<official-title display="yes">To amend section 552a of title 5, United States Code (commonly referred to as the Privacy Act) to require agencies to accept electronic release forms, and for other purposes.<pagebreak/></official-title>

<section id="H9F2343F75B7F452999BB5DAAAB4BAFBB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Advanced Streamlined Electronic Services for Constituents Act of 2018</short-title></quote> or the <quote><short-title>CASES Act</short-title></quote>.</text> </section> <section id="H69F15128584D4ED08035DC23F053A831"><enum>2.</enum><header>Sense of congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HC61A67FA9D994FED96B8247A47EC1549"><enum>(1)</enum><text>congressional offices provide crucial services to constituents by acting as a liaison between the constituents and the respective agencies;</text> </paragraph> <paragraph id="H2BE21CA6CBAA4623A7CF71C0723D6360"><enum>(2)</enum><text>this includes assisting constituents by making inquiries and working toward resolutions on behalf of the constituent with the respective agencies; and</text> </paragraph> 
<paragraph id="HF2F8F629DFFE46B78C3B4955C7C135DA"><enum>(3)</enum><text>this process should be simplified through the creation of electronic forms that may be submitted under section 552a of title 5, United States Code (commonly referred to as the Privacy Act), thus modernizing the process for constituents and improving access and efficiency of Government services and agencies in order to expedite the resolution of the problem for which constituents sought help.</text> </paragraph></section> <section id="H46A0DE197C564196B307F3DD298A2127"><enum>3.</enum><header>OMB guidance on electronic consent forms</header> <subsection id="H122FA8080F494D59918A899E60D3212D"><enum>(a)</enum><header>Guidance</header><text>Not later than 1 year after the date of the enactment of this Act, the Director shall issue guidance that does the following:</text> 
<paragraph id="HF6FBB7DC82E148F296F2E29EFB0594AC"><enum>(1)</enum><text>Establishes—</text> <subparagraph id="H780F445375904F65B9567D318D7E6DBA"><enum>(A)</enum><text display-inline="yes-display-inline">standards for each agency to develop an electronic identity proofing and authentication process for allowing an individual to provide a prior written electronic consent form for the disclosure of the individual’s record under section 552a(b) of title 5, United States Code, or for individual access to a record under section 552a(d) of such title; or</text> </subparagraph> 
<subparagraph id="H1CB4D118A1C04A8BBBB154CA3D3A0BAA"><enum>(B)</enum><text display-inline="yes-display-inline">a method by which each agency can electronically identity proof and authenticate an individual submitting an electronic consent form through a central online portal.</text> </subparagraph></paragraph> <paragraph id="HCA14841ACD9F47089B2D80D2BC00D5E4"><enum>(2)</enum><text display-inline="yes-display-inline">Creates a template for an electronic consent form that can be properly identity proofed and authenticated in accordance with paragraph (1).</text> </paragraph> 
<paragraph id="H4556BA68061740D0BD65038A438BC5C0"><enum>(3)</enum><text display-inline="yes-display-inline">Requires each agency to accept the electronic consent form described in paragraph (2) that provides consent from any individual properly identity proofed and authenticated in accordance with paragraph (1) from the individual providing consent or an entity other than the individual, including a congressional office, on behalf of the individual for the purpose of authorizing the disclosure of the individual’s record in accordance with section 552a(b) or 552a(d) of title 5, United States Code.</text> </paragraph> <paragraph id="HB7944EE7FF9447A8ACDA0AD4F7E13C4C"><enum>(4)</enum><text display-inline="yes-display-inline">Authorizes each agency to provide an online link to the consolidated online portal described under subsection (b)(1).</text> </paragraph></subsection> 
<subsection id="HBA3264677671496BAFA7B55B3968CBD5"><enum>(b)</enum><header>Portal; consent identifier; congressional function</header> 
<paragraph id="HE206B99EB08E4008908C72C5FCC15F14"><enum>(1)</enum><header>Consolidated online portal</header> 
<subparagraph id="HEA2ACADD691D4FEBB95E8837620C5047"><enum>(A)</enum><header>Operation of portal</header><text display-inline="yes-display-inline">The Director (or a designee) shall operate (or designate the head of an agency to operate) a consolidated online portal that allows a member of the public to submit an electronic consent form in accordance with the guidance issued pursuant to subsection (a) to any agency from a single website.</text> </subparagraph> <subparagraph id="H05229B4906B54C1C8796531B01E9E106"><enum>(B)</enum><header>Privacy and other features</header><text>The portal shall include features to protect the privacy of individuals using the portal and may include any additional functions the Director finds will improve the implementation of this section.</text> </subparagraph> 
<subparagraph id="HB2309DCB20814F7CA2AC933E75B517D8"><enum>(C)</enum><header>Use of existing website or portal</header><text>The Director may use any existing website or portal to satisfy the requirements of this subsection, including the portal established under section 552(m) of title 5, United States Code.</text> </subparagraph></paragraph> <paragraph id="H3460B8B736474B30A18D0B191C640E5F"><enum>(2)</enum><header>Consent identifier</header><text>The Director, or a designee, shall assign each consent form submitted through the portal described in paragraph (1) a consent identifier, which shall be provided to the agency and the individual or entity submitting the consent form. The agency shall track the consent form with the consent identifier.</text> </paragraph> 
<paragraph id="H98635659D94E458688EA67A56EA4EF3D"><enum>(3)</enum><header>Congressional assistance function</header> 
<subparagraph id="H2AE084CA147D4907A7B56917BD8EBA53"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Director, or a designee, shall ensure the operation of a function that allows a congressional office to provide a publicly available online link to the portal described in paragraph (1), which shall auto-populate information about such congressional office, including an indication of consent for such office to access a record in accordance with section 552a(b) of title 5, United States Code, in the consent form accessed through the portal.</text> </subparagraph> <subparagraph id="HA291BF3881C14CE08476B99C6CA82BB7"><enum>(B)</enum><header>Notification of consent identifier required</header><text>The Director, or a designee, shall ensure the function sends the consent identifier to the congressional office when a consent form is submitted to an agency through the portal as accessed through the function.</text> </subparagraph></paragraph></subsection> 
<subsection id="H03DFDBAAB04C41069F34325A7C65F067"><enum>(c)</enum><header>Agency compliance</header><text display-inline="yes-display-inline">Each agency shall comply with the guidance issued pursuant to subsection (a) not later than 1 year after the date on which such guidance is issued.</text> </subsection> <subsection id="HAC231955DCDA4E5099C82302B063A9A0"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H7F95E2A05C0F4DDCBFEA78D768D355B1"><enum>(1)</enum><header>Agency; individual; record</header><text>The terms <term>agency</term>, <term>individual</term>, and <term>record</term> have the meanings given those terms in section 552a(a) of title 5, United States Code.</text> </paragraph> <paragraph id="H333CF282297E4DF296C92825FE715D72"><enum>(2)</enum><header>Consent identifier</header><text>The term <term>consent identifier</term> means a nonproprietary, unique identification number.</text> </paragraph>
