<official-title display="yes">To amend title 44, United States Code, to require preservation of certain electronic records by Federal agencies, to require a certification and reports relating to Presidential records, and for other purposes.</official-title>

<section id="H93125426C76B4757B1ED96A137837AB3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electronic Message Preservation Act of 2017</short-title></quote>.</text> </section> <section id="H46A2EE60572A43AA9EA809580828B7C6" section-type="subsequent-section"><enum>2.</enum><header>Preservation of electronic messages and other records</header> <subsection id="HB6754A581B074DC481EFE8ED0E957AC8"><enum>(a)</enum><header>Requirement for Preservation of Electronic Messages</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">Chapter 29</external-xref> of title 44, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block display-inline="no-display-inline" id="H50648BED89B948299724CA4F7F128CAC" style="USC"> 
<section id="H2D319186AC0E494DAD514D97A2B7CB7D"><enum>2912.</enum><header>Preservation of electronic messages and other records</header> 
<subsection id="H5DBE2F5E504D49579D02D24F911CB468"><enum>(a)</enum><header>Regulations required</header><text display-inline="yes-display-inline">The Archivist shall promulgate regulations governing Federal agency preservation of electronic messages that are determined to be records. Such regulations shall, at a minimum—</text> <paragraph id="H2CD1BC5701044E278C1C5A0E60D20515"><enum>(1)</enum><text>require the electronic capture, management, and preservation of such electronic records in accordance with the records disposition requirements of chapter 33;</text> </paragraph>
<paragraph id="HF7E84B9A6FB8481CA18F4351C92D311A"><enum>(2)</enum><text>require that such electronic records are readily accessible for retrieval through electronic searches; and</text> </paragraph> <paragraph id="H979642581D6B4BB3AB89E4C29B020E6F"><enum>(3)</enum><text>include timelines for Federal agency implementation of the regulations that ensure compliance as expeditiously as practicable.</text> </paragraph></subsection>
<subsection id="HF5CABD19912B4887BBE17FBDB48FC9D8"><enum>(b)</enum><header>Ensuring compliance</header><text display-inline="yes-display-inline">The Archivist shall promulgate regulations that—</text> <paragraph id="HB10D9986F07E422CA9B8265723DD6C40"><enum>(1)</enum><text>establish mandatory minimum functional requirements for electronic records management systems to ensure compliance with the requirements in paragraphs (1) and (2) of subsection (a); and</text> </paragraph>
<paragraph id="H88F39D614D1B4FFC980B225AA61A2AB9"><enum>(2)</enum><text display-inline="yes-display-inline">establish a process to ensure that the electronic records management system of each Federal agency meets the functional requirements established under paragraph (1).</text> </paragraph></subsection> <subsection id="HDCAF471F5A2C47E08B00556A308C21A2"><enum>(c)</enum><header>Coverage of other electronic records</header><text display-inline="yes-display-inline">To the extent practicable, the regulations promulgated under subsections (a) and (b) shall also include requirements for the capture, management, and preservation of other electronic records.</text> </subsection>
<subsection commented="no" id="HB406B449000446AFA832C17397473652"><enum>(d)</enum><header>Compliance by Federal agencies</header><text display-inline="yes-display-inline">Each Federal agency shall comply with the regulations promulgated under subsections (a) and (b).</text> </subsection> <subsection id="H2886EF4CBF6E4DF0810C8433BF6CA758"><enum>(e)</enum><header>Review of regulations required</header><text display-inline="yes-display-inline">The Archivist shall periodically review and, as necessary, amend the regulations promulgated under subsections (a) and (b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="H32B271612C744AC4AD3B1E620460FEE9"><enum>(b)</enum><header>Deadline for regulations</header> 
<paragraph id="H2B89B298F90D4FAEA081D47276D9C7FB"><enum>(1)</enum><header>Preservation of electronic messages</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Archivist shall promulgate the regulations required under section 2912(a) of title 44, United States Code, as added by subsection (a).</text> </paragraph> <paragraph id="HC6C422BBDEAB45BFAEBDAC6DF32980FA"><enum>(2)</enum><header>Ensuring compliance</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Archivist shall promulgate the regulations required under section 2912(b) of title 44, United States Code, as added by subsection (a).</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HB0967F1A7D3E4B7F8146928841592A05"><enum>(c)</enum><header>Reports on implementation of regulations</header> 
<paragraph commented="no" id="H5764297E7C4D4EA9ACA7DF72F44279C0"><enum>(1)</enum><header>Agency report to Archivist</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the head of each Federal agency shall submit to the Archivist a report on the agency’s compliance with the regulations promulgated under section 2912 of title 44, United States Code, as added by subsection (a), and shall make the report publicly available on the website of the agency.</text> </paragraph> <paragraph commented="no" id="HD6B6F8C54AC84E27873CF95A0E88C9E1"><enum>(2)</enum><header>Archivist report to Congress</header><text display-inline="yes-display-inline">Not later than 90 days after receipt of all reports required by paragraph (1), the Archivist shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report on Federal agency compliance with the regulations promulgated under section 2912(a) of title 44, United States Code, as added by subsection (a), and shall make the report publicly available on the website of the agency.</text> </paragraph>
<paragraph id="H0AED03ED8FF347CC908012580A88CF68"><enum>(3)</enum><header>Federal agency defined</header><text>In this subsection, the term <term>Federal agency</term> has the meaning given that term in section 2901 of title 44, United States Code.</text> </paragraph></subsection> <subsection id="HFC66B35A49324449A8E32C780EB75779"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/29">chapter 29</external-xref> of title 44, United States Code, is amended by adding after the item relating to section 2911 the following new item:</text>

<toc-entry level="item">2912. Preservation of electronic messages and other records.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection id="HB29BF34AD6894ABEB22F73091DF400E3"><enum>(e)</enum><header>Definitions</header><text>Section 2901 of title 44, United States Code, is amended—</text> <paragraph id="H7AF27F3807FA4E3AA938DA965906AD84"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (14); and</text> </paragraph>
<paragraph id="HFA1415E173B34FEA9374325B6249557B"><enum>(2)</enum><text>by striking paragraph (15) and inserting the following new paragraphs:</text> <quoted-block display-inline="no-display-inline" id="H477C7EDC52B746909496057FF5A167CF" style="USC"> <paragraph id="HEA1FD921E66D42C59BE6A52F7F21B76C"><enum>(15)</enum><text display-inline="yes-display-inline">the term <term>electronic messages</term> means electronic mail and other electronic messaging systems that are used for purposes of communicating between individuals; and</text> </paragraph>
<paragraph id="H7CF077C5BF6A4C2D94E42D8F725538EE"><enum>(16)</enum><text>the term <term>electronic records management system</term> means software designed to manage electronic records, including by—</text> <subparagraph id="H6A7E191988814EA1815CD22D0AB1A97C"><enum>(A)</enum><text>categorizing and locating records;</text> </subparagraph>
<subparagraph id="H4709766FD255401B805E31A8A5314BD3"><enum>(B)</enum><text>ensuring that records are retained as long as necessary;</text> </subparagraph> <subparagraph id="H666D0FBA689C4D4995EA4E42170D5ACC"><enum>(C)</enum><text>identifying records that are due for disposition; and</text> </subparagraph>
<subparagraph id="H7A3AD75E647C47D9B6E0590238FA4E2F"><enum>(D)</enum><text>ensuring the storage, retrieval, and disposition of records.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section> <section id="H0E0C284F8C824373A03AAE212BC5852C"><enum>3.</enum><header>Presidential records</header> <subsection display-inline="no-display-inline" id="HF5629EE5EB3C40D2A6B55EB4000DC7CF"><enum>(a)</enum><header>Additional Regulations Relating to Presidential Records</header> <paragraph id="H76800DC54DA74B88965FF4D236AF931D"><enum>(1)</enum><header>In general</header><text>Section 2206 of title 44, United States Code, is amended—</text> 
<subparagraph id="H73073EA6014C437888691EF91EA8B919"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text> </subparagraph> <subparagraph id="HD7136265E3744209ADA530A5D2B177AD"><enum>(B)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text> </subparagraph>
<subparagraph id="H90A85C23C3714C1F974E6E0EAF1B07EA"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HB56BE745D206472A9B7C47CFECAE6C29" style="USC"> <paragraph id="H21111333959A4677883C0979E9A37249"><enum>(5)</enum><text display-inline="yes-display-inline">provisions for establishing standards necessary for the economical and efficient management of electronic Presidential records during the President’s term of office, including—</text> 
<subparagraph id="HC10B3E47151E47AD96C532EB6F31A9BC"><enum>(A)</enum><text>records management controls necessary for the capture, management, and preservation of electronic messages;</text> </subparagraph> <subparagraph id="H42EFFEA28F254FCCBE0E3D72A5DA511F"><enum>(B)</enum><text>records management controls necessary to ensure that electronic messages are readily accessible for retrieval through electronic searches; and</text> </subparagraph>
<subparagraph id="H2E7B365DAE2146BD9CC8CBF226F34C9A"><enum>(C)</enum><text>a process to ensure the electronic records management system to be used by the President for the purposes of complying with the requirements in subparagraphs (A) and (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph> <paragraph id="H6D5E0B713DB4494F95377EAB2B9B751C"><enum>(2)</enum><header>Definitions</header><text>Section 2201 of title 44, United States Code, is amended by adding at the end the following new paragraphs:</text>

<paragraph id="HDCC52026D84D486699376D79BB6AA203"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>electronic messages</term> has the meaning given that term under section 2901(15).</text> </paragraph> <paragraph id="HCE7E48E68DEB4081BBBC198A74C75C2C"><enum>(7)</enum><text>The term <term>electronic records management system</term> has the meaning given that term under section 2901(16).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection display-inline="no-display-inline" id="H8069D206F5C248AAB8FDC7AE9A6F0942"><enum>(b)</enum><header>Certification of President’s Management of Presidential Records</header> 
<paragraph id="HDC5A1FEAA71D4FD184AFF2F2CDB2F2E1"><enum>(1)</enum><header>Certification required</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">Chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following new section:</text> <quoted-block id="H2AA5685380324D6EA98363AFE4332E48" style="USC"> <section id="HC66BF3C2D04A45758BE325E970FF4001"><enum>2210.</enum><header>Certification of the President’s management of Presidential records</header> <subsection id="H50BEE0C2467546ED8E07494136F62C9F"><enum>(a)</enum><header>Annual Certification</header><text>The Archivist shall annually certify whether the electronic records management controls established by the President meet requirements under sections 2203(a) and 2206(5).</text> </subsection>
<subsection id="H4C76E6FA9C4745D3A2C435A106DC1675"><enum>(b)</enum><header>Report to Congress</header><text>The Archivist shall report annually to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives on the status of the certification.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> <paragraph id="HD215701E971649F398240EF4545ED99E"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/22">chapter 22</external-xref> of title 44, United States Code, is amended by adding at the end the following new item:</text>

<toc-entry level="item">2210. Certification of the President’s management of Presidential records. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="HF0E588933B36483DBE5F77365905CCDC"><enum>(c)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Section 2203(g) of title 44, United States Code, is amended by adding at the end the following new paragraph:</text> <quoted-block display-inline="no-display-inline" id="HAD6129F27A574162BC46F8046CEB62FE" style="USC"> <paragraph id="H89FAC1B6160A471AAC99763D4F690AB5" indent="up1"><enum>(5)</enum><text>One year following the conclusion of a President’s term of office, or if a President serves consecutive terms 1 year following the conclusion of the last term, the Archivist shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report on—</text> 
<subparagraph id="H13C2AF1FFE004CE5ACF8542A01A22321"><enum>(A)</enum><text>the volume and format of electronic Presidential records deposited into that President’s Presidential archival depository; and</text> </subparagraph> <subparagraph id="H22D77979B4BE404DAEEDBB691BF09884"><enum>(B)</enum><text>whether the electronic records management controls of that President met the requirements under sections 2203(a) and 2206(5).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
