 <section id="H45F30BCABC3E425597B1D9E8949A4727" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Utilization of Keynote Energy Act</short-title></quote>.</text> </section><section display-inline="no-display-inline" id="H9BBF064997EB4C6DAD14AB90F05D2393"><enum>2.</enum><header>Nuclear Regulatory Commission user fees and annual charges through fiscal year 2020</header> <subsection id="H25BB9E2D95B9457CBB0A1A9C15EDC66B"><enum>(a)</enum><header>In general</header><text>Section 6101(c)(2)(A) of the Omnibus Budget Reconciliation Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/2214">42 U.S.C. 2214(c)(2)(A)</external-xref>) is amended—</text>
 <paragraph id="H9AB70664EBBC4690B8DD990C75467404"><enum>(1)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text> </paragraph><paragraph id="H3EEB37F209514891A60AF13FDBEFB845"><enum>(2)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </paragraph><paragraph id="HB201C7574D2D4F90B0E0212B6F87415F"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H271E1BC88AC446309468555FF81497E1" style="OLC"> <clause id="H3BF88F33D41745C7B97B6E336F4E84CC"><enum>(v)</enum><text display-inline="yes-display-inline">amounts appropriated to the Commission for the fiscal year for activities related to the development of a regulatory infrastructure for advanced nuclear reactor technologies (which may not exceed $10,300,000).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="HF2568E52295D42C8AD2CEE2F6CCC59B1"><enum>(b)</enum><header>Repeal</header><text>Effective October 1, 2020, section 6101 of the Omnibus Budget Reconciliation Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/2214">42 U.S.C. 2214</external-xref>) is repealed.</text>
			</subsection></section><section display-inline="no-display-inline" id="H7374805D4C494C90BB3B2F3BB18DA2C5" section-type="subsequent-section"><enum>3.</enum><header>Nuclear Regulatory Commission user fees and annual charges for fiscal year 2021 and each fiscal
			 year thereafter</header>
			<subsection id="H84028659D54E478883687291D439B671"><enum>(a)</enum><header>Annual budget justification</header>
 <paragraph id="H1D3F7D7D759545DE8443F8C473A0A85E"><enum>(1)</enum><header>In general</header><text>In the annual budget justification submitted by the Commission to Congress, the Commission shall expressly identify anticipated expenditures necessary for completion of the requested activities of the Commission anticipated to occur during the applicable fiscal year.</text>
 </paragraph><paragraph commented="no" id="HA3C0E15C97544CEC9E877E2F8DDEEB28"><enum>(2)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Commission shall, to the maximum extent practicable, use any funds made available to the Commission for a fiscal year for the anticipated expenditures identified under paragraph (1) for the fiscal year.</text>
 </paragraph><paragraph id="H259A7C59A5764A0A807CAAC32478802E"><enum>(3)</enum><header>Limitation on corporate support costs</header><text>With respect to the annual budget justification submitted to Congress, corporate support costs, to the maximum extent practicable, shall not exceed the following percentages of the total budget authority of the Commission requested in the annual budget justification:</text>
 <subparagraph id="H7C0E7696AFFE4A03831438E48D79F701"><enum>(A)</enum><text>30 percent for each of fiscal years 2021 and 2022.</text> </subparagraph><subparagraph id="HC9992B0EB5EB4BE0AB0E5EAE2AE7E731"><enum>(B)</enum><text>29 percent for each of fiscal years 2023 and 2024.</text>
 </subparagraph><subparagraph id="HADB5606AD8DB4F84850501808FDE2DE0"><enum>(C)</enum><text>28 percent for fiscal year 2025 and each fiscal year thereafter.</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4B85B691AC994316B2265E4D30514E0E"><enum>(b)</enum><header display-inline="yes-display-inline">Fees and charges</header> <paragraph commented="no" display-inline="no-display-inline" id="H3F52F41789214A4183A5D7E4DCEBA93A"><enum>(1)</enum><header>Annual assessment</header> <subparagraph commented="no" display-inline="no-display-inline" id="H2C80F399C7AB480F9605E0B876127519"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each fiscal year, the Commission shall assess and collect fees and charges in accordance with paragraphs (2) and (3) in a manner that ensures that, to the maximum extent practicable, the amount assessed and collected is equal to an amount that approximates—</text>
 <clause commented="no" display-inline="no-display-inline" id="H05A660C1B13A4C57A557DBE0CA256647"><enum>(i)</enum><text display-inline="yes-display-inline">the total budget authority of the Commission for that fiscal year; less</text> </clause><clause commented="no" display-inline="no-display-inline" id="H0DAEB93CE2914E2D9E33B65F2A8033FC"><enum>(ii)</enum><text display-inline="yes-display-inline">the budget authority of the Commission for the activities described in subparagraph (B).</text>
 </clause></subparagraph><subparagraph id="HD4C33E6FA1524D1B862F251A7B5B764D"><enum>(B)</enum><header>Excluded activities described</header><text>The activities referred to in subparagraph (A)(ii) are the following:</text> <clause commented="no" id="H65B4E5F5B99B4718BB766472382E844A"><enum>(i)</enum><text display-inline="yes-display-inline">Any fee-relief activity, as identified by the Commission.</text>
 </clause><clause id="HF6B8D16F195840FEACAD8EFD4F1646E8"><enum>(ii)</enum><text>Amounts appropriated for the fiscal year to the Commission—</text> <subclause id="H712BDA8FF34A462D84F2E602CAB83E17"><enum>(I)</enum><text>from the Nuclear Waste Fund established under section 302(c) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(c)</external-xref>);</text>
 </subclause><subclause id="HE6319F36A5924A96B27A423A27BD1B34"><enum>(II)</enum><text>for implementation of section 3116 of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (<external-xref legal-doc="usc" parsable-cite="usc/50/2601">50 U.S.C. 2601</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/375">Public Law 108–375</external-xref>);</text>
 </subclause><subclause id="H5DBCAAC849654156B7F06B56B066217E"><enum>(III)</enum><text>for the homeland security activities of the Commission (other than for the costs of fingerprinting and background checks required under section 149 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2169">42 U.S.C. 2169</external-xref>) and the costs of conducting security inspections);</text>
 </subclause><subclause id="H6F4D83ED25AE4E949D96F90FD237492E"><enum>(IV)</enum><text>for the Inspector General services of the Commission provided to the Defense Nuclear Facilities Safety Board;</text>
 </subclause><subclause commented="no" id="H4F0C5347EED34355BC342887B0DB7E40"><enum>(V)</enum><text display-inline="yes-display-inline">for the partnership program with institutions of higher education established under section 244 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2015c">42 U.S.C. 2015c</external-xref>); and</text>
 </subclause><subclause commented="no" id="H46E90968A4384B9386B01A2673F41737"><enum>(VI)</enum><text display-inline="yes-display-inline">for the scholarship and fellowship programs under section 243 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2015b">42 U.S.C. 2015b</external-xref>).</text>
 </subclause></clause><clause id="H4744FBC00E6C4B40A580F23672BB14C9"><enum>(iii)</enum><text display-inline="yes-display-inline">Costs for activities related to the development of regulatory infrastructure for advanced nuclear reactor technologies (which may not exceed $10,300,000).</text>
 </clause></subparagraph><subparagraph commented="no" id="HFCF37AFA3DFB4F6F9F4B0858D4FF4055"><enum>(C)</enum><header>Exception</header><text>The exclusion described in subparagraph (B)(iii) shall cease to be effective on January 1, 2026.</text> </subparagraph><subparagraph id="H4C93D45505D949519364A3F29A50B392"><enum>(D)</enum><header>Report</header><text>Not later than December 31, 2023, the Commission shall submit to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a report describing the views of the Commission on the continued appropriateness and necessity of funding for the activities described in subparagraph (B)(iii).</text>
 </subparagraph></paragraph><paragraph id="HE80CFCD705464D2FBAFCD29F7887E208"><enum>(2)</enum><header>Fees for service or thing of value</header><text>In accordance with section 9701 of title 31, United States Code, the Commission shall assess and collect fees from any person who receives a service or thing of value from the Commission to cover the costs to the Commission of providing the service or thing of value.</text>
				</paragraph><paragraph id="H9254598A359D4D6A98F16769C950539B"><enum>(3)</enum><header>Annual charges</header>
 <subparagraph id="H4E2DE1BCC76C48619487C0181F3E1919"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B) and except as provided in subparagraph (D), the Commission may charge to any licensee or certificate holder of the Commission an annual charge in addition to the fees set forth in paragraph (2).</text>
					</subparagraph><subparagraph id="HB19C19B446E248669DF6F8E79805890B"><enum>(B)</enum><header>Cap on annual charges of certain licensees</header>
 <clause commented="no" id="H04D93D38DEE4478691FDA92D180BFA3A"><enum>(i)</enum><header>Operating reactors</header><text display-inline="yes-display-inline">The annual charge under subparagraph (A) charged to an operating reactor licensee, to the maximum extent practicable, shall not exceed the annual fee amount per operating reactor licensee established in the final rule of the Commission entitled <quote>Revision of Fee Schedules; Fee Recovery for Fiscal Year 2015</quote> (80 Fed. Reg. 37432 (June 30, 2015)), as may be adjusted annually by the Commission to reflect changes in the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor.</text>
						</clause><clause id="HBF100EA4AF8F41719EAC0A6FD3A3F6FE"><enum>(ii)</enum><header>Fuel facilities</header>
 <subclause id="H89CF15B446134997ACB2D9E84A27C457"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The total annual charges under subparagraph (A) charged to fuel facility licensees, to the maximum extent practicable, shall not exceed an amount that is equal to the total annual fees collected from the fuel facilities class under the final rule of the Commission entitled <quote>Revision of Fee Schedules; Fee Recovery for Fiscal Year 2016</quote> (81 Fed Reg. 41171 (June 24, 2016)), which amount may be adjusted annually by the Commission to reflect changes in the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor.</text>
 </subclause><subclause id="H32FAE39B7B584F4D98B446A4187DCE16"><enum>(II)</enum><header>Exception</header><text>Subclause (I) shall not apply if the number of licensed facilities classified by the Commission as fuel facilities exceeds seven.</text>
 </subclause><subclause commented="no" id="H39C3498DCC56409CBEBB4C542848150F"><enum>(III)</enum><header>Changes to annual charges</header><text display-inline="yes-display-inline">Any change in an annual charge under subparagraph (A) charged to a fuel facility licensee shall be based on—</text>
 <item commented="no" id="HC1BA2B797A854858A7A14A61A985F5AE"><enum>(aa)</enum><text>a change in the regulatory services provided with respect to the fuel facility; or</text> </item><item commented="no" id="HBA47FE47B5024D53A92F41DAD9624BE6"><enum>(bb)</enum><text>an adjustment described in subclause (I).</text>
 </item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE06E0AD3E9EE43FF9E6DDD3A000619B9"><enum>(iii)</enum><header>Waiver</header><text>The Commission may waive, for a period of 1 year, the cap on annual charges described in clause (i) or (ii) if the Commission submits to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a written determination that the cap on annual charges may compromise the safety and security mission of the Commission.</text>
						</clause></subparagraph><subparagraph id="H4AD05836F0EB44F8B8DB7DDFCDF9472C"><enum>(C)</enum><header>Amount per licensee</header>
 <clause id="HB2750FF9A2364C69A3D32C5878F9B1EA"><enum>(i)</enum><header>In general</header><text>The Commission shall establish by rule a schedule of annual charges fairly and equitably allocating the aggregate amount of charges described in clause (ii) among licensees and certificate holders.</text>
 </clause><clause commented="no" id="HE3DDF5C337194CB39D538914C0D48A5A"><enum>(ii)</enum><header>Aggregate amount</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the aggregate amount of charges for a fiscal year shall equal an amount that approximates—</text>
 <subclause commented="no" id="H6A3B6958A8B74D46BF170E536D2CE44D"><enum>(I)</enum><text>the amount to be collected under paragraph (1)(A) for the fiscal year; less</text> </subclause><subclause commented="no" id="HE582D9900619455AA476BA83B020F895"><enum>(II)</enum><text>the amount of fees to be collected under paragraph (2) for the fiscal year.</text>
 </subclause></clause><clause id="H4E25D000199D4130B99B6A28AF1A2BBC"><enum>(iii)</enum><header>Requirement</header><text>The schedule of charges under clause (i)—</text> <subclause id="H127B09DAAF2C41ADB2869B8F63EAA10C"><enum>(I)</enum><text>to the maximum extent practicable, shall be reasonably related to the cost of providing regulatory services; and</text>
 </subclause><subclause id="H08E65E544F234BB89F01A602004CE0DD"><enum>(II)</enum><text>may be based on the allocation of the resources of the Commission among licensees or certificate holders or classes of licensees or certificate holders.</text>
 </subclause></clause></subparagraph><subparagraph id="HED4948C0AAB74CD1A2ED41B26D5B9DC9"><enum>(D)</enum><header>Exemption</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to the holder of any license for a federally owned research reactor used primarily for educational training and academic research purposes.</text>
					</subparagraph></paragraph></subsection><subsection id="HD72099EABD494704912B962946CBCADD"><enum>(c)</enum><header>Performance and reporting</header>
 <paragraph id="HC93BEBA8DC2E4D8999C90F95F7581DA2"><enum>(1)</enum><header>In general</header><text>The Commission shall develop for the requested activities of the Commission—</text> <subparagraph id="H5E0E1F55946E40109281FCC308544154"><enum>(A)</enum><text>performance metrics; and</text>
 </subparagraph><subparagraph commented="no" id="HE0A04018B6F64553A631C23FA5AD7638"><enum>(B)</enum><text>milestone schedules.</text> </subparagraph></paragraph><paragraph commented="no" id="H384F084229A94A8CA99FB5F348D41D79"><enum>(2)</enum><header>Delays in issuance of final safety evaluation</header><text>If the final safety evaluation for a requested activity of the Commission is not completed by the completion date required by the performance metrics or milestone schedule under paragraph (1), the Executive Director for Operations of the Commission shall, not later than 30 days after such required completion date, inform the Commission of the delay.</text>
 </paragraph><paragraph id="HAE34238AD68A4921AC7C00899CE31487"><enum>(3)</enum><header>Delays in issuance of final safety evaluation exceeding 180 days</header><text display-inline="yes-display-inline">If a final safety evaluation described in paragraph (2) is not completed by the date that is 180 days after the completion date required by the performance metrics or milestone schedule under paragraph (1), the Commission shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a timely report describing the delay, including a detailed explanation accounting for the delay and a plan for timely completion of the final safety evaluation.</text>
 </paragraph></subsection><subsection id="HA3DF4ED917F243CFA2AB00B85F9AB199"><enum>(d)</enum><header>Accurate invoicing</header><text>With respect to invoices for fees charged under subsection (b)(2), the Commission shall—</text> <paragraph id="H0888FBB151F748859A9897C9832ED260"><enum>(1)</enum><text>ensure appropriate review and approval prior to the issuance of invoices;</text>
 </paragraph><paragraph id="H41FF3874BE154D12BC1FA17A7C1B3F16"><enum>(2)</enum><text>develop and implement processes to audit invoices to ensure accuracy, transparency, and fairness; and</text>
 </paragraph><paragraph id="HF2EDF660DA7A4F318CCAA7CE243CC9BC"><enum>(3)</enum><text>modify regulations to ensure fair and appropriate processes to provide licensees and applicants an opportunity to efficiently dispute or otherwise seek review and correction of errors in invoices for such fees.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAFFCBD8B5D60463B99F2EBD17CF58CD4"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than September 30, 2022, the Commission shall submit to the Committee on Appropriations and the Committee on Environment and Public Works of the Senate and the Committee on Appropriations and the Committee on Energy and Commerce of the House of Representatives a report describing the implementation of this section, including any effects of such implementation and recommendations for improvement.</text>
 </subsection><subsection display-inline="no-display-inline" id="H6A692B6DF9F4490CB1086BCE04097E81"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H62590BDACF1D4E70A70B5CD1C835E534"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> means a nuclear fission or fusion reactor, including a prototype plant (as defined in sections 50.2 and 52.1 of title 10, Code of Federal Regulations), with significant improvements compared to commercial nuclear reactors under construction as of the date of enactment of this Act, including improvements such as—</text>
 <subparagraph id="H7EEE83D233D849E696564E5A411FB1FF"><enum>(A)</enum><text>additional inherent safety features;</text> </subparagraph><subparagraph id="HC59535F482D0472480A3D6C7B3C7C505"><enum>(B)</enum><text>significantly lower levelized cost of electricity;</text>
 </subparagraph><subparagraph id="HC7B2ADD06D92449DAEE04340201D4827"><enum>(C)</enum><text>lower waste yields;</text> </subparagraph><subparagraph id="H5997F05B32184B47A5643EBFA6F33FD6"><enum>(D)</enum><text>greater fuel utilization;</text>
 </subparagraph><subparagraph id="HF40B82AADB98487EBEFC6F988D2CF74C"><enum>(E)</enum><text>enhanced reliability;</text> </subparagraph><subparagraph id="H89F984248E2A4784814B562C629FDF19"><enum>(F)</enum><text>increased proliferation resistance;</text>
 </subparagraph><subparagraph id="H9BF99BF1341E468ABFE157097371B5C2"><enum>(G)</enum><text>increased thermal efficiency; or</text> </subparagraph><subparagraph id="H5D0C48AAD99E4F5FB35492E097686346"><enum>(H)</enum><text>ability to integrate into electric and nonelectric applications.</text>
 </subparagraph></paragraph><paragraph id="HEABC1FE66ACE4268869DA3EA8C638D1E"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2001BB9C92924E35B2CACCD75C95E5A3"><enum>(3)</enum><header>Corporate support costs</header><text>The term <term>corporate support costs</term> means expenditures for acquisitions, administrative services, financial management, human resource management, information management, information technology, policy support, outreach, and training.</text>
 </paragraph><paragraph display-inline="no-display-inline" id="H2B748D73987E44B0817A315D0C46E3FB"><enum>(4)</enum><header>Research reactor</header><text>The term <term>research reactor</term> means a nuclear reactor that—</text> <subparagraph id="H120886795C2949FFB90DCB0C0F5930B1"><enum>(A)</enum><text>is licensed by the Commission under section 104 c. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(c)</external-xref>) for operation at a thermal power level of not more than 10 megawatts; and</text>
 </subparagraph><subparagraph id="HAA2BAA1A51C640FAA866AB897402DC6F"><enum>(B)</enum><text>if so licensed for operation at a thermal power level of more than 1 megawatt, does not contain—</text> <clause id="HF8472DEF8C6C40FDB4D2C489B748AC74"><enum>(i)</enum><text>a circulating loop through the core in which the licensee conducts fuel experiments;</text>
 </clause><clause id="H9440541412AB4BE5A346DB89A4134ED9"><enum>(ii)</enum><text>a liquid fuel loading; or</text> </clause><clause id="H825AC08F853A4F46BADBC8278BD349AA"><enum>(iii)</enum><text>an experimental facility in the core in excess of 16 square inches in cross-section.</text>
 </clause></subparagraph></paragraph><paragraph id="HA786CB2C1A544AC388CAACCB433F4859"><enum>(5)</enum><header>Requested activity of the Commission</header><text>The term <term>requested activity of the Commission</term> means—</text> <subparagraph id="H59BBF8333A714D57884FB07DD700C293"><enum>(A)</enum><text>the processing of applications for—</text>
 <clause id="HBDF04197B60F42C2B6FDA3789C2E1713"><enum>(i)</enum><text>design certifications or approvals;</text> </clause><clause id="HF2CE5EF74FDD4D7EA81BED2F8539545F"><enum>(ii)</enum><text>licenses;</text>
 </clause><clause id="HF6510A8AFA0D4B02A6009F88944B0A5C"><enum>(iii)</enum><text>permits;</text> </clause><clause id="H0395A8867B26461E93D4186281CA93AF"><enum>(iv)</enum><text>license amendments;</text>
 </clause><clause id="HB0FC6D4363AC4363BC39E2759725EDF4"><enum>(v)</enum><text>license renewals;</text> </clause><clause id="HC497905F494540B082FA18B91DC7D75B"><enum>(vi)</enum><text>certificates of compliance; and</text>
 </clause><clause id="H0B767B0016B5401589EFF98FA6B3ED36"><enum>(vii)</enum><text>power uprates; and</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H40C1B1924C904617AB8ACB68135FDFC4"><enum>(B)</enum><text>any other activity requested by a licensee or applicant.</text>
 </subparagraph></paragraph></subsection><subsection id="H70B5A844998C4BEDA5520E193DC9AE76"><enum>(g)</enum><header>Effective date</header><text>This section takes effect on October 1, 2020.</text> </subsection></section><section id="H636698F85F7E402199776B6C5D4C97AB"><enum>4.</enum><header>Study on elimination of foreign licensing restrictions</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit to Congress a report containing the results of a study on the feasibility and implications of repealing restrictions under sections 103 d. and 104 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>; 2134(d)) on issuing licenses for certain nuclear facilities to an alien or an entity owned, controlled, or dominated by an alien, a foreign corporation, or a foreign government.</text>
 </section><section commented="no" id="HA8BCFAC96B1540C8A48476CE6DC102B7"><enum>5.</enum><header>Study on the impact of the elimination of mandatory hearing for uncontested licensing applications</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Comptroller General shall transmit to Congress a report containing the results of a study on the effects of eliminating the hearings required under section 189 a. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2239">42 U.S.C. 2239(a)</external-xref>) for an application under section 103 or section 104 b. of such Act for a construction permit for a facility in the absence of a request of any person whose interest may be affected by the proceeding.</text>
 </section><section id="HDE749F01158940E789F6DCAFCE8FB3A3"><enum>6.</enum><header>Informal hearing procedures</header><text display-inline="no-display-inline">Section 189 a. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2239">42 U.S.C. 2239(a)</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block id="H9E39F9507FB845639C7AEE21F5B878A2" style="OLC">
 <paragraph commented="no" id="H86E3754D9FB948D390E5386F2B9EB16F" indent="up1"><enum>(3)</enum><text>The Commission may use informal adjudicatory procedures for any hearing required under this section for which the Commission determines that adjudicatory procedures under section 554 of title 5, United States Code, are unnecessary.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="H0BA11C428AD34819BD2E87F010F1EEF5"><enum>7.</enum><header>Application reviews for nuclear energy projects</header><text display-inline="no-display-inline">Section 185 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2235">42 U.S.C. 2235</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HFC8501DCED054C479E489CB97B1C4705" other-style="nuclear" style="other">
				<subsection id="HCF5B5EDD6221463086158C87AF870897"><enum>c.</enum><header>Application reviews for nuclear energy projects</header>
 <paragraph id="H1C4726B844B341599D8713AE5550BF7F"><enum>(1)</enum><header>Streamlining license application review</header><text>With respect to an application that is docketed seeking issuance of a construction permit, operating license, or combined construction permit and operating license for a production or utilization facility, the Commission shall include the following procedures:</text>
 <subparagraph id="HA63C1A2CC3C347FDBC983C62D4B256DD"><enum>(A)</enum><text>Undertake an environmental review process and issue any draft environmental impact statement to the maximum extent practicable within 24 months after the application is accepted for docketing.</text>
 </subparagraph><subparagraph id="H9619528D1FEE47B6B1B387DDC850E1F7"><enum>(B)</enum><text>Complete the technical review process and issue any safety evaluation report and any final environmental impact statement to the maximum extent practicable within 42 months after the application is accepted for docketing.</text>
						</subparagraph></paragraph><paragraph id="H9A1E1A9BAEEF4D14819E8172CACB3909"><enum>(2)</enum><header>Early site permit</header>
 <subparagraph id="H0EC3E201011142779DFE04B336AC8193"><enum>(A)</enum><header>Supplemental environmental impact statement</header><text>In a proceeding for a combined construction permit and operating license for a site for which an early site permit has been issued, any environmental impact statement prepared by the Commission and cooperating agencies shall be prepared as a supplement to the environmental impact statement prepared for the early site permit.</text>
 </subparagraph><subparagraph id="H8A40B55B100C4EE2B4222FB9C49AA64B"><enum>(B)</enum><header>Incorporation by reference</header><text>The supplemental environmental impact statement shall—</text> <clause id="H45E16EF7157E46C789F5BA0B9B49EB48"><enum>(i)</enum><text>incorporate by reference the analysis, findings, and conclusions from the environmental impact statement prepared for the early site permit; and</text>
 </clause><clause id="HA6A58D9F957F4C8B8A6D602B815485D1"><enum>(ii)</enum><text>include additional discussion, analyses, findings, and conclusions on matters resolved in the early site permit proceeding only to the extent necessary to address information that is new and significant in that the information would materially change the prior findings or conclusions.</text>
 </clause></subparagraph></paragraph><paragraph id="HCEE55C81CA874BA28BE8C23613AF7A3D"><enum>(3)</enum><header>Production or utilization facility located at an existing site</header><text>In reviewing an application for an early site permit, construction permit, operating license, or combined construction permit and operating license for a production or utilization facility located at the site of a licensed production or utilization facility, the Commission shall, to the extent practicable, use information that was part of the licensing basis of the licensed production or utilization facility.</text>
 </paragraph><paragraph id="H0C87E965AF164B1798046FCFADE215C9"><enum>(4)</enum><header>Regulations</header><text>The Commission shall initiate a rulemaking, not later than 1 year after the date of enactment of the <short-title>Nuclear Utilization of Keynote Energy Act</short-title>, to amend the regulations of the Commission to implement this subsection.</text>
 </paragraph><paragraph commented="no" id="H6BD23F2623E14D58A464B73329BFEEA5"><enum>(5)</enum><header>Environmental impact statement defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>environmental impact statement</term> means a detailed statement required under section 102(C) of the National Environmental Policy Act of 1969 (42 U.S.C. 4332(C)).</text>
 </paragraph><paragraph commented="no" id="H83F1F05A7BFF4804B0C6AF52CC23BE2B"><enum>(6)</enum><header>Relationship to other law</header><text>Nothing in this subsection exempts the Commission from any requirement for full compliance with section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE335A94C3E2D4757B985CC08F4B9FD89"><enum>8.</enum><header>Report identifying best practices for establishment and operation of local community advisory
			 boards</header>
 <subsection id="H6E47949C6BE8477A89E46140E0940CF5"><enum>(a)</enum><header>Best practices report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Nuclear Regulatory Commission shall submit to Congress, and make publicly available, a report identifying best practices with respect to the establishment and operation of a local community advisory board to foster communication and information exchange between a licensee planning for and involved in decommissioning activities and members of the community that decommissioning activities may affect, including lessons learned from any such board in existence before the date of enactment of this Act.</text>
 </subsection><subsection id="HCEC1B15F65AC43F4852CFE481F6FC36A"><enum>(b)</enum><header>Contents</header><text>The report described in subsection (a) shall include—</text> <paragraph id="H1E942946AEEF42509EA253DE903652D0"><enum>(1)</enum><text>a description of—</text>
 <subparagraph id="H31E51656458246D8822AA97B00EB7C90"><enum>(A)</enum><text>the topics that could be brought before a local community advisory board;</text> </subparagraph><subparagraph id="H4CAA5EF80102409796923388D4FB7930"><enum>(B)</enum><text display-inline="yes-display-inline">how such a board’s input could be used to inform the decision-making processes of stakeholders for various decommissioning activities;</text>
 </subparagraph><subparagraph id="H21AF7768FE3144ABAE01C005C7C5B320"><enum>(C)</enum><text display-inline="yes-display-inline">what interaction such a board could have with the Nuclear Regulatory Commission and other Federal regulatory bodies to support the board members’ overall understanding of the decommissioning process and promote dialogue between the affected stakeholders and the licensee involved in decommissioning activities; and</text>
 </subparagraph><subparagraph id="HFF71A1C0850643B99C58754D2267AC82"><enum>(D)</enum><text display-inline="yes-display-inline">how such a board could offer opportunities for public engagement throughout all phases of the decommissioning process;</text>
 </subparagraph></paragraph><paragraph id="H884EFA6A111C43CAB7B1D3A5D551FD5B"><enum>(2)</enum><text>a discussion of the composition of a local community advisory board; and</text> </paragraph><paragraph id="HC381998184E14B99ADD0FBAD07122329"><enum>(3)</enum><text>best practices relating to the establishment and operation of a local community advisory board, including—</text>
 <subparagraph commented="no" id="H406606E7E86F40BCAC4FDD210423EDD1"><enum>(A)</enum><text display-inline="yes-display-inline">the time of establishment of such a board;</text> </subparagraph><subparagraph id="H3AB0431E5F51421F9D6168433162F0B9"><enum>(B)</enum><text>the frequency of meetings of such a board;</text>
 </subparagraph><subparagraph id="H7F7E4C78495B404DBACC9B73A80D934D"><enum>(C)</enum><text>the selection of board members;</text> </subparagraph><subparagraph id="H3D5BAE3F7C994157AB8CBE09951DC0CB"><enum>(D)</enum><text>the term of board members;</text>
 </subparagraph><subparagraph id="H1819037F4EFC44CAA985D7F88DBE70E1"><enum>(E)</enum><text display-inline="yes-display-inline">the responsibility for logistics required to support such a board’s meetings and other routine activities; and</text>
 </subparagraph><subparagraph id="H4D09B902160A47BEA3062D74A842716D"><enum>(F)</enum><text>any other best practices relating to such a local community advisory board that are identified by the Commission.</text>
 </subparagraph></paragraph></subsection><subsection id="HF2E320F6820948DAA23214C9B51DC147"><enum>(c)</enum><header>Consultation</header><text>In developing the report described in subsection (a), the Nuclear Regulatory Commission shall consult with any host State, any community within the emergency planning zone of an applicable nuclear facility, and any existing local community advisory board.</text>
 </subsection></section><section id="H7B9F641427944B00B58B369B138E26AA"><enum>9.</enum><header>Report on study recommendations</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Nuclear Regulatory Commission shall submit to Congress a report on the status of addressing and implementing the recommendations contained in the memorandum of the Executive Director of Operations of the Commission entitled <quote>Tasking in Response to the Assessment of the Considerations Identified in a <quote>Study of Reprisal and Chilling Effect for Raising Mission-Related Concerns and Differing Views at the Nuclear Regulatory Commission</quote></quote> and dated June 19, 2018 (ADAMS Accession No.: ML18165A296).</text>
