 <section id="H21D028F75F2E4092B780EDCCCCEB0CD9"><enum>101.</enum><header>Authorization</header><text display-inline="no-display-inline">Section 308 of title 46, United States Code, is amended by striking <quote>$24,700,000 for each of fiscal years 2016 and 2017</quote> and inserting <quote>$28,012,310 for fiscal year 2018 and $28,544,543 for fiscal year 2019</quote>.</text> </section><section id="H52BA4AEF3AAF4B648A1E35FC4E64E7E0" section-type="subsequent-section"><enum>102.</enum><header>Port services</header> <subsection id="H6EA83FF7B05B487896561991A41741A8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 40102 of title 46, United States Code, is amended by adding at the end the following:</text>

 <paragraph id="H42C7F8BD6D7D4E49934416EA9A46CDA7"><enum>(26)</enum><header>Port services</header><text display-inline="yes-display-inline">The term <term>port services</term> means intermediary services provided to an ocean carrier at a United States port to facilitate vessels operated by such a carrier to operate and load and unload cargo at such port, including towage, cargo handling, and bunkering.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H20D4ACC59A8C4C31BEC6BC943BB5663C"><enum>(b)</enum><header>Concerted action</header><text display-inline="yes-display-inline">Section 41105 of title 46, United States Code, is amended—</text> <paragraph id="HBD421DD8F866425CB27B3252A0BDBBA8"><enum>(1)</enum><text>in paragraph (7) by striking <quote>or</quote> at the end;</text>
 </paragraph><paragraph id="H2239BF6CD0724295B95D6F973982162E"><enum>(2)</enum><text>in paragraph (8) by striking the period at the end and inserting <quote>;</quote>; and</text> </paragraph><paragraph id="HE89FBE8BD82B4484AD175FB8973FBEDF"><enum>(3)</enum><text>by adding at the end the following:</text>

 <paragraph id="HF3012C08E7C9440FBD5DA81A1D197B4E"><enum>(9)</enum><text display-inline="yes-display-inline">negotiate with a provider of port services, other than a provider of towing vessel services, on any matter relating to rates or services provided within the United States by such provider, unless advance notice is provided to the Federal Maritime Commission of the intent and need for the negotiation, the negotiation and any resulting agreement are not in violation of the antitrust laws and are consistent with the purposes of this part, and, as determined by the Commission, the negotiation and any resulting agreement will not substantially lessen competition in the purchasing of port services provided at United States ports (this paragraph does not prohibit the setting and publishing of a joint through rate by a conference, joint venture, or association of common carriers); or</text>
 </paragraph><paragraph id="H6B0A4407B43046BD8C879BD1D0817D36"><enum>(10)</enum><text display-inline="yes-display-inline">negotiate with a provider of towing vessel services on any matter relating to rates or services provided within the United States by towing vessels.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HF31D8DC8E7D1444784B66E2BFB895EC2"><enum>(c)</enum><header>Injunctive relief sought by the Commission</header><text display-inline="yes-display-inline">Section 41307(b) of title 46, United States Code, is amended—</text> <paragraph id="HF693FE9205E04DDAA07692F97D3EB278"><enum>(1)</enum><text>in paragraph (1) by striking <quote>produce an unreasonable reduction in transportation service or an unreasonable increase in transportation cost</quote> and inserting <quote>produce an unreasonable reduction in transportation service, produce an unreasonable increase in transportation cost, or substantially lessen competition in the purchasing of port services</quote>; and</text>
 </paragraph><paragraph id="H1E320854A4204B2FB5C00A5316334C6D"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="HD5D9473E60D24C6B9CCEB7864A95A7AD" reported-display-style="italic" style="USC"> <paragraph id="HC67110CC6B5143C89CBE4064DEE1E958"><enum>(4)</enum><header>Competition factors</header><text display-inline="yes-display-inline">In making a determination under this subsection, the Commission may consider any relevant competition factors in affected markets, including, without limitation, the competitive effect of agreements other than the agreement under review.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H9D1E595C60024D92B7B0C24CDE6C16A0"><enum>103.</enum><header>Information</header>
 <subsection id="H5A685460386448E9B6E2241F4FAB1C39"><enum>(a)</enum><header>Reports filed with the Commission</header><text display-inline="yes-display-inline">Section 40104(a) of title 46, United States Code, is amended—</text> <paragraph id="HC97E9A024BF246F39DB976C9EB919DD7"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>, marine terminal operator, or ocean transportation intermediary,</quote> after <quote>common carrier</quote>;</text>
 </paragraph><paragraph id="HFB49F5FBB9E8491BBE989641B4CC0C1F"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>, operator, or intermediary,</quote> after <quote>employee of the carrier</quote>; and</text> </paragraph><paragraph id="H17CA9782D0384C4B969F9725EC384E87"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting <quote>, operator, or intermediary</quote> after <quote>business of the carrier</quote>.</text>
 </paragraph></subsection><subsection id="H1A8D3657CC4B470E8A44838F62617665"><enum>(b)</enum><header>Commission action</header><text display-inline="yes-display-inline">Section 40304 of title 46, United States Code, is amended—</text> <paragraph id="H2A86A3393F124E23B838AC576A13C57F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a) by inserting <quote>, and interested persons may submit relevant information and documents to the Commission</quote> after <quote>publication</quote>; and</text>
 </paragraph><paragraph id="H794F2339A4F34CE0B06349719C39BE17"><enum>(2)</enum><text>in subsection (d) by striking <quote>to make the determinations required by this section</quote>.</text> </paragraph></subsection></section><section id="H93AAD313A03D4F61B771966936F21DE8"><enum>104.</enum><header>Ocean transportation intermediaries</header> <subsection id="H3008F26C67E247579315C84AF8EB4926"><enum>(a)</enum><header>License requirement</header><text display-inline="yes-display-inline">Section 40901(a) of title 46, United States Code, is amended by inserting <quote>advertise, hold oneself out, or</quote> after <quote>may not</quote>.</text>
 </subsection><subsection id="H29186DA90D024E59BF46A9F6370280E5"><enum>(b)</enum><header>Financial responsibility</header><text display-inline="yes-display-inline">Section 40902(a) of title 46, United States Code, is amended by inserting <quote>advertise, hold oneself out, or</quote> after <quote>may not</quote>.</text> </subsection><subsection id="H07C8719A07B74526B6F1D2616E8C174D"><enum>(c)</enum><header>Common carriers</header><text display-inline="yes-display-inline">Section 41104(11) of title 46, United States Code, is amended by striking <quote>a tariff as required by section 40501 of this title and</quote>.</text>
				</subsection></section><section id="H2CC1822F4DB94AD7A581447E24E48ED4"><enum>105.</enum><header>Interrelated agreements</header>
 <subsection id="H14BA2092AE6D4E268B02534FB51A6979"><enum>(a)</enum><header>Common carriers</header><text display-inline="yes-display-inline">Section 41104 of title 46, United States Code, is amended—</text> <paragraph id="H6DCEE3EE40414DD8AA31A6E63C00527C"><enum>(1)</enum><text>in paragraph (11) by striking <quote>or</quote> at the end;</text>
 </paragraph><paragraph id="HCF1EF47CB88948BBBA19CC3CB361316F"><enum>(2)</enum><text>in paragraph (12) by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph><paragraph id="H4D4FD2F9A65D4100ADF94EC2FD8BE191"><enum>(3)</enum><text>by adding at the end the following:</text>

 <paragraph id="H1524CAE5F9614893824D3FCD1B465BB5"><enum>(13)</enum><text display-inline="yes-display-inline">participate in a rate discussion agreement and a vessel sharing agreement, slot sharing agreement, space sharing agreement, or similar agreement for use of vessels by two or more ocean common carriers, unless the Commission has granted the parties an exemption pursuant to section 40103.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="H91DB1AA54E094725A91B3CD5C1F25B7B"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Participants in an agreement in effect on the date of enactment of this Act and prohibited as a result of the amendment made in subsection (a) shall have 1 year from such date of enactment to—</text>
 <paragraph id="H04BCDF3738C749F68215577C590258F5"><enum>(1)</enum><text>obtain an exemption from the application of section 41104(13) of title 46, United States Code, pursuant to section 40103 of such title; or</text>
 </paragraph><paragraph id="H401618210CE14732B8EF9953C006EBD5"><enum>(2)</enum><text>withdraw from the agreement as necessary to comply with such section 41104(13).</text> </paragraph></subsection></section></title><title id="H394F7E4BA4C043698C1E7E941F970512"><enum>II</enum><header>Other matters</header> <section id="HA3B7A4276B9F42D5B0C798F502C107F2"><enum>201.</enum><header>Fishing safety grants</header><text display-inline="no-display-inline">Section 4502 of title 46, United States Code, is amended—</text>
 <paragraph id="H2E0163B3334F42E2902D4667BBDC72BD"><enum>(1)</enum><text>in subsections (i) and (j), by striking <quote>Secretary</quote> each place it appears and inserting <quote>Secretary of Commerce</quote>;</text> </paragraph><paragraph id="H890A10B1497D44258A9DE99AFE825A8A"><enum>(2)</enum><text>in subsection (i)(3), by striking <quote>75</quote> and inserting <quote>50</quote>;</text>
 </paragraph><paragraph id="H1F5908E3F69648C18375250AA23B8C3E"><enum>(3)</enum><text>in subsection (i)(4), by striking <quote>$3,000,000 for each of fiscal years 2015 through 2017</quote> and inserting <quote>$3,000,000 for each of fiscal years 2018 through 2019</quote>;</text> </paragraph><paragraph display-inline="no-display-inline" id="HD6B8401EE579471FAB5C96672DE8EB56"><enum>(4)</enum><text>in subsection (j)(3), by striking <quote>75</quote> and inserting <quote>50</quote>; and</text>
 </paragraph><paragraph id="H149E7D0883F04BBD838D5135218AB087"><enum>(5)</enum><text>in subsection (j)(4), by striking <quote>$3,000,000 for each fiscal years 2015 through 2017</quote> and inserting <quote>$3,000,000 for each of fiscal years 2018 through 2019</quote>.</text> </paragraph></section><section id="H099BBCFC777842F4BC3E16C7884350E1"><enum>202.</enum><header>Assistance for small shipyards</header> <subsection id="H2097C6D885AB44C68184A3CE6B18F019"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 54101 of title 46, United States Code, is amended—</text>
 <paragraph id="HFD75AFA7A478485C86096AC7C946AF0E"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">and maritime communities</header-in-text></quote>;</text> </paragraph><paragraph id="HD8E7CC4B3E5642B398C3AB97326FF2DF"><enum>(2)</enum><text>in subsection (a)(2), by striking <quote>in communities</quote> and all that follows through the period and inserting <quote>relating to shipbuilding, ship repair, and associated industries.</quote>;</text>
 </paragraph><paragraph id="H628860E609E943D3AE2CFF462B826D13"><enum>(3)</enum><text>in subsection (b), by amending paragraph (1) to read as follows:</text> <quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="HBBD53FAA869E424992E5116A364B89AC" reported-display-style="italic" style="USC"> <paragraph id="H75E9F738BA6444DA85250BF25990C700"><enum>(1)</enum><text display-inline="yes-display-inline">consider projects that foster—</text>

 </paragraph><paragraph id="H6950C0B8614248028EE3A7CCDDEA1119"><enum>(4)</enum><text>in subsection (c)(1)—</text> <subparagraph id="H8C7FDDD057E04EB487EB5549BE50F0AF"><enum>(A)</enum><text>by inserting <quote>to</quote> after <quote>may be used</quote>; and</text>
 </subparagraph><subparagraph id="H91389648639F49A293E428A4912BE18F"><enum>(B)</enum><text>by striking subparagraphs (A), (B), and (C) and inserting the following:</text> <quoted-block changed="added" committee-id="HPW00" display-inline="no-display-inline" id="H3A39AC6414CD4FC8B4563C5754C63A7A" reported-display-style="italic" style="USC"> <subparagraph id="HAB81E568134D45DC8DD12D3E20EF52EF"><enum>(A)</enum><text display-inline="yes-display-inline">make capital and related improvements in small shipyards; and</text>

 <subsection id="H931D9D0D9D0442388C51F179FF80B573"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/313">chapter 313</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text>

						<section id="HA876B638318E4CF5AE17B91C9A8AD01A"><enum>31310.</enum><header>Treatment of fishing permits</header>
 <subsection id="HC664C9FDC2F74F268C2B4FF7E0E1BDEF"><enum>(a)</enum><header>Limitation on maritime liens</header><text display-inline="yes-display-inline">This chapter—</text> <paragraph id="H8F1821957B454D2CA1673D1FDE93B67B"><enum>(1)</enum><text>does not establish a maritime lien on a fishing permit; and</text>
 </paragraph><paragraph id="HA89C1F6E4CD544838BFFF2EC4D02EA8F"><enum>(2)</enum><text>does not authorize any civil action to enforce a maritime lien on a fishing permit.</text> </paragraph></subsection><subsection id="HE3662EFDA1284BDB88B3BB38E8D8D089"><enum>(b)</enum><header>Treatment of fishing permits under State and Federal law</header><text>A fishing permit—</text>
 <paragraph id="H02BE87EE8E584D18880FA6F8102C35EF"><enum>(1)</enum><text>is governed solely by the State or Federal law under which it is issued; and</text> </paragraph><paragraph id="HBDF3252188DC4CDA9AAF8F2200F0C5CE"><enum>(2)</enum><text>shall not be treated as part of a vessel, or as an appurtenance or intangible of a vessel, for any purpose under Federal law.</text>
 </paragraph></subsection><subsection id="HB269243BCCB34CD1BF47BAE91E27C7AF"><enum>(c)</enum><header>Authority of Secretary of Commerce not affected</header><text>Nothing in this section shall be construed as imposing any limitation upon the authority of the Secretary of Commerce—</text>

 <paragraph id="H9AA2CCA502064972B82F4A96B81E293E"><enum>(1)</enum><text>Gulf of Mexico;</text> </paragraph><paragraph id="H125FF3124A80415C9E8853866C27209B"><enum>(2)</enum><text>Atlantic Ocean;</text>
 </paragraph><paragraph id="H7081884A2A7A483C906E1406BDB7D7CA"><enum>(3)</enum><text>Long Island Sound;</text> </paragraph><paragraph id="H98269BBFC90D45F9B9819479E9EB493D"><enum>(4)</enum><text>Pacific Ocean;</text>
 </paragraph><paragraph id="H19C848F1210D4D2CA9EBB08A17E75AD8"><enum>(5)</enum><text>Great Lakes; or</text> </paragraph><paragraph id="HBAAE5A402B6E426894C0C2535BF139B9"><enum>(6)</enum><text display-inline="yes-display-inline">Mississippi River System.</text>
 </paragraph></subsection><subsection id="H99CA7026DFBD4A7BAD1D2CF7A67ACC34"><enum>(b)</enum><header>Assistance</header><text>The Secretary may enter into a cooperative agreement (as that term is used in section 6305 of title 31) with a center of excellence designated under subsection (a) to support maritime workforce training and education at the center of excellence, including efforts of the center of excellence to—</text>
 <paragraph id="HB4FA5C294C0647949DEBA905F059114E"><enum>(1)</enum><text>admit additional students;</text> </paragraph><paragraph id="HEBB4A2F6FC294DF7AB464BC2944701B8"><enum>(2)</enum><text>recruit and train faculty;</text>
 </paragraph><paragraph id="H5305975AFF7241C88094D2BB97F21BB1"><enum>(3)</enum><text>expand facilities;</text> </paragraph><paragraph id="H8F1E2C8A1B014052AFC2C404BAE7150C"><enum>(4)</enum><text>create new maritime career pathways; or</text>
 </paragraph><paragraph id="HCCF02FE8619D4EE3A3CCD474DBCA1552"><enum>(5)</enum><text>award students credit for prior experience, including military service.</text> </paragraph></subsection><subsection id="H9112A9FFCB1B457C8AA4999F6D3F7212"><enum>(c)</enum><header>Covered training entity defined</header><text>In this section, the term <term>covered training entity</term> means an entity that is—</text>
 <paragraph id="H975D6B6F215C4E789BBD4B43FDAA6422"><enum>(1)</enum><text>a community or technical college; or</text> </paragraph><paragraph id="H6F78042B298746D28A080CA5D0980AC2"><enum>(2)</enum><text>a maritime training center—</text>
 <subparagraph id="H3A950DFE4C9645669F1D70E61A08E53F"><enum>(A)</enum><text>operated by, or under the supervision of, a State; and</text> </subparagraph><subparagraph id="HD599E04A01FE45189B2FA4035FD92A88"><enum>(B)</enum><text>with a maritime training program in operation on the date of enactment of this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
