			 clinic and Federally qualified health center services furnished to hospice
			 patients under the Medicare program.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Access to Hospice Act of 2017</short-title></quote>.</text>
		</section><section id="idE7A25D4332A341FD8C0F06D06BE924E2"><enum>2.</enum><header>Medicare payment for certain rural health clinic and Federally qualified health center services
			 furnished  to
			 hospice patients</header>
 <subsection id="id123348C1C4844C8BBFC8E180D47255F8"><enum>(a)</enum><header>In general</header><text>Section 1812(d)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395d">42 U.S.C. 1395d(d)(2)</external-xref>) is amended—</text> <paragraph id="id46D923D4F4DF412495D6F90C9620EA57"><enum>(1)</enum><text>in subparagraph (A)—</text>
 <subparagraph id="id52E7259F69974AE5B6DF9E50E98199A1"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>the succeeding provisions of this paragraph</quote>;</text> </subparagraph><subparagraph id="id6625180BE91C48BDA9C955D6C4F3F1B3"><enum>(B)</enum><text>in clause (ii)(II), by striking the semicolon at the end and inserting a period; and</text>
 </subparagraph><subparagraph id="id11DFFB4622B845D6A84977C361DD45F9"><enum>(C)</enum><text>by striking the flush matter following clause (ii)(II); and</text> </subparagraph></paragraph><paragraph id="id508023CFC6824CC4BA76BD9B39BC9D28"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="idDF79D4D3A04E43E79407F76141B75E36" style="OLC">
 <subparagraph id="idC43EF9F9C032464C9524D05075A63CA5" indent="up1"><enum>(E)</enum><text>Subparagraph (A)(ii) shall not apply to—</text> <clause id="id1FA2960C57874C0D85A80ACBC6CCCA10"><enum>(i)</enum><text>physicians' services furnished by the individual's attending physician (as defined in section 1861(dd)(3)(B)), if not an employee of the hospice program;</text>
 </clause><clause id="id0A22F0FBC49F49BD9F47B0FC2180452E"><enum>(ii)</enum><text>services provided by (or under arrangements made by) the hospice program; or</text>
 </clause><clause id="idFE860572F61B4F9DBFF90C1CF14C1FE1"><enum>(iii)</enum><text>rural health clinic services (as defined in paragraph (1) of section 1861(aa)) and Federally qualified health center services (as defined in paragraph (3) of such section) if such services—</text>
 <subclause id="idB3EE3CC9083643FC8218CC6D6CB7F4C1"><enum>(I)</enum><text>would otherwise be physicians' services if furnished by an individual not affiliated with a rural health clinic (as defined in paragraph (2) of such section) or a Federally qualified health center (as defined in paragraph (4) of such section); and</text>
 </subclause><subclause id="id9F6BC11216FC488D88724B428DD2A636"><enum>(II)</enum><text>are—</text> <item id="id5048A81E03594BE58CA7F3B21FC5D760"><enum>(aa)</enum><text>furnished by the individual's attending physician (as so defined), if not an employee of the hospice program; or</text>
 </item><item id="idFCBB84514E8D479ABE6FE56C413F4B53"><enum>(bb)</enum><text>provided under arrangements made by the hospice program.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id248B32B6FCB74C4EBC5B6CBB1EE5BFEB"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after the date that is six months after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
