		<official-title display="yes">To direct the Secretary of Veterans Affairs to carry out a pilot program to improve the access to
			 private health care for veterans who are survivors of military sexual
			 trauma.</official-title>

 <section id="H2A940FC730BE4BAE86A67AE89963BB5C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Sexual Assault Victims Empowerment Act</short-title></quote> or the <quote><short-title>Military SAVE Act</short-title></quote>.</text> </section><section id="H49F4C69DC83B418B8A317DF4CBE842DA"><enum>2.</enum><header>Pilot program for private health care for veterans who are survivors of military sexual trauma</header> <subsection id="H8C5C7608A4464A5199EB575D23BE6199"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out a pilot program to furnish hospital care and medical services to eligible veterans through non-Department health care providers to treat injuries or illnesses which, in the judgment of a professional employed by the Department, resulted from a physical assault of a sexual nature, battery of a sexual nature, or sexual harassment which occurred while the veteran was serving on active duty, active duty for training, or inactive duty training.</text>
 </subsection><subsection id="H22EBAC32EAB44F6EBA8A69251CF3B394"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">The Secretary shall carry out the pilot program under subsection (a) for a 3-year period. If at the completion of the pilot program an eligible veteran is receiving hospital care and medical services from a non-Department health care provider under the pilot program, the Secretary may approve, on a case-by-case basis, the continuation of such hospital care and medical services from that non-Department health care provider until the completion of the episode of care.</text>
 </subsection><subsection id="H429B3DF9105344D48F4AC2357B723A37"><enum>(c)</enum><header>Eligible veterans</header><text display-inline="yes-display-inline">A veteran is eligible to participate in the pilot program under subsection (a) if the veteran—</text> <paragraph id="H7953F35FA0B14114BF0253F700523E41"><enum>(1)</enum><text display-inline="yes-display-inline">is eligible to receive counseling and appropriate care and services under section 1720D of title 38, United States Code; and</text>
 </paragraph><paragraph id="HB075D6A7F43E4AD7AE1C9A1B0CE6731A"><enum>(2)</enum><text>resides in a site selected under subsection (d).</text> </paragraph></subsection><subsection id="HD7DEDEC90B854BADBF9FCA1B275596B3"><enum>(d)</enum><header>sites</header> <paragraph id="H17EB78157E514F6DA6BA92AB562FAAB5"><enum>(1)</enum><header>Selection</header><text>The Secretary shall select not more than five sites in which to carry out the pilot program under subsection (a). Each site shall meet each of the following criteria:</text>
 <subparagraph id="HF8B4234026AC4A0C94E6B8CFE5CC9ABF"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided by paragraph (2), the site consists of a city with a population between 200,000 and 500,000, as determined by the Bureau of the Census as of the first day of the pilot program.</text>
 </subparagraph><subparagraph id="H56B149DAA098438681266EA95D336280"><enum>(B)</enum><text display-inline="yes-display-inline">The site is in a State in which the National Violence Against Women Prevention Research Center or the Centers for Disease Control and Prevention, or both, has determined the rate of sexual assault to be a substantial problem.</text>
 </subparagraph><subparagraph commented="no" id="H20360F0CB8294A0CADBD73DDE743A3A8"><enum>(C)</enum><text display-inline="yes-display-inline">The site is in a State that, as of the first day of the pilot program, has a weighted percentage of reported rape of not less than 20 percent but not more than 30 percent of sexual assault cases, in accordance with the finding of the Centers for Disease Control and Prevention contained in the ‘<quote>Lifetime Prevalence of Sexual Violence by any Perpetrator</quote> (NISVS 2010).</text>
 </subparagraph></paragraph><paragraph id="HCBE763274BDA4DAEAA3A85E3597D48B2"><enum>(2)</enum><header>Rural site</header><text>Not fewer than one site selected under paragraph (1) shall be rural, as determined by the Secretary.</text>
				</paragraph></subsection><subsection id="HD4E03A3F50CF409087811AE923694ED2"><enum>(e)</enum><header>Participation</header>
 <paragraph id="H9147F4DC00444F3A890F1D77995D23E8"><enum>(1)</enum><header>Election</header><text display-inline="yes-display-inline">Subject to paragraph (2), an eligible veteran may elect to participate in the pilot program under subsection (a). Such election shall not affect the ability of the veteran to receive health care furnished by Department providers.</text>
 </paragraph><paragraph commented="no" id="H1E0504C6126A4C6AA7C4C2E0CBF9C4AB"><enum>(2)</enum><header>Number</header><text display-inline="yes-display-inline">Not more than 75 veterans may participate in the pilot program under subsection (a) at each site selected under subsection (d).</text>
 </paragraph><paragraph commented="no" id="H3A9742778E354E84812599603AFF1294"><enum>(3)</enum><header>Choice of non-Department health care providers</header><text display-inline="yes-display-inline">An eligible veteran who participates in the pilot program under subsection (a) may freely choose from which non-Department health care provider the veteran receives hospital care or medical services under the pilot program, except that the Secretary shall—</text>
 <subparagraph id="HFF1D8E81FD7A466DAF14FEAC7E810C6B"><enum>(A)</enum><text display-inline="yes-display-inline">ensure that each such non-Department health care provider maintains at least the same or similar credentials and licenses as those credentials and licenses that are required of health care providers of the Department, as determined by the Secretary for the purposes of this section; and</text>
 </subparagraph><subparagraph id="H0AD1DB7E8B3848F196C5B2183387F22D"><enum>(B)</enum><text display-inline="yes-display-inline">make a reasonable effort to ensure that such non-Department health care provider is familiar with the conditions and concerns that affect members of the Armed Forces and veterans and is trained in evidence-based psychotherapy.</text>
 </subparagraph></paragraph><paragraph id="H3ED0DCDD592940A28C62E33A2FB0E840"><enum>(4)</enum><header>Provision of information</header><text>The Secretary shall—</text> <subparagraph id="H9660174A4ABD4B8C8EF7A241E8EDDB81"><enum>(A)</enum><text display-inline="yes-display-inline">notify eligible veterans of the ability to make an election under paragraph (1); and</text>
 </subparagraph><subparagraph id="H90C0CC3B11474D4ABDD71F03F6B3709C"><enum>(B)</enum><text>provide to such veterans educational referral materials, including through pamphlets and internet websites, on the non-Department providers in the sites selected under subsection (d).</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5E53681EA9DD4E0890234FF9E1B5AEC5"><enum>(f)</enum><header>Authorization and monitoring of care</header><text display-inline="yes-display-inline">In accordance with subsection (e), the Secretary shall ensure that the Department of Veterans Affairs authorizes and monitors the hospital care and medical services furnished under the pilot program for appropriateness and necessity. In authorizing and monitoring such care, the Secretary shall—</text>
 <paragraph id="H981DFBDF5B6C4DC2BBE41929700DDFE6"><enum>(1)</enum><text display-inline="yes-display-inline">treat a non-Department health care provider that furnishes to such a veteran hospital care or medical services under the pilot program as an authorized recipient of records of such veteran for purposes of section 7332(b) of title 38, United States Code; and</text>
 </paragraph><paragraph id="H1359CBB3298B4CCAAA3D9D1807556A5C"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that such non-Department health care provider transmits to the Department such records as the Secretary determines appropriate.</text>
				</paragraph></subsection><subsection commented="no" id="HC68559D7CA134F2194290A7D97130798"><enum>(g)</enum><header>Payments</header>
 <paragraph commented="no" id="H6055C9C08CF14AF8AEF351B7D7223D61"><enum>(1)</enum><header>Current providers</header><text display-inline="yes-display-inline">If a non-Department health care provider has entered into a contract, agreement, or other arrangement with the Secretary pursuant to another provision of law to furnish hospital care or medical services to veterans, the Secretary shall pay the health care provider for hospital care or medical services furnished under this section using the same rates and payment schedules as provided for in such contract, agreement, or other arrangement.</text>
 </paragraph><paragraph commented="no" id="H74A6087B20F3460BABBBCE8919FFD834"><enum>(2)</enum><header>New providers</header><text display-inline="yes-display-inline">If a non-Department health care provider has not entered into a contract, agreement, or other arrangement with the Secretary pursuant to another provision of law to furnish hospital care or medical services to veterans, the Secretary shall pay the health care provider for hospital care or medical services furnished under this section using the same rates and payment schedule as if such care and services was furnished pursuant to section 1703 of title 38, United States Code.</text>
 </paragraph><paragraph id="H116F1CABEB854ADD908CC45ECE2C31ED"><enum>(3)</enum><header>New Contracts And Agreements</header><text display-inline="yes-display-inline">The Secretary shall take reasonable efforts to enter into a contract, agreement, or other arrangement with a non-Department health care provider described in subsection (a) to ensure that future care and services authorized by the Secretary and furnished by the provider are subject to such a contract, agreement, or other arrangement.</text>
 </paragraph></subsection><subsection id="HDE6B29C9B5074ECB8611BCB835AEEDB8"><enum>(h)</enum><header>Surveys</header><text display-inline="yes-display-inline">The Secretary shall conduct a survey of a sample of eligible veterans to assess the hospital care and medical services furnished to such veterans either pursuant to this section or section 1720D of title 38, United States Code, as the case may be.</text>
 </subsection><subsection id="H180E6DC729964193B0CB1B7590A9FB30"><enum>(i)</enum><header>Report</header><text>Not later than 60 days before the completion of the pilot program under subsection (a), the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report on the pilot program. The report shall include the following:</text>
 <paragraph id="H4D72C99F080D4EA69054C8FA633313E7"><enum>(1)</enum><text display-inline="yes-display-inline">The results of the pilot program, including, to the extent possible, an assessment of the health outcomes of veterans who participated in the pilot program.</text>
 </paragraph><paragraph id="HCEE5D1F7F2CA444AA056BD60D6AA386C"><enum>(2)</enum><text>The recommendation of the Secretary with respect to extending or making permanent the pilot program.</text>
 </paragraph></subsection><subsection commented="no" id="H22BBE615069F478A8BE08056DBF040BA"><enum>(j)</enum><header>Definitions</header><text>In this section:</text> <paragraph commented="no" id="HEC91D916B4C244F9A5D423E8B40890D2"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>non-Department health care provider</term> means an entity specified in section 101(a)(1)(B) of section 101 of the Veterans Access, Choice, and Accountability Act of 2015 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref>) or any other health care provider that has entered into a contract, agreement, or other arrangement with the Secretary pursuant to another provision of law to furnish hospital care or medical services to veterans.</text>
 </paragraph><paragraph commented="no" id="HBF0655E8A2B149DDBFB8BAB4EE05A4FC"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>sexual harassment</term> has the meaning given that term in section 1720D of title 38, United States Code.</text> </paragraph><paragraph commented="no" id="HD1F78B6E65DA403AA9F23A407F7EADC0"><enum>(3)</enum><text>The term <term>State</term> has the meaning given that term in section 101(20) of title 38, United States Code.</text>
 </paragraph></subsection></section><section id="HF15048BADEE74691A4B96AED45FFFCF0"><enum>3.</enum><header>No additional funds authorized</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out the requirements of this Act. Such requirements shall be carried out using amounts otherwise authorized to be appropriated.</text>
