			 before making an expenditure from the Nuclear Waste Fund for a nuclear
			 waste repository.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nuclear Waste Informed Consent Act</short-title></quote>.</text>
 </section><section id="idA1FDF71B4DC247F8820D77A4CA0A0E0C" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the terms <term>affected Indian tribe</term>, <term>affected unit of local government</term>, <term>Commission</term>, <term>high-level radioactive waste</term>, <term>repository</term>, <term>spent nuclear fuel</term>, and <term>unit of general local government</term> have the meanings given the terms in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text>
		</section><section id="id08acf72d82b442558fb1b4353d12d80c"><enum>3.</enum><header>Consent based approval</header>
 <subsection id="ide7416fec86cf45aeb890bccd2b9042b8"><enum>(a)</enum><header>In general</header><text>The Secretary may not make an expenditure from the Nuclear Waste Fund for the costs of the activities described in paragraphs (4) and (5) of section 302(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(d)</external-xref>) unless the Secretary has entered into an agreement to host a repository with—</text>
 <paragraph id="id0513da47f1ac47e09ee9df8be6c92b42"><enum>(1)</enum><text>the Governor of the State in which the repository is proposed to be located;</text> </paragraph><paragraph id="id45e54c8fd3914570a1718fbd4a45dc2c"><enum>(2)</enum><text>each affected unit of local government;</text>
 </paragraph><paragraph id="ide7771f83744e4beda7c567f73888c12c"><enum>(3)</enum><text>any unit of general local government contiguous to the affected unit of local government if spent nuclear fuel or high-level radioactive waste will be transported through that unit of general local government for disposal at the repository; and</text>
 </paragraph><paragraph id="idb9232e4c21d04308b423150763cb3b55"><enum>(4)</enum><text>each affected Indian tribe.</text> </paragraph></subsection><subsection id="id0634510983aa47b9b080f3e1e35835c5"><enum>(b)</enum><header>Conditions on agreement</header><text>Any agreement to host a repository under this Act—</text>
 <paragraph id="id001442028a854f428a891804b1b9b618"><enum>(1)</enum><text>shall be in writing and signed by all parties;</text> </paragraph><paragraph id="idce74a1aa2a034ac1af15eb7f2565b6a9"><enum>(2)</enum><text>shall be binding on the parties; and</text>
 </paragraph><paragraph id="idd2f50ac2b3ef48f89919c3d58d4762a7"><enum>(3)</enum><text>shall not be amended or revoked except by mutual agreement of the parties.</text></paragraph></subsection></section></legis-body></bill>
