Authorization of appropriations for airport personnel training to identify and report human trafficking victims.</toc-entry></toc></section><title id="id3344c5e6b4d84b029c0170049519cb32"><enum>I</enum><header>Combating trafficking in persons in the United States</header><subtitle id="idca4cf3022265433c9bac7e83712863cb"><enum>A</enum><header>Programs to support victims and persons vulnerable to human trafficking</header><section id="id4f86f4e202e24f31be1b4aeb974745f8"><enum>101.</enum><header>Grants to assist in the recognition of trafficking</header><subsection id="idc609807b7e324d82bac39830b2e20506"><enum>(a)</enum><header>Grants to assist in recognition of trafficking</header><text>Section 106(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7104">22 U.S.C. 7104(b)</external-xref>) is amended—</text><paragraph id="id599ce896830445d286c539e6a4ac840b"><enum>(1)</enum><text>by striking <quote>The President</quote> and inserting the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id6b4255ebd25c4af99121323c1ca34fa0" reported-display-style="italic" style="OLC"><paragraph id="idb315b3fb0b3243439c8bcb817070f462"><enum>(1)</enum><header>In general</header><text>The President</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idc753eb593daa474cb49994238000d2ee"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id465dc6a180c04ccfb190c69f9f62ac19" reported-display-style="italic" style="OLC"><paragraph id="id040fe357c6374b239fa898f818af880c"><enum>(2)</enum><header>Grants to assist in the recognition of trafficking</header><subparagraph id="idBC48AE142045476FB5D0856A19D68EB8"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="idBB3D6D59F43749169AB6F42A67CF9281"><enum>(i)</enum><header>ESEA terms</header><text>The terms <term>elementary school</term>, <term>local educational agency</term>, <term>other staff</term>, and <term>secondary school</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></clause><clause id="idAF77330CE7F24E63A6CEAB39618CB9C0"><enum>(ii)</enum><header>High-intensity child sex trafficking area</header><text>The term <term>high-intensity child sex trafficking area</term> means a metropolitan area designated by the Director of the Federal Bureau of Investigation as having a high rate of children involved in sex trafficking.</text></clause><clause id="id5EA78C0C6D2C4A3D8FB6AA16D765E92A"><enum>(iii)</enum><header>Labor trafficking</header><text>The term <term>labor trafficking</term> means conduct described in section 103(9)(B) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(9)(B)</external-xref>).</text></clause><clause id="idDFD04498208C4BCA90B6237E6DBF31E8"><enum>(iv)</enum><header>School staff</header><text>The term <term>school staff</term> means teachers, nurses, school leaders and administrators, and other staff at elementary schools and secondary schools.</text></clause><clause id="idF40E9A7B69E04F42B54E4E693999706A"><enum>(v)</enum><header>Sex trafficking</header><text>The term <term>sex trafficking</term> means the conduct described in section 103(9)(A) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(9)(A)</external-xref>).</text></clause></subparagraph><subparagraph id="id5949e6dd273245f881f2544290c36cc7"><enum>(B)</enum><header>In general</header><text>The Secretary of Health and Human Services, in consultation with the Secretary of Education and the Secretary of Labor, may award grants to local educational agencies, in partnership with a nonprofit, nongovernmental agency, to establish, expand, and support programs—</text><clause id="idcd4234f992bc41d58a9fc8dc34916e18"><enum>(i)</enum><text>to educate school staff to recognize and respond to signs of labor trafficking and sex trafficking; and</text></clause><clause id="id78d557f7de6143a6a849f6695c9487ec"><enum>(ii)</enum><text>to provide age-appropriate information to students on how to avoid becoming victims of labor trafficking and sex trafficking.</text></clause></subparagraph><subparagraph id="id389ef0313fbd49c4947d053c91927c6c"><enum>(C)</enum><header>Program requirements</header><text>Amounts awarded under this paragraph shall be used for—</text><clause id="id6a010e70a6b94798ba9b507233adffeb"><enum>(i)</enum><text>education regarding—</text><subclause id="idff424114f8b9451dad437d0020b5ad8b"><enum>(I)</enum><text>avoiding becoming victims of labor trafficking and sex trafficking;</text></subclause><subclause id="id6254e926966b407089713f2b6a09e965"><enum>(II)</enum><text>indicators that an individual is a victim or potential victim of labor trafficking or sex trafficking;</text></subclause><subclause id="id5e9d8ef0d8054d0d825cefe1f6cda9ae"><enum>(III)</enum><text>options and procedures for referring such an individual, as appropriate, to information on such trafficking and services available for victims of such trafficking;</text></subclause><subclause id="id97bc6722478c43e99e06a7b6e5063c5e"><enum>(IV)</enum><text>reporting requirements and procedures in accordance with applicable Federal and State law; and</text></subclause><subclause id="id143364518840492494d0c7879235c87a"><enum>(V)</enum><text>how to carry out activities authorized under subparagraph (A)(ii); and</text></subclause></clause><clause id="idaca6ab03d5ff4d7ea7119b3567f4224c"><enum>(ii)</enum><text>a plan, developed and implemented in consultation with local law enforcement agencies, to ensure the safety of school staff and students reporting such trafficking.</text></clause></subparagraph><subparagraph id="id6aa1707d032d4900a6b9fa1684bd7872"><enum>(D)</enum><header>Priority</header><text>In awarding grants under this paragraph, the Secretary shall give priority to local educational agencies serving a high-intensity child sex trafficking area.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfac0812c2b75461096791a46acf25d05"><enum>(b)</enum><header>Inclusion in authorization of appropriations</header><text>Section 113(b)(1) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7110">22 U.S.C. 7110(b)(1)</external-xref>) is amended by striking <quote>section 107(b)</quote> and inserting <quote>sections 106(b) and 107(b)</quote>.</text></subsection></section><section id="id79a071186dca43669f4a9e2f26e693ba"><enum>102.</enum><header>Preventing future trafficking in the United States through receipt of complaints abroad</header><subsection id="id5b65ae40136349d9909624cc4e28a263"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall ensure that each diplomatic or consular post or other mission designates an employee to be responsible for receiving information from—</text><paragraph id="id085D2FE738814C66B771FC1CC8F9CD53"><enum>(1)</enum><text>any person who was a victim of a severe form of trafficking in persons (as such term is defined in section 103(14) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(14)</external-xref>)) while present in the United States; or</text></paragraph><paragraph id="idEA311B32843B451DB6E917B681FE2B65"><enum>(2)</enum><text>any person who has information regarding a victim described in paragraph (1).</text></paragraph></subsection><subsection id="idc60c0f7bc94a4296a1014fdef5124c48"><enum>(b)</enum><header>Provision of information</header><text>Any information received pursuant to subsection (a) shall be transmitted to the Department of Justice, the Department of Labor, the Department of Homeland Security, and to any other relevant Federal agency for appropriate response. The Attorney General, the Secretary of Labor, the Secretary of Homeland Security, and the head of any other such relevant Federal agency shall establish a process to address any actions to be taken in response to such information.</text></subsection><subsection id="idc98227626b5f434cbe599dd8ed450e6e"><enum>(c)</enum><header>Assistance from foreign governments</header><text>The employee designated for receiving information pursuant to subsection (a) should coordinate with foreign governments or civil society organizations in the countries of origin of victims of severe forms of trafficking in persons, with the permission of and without compromising the safety of such victims, to ensure that such victims receive any additional support available.</text></subsection></section><section id="idab6a4a175b1446f18e9210c53208b5c8"><enum>103.</enum><header>Modification to grants for victims services</header><text display-inline="no-display-inline">Section 107(b)(2)(A) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105(b)(2)(A)</external-xref>) is amended by striking <quote>programs for</quote> and all that follows and inserting the following: “programs for victims of human trafficking, including programs that provide trauma-informed care or housing options to such victims who are—</text><quoted-block changed="added" display-inline="no-display-inline" id="idb6046acb011b484489ed31ab10cfca44" reported-display-style="italic" style="OLC"><clause id="id9f245476e5e242bab6595c57762a0c94"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id274DEA5D570348148325B0A6096A87C9"><enum>(I)</enum><text>between 12 and 24 years of age; and</text></subclause><subclause changed="added" id="idE4B97ED463684E1B866D56690CBC97FE" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>homeless, in foster care, or involved in the criminal justice system;</text></subclause></clause><clause id="id73021f17cb3340829326336b676992ec"><enum>(ii)</enum><text>transitioning out of the foster care system; or</text></clause><clause id="idd4d74b437ece45c0abdbf2efc6e0aea6"><enum>(iii)</enum><text>women or girls in underserved populations.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle><subtitle id="id09239264a242473e8609505c50c48e29"><enum>B</enum><header>Governmental efforts to prevent human trafficking</header><section id="id0d2412bbeb704ebdb049684dad593258"><enum>111.</enum><header>Required training to prevent human trafficking for certain contracting air carriers</header><subsection id="id768a62d155eb4624a6e826c0b67b3d2d"><enum>(a)</enum><header>In general</header><text>Section 40118 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id88ad9d4354484c23a2c8c32f99ce7596" reported-display-style="italic" style="OLC"><subsection id="id1db877d28f4f48ebb69b1317b45c53d8"><enum>(g)</enum><header>Training requirements</header><text>The Administrator of General Services shall ensure that any contract entered into for provision of air transportation with a domestic carrier under this section requires that the contracting air carrier submits to the Administrator of General Services, the Secretary of Transportation, the Administrator of the Transportation Security Administration, the Secretary of Labor and the Commissioner of U.S. Customs and Border Protection an annual report regarding—</text><paragraph id="id7575402d2e174d4483b3d89493f9fab8"><enum>(1)</enum><text>the number of personnel trained in the detection and reporting of potential human trafficking (as described in paragraphs (9) and (10) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)), including the training required under section 44734(a)(4);</text></paragraph><paragraph id="idb20483054f2644a6b5fd04ccc05d8b04"><enum>(2)</enum><text>the number of notifications of potential human trafficking victims received from staff or other passengers; and</text></paragraph><paragraph id="idde0e93aa8a6a450aa8d194b3181e47da"><enum>(3)</enum><text>whether the air carrier notified the National Human Trafficking Hotline or law enforcement at the relevant airport of the potential human trafficking victim for each such notification of potential human trafficking, and if so, when the notification was made.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5375eb89359b409e9ca9ef0c6393ee45"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any contract entered into after the date of enactment of this Act except for contracts entered into by the Secretary of Defense.</text></subsection></section><section display-inline="no-display-inline" id="idf6e4e0be-3e61-459c-8e95-40df78b2fa30" section-type="subsequent-section"><enum>112.</enum><header>Ensuring United States procurement does not fund human trafficking</header><text display-inline="no-display-inline">Section 106 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7104">22 U.S.C. 7104</external-xref>) is amended by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="idd2a55429-7679-4993-ab71-7ce3d0e3f304" reported-display-style="italic" style="OLC"><subsection id="id7605e5d3-e27d-47d3-bda9-9707bcbf925c"><enum>(k)</enum><header>Agency action To prevent funding of human trafficking</header><paragraph id="idf01eebc3-dc53-496e-b098-f5ce508d6b10"><enum>(1)</enum><header>In general</header><text>At the end of each fiscal year, the Secretary of State, the Secretary of Labor, the Administrator of the United States Agency for International Development, and the Director of the Office of Management and Budget shall each submit a report to the Administrator of General Services that includes—</text><subparagraph commented="no" id="id5b09508b-0d3e-4a46-aaaf-28a43fc245da"><enum>(A)</enum><text display-inline="yes-display-inline">the name and contact information of the individual within the agency’s Office of Legal Counsel or Office of Acquisition Policy who is responsible for overseeing the implementation of—</text><clause commented="no" id="id0582E9471D9B4CEFBF336822C468433C"><enum>(i)</enum><text display-inline="yes-display-inline">subsection (g);</text></clause><clause commented="no" id="id86BB4E4959FF48589413997430467AC4"><enum>(ii)</enum><text display-inline="yes-display-inline">title XVII of the National Defense Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="usc" parsable-cite="usc/22/7104a">22 U.S.C. 7104a</external-xref> et seq.); and</text></clause><clause commented="no" id="id59EC398837F148ABBF742C80F520EC51"><enum>(iii)</enum><text display-inline="yes-display-inline">any regulation in the Federal Acquisition Regulation (48 C.F.R. 1 et seq.) that is related to any subject matter referred to in clause (i) or (ii);</text></clause></subparagraph><subparagraph id="id12ab011d-9fd2-4d45-a2d1-908988e09053"><enum>(B)</enum><text display-inline="yes-display-inline">agency action to ensure that contractors are educated on the applicable laws and regulations listed in subparagraph (A);</text></subparagraph><subparagraph id="ideaa3d705-d865-4b01-bc83-6d6dd7806507"><enum>(C)</enum><text display-inline="yes-display-inline">agency action to ensure that the acquisition workforce and agency officials understand implementation of the laws and regulations listed in subparagraph (A), including best practices for—</text><clause id="id9037a811-a1b9-46d4-8cac-fc7110b270ba"><enum>(i)</enum><text>ensuring compliance with such laws and regulations;</text></clause><clause id="idae83bb07-3bb5-43f9-9cc7-dd0f0088ecc4"><enum>(ii)</enum><text>assessing the serious, repeated, willful, or pervasive nature of any violation of such laws or regulations; and</text></clause><clause id="idaeb2829a-30b8-4c2e-8888-0d5217d57404"><enum>(iii)</enum><text>evaluating steps contractors have taken to correct any such violation;</text></clause></subparagraph><subparagraph id="id152f35f2-88a8-409e-aeaa-c0dc853a2406"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id7AB37542E9374CF1AF0FBDC698EFF2DD"><enum>(i)</enum><text display-inline="yes-display-inline">the number of contracts containing language referring to the laws and regulations listed in subparagraph (A); and</text></clause><clause changed="added" id="idBD62A323B74045B5A1E9A13A8591C5AB" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of contracts that did not contain any language referring to such laws and regulations;</text></clause></subparagraph><subparagraph id="id655256a3-3241-4864-92d0-a447d2139dac"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id12785206193843769721AA235263F1A6"><enum>(i)</enum><text display-inline="yes-display-inline">the number of allegations of severe forms of trafficking in persons received; and</text></clause><clause changed="added" id="id1B7C1706F8DE491D854F8D56AEDAC30B" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">the source type of the allegation (such as contractor, subcontractor, employee of contractor or subcontractor, or an individual outside of the contract);</text></clause></subparagraph><subparagraph id="id33081f0f-9496-4b9d-b04d-19be039e863e"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="id5F52E2CA5C4647A28365C1BFA6D19436"><enum>(i)</enum><text display-inline="yes-display-inline">the number of such allegations investigated by the agency;</text></clause><clause changed="added" id="id2F52B0E0C0B642219727B2B326CEDB38" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">a summary of any findings from such investigations; and</text></clause><clause changed="added" id="id494B6BD4A55E49A393E74E581C26AD65" indent="up1" reported-display-style="italic"><enum>(iii)</enum><text display-inline="yes-display-inline">any improvements recommended by the agency to prevent such conduct from recurring;</text></clause></subparagraph><subparagraph id="idb77fec6c-1fdf-4928-ae35-3250e363d02c"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="id057A530A0D9A4C9185EE0E8D34566FD9"><enum>(i)</enum><text display-inline="yes-display-inline">the number of such allegations referred to the Attorney General for prosecution under section 3271 of title 18, United States Code; and</text></clause><clause changed="added" id="idA92C3F123BFE4E32B5DDF9C67856112D" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">the outcomes of such referrals;</text></clause></subparagraph><subparagraph id="iddb0e08eb-6707-43db-9ad4-c958986fa9f1"><enum>(H)</enum><text>any remedial action taken as a result of such investigation, including whether—</text><clause id="id631f7abe-fa54-42fb-b98d-e9e83ecff36d"><enum>(i)</enum><text>a contractor or subcontractor (at any tier) was debarred or suspended due to a violation of a law or regulation relating to severe forms of trafficking in persons; or</text></clause><clause id="id9898d305-a4f8-4e2c-9f82-c10e0d0c0dda"><enum>(ii)</enum><text>a contract was terminated pursuant to subsection (g) as a result of such violation;</text></clause></subparagraph><subparagraph id="id73f9312d-7b89-4303-b903-88371ed57c2f"><enum>(I)</enum><text>any other assistance offered to agency contractors to ensure compliance with a law or regulation relating to severe forms of trafficking in persons;</text></subparagraph><subparagraph id="id98aee918-8450-41a4-83a0-7f8f8f54891f"><enum>(J)</enum><text>any interagency meetings or data sharing regarding suspended or disbarred contractors or subcontractors (at any tier) for severe forms of trafficking in persons; and</text></subparagraph><subparagraph id="id37853a69-c778-4092-b39e-5fb0b8bf40e9"><enum>(K)</enum><text>any contract with a contractor or subcontractor (at any tier) located outside the United States and the country location, where safe to reveal location, for each such contractor or subcontractor.</text></subparagraph></paragraph><paragraph commented="no" id="idf8f2e557-88c9-4c05-90e9-e9cce520a6e7"><enum>(2)</enum><header>Appropriate congressional committees</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" id="id883bea41-7bc1-40d3-bbe2-76aaae7f63d3"><enum>(A)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="id1AC7A1F313CB47C2A903AC1284CF6126"><enum>(B)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="idF865B8623E7F495E8696A825AEE5EAA9"><enum>(C)</enum><text>the <committee-name committee-id="">Committee on Education and the Workforce of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="idB8DA8115D2AF47D48E63475597B617FA"><enum>(D)</enum><text>the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="idBA7177C870664141A1FD46686C5D6EFD"><enum>(E)</enum><text>the <committee-name committee-id="">Committee on Oversight and Government Reform of the House of Representatives</committee-name>;</text></subparagraph><subparagraph commented="no" id="id72629689-c8ab-40c2-83f3-03eef148ec18"><enum>(F)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" id="idB93A438667224589A1BC28DD64C67DA0"><enum>(G)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" id="id2CA7FE7BB83B4C69B2ABBFEA9F094B5C"><enum>(H)</enum><text>the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>; and</text></subparagraph><subparagraph commented="no" id="idF3F4734A8C6343B2843012A7A5E5F7D6"><enum>(I)</enum><text>the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions of the Senate</committee-name>.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id2ddc5321e0e14fb9892a4cb64d3af0ec"><enum>113.</enum><header>Training course on human trafficking and government contracting</header><text display-inline="no-display-inline">Any curriculum, including any continuing education curriculum, for the acquisition workforce used by the Federal Acquisition Institute established under section 1201 of title 41, United States Code, shall include at least 1 course, lasting at least 30 minutes, regarding the law and regulations relating to human trafficking and contracting with the Federal Government.</text></section><section id="ida489185010ab498eaba53166369e91a6"><enum>114.</enum><header>Modifications to the Advisory Council on Human Trafficking</header><text display-inline="no-display-inline">The Survivors of Human Trafficking Empowerment Act (section 115 of <external-xref legal-doc="public-law" parsable-cite="pl/114/22">Public Law 114–22</external-xref>; 129 Stat. 243) is amended—</text><paragraph id="id774078c6882245009d261aa62ab61ee0"><enum>(1)</enum><text>in subsection (f), by amending paragraph (2) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="id25d85c25329c42ab8ef213b1d53938e6" reported-display-style="italic" style="OLC"><paragraph id="idac9f42ce971f48f29610abcc5d352ce5"><enum>(2)</enum><text>shall receive travel expenses, including per diem in lieu of subsistence, in accordance with the applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id990ad3cd40c94c088914c42c1d49e83b"><enum>(2)</enum><text>in subsection (h), by striking <quote>2020</quote> and inserting <quote>2021</quote>.</text></paragraph></section><section id="id80d154ea567545f6a815fc6900a8f8b8"><enum>115.</enum><header>Sense of Congress on the Senior Policy Operating Group</header><text display-inline="no-display-inline">It is the sense of Congress that the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(g)</external-xref>) should create a working group to examine the role of demand reduction, both domestically and internationally, in achieving the purposes of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101</external-xref> et seq.) and the Justice for Victims of Trafficking Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/22">Public Law 114–22</external-xref>; 129 Stat. 227).</text></section><section id="idb9e2a6439af846d1a094e65f73e74a59"><enum>116.</enum><header>Best practices to prevent forced child labor trafficking</header><text display-inline="no-display-inline">It is the sense of the Congress that—</text><paragraph id="idefdcaa2fb6204c96b4030395ebc91344"><enum>(1)</enum><text>the United States Government condemns, in the strongest terms, forced child labor, including in situations of trafficking; and</text></paragraph><paragraph id="id168f82613c4641a297a553de2a5fa1ac"><enum>(2)</enum><text>the President should work with the private sector to develop best practices and guidance for preventing forced child labor and indentured servitude, including in situations of trafficking.</text></paragraph></section></subtitle><subtitle id="idb19a084d24f5460bb8766755d3cd95c2"><enum>C</enum><header>Preventing trafficking in persons in the United States</header><section id="idec1763e3f80a4a57a040932919180b89"><enum>121.</enum><header>Demand reduction strategies in the United States</header><subsection id="id3f8c49b446f14dc99c6ff7feb3036724"><enum>(a)</enum><header>Department of Justice task force</header><text>Section 105(d)(7) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(d)(7)</external-xref>) is amended—</text><paragraph id="idf98d6d248be34a3e88c71befba4be025"><enum>(1)</enum><text>in subparagraph (Q)(vii), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id49f80d082282462e9c12d7d6ca085d64"><enum>(2)</enum><text>in subparagraph (R), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id50e88ab2d114413e8bba5d3f7b16f9d9"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id3b480c9649c141cf97a76c2dc151ea4f" reported-display-style="italic" style="OLC"><subparagraph id="id36f312756fdf45aa9286bd87ee81230c"><enum>(S)</enum><text>tactics and strategies employed by human trafficking task forces sponsored by the Department of Justice to reduce demand for trafficking victims.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf3fcdc059b7f45a082bfc52a92b67ae4"><enum>(b)</enum><header>Report on State enforcement</header><text>Subsection (e)(1)(A) of the Combat Human Trafficking Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/34/20709">34 U.S.C. 20709(e)(1)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idA7F7939F687C4ADE803C03B2FC4C3341"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>rates</quote> and inserting <quote>number</quote>;</text></paragraph><paragraph id="idb3366b9afe9948878838c1b0ae7c6d47"><enum>(2)</enum><text>by inserting <quote>, noting the number of covered offenders</quote> after <quote>covered offense</quote> each place such term appears;</text></paragraph><paragraph id="id095327ad65b3419598847eb53b9fac7a"><enum>(3)</enum><text>in clause (i), by striking <quote>arrest</quote> and inserting <quote>arrests</quote>;</text></paragraph><paragraph id="id8b7761aa5f2e4f0e9c013a60796b26dc"><enum>(4)</enum><text>in clause (ii), by striking <quote>prosecution</quote> and inserting <quote>prosecutions</quote>; and</text></paragraph><paragraph id="id022fef9ddf204a5691f37986a901fd19"><enum>(5)</enum><text>in clause (iii), by striking <quote>conviction</quote> and inserting <quote>convictions</quote>.</text></paragraph></subsection></section><section id="idf02ccad26405410ebf0e13daa96b8d16"><enum>122.</enum><header>Designation of a labor prosecutor to enhance State and local efforts to combat trafficking in persons</header><text display-inline="no-display-inline">Section 204(a)(1) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/34/20705">34 U.S.C. 20705(a)(1)</external-xref>) is amended—</text><paragraph id="id38fcb4490ed1487daa9bb55d0fd1b027"><enum>(1)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="idc97984522568483b8d1c583f5709f837"><enum>(2)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id37db808ec7bf432fb8d39db29d6dcee5"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="idb20ca8b62a964263a040f0ea2e4f1842" reported-display-style="italic" style="OLC"><subparagraph id="id8abb3fe06dda45b2b9916a9745577f34"><enum>(F)</enum><text>as appropriate, to designate at least 1 prosecutor for cases of severe forms of trafficking in persons (as such term is defined in section 103(9) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(9)</external-xref>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id60a85a3c75a0452dbce72cb514020cd3"><enum>123.</enum><header>Preventing human trafficking in foreign missions and diplomatic households</header><text display-inline="no-display-inline">Section 203(a) of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/8/1375c">8 U.S.C. 1375c(a)</external-xref>) is amended—</text><paragraph id="id981a883295ed4848831a3e666651e489"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="id46e823dc1c644e8082b28059a35aef1a"><enum>(A)</enum><text>by striking <quote>for such period as the Secretary determines necessary</quote> and inserting <quote>for a period of at least 1 year, except if the Secretary determines and reports to the appropriate congressional committees, in advance, the reasons a shorter period is in the national interest,</quote>; and</text></subparagraph><subparagraph id="id8a13a5f1b22249ed906ac61b091e26b7"><enum>(B)</enum><text>by striking <quote>the Secretary determines</quote> and all that follows and inserting <quote>there is an unpaid default or final civil judgement directly or indirectly related to human trafficking against the employer or a family member assigned to the embassy, or the diplomatic mission or international organization hosting the employer or family member has not responded affirmatively to a request to waive immunity within 6 weeks of the request in a case brought by the United States Government and the country that accredited the employer or family member or, in the case of international organizations, the country of citizenship, has not initiated prosecution against the employer or family member.</quote>; and</text></subparagraph></paragraph><paragraph id="ida84888e303454e36afda233d2c585579"><enum>(2)</enum><text>in paragraph (3), by striking <quote>a mechanism is in place</quote> and inserting <quote>, as applicable, the unpaid default judgment or final civil judgement has been resolved, the diplomatic mission or international organization hosting the employer or family member has waived immunity for the employer or family member or the country that accredited the employer or family member or the country of citizenship of the employer or family member completed the prosecution of the employer or family member, and the diplomatic mission or international organization hosting the employer or family member has a mechanism in place</quote>.</text></paragraph></section><section id="id6456D6AF39394CDEB6A1AD8A8CF3E727"><enum>124.</enum><header>Actions against significant traffickers in persons</header><text display-inline="no-display-inline">Section 111(a)(1) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7108">22 U.S.C. 7108(a)(1)</external-xref>) is amended—</text><paragraph id="id217312081AEA4FCD811D6503AADA4BC8"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, or section 1263 of the Global Magnitsky Human Rights Accountability Act (subtitle F of title XII of <external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note),</quote> after <quote>1701)</quote> the second place it appears; and</text></paragraph><paragraph id="id4297B750D4054FE59FC9CC7D08C87756"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="idC1E9CC474C80405C99EED8A2262CA431" reported-display-style="italic" style="OLC"><subparagraph id="id7f63ce8cfe5449d682955cc0a8177e8d"><enum>(D)</enum><text>Officials of a foreign government who participate in, facilitate, or condone severe forms of trafficking in persons for significant financial gain.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle><subtitle id="idd14acb72494e438082302a4d5a309526"><enum>D</enum><header>Monitoring child, forced, and slave labor</header><section id="id2b382928ddcd44c98961c10b16bf5bf7"><enum>131.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="ide1420f44000e4cbab30ccf9627ea837f"><enum>(1)</enum><text>foreign assistance that addresses poverty alleviation and humanitarian disasters reduces the vulnerability of men, women, and children to human trafficking and is a crucial part of the response of the United States to modern-day slavery;</text></paragraph><paragraph id="id0d19ab64dc3d45dfb4022602fc3d0a13"><enum>(2)</enum><text>the Deputy Under Secretary of the Bureau of International Labor Affairs of the Department of Labor and the grant programs administered by the Deputy Under Secretary play a critical role in preventing and protecting children from the worst forms of child labor, including situations of trafficking, and in reducing the vulnerabilities of men and women to situations of forced labor and trafficking; and</text></paragraph><paragraph commented="no" id="id8D3F96AB1C2F4820BD9BA2DAA590ECF7"><enum>(10)</enum><text>the <committee-name committee-id="SSFI00">Committee on Finance of the Senate</committee-name>.</text></paragraph></subsection><subsection id="id8f810bd59e8e49539eef49dbfb4dda97"><enum>(c)</enum><header>Requirements</header><text>The report required under subsection (a) shall—</text><paragraph id="iddc01c228c6a04adabfc89a2bcfb6b552"><enum>(1)</enum><text>describe the role and best practices of private sector employers in the United States in complying with the provisions of section 307 of the Tariff Act of 1930;</text></paragraph><paragraph id="idf0127dbe83e24c989999cb8dd0fba6c6"><enum>(2)</enum><text>describe any efforts or programs undertaken by relevant Federal, State, or local government agencies to encourage employers, directly or indirectly, to comply with such provisions;</text></paragraph><paragraph id="idc452d85de2ab46ba9afa014ba44ca7f4"><enum>(3)</enum><text>describe the roles of the relevant Federal departments and agencies in overseeing and regulating such provisions, and the oversight and enforcement mechanisms used by such departments or agencies;</text></paragraph><paragraph id="id6b2483f179c54dfcb50773ae319583ac"><enum>(4)</enum><text>provide concrete, actual case studies or examples of how such provisions are enforced;</text></paragraph><paragraph id="idd993332170734856ad3e3da485a71aac"><enum>(5)</enum><text>identify the number of petitions received and cases initiated (whether by petition or otherwise) or investigated by each relevant Federal department or agency charged with implementing and enforcing such provisions, as well as the dates petitions were received or investigations were initiated, and their current statuses;</text></paragraph><paragraph id="idf1d8472fe9164fc49b711de6a33b5127"><enum>(6)</enum><text>identify any enforcement actions during the most recent 10 years, including—</text><subparagraph id="idC6B28FA356604B6E93D1C02D6EA7464D"><enum>(A)</enum><text>the issuance of Withhold Release Orders;</text></subparagraph><subparagraph id="id624F37EAB36E4FFC95F99D2FAB56DFC1"><enum>(B)</enum><text>the detention of shipments;</text></subparagraph><subparagraph id="id94D1E2CE3B8F4CEEB915E21BD12161CA"><enum>(C)</enum><text>the issuance of civil penalties; and</text></subparagraph><subparagraph id="idAC0D679C067D40BFA405082B80BB61F6"><enum>(D)</enum><text>the formal charging with criminal charges relating to the forced labor scheme taken as a result of petitions and investigations identified pursuant to paragraph (5), organized by type of action, date of action, commodity, and country of origin;</text></subparagraph></paragraph><paragraph id="id0b9ca81fff1943f589a9e18a3189bc00"><enum>(7)</enum><text>with respect to any relevant petition filed during the 10-year period immediately preceding the date of the enactment of this Act with the relevant Federal departments and agencies tasked with implementing such provisions, list the specific products, country of origin, manufacturer, importer, end-user or retailer, and outcomes of any investigation;</text></paragraph><paragraph id="ide7e07b8638984b28b3926a699cd9dcdd"><enum>(8)</enum><text>identify any gaps that may exist in enforcement of such provisions;</text></paragraph><paragraph id="id562cf05a97c34d58b347b26ffb2e3b9f"><enum>(9)</enum><text>describe the engagement of the relevant Federal departments and agencies with stakeholders, including the engagement of importers, forced labor experts, and nongovernmental organizations; and</text></paragraph><paragraph id="id621d7b681a3641a6990eec90d8651544"><enum>(10)</enum><text>based on the information required under paragraphs (1) through (9)—</text><subparagraph id="idB86FFB99623049D89FEF134F7BB5D2D6"><enum>(A)</enum><text>identify any regulatory obstacles or challenges to enforcement of such provisions; and</text></subparagraph><subparagraph id="id51CCB647B6EB4314BDB66C775571073E"><enum>(B)</enum><text>provide recommendations for actions that could be taken by the relevant Federal departments and agencies to overcome such obstacles.</text></subparagraph></paragraph></subsection></section><section id="id7ba4aeb42b0c49ddb626db833a7514ac"><enum>133.</enum><header>Modification to list of child-made and slavery-made goods</header><subsection id="id3d15f97c7b5b488abb48eca81337d4bc"><enum>(a)</enum><header>In general</header><text>Section 105(b)(2)(C) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7112">22 U.S.C. 7112(b)(2)(C)</external-xref>) is amended by inserting <quote>, including, to the extent practicable, goods that are produced with inputs that are produced with forced labor or child labor</quote> after <quote>international standards</quote>.</text></subsection><subsection id="id2bdcd86af0ca4230bd28868f32fecda3"><enum>(b)</enum><header>Inclusion in authorization of appropriations</header><text>Amounts appropriated pursuant to the authorization of appropriations under section 113(f) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7110">22 U.S.C. 7110(f)</external-xref>), as amended by section 301, are authorized to be made available to carry out the purposes described in section 105(b)(2) of the Trafficking Victims Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7112">22 U.S.C. 7112(b)(2)</external-xref>), as amended by subsection (a).</text></subsection></section></subtitle></title><title id="id848f39cbf4ff45dfa9d4918c4c35ecb0"><enum>II</enum><header>Fighting human trafficking abroad</header><subtitle id="id0af85d06ea054dd98b30857162f2e6e7"><enum>A</enum><header>Efforts to combat trafficking</header><section id="idde550271257449c7b6e1fcf971350591"><enum>201.</enum><header>Including the Secretary of the Treasury and the United States Trade Representative as a member of
 the Interagency Task Force to Monitor and Combat Trafficking</header><text display-inline="no-display-inline">Section 105(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(b)</external-xref>) is amended by inserting <quote>the Secretary of the Treasury, the United States Trade Representative,</quote> after <quote>the Secretary of Education,</quote>.</text></section><section id="id4f229239f5d34775bf1b30012f092c0f"><enum>202.</enum><header>Encouraging countries to maintain and share data on human trafficking efforts</header><text display-inline="no-display-inline">Section 108(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7106">22 U.S.C. 7106(b)</external-xref>) is amended—</text><paragraph id="idAD0F51BBEB96442B8EE48573D5C09EE7"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="id25D1443EA6BD4A2F97C7DA17EFB0AE6C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the capacity</quote> and inserting <quote>a demonstrably increasing capacity</quote>; and</text></subparagraph><subparagraph id="id5003F8375C4347F4AACBD0C806D8C727"><enum>(B)</enum><text>by striking the last sentence; and</text></subparagraph></paragraph><paragraph id="id3B9F7E7A64A8438DB33C13E5FCAFFEE3"><enum>(2)</enum><text>in paragraph (7)—</text><subparagraph id="id7B5692E29FC549B0995993B15CE6A803"><enum>(A)</enum><text>by striking <quote>consistent with its resources</quote> and inserting <quote>, consistent with a demonstrably increasing capacity of such government to obtain such data,</quote>; and</text></subparagraph><subparagraph id="id1776224633EA4054866662A220A0C9BF"><enum>(B)</enum><text>by striking the last sentence.</text></subparagraph></paragraph></section><section id="id2e074917f77849e682c4d8ec5414502f"><enum>203.</enum><header>Appropriate listing of governments involved in human trafficking</header><text display-inline="no-display-inline">Section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>) is amended—</text><paragraph id="idc2f81822ef3047558bc01430c984d071"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="id17167490d88446d49ca5549b25e825bf"><enum>(A)</enum><text>in subparagraph (A)(iii)(I)—</text><clause id="idc0ab0cf7ef284520b92784c6a5cb05d6"><enum>(i)</enum><text>by striking <quote>absolute</quote> and inserting <quote>estimated</quote>; and</text></clause><clause id="idc7f6ff2933ce4902be74ecf740740a39"><enum>(ii)</enum><text>by inserting <quote>and the country is not taking proportional concrete actions</quote> before the semicolon at the end; and</text></subclause><subclause id="idc878533fe95d4eb1ad2513cd079adfd7"><enum>(II)</enum><text>any additional years after such date of enactment as a result of the President exercising the waiver authority under subparagraph (D)(ii); and</text></subclause></clause><clause id="id88e9fb2a72b94cb697c8d667cb94f84f"><enum>(ii)</enum><text>was subsequently included on the list of countries described in paragraph (1)(C).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id5DAFC47451214DE18A8E4F4935CFC328"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id072F003DF25C4F32850C07A80161C5FD" reported-display-style="italic" style="OLC"><subparagraph id="idBD1A481B9BB4448289AFB9AA2379FA57"><enum>(B)</enum><header>Proof of failure to make significant efforts</header><text>In addition to the considerations described in clauses (i), (ii), and (iii) of subparagraph (A), in determinations under paragraph (1)(C) as to whether the government of a country is not making significant efforts to bring itself into compliance with the minimum standards for the elimination of trafficking, the Secretary of State shall consider, as proof of failure to make significant efforts, a government policy or pattern of—</text><clause id="ida948ebcc5f75407897f08c2ccbc6401a"><enum>(i)</enum><text>trafficking;</text></clause><clause id="idd6efe1e018d642c4b4d5b565d769b139"><enum>(ii)</enum><text>trafficking in government-funded programs;</text></clause><clause id="ideecb0be1867646169cd143cbf41cec93"><enum>(iii)</enum><text>forced labor (in government-affiliated medical services, agriculture, forestry, mining, construction, or other sectors);</text></clause><clause id="id5a6c1a9a7381437ab43e6aec7b531e42"><enum>(iv)</enum><text>sexual slavery in government camps, compounds, or outposts; or</text></clause><clause id="id624440431ce14fe285d4d4642a25d599"><enum>(v)</enum><text>employing or recruiting child soldiers.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id727166c4043a47d1a14393d45f26f2cd"><enum>204.</enum><header>Requirements for strategies to prevent trafficking</header><subsection id="id8bf8cbb800f3439fbfc99b37efbea67f"><enum>(a)</enum><header>Report on new practices To combat trafficking</header><paragraph id="id0948cc0a325e4295a1662293154d234f"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, and annually thereafter for 7 years, the Secretary of State, in consultation with the Administrator of the United States Agency for International Development, shall submit a report to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name> and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that—</text><subparagraph id="id193d495eca92464499325d62fdf2897a"><enum>(A)</enum><text>describes any practices adopted by the Department of State or the United States Agency for International Development to better combat trafficking in persons, in accordance with the report submitted under section 101(b)(4) of the Trafficking Victims Protection Reauthorization Act of 2005, in order to reduce the risk of trafficking in post-conflict or post-disaster areas; or</text></subparagraph><subparagraph id="id3fc72c6a778145b59427282dc46adf53"><enum>(B)</enum><text>if no practices referred to in subparagraph (A) have been adopted, includes a strategy to reduce the risk of trafficking in such areas.</text></subparagraph></paragraph><paragraph id="id30bcf6a44893468295e6d3170f695b7a"><enum>(2)</enum><header>Public availability</header><text>Each report submitted under paragraph (1) shall be posted on a publicly available internet website of the Department of State.</text></paragraph></subsection><subsection id="ideab1ffd30d6a43ea99c712aba8384aed"><enum>(b)</enum><header>Child protection strategies in watch list countries</header><paragraph id="id58AE59ED33A449B5B12BC30FE67D68C9"><enum>(1)</enum><header>In general</header><text>The Administrator of the United States Agency for International Development shall incorporate into the relevant country development cooperation strategy for each country on the list described in paragraph (1)(C) of section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>) or the special watch list described in paragraph (2)(A)(iii) of such section, strategies for the protection of children and the reduction of the risk of trafficking.</text></paragraph><paragraph id="id44B1E9A9AC934538BDFC39858588D34B"><enum>(2)</enum><header>Components</header><text>The child protection and trafficking reduction strategies required under paragraph (1) shall—</text><subparagraph id="id29ACE7C824FC4528ADA438EE6498E737"><enum>(A)</enum><text>address the root causes of insecurity that leave children and youth vulnerable to trafficking; and</text></subparagraph><subparagraph id="iddc7bc10e13b44ed393dd6a7dcca25ddb"><enum>(B)</enum><text>include common metrics and indicators to monitor progress across Federal agencies to prevent, address, and end violence against children and youth globally in post-conflict and post-disaster areas.</text></subparagraph></paragraph></subsection></section><section id="id677e2665542849de8dc907bb5704e2be"><enum>205.</enum><header>Briefing on countries with primarily migrant workforces</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of State shall provide a briefing to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that includes, with respect to each country that has a domestic workforce of which more than 80 percent are third-country nationals—</text><paragraph id="id59ae351d06b7484a90dddac2c3e6edd4"><enum>(1)</enum><text>an assessment of the progress made by the government of such country toward implementing the recommendations with respect to such country contained in the most recent Trafficking in Persons Report submitted by the Secretary under section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>), as amended by section 203 of this Act; and</text></paragraph><paragraph id="id117c4bcc5ccf488d8516e667b7b2c453"><enum>(2)</enum><text>a description of the efforts made by the United States to ensure that any domestic worker brought into the United States by an official of such country is not a victim of trafficking.</text></paragraph></section><section id="id20c2202257aa448d8b5f51c2b10adb4b"><enum>206.</enum><header>Report on recipients of funding from the United States Agency for International Development</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, and by October 1 of each of the following 4 years, the Administrator of the United States Agency for International Development shall submit a report to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name> that describes, with respect to the prior fiscal year—</text><paragraph id="idabd999fd9af8441aa70a111960af681e"><enum>(1)</enum><text>each obligation or expenditure of Federal funds by the Agency for the purpose of combating human trafficking and forced labor; and</text></paragraph><paragraph id="id24d0dd4ee8f74ad8b815e98db1879134"><enum>(2)</enum><text>with respect to each such obligation or expenditure, the program, project, activity, primary recipient, and any subgrantees or subcontractors.</text></paragraph></section></subtitle><subtitle id="ide6c8c966cf604a7ebc7f99b4c331afd6"><enum>B</enum><header>Child Soldier Prevention Act of 2018</header><section id="idb622d67b4732427b9d5feb803e7742a0"><enum>211.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idfc6a9c70bf154bcbaa282c0b106157fb"><enum>(1)</enum><text>The recruitment or use of children in armed conflict is unacceptable for any government or government-supported entity receiving United States assistance.</text></paragraph><paragraph id="id6b0046813e504194b7c45b9d817c8fa5"><enum>(2)</enum><text>The recruitment or use of children in armed conflict, including direct combat, support roles, and sexual slavery, occurred during 2016 or 2017 in Afghanistan, Iran, Mali, Niger, South Sudan, Sudan, Burma, the Democratic Republic of the Congo, Iraq, Nigeria, Rwanda, Somalia, Syria, and Yemen.</text></paragraph><paragraph id="id6afa3ad1172e4055948a5d574f8d6a29"><enum>(3)</enum><text>Entities of the Government of Afghanistan, particularly the Afghan Local Police and Afghan National Police, continue to recruit children to serve as combatants or as servants, including as sex slaves.</text></paragraph><paragraph id="id80015f9769d0476fa3dafc4991dcc3c3"><enum>(4)</enum><text>Police forces of the Government of Afghanistan participate in counterterrorism operations, direct and indirect combat, security operations, fight alongside regular armies, and are targeted for violence by the Taliban and other opposition groups.</text></paragraph><paragraph id="idda16765ab9204131bf2c80dde34931d5"><enum>(5)</enum><text>In February 2016, a 10-year-old boy was assassinated by the Taliban after he had been publicly honored by Afghan local police forces for his assistance in combat operations against the Taliban.</text></paragraph><paragraph id="id2ec3a75e22c24d389c8344583cdf8c4d"><enum>(6)</enum><text>Recruitment and use of children in armed conflict by government forces has continued in South Sudan with the return to hostilities.</text></paragraph><paragraph id="id6ddeabf921a74599b24dd51c2c2ef68d"><enum>(7)</enum><text>At least 19,000 children have been recruited since South Sudan’s civil war began in 2013.</text></paragraph></section><section id="idcd9580a4030d48cb89ca851f85ae5c8d"><enum>212.</enum><header>Amendments to the Child Soldiers Prevention Act of 2008</header><subsection id="ide0c999f8572e4770b45442b4672b1504"><enum>(a)</enum><header>Definitions</header><text>Section 402(2) of the Child Soldiers Prevention Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/22/2370c">22 U.S.C. 2370c(2)</external-xref>) is amended—</text><paragraph id="id93F52E2A079746C6804634C4B0975D83"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>, police, or other security forces</quote> after <quote>governmental armed forces</quote> each place such term appears; and</text></paragraph><paragraph id="idBEB0B72D0C4040508D62AD87C94B938B"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>clauses</quote> and inserting <quote>clause</quote>.</text></paragraph></subsection><subsection id="idd966d6659f944c128916457d443b72e3"><enum>(b)</enum><header>Prohibition</header><text>Section 404 of the Child Soldiers Prevention Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/22/2370c-1">22 U.S.C. 2370c–1</external-xref>) is amended—</text><paragraph id="id028ed1474a2e4301bf58fbc6e3feedf4"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idcd1a2c5b78624a5cb86744f13df41b5e"><enum>(A)</enum><text>by inserting <quote>, police, or other security forces,</quote> after <quote>governmental armed forces</quote>; and</text></subparagraph><subparagraph id="idc09bfff251de4bd3801057f28af20289"><enum>(B)</enum><text>by striking <quote>recruit and use child soldiers</quote> and inserting <quote>recruit or use child soldiers</quote>;</text></subparagraph></paragraph><paragraph id="id31f5600f5ef341b1a4ef3de9553261a7"><enum>(2)</enum><text>in subsection (b), by amending paragraph (2) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="id12ed32b874e640539a72b8a9b1c05025" reported-display-style="italic" style="OLC"><paragraph id="id3f9819634c8d4bbfa270b86d84a53386"><enum>(2)</enum><header>Notification</header><subparagraph id="id75c552a508c84f84b676cf033814e92b"><enum>(A)</enum><header>In general</header><text>Not later than 45 days after the date on which each report is submitted under section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>), the Secretary of State shall formally notify each government included in the list under paragraph (1) that such government is included in such list.</text></subparagraph><subparagraph id="id9a8f3893813a4e619928b35917ecfc4d"><enum>(B)</enum><header>Congressional notification</header><text>As soon as practicable after making all of the notifications required under subparagraph (A) with respect to a report, the Secretary of State shall notify the appropriate congressional committees that the requirements of subparagraph (A) have been met.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idd5a3c89db471496195b4ecadc45f8089"><enum>(3)</enum><text>in subsection (c)(1), by inserting before the period at the end the following: <quote>and certifies to the appropriate congressional committees that the government of such country is taking effective and continuing steps to address the problem of child soldiers</quote>; and</text></paragraph><paragraph id="id988b8c3ff9624c7791da621c78ec6485"><enum>(4)</enum><text>in subsection (e)(1), in the matter preceding subparagraph (A), by striking <quote>to a country</quote> and all that follows through <quote>subsection (a)</quote> and inserting <quote>under section 541 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2347">22 U.S.C. 2347</external-xref>) through the Defense Institute for International Legal Studies or the Center for Civil-Military Relations at the Naval Post-Graduate School, and may provide nonlethal supplies (as defined in section 2557(d)(1)(B) of title 10, United States Code), to a country subject to the prohibition under subsection (a)</quote>.</text></paragraph></subsection><subsection id="id5af167ffcbe7456aaad89747a623a2de"><enum>(c)</enum><header>Reports</header><text>Section 405 of the Child Soldiers Prevention Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/22/2370c-2">22 U.S.C. 2370c–2</external-xref>) is amended—</text><paragraph id="id60572d8035454e22ae35eaa9510348f4"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="id266b92189e7142f58abb1e3c5294d040"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="id7F97E11EB66E45C6979DD20CA7B29DDF"><enum>(i)</enum><text>by striking <quote>, during any of the 5 years following the date of the enactment of this Act,</quote>; and</text></clause><clause id="id8B756B4AC22740A0B23964A93DF72EEE"><enum>(ii)</enum><text>by striking <quote>wavier</quote> and inserting <quote>waiver</quote>;</text></clause></subparagraph><subparagraph id="idab85b79fcb47457589e13bf1cdddc46a"><enum>(B)</enum><text>by redesignating paragraphs (2), (3), and (4) as paragraphs (3), (4), and (5), respectively;</text></subparagraph><subparagraph id="id8746ff26887e43c88994f85e0cd23d79"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="idfd144778d66f40b2b81869aa3b1da8da" reported-display-style="italic" style="OLC"><paragraph id="id177073ba240f4516ad8055baab64cdeb"><enum>(2)</enum><text>a description and the amount of any assistance withheld under this title pursuant to the application to those countries of the prohibition in section 404(a);</text></paragraph><after-quoted-block>; and</text></subparagraph></paragraph><paragraph id="idf3a3180198004ca2b078559d3612aa63"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block changed="added" display-inline="no-display-inline" id="id798ba92aeeb04a979b68c4190e0651e9" reported-display-style="italic" style="OLC"><subsection id="id392db92b34874b56b7688d7003e34c58"><enum>(d)</enum><header>Information to be included in annual trafficking in persons report</header><text>If the Secretary of State notifies a country pursuant to section 404(b)(2), or the President grants a waiver pursuant to section 404(c)(1), the Secretary of State shall include, in each report required under section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>), the information required to be included in the annual report to Congress under paragraphs (1) through (5) of subsection (c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD5EAE39F3E0C40FFBE20B28428F5FD25"><enum>(d)</enum><header>Elimination of child sexual assault by Afghan security forces</header><paragraph id="id1B176E25A9FE4FE2A064276027114809"><enum>(1)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Department of State and the Department of Defense should fully implement the recommendations in the Special Inspector General for Afghanistan Reconstruction’s 2017 report on Child Sexual Assault in Afghanistan.</text></paragraph><paragraph id="idA695DD672E9546D9A38FC240E09F4D5E"><enum>(2)</enum><header>Report on status of implementation of recommendations</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State and the Secretary of Defense shall report to the appropriate congressional committees on the status of implementation, within their respective departments, of each recommendation included in the report referenced in paragraph (1).</text></paragraph><paragraph id="idF451B65A6C4E4B31A3002AF755E26173"><enum>(3)</enum><header>Report on interagency efforts to monitor abuses</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of State and the Secretary of Defense shall report to the appropriate congressional committees on the status of interagency efforts to establish effective, coherent, and discrete reporting by United States personnel on child sexual abuse by Afghan security forces with whom they train or advise or to whom they provide assistance.</text></paragraph><paragraph id="idDF093E4CC23E42F0B5AD7E7A8FB677E6"><enum>(4)</enum><header>Prioritization at Ministerial Conference on Afghanistan</header><text>The Department of State shall ensure that the issue of child sexual assault by Afghan security forces is incorporated and elevated as an issue of international concern and focus at the next Ministerial Conference on Afghanistan, scheduled for November 27-28, 2018, in Geneva, Switzerland, with the goal of ending the illegal but ongoing practice known as <quote>bacha bazi</quote>.</text></paragraph><paragraph id="id0863D2DEE05B428C98272A03E8ECEE99"><enum>(5)</enum><header>Appropriate congressional committees defined</header><text>In this subsection, the term <term>appropriate congressional committees</term> means—</text><subparagraph id="id56918952906746679E7B446EFCECF356"><enum>(A)</enum><text>the Committee on Foreign Relations and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="id6D1FB1EEF19A4BEC800A69B304C03EF6"><enum>(B)</enum><text>the Committee on Foreign Affairs and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph></subsection></section></subtitle></title><title id="id50872d19e281433aae39eb91f4fab472"><enum>III</enum><header>Authorization of appropriations</header><section id="idbf25e619595649468bed93cb83b06067"><enum>301.</enum><header>Authorization of appropriations under the Trafficking Victims Protection Act of 2000</header><text display-inline="no-display-inline">Section 113 of the Trafficking Victims Prevention Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7110">22 U.S.C. 7110</external-xref>) is amended—</text><paragraph id="ide03e2c638c8a4da4bf371afbd4af968e"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="iddf8b43b71c394c14be996e3d4e2b6e46" reported-display-style="italic" style="OLC"><subsection id="id6bc1a61046f44e28b7f4d7bfb809ab7e"><enum>(a)</enum><header>Authorization of appropriations in support of the task force</header><text>There are authorized to be appropriated to the Department of State, for each of the fiscal years 2018 through 2021, $13,822,000 for Diplomatic and Consular Programs of the Office to Monitor and Combat Trafficking in Persons, which shall be used to carry out sections 105(e), 105(f), and 110, including for additional personnel.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id928E2FA209864949B978113BDA0CE1C2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking <quote>$14,500,000 for each of the fiscal years 2014 through 2017</quote> and inserting <quote>$19,500,000 for each of the fiscal years 2018 through 2021, of which $3,500,000 is authorized to be appropriated for each fiscal year for the National Human Trafficking Hotline.</quote>;</text></paragraph><paragraph id="id8fde16e5bbe946ad9c5bcbed19f6c722"><enum>(3)</enum><text>in subsection (c), by amending paragraph (1) to read as follows:</text><quoted-block changed="added" display-inline="no-display-inline" id="id77AC2D91A8534842A5662035C916D773" reported-display-style="italic" style="OLC"><paragraph id="idfb7fa0734ecb4723bdcd5f29ed2df069"><enum>(1)</enum><header>Assistance to combat trafficking</header><text>There are authorized to be appropriated to the Department of State, for each of the fiscal years 2018 through 2021, $65,000,000, which shall be used—</text><subparagraph id="id17f793a1c84349eea00941827beca887"><enum>(A)</enum><text>to carry out sections 106 and 107(a);</text></subparagraph><subparagraph id="id8be215c761fb4af2b41bf31c20b75ff3"><enum>(B)</enum><text>to carry out section 134 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2152d">22 U.S.C. 2152d</external-xref>);</text></subparagraph><subparagraph id="id8c3ae9bb706f45f7aff4b10723df2696"><enum>(C)</enum><text>to assist countries in meeting the minimum standards described in section 108; and</text></subparagraph><subparagraph id="id19f2f93ac8fa405096d95c367d99744e"><enum>(D)</enum><text>for programs and activities on prevention, protection, and prosecution to combat all forms of trafficking in persons internationally, including training activities for law enforcement officers, prosecutors, and members of the judiciary with respect to trafficking in persons at the International Law Enforcement Academies.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id661598ddace541cd944fa1046c56d3aa"><enum>(4)</enum><text>in subsection (f), by striking <quote>2014 through 2017</quote> and inserting <quote>2018 through 2021.</quote>.</text></paragraph></section><section id="idef90770556464620963dbb34056eb977"><enum>302.</enum><header>Authorization of appropriations under the International Megan’s Law</header><text display-inline="no-display-inline">Section 11 of the International Megan’s Law to Prevent Child Exploitation and Other Sexual Crimes Through Advanced Notification of Traveling Sex Offenders (<external-xref legal-doc="usc" parsable-cite="usc/34/21509">34 U.S.C. 21509</external-xref>) is amended by striking <quote>2017 and 2018</quote> and inserting <quote>2018 through 2021</quote>.</text></section><section id="idafb1d1ce88f14e9b9ef3b60dc266d734"><enum>303.</enum><header>Authorization of appropriations for airport personnel training to identify and report human
 trafficking victims</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Commissioner of U.S. Customs and Border Protection $250,000 for each of the fiscal years 2018 through 2021 to expand outreach and live on-site anti-trafficking training for airport and airline personnel.</text></section></title></legis-body></amendment-block></amendment></engrossed-amendment-body><attestation><attestation-group><attestor></attestor><role>Secretary</role></attestation-group></attestation><endorsement></endorsement></amendment-doc>
