning area</header>
 <clause id="HCE66DD3670ED42BE8DC814383B0070C5"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the term <term>covered planning area</term> means each of the following planning areas, as such planning areas are generally depicted in the later of the 2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program, dated November 2016, or a subsequent oil and gas leasing program developed under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>):</text>
 <subclause id="H26E2384FBDE74E1D91E0424D57259BCA"><enum>(I)</enum><text>Mid-Atlantic.</text> </subclause><subclause id="HBF049BF549F8453E8EFB29B9AA1BBF74"><enum>(II)</enum><text>South Atlantic.</text>
 </subclause><subclause id="HF965BA9CE25F42A483C8AE66828DC383"><enum>(III)</enum><text>Any planning area located off the coast of Alaska.</text> </subclause></clause><clause id="H3A3884CA8461452BBE8BB73C3B4994CF"><enum>(ii)</enum><header>Exclusions</header><text>The term <term>covered planning area</term> does not include any area in the Atlantic—</text>
 <subclause id="HB77A0D4395E145A0A92D6AAD4682B747"><enum>(I)</enum><text>north of the southernmost lateral seaward administrative boundary of the State of Maryland; or</text> </subclause><subclause id="HDFDE4CB38C954322B0FCFEE10ED72AA0"><enum>(II)</enum><text>south of the northernmost lateral seaward administrative boundary of the State of Florida.</text>
 </subclause></clause></subparagraph><subparagraph id="H61347BAC359340689BCC4EAFAB8AD694"><enum>(B)</enum><header>Producing State</header><text>The term <term>producing State</term> means each of the following States:</text> <clause id="HF3D4A7AFCCF14055BBA27C95C1F5D5E9"><enum>(i)</enum><text>Virginia.</text>
 </clause><clause id="HC10CAA8DB8F6489580F5ADA208663F96"><enum>(ii)</enum><text>North Carolina.</text> </clause><clause id="HE700DCFC156F4FBBA6637C23DB4DF2C1"><enum>(iii)</enum><text>South Carolina.</text>
 </clause><clause id="HF10A1AAB08474CD29E5E07E44DD82ED1"><enum>(iv)</enum><text>Georgia.</text> </clause><clause id="H7A916863C68C40E3AF4393B2D02A8794"><enum>(v)</enum><text>Alaska.</text>
									</clause></subparagraph><subparagraph id="H13E1F2F0D59B4B9AB0E0EBBF5F2270D9"><enum>(C)</enum><header>Qualified revenues</header>
 <clause id="H764154C727084B548D6562B570FBF688"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualified revenues</term> means revenues derived from rentals, royalties, bonus bids, and other sums due and payable to the United States under oil and gas leases entered into on or after the date of the enactment of this Act for an area in a covered planning area.</text>
 </clause><clause id="H7573BE1F02524B9698455C5C7DDB3AC6"><enum>(ii)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>qualified revenues</term> does not include—</text> <subclause id="H7CF140952D4C4F6C86B6B4ECC5DD962A"><enum>(I)</enum><text>revenues from the forfeiture of a bond or other surety securing obligations other than royalties, civil penalties, or royalties taken by the Secretary in-kind and not sold;</text>
 </subclause><subclause id="HA5C82CA3A9DC44BCB2A64C0716413264"><enum>(II)</enum><text>revenues generated from leases subject to section 8(g); and</text> </subclause><subclause id="HADE7388CF6AA42C29635AB0275B1BE6C"><enum>(III)</enum><text display-inline="yes-display-inline">the portion of rental revenues in excess of those that would have been collected at the rental rates in effect before August 5, 1993.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HC4AA3F525BFC4602826565102D83B125"><enum>(2)</enum><header>Deposit of qualified revenues</header>
 <subparagraph id="H8A832891651544F78A295DB7C501873C"><enum>(A)</enum><header>Phase I</header><text display-inline="yes-display-inline">With respect to qualified revenues under leases awarded under the first leasing program approved under section 18(a) that takes effect after the date of the enactment of this section, the Secretary of the Treasury shall deposit or allocate, as applicable—</text>
 <clause id="HDA2388996DCE490E8116F31BC71100DA"><enum>(i)</enum><text display-inline="yes-display-inline">87.5 percent into the general fund of the Treasury; and</text> </clause><clause id="H8F6478E3BC1A4EB181A8203B72630C85"><enum>(ii)</enum><text display-inline="yes-display-inline">12.5 percent to States in accordance with paragraph (3).</text>
 </clause></subparagraph><subparagraph id="HAAFF8D5A8A2C42DF8C92F8EE10E2FD76"><enum>(B)</enum><header>Phase II</header><text display-inline="yes-display-inline">With respect to qualified revenues under leases awarded under the second leasing program approved under section 18(a) that takes effect after the date of the enactment of this section, the Secretary of the Treasury shall deposit or allocate, as applicable—</text>
 <clause id="HE87E7A1E2F44456D9E0D90F9A9E1FC6C"><enum>(i)</enum><text display-inline="yes-display-inline">75 percent into the general fund of the Treasury; and</text> </clause><clause id="H72BB20818962484FAA212D2125D46F37"><enum>(ii)</enum><text display-inline="yes-display-inline">25 percent to States in accordance with paragraph (3).</text>
 </clause></subparagraph><subparagraph id="H47FBE47F97D44C7D8DF88EC1BC0129D6"><enum>(C)</enum><header>Phase III</header><text>With respect to qualified revenues under leases awarded under the third leasing program approved under section 18(a) that takes effect after the date of the enactment of this section and under any such leasing program subsequent to such third leasing program, the Secretary of the Treasury shall deposit or allocate, as applicable—</text>
 <clause id="H9EDF0FACEE6E42FEB887817EF919272A"><enum>(i)</enum><text display-inline="yes-display-inline">50 percent into the general fund of the Treasury; and</text> </clause><clause id="H30C04D7166AF487D914FB5FC4AA4C986"><enum>(ii)</enum><text>50 percent into a special account in the Treasury from which the Secretary of the Treasury shall disburse—</text>
 <subclause display-inline="no-display-inline" id="H5894E2DB03E24A9F92464C09FDC7D736"><enum>(I)</enum><text display-inline="yes-display-inline">75 percent to States in accordance with paragraph (3);</text> </subclause><subclause id="H31E5300E066845A49D40FCA0EA39B983"><enum>(II)</enum><text display-inline="yes-display-inline">12.5 percent to the Secretary of Transportation for energy infrastructure development in coastal ports; and</text>
 </subclause><subclause id="HCF029907A657420AA6D54A3544CC574E"><enum>(III)</enum><text display-inline="yes-display-inline">12.5 percent to the Secretary of the Interior for units of the National Park System.</text> </subclause></clause></subparagraph></paragraph><paragraph id="HE53DA0849D0549A18A3511A1A432F6FF"><enum>(3)</enum><header>Allocation to producing States</header> <subparagraph commented="no" id="HFCA808C7B2234FCDB0E6E6836228318A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Secretary of the Treasury shall allocate the qualified revenues distributed to States under paragraph (2) to each producing State in an amount based on a formula established by the Secretary of the Interior, by regulation, that—</text>
 <clause id="H628927CC501942C5B87B9952AC20DAEA"><enum>(i)</enum><text>is inversely proportional to the respective distances between—</text> <subclause commented="no" id="HC58CFEBADCF64557B2D051051783A625"><enum>(I)</enum><text display-inline="yes-display-inline">the point on the coastline of the producing State that is closest to the geographical center of the applicable leased tract; and</text>
 </subclause><subclause commented="no" id="H8B9331147A554794923192AAC36B8A75"><enum>(II)</enum><text>the geographical center of that leased tract;</text> </subclause></clause><clause id="HE8B4EBC0158C47689E0E3F505A64C148"><enum>(ii)</enum><text>does not allocate qualified revenues to any producing State that is further than 200 nautical miles from the leased tract; and</text>
 </clause><clause commented="no" id="HB0110823D069444E9F8A1581592C6421"><enum>(iii)</enum><text>allocates not less than 10 percent of qualified revenues to each producing State that is 200 or fewer nautical miles from the leased tract.</text>
									</clause></subparagraph><subparagraph id="H36B9AF52A8CD4EAA9AD0427F533A32A0"><enum>(B)</enum><header>Payments to coastal political subdivisions</header>
 <clause id="H5B0A7B66675049F58923EE3595921F6C"><enum>(i)</enum><header>In general</header><text>The Secretary of the Treasury shall pay 20 percent of the allocable share of each producing State determined under this paragraph to the coastal political subdivisions of the producing State.</text>
 </clause><clause id="HCEEC1667757544EE9F44B1EDE62F89F4"><enum>(ii)</enum><header>Allocation</header><text display-inline="yes-display-inline">The amount paid by the Secretary of the Treasury to coastal political subdivisions shall be allocated to each coastal political subdivision in accordance with subparagraphs (B) and (E) of section 31(b)(4).</text>
 </clause><clause id="HEDA175B2B45C47B08ED928A07E34F763"><enum>(iii)</enum><header>Definition of coastal political subdivision</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>coastal political subdivision</term> means—</text> <subclause id="HA0217979C91F4B8CBDE89B19FB2F9B89"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to a contiguous coastal State, a political subdivision of such State, any part of which is—</text>
 <item id="H533431F67C464F7BA55DE43ACB87C80C"><enum>(aa)</enum><text display-inline="yes-display-inline">within the coastal zone of the State (as defined in section 304 of the Coastal Zone Management 2 Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>)); and</text>
 </item><item id="HDDA32E65DFB94F5CB122A94C5D4669FA"><enum>(bb)</enum><text display-inline="yes-display-inline">not more than 200 nautical miles from the geographic center of any leased tract; and</text> </item></subclause><subclause id="H716DAE1D382645FF83E1569259549C10"><enum>(II)</enum><text display-inline="yes-display-inline">with respect to a noncontiguous coastal State—</text>
 <item id="HC17CFB510FBB4EB8A6A87C1316EAD977"><enum>(aa)</enum><text display-inline="yes-display-inline">a county-equivalent subdivision of the State for which—</text> <subitem id="HA2446ADF44C543E7B7473C7988837765"><enum>(AA)</enum><text>all or part lies within the coastal zone of the State (as defined in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>)); and</text>
 </subitem><subitem id="H3B613151132543049BB8C4FAECB2E75D"><enum>(BB)</enum><text>the closest coastal point is not more than 200 nautical miles from the geographical center of any leased tract on the outer Continental Shelf; or</text>
 </subitem></item><item id="H8D91B3CD9DF54813A560F851BFF51E34"><enum>(bb)</enum><text>a municipal subdivision of the State for which—</text> <subitem id="HC75FE79FE7224B2A8ACB6DC88691C486"><enum>(AA)</enum><text>the closest point is more than 200 nautical miles from the geographical center of a leased tract on the outer Continental Shelf; and</text>
 </subitem><subitem id="HDD8B73DDF36642FB9B1E7F2D0A4D5A01"><enum>(BB)</enum><text>the State has determined to be a significant staging area for oil and gas servicing, supply vessels, operations, suppliers, or workers.</text>
 </subitem></item></subclause></clause></subparagraph></paragraph><paragraph id="H1A4A9DB89B684698A8A10E22B019E641"><enum>(4)</enum><header>Administration</header><text display-inline="yes-display-inline">Amounts made available under paragraph (2)(B) shall—</text> <subparagraph id="H3E70B2C0854849029FE19A9CBA1DF6C6"><enum>(A)</enum><text>be made available, without further appropriation, in accordance with this subsection;</text>
 </subparagraph><subparagraph id="H60D9A95EC35242EB9FF618FD2D42F9C4"><enum>(B)</enum><text>remain available until expended;</text> </subparagraph><subparagraph id="H2DB2495AE188414F9CC95367588B831F"><enum>(C)</enum><text>be in addition to any amounts appropriated under—</text>
 <clause id="H825253CE8644411B82ACB9CBF9559F84"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code;</text> </clause><clause id="H208AB67A54DA4E42AE65E11136062794"><enum>(ii)</enum><text display-inline="yes-display-inline">any other provision of this Act; and</text>

				</paragraph></section><section id="HCE9CA5E3943E4B8DB7299FABCE328500"><enum>103.</enum><header>Limitations on the amount of distributed qualified outer Continental Shelf revenues under the Gulf
 of Mexico Energy Security Act of 2006</header><text display-inline="no-display-inline">Section 105(f)(1) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note) is amended to read as follows:</text>

			</section><section id="H33A3B51683D64F618B4190DFC3AD3CAB"><enum>104.</enum><header>Limitation of authority of the President to withdraw areas of the outer Continental Shelf from oil
			 and gas leasing</header>
 <subsection id="HCA358B1BEF3D4245AA924C6E4AC95E53"><enum>(a)</enum><header>Limitation on withdrawal from disposition of lands on the outer Continental Shelf</header><text>Section 12 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1341">43 U.S.C. 1341</external-xref>) is amended by amending subsection (a) to read as follows:</text>

						<subsection id="H67A74270B5624308A6C8CC8A3F301BDA"><enum>(a)</enum><header>Limitation on withdrawal</header>
 <paragraph id="H605756877AE54D04B01CDA0851476266"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, no lands of the outer Continental Shelf may be withdrawn from disposition except by an Act of Congress.</text>
 </paragraph><paragraph id="HF9359FF831C74E0183F78D9CE38089FF"><enum>(2)</enum><header>National marine sanctuaries</header><text>The President may withdraw from disposition any of the unleased lands of the outer Continental Shelf located in a national marine sanctuary designated in accordance with the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431</external-xref> et seq.) or otherwise by statute.</text>
							</paragraph><paragraph id="H1904CECE84E64B80B0D6ABACC3465EBC"><enum>(3)</enum><header>Existing withdrawals</header>
 <subparagraph id="HB06C04E8942E4A549B2B1704180FAA76"><enum>(A)</enum><header>In general</header><text>Except for the withdrawals listed in subparagraph (B), any withdrawal from disposition of lands on the outer Continental Shelf before the date of the enactment of this subsection shall have no force or effect.</text>
 </subparagraph><subparagraph id="H83C5AC6CF6634E71BBB1D080190D0AFA"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to the following withdrawals:</text> <clause id="H426BB1F6416A49D3871D8A1A1296753B"><enum>(i)</enum><text>Any withdrawal in a national marine sanctuary designated in accordance with the National Marine Sanctuaries Act.</text>
 </clause><clause id="H0F574FD2749246BEA33B2A08B81E7C1E"><enum>(ii)</enum><text>Any withdrawal in a national monument declared under section 320301 of title 54, United States Code, or the Act of June 8, 1906 (ch. 3060; 34 Stat. 225).</text>
 </clause><clause commented="no" id="H2A4CAB12529F45099D064539FE85A34E"><enum>(iii)</enum><text display-inline="yes-display-inline">Any withdrawal in the North Aleutian Basin Planning Area, including Bristol Bay.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="H15E893ECB9F2413BBB3B44F812A863BA"><enum>(b)</enum><header>Termination of authority To establish marine national monuments</header><text display-inline="yes-display-inline">Section 320301 of title 54, United States Code, is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HII00" id="HBCED7B8ACA28475E9D565E13F62F4FB9" reported-display-style="italic" style="OLC">
						<subsection id="HFF075AFC9F444ABAB2EBF1CABB9CD248"><enum>(e)</enum><header>Limitation on marine national monuments</header>
 <paragraph id="H95B0E7DFB1FA4A84A371550CED11329B"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsections (a) and (b), the President may not declare or reserve any ocean waters (as such term is defined in section 3 of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1402">33 U.S.C. 1402</external-xref>)) or lands beneath ocean waters as a national monument.</text>
 </paragraph><paragraph id="H5CD55792234A4FB18BFACA55A556B28C"><enum>(2)</enum><header>Marine national monuments designated before the date of the enactment of this subsection</header><text display-inline="yes-display-inline">This subsection shall not affect any national monument designated by the President before the date of the enactment of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="H632A8BEC0F624119896CA06DFD43FCAC"><enum>105.</enum><header>Modification to the outer Continental Shelf leasing program</header><text display-inline="no-display-inline">Section 18(e) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344(e)</external-xref>) is amended by adding at the end the following: <quote>The Secretary shall include in any such revised leasing program each unexecuted lease sale that was included in the most recent leasing program and the Secretary shall execute each such lease sale as close as practicable to the time specified in the most recent leasing program. Section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>) shall be deemed to have been satisfied with respect to the execution of such unexecuted lease sales if the Secretary, in the Secretary’s sole discretion, determines that such section was satisfied with respect to such unexecuted lease sales for the most recent leasing program.</quote>.</text>
 </section><section commented="no" id="H7981FD59440541A4BD79F07E945D07B2"><enum>106.</enum><header>Inspection fee collection</header><text display-inline="no-display-inline">Section 22 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1348">43 U.S.C. 1348</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H122C17E804234806B17158EAB5749AD6" reported-display-style="italic" style="OLC">
					<subsection id="HAD6D70A6028844A19D15596633153B62"><enum>(g)</enum><header>Inspection fees</header>
 <paragraph id="H6701DBA7AEA44B1F9FF94F735BB11AC0"><enum>(1)</enum><header>Establishment</header><text>The Secretary of the Interior shall collect from the operators of facilities subject to inspection under subsection (c) non-refundable fees for such inspections—</text>
 <subparagraph id="H2DDED920B3504DAFA951C1308C9E4C52"><enum>(A)</enum><text>at an aggregate level equal to the amount necessary to offset the annual expenses of inspections of outer Continental Shelf facilities (including mobile offshore drilling units) by the Secretary of the Interior; and</text>
 </subparagraph><subparagraph id="H1951A6F9F497430D9A7EA307C01D2089"><enum>(B)</enum><text>using a schedule that reflects the differences in complexity among the classes of facilities to be inspected.</text>
 </subparagraph></paragraph><paragraph id="H297765A15FD444F5ADDB75BD59806B9F"><enum>(2)</enum><header>Ocean energy safety fund</header><text>There is established in the Treasury a fund, to be known as the <quote>Ocean Energy Safety Fund</quote> (referred to in this subsection as the <quote>Fund</quote>), into which shall be deposited all amounts collected as fees under paragraph (1) and which shall be available as provided under paragraph (3).</text>
						</paragraph><paragraph id="H3DE84A3188A04AB08F15032EB11B4467"><enum>(3)</enum><header>Availability of fees</header>
 <subparagraph id="H685C9756C2A1487495AF7C37289149A2"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 3302 of title 31, United States Code, all amounts deposited in the Fund—</text> <clause id="H3AD71A61039840B68F7B4C955859DBF8"><enum>(i)</enum><text>shall be credited as offsetting collections;</text>
 </clause><clause id="H2790EF41F6444F7890DD2D806524D111"><enum>(ii)</enum><text>shall be available for expenditure for purposes of carrying out inspections of outer Continental Shelf facilities (including mobile offshore drilling units) and the administration of the inspection program under this section;</text>
 </clause><clause id="H75831B61581F4D6999F73573743F4001"><enum>(iii)</enum><text>shall be available only to the extent provided for in advance in an appropriations Act; and</text> </clause><clause id="H36AC444CDE5B485C871C7A5E1679BBB3"><enum>(iv)</enum><text>shall remain available until expended.</text>
 </clause></subparagraph><subparagraph id="H758DC4061D754ED28E2F7F82C1CA5458"><enum>(B)</enum><header>Use for field offices</header><text>Not less than 75 percent of amounts in the Fund may be appropriated for use only for the respective Department of the Interior field offices where the amounts were originally assessed as fees.</text>
 </subparagraph></paragraph><paragraph id="H61C820D3FAFB4E1DA92C1AD51B0CCD97"><enum>(4)</enum><header>Initial fees</header><text>Fees shall be established under this subsection for the fiscal year in which this subsection takes effect and the subsequent 10 years, and shall not be raised, except as determined by the Secretary to be appropriate as an adjustment equal to the percentage by which the Consumer Price Index for the month of June of the calendar year preceding the adjustment exceeds the Consumer Price Index for the month of June of the calendar year in which the fee was determined or last adjusted.</text>
 </paragraph><paragraph id="HCC2E4A0BEF0E4219B26691027F1452F8"><enum>(5)</enum><header>Annual fees</header><text>Annual fees shall be collected under this subsection for facilities that are above the waterline, excluding drilling rigs, and are in place at the start of the fiscal year. Fees for fiscal year 2019 shall be—</text>
 <subparagraph id="H9E304CCAAA774807A8704A228619C333"><enum>(A)</enum><text>$10,500 for facilities with no wells, but with processing equipment or gathering lines;</text> </subparagraph><subparagraph id="HE3125B02FBF7433DB04157AF4308ADED"><enum>(B)</enum><text>$17,000 for facilities with 1 to 10 wells, with any combination of active or inactive wells; and</text>
 </subparagraph><subparagraph id="H8397F84DCD464114A309AA3FFCC0F762"><enum>(C)</enum><text>$31,500 for facilities with more than 10 wells, with any combination of active or inactive wells.</text> </subparagraph></paragraph><paragraph id="H40FA28A7E03E49C3810A58E7118F3E84"><enum>(6)</enum><header>Fees for drilling rigs</header><text display-inline="yes-display-inline">Fees shall be collected under this subsection for drilling rigs on a per inspection basis. Fees for fiscal year 2019 shall be—</text>
 <subparagraph id="HFC469C3F08DD4565A4901879EA470E12"><enum>(A)</enum><text>$30,500 per inspection for rigs operating in water depths of 1,000 feet or more; and</text> </subparagraph><subparagraph id="HE344D97959224310A1E09EE1BF209C02"><enum>(B)</enum><text>$16,700 per inspection for rigs operating in water depths of less than 1,000 feet.</text>
 </subparagraph></paragraph><paragraph id="H29326D220C54413FAD8C40FBF88BDAA7"><enum>(7)</enum><header>Billing</header><text>The Secretary shall bill designated operators under paragraph (5) annually, with payment required within 30 days of billing. The Secretary shall bill designated operators under paragraph (6) within 30 days of the end of the month in which the inspection occurred, with payment required within 30 days after billing.</text>
						</paragraph><paragraph id="HA75E406FC2EF41788A4F542F2D22EAD3"><enum>(8)</enum><header>Annual reports</header>
 <subparagraph id="H71BC1A6DF3E642B28EF1D06F90ED0F16"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the end of each fiscal year beginning with fiscal year 2019 and ending with fiscal year 2029, the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives a report on the operation of the Fund during the fiscal year.</text>
 </subparagraph><subparagraph id="H1BB060C80B4F4DC49CC533F51DDA1F02"><enum>(B)</enum><header>Contents</header><text>Each report shall include, for the fiscal year covered by the report, the following:</text> <clause id="HF1ADB6C561D4448F97497F5780AF67EA"><enum>(i)</enum><text>A statement of the amounts deposited into the Fund.</text>
 </clause><clause id="HF45BE4CB683D45C0A3BCFA5E4261F5D6"><enum>(ii)</enum><text>A description of the expenditures made from the Fund for the fiscal year, including the purpose of the expenditures and the additional hiring of personnel.</text>
 </clause><clause id="HAF3B1255FE1F4D35AB6EDD1388F4AB4A"><enum>(iii)</enum><text>A statement of the balance remaining in the Fund at the end of the fiscal year.</text> </clause><clause id="H57A4A134EE62415AB14D44826BA00CC6"><enum>(iv)</enum><text>An accounting of pace of permit approvals.</text>
 </clause><clause id="H1258A0C7E87A4C0C938A9153CACAE0FE"><enum>(v)</enum><text display-inline="yes-display-inline">If fee increases are proposed, a proper accounting of the potential adverse economic impacts such fee increases will have on offshore economic activity and overall production.</text>
 </clause><clause id="HD903013AC4CF46DEBF8D0B846ADE18CE"><enum>(vi)</enum><text>Recommendations to increase the efficacy and efficiency of offshore inspections.</text> </clause><clause id="H1183DE88917E4619BF78FEEFB28826F3"><enum>(vii)</enum><text>Any corrective actions levied upon offshore inspectors as a result of any form of misconduct.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H91E8BAB808B44AB3A4C8F84953F886E4"><enum>107.</enum><header>Arctic rule shall have no force or effect</header><text display-inline="no-display-inline">The rule entitled <quote>Oil and Gas and Sulfur Operations on the Outer Continental Shelf – Requirements for Exploratory Drilling on the Arctic Outer Continental Shelf</quote> and published in the Federal Register on July 15, 2016 (81 Fed. Reg. 46478), shall have no force or effect.</text>
			</section><section id="H9D60D2C6AF6B42E197269A541405D010"><enum>108.</enum><header>Application of outer Continental Shelf Lands Act with respect to territories of the United States</header>
 <subsection id="HF8513B515D4145EF85F037777BE6A1D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>) is amended—</text> <paragraph id="HE4189C417F8940478FEC4847C1411BD9"><enum>(1)</enum><text>in paragraph (a), by inserting after <quote>control</quote> the following: <quote>or lying within the exclusive economic zone of the United States</quote>;</text>
 </paragraph><paragraph id="H51749F61A0E14721812695FDE54056C1"><enum>(2)</enum><text>in paragraph (p), by striking <quote>and</quote> after the semicolon at the end;</text> </paragraph><paragraph id="H7006A77862634CD9B09CAE0DE8599765"><enum>(3)</enum><text>in paragraph (q), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="H7F3B987CF443490AAD659E568E5BCB41"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" id="HA8D2E2D8F3C847B4A4A33CE14503E8E1" reported-display-style="italic" style="OLC"> <subsection commented="no" id="HD19DB76E8B4144439032879C5F2772C4"><enum>(r)</enum><text>The term <term>State</term> includes each territory of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="HD1D66927973C42CFB52B5C823B38CA84"><enum>(b)</enum><header>Exclusions</header>
 <paragraph id="H35A99129349945E3BC332852C5DE9B96"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4(a) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1333">43 U.S.C. 1333</external-xref>) is amended by adding at the end the following:</text>

 <subsection id="H4E8E326D2E074A209475F8F5A49A2F4F"><enum>(i)</enum><text display-inline="yes-display-inline">This section shall not apply to the scheduling of lease sales in the outer Continental Shelf adjacent to the territories and possessions of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H028B13BDF3C34D54B886C18BEE87A1F1"><enum>(c)</enum><header>Exploration licenses and leases</header><text display-inline="yes-display-inline">Section 8(k) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="HA62C3692BC4543BA8E9CCD3C77D0630A" reported-display-style="italic" style="OLC">
						<paragraph id="H342F6B69A476473CAF72D8B8DE25EC82"><enum>(3)</enum><header>Exploration licenses and leases on outer Continental Shelf adjacent to territories and possessions</header>
 <subparagraph id="H2611805DA97B44E2B0A56D5ABF640B86"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized to grant to any qualified applicant an exploration license which will provide the exclusive right to explore for minerals, other than oil, gas, and sulphur, in an area lying within the United States exclusive economic zone and the outer Continental Shelf adjacent to any territory or possession of the United States.</text>
 </subparagraph><subparagraph id="H7233116DD4D04BE3AF6A46614BF72553"><enum>(B)</enum><header>Application</header><text>Subsection (a) shall not apply to any area conveyed by Congress to a territorial government for administration.</text>
 </subparagraph><subparagraph id="H49A99BA9B5D7471AA07D8C00770D70F0"><enum>(C)</enum><header>Exploration license duration</header><text display-inline="yes-display-inline">Exploration licenses granted under this paragraph will be issued for a period pursuant to regulations prescribed by the Secretary.</text>
 </subparagraph><subparagraph id="HD6064C6DD82148429E77D46E05C11540"><enum>(D)</enum><header>Lease</header><text display-inline="yes-display-inline">Upon showing to the satisfaction of the Secretary that valuable mineral deposits have been discovered by the licensee within the area described by the exploration license of the licensee, the licensee will be entitled to a lease for any or all of that area at a royalty rate established by regulation and lease terms.</text>
 </subparagraph><subparagraph id="H464B11079B1D4436B544E38EE395AB63"><enum>(E)</enum><header>Lease duration</header><text display-inline="yes-display-inline">Leases under this section will be issued for a period established by regulation with a preferential right in the lessee to renew.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="HBD3A03F635554BE2AF688CB7B294B0AE"><enum>109.</enum><header>Wind lease sales for the outer Continental Shelf</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H545FC4098FD649D8861B20D8C3719C58" reported-display-style="italic" style="OLC">
					<section id="H97ACC3D6D7FE400B97309F4A810E75AB"><enum>33.</enum><header>Wind lease sales for the outer Continental Shelf</header>
 <subsection id="H00A711B1650E42308FF33CCA88461C81"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary may conduct wind lease sales for the outer Continental Shelf.</text> </subsection><subsection id="H365626A4BD344A59A690DEC46C746BE0"><enum>(b)</enum><header>Wind lease sale procedure</header><text display-inline="yes-display-inline">Any wind lease sale conducted under this section shall be considered a lease under section 8(p).</text>
 </subsection><subsection id="H58BE7636B6384D1EB30392BF1842FAD1"><enum>(c)</enum><header>Wind lease sale off coast of California</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Defense, shall offer a wind lease sale for the outer Continental Shelf off the coast of California as soon as practicable, but not later than one year after the date of enactment of this section.</text>
						</subsection><subsection id="HFDC4AF402BC94020BC41716063C86B3C"><enum>(d)</enum><header>Wind lease sales off coast of Puerto Rico, Virgin Islands of the United States, Guam, American
			 Samoa, and the Commonwealth of the Northern Mariana Islands</header>
							<paragraph id="H48B45FC53F824634A1139EE379F22BEB"><enum>(1)</enum><header>Study on feasibility of conducting wind lease sales off coast of Puerto Rico, Virgin Islands of the
			 United States, Guam, American Samoa, and the Commonwealth of the Northern
			 Mariana Islands</header>
 <subparagraph id="HEF8FA8D6FFEB4F0BADEC76BBFBEF98D4"><enum>(A)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary shall conduct a study on the feasibility, including the long term economic feasibility, of conducting wind lease sales for the outer Continental Shelf off the coast of Puerto Rico, the Virgin Islands of the United States, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text>
 </subparagraph><subparagraph id="H9D973F8CB076467BBD74654CE96C9291"><enum>(B)</enum><header>Submission of results</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary shall submit to Congress the results of the study conducted under subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="HC22AA77A8D304201927DC071AC293CB3"><enum>(2)</enum><header>Wind lease sales conditional upon results of study</header>
 <subparagraph id="H6B1C66FBF84B4B27BF6CD49D656D7180"><enum>(A)</enum><header>Wind lease sale off coast of Puerto Rico</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of Puerto Rico is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of Puerto Rico as soon as practicable, but not later than one year after the date of the enactment of this section.</text>
 </subparagraph><subparagraph id="HF755762E819B4718B7834036EE592CFA"><enum>(B)</enum><header>Wind lease sale off coast of Virgin Islands of the United States</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of the Virgin Islands of the United States is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of the Virgin Islands of the United States as soon as practicable, but not later than one year after the date of the enactment of this section.</text>
 </subparagraph><subparagraph id="H1289755BE8E64716896FAFC609007BB4"><enum>(C)</enum><header>Wind lease sale off coast of Guam</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of Guam is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of Guam as soon as practicable, but not later than one year after the date of the enactment of this section.</text>
 </subparagraph><subparagraph id="H2120770DD5FF43FBA589E9A4BD5E880D"><enum>(D)</enum><header>Wind lease sale off coast of American Samoa</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of American Samoa is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of American Samoa as soon as practicable, but not later than one year after the date of the enactment of this section.</text>
 </subparagraph><subparagraph id="H3F9D7F379BE246FC9BF7635D9C970DFE"><enum>(E)</enum><header>Wind lease sale off coast of the Commonwealth of the Northern Mariana Islands</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of the Commonwealth of the Northern Mariana Islands is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of the Commonwealth of the Northern Mariana Islands as soon as practicable, but not later than one year after the date of the enactment of this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HBFF6C446E7224C83802794121E67FE23"><enum>(e)</enum><header>Wind lease sale off coast of Hawaii</header>
							<paragraph id="H3D870AB30D2A4DC89F34CC586BCD2BD0"><enum>(1)</enum><header>Study on feasibility of conducting wind lease sales off coast of the State of Hawaii</header>
 <subparagraph id="HDFF31315BAE44983A7C3E83D0F241BEC"><enum>(A)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Defense, shall conduct a study on the feasibility of conducting wind lease sales for the outer Continental Shelf off the coast of the State of Hawaii.</text>
 </subparagraph><subparagraph id="HCCA619EC779E48CF85C5DD57DA7CE42F"><enum>(B)</enum><header>Submission of results</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Secretary shall submit to Congress the results of the study conducted under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="H3CFA63FF5AD0457F8577EDC1583E5F5A"><enum>(2)</enum><header>Wind lease sales conditional upon results of study</header><text display-inline="yes-display-inline">If the study required under paragraph (1)(A) concludes that a wind lease sale for the outer Continental Shelf off the coast of the State of Hawaii is feasible, then the Secretary shall offer a wind lease sale for the outer Continental Shelf off the coast of the State of Hawaii as soon as practicable, but not later than one year after the date of the enactment of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HF5B254405C4045FCB6C462A31E698171" section-type="subsequent-section"><enum>110.</enum><header>Reducing permitting delays for taking of marine mammals</header>
 <subsection id="HC7569C385A9648C1B538AA497EA78F2E"><enum>(a)</enum><header>Addressing permits for taking of marine mammals</header><text display-inline="yes-display-inline">Section 101(a)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(5)(D)</external-xref>) is amended as follows:</text>
 <paragraph id="H63979897ABB3486AA2528DC770A342C1"><enum>(1)</enum><text>In clause (i)—</text> <subparagraph id="HCAD4C64DCA3C48B49D6D7474681B66E8"><enum>(A)</enum><text>by striking <quote>citizens of the United States</quote> and inserting <quote>persons</quote>;</text>
 </subparagraph><subparagraph id="H120AA70F6E0C49129B287C0429A08B53"><enum>(B)</enum><text>by striking <quote>within a specific geographic region</quote>;</text> </subparagraph><subparagraph id="HE03E04213413429C8317FABE775CE878"><enum>(C)</enum><text>by striking <quote>of small numbers</quote>;</text>
 </subparagraph><subparagraph id="HF57D2F296B6E4BB49655C0C3F90A04B7"><enum>(D)</enum><text>by striking <quote>such citizens</quote> and inserting <quote>such persons</quote>; and</text> </subparagraph><subparagraph id="H7A9CD943E4184232AEA5C134DE1548FA"><enum>(E)</enum><text>by striking <quote>within that region</quote>.</text>
 </subparagraph></paragraph><paragraph id="H71587DC3E2674EC986379EFB77508F0B"><enum>(2)</enum><text>In clause (ii)—</text> <subparagraph id="H064F9ECF09654D7AB196E3E8920DA271"><enum>(A)</enum><text>in subclause (I), by striking <quote>, and other means of effecting the least practicable impact on such species or stock and its habitat</quote>;</text>
 </subparagraph><subparagraph id="H73E759AC94FD457D87D0FFF669740F9C"><enum>(B)</enum><text display-inline="yes-display-inline">in subclause (III), by striking <quote>requirements pertaining to the monitoring and reporting of such taking by harassment, including</quote> and inserting <quote>efficient and practical requirements pertaining to the monitoring of such taking by harassment while the activity is being conducted and the reporting of such taking, including, as the Secretary determines necessary, </quote>; and</text>
 </subparagraph><subparagraph id="HED0C43C5EA694D71A9F685FCB6C2D8CA"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H19D397A0893D4F79BBF299274ABD07CC" reported-display-style="italic" style="OLC"> <quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Any condition imposed pursuant to subclause (I), (II), or (III) may not result in more than a minor change to the specified activity and may not alter the basic design, location, scope, duration, or timing of the specified activity.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="H80023470C7904E2D9D681345F9DE277A"><enum>(3)</enum><text>In clause (iii), by striking <quote>receiving an application under this subparagraph</quote> and inserting <quote>an application is accepted or required to be considered complete under subclause (I)(aa), (II)(aa), or (IV) of clause (viii), as applicable,</quote>.</text>
 </paragraph><paragraph id="HA58D43AAD1134B369B61AFE20C5A1F0D"><enum>(4)</enum><text>In clause (vi), by striking <quote>a determination of <quote>least practicable adverse impact on such species or stock</quote> under clause (i)(I)</quote> and inserting <quote>conditions imposed under subclause (I), (II), or (III) of clause (ii)</quote>.</text> </paragraph><paragraph id="H7162B0AF4B3A47EDB2B1FA4B3299FD9E"><enum>(5)</enum><text>By adding at the end the following:</text>

							<clause id="H771797CDC57240A596C951AEC1102228" indent="up2"><enum>(viii)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H97E4C6C8F8F94829B472E3F4863CA4B3"><enum>(I)</enum><text display-inline="yes-display-inline">The Secretary shall—</text> <item changed="added" committee-id="HII00" id="HD81A87C56BA4466A9CB0968FE083523F" indent="up1" reported-display-style="italic"><enum>(aa)</enum><text>accept as complete a written request for authorization under this subparagraph for incidental taking described in clause (i), by not later than 45 days after the date of submission of the request; or</text>
 </item><item changed="added" committee-id="HII00" id="HF78401549CAB4F9293D47061FB85748E" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text>provide to the requester, by not later than 15 days after the date of submission of the request, a written notice describing any additional information required to complete the request.</text>
 </item></subclause><subclause changed="added" committee-id="HII00" id="H8887908EB6B84406AA34E155FB14313E" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>If the Secretary provides notice under subclause (I)(bb), the Secretary shall, by not later than 30 days after the date of submission of the additional information described in the notice—</text>
 <item id="H8B832A6D9469432085259D7E1124151B"><enum>(aa)</enum><text display-inline="yes-display-inline">accept the written request for authorization under this subparagraph for incidental taking described in clause (i); or</text>
 </item><item id="HFD9FEAB9A42F4B559BA6476176FE0B52"><enum>(bb)</enum><text>deny the request and provide the requester a written explanation of the reasons for the denial.</text> </item></subclause><subclause changed="added" committee-id="HII00" id="H668D981EFD5E49729E10B2ADF348EC93" indent="up1" reported-display-style="italic"><enum>(III)</enum><text display-inline="yes-display-inline">The Secretary may not under this subparagraph make a second request for information, request that the requester withdraw and resubmit the request, or otherwise delay a decision on the request.</text>
 </subclause><subclause changed="added" committee-id="HII00" id="H24B5B3F7A2B0423DBE43173A847E1AD7" indent="up1" reported-display-style="italic"><enum>(IV)</enum><text>If the Secretary fails to respond to a request for authorization under this subparagraph in the manner provided in subclause (I) or (II), the request shall be considered to be complete.</text>
								</subclause></clause><clause id="H12D6A3011E2940B6BF28C010C325EC7F" indent="up2"><enum>(ix)</enum>
 <subclause commented="no" display-inline="yes-display-inline" id="H96305150FBDE4140B6354E2E9C747547"><enum>(I)</enum><text>At least 90 days before the date of the expiration of any authorization issued under this subparagraph, the holder of such authorization may apply for a one-year extension of such authorization. The Secretary shall grant such extension within 14 days after the date of such request on the same terms and without further review if there has been no substantial change in the activity carried out under such authorization nor in the status of the marine mammal species or stock, as applicable, as reported in the final annual stock assessment reports for such species or stock.</text>
 </subclause><subclause changed="added" committee-id="HII00" id="H540CF733CC154B2781BB16CB26126DA7" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">In subclause (I) the term <term>substantial change</term> means a change that prevents the Secretary from making the required findings to issue an authorization under clause (i) with respect to such species or stock.</text>
 </subclause><subclause changed="added" committee-id="HII00" id="HF1B2733EA051467C8DEDE9B69CF2F21B" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>The Secretary shall notify the applicant of such substantial changes with specificity and in writing within 14 days after the applicant’s submittal of the extension request.</text>
 </subclause></clause><clause commented="no" id="H35999D9429094B91948C0DB8EFDB7328" indent="up2"><enum>(x)</enum><text display-inline="yes-display-inline">If the Secretary fails to make the required findings and, as appropriate, issue the authorization within 120 days after the application is accepted or required to be considered complete under subclause (I)(aa), (II)(aa), or (III) of clause (viii), as applicable, the authorization is deemed to have been issued on the terms stated in the application and without further process or restrictions under this Act.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H6AE21EA594194FE8BF4EF280D1F7B79D"><enum>(b)</enum><header>Removing duplications</header><text display-inline="yes-display-inline">Section 101(a)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(5)(D)</external-xref>), as amended by subsection (a), is further amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H5272561E08C04DF98585C954BF4E5B7A" reported-display-style="italic" style="OLC">
 <clause id="H1A525EAE4C104A6B9D9FC8047F0E3C50" indent="up2"><enum>(xi)</enum><text display-inline="yes-display-inline">Any taking of a marine mammal in compliance with an authorization under this subparagraph is exempt from the prohibition on taking in section 9 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538</external-xref>). Any Federal agency authorizing, funding, or carrying out an action that results in such taking, and any agency action authorizing such taking, is exempt from the requirement to consult regarding potential impacts to marine mammal species or designated critical habitat under section 7(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HC761B35A12C5452191D70FBE9A2794F3"><enum>(c)</enum><header>Transfer of certain responsibilities to the Secretary of the Interior</header><text display-inline="yes-display-inline">Section 3(12) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1362">16 U.S.C. 1362(12)</external-xref>) is amended—</text> <paragraph id="H623DC2F319E34565AEFFC777B29F72EA"><enum>(1)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>; and</text>
 </paragraph><paragraph id="HF6809C8D9E734ABC9DA021085DC4CF71"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H1DC6AF3F93BF45F481CD709770E772F6" reported-display-style="italic" style="OLC"> <subparagraph id="H2155CE0A03B5487A84BA53DC7F2C3708"><enum>(C)</enum><text display-inline="yes-display-inline">In sections 101(a)(3), 101(a)(5), 103, and 104 (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(3)</external-xref>, 1371(a)(5), 1373, and 1374), for activities associated with operations authorized under the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> et seq.), the term <quote>Secretary</quote> means the Secretary of the Interior with respect to all marine mammals.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection></section><section id="HB6CD9FD537EE4E39984F1F84257DC95A"><enum>111.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act, with respect to the State of Florida, shall be construed to modify—</text> <paragraph id="H9C646CBEBF744E38B95BCD96C7CD4A75"><enum>(1)</enum><text>the moratorium imposed by section 104 of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note); or</text>
 </paragraph><paragraph id="H59C8AFCE83564419B11ABE473373B6FC"><enum>(2)</enum><text>the 2017–2022 leasing program prepared under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>).</text>
				</paragraph></section></title><title id="H951F834CC6CF4E41A85D1734B1CC2AB2"><enum>II</enum><header>Onshore</header>
 <section id="HC2021DF9A783450784D26D959B667977" section-type="subsequent-section"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Opportunities for the Nation and States to Harness Onshore Resources for Energy Act</short-title></quote> or the <quote><short-title>ONSHORE Act</short-title></quote>.</text> </section><section id="HE907EA8A83EE4EBFAA33E08C9D7243E5"><enum>202.</enum><header>Cooperative federalism in oil and gas permitting on available Federal land</header> <subsection id="H32547A0FFB044A0D998DF896B86AC763"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) is amended—</text>
 <paragraph id="H6898D341069F4E4893568C5EE3FE33B4"><enum>(1)</enum><text>by redesignating section 44 as section 47; and</text> </paragraph><paragraph id="H8755E66DEC574FCDB050C5B9635A569B"><enum>(2)</enum><text>by adding after section 43 the following new section:</text>

								<subsection commented="no" id="H8FEDEE67EAC8455E88E40A6E800197DE"><enum>(a)</enum><header>Authorizations</header>
 <paragraph commented="no" id="HE939EEA7ECF14979AECCD893D667FD40"><enum>(1)</enum><header>In general</header><text>Upon receipt of an application under subsection (b), the Secretary may delegate to a State exclusive authority—</text>
 <subparagraph commented="no" id="H875002D314E049658C5F4ACC58E403CD"><enum>(A)</enum><text display-inline="yes-display-inline">to issue an APD on available Federal land; or</text> </subparagraph><subparagraph commented="no" id="H098C9FE407094297AFD2F63ABEBBF9E0"><enum>(B)</enum><text display-inline="yes-display-inline">to approve drilling plans on available Federal land.</text>
 </subparagraph></paragraph><paragraph commented="no" id="HB9AD6C4A84AF4C22A9D034DECD68CBB2"><enum>(2)</enum><header>Sundry notices</header><text display-inline="yes-display-inline">Any authorization under paragraph (1) may, upon the request of the State, include authority to issue sundry notices.</text>
 </paragraph><paragraph id="H085DDA7269524A74881B182072ECFCA7"><enum>(3)</enum><header>Inspection and enforcement</header><text display-inline="yes-display-inline">Any authorization under paragraph (1) may, upon the request of the State, include authorization to inspect and enforce an APD or drilling plan, as applicable. An authorization under paragraph (1)(A) shall not affect the ability of the Secretary to collect inspection fees under section 108(d) of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1718">30 U.S.C. 1718(d)</external-xref>).</text>
									</paragraph></subsection><subsection id="HCF7F140DCA7A452499DF52BD1A9CCC96"><enum>(b)</enum><header>State application process</header>
 <paragraph id="HBB5450EEF5FB4F35B5DE222D21C701FC"><enum>(1)</enum><header>Submission of application</header><text>A State may submit an application under subparagraph (A) or (B) of subsection (a)(1) to the Secretary at such time and in such manner as the Secretary may require.</text>
 </paragraph><paragraph id="H871D0D225C2744158C9FEBCF598F249F"><enum>(2)</enum><header>Content of application</header><text>An application submitted under this subsection shall include—</text> <subparagraph id="HFABAD100C4134F2CA6B29F93A65D8380"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the State program that the State proposes to administer under State law; and</text>
 </subparagraph><subparagraph id="HB2B3A2B1377B4045A9EBBE31B5E4649A"><enum>(B)</enum><text display-inline="yes-display-inline">a statement from the Governor or attorney general of such State that the laws of such State provide adequate authority to carry out the State program.</text>
 </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H0827272304A444ABAFE3BD90F5E3AE72"><enum>(3)</enum><header>Deadline for approval or disapproval</header><text display-inline="yes-display-inline">Not later than 180 days after the date of receipt of an application under this subsection, the Secretary shall approve or disapprove such application.</text>
 </paragraph><paragraph id="HB87B4D3587334037A8310FDF73F27106"><enum>(4)</enum><header>Criteria for approval</header><text display-inline="yes-display-inline">The Secretary may approve an application received under this subsection only if the Secretary has—</text> <subparagraph id="H26A049C1924D4E9C9D0C115E237D75DA"><enum>(A)</enum><text display-inline="yes-display-inline">determined that the State applicant would be at least as effective as the Secretary in issuing APDs or in approving drilling plans, as applicable;</text>
 </subparagraph><subparagraph id="H8BC631C46E014C7F9FC7D8394A881631"><enum>(B)</enum><text display-inline="yes-display-inline">determined that the State program of the State applicant—</text> <clause id="H4515301333044AC18CDA07BC896589AC"><enum>(i)</enum><text>complies with this Act; and</text>
 </clause><clause id="HF6D8AFEE21FA4A638B2930BC99DEF5A5"><enum>(ii)</enum><text display-inline="yes-display-inline">provides for the termination or modification of an issued APD or approved drilling plan, as applicable, for cause, including for—</text>
 <subclause id="H822BF1567EDC4FCE872E5C065BDE31C4"><enum>(I)</enum><text>the violation of any condition of the issued APD or approved drilling plan;</text> </subclause><subclause id="HEF3E5B7FE96E40C996F1D9CAAE7723E3"><enum>(II)</enum><text display-inline="yes-display-inline">obtaining the issued APD or approved drilling plan by misrepresentation; or</text>
 </subclause><subclause id="H5A34FEABC02E403F9E66033FC31204D1"><enum>(III)</enum><text display-inline="yes-display-inline">failure to fully disclose in the application all relevant facts;</text> </subclause></clause></subparagraph><subparagraph id="HA3FA3693906A4032A32CFFB588F45BF5"><enum>(C)</enum><text>determined that the State applicant has sufficient administrative and technical personnel and sufficient funding to carry out the State program;</text>
 </subparagraph><subparagraph id="H955BC188242A48458E869D0D9372EEF0"><enum>(D)</enum><text display-inline="yes-display-inline">provided notice to the public, solicited public comment, and held a public hearing within the State;</text>
 </subparagraph><subparagraph id="HE4C0A27AEB6143E8A020CDE11D1C0A11"><enum>(E)</enum><text>determined that approval of the application would not result in decreased royalty payments owed to the United States under section 35(a), except as provided in subsection (e) of that section; and</text>
 </subparagraph><subparagraph id="H776094153E234DB0AC4FD00850876D1D"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of a State applicant seeking authority under subsection (a)(3) to inspect and enforce APDs or drilling plans, as applicable, entered into a memorandum of understanding with a State applicant that delineates the Federal and State responsibilities with respect to such inspection and enforcement.</text>
 </subparagraph></paragraph><paragraph id="H46D26D9B19B941F8AC9D485DA8ECBB74"><enum>(5)</enum><header>Disapproval</header><text display-inline="yes-display-inline">If the Secretary disapproves an application submitted under this subsection, then the Secretary shall—</text>
 <subparagraph id="H7D5117574EFD4944A75F4246F628A59B"><enum>(A)</enum><text display-inline="yes-display-inline">notify, in writing, the State applicant of the reason for the disapproval and any revisions or modifications necessary to obtain approval; and</text>
 </subparagraph><subparagraph id="H4C53E2E6127A4F5F9CAA7F1C836B2C40"><enum>(B)</enum><text>provide any additional information, data, or analysis upon which the disapproval is based.</text> </subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H5381E147EF7648DEBD4AE346F9EBB3CC"><enum>(6)</enum><header>Resubmittal of application</header><text display-inline="yes-display-inline">A State may resubmit an application under this subsection at any time.</text>
 </paragraph><paragraph id="HC5F58E3BE32144878FA909BFCF334CDC"><enum>(7)</enum><header>State Memorandum of Understanding</header><text display-inline="yes-display-inline">Before a State submits an application under this subsection, the Secretary may, at the request of a State, enter into a memorandum of understanding with the State regarding the proposed State program—</text>
 <subparagraph id="HE430A208B70A49C58B8E15857B022330"><enum>(A)</enum><text display-inline="yes-display-inline">to delineate the Federal and State responsibilities for oil and gas regulations;</text> </subparagraph><subparagraph id="HC69626ACA16847028176F7ED2DA585E5"><enum>(B)</enum><text>to provide technical assistance; and</text>
 </subparagraph><subparagraph id="HC32DE9D72340426EA9AFAB8CC89C5999"><enum>(C)</enum><text>to share best management practices.</text> </subparagraph></paragraph></subsection><subsection commented="no" id="H6718CC4B2D184729B03D811140A78298"><enum>(c)</enum><header>Administrative fees for APDs</header> <paragraph commented="no" id="H69D08E6202184590B059049B4C9E0114"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State for which authority has been delegated under subsection (a)(1)(A) may collect a fee for each application for an APD that is submitted to the State.</text>
 </paragraph><paragraph id="HF1233FFA7B4845278420CF58FA80A64A"><enum>(2)</enum><header>No collection of fee by Secretary</header><text>The Secretary may not collect a fee from the applicant or from the State for an application for an APD that is submitted to a State for which authority has been delegated under subsection (a)(1)(A).</text>
 </paragraph><paragraph commented="no" id="HBE9FB6CE1F9F483BB3717EB4BADCA779"><enum>(3)</enum><header>Fee amount</header><text display-inline="yes-display-inline">The fee collected under paragraph (1) shall be less than or equal to the amount of the fee collected by the Secretary under section 35(d)(2)from States for which authority has not been delegated under subsection (a)(1)(A).</text>
 </paragraph><paragraph commented="no" id="H86666E4E8FC14312BFA2E1E3225E7736"><enum>(4)</enum><header>Use</header><text>A State shall use 100 percent of the fees collected under this subsection for the administration of the approved State program of the State.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDA497AA19EDD4C2CB4A3D5B8EC1A3624"><enum>(d)</enum><header>Voluntary termination of authority</header><text display-inline="yes-display-inline">A State may voluntarily terminate any authority delegated to such State under subsection (a) upon providing written notice to the Secretary 60 days in advance. Upon expiration of such 60-day period, the Secretary shall resume any activities for which authority was delegated to the State under subsection (a).</text>
								</subsection><subsection id="H843A64F2C3484EABB3C7DD180518DED7"><enum>(e)</enum><header>Appeal of denial of application for APD or application for approval of drilling plan</header>
 <paragraph id="H0F19722CBCF347ABA32C16621D5BFEAA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a State for which the Secretary has delegated authority under subsection (a)(1) denies an application for an APD or an application for approval of a drilling plan, the applicant may appeal such decision to the Department of the Interior Office of Hearings and Appeals.</text>
 </paragraph><paragraph id="H30F46DC82C064D75B27115FD822CFF35"><enum>(2)</enum><header>Fee allowed</header><text>The Secretary may charge the applicant a fee for the appeal referred to in paragraph (1).</text> </paragraph></subsection><subsection id="H22BAABF1E5C94DE985E88B95AF63041E"><enum>(f)</enum><header>Federal administration of State program</header> <paragraph id="H65B99BA0AF704292B7567F535A091AEE"><enum>(1)</enum><header>Notification</header><text>If the Secretary has reason to believe that a State is not administering or enforcing an approved State program, the Secretary shall notify the relevant State regulatory authority of any possible deficiencies.</text>
 </paragraph><paragraph id="H050A887F2C72476291A9E2E113042A3C"><enum>(2)</enum><header>State response</header><text>Not later than 30 days after the date on which a State receives notification of a possible deficiency under paragraph (1), the State shall—</text>
 <subparagraph id="H408B33A50F1B40F1A4A8F3B4FB85BE00"><enum>(A)</enum><text>take appropriate action to correct the possible deficiency; and</text> </subparagraph><subparagraph id="H1A99BEC143E644E2AA3C9CCA6955D910"><enum>(B)</enum><text>notify the Secretary of the action in writing.</text>
										</subparagraph></paragraph><paragraph id="H83F579271548466EA1F9DB1B96852BF4"><enum>(3)</enum><header>Determination</header>
 <subparagraph id="H205DDBD2E5324AD49EC0F80660B27353"><enum>(A)</enum><header>In general</header><text>On expiration of the 30-day period referred to in paragraph (2), if the Secretary determines that a violation of all or any part of an approved State program has resulted from a failure of the State to administer or enforce the approved State program of the State or that the State has not demonstrated its capability and intent to administer or enforce such a program, the Secretary shall issue public notice of such a determination.</text>
 </subparagraph><subparagraph id="H4BFDB00140264F4C817EC160C6268320"><enum>(B)</enum><header>Appeal</header><text display-inline="yes-display-inline">A State may appeal the determination of the Secretary under subparagraph (A) in the applicable United States District Court. The Secretary may not resume activities under paragraph (4) pending the resolution of the appeal.</text>
 </subparagraph></paragraph><paragraph id="HCFFD09890A2440AEA019A90E4804662C"><enum>(4)</enum><header>Resumption by Secretary</header><text>If the Secretary has made a determination under paragraph (3), the Secretary shall resume any activities for which authority was delegated to the State during the period—</text>
 <subparagraph id="HA86790CC7AA74BDA90AC9516B3393508"><enum>(A)</enum><text>beginning on the date on which the Secretary issues the public notice under paragraph (3); and</text> </subparagraph><subparagraph id="H065742E4212C402184CF193E91672758"><enum>(B)</enum><text>ending on the date on which the Secretary determines that the State will administer or enforce, as applicable, the approved State program of the State.</text>
 </subparagraph></paragraph><paragraph id="HF856FB35454C49C28F8E48F1F2443664"><enum>(5)</enum><header>Standing</header><text>States with approved regulatory programs shall have standing to sue the Secretary for any action taken under this subsection.</text>
 </paragraph></subsection><subsection id="HA1F3C0F774334764B631B79061AF971D"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H672C1C5CC84C43B2818AF69EF3D4AB26"><enum>(1)</enum><header>Available Federal land</header><text display-inline="yes-display-inline">The term <term>available Federal land</term> means any Federal land that—</text>
 <subparagraph id="H297FB4E862DD45A38A0B4FF26559E563"><enum>(A)</enum><text display-inline="yes-display-inline">is located within the boundaries of a State;</text> </subparagraph><subparagraph id="H1307FFB631AB4E1EA84CC50B3AFC952C"><enum>(B)</enum><text display-inline="yes-display-inline">is not held by the United States in trust for the benefit of a federally recognized Indian Tribe or a member of such an Indian Tribe;</text>
 </subparagraph><subparagraph id="HF62FEF9ED7A14316AF60D87A6F27BF4C"><enum>(C)</enum><text>is not a unit of the National Park System;</text> </subparagraph><subparagraph id="HD3346FD0F4BC4076BE9E875E47C8EA80"><enum>(D)</enum><text>is not a unit of the National Wildlife Refuge System, except for the portion of such unit for which oil and gas drilling is allowed under law;</text>
 </subparagraph><subparagraph id="H6350BB4A2A5749419B2F27305ADB5C68"><enum>(E)</enum><text>is not a congressionally approved wilderness area under the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131</external-xref> et seq.); and</text>
 </subparagraph><subparagraph id="H7CCAC362294E496FBF6C5F583F43265F"><enum>(F)</enum><text>has been identified as land available for lease or has been leased for the exploration, development, and production of oil and gas—</text>
 <clause id="H507545AB7E0F4AA9B56D5E15A5BFF635"><enum>(i)</enum><text>by the Bureau of Land Management under—</text> <subclause id="H396BC3626F6B40848AE037CE9DCAB2F7"><enum>(I)</enum><text>a resource management plan under the process provided for in the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.); or</text>
 </subclause><subclause id="H87EFC4A8EAAE4F4AA1560CB1B4CCC153"><enum>(II)</enum><text>an integrated activity plan with respect to the National Petroleum Reserve in Alaska; or</text> </subclause></clause><clause id="H151CB1B4BA884D699623D676137CF3D7"><enum>(ii)</enum><text display-inline="yes-display-inline">by the Forest Service under a National Forest management plan under the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600</external-xref> et seq.).</text>
 </clause></subparagraph></paragraph><paragraph id="HDC76275099814EFD944AB7B70EB54644"><enum>(2)</enum><header>Drilling plan</header><text display-inline="yes-display-inline">The term <term>drilling plan</term> means a plan described under section 3162.3–1(e) of title 43, Code of Federal Regulations (or successor regulation).</text>
 </paragraph><paragraph id="H1254960AFFAD46348D778A5C90313155"><enum>(3)</enum><header>APD</header><text>The term <term>APD</term> means a permit—</text> <subparagraph id="H1EBE44A000BA41608580CA5185CF949C"><enum>(A)</enum><text display-inline="yes-display-inline">that grants authority to drill for oil and gas; and</text>
 </subparagraph><subparagraph id="H7117B37E55D04DA39B48162E471F1F5B"><enum>(B)</enum><text>for which an application has been received that contains—</text> <clause id="H01BB4E47649D4D399F4125F95B077701"><enum>(i)</enum><text display-inline="yes-display-inline">a drilling plan;</text>
 </clause><clause id="H7DB1402A04BA4C419CFF751C6BB30BD4"><enum>(ii)</enum><text display-inline="yes-display-inline">a surface use plan of operations described under section 3162.3–1(f) of title 43, Code of Federal Regulations (or successor regulation);</text>
 </clause><clause id="H7C42E6382CF246008A224ABC285F219C"><enum>(iii)</enum><text>evidence of bond coverage; and</text> </clause><clause id="HFA61A93CE70B4337ACE6B4E05CAD87B9"><enum>(iv)</enum><text>such other information as may be required by applicable orders and notices.</text>
 </clause></subparagraph></paragraph><paragraph id="H5312FD89059E47CDA52C4FC5D2B7D963"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph><paragraph id="HE960D812DFD14B8EB3780A21E083AB55"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States.</text>
 </paragraph><paragraph commented="no" id="H6D325058EEA7476B961D1C79D6138BE4"><enum>(6)</enum><header>State applicant</header><text>The term <term>State applicant</term> means a State that has submitted an application under subsection (b).</text> </paragraph><paragraph id="HBDF7B46117AC41228E6F145281073E92"><enum>(7)</enum><header>State program</header><text display-inline="yes-display-inline">The term <term>State program</term> means a program that provides for a State to—</text>
 <subparagraph display-inline="no-display-inline" id="H313FBC055A4B42A4946000156EA77908"><enum>(A)</enum><text display-inline="yes-display-inline">issue APDs or approve drilling plans, as applicable, on available Federal land; and</text> </subparagraph><subparagraph id="HCA7AB2FCD7DD4C7F9604B12F93FD17D7"><enum>(B)</enum><text display-inline="yes-display-inline">impose sanctions for violations of State laws, regulations, or any condition of an issued APD or approved drilling plan, as applicable.</text>
 </subparagraph></paragraph><paragraph id="HCCF43441B68D4C6EAF7DC2AE2CE87FFF"><enum>(8)</enum><header>Sundry notice</header><text display-inline="yes-display-inline">The term <term>sundry notice</term> means a written request—</text> <subparagraph id="H96902D08A8A74F4186951F22B5CDE1CF"><enum>(A)</enum><text display-inline="yes-display-inline">to perform work not covered under an APD or drilling plan; or</text>
 </subparagraph><subparagraph id="HECB9E5BF4B9040B7B3AC269D07835122"><enum>(B)</enum><text display-inline="yes-display-inline">for a change to operations covered under a an APD or drilling plan.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="H391639106E414397923F184357D86A31"><enum>(b)</enum><header>Inspection fees</header><text>Section 108 of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1718">30 U.S.C. 1718</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block changed="added" committee-id="HII00" display-inline="no-display-inline" id="H162FA1FAD5DC42EC92FA9045EC52758D" reported-display-style="italic" style="OLC">
						<subsection id="H314AAEA8E0174C0DB21B7EF3DDF6B3D9"><enum>(d)</enum><header>Inspection fees for certain States</header>
 <paragraph id="H0B36AA3D93454148B2C30411FCFB3299"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct inspections of operations under each oil and gas lease. The Secretary shall collect annual nonrefundable inspection fees in the amount specified in paragraph (2), from each designated operator under each oil and gas lease on Federal or Indian land that is subject to inspection under subsection (b) and that is located in a State for which the Secretary has delegated authority under section 44(a)(1)(A) of the Mineral Leasing Act.</text>
 </paragraph><paragraph id="H98EA6C12A26E443D962122BE3A6532BD"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of the fees collected under paragraph (1) shall be—</text> <subparagraph id="H76A9D91A7CD44A5283426B68A89ECD8A"><enum>(A)</enum><text>$700 for each lease or unit or communitization agreement with no active or inactive wells, but with surface use, disturbance or reclamation;</text>
 </subparagraph><subparagraph id="H7C72936AA6D043B08CEBB59EB23F85D4"><enum>(B)</enum><text>$1,225 for each lease or unit or communitization agreement with 1 to 10 wells, with any combination of active or inactive wells;</text>
 </subparagraph><subparagraph id="H6F310A12A3614496BED0629B7A87B770"><enum>(C)</enum><text>$4,900 for each lease or unit or communitization agreement with 11 to 50 wells, with any combination of active or inactive wells; and</text>
 </subparagraph><subparagraph id="H3FD87E8148114F58943DBDE7224296DE"><enum>(D)</enum><text>$9,800 for each lease or unit or communitization agreement with more than 50 wells, with any combination of active or inactive wells.</text>
 </subparagraph></paragraph><paragraph id="H4321AB899F36430F8C787E6109B1932B"><enum>(3)</enum><header>Onshore energy safety fund</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>Onshore Energy Safety Fund</quote> (referred to in this subsection as the <quote>Fund</quote>), into which shall be deposited all amounts collected as fees under paragraph (1) and which shall be available as provided under paragraph (4).</text>
 </paragraph><paragraph id="H68ECD39AC09C46EB9F30A4C26D4E2BFB"><enum>(4)</enum><header>Availability of fees</header><text>Notwithstanding section 3302 of title 31, United States Code, all amounts deposited in the Fund—</text> <subparagraph id="H870FC0B7774D4F4B84496220BA316387"><enum>(A)</enum><text>shall be credited as offsetting collections;</text>
 </subparagraph><subparagraph id="HF7D9FED59BDA4605B7BF249A3F12BD46"><enum>(B)</enum><text display-inline="yes-display-inline">shall be available for expenditure for purposes of carrying out inspections of onshore oil and gas operations in those States for which the Secretary has delegated authority under section 44(a)(1)(A) of the Mineral Leasing Act;</text>
 </subparagraph><subparagraph id="H69A3BB883AAA4292B43FE7CFBF7D9B1F"><enum>(C)</enum><text>shall be available only to the extent provided for in advance in an appropriations Act; and</text> </subparagraph><subparagraph id="HE5598F952A7A44C5905EB0BBE73EB18A"><enum>(D)</enum><text>shall remain available until expended.</text>
 </subparagraph></paragraph><paragraph id="H55844A266E264A8ABAA67D4B4C61A041"><enum>(5)</enum><header>Payment due date</header><text display-inline="yes-display-inline">The Secretary shall require payment of any fee assessed under this subsection within 30 days after the Secretary provides notice of the assessment of the fee after the completion of an inspection.</text>
 </paragraph><paragraph commented="no" id="HF3FFB2660CDE4C10852FCD4C1DE8EE04"><enum>(6)</enum><header>Penalty</header><text display-inline="yes-display-inline">If a designated operator assessed a fee under this subsection fails to pay the full amount of the fee as prescribed in this subsection, the Secretary may, in addition to utilizing any other applicable enforcement authority, assess civil penalties against the operator under section 109 in the same manner as if this section were a mineral leasing law.</text>
 </paragraph><paragraph id="HE60E19E58C8F41469DF53F699FE08899"><enum>(7)</enum><header>Notification to State of noncompliance</header><text display-inline="yes-display-inline">If, on the basis of any inspection under subsection (b), the Secretary determines that an operator is in noncompliance with the requirements of mineral leasing laws and this chapter, the Secretary shall notify the State of such noncompliance immediately.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="HA7D07DE68D56467FABAD0476602DF0FC"><enum>(c)</enum><header>Existing authorities</header><text display-inline="yes-display-inline">Section 390(a) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15942">42 U.S.C. 15942(a)</external-xref>) is amended—</text> <paragraph id="H0653EAB5269B498C93EF48DA5CBE1564"><enum>(1)</enum><text>by striking <quote>Action by the Secretary</quote> and inserting <quote>The Secretary</quote>;</text>
 </paragraph><paragraph id="H156D025358CF4A22BB4C5D57C417F98C"><enum>(2)</enum><text>by striking <quote>with respect to any of the activities described in subsection (b) shall be subject to a rebuttable presumption that the use of</quote> and inserting <quote>shall apply</quote>; and</text>
 </paragraph><paragraph id="H49930CC27AF04C27A42E7FC473BA39F3"><enum>(3)</enum><text>by striking <quote>would apply if the activity</quote> and inserting <quote>for each action described in subsection (b) if the action</quote>.</text> </paragraph></subsection></section><section id="H512A6ECBA114471AB60AFDF906EF3E0A"><enum>203.</enum><header>Conveyance to certain States of property interest in State share of royalties and other payments</header> <subsection id="HEFA853A0052B4F9BA70B7C77F4C02432"><enum>(a)</enum><header>In general</header><text>Section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) is amended—</text>
 <paragraph id="H312FF01D83E542ACB6C27A2ED690CCB7"><enum>(1)</enum><text>in the first sentence of subsection (a), by striking <quote>shall be paid into the Treasury</quote> and inserting <quote>shall, except as provided in subsection (e), be paid into the Treasury</quote>;</text> </paragraph><paragraph id="HCDE07EA1DEE24373A35121632735E871"><enum>(2)</enum><text>in subsection (c)(1), by inserting <quote>and except as provided in subsection (e)</quote> before <quote>, any rentals</quote>; and</text>
 </paragraph><paragraph id="H1CE538AB66434ED28887F24FAE7B4027"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HII00" id="H5FD00CA2FDFF4FB394BE5B29177894B9" reported-display-style="italic" style="OLC"> <subsection id="HB68A56817BC94DDC9B48F2B4BA2198F4"><enum>(e)</enum><header>Conveyance to certain States of property interest in State share</header> <paragraph commented="no" id="HD5F22F8A543F4A19B42830649B190C9C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, on request of a State and in lieu of any payments to the State under subsection (a), the Secretary of the Interior shall convey to the State all right, title, and interest in and to the percentage specified in that subsection for that State that would otherwise be required to be paid into the Treasury under that subsection.</text>
 </paragraph><paragraph id="H4953FCC732184F46ACE53F5B7CC40A58"><enum>(2)</enum><header>Amount</header><text>Notwithstanding any other provision of law, after a conveyance to a State under paragraph (1), any person shall pay directly to the State any amount owed by the person for which the right, title, and interest has been conveyed to the State under this subsection.</text>
 </paragraph><paragraph id="H3687153146C8422198B756918BEAA3B0"><enum>(3)</enum><header>Notice</header><text>The Secretary of the Interior shall promptly provide to each holder of a lease of public land to which subsection (a) applies that is located in a State to which right, title, and interest is conveyed under this subsection notice that—</text>
 <subparagraph id="H12D4C78997AD48CAA50339504154FB82"><enum>(A)</enum><text>the Secretary of the Interior has conveyed to the State all right, title, and interest in and to the amounts referred to in paragraph (1); and</text>
 </subparagraph><subparagraph id="HC93B6929FF2841708D1A74EE56B9157B"><enum>(B)</enum><text>the leaseholder is required to pay the amounts directly to the State.</text> </subparagraph></paragraph><paragraph id="H1226102FF7A048D18248870712EA9C8E"><enum>(4)</enum><header>Report</header><text>A State that has received a conveyance under this subsection shall report monthly to the Office of Natural Resources Revenue of the Department of the Interior the amount paid to such State pursuant to this subsection.</text>
 </paragraph><paragraph commented="no" id="HC16F920F25C4414992AFD042726AA6A2"><enum>(5)</enum><header>Application with respect to FOGRMA</header><text display-inline="yes-display-inline">With respect to the interest conveyed to a State under this subsection from sales, bonuses, royalties (including interest charges), and rentals collected under the Federal Oil and Gas Royalty Management Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/30/1701">30 U.S.C. 1701</external-xref> et seq.), this subsection shall only apply with respect to States for which the Secretary has delegated any authority under section 44(a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

 </subsection><subsection commented="no" id="HECCCDD69CEA04966AB91CB8A581F8CB2"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 205(f) of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1735">30 U.S.C. 1735(f)</external-xref>) is amended by striking <quote>All</quote> in the seventh sentence and inserting <quote>Subject to subsection (e) of section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>), all</quote>.</text>
 </subsection></section><section id="H09F07C8D177B47218DC8DAEC79167519"><enum>204.</enum><header>Permitting on non-Federal surface estate</header><text display-inline="no-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) is amended by inserting after section 44 (as added by section 202(a)(2)) the following:</text>

					<section id="HB6CB257737A34BBAA2838C1A14A7FF5C"><enum>45.</enum><header>Permitting on non-Federal surface estate</header>
 <subsection commented="no" id="HA6EE2BE3FCAF428E813851A116E85477"><enum>(a)</enum><header>Permits not required for certain activities on non-Federal surface estate</header><text display-inline="yes-display-inline">The following activities conducted on non-Federal surface estate shall not require a Bureau of Land Management drilling permit under the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1701">30 U.S.C. 1701</external-xref> et seq.) or section 3164.1 of title 43, Code of Federal Regulations (or successor regulation) and shall not be considered a major Federal action under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.):</text>
 <paragraph commented="no" id="HC89F926B3761438A8DC49E7CD15A4B3B"><enum>(1)</enum><text display-inline="yes-display-inline">Oil and gas operations for the exploration for or development or production of oil and gas in a lease or unit or communitization agreement in which the United States holds a mineral ownership interest of 50 percent or less.</text>
 </paragraph><paragraph commented="no" id="H9EC88266454A4D51988030CFE465895F"><enum>(2)</enum><text display-inline="yes-display-inline">Oil and gas operations that may have potential drainage impacts, as determined by the Bureau of Land Management, on oil and gas in which the United States holds a mineral ownership interest.</text>
 </paragraph></subsection><subsection id="H3F6798DD0D5F4682A69B39C2F1FFD6B7"><enum>(b)</enum><header>DOI notification</header><text display-inline="yes-display-inline">The Secretary of the Interior shall provide to each State a map or list indicating Federal mineral ownership within that State.</text>
 </subsection><subsection id="HF0B5EBB0A71A4CE68F4BA255B7334511"><enum>(c)</enum><header>State notification</header><text display-inline="yes-display-inline">Each State that has issued an APD or approved a drilling plan that would impact or extract oil and gas owned by the United States shall notify the Secretary of the Interior within 7 days of issuing an APD.</text>
 </subsection><subsection commented="no" id="HDF7F644DEE7D44819DDB55EC8293F84E"><enum>(d)</enum><header>Royalties</header><text display-inline="yes-display-inline">Nothing in this section shall affect the amount of royalties due to the United States under this Act from the production of oil and gas or alter the Secretary's authority to conduct audits and collect civil penalties pursuant to the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1711">30 U.S.C. 1711</external-xref> et seq.).</text>
 </subsection><subsection commented="no" id="HF092E3EF8796427CBE67F11AE33564D0"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">This section shall only apply with respect to States for which the Secretary has delegated any authority under section 44(a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="HCC5D01E7BF3C4B25ACC82D6795996B65"><enum>205.</enum><header>State and Tribal authority for hydraulic fracturing regulation</header><text display-inline="no-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) is amended by inserting after section 45 (as added by section 204) the following:</text>

					<section id="HE14C16B460704104BF98A756E0B68020"><enum>46.</enum><header>State and Tribal authority for hydraulic fracturing regulation</header>
 <subsection id="H402CEA2E3C02430AA28C2B23D2090DD9"><enum>(a)</enum><header>In general</header><text>The Secretary of the Interior shall not enforce any Federal regulation, guidance, or permit requirement regarding hydraulic fracturing relating to oil, gas, or geothermal production activities on or under any land in any State that has regulations, guidance, or permit requirements for that activity.</text>
 </subsection><subsection id="HF02844CA85054C389E531A0B6FCEAE7F"><enum>(b)</enum><header>State authority</header><text display-inline="yes-display-inline">The Secretary of the Interior shall defer to State regulations, guidance, and permit requirements for all activities regarding hydraulic fracturing relating to oil, gas, or geothermal production activities on Federal land.</text>
						</subsection><subsection id="H4998013C9D6148C79B30C5579B2307AC"><enum>(c)</enum><header>Transparency of State regulations</header>
 <paragraph id="HB8961556FDC947B097EF532CA8B1B531"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each State shall submit to the Bureau of Land Management a copy of the regulations of such State that apply to hydraulic fracturing operations on Federal land, including those that require disclosure of chemicals used in hydraulic fracturing operations.</text>
 </paragraph><paragraph id="HCDE8FBDFCE2647BCB5ABF214A3F33863"><enum>(2)</enum><header>Availability</header><text>The Secretary of the Interior shall make available to the public on the website of the Secretary the regulations submitted under paragraph (1).</text>
 </paragraph></subsection><subsection id="H67D1FCEA7A2443579403F88B4F706C15"><enum>(d)</enum><header>Tribal authority on trust land</header><text display-inline="yes-display-inline">The Secretary of the Interior shall not enforce any Federal regulation, guidance, or permit requirement with respect to hydraulic fracturing on any land held in trust or restricted status for the benefit of a federally recognized Indian Tribe or a member of such an Indian Tribe, except with the express consent of the beneficiary on whose behalf such land is held in trust or restricted status.</text>
 </subsection><subsection id="HAC0DAEFD797E4DB18BFA4935557336FB"><enum>(e)</enum><header>Hydraulic fracturing defined</header><text display-inline="yes-display-inline">In this section the term <term>hydraulic fracturing</term> means the process of creating small cracks, or fractures, in underground geological formations for well stimulation purposes of bringing hydrocarbons into the wellbore and to the surface for capture.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H3B16C99D507E4EC18D4539AA1D039390"><enum>206.</enum><header>Review of Integrated Activity Plan for the National Petroleum Reserve in Alaska</header><text display-inline="no-display-inline">The Secretary of the Interior shall—</text> <paragraph id="H1A253A43F8A44FC5AC4510BD25E5C72B"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a review of the National Petroleum Reserve–Alaska Final Integrated Activity Plan/Environmental Impact Statement, for which notice of availability was published in the Federal Register on December 28, 2012 (77 Fed. Reg. 76515), to determine which lands within the National Petroleum Reserve in Alaska should be made available for oil and gas leasing; and</text>
 </paragraph><paragraph id="HA740ABB3DDEB49D186F435C7C8B39ACD"><enum>(2)</enum><text display-inline="yes-display-inline">make available the lands described in paragraph (1) for oil and gas leasing.</text> </paragraph></section><section id="H2B5D52E1FAA341FC92E71A9B209439BD"><enum>207.</enum><header>Protested lease sales</header><text display-inline="no-display-inline">Section 17(b)(1)(A) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(b)(1)(A)</external-xref>) is amended by inserting <quote>The Secretary shall resolve any protest to a lease sale within 60 days following such payment.</quote> after <quote>annual rental for the first lease year.</quote>.</text>
 </section><section id="H9351984FA10E4295A44D14629E11A0D9"><enum>208.</enum><header>Clarification regarding liability under Migratory Bird Treaty Act</header><text display-inline="no-display-inline">Section 6 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/707">16 U.S.C. 707</external-xref>) is amended by adding at the end the following:</text>
