<official-title display="yes">To amend the Homeland Security Act of 2002 to authorize the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security, and for other purposes.</official-title>

<section commented="no" display-inline="no-display-inline" id="H4DFDC59F718C4536A4A9F3A7BC1BD257" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cybersecurity and Infrastructure Security Agency Act of 2018</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H39540F24FE1749ADB2F186FFCAF5D716" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Cybersecurity and infrastructure security agency</header> <subsection commented="no" display-inline="no-display-inline" id="H2F44D10D26F14E9FA5F115E8AEF7CF26"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref> et seq.) is amended by adding at the end the following:</text>

<subtitle commented="no" id="H59C7F88A38C7494685D7F4425AA8BEA5" level-type="subsequent"><enum>A</enum><header display-inline="yes-display-inline">Cybersecurity and infrastructure security</header>
<section commented="no" display-inline="no-display-inline" id="H9C658879ED2143C68CB32217B4169B34" section-type="subsequent-section"><enum>2201.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this subtitle:</text> <paragraph commented="no" display-inline="no-display-inline" id="HECB492222008487E92C3CC2D51CB15D6"><enum>(1)</enum><header display-inline="yes-display-inline">Critical infrastructure information</header><text display-inline="yes-display-inline">The term <term>critical infrastructure information</term> has the meaning given the term in section 2222.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H13114989ECA84338B727BC7AEA109FF1"><enum>(2)</enum><header display-inline="yes-display-inline">Cybersecurity risk</header><text display-inline="yes-display-inline">The term <term>cybersecurity risk</term> has the meaning given the term in section 2209.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC0499333870D420BACF72D0A91344374"><enum>(3)</enum><header display-inline="yes-display-inline">Cybersecurity threat</header><text display-inline="yes-display-inline">The term <term>cybersecurity threat</term> has the meaning given the term in section 102(5) of the Cybersecurity Act of 2015 (contained in division N of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/1501">6 U.S.C. 1501</external-xref>)).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6D5EB041FE76471BA7FF4FA5BCC135C7"><enum>(4)</enum><header display-inline="yes-display-inline">National cybersecurity asset response activities</header><text display-inline="yes-display-inline">The term <term>national cybersecurity asset response activities</term> means—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H930681801174495F801A0CD72CED6AC8"><enum>(A)</enum><text display-inline="yes-display-inline">furnishing cybersecurity technical assistance to entities affected by cybersecurity risks to protect assets, mitigate vulnerabilities, and reduce impacts of cyber incidents;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0C2CCD704DB649639D026846F5A2D2C6"><enum>(B)</enum><text display-inline="yes-display-inline">identifying other entities that may be at risk of an incident and assessing risk to the same or similar vulnerabilities;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H95030249A3DC4DE8AFC069218CC16BDA"><enum>(C)</enum><text display-inline="yes-display-inline">assessing potential cybersecurity risks to a sector or region, including potential cascading effects, and developing courses of action to mitigate such risks;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H937D11193FB04DE5915411E72811E44A"><enum>(D)</enum><text display-inline="yes-display-inline">facilitating information sharing and operational coordination with threat response; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H898DA4F20DD942F4BB765B76E9D08D16"><enum>(E)</enum><text display-inline="yes-display-inline">providing guidance on how best to utilize Federal resources and capabilities in a timely, effective manner to speed recovery from cybersecurity risks.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3EA2AE4A4BFD438587AFFD31CD93A46A"><enum>(5)</enum><header display-inline="yes-display-inline">Sector-specific agency</header><text display-inline="yes-display-inline">The term <term>Sector-Specific Agency</term> means a Federal department or agency, designated by law or presidential directive, with responsibility for providing institutional knowledge and specialized expertise of a sector, as well as leading, facilitating, or supporting programs and associated activities of its designated critical infrastructure sector in the all hazards environment in coordination with the Department.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA4C67F37C95D4019BFFDA288969EE533"><enum>(6)</enum><header display-inline="yes-display-inline">Sharing</header><text display-inline="yes-display-inline">The term <term>sharing</term> has the meaning given the term in section 2209.</text></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H840570DC93114AEEBABE8AF9D64D8B28" section-type="subsequent-section"><enum>2202.</enum><header display-inline="yes-display-inline">Cybersecurity and infrastructure security agency</header>
<subsection commented="no" display-inline="no-display-inline" id="HF12F421303C04CA5ABB7162496769100"><enum>(a)</enum><header display-inline="yes-display-inline">Redesignation</header>
<paragraph commented="no" display-inline="no-display-inline" id="H77ECDC9178A0409FAD4AE8B5D4E6AA5F"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The National Protection and Programs Directorate of the Department shall, on and after the date of the enactment of this subtitle, be known as the <quote>Cybersecurity and Infrastructure Security Agency</quote> (in this subtitle referred to as the <quote>Agency</quote>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H3F19067DCB0C495A85DD1A7B312FD8DC"><enum>(2)</enum><header display-inline="yes-display-inline">References</header><text display-inline="yes-display-inline">Any reference to the National Protection and Programs Directorate of the Department in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Cybersecurity and Infrastructure Security Agency of the Department.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H677438B161EA4D7098314F94412CCB11"><enum>(b)</enum><header display-inline="yes-display-inline">Director</header>
<paragraph commented="no" display-inline="no-display-inline" id="HE3130BB31C3847CEBF218F3E520762AB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Agency shall be headed by a Director of Cybersecurity and Infrastructure Security (in this subtitle referred to as the <quote>Director</quote>), who shall report to the Secretary.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H9A2028D195CA45CAB26E3EE98631529D"><enum>(2)</enum><header display-inline="yes-display-inline">Reference</header><text display-inline="yes-display-inline">Any reference to an Under Secretary responsible for overseeing critical infrastructure protection, cybersecurity, and any other related program of the Department as described in section 103(a)(1)(H) as in effect on the day before the date of enactment of this subtitle in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Director of Cybersecurity and Infrastructure Security of the Department.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF7AE3B9F29674D7ABE50074A4BEB0761"><enum>(c)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The Director shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H831EAE43D025454483F8FF8079426182"><enum>(1)</enum><text display-inline="yes-display-inline">lead cybersecurity and critical infrastructure security programs, operations, and associated policy for the Agency, including national cybersecurity asset response activities;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2F24370073754D82B91E897C66B079DF"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate with Federal entities, including Sector-Specific Agencies, and non-Federal entities, including international entities, to carry out the cybersecurity and critical infrastructure activities of the Agency, as appropriate;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H489503599EAD42C188323DBF3710F7B7"><enum>(3)</enum><text display-inline="yes-display-inline">carry out the responsibilities of the Secretary to secure Federal information and information systems consistent with law, including subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, and the Cybersecurity Act of 2015 (contained in division N of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>));</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5C4C165774244C8E849AB901BF31815D"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate a national effort to secure and protect against critical infrastructure risks, consistent with subsection (e)(1)(E);</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7C0B8B063AD94C75B3EE9A5998DF263E"><enum>(5)</enum><text display-inline="yes-display-inline">upon request, provide analyses, expertise, and other technical assistance to critical infrastructure owners and operators and, where appropriate, provide those analyses, expertise, and other technical assistance in coordination with Sector-Specific Agencies and other Federal departments and agencies;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4805A5FD17D244C0A020CFC1EDC63996"><enum>(6)</enum><text display-inline="yes-display-inline">develop and utilize mechanisms for active and frequent collaboration between the Agency and Sector-Specific Agencies to ensure appropriate coordination, situational awareness, and communications with Sector-Specific Agencies;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0178718F43B042D288E2AC261DA04007"><enum>(7)</enum><text display-inline="yes-display-inline">maintain and utilize mechanisms for the regular and ongoing consultation and collaboration among the Divisions of the Agency to further operational coordination, integrated situational awareness, and improved integration across the Agency in accordance with this Act;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9224D10E65B649638239058E2FDBEB81"><enum>(8)</enum><text display-inline="yes-display-inline">develop, coordinate, and implement—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HDBE48EEA00694932B0E83B5700BA0D83"><enum>(A)</enum><text display-inline="yes-display-inline">comprehensive strategic plans for the activities of the Agency; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6B1FE0F0877E49EE99D9E0479D1D3DE2"><enum>(B)</enum><text display-inline="yes-display-inline">risk assessments by and for the Agency;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE996CAD0950B41EF82965DBE79C38EF5"><enum>(9)</enum><text display-inline="yes-display-inline">carry out emergency communications responsibilities, in accordance with title XVIII;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5616F2045A3E4CFAB6ED21CD435C8B57"><enum>(10)</enum><text display-inline="yes-display-inline">carry out cybersecurity, infrastructure security, and emergency communications stakeholder outreach and engagement and coordinate that outreach and engagement with critical infrastructure Sector-Specific Agencies, as appropriate; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H14EECA30BFA749DD83AE6E43566B98B5"><enum>(11)</enum><text display-inline="yes-display-inline">carry out such other duties and powers prescribed by law or delegated by the Secretary.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HAAADA6E4E94248209C8195120D9F9972"><enum>(d)</enum><header display-inline="yes-display-inline">Deputy director</header><text display-inline="yes-display-inline">There shall be in the Agency a Deputy Director of Cybersecurity and Infrastructure Security who shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="HDE2075E2B6044E5592C84FBFBC44B973"><enum>(1)</enum><text display-inline="yes-display-inline">assist the Director in the management of the Agency; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5879C3DFEEF745DF9F25D9B586E6C9B3"><enum>(2)</enum><text display-inline="yes-display-inline">report to the Director.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HEFB79AF98CB74FAD8C94D63428ED84AC"><enum>(e)</enum><header display-inline="yes-display-inline">Cybersecurity and infrastructure security authorities of the secretary</header> <paragraph commented="no" display-inline="no-display-inline" id="HA5C6866C53E04E63B97D1BB9DFE476F6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The responsibilities of the Secretary relating to cybersecurity and infrastructure security shall include the following:</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HCEE9433F22F54AE584C77E341FB9DABC"><enum>(A)</enum><text display-inline="yes-display-inline">To access, receive, and analyze law enforcement information, intelligence information, and other information from Federal Government agencies, State, local, tribal, and territorial government agencies, including law enforcement agencies, and private sector entities, and to integrate that information, in support of the mission responsibilities of the Department, in order to—</text> <clause commented="no" display-inline="no-display-inline" id="HD1E58A1B43D34C508D599C16470889B7"><enum>(i)</enum><text display-inline="yes-display-inline">identify and assess the nature and scope of terrorist threats to the homeland;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H6BD32304EFE74E19AF70BBB245404050"><enum>(ii)</enum><text display-inline="yes-display-inline">detect and identify threats of terrorism against the United States; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H8BC8739BBCDA43659CEED79F53DC8E6D"><enum>(iii)</enum><text display-inline="yes-display-inline">understand those threats in light of actual and potential vulnerabilities of the homeland.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H3612C626601B4429995E5236E556434F"><enum>(B)</enum><text display-inline="yes-display-inline">To carry out comprehensive assessments of the vulnerabilities of the key resources and critical infrastructure of the United States, including the performance of risk assessments to determine the risks posed by particular types of terrorist attacks within the United States, including an assessment of the probability of success of those attacks and the feasibility and potential efficacy of various countermeasures to those attacks. At the discretion of the Secretary, such assessments may be carried out in coordination with Sector-Specific Agencies.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HDE397E35BC0342E489524245E5569BE4"><enum>(C)</enum><text display-inline="yes-display-inline">To integrate relevant information, analysis, and vulnerability assessments, regardless of whether the information, analysis, or assessments are provided or produced by the Department, in order to make recommendations, including prioritization, for protective and support measures by the Department, other Federal Government agencies, State, local, tribal, and territorial government agencies and authorities, the private sector, and other entities regarding terrorist and other threats to homeland security.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4993CE185A614FD280A4DB3C90CDB9BF"><enum>(D)</enum><text display-inline="yes-display-inline">To ensure, pursuant to section 202, the timely and efficient access by the Department to all information necessary to discharge the responsibilities under this title, including obtaining that information from other Federal Government agencies.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HCAA311F414B64E8E89FCB2AE68FF4BE3"><enum>(E)</enum><text display-inline="yes-display-inline">To develop, in coordination with the Sector-Specific Agencies with available expertise, a comprehensive national plan for securing the key resources and critical infrastructure of the United States, including power production, generation, and distribution systems, information technology and telecommunications systems (including satellites), electronic financial and property record storage and transmission systems, emergency communications systems, and the physical and technological assets that support those systems.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA0BD8BE129F54A27B96B50BAF657AC0D"><enum>(F)</enum><text display-inline="yes-display-inline">To recommend measures necessary to protect the key resources and critical infrastructure of the United States in coordination with other Federal Government agencies, including Sector-Specific Agencies, and in cooperation with State, local, tribal, and territorial government agencies and authorities, the private sector, and other entities.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7B7C809666B140E194961EA49D680A39"><enum>(G)</enum><text display-inline="yes-display-inline">To review, analyze, and make recommendations for improvements to the policies and procedures governing the sharing of information relating to homeland security within the Federal Government and between Federal Government agencies and State, local, tribal, and territorial government agencies and authorities.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H21B52E32087A481CB56DE3979A262D24"><enum>(H)</enum><text display-inline="yes-display-inline">To disseminate, as appropriate, information analyzed by the Department within the Department to other Federal Government agencies with responsibilities relating to homeland security and to State, local, tribal, and territorial government agencies and private sector entities with those responsibilities in order to assist in the deterrence, prevention, or preemption of, or response to, terrorist attacks against the United States.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA8665B7BBF264C699CCC8DCC159AFE8A"><enum>(I)</enum><text display-inline="yes-display-inline">To consult with State, local, tribal, and territorial government agencies and private sector entities to ensure appropriate exchanges of information, including law enforcement-related information, relating to threats of terrorism against the United States.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9DF52D8B26B64336ADC486103D59A0BF"><enum>(J)</enum><text display-inline="yes-display-inline">To ensure that any material received pursuant to this Act is protected from unauthorized disclosure and handled and used only for the performance of official duties.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HFEDC2A5D6A5C46839B1FD24D062F90E0"><enum>(K)</enum><text display-inline="yes-display-inline">To request additional information from other Federal Government agencies, State, local, tribal, and territorial government agencies, and the private sector relating to threats of terrorism in the United States, or relating to other areas of responsibility assigned by the Secretary, including the entry into cooperative agreements through the Secretary to obtain such information.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H73EBA428C7D046B4B7E0C529A38C8B2D"><enum>(L)</enum><text display-inline="yes-display-inline">To establish and utilize, in conjunction with the Chief Information Officer of the Department, a secure communications and information technology infrastructure, including data-mining and other advanced analytical tools, in order to access, receive, and analyze data and information in furtherance of the responsibilities under this section, and to disseminate information acquired and analyzed by the Department, as appropriate.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H4915B698DC1346CDB8EB7311A06177A0"><enum>(M)</enum><text display-inline="yes-display-inline">To coordinate training and other support to the elements and personnel of the Department, other Federal Government agencies, and State, local, tribal, and territorial government agencies that provide information to the Department, or are consumers of information provided by the Department, in order to facilitate the identification and sharing of information revealed in their ordinary duties and the optimal utilization of information received from the Department.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9A95D6CE7608475DA42434A7598AF746"><enum>(N)</enum><text display-inline="yes-display-inline">To coordinate with Federal, State, local, tribal, and territorial law enforcement agencies, and the private sector, as appropriate.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H6FF4386C050746BBA6DC05848C69FAB1"><enum>(O)</enum><text display-inline="yes-display-inline">To exercise the authorities and oversight of the functions, personnel, assets, and liabilities of those components transferred to the Department pursuant to section 201(g).</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7D185EA529AC488399062558BB89ED92"><enum>(P)</enum><text display-inline="yes-display-inline">To carry out the functions of the national cybersecurity and communications integration center under section 2209.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H8523CA64BA7F49C48976F713D7C06B44"><enum>(Q)</enum><text display-inline="yes-display-inline">To carry out the requirements of the Chemical Facility Anti-Terrorism Standards Program established under title XXI and the secure handling of ammonium nitrate program established under subtitle J of title VIII, or any successor programs.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6A5836E5685D4EEBBEFA6DB42C165105"><enum>(2)</enum><header display-inline="yes-display-inline">Reallocation</header><text display-inline="yes-display-inline">The Secretary may reallocate within the Agency the functions specified in sections 2203(b) and 2204(b), consistent with the responsibilities provided in paragraph (1), upon certifying to and briefing the appropriate congressional committees, and making available to the public, at least 60 days prior to the reallocation that the reallocation is necessary for carrying out the activities of the Agency.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H057FF1ADECC444619F61FF79D6E45996"><enum>(3)</enum><header display-inline="yes-display-inline">Staff</header> <subparagraph commented="no" display-inline="no-display-inline" id="H849ACDC1E8064F73B599CED6C6162A5F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall provide the Agency with a staff of analysts having appropriate expertise and experience to assist the Agency in discharging the responsibilities of the Agency under this section.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2A8CA82EC43F40A78F4F1490E2A5C32C"><enum>(B)</enum><header display-inline="yes-display-inline">Private sector analysts</header><text display-inline="yes-display-inline">Analysts under this subsection may include analysts from the private sector.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HAB526A5AF8D648008D5DDD1C7D145112"><enum>(C)</enum><header display-inline="yes-display-inline">Security clearances</header><text display-inline="yes-display-inline">Analysts under this subsection shall possess security clearances appropriate for their work under this section.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H40B8A4F5FB1A4A4691F82C588331C629"><enum>(4)</enum><header display-inline="yes-display-inline">Detail of personnel</header>
<subparagraph commented="no" display-inline="no-display-inline" id="H495018EA54C54667A07CDA9708514ED8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In order to assist the Agency in discharging the responsibilities of the Agency under this section, personnel of the Federal agencies described in subparagraph (B) may be detailed to the Agency for the performance of analytic functions and related duties.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H2D65EA1C9FA84B9ABF75DC0C8DF14E84"><enum>(B)</enum><header display-inline="yes-display-inline">Agencies</header><text display-inline="yes-display-inline">The Federal agencies described in this subparagraph are—</text>
<clause commented="no" display-inline="no-display-inline" id="HA6B28D7D3B9145CDB0E0F7F678A04AA1"><enum>(i)</enum><text display-inline="yes-display-inline">the Department of State;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HCE420DCD660E4C49B19932EFB3E2FEDB"><enum>(ii)</enum><text display-inline="yes-display-inline">the Central Intelligence Agency;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H274E8DE830974015BF11439F0C640EAA"><enum>(iii)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H2C19EC9616894238B83B44E8C409D156"><enum>(iv)</enum><text display-inline="yes-display-inline">the National Security Agency;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HDA85251A1CB14E819EE858F5EA239B3D"><enum>(v)</enum><text display-inline="yes-display-inline">the National Geospatial-Intelligence Agency;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H77F9125290644B248716A4C160DE2307"><enum>(vi)</enum><text display-inline="yes-display-inline">the Defense Intelligence Agency;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="HE779BE37585C4CA6992591C83ADECE08"><enum>(vii)</enum><text display-inline="yes-display-inline">Sector-Specific Agencies; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H055797742945489F82C2BB13E07C351A"><enum>(viii)</enum><text display-inline="yes-display-inline">any other agency of the Federal Government that the President considers appropriate.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H742251398D8B4645BC45B828078CF97A"><enum>(C)</enum><header display-inline="yes-display-inline">Interagency agreements</header><text display-inline="yes-display-inline">The Secretary and the head of a Federal agency described in subparagraph (B) may enter into agreements for the purpose of detailing personnel under this paragraph.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB5A918633DFE4313BFAF47174F7875F1"><enum>(D)</enum><header display-inline="yes-display-inline">Basis</header><text display-inline="yes-display-inline">The detail of personnel under this paragraph may be on a reimbursable or non-reimbursable basis.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H2D79DEDE767A49D78E92EC2553E620D4"><enum>(f)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Agency shall be composed of the following divisions:</text> <paragraph commented="no" display-inline="no-display-inline" id="HA27D01C93E8E41268BC59D8AF991D941"><enum>(1)</enum><text display-inline="yes-display-inline">The Cybersecurity Division, headed by an Assistant Director.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD6B1726E7F4347B6B47B6FA7A586A735"><enum>(2)</enum><text display-inline="yes-display-inline">The Infrastructure Security Division, headed by an Assistant Director.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H42196CEF3FC042B18F10F7860C4254DB"><enum>(3)</enum><text display-inline="yes-display-inline">The Emergency Communications Division under title XVIII, headed by an Assistant Director.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HB7B0F40F2F3743DBA3FE9CEF6FFB27CE"><enum>(g)</enum><header display-inline="yes-display-inline">Co-location</header>
<paragraph commented="no" display-inline="no-display-inline" id="H9DF9EF0AB1D84759AA94847B7DAF5D3A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Director shall examine the establishment of central locations in geographical regions with a significant Agency presence.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC519B4DC23D247849FA753247B1B78EA"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">When establishing the central locations described in paragraph (1), the Director shall coordinate with component heads and the Under Secretary for Management to co-locate or partner on any new real property leases, renewing any occupancy agreements for existing leases, or agreeing to extend or newly occupy any Federal space or new construction.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H431B4DA75DC74396B0219F3FDDD749A2"><enum>(h)</enum><header display-inline="yes-display-inline">Privacy</header>
<paragraph commented="no" display-inline="no-display-inline" id="HD22A32E7211F49B397CB0EFC6449024A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There shall be a Privacy Officer of the Agency with primary responsibility for privacy policy and compliance for the Agency.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H6B7B27D3221244F19DC45EACF2070F18"><enum>(2)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The responsibilities of the Privacy Officer of the Agency shall include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H4BEAAED4595A45A8A9318EF54814700C"><enum>(A)</enum><text display-inline="yes-display-inline">assuring that the use of technologies by the Agency sustain, and do not erode, privacy protections relating to the use, collection, and disclosure of personal information;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HD433FF2B4B304961B3B6718ED8AF77B7"><enum>(B)</enum><text display-inline="yes-display-inline">assuring that personal information contained in systems of records of the Agency is handled in full compliance as specified in section 552a of title 5, United States Code (commonly known as the <quote>Privacy Act of 1974</quote>);</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7334B9AF28A64AF292BA5443FBCE40B5"><enum>(C)</enum><text display-inline="yes-display-inline">evaluating legislative and regulatory proposals involving collection, use, and disclosure of personal information by the Agency; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H35167F8072B34E5FAF2714AA302B2D8B"><enum>(D)</enum><text display-inline="yes-display-inline">conducting a privacy impact assessment of proposed rules of the Agency on the privacy of personal information, including the type of personal information collected and the number of people affected.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HC4776D038BE84FCAA5A9410E8F590579"><enum>(i)</enum><header display-inline="yes-display-inline">Savings</header><text display-inline="yes-display-inline">Nothing in this title may be construed as affecting in any manner the authority, existing on the day before the date of enactment of this title, of any other component of the Department or any other Federal department or agency, including the authority provided to the Sector-Specific Agency specified in section 61003(c) of division F of the Fixing America’s Surface Transportation Act (<external-xref legal-doc="usc" parsable-cite="usc/6/121">6 U.S.C. 121</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>).</text></subsection></section> <section commented="no" display-inline="no-display-inline" id="H918D2366FA4E4390AA8C5F2FD727D07D" section-type="subsequent-section"><enum>2203.</enum><header display-inline="yes-display-inline">Cybersecurity division</header> <subsection commented="no" display-inline="no-display-inline" id="H733B6C7996204B7E83EBDD9E1978028A"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header> <paragraph commented="no" display-inline="no-display-inline" id="HF4F4D59573CF4AEC819BB43380B75090"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established in the Agency a Cybersecurity Division.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7E9BDA64235A4365B8BDC980ED430B39"><enum>(2)</enum><header display-inline="yes-display-inline">Assistant director</header><text display-inline="yes-display-inline">The Cybersecurity Division shall be headed by an Assistant Director for Cybersecurity (in this section referred to as the <quote>Assistant Director</quote>), who shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8ED5ED65EED54405B44AAF872B20BDD6"><enum>(A)</enum><text display-inline="yes-display-inline">be at the level of Assistant Secretary within the Department;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCDF9A8EB5E7846AFA2A5D6C578B86549"><enum>(B)</enum><text display-inline="yes-display-inline">be appointed by the President without the advice and consent of the Senate; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H357D954351FB405585A3F2E30F1BF7D9"><enum>(C)</enum><text display-inline="yes-display-inline">report to the Director.</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H708F635802C9480E9B162BF632959553"><enum>(3)</enum><header display-inline="yes-display-inline">Reference</header><text display-inline="yes-display-inline">Any reference to the Assistant Secretary for Cybersecurity and Communications in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Assistant Director for Cybersecurity.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HBB6676AB13104DD1924810ABFA2F1D86"><enum>(b)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Assistant Director shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H31C155AEE0DA46769B37F4750D656852"><enum>(1)</enum><text display-inline="yes-display-inline">direct the cybersecurity efforts of the Agency;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H76ED6BE1521043FB8DADA42DF7E221C7"><enum>(2)</enum><text display-inline="yes-display-inline">carry out activities, at the direction of the Director, related to the security of Federal information and Federal information systems consistent with law, including subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, and the Cybersecurity Act of 2015 (contained in division N of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/113">Public Law 114–113</external-xref>));</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB2A331658D7343F597F927E84354315C"><enum>(3)</enum><text display-inline="yes-display-inline">fully participate in the mechanisms required under section 2202(c)(7); and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H11FAF92434884DEB89CDF768F69DB3E8"><enum>(4)</enum><text display-inline="yes-display-inline">carry out such other duties and powers as prescribed by the Director.</text></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H8358574154474597A0A53FCDFD296F97" section-type="subsequent-section"><enum>2204.</enum><header display-inline="yes-display-inline">Infrastructure security division</header>
<subsection commented="no" display-inline="no-display-inline" id="H6883ECC58B6242C9BCD7DA6ABF17785D"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header>
<paragraph commented="no" display-inline="no-display-inline" id="H6F4C9C0559384D8C89AD8F1212F69938"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established in the Agency an Infrastructure Security Division.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H14EF7E46C5C44408AE3DE7F7C8EBD2DF"><enum>(2)</enum><header display-inline="yes-display-inline">Assistant director</header><text display-inline="yes-display-inline">The Infrastructure Security Division shall be headed by an Assistant Director for Infrastructure Security (in this section referred to as the <quote>Assistant Director</quote>), who shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBE186EBE581B484EA36C090051BEA010"><enum>(A)</enum><text display-inline="yes-display-inline">be at the level of Assistant Secretary within the Department;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H22C310620F3F4E0D83665C7A63BE92CF"><enum>(B)</enum><text display-inline="yes-display-inline">be appointed by the President without the advice and consent of the Senate; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6A667B3E24E847A9A8D73CEA9C7A8140"><enum>(C)</enum><text display-inline="yes-display-inline">report to the Director.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2E03DE17B92146DF8916FE25E48C186E"><enum>(3)</enum><header display-inline="yes-display-inline">Reference</header><text display-inline="yes-display-inline">Any reference to the Assistant Secretary for Infrastructure Protection in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Assistant Director for Infrastructure Security.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCDD79CEC8A5344E5A63E70E7366855B6"><enum>(b)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Assistant Director shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="H47D203B92E5644DEA6DD8F5ED8FAFF06"><enum>(1)</enum><text display-inline="yes-display-inline">direct the critical infrastructure security efforts of the Agency;</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7A426F92172C4383A52A63B6AB5231D6"><enum>(2)</enum><text display-inline="yes-display-inline">carry out, at the direction of the Director, the Chemical Facilities Anti-Terrorism Standards Program established under title XXI and the secure handling of ammonium nitrate program established under subtitle J of title VIII, or any successor programs;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H02E167C3506B42C6BF99A09A1C40C4DE"><enum>(3)</enum><text display-inline="yes-display-inline">fully participate in the mechanisms required under section 2202(c)(7); and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HEB596222EAEC45F38E06CB89F10BBE7C"><enum>(4)</enum><text display-inline="yes-display-inline">carry out such other duties and powers as prescribed by the Director.</text></paragraph></subsection></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H6F858D26E6FB45359E0D3DA40CF84F8F"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of certain positions</header> <paragraph commented="no" display-inline="no-display-inline" id="HEBD6C64730B34CB7AD192BA9BB1BBE37"><enum>(1)</enum><header display-inline="yes-display-inline">Under secretary</header><text display-inline="yes-display-inline">The individual serving as the Under Secretary appointed pursuant to section 103(a)(1)(H) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/113">6 U.S.C. 113(a)(1)(H)</external-xref>) of the Department of Homeland Security on the day before the date of enactment of this Act may continue to serve as the Director of Cybersecurity and Infrastructure Security of the Department on and after such date.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H31617E53BA5F4DDC8104F416FB5C85ED"><enum>(2)</enum><header display-inline="yes-display-inline">Director for emergency communications</header><text display-inline="yes-display-inline">The individual serving as the Director for Emergency Communications of the Department of Homeland Security on the day before the date of enactment of this Act may continue to serve as the Assistant Director for Emergency Communications of the Department on and after such date.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H50C6DD69706E4BAF95FDF75F41D191F6"><enum>(3)</enum><header display-inline="yes-display-inline">Assistant secretary for cybersecurity and communications</header><text display-inline="yes-display-inline">The individual serving as the Assistant Secretary for Cybersecurity and Communications on the day before the date of enactment of this Act may continue to serve as the Assistant Director for Cybersecurity on and after such date.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0097A8CE17BE47C685B603F181CB2402"><enum>(4)</enum><header display-inline="yes-display-inline">Assistant secretary for infrastructure protection</header><text display-inline="yes-display-inline">The individual serving as the Assistant Secretary for Infrastructure Protection on the day before the date of enactment of this Act may continue to serve as the Assistant Director for Infrastructure Security on and after such date.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="HBCDE51442AF34292A9509817A9981E70"><enum>(c)</enum><header display-inline="yes-display-inline">Reference</header><text display-inline="yes-display-inline">Any reference to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H68F66B066EAE4B4FA6535A50D36C5627"><enum>(1)</enum><text display-inline="yes-display-inline">the Office of Emergency Communications in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Emergency Communications Division; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H942AD09C77DD40A0AB5D08C1F7C01476"><enum>(2)</enum><text display-inline="yes-display-inline">the Director for Emergency Communications in any law, regulation, map, document, record, or other paper of the United States shall be deemed to be a reference to the Assistant Director for Emergency Communications.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD472E15374BC4BE6AC21176740E456AC"><enum>(d)</enum><header display-inline="yes-display-inline">Oversight</header><text display-inline="yes-display-inline">The Director of Cybersecurity and Infrastructure Security of the Department of Homeland Security shall provide to Congress, in accordance with the deadlines specified in paragraphs (1) through (6), information on the following:</text> <paragraph commented="no" display-inline="no-display-inline" id="H25A614CCD1CE478399A6876189D5DDFE"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, a briefing on the activities of the Agency relating to the development and use of the mechanisms required pursuant to section 2202(c)(6) of the Homeland Security Act of 2002 (as added by subsection (a)).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H112998282AA14733B4323B6DAD2C1F90"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, a briefing on the activities of the Agency relating to the use and improvement by the Agency of the mechanisms required pursuant to section 2202(c)(6) of the Homeland Security Act of 2002 and how such activities have impacted coordination, situational awareness, and communications with Sector-Specific Agencies.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H1C33FDD7A564459892CA3C4F8F74E562"><enum>(3)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, information on the mechanisms of the Agency for regular and ongoing consultation and collaboration, as required pursuant to section 2202(c)(7) of the Homeland Security Act of 2002 (as added by subsection (a)).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H659C21A88DD646A092DAFA2E3235E8E0"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, information on the activities of the consultation and collaboration mechanisms of the Agency as required pursuant to section 2202(c)(7) of the Homeland Security Act of 2002, and how such mechanisms have impacted operational coordination, situational awareness, and integration across the Agency.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HF03534AACC064CB2AE9A610FF83821D1"><enum>(5)</enum><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, information, which shall be made publicly available and updated as appropriate, on the mechanisms and structures of the Agency responsible for stakeholder outreach and engagement, as required under section 2202(c)(10) of the Homeland Security Act of 2002 (as added by subsection (a)).</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HFB91DC7E22E64269BEBB55B7526A2ACB"><enum>(e)</enum><header display-inline="yes-display-inline">Cyber workforce</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security, in coordination with the Director of the Office of Personnel Management, shall submit to Congress a report detailing how the Agency is meeting legislative requirements under the Cybersecurity Workforce Assessment Act (<external-xref legal-doc="public-law" parsable-cite="pl/113/246">Public Law 113–246</external-xref>; 128 Stat. 2880) and the Homeland Security Cybersecurity Workforce Assessment Act (enacted as section 4 of the Border Patrol Agent Pay Reform Act of 2014; <external-xref legal-doc="public-law" parsable-cite="pl/113/277">Public Law 113–277</external-xref>) to address cyber workforce needs.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H354F521A026A497CAF9BBEB54597B56D"><enum>(f)</enum><header display-inline="yes-display-inline">Facility</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Director of the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security shall report to Congress on the most efficient and effective methods of consolidating Agency facilities, personnel, and programs to most effectively carry out the Agency’s mission.</text></subsection>

<paragraph commented="no" display-inline="no-display-inline" id="H9D44E6B6482D490EB4918A5DDF6AD00C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the completion of the Government Accountability Office review of the organizational placement of the Federal Protective Service (authorized under section 1315 of title 40, United States Code), the Secretary of Homeland Security shall determine the appropriate placement of the Service within the Department of Homeland Security and commence the transfer of the Service to such component, directorate, or other office of the Department that the Secretary so determines appropriate.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H2C48DA019727425B8E8B0A9E3B4A95B6"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If the Secretary of Homeland Security determines pursuant to paragraph (1) that no component, directorate, or other office of the Department of Homeland Security is an appropriate placement for the Federal Protective Service, the Secretary shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H149545EBDD46425083E4206C32DCBA08"><enum>(A)</enum><text display-inline="yes-display-inline">provide to the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate and the Office of Management and Budget a detailed explanation, in writing, of the reason for such determination that includes—</text> <clause commented="no" display-inline="no-display-inline" id="H0966649350FA465889B7A6A56C12092B"><enum>(i)</enum><text display-inline="yes-display-inline">information on how the Department considered the Government Accountability Office review described in such paragraph;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H6F253E515174449296DFABE23E8B028A"><enum>(ii)</enum><text display-inline="yes-display-inline">a list of the components, directorates, or other offices of the Department that were considered for such placement; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HEA740E92D0334EB586119E7E34C9448F"><enum>(iii)</enum><text display-inline="yes-display-inline">information on why each such component, directorate, or other office of the Department was determined to not be an appropriate placement for the Service;</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H2240108EFF74479AA53D52CC1193270B"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 120 days after the completion of the Government Accountability Office review described in such paragraph, develop and submit to the committees specified in subparagraph (A) and the Office of Management and Budget a plan to coordinate with other appropriate Federal agencies, including the General Services Administration, to determine a more appropriate placement for the Service; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE00A8879C27E4A1D92103F100CD47414"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 180 days after the completion of such Government Accountability Office review, submit to such committees and the Office of Management and Budget a recommendation regarding the appropriate placement of the Service within the executive branch of the Federal Government.</text></subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H96FAE426586B49319C9ED9E77C6E1D45" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">DHS report on cloud-based cybersecurity</header>
<subsection commented="no" display-inline="no-display-inline" id="HAB05B721CB0E4659A2E1B2B4C028F901"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>Department</term> means the Department of Homeland Security.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H86EB9A35909544DE89ECAEA97784B4E6"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of Homeland Security, in coordination with the Director of the Office of Management and Budget and the Administrator of General Services, shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform and the Committee on Homeland Security of the House of Representatives a report on the leadership role of the Department in cloud-based cybersecurity deployments for civilian Federal departments and agencies, which shall include—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H76203FD9046040979D87771CC4DF4952"><enum>(1)</enum><text display-inline="yes-display-inline">information on the plan of the Department for ensuring access to a security operations center as a service capability in accordance with the December 19, 2017 Report to the President on Federal IT Modernization issued by the American Technology Council;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H16D173D05F50476BBFFFE7E52A8611D9"><enum>(2)</enum><text display-inline="yes-display-inline">information on what service capabilities under paragraph (1) the Department will prioritize, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HBCF945CE5F094E5EBF8AB0FECD5AF30D"><enum>(A)</enum><text display-inline="yes-display-inline">criteria the Department will use to evaluate capabilities offered by the private sector; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HE232CCD6CFF94A88A6719F7F0B9E6804"><enum>(B)</enum><text display-inline="yes-display-inline">how Federal government- and private sector-provided capabilities will be integrated to enable visibility and consistency of such capabilities across all cloud and on premise environments, as called for in the report described in paragraph (1); and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H820EFBB42AB34981992E376789A4E091"><enum>(3)</enum><text display-inline="yes-display-inline">information on how the Department will adapt the current capabilities of, and future enhancements to, the intrusion detection and prevention system of the Department and the Continuous Diagnostics and Mitigation Program of the Department to secure civilian Federal government networks in a cloud environment.</text></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="H1D607651E6EC43A7B6ACFC287BD4C858" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act or an amendment made by this Act may be construed as—</text>
<paragraph commented="no" display-inline="no-display-inline" id="HE3F40DA870464186B72B2984AABB55EE"><enum>(1)</enum><text display-inline="yes-display-inline">conferring new authorities to the Secretary of Homeland Security, including programmatic, regulatory, or enforcement authorities, outside of the authorities in existence on the day before the date of enactment of this Act;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H3B032B4B2E5245EBBD5D788CC2546700"><enum>(2)</enum><text display-inline="yes-display-inline">reducing or limiting the programmatic, regulatory, or enforcement authority vested in any other Federal agency by statute; or</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8E7B498578E04F4385B060D268DB70EF"><enum>(3)</enum><text display-inline="yes-display-inline">affecting in any manner the authority, existing on the day before the date of enactment of this Act, of any other Federal agency or component of the Department of Homeland Security.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="H03519C1443CF454293DA1F231726656F" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Prohibition on additional funding</header><text display-inline="no-display-inline">No additional funds are authorized to be appropriated to carry out this Act or the amendments made by this Act. This Act and the amendments made by this Act shall be carried out using amounts otherwise authorized.</text></section>
