 <section changed="deleted" committee-id="SSGA00" id="HE8688DD68D7B4510920BBFF90A683C2E" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Appointee Burrowing Prevention Act</short-title></quote>.</text> </section><section changed="deleted" committee-id="SSGA00" id="H206FAA9F3F9E4DAEB6344DCB8799F0FC" reported-display-style="strikethrough"><enum>2.</enum><header>Limitation on employment of political appointees in career civil service positions</header> <subsection id="HEA99EFC5BF6A469BB817EF23476CE097"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

					<section id="H53454E1B552E49DF89A4E6FF738F746C"><enum>3115.</enum><header>Employment of political appointees </header>
						<subsection id="HF6E8B521D9504EF0BE7F68FD339CFF40"><enum>(a)</enum><header>Appointment approval required</header>
 <paragraph id="HB3E243BEC2A845B895F88585A50299B9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The head of an agency may not appoint any individual described in paragraph (5) to a career position within the agency without receiving prior written approval from the Associate Director of Merit Systems Accountability and Compliance, consistent with the requirements of this subsection.</text>
 </paragraph><paragraph id="HE505113CFFC749FF9411FDBA800B10D2"><enum>(2)</enum><header>Request</header><text display-inline="yes-display-inline">The head of an agency shall submit a request to the Associate Director to approve the appointment of any individual described in paragraph (5) to a career position. Any such request shall include certification by the head of the agency to the Associate Director that the appointment is necessary for the agency to meet its mission.</text>
 </paragraph><paragraph id="H28C8A7C09C2646589A5681C8151B283A"><enum>(3)</enum><header>Review and determination</header><text display-inline="yes-display-inline">The Associate Director shall review any request received pursuant to paragraph (2) and deny any such request unless the Associate Director determines that the appointment process with respect to the request was fair, open, and free from political influence. If the Associate Director makes that determination, the Associate Director may approve the request.</text>
 </paragraph><paragraph id="HF7B6AEA9268C487D9B2A7041AD2B3133"><enum>(4)</enum><header>Notification to Congress</header><text display-inline="yes-display-inline">With respect to any request approved under paragraph (3), the Associate Director shall, not less than five days before the date the Associate Director provides approval to the head of the requesting agency, provide to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate the agency certification under paragraph (2) and the agency head’s rationale for that certification.</text>
 </paragraph><paragraph id="H7A65A417C4CD4434A8B13C7C7BCA3C3A"><enum>(5)</enum><header>Covered individuals</header><text>An individual described in this paragraph is—</text> <subparagraph id="H45835810D4EF4CA58698AD79C5734599"><enum>(A)</enum><text>a political appointee;</text>
 </subparagraph><subparagraph id="H5A3F7924716546DF9ED1270228BFED46"><enum>(B)</enum><text>a former political appointee who held any political position during the 5-year period before the date of the request described in paragraph (2); or</text>
 </subparagraph><subparagraph id="H7C29228CE2074CD38D9C5779B7EDE120"><enum>(C)</enum><text display-inline="yes-display-inline">at the discretion of the Director of the Office of Personnel Management, a former political appointee who held any political position before the five-year period described in subparagraph (B).</text>
								</subparagraph></paragraph></subsection><subsection id="H605CDEA20960478B92642B727DD06D05"><enum>(b)</enum><header>Restriction on appointment</header>
 <paragraph id="H16E15714897F4CED8488950B1341969E"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other law, rule, or regulation, during the 2-year period following the date a political appointee leaves or departs from a political position, such appointee may not be appointed to any career position in the civil service.</text>
 </paragraph><paragraph id="H8833C370D3EB4A589A112A7D6C322C0C"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to a political appointee who has not personally and substantially participated in any particular matter while employed in a political position.</text>
 </paragraph></subsection><subsection id="HFA2A063E05A7421489319DD49DFC6769"><enum>(c)</enum><header>Application</header><text>Nothing in this section shall be construed to restrict the appointment of an individual who is—</text> <paragraph id="H966DF003EDD04B80A364038B8298F43D"><enum>(1)</enum><text>entitled to reinstatement under section 3593(b); or</text>
 </paragraph><paragraph id="H264E7051C03E405CBB27F46348336410"><enum>(2)</enum><text>eligible for reinstatement under section 3593(a).</text> </paragraph></subsection><subsection id="HA8F60E0B1E1D4032ADA94E200DEA0802"><enum>(d)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="H6235153BCF4F4B7AA6D51923D440C0AA"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>agency</quote> has the meaning given the term <quote>Executive agency</quote> in section 105;</text> </paragraph><paragraph id="HBCBF8AB48F7C4C3496B1D85153FF4853"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>Associate Director</quote> means the Associate Director of Merit Systems Accountability and Compliance at the Office of Personnel Management;</text>
 </paragraph><paragraph id="HD90A2575E577453D84625ED12F6D4C4D"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>political appointee</quote> means an individual serving in an appointment of any duration to a political position;</text> </paragraph><paragraph id="H5ED5DCB96E3B4DF490EF491A515B612A"><enum>(4)</enum><text>the term <quote>political position</quote> means—</text>
 <subparagraph id="H2E6EAB9596444F14AF253B86BC7ED3D2"><enum>(A)</enum><text display-inline="yes-display-inline">a position with respect to which appointment is made—</text> <clause id="HB065934392BF43C0B7CE50C324543BF8"><enum>(i)</enum><text>by the President; or</text>
 </clause><clause id="H5F510CBA974A4A90AE2B44971C424365"><enum>(ii)</enum><text>by the President, by and with the advice and consent of the Senate;</text> </clause></subparagraph><subparagraph id="HFE3083214CB347EB9922AE18475637B1"><enum>(B)</enum><text>a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character;</text>
 </subparagraph><subparagraph id="H6BBC24FCA5F84405A8F2B244ECB54406"><enum>(C)</enum><text>a position described under sections 5312 through 5316 (relating to the Executive Schedule); and</text> </subparagraph><subparagraph id="H749948EA841248FA9BB04FBB5E32E11E"><enum>(D)</enum><text display-inline="yes-display-inline">a general position in the Senior Executive Service during such time as it is filled by—</text>
 <clause id="HD374FB10969E42EFA40A04C53D090BA7"><enum>(i)</enum><text>a noncareer appointee, as defined in paragraph (7) of section 3132(a); or</text> </clause><clause id="H6E90A07119484AE38F1F8D6145251644"><enum>(ii)</enum><text>a limited term appointee or limited emergency appointee, as defined in paragraphs (5) and (6) of section 3132(a), who is serving under a political appointment.</text>
 </clause></subparagraph></paragraph><paragraph id="HFCD22D982CAB4613ABC6F8BCA3ACE2B1"><enum>(5)</enum><text>the term <quote>career position</quote> means—</text> <subparagraph id="HBD3E7FA1BDB24AB28B3FBAC2E8058641"><enum>(A)</enum><text display-inline="yes-display-inline">a position in the competitive service filled by career or career-conditional appointment;</text>
 </subparagraph><subparagraph id="H4AA382D636B649048A67230668777165"><enum>(B)</enum><text display-inline="yes-display-inline">a position in the excepted service filled by an appointment of equivalent tenure as a position described in subparagraph (A);</text>
 </subparagraph><subparagraph id="H8832DFA860E74852881F2684B441A203"><enum>(C)</enum><text display-inline="yes-display-inline">a career reserved position, as defined in paragraph (8) of section 3132(a), in the Senior Executive Service; or</text>
 </subparagraph><subparagraph id="H8CE107F3544F496D9B4AA5235A6DA376"><enum>(D)</enum><text>a general position in the Senior Executive Service when filled by a career appointee, as defined in section 3132(a)(4);</text>
 </subparagraph></paragraph><paragraph id="H6510B1B1F454442D8712FCA5E0E97A76"><enum>(6)</enum><text>the term <quote>participated</quote> means an action taken as an officer or employee through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or other such action; and</text>
 </paragraph><paragraph id="HC506B08CCA0E431F9E1E3FD3348B76A3"><enum>(7)</enum><text>the term <quote>particular matter</quote> includes any investigation, application, request for a ruling or determination, rulemaking, contract, controversy, claim, charge, accusation, arrest, or judicial or other proceeding.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H53CCA68531B445CD9D80E1DE39FAE3B3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 3114 the following:</text>
				<quoted-block changed="deleted" committee-id="SSGA00" id="HCA0AEEE8BA5D499BB3B1C61924063C94" reported-display-style="strikethrough" style="USC"><toc changed="deleted" committee-id="SSGA00" regeneration="no-regeneration" reported-display-style="strikethrough"><toc-entry level="section">3115. Employment of political appointees.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H225758DFA4994BA0B3F0290D776DB45E"><enum>(c)</enum><header>Application</header>
 <paragraph id="H049DEFE1417447578307E9721E385EE0"><enum>(1)</enum><header>Appointment requests</header><text display-inline="yes-display-inline">Section 3115(a) of title 5, United States Code, as added by subsection (a), shall apply to any appointment or request for appointment described in such section submitted to the Associate Director of Merit Systems Accountability and Compliance after the date of enactment of this Act.</text>
 </paragraph><paragraph id="H5714419054A64A3980CDEB7777622FD2"><enum>(2)</enum><header>Limitation on appointments</header><text>Section 3115(b) of title 5, United States Code, as added by subsection (a), shall apply to any individual who leaves or departs from a political position (as that term is defined in section 3115(c)(2) of such title, as added by such subsection) after the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="HAD3DCD4D82774549AE781D253DDEAEFA"><enum>(d)</enum><header>Regulations required</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall issue regulations necessary to carry out this Act. Such regulations shall include guidance on the definition of the term <quote>personally and substantially participated in a particular matter</quote> in section 3115(b)(2) of title 5, United States Code, as added by subsection (a), consistent with section 2641.201 of title 5, Code of Federal Regulations.</text></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
 <section changed="added" committee-id="SSGA00" id="id9fc51d4f69384d03bffab91bbc3b820b" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Appointee Burrowing Prevention Act</short-title></quote>.</text> </section><section changed="added" committee-id="SSGA00" id="id712acda4b362457db60374ee3e68a7b1" reported-display-style="italic"><enum>2.</enum><header>Limitation on employment of political appointees in career civil service positions</header> <subsection id="id6b07871e1c4d4131ae4141b19dd8d35b"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

					<section id="idef2723a6a263402a9858f704ad9b3a9f"><enum>3117.</enum><header>Employment of political appointees</header>
						<subsection id="idbd643d05e9354819b5bbc6a87da4d406"><enum>(a)</enum><header>Appointment approval required</header>
 <paragraph id="id23a5f689bb8e4eed92b63038da670055"><enum>(1)</enum><header>In general</header><text>The head of an agency may not appoint a covered individual to a career position within the agency without receiving prior written approval from the Associate Director, consistent with the requirements of this subsection.</text>
 </paragraph><paragraph id="id2f800081e22d42678780c774692fc1a9"><enum>(2)</enum><header>Request</header><text>If the head of an agency wishes to appoint a covered individual to a career position, the head of the agency shall submit a request to the Associate Director to approve the appointment, which shall include a certification by the head of the agency to the Associate Director that—</text>
 <subparagraph id="idf90494f85f984a63993181d95728f15a"><enum>(A)</enum><text>the career position would not involve confidential, policy-determining, policy-making, or policy-advocating responsibilities (unless the career position is in the Senior Executive Service);</text>
 </subparagraph><subparagraph id="idb3d6ecccb6c349cea89af6d9b92157f7"><enum>(B)</enum><text>the appointment process was based on merit after a fair and open competition; and</text> </subparagraph><subparagraph id="id45f97b1fd2464776a74208e63af47c8b"><enum>(C)</enum><text>the appointment process did not give any preference or special advantage to the covered individual based on a prior political appointment, political influence, or political affiliation.</text>
								</subparagraph></paragraph><paragraph id="idfdf10fc2501045c69ccb70cd2613eb88"><enum>(3)</enum><header>Review and determination</header>
 <subparagraph id="idB973CE164FFE43089930143E887D58C6"><enum>(A)</enum><header>In general</header><text>The Associate Director shall—</text> <clause id="idF37FCD472F7D469A9B231428E0ADDAFB"><enum>(i)</enum><text>review each request received pursuant to paragraph (2); and</text>
 </clause><clause id="id929F4698B3464332806389A847DE2A81"><enum>(ii)</enum><text>make a favorable or unfavorable determination whether, with respect to the request, the position classification and qualifications requirements and the appointment process were fair, open, and free from political influence.</text>
 </clause></subparagraph><subparagraph id="idF9866783725142EC842415A6ACE6CC72"><enum>(B)</enum><header>Approval</header><text>If the Associate Director makes a favorable determination under subparagraph (A)(ii), the Associate Director may approve the request.</text>
 </subparagraph><subparagraph id="id0aae92da3d7e40aa8670cd592189d1b8"><enum>(C)</enum><header>Denial</header><text>If the Associate Director makes an unfavorable determination under subparagraph (A)(ii), the Associate Director shall deny the request.</text>
 </subparagraph></paragraph><paragraph id="iddc316f547da74c0ea90c85ac2eafe488"><enum>(4)</enum><header>Notification to Congress</header><text>With respect to any request approved under paragraph (3), the Associate Director shall, not later than 5 days before the date the Associate Director provides the approval to the head of the requesting agency, submit to the Committee on Oversight and Government Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate the certification under paragraph (2) relating to the request and the rationale of the head of the agency for the certification.</text>
							</paragraph></subsection><subsection id="id4e0b9c183aad4aaaacc5fe37f7daf5dc"><enum>(b)</enum><header>Probationary period</header>
 <paragraph id="id784e30e793b14871aee4f6899dccef67"><enum>(1)</enum><header>In general</header><text>A covered individual shall complete a 2-year period of probation before an appointment to a career position in the competitive service approved under subsection (a) becomes final.</text>
 </paragraph><paragraph id="ida44cedf1224f4c1abbfc26d70c500c6c"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to—</text> <subparagraph id="idb8c1988519dc4e1e91a543dc4bc35cb1"><enum>(A)</enum><text>a political appointee who has not personally and substantially participated in any particular policy-making activity or similar matter while employed in a political position; or</text>
 </subparagraph><subparagraph id="id273d935b51e44710962a3ffc6d4b366b"><enum>(B)</enum><text>a political appointee who has previously held a career position in the competitive service and successfully completed a probationary period for that position under section 3321.</text>
 </subparagraph></paragraph></subsection><subsection id="idd4e59b0c5dec4811880fa9c2e12df164"><enum>(c)</enum><header>Application</header><text>Nothing in this section shall be construed to restrict the appointment of an individual who is—</text> <paragraph id="id8ec67a8b3faa4f508e084dbafb1b4e97"><enum>(1)</enum><text>entitled to reinstatement under section 3593(b); or</text>
 </paragraph><paragraph id="id599c2608e48a420690387071ed75082c"><enum>(2)</enum><text>eligible for reinstatement under section 3593(a).</text> </paragraph></subsection><subsection id="id7d5391b90c5c48b5aa930c678c3c0d48"><enum>(d)</enum><header>Definitions</header><text>In this section—</text>
 <paragraph id="id5b66212939d348d797721ed3a20c250a"><enum>(1)</enum><text>the term <term>agency</term> has the meaning given the term <term>Executive agency</term> in section 105;</text> </paragraph><paragraph id="idca7488b2dc1e4167a4d5c45b625fcf23"><enum>(2)</enum><text>the term <term>Associate Director</term> means—</text>
 <subparagraph id="id5E5803B45A80470CAF334AB98446C7C5"><enum>(A)</enum><text>the Associate Director of Merit Systems Accountability and Compliance of the Office of Personnel Management; or</text>
 </subparagraph><subparagraph id="id33D1AFCC95B2428EB0BA51C95025C900"><enum>(B)</enum><text>if the Associate Director described in subparagraph (A) is not responsible for carrying out the authorities under section 1104(b)(2), the Associate Director of the Office of Personnel Management responsible for carrying out such authorities;</text>
 </subparagraph></paragraph><paragraph id="id9e58d8a49f2948e0ba5fc89b04f6d315"><enum>(3)</enum><text>the term <term>career position</term> means—</text> <subparagraph id="ida54a779c1a184faaa3d8897724563a10"><enum>(A)</enum><text>a position in the competitive service filled by a career or career-conditional appointment;</text>
 </subparagraph><subparagraph id="id0c404102b7bb4495bfb9a670213a8e28"><enum>(B)</enum><text>a position in the excepted service filled by an appointment of equivalent tenure as a position described in subparagraph (A);</text>
 </subparagraph><subparagraph id="id2ee4d6907ff943a7a0df3e4319d89c5f"><enum>(C)</enum><text>a career reserved position, as defined in paragraph (8) of section 3132(a), in the Senior Executive Service; or</text>
 </subparagraph><subparagraph id="id0b95481c60be459db8988badb16ad1ff"><enum>(D)</enum><text>a general position in the Senior Executive Service filled by a career appointee, as defined in section 3132(a)(4);</text>
 </subparagraph></paragraph><paragraph id="id4ccee834b86245dab998fd0a4fb4599f"><enum>(4)</enum><text>the term <term>covered individual</term> means—</text> <subparagraph id="idab4e4140de2f4b1db2dbf73e16a699cf"><enum>(A)</enum><text>a political appointee;</text>
 </subparagraph><subparagraph id="id68687f03a1794daf873769f45e624455"><enum>(B)</enum><text>a former political appointee who held any political position during the 5-year period before the date of the request described in subsection (a)(2); or</text>
 </subparagraph><subparagraph id="idbb072d5a35414011ac75765ff1222077"><enum>(C)</enum><text>at the discretion of the Director of the Office of Personnel Management, a former political appointee who held any political position before the 5-year period described in subparagraph (B);</text>
 </subparagraph></paragraph><paragraph id="idb0d12a29db794d1e90eb8cd0462d2d37"><enum>(5)</enum><text>the term <term>participated</term> means an action taken as an officer or employee through decision, approval, disapproval, recommendation, the rendering of advice, investigation, or other such action;</text>
 </paragraph><paragraph id="id7220777397004614861318bb33ffa00d"><enum>(6)</enum><text>the term <term>particular matter</term> includes any investigation, application, request for a ruling or determination, rulemaking, contract, controversy, claim, charge, accusation, arrest, or judicial or other proceeding;</text>
 </paragraph><paragraph id="ida3ed82fc18d74f66be40fee577091186"><enum>(7)</enum><text>the term <term>political appointee</term> means an individual serving in an appointment of any duration to a political position; and</text> </paragraph><paragraph id="id16cd118bfd484867ba41ffd10d54462c"><enum>(8)</enum><text>the term <term>political position</term> means—</text>
 <subparagraph id="id88cada2ea0234f5b8dbe1995ae5651f7"><enum>(A)</enum><text>a position with respect to which appointment is made—</text> <clause id="id89dc64375065447f817fa1a045313fb8"><enum>(i)</enum><text>by the President; or</text>
 </clause><clause id="id875ed85d7cfd4fb4a8336a9004c01640"><enum>(ii)</enum><text>by the President, by and with the advice and consent of the Senate;</text> </clause></subparagraph><subparagraph id="id2e626f3be3d949cbaf074b420c6e53aa"><enum>(B)</enum><text>a position which has been excepted from the competitive service by reason of its confidential, policy-determining, policy-making, or policy-advocating character;</text>
 </subparagraph><subparagraph id="id47d120642a3f4f7597f4efbaa4126ea5"><enum>(C)</enum><text>a position described under sections 5312 through 5316 (relating to the Executive Schedule); or</text> </subparagraph><subparagraph id="id5f6d869781f748619d478dfe447ec178"><enum>(D)</enum><text>a general position in the Senior Executive Service filled by—</text>
 <clause id="id0026bc2662be4534a81a7aeacd455d8c"><enum>(i)</enum><text>a noncareer appointee, as defined in paragraph (7) of section 3132(a); or</text> </clause><clause id="id9b1ff80d48e94385931a9f8adad0bec9"><enum>(ii)</enum><text>a limited term appointee or limited emergency appointee, as defined in paragraphs (5) and (6) of section 3132(a), who is serving under a political appointment.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idf7594aebed7b4641b67d4686b93e3774"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 3116 the following:</text>

			</subsection><subsection id="id9124d6cd2a744f4a9eb23bb4eb136b15"><enum>(c)</enum><header>Application</header>
 <paragraph id="iddca5a0a8d343478580adb3a9667a8189"><enum>(1)</enum><header>Appointment requests</header><text>Section 3117(a) of title 5, United States Code, as added by subsection (a), shall apply to any appointment or request for appointment described in such section submitted to the Associate Director of Merit Systems Accountability and Compliance after the date of enactment of this Act.</text>
 </paragraph><paragraph id="id852b1e23243b41ea949bfe1e43844e59"><enum>(2)</enum><header>Limitation on appointments</header><text>Section 3117(b) of title 5, United States Code, as added by subsection (a), shall apply to any individual who leaves or departs from a political position (as that term is defined in section 3117 of such title, as added by such subsection) after the date of enactment of this Act.</text>
 </paragraph></subsection><subsection id="ide2204a0802e64ef780466143667d9067"><enum>(d)</enum><header>Regulations required</header><text>The Director of the Office of Personnel Management, in consultation with the Office of Special Counsel, shall issue regulations necessary to carry out this Act and the amendments made by this Act, which shall include guidance on the definition of the term <term>personally and substantially participated in a particular policy-making activity or similar matter</term> in section 3117(b)(2) of title 5, United States Code, as added by subsection (a), consistent with section 2641.201 of title 5, Code of Federal Regulations.</text></subsection></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>An Act to amend title 5, United States Code, to appropriately limit employment in a career civil
			 service position for political appointees and former political appointees,
