<official-title display="yes">To amend the Small Business Act to expand intellectual property education and training for small businesses, and for other purposes.</official-title>

<section id="HCF03450A53DA4541A7E13B3F50B3149A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Innovation Protection Act of 2017</short-title></quote>.</text> </section> <section display-inline="no-display-inline" id="H7314FB18C3724B678D806D1A91D27E12" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text> 
<paragraph id="H76DE73D7DD42484A8EB4789BFBF3EED2"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the SBA;</text> </paragraph> <paragraph id="HDFF05C19EEFB4A03AF056B0ED0D7B023"><enum>(2)</enum><text>the term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the USPTO;</text> </paragraph>
<paragraph id="HB6A0C338C4224337A7E871D9656F1126"><enum>(3)</enum><text>the term <term>SBA</term> means the Small Business Administration;</text> </paragraph> <paragraph id="H500697558C6C42E498F7809D895941ED"><enum>(4)</enum><text>the term <term>small business concern</term> has the meaning given the term in section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>);</text> </paragraph>
<paragraph id="HEFE59804F6C142A9BC0F9F9EE85F896D"><enum>(5)</enum><text>the term <term>small business development center</term> means a center described in section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>); and</text> </paragraph> <paragraph id="HAB6F401CB6334963AE6BB9031DE5F9ED"><enum>(6)</enum><text>the term <term>USPTO</term> means the United States Patent and Trademark Office.</text> </paragraph></section>
<section id="HF7E27384DA764185988409BA46B82BA6"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> <paragraph id="H45C182F0CF674197ADD09097FFB15429"><enum>(1)</enum><text>the USPTO and the SBA are positioned to—</text> 
<subparagraph id="HF96C7B7A18A54D39A632D39ACC0D128A"><enum>(A)</enum><text>build upon several successful intellectual property and training programs aimed at small business concerns; and</text> </subparagraph> <subparagraph id="H7F2827E331CC421599FCC26F85B40490"><enum>(B)</enum><text>increase the availability of and the participation in those programs across the United States; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H36A3FC1B12284CAAA21A82B837CFF46A"><enum>(2)</enum><text>any education and training program administered by the USPTO and the SBA should be scalable so that the program is able to reach more small business concerns.</text> </paragraph></section> <section commented="no" display-inline="no-display-inline" id="H3ED4AA5926624F569863680E5C049CFC"><enum>4.</enum><header>SBA and USPTO partnerships</header> <subsection id="H13D197BBDBCF48848F5D5BA7BA000F6E"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator and the Director shall enter into a partnership agreement under which the Administrator and Director shall—</text> 
<paragraph id="H445B5CE6B4D145E4B5F1A8656976B488"><enum>(1)</enum><text>develop high-quality training, including in-person or modular training sessions, for small business concerns relating to—</text> <subparagraph id="H1F15C5CF1D8B4F3B8FF36170FE2D994C"><enum>(A)</enum><text>domestic and international protection of intellectual property; and</text> </subparagraph>
<subparagraph id="H9C6533B5DB194377B45B480C36305B9E"><enum>(B)</enum><text>how such protections should be considered in the business plans and growth strategies of the small business concerns; and</text> </subparagraph></paragraph> <paragraph id="HC4AAB99734A2492098FF9180554440A7"><enum>(2)</enum><text>leverage existing training materials already developed to educate inventors and small business concerns.</text> </paragraph></subsection>
<subsection id="HB0BF83E04F2D4BBD971FB3E5FBA7DCF6"><enum>(b)</enum><header>Training</header><text display-inline="yes-display-inline">The training developed under subsection (a) may be provided by the Administrator, the Director, or small business development centers established under section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>)—</text> <paragraph id="HA3EBFD19BA554583AF092D5BB113D617"><enum>(1)</enum><text>through electronic resources, including Internet-based webinars; and</text> </paragraph>
<paragraph id="HDC5A12BD03FF483C80AE011320B0932C"><enum>(2)</enum><text>at physical locations, including at—</text> <subparagraph id="HBEBFACA098584CDA83642B704661B8DA"><enum>(A)</enum><text>a small business development center; or</text> </subparagraph>
<subparagraph id="HB6DF00BEF0964CDBB888F6775A2FA7C4"><enum>(B)</enum><text>the headquarters or a regional office of the USPTO.</text> </subparagraph></paragraph></subsection></section> <section id="H96F6A6739FFD4A9B8D45560091B1B02E"><enum>5.</enum><header>Small Business Development Centers</header><text display-inline="no-display-inline">Section 21(c)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(c)(3)</external-xref>) is amended—</text> 
<paragraph id="H7CAE34E59E6C4E02B29B766DC5253EE5"><enum>(1)</enum><text>in subparagraph (S), by striking <quote>and</quote> at the end;</text> </paragraph> <paragraph id="H236B7C1F343B4B61A98C479F2247F50C"><enum>(2)</enum><text>in subparagraph (T), by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph>
<paragraph id="HFEF0FAAE328C4F5D9ED1977865B5490D"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="H6651256A20194672A8A771C8E4089673" style="OLC"> <subparagraph id="H4774F4145F40491B862AC314AFEC284D" indent="up1"><enum>(U)</enum><text>training developed by the Administrator and the Director of the United States Patent and Trademark Office, which may be delivered in person or through a website to small business concerns relating to—</text> 
<clause id="HA30B7E97EEE7497B9ED1B26AF24962E2"><enum>(i)</enum><text>domestic and international intellectual property protections; and</text> </clause> <clause id="H4C6C8D1DF9154DA99DAEB4FE6B82E302"><enum>(ii)</enum><text>how such protections should be considered in the business plans and growth strategies of the small business concerns.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
