<official-title display="yes">To provide priority under certain federally assisted housing programs to assist youths who are aging out of foster care, and for other purposes.<pagebreak/></official-title>

<section id="H152D541BFA1E41048E91A88840F4E779" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fostering Stable Housing Opportunities Act of 2018</short-title></quote>.</text> </section> <section id="HBC07FAF2ABA842B087EA3D22E288B378"><enum>2.</enum><header>Definition of family</header><text display-inline="no-display-inline">Subparagraph (A) of section 3(b)(3) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(3)(A)</external-xref>) is amended—</text> 
<paragraph id="H8ED326C6951142DAAF2014615B1C5082"><enum>(1)</enum><text>in the first sentence—</text> <subparagraph id="HC6D536D578ED45F89C6EE0A3A5223208"><enum>(A)</enum><text>by striking <quote>(v)</quote> and inserting <quote>(vi)</quote>; and</text> </subparagraph>
<subparagraph id="H7D0CAEC35A124A8A9DE4610FF1840D78"><enum>(B)</enum><text>by inserting after <quote>tenant family,</quote> the following: <quote>(v) a child who is in foster care and has attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months,</quote>; and</text> </subparagraph></paragraph> <paragraph commented="no" id="H3F26D2151D9E44E588904A1414FFC247"><enum>(2)</enum><text>in the second sentence, by inserting <quote>or (vi)</quote> after <quote>clause (v)</quote>.</text> </paragraph></section>
<section id="HFEDB10E62EFD4F509DC039BAA2ADD7B5" section-type="subsequent-section"><enum>3.</enum><header>Priority for public housing occupancy and section 8 assistance</header> 
<subsection id="H64EF41A829844B5D9B65945505135B28"><enum>(a)</enum><header>Public housing</header><text display-inline="yes-display-inline">Subparagraph (A) of section 6(c)(4) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437d">42 U.S.C. 1437d(c)(4)(A)</external-xref>) is amended—</text> <paragraph id="HE6B5E5DF85B54F53B480C7DD31CE9C8C"><enum>(1)</enum><text>by striking <quote>may establish a system for making dwelling units available that provides preference</quote> and inserting the following:</text> 
<quoted-block changed="added" committee-id="HBA00" display-inline="yes-display-inline" id="H646DA342D33548219218DC3CB223A4E0" reported-display-style="italic" style="OLC"> <text>shall establish a system for making dwelling units available that—</text> <clause id="H2AA5434F8BB442A59787E33674371652"><enum>(i)</enum><text display-inline="yes-display-inline">shall provide preferences</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H6656854B16AD4782B2E66B884256DCC7"><enum>(2)</enum><text>by striking <quote>each system of preferences established pursuant to this subparagraph shall be based</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H0787131C27FC40DBB62DC4C2B8EAA6CB" reported-display-style="italic" style="OLC"> <clause id="H0A7EFFC8D9134614869822F0ACA89EF2"><enum>(ii)</enum><text display-inline="yes-display-inline">except as provided in clause (iii), shall be based</text></clause><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H886D918CBDC24CC789180AE86EF88A6B"><enum>(3)</enum><text>by adding at the end the following new clause:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H9FB413F0F1CB4244AB9010B481A190BE" reported-display-style="italic" style="OLC"> <clause id="H22961C35EE8D4C3A84EBC539DA4F785B"><enum>(iii)</enum><text display-inline="yes-display-inline">except for projects or portions of projects designated for occupancy pursuant to section 7(a), shall provide that the highest preference for occupancy shall be given to otherwise eligible children who are in foster care, have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months, meet the requirements under clauses (i) and (ii) of paragraph (1) of the definition of <quote>at risk of homelessness</quote> in section 91.5 of the Secretary’s regulations (24 C.F.R. 91.5), as in effect on September 1, 2016, and have agreed to comply with the requirements under section 39(c); and</text> </clause>
<clause id="H547E7ADC571B4BC4A05F788657572EE3"><enum>(iv)</enum><text>may provide highest preference for occupancy to, in addition to eligible children described in clause (iii), not more than two other types of families.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H36E43D3BAC8F43FB85870CC3F0E236C0"><enum>(b)</enum><header>Voucher assistance</header><text>Subparagraph (A) of section 8(o)(6) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(6)(A)</external-xref>) is amended—</text> 
<paragraph id="H7F2B023F95A6426EA9DBCFD9AD912DEA"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>may</quote> the first place such term appears and inserting <quote>shall</quote>;</text> </paragraph> <paragraph id="H4906E6F7C1554C9A838A5DFDAAC20C29"><enum>(2)</enum><text>by redesignating clause (ii) as clause (iii);</text> </paragraph>
<paragraph id="H0EC33B39E3C744F4ABA89AC44B48075F"><enum>(3)</enum><text>by inserting before clause (iii), as so redesignated by paragraph (1) of this subsection, the following new clause:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H79D3CA1F9B084735903328A4F84D76AE" reported-display-style="italic" style="OLC"> <clause id="H441A43A7BE384A169EB46BF4029A598F"><enum>(ii)</enum><header>Highest preference</header><text display-inline="yes-display-inline">Each system of preferences established pursuant to this subparagraph—</text> 
<subclause id="H164BC0D3F44A4357B3AA7BACD6F5DBC3"><enum>(I)</enum><text display-inline="yes-display-inline">shall provide that the highest preference for assistance shall be given to otherwise eligible children who are in foster care, have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months, meet the requirements under clauses (i) and (ii) of paragraph (1) of the definition of <quote>at risk of homelessness</quote> in section 91.5 of the Secretary’s regulations (24 C.F.R. 91.5), as in effect on September 1, 2016, and have agreed to comply with the requirements under section 39(c); and</text> </subclause> <subclause id="H6230B175F2F14B00BE8B3B20B404743E"><enum>(II)</enum><text display-inline="yes-display-inline">may provide highest preference for assistance to, in addition to eligible children described in subclause (I), not more than two other types of eligible families.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H697EC903ED7045C7A772674DA08E4332"><enum>(4)</enum><text display-inline="yes-display-inline">in clause (iii), as so redesignated by paragraph (2) of this subsection, by striking <quote>Each system</quote> and inserting <quote>Except as provided in clause (ii)(I), each system</quote>.</text> </paragraph></subsection> <subsection id="H37CD09265C2A498C951DE89CB8AF95EF"><enum>(c)</enum><header>PHA project-based voucher assistance</header><text>Subparagraph (J) of section 8(o)(13) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(13)(J)</external-xref>) is amended—</text> 
<paragraph id="H1A513E0798444EC8B0F385FAA8549791"><enum>(1)</enum><text>by striking <quote>(J) <header-in-text level="subparagraph" style="OLC">Tenant selection</header-in-text>.—A public</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H7A631502B9544192A2F2F1E79DB83F19" reported-display-style="italic" style="OLC"> <subparagraph id="H61276BE93B3F4342B87D1C088420A2EE"><enum>(J)</enum><header>Tenant selection</header> <clause id="H7A418FAD27FE4F9C8E4B129053BC03D7"><enum>(i)</enum><header>Selection and eligibility</header><text display-inline="yes-display-inline">A public</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H88193A0A3AD2419199CB4917777ACD23"><enum>(2)</enum><text>by striking <quote>The agency or owner may establish preferences or criteria for selection for a unit assisted under this paragraph that</quote> and inserting the following:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H14FD3D48CD964E9D811A8953CCB9348F" reported-display-style="italic" style="OLC"> <clause id="H4A3D24F417F8407A8DF1C3C283111BDF"><enum>(ii)</enum><header>Preferences for occupancy</header><text display-inline="yes-display-inline">The agency or owner shall establish a system of preferences or criteria for selection for a unit assisted under this section that—</text> 
<subclause id="HB29755564FF949898F51237B44175B78"><enum>(I)</enum><text>shall provide that the highest preference shall be given to otherwise eligible children who are in foster care, have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months, meet the requirements under clauses (i) and (ii) of paragraph (1) of the definition of <quote>at risk of homelessness</quote> in section 91.5 of the Secretary’s regulations (24 C.F.R. 91.5), as in effect on September 1, 2016, and have agreed to comply with the requirements under section 39(c); and</text> </subclause> <subclause id="HD7EBD4EB34F349B7BF1D580BD3BE5745"><enum>(II)</enum><text display-inline="yes-display-inline">may provide highest preference to, in addition to eligible children described in subclause (I), not more than two other types of eligible families; and</text> </subclause>
<subclause id="H64BE03B2DBCA44A5A5CA188D7D06DB8A"><enum>(III)</enum><text>except as provided under subclause (I),</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> <paragraph id="HA7839C30C2A2412993A165628EE88286"><enum>(3)</enum><text>by striking <quote>Any family that</quote> and inserting the following:</text> 
<quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H4301206289FA40A8A02E810BB4E5FCB4" reported-display-style="italic" style="OLC"> 
<clause id="HE02A8DA04B754206890B2922A0943319"><enum>(iii)</enum><header>Waiting lists</header><text display-inline="yes-display-inline">Any family that</text></clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H25AF5F49138943AE8FCB32B269F351FA"><enum>(d)</enum><header>Project-based section 8 rental assistance</header><text display-inline="yes-display-inline">Subparagraph (A) of section 8(d)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(d)(1)(A)</external-xref>) is amended—</text> 
<paragraph id="HEEB040A81E9E42D28C4DAD78A01415B3"><enum>(1)</enum><text>by realigning such subparagraph so as to be indented 2 ems from the left margin;</text> </paragraph> <paragraph id="H049635B818404B5FBAFF8CBF0FFF36EE"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>except that with respect</quote> and inserting the following:</text> 
<quoted-block changed="added" committee-id="HBA00" display-inline="yes-display-inline" id="HAC00E199AF484A9C80D1C99719F6542D" reported-display-style="italic" style="OLC"> <text>except that—</text> <clause id="HE92D064984FE4B2486D7346262C4FFA9" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to assisted dwelling units in a project assisted with project-based assistance under this section, the tenant selection criteria used by the owner—</text> 
<subclause id="H3A9028ED4AAE40F58D3FFC8987DE6030"><enum>(I)</enum><text>shall provide that the highest preference shall be given to otherwise eligible children who are in foster care, have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months, meet the requirements under clauses (i) and (ii) of paragraph (1) of the definition of <quote>at risk of homelessness</quote> in section 91.5 of the Secretary’s regulations (24 C.F.R. 91.5), as in effect on September 1, 2016, and have agreed to comply with the requirements under section 39(c); and</text> </subclause> <subclause id="H3ABC85CF09014F7F998A801BC550C7BB"><enum>(II)</enum><text display-inline="yes-display-inline">may provide highest preference to, in addition to eligible children described in subclause (I), not more than two other types of eligible families; and</text> </subclause></clause>
<clause id="H5004B09FAA3D4A0EA587C96A75A13A8E" indent="up1"><enum>(ii)</enum><text>with respect</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> <paragraph id="HB2BBD4B307904C1BB3897DA668A39880"><enum>(3)</enum><text>by inserting <quote>who are not eligible for highest preference pursuant to clause (i)(I)</quote> after <quote>to be assisted</quote>.</text> </paragraph></subsection>
<subsection id="HD2555CCFF22D4FAC887A105A2BB7A5A4"><enum>(e)</enum><header>Terms and conditions on priority</header><text>Title I of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437">42 U.S.C. 1437</external-xref> et seq.) is amended by adding at the end the following new section:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="HB86CEA7A9FD94540838E2FF89383716E" reported-display-style="italic" style="OLC"> <section id="HE822638BDE7640E788F61BA6AF2D555B"><enum>39.</enum><header>Terms and conditions on preference for assistance for children aging out of foster care</header> <subsection id="HF5A5056154F840108F607F10FE162675"><enum>(a)</enum><header>Preference</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>preference for housing assistance</quote> means preference, for an otherwise eligible child in foster care, for—</text> 
<paragraph id="H2E51E9DF3144414BA79A80C875E7F342"><enum>(1)</enum><text>occupancy in a public housing dwelling unit, pursuant to section 6(c)(4)(A)(iii);</text> </paragraph> <paragraph id="H3C2D34B064CC474FBA1E12E9CC48FC28"><enum>(2)</enum><text>tenant-based assistance under section 8(o), pursuant to paragraph (6)(A)(ii)(I) of such section;</text> </paragraph>
<paragraph id="H559AF4FF5C1543428C45DD63CCBDBF9E"><enum>(3)</enum><text>project-based assistance under section 8(o)(13), pursuant to subparagraph (J)(ii)(I) of such section; and</text> </paragraph> <paragraph id="H4C1FE1E6FCE841DE9FCD2FA90BB34121"><enum>(4)</enum><text>occupancy in a dwelling unit in a project assisted with project-based assistance under section 8, pursuant to subsection (d)(1)(A)(i)(I) of such section.</text> </paragraph></subsection>
<subsection id="HBF3D53D57BDA48C487CC1FFAC71E23C5"><enum>(b)</enum><header>Early application for assistance</header><text display-inline="yes-display-inline">Notwithstanding the period during which a preference for housing assistance is provided for a person, an otherwise eligible person may apply for such occupancy or assistance at any time after such person attains 16 years of age.</text> </subsection> <subsection id="HA73FA39044BA40AD9C4614628C551362"><enum>(c)</enum><header>Requirement for education or training</header> <paragraph id="H4A7AE7F494724F759167139C52742D8E"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), each person occupying a dwelling unit pursuant to a preference for housing assistance shall, not later than 30 months after such initial occupancy, comply with the requirements under one of the following subparagraphs, as selected by the public housing agency for or project owner of the assisted housing dwelling unit involved, in consultation with relevant public child welfare agencies:</text> 
<subparagraph id="H676023DE35A84491BD9A18756D87FBE1"><enum>(A)</enum><header>Option 1</header><text>The requirements under this subparagraph are—</text> <clause id="H21F656E743464AB7AD07462A395149EE"><enum>(i)</enum><text display-inline="yes-display-inline">obtaining a recognized postsecondary credential or a secondary school diploma or its recognized equivalent;</text> </clause>
<clause id="HE53B22E5846F40B285E8A542E707F261"><enum>(ii)</enum><text display-inline="yes-display-inline">enrollment in an institution of higher education, as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>) and including the institutions described in subparagraphs (A) and (B) of section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)(1)</external-xref>); or</text> </clause> <clause id="H984B87B6CD77412BA29BCBA8B9672466"><enum>(iii)</enum><text display-inline="yes-display-inline">participation in a career pathway, as such term is defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text> </clause><continuation-text continuation-text-level="subparagraph">Notwithstanding any other provision of this paragraph, a public housing agency or project owner may consider employment as satisfying the requirements under this subparagraph.</continuation-text></subparagraph>
<subparagraph id="HBB31C4197FCA46F09B24DDB29E255559"><enum>(B)</enum><header>Option 2</header><text>The requirements under this subparagraph are compliance with the terms and conditions applicable under section 23 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437u">42 U.S.C. 1437u</external-xref>) and the regulations implementing such section to a person participating in a family self-sufficiency program under such section, except that—</text> <clause id="H548CD9F2074447F38382A8270B85D11B"><enum>(i)</enum><text>a public housing agency may select the option under this subparagraph only if the agency is participating in such self-sufficiency program or has made such commitments to commence participation as the Secretary considers sufficient; and</text> </clause>
<clause id="H18B16E75B5A04F4382FC965A620AF88D"><enum>(ii)</enum><text display-inline="yes-display-inline">a project owner of assisted housing may select the option under this subparagraph only if the public housing agency in whose jurisdiction the project is located is participating in such self-sufficiency program or has made such commitments to commence participation as the Secretary considers sufficient.</text> </clause></subparagraph> <subparagraph id="H7A05831D0CD54384B1B29AC856896F40"><enum>(C)</enum><header>Option 3</header><text display-inline="yes-display-inline">The requirements under this subparagraph are compliance with any combination of the terms, conditions, and requirements under subparagraphs (A) and (B), as may be established by the public housing agency, except that a project owner of assisted housing may select the option under this subparagraph only if the public housing agency in whose jurisdiction the project is located has selected the option under this subparagraph and has established such terms, conditions, and requirements. In designing such terms, conditions, and requirements, the public housing agency may consult with local workforce development agencies and other organizations and entities with expertise and experience in this field.</text> </subparagraph></paragraph>
<paragraph id="H43EE93157F6D4DDE857CDEEE11CA4F4B"><enum>(2)</enum><header>Exceptions</header><text>The requirement under paragraph (1) shall not apply to—</text> <subparagraph id="H371D83ECF11947B1A64130C208A4FD27"><enum>(A)</enum><text>a parent or other household member responsible for the care of a dependent child under the age of 6 or for the care of an incapacitated person;</text> </subparagraph>
<subparagraph id="H99FCAE7E8A0049929258EC66C0E3F16B"><enum>(B)</enum><text>a person who is regularly and actively participating in a drug addiction or alcohol treatment and rehabilitation program; and</text> </subparagraph> <subparagraph id="H5DB33B63F8FC4D44956F6D7AC1457BF9"><enum>(C)</enum><text display-inline="yes-display-inline">a person who is incapable of complying with the requirement under paragraph (1) due to a documented medical condition.</text> </subparagraph></paragraph>
<paragraph id="H682100EC48B145DAA45F2D7153A6C952"><enum>(3)</enum><header>Verification of compliance</header><text>The Secretary shall require the public housing agency or project owner, as applicable, to verify compliance with the requirement under paragraph (1) by each person occupying a dwelling unit assisted or administered by such agency or owner, as applicable, pursuant to a preference for housing assistance annually in conjunction with reviews of income for purposes of determining eligibility for assistance described in subsection (a).</text> </paragraph></subsection> <subsection id="HBC656EF960844AB5A86BE8AEF3DD9DB1"><enum>(d)</enum><header>Limitation on bedrooms</header><text display-inline="yes-display-inline">A dwelling unit that is occupied by a person, or assisted with assistance made available on behalf of a person, pursuant to a preference for housing assistance may contain more than one bedroom only if such additional bedrooms are occupied only by other persons who occupy such dwelling unit, or receive assistance made available, pursuant to a preference for housing assistance.</text> </subsection>
<subsection id="H64CD423733CC4C079F564D783E4FA2CB"><enum>(e)</enum><header>Supportive services</header> 
<paragraph id="H218AE060565E4579B9423BFDB36122C0"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Each person occupying a dwelling unit pursuant to a preference for housing assistance shall be eligible for any supportive services (as such term is defined in section 103 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)) made available, in connection with any housing assistance program of the agency, by or through the public housing agency providing such preference or, in the case of a preference for housing assistance for housing not assisted by such agency, by or through the public housing agency in whose jurisdiction the housing is located, including any services provided under a family self-sufficiency program under section 23 of this Act.</text> </paragraph> <paragraph id="HF7173F81E73143F0B3C618B190F6ED51"><enum>(2)</enum><header>Information</header><text>Upon the initial provision of housing assistance for any person pursuant to a preference for such assistance, the public housing agency or owner, as applicable, shall inform such person of the existence of any programs or services referred to in paragraph (1) and of their eligibility for such programs and services.</text> </paragraph></subsection>
<subsection id="HC0BA47EDE753424EBE64E4FB7271BFFB"><enum>(f)</enum><header>Termination of assistance</header><text>The public housing agency or project owner, as applicable, shall terminate any occupancy of, or assistance on behalf of, a person pursuant to any preference for housing assistance upon the person attaining 25 years of age or upon substantial noncompliance with the requirement under subsection (c), except that nothing in this subsection may be construed to prohibit the occupancy of housing assisted under this title by, or the provision of rental assistance under section 8 for, any person, or to affect the eligibility of any person for such occupancy or assistance, other than pursuant to a preference for housing assistance.</text> </subsection> <subsection id="H0D3A3AD53C6E46019F41EED6356A5662"><enum>(g)</enum><header>Applicability to Moving to Work agencies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the preferences for housing assistance identified in subsection (a) of this section shall apply to assistance made available by each public housing agency participating in the Moving to Work Program under section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note), except that in lieu of compliance with one of the options under subsection (c)(1) of this section, such an agency may comply with the requirement under such subsection by complying with such terms, conditions, and requirements as may be established by the agency for persons occupying dwelling units pursuant to a preference for housing assistance.</text> </subsection>
<subsection id="H977125E6C65F421594BB248E6E402C73"><enum>(h)</enum><header>Reports</header><text>The Secretary of Housing and Urban Development shall require each public housing agency that provides any preference for housing assistance pursuant to this section in any fiscal year to submit a report to the Secretary for such fiscal year that—</text> <paragraph id="H0DD203A16330494BB5C7766E217653F7"><enum>(1)</enum><text>specifies the number of applications for such preferences received during such fiscal year disaggregated by—</text> 
<subparagraph id="H93E41FD921434D679E66DD86290749AE"><enum>(A)</enum><text>the number received by persons who have attained 16 years of age but have not attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months; and</text> </subparagraph> <subparagraph id="HB7095C5096A44573B7913C483855F572"><enum>(B)</enum><text display-inline="yes-display-inline">the number received by persons who have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months;</text> </subparagraph></paragraph>
<paragraph id="H6417744B96604A7EB05FA8E0558DFC6D"><enum>(2)</enum><text>specifies the number of persons provided a preference for housing assistance during such fiscal year; and</text> </paragraph> <paragraph id="HE84C71B0CA3847448CF17DE29C72272E"><enum>(3)</enum><text display-inline="yes-display-inline">describes how the public housing agency communicated or collaborated with public child welfare agencies to collect such data.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
<section id="H417E94905E2C426CAC3ADAF2E6862B9B"><enum>4.</enum><header>Priority for rural rental assistance</header><text display-inline="no-display-inline">Paragraph (2) of section 521(a) of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490a">42 U.S.C. 1490a(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block changed="added" committee-id="HBA00" display-inline="no-display-inline" id="H645CAA36A4F8474BB60C8A765C25CDA4" reported-display-style="italic" style="OLC"> <subparagraph id="H646230CD643F4E4494F2B3DF98647C74" indent="up2"><enum>(F)</enum> <clause commented="no" display-inline="yes-display-inline" id="HF321182E1A364233962EF0483FCB3980"><enum>(i)</enum><text display-inline="yes-display-inline">In making occupancy in a project assisted under this paragraph, and rental assistance under this paragraph, available on behalf of eligible families, the project owner—</text> 
<subclause changed="added" committee-id="HBA00" id="H861235446CD0400B9BB666D458F337BE" indent="up1" reported-display-style="italic"><enum>(I)</enum><text>shall provide that the highest preference shall be given to otherwise eligible children who—</text> <item id="H10E7D8D3D3F34DA2993E5C656949BA39"><enum>(aa)</enum><text>are in foster care;</text> </item>
<item id="H0FFC0F5362624636B4919979A56108B2"><enum>(bb)</enum><text>have attained an age such that the provision of foster care for such child will end by reason of the age of the child within 6 months;</text> </item> <item id="HFBB20630C8AF4BBEA89ED3AF58E6E6D0"><enum>(cc)</enum><text display-inline="yes-display-inline">meet the requirements under clauses (i) and (ii) of paragraph (1) of the definition of <quote>at risk of homelessness</quote> in section 91.5 of the Secretary of Housing and Urban Development’s regulations (24 C.F.R. 91.5), as in effect on September 1, 2016; and</text> </item>
<item id="H144A51A56CEA497B9288FBB35D57DA09"><enum>(dd)</enum><text>have agreed to comply with the requirements under clause (iii); and</text> </item></subclause> <subclause changed="added" committee-id="HBA00" id="H5CC60816140E48B0A0F49F120936A483" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">may provide highest preference to, in addition to eligible children described in subclause (I), not more than two other types of eligible families.</text> </subclause></clause>
<clause changed="added" committee-id="HBA00" id="HF750527EDB2447B499D9BBF10AB5ED53" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>Notwithstanding the period during which a preference pursuant to clause (i)(I) for occupancy in project assisted under this paragraph or for rental assistance under this paragraph is provided for a person, an otherwise eligible person may apply for such occupancy or assistance at any time after the person attains 16 years of age.</text> </clause> <clause changed="added" committee-id="HBA00" id="HE69F56D57F704B9D84E683517F9DEE35" indent="up1" reported-display-style="italic"><enum>(iii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H68250227E5E94F7FBA51C5EB9D9488AB"><enum>(I)</enum><text>Except as provided in subclause (II), each person occupying a dwelling unit pursuant to a preference under clause (i)(I) shall, not later than 30 months after such initial occupancy, be—</text> 
<item changed="added" committee-id="HBA00" id="H15F6E5A5CF574672B551FF8B2E1938D8" indent="up1" reported-display-style="italic"><enum>(aa)</enum><text>obtaining a recognized postsecondary credential or a secondary school diploma or its recognized equivalent;</text> </item> <item changed="added" committee-id="HBA00" id="HF02312077BBA486AA3187E8726467E22" indent="up1" reported-display-style="italic"><enum>(bb)</enum><text display-inline="yes-display-inline">enrolled in an institution of higher education, as such term is defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>) and including the institutions described in subparagraphs (A) and (B) of section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)(1)</external-xref>); or</text> </item>
<item changed="added" committee-id="HBA00" id="H48A90D8C9068455AA863C3C0F4A91C27" indent="up1" reported-display-style="italic"><enum>(cc)</enum><text>participating in a career pathway, as such term is defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text> </item><continuation-text changed="added" committee-id="HBA00" continuation-text-level="subclause" indent="subsection" reported-display-style="italic">Notwithstanding any other provision of this subclause, a project owner may consider employment as satisfying the requirements under this subclause.</continuation-text></subclause> <subclause changed="added" committee-id="HBA00" id="H8D80C7BAD2D34EC181AFC9BF12E056A2" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">The requirement under subclause (I) shall not apply to—</text> 
<item id="HE15200CEB5E34C789054A5588C825BE1"><enum>(aa)</enum><text>a parent or other household member responsible for the care of a dependent child under the age of 6 or for the care of an incapacitated person;</text> </item> <item id="H52B14B78347F4E85A2E3F92741BE0D65"><enum>(bb)</enum><text>a person who is regularly and actively participating in a drug addiction or alcohol treatment and rehabilitation program; and</text> </item>
<item id="H179999E8CB204232A357A244E4138943"><enum>(cc)</enum><text>a person who is incapable of complying with the requirement under subclause (I) due to a documented medical condition.</text> </item></subclause> <subclause changed="added" committee-id="HBA00" id="HE423CC2DE17841AE83E5D1550E73AACF" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>The Secretary shall require a project owner to verify compliance with the requirement under this clause by each person occupying a dwelling unit pursuant to a preference under clause (i)(I) annually in conjunction with reviews of income for purposes of determining eligibility for assistance described in clause (i).</text> </subclause></clause>
<clause changed="added" committee-id="HBA00" id="HF4E21402823948F5B59C4BF352D647CB" indent="up1" reported-display-style="italic"><enum>(iv)</enum><text display-inline="yes-display-inline">A dwelling unit that is occupied by a person pursuant to a preference under clause (i)(I) may contain more than one bedroom only if such additional bedrooms are occupied only by other persons who occupy such dwelling unit pursuant to a preference under clause (i)(I).</text> </clause> <clause changed="added" committee-id="HBA00" id="HD61B88A92F4E48FBA3E4F22813DBC8B1" indent="up1" reported-display-style="italic"><enum>(v)</enum><text display-inline="yes-display-inline">The project owner shall terminate any occupancy of a person pursuant to the preference under clause (i)(I) upon the person attaining 25 years of age or upon substantial noncompliance with the requirement under clause (iii), except that nothing in this clause may be construed to prohibit the occupancy in a project assisted under this paragraph by, or the provision of rental assistance under this paragraph for, any person, or to affect the eligibility of any person for such occupancy or assistance, other than pursuant to a preference under clause (i)(I).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
<section id="H0CFE6E55F678483FA6A49F6E01F09302"><enum>5.</enum><header>Exceptions to limitations for project-based voucher assistance</header> 
<subsection id="H65EEC93256F34E94BC9064BEB1F86AE1"><enum>(a)</enum><header>Percentage limitation</header><text display-inline="yes-display-inline">The first sentence of clause (ii) of section 8(o)(13)(B) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(13)(B)(ii)</external-xref>) is amended by inserting before <quote>or that</quote> the following: <quote>that house eligible children described in section 6(c)(4)(A)(iii) who comply with the requirements under section 39(c),</quote>.</text> </subsection> <subsection id="HB31D76202A4F47C7B593EFFA0493DED1"><enum>(b)</enum><header>Income-mixing requirement</header><text display-inline="yes-display-inline">Subclause (I) of section 8(o)(13)(D)(ii) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(13)(D)(ii)(I)</external-xref>) is amended by inserting after <quote>elderly families</quote> the following: <quote>, to eligible children described in section 6(c)(4)(A)(iii),</quote>.</text> </subsection></section>
<section id="HC5837FBD23AC48129D20525A6EA73A82"><enum>6.</enum><header>Guidance regarding implementation</header> 
<subsection id="H1D3A3858E2A64E57809C16E4B6C841C9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development jointly with the Secretary of Agriculture, in consultation with the Secretary of Health and Human Services, shall develop guidance for public housing agencies and owners of assisted housing regarding how to correctly and efficiently implement and comply with the requirements of this Act and the amendments made by this Act and shall make such guidance available to such agencies and owners.</text> </subsection> <subsection id="H13D31403EAE4464DA4EDE96F7EBD3344"><enum>(b)</enum><header>Consultation with HHS</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development jointly with the Secretary of Agriculture shall consult with the Secretary of Health and Human Services to provide such information and guidance to the Secretary of Health and Human Services as may be necessary to facilitate such Secretary in informing States and public child welfare agencies on how to correctly and efficiently implement and comply with the requirements of this Act and the amendments made by this Act.</text> </subsection></section>
