			 Things.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="id9aa8f6f9bcd840f2b73286e81c762793" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Developing Innovation and Growing the Internet of Things Act</short-title></quote> or <quote>DIGIT Act</quote>.</text> </section><section id="ida3470bcf61ca48f98ae9e7241a5a0434"><enum>2.</enum><header>Findings; sense of Congress</header> <subsection id="id170dbf163710478ebad5d48ecf6d79d1"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text>
 <paragraph id="id597794aca2cf4356819c768b414e0516"><enum>(1)</enum><text>the Internet of Things refers to the growing number of connected and interconnected devices;</text> </paragraph><paragraph id="id966597ba800b4b28b3c8d6dfe2f5ff5c"><enum>(2)</enum><text>estimates indicate that more than 50,000,000,000 devices will be connected to the Internet by the year 2020;</text>
 </paragraph><paragraph id="id80a06701d4a7470a9cd2d88aae7b86c8"><enum>(3)</enum><text>the Internet of Things has the potential to generate trillions of dollars in new economic activity around the world;</text>
 </paragraph><paragraph id="id1c22e1d247c14da2a4150c803a1e0795"><enum>(4)</enum><text>businesses across the United States can develop new services and products, improve operations, simplify logistics, cut costs, and pass savings on to consumers by utilizing the Internet of Things and related innovations;</text>
 </paragraph><paragraph id="idd361c967eb9d4ac18835785e1daccb92"><enum>(5)</enum><text>the United States leads the world in the development of technologies that support the Internet and the United States technology sector is well-positioned to lead in the development of technologies for the Internet of Things;</text>
 </paragraph><paragraph id="ida4930b3cd2b04e0e8bb64b35a074f54f"><enum>(6)</enum><text>the United States Government can implement this technology to better deliver services to the public; and</text>
 </paragraph><paragraph id="id39a9a41d8f71466bbf8790e2092f03bb"><enum>(7)</enum><text>the United States Senate unanimously passed Senate Resolution 110, 114th Congress, agreed to March 24, 2015, calling for a national strategy for the development of the Internet of Things.</text>
 </paragraph></subsection><subsection id="id89cc27ba31c5400c8eff195e043ed40d"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that policies governing the Internet of Things should maximize the potential and development of the Internet of Things to benefit all stakeholders, including businesses, governments, and consumers.</text>
 </subsection></section><section id="idaf5cc7cd063949bea51b3e3adfd3fd17"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="idA26758B7C236454798494A3E0FD3E5AB"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
 <subparagraph id="idd719b8724fa14b049d93f2829058fe6d"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text> </subparagraph><subparagraph id="id5a97a154d2ea420bb2552ee5cd56d97d"><enum>(B)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph id="id69fbe1b7b88c440da49429599c7907ee"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text> </paragraph><paragraph id="id27baf986640f464ba89d4058e2a3e82d"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text>
 </paragraph><paragraph id="idE6198884B52B4884BAEAF874E46673FE"><enum>(4)</enum><header>Steering committee</header><text>The term <term>steering committee</term> means the steering committee established under section 4(e)(1).</text> </paragraph><paragraph id="id350aa22f3fc84467a94219fe1754909a"><enum>(5)</enum><header>Working group</header><text>The term <term>working group</term> means the working group convened under section 4(a).</text>
			</paragraph></section><section id="id92404e6c5db14478afdefc0191aef1ae"><enum>4.</enum><header>Federal working group</header>
 <subsection id="idf0c0f0590b334ee59b64ce994cd9648a"><enum>(a)</enum><header>In general</header><text>The Secretary shall convene a working group of Federal stakeholders for the purpose of providing recommendations and a report to Congress related to the aspects of the Internet of Things described in subsection (b).</text>
 </subsection><subsection id="id7d63b07dd90a4507b2fd651b53f62efb"><enum>(b)</enum><header>Duties</header><text>The working group shall—</text> <paragraph id="id5b08341c92e44da1a55a0903f5e324f4"><enum>(1)</enum><text>identify any Federal regulations, statutes, grant practices, budgetary or jurisdictional challenges, and other sector-specific policies that are inhibiting or could inhibit the development of the Internet of Things;</text>
 </paragraph><paragraph id="idf3ba633bb3b24705a39aa4d73832e98a"><enum>(2)</enum><text>consider policies or programs that encourage and improve coordination among Federal agencies with jurisdiction over the Internet of Things;</text>
 </paragraph><paragraph id="id77c1b6e1192e41e48255c41d0fc72b10"><enum>(3)</enum><text>consider any findings or recommendations made by the steering committee and, where appropriate, act to implement those recommendations; and</text>
 </paragraph><paragraph id="id720d68aadb904939a17021be36b66049"><enum>(4)</enum><text>examine—</text> <subparagraph id="idDC21C3E2C7BF41F58EADCDD4A16AEF45"><enum>(A)</enum><text>how Federal agencies can benefit from utilizing the Internet of Things;</text>
 </subparagraph><subparagraph id="id2DEB754B72354232AE36FC1C56D0ED38"><enum>(B)</enum><text>the use of Internet of Things technology by Federal agencies as of the date the working group performs the examination;</text>
 </subparagraph><subparagraph id="id0BC6E95782984A45888CA1F6B67B5739"><enum>(C)</enum><text>the preparedness and ability of Federal agencies to adopt Internet of Things technology in the future; and</text>
 </subparagraph><subparagraph id="id74510C69475242CEB943084161794F8F"><enum>(D)</enum><text>any additional security measures that Federal agencies may need to take to—</text> <clause id="id8EA72DCD53CB41A6BA410D4A197167BC"><enum>(i)</enum><text>safely and securely use the Internet of Things; and</text>
 </clause><clause id="idD27A1EBF77CD48AE872AD0F782E2C300"><enum>(ii)</enum><text>enhance the resiliency of Federal systems against cyber threats to the Internet of Things.</text> </clause></subparagraph></paragraph></subsection><subsection id="id7df3dff4d231423ca4490fb2764f9024"><enum>(c)</enum><header>Agency representatives</header><text>In convening the working group under subsection (a), the Secretary shall have discretion to appoint representatives and shall specifically consider seeking representation from—</text>
 <paragraph id="id7e86f23374524fe89acc7e9747bbb968"><enum>(1)</enum><text>the Department of Commerce, including—</text> <subparagraph id="ide72e604920834322ba906a0aaf212624"><enum>(A)</enum><text>the National Telecommunications and Information Administration;</text>
 </subparagraph><subparagraph id="idf1a8e224f69c43639d70c9bf0c2255d9"><enum>(B)</enum><text>the National Institute of Standards and Technology; and</text> </subparagraph><subparagraph id="iddf2390d1645649c79635821cdb9f1421"><enum>(C)</enum><text>the National Oceanic and Atmospheric Administration;</text>
 </subparagraph></paragraph><paragraph id="idf97f6252ebda482db452e36e14cfb0c1"><enum>(2)</enum><text>the Department of Transportation;</text> </paragraph><paragraph id="idF5A4E1D2F654424191EB97B2F22895FC"><enum>(3)</enum><text>the Department of Homeland Security;</text>
 </paragraph><paragraph id="idBBA4CC826A254A18B999CDC9E19B8122"><enum>(4)</enum><text>the Office of Management and Budget;</text> </paragraph><paragraph id="idf05ac138910e47dabd5949c2f9e4cc1e"><enum>(5)</enum><text>the National Science Foundation;</text>
 </paragraph><paragraph id="id35893075b91f4ac2a024c8aa5e346c3e"><enum>(6)</enum><text>the Commission;</text> </paragraph><paragraph id="id07289bd0014242609944066b2e5ec132"><enum>(7)</enum><text>the Federal Trade Commission;</text>
 </paragraph><paragraph id="iddda6464bc7084b0bbbe0436307640006"><enum>(8)</enum><text>the Office of Science and Technology Policy; and</text> </paragraph><paragraph id="idEB65A07D2B674AB29CC9AF5C2AF64AF4"><enum>(9)</enum><text>the Department of Energy.</text>
 </paragraph></subsection><subsection id="idaa19d6e0503f4e4b856c6be01e1dc1fd"><enum>(d)</enum><header>Nongovernmental stakeholders</header><text>The working group shall consult with nongovernmental stakeholders, including—</text> <paragraph id="id070d784e48664f798fbf028d130f5bba"><enum>(1)</enum><text>the steering committee;</text>
 </paragraph><paragraph id="id35575af81c784a3195ad29b46b42390e"><enum>(2)</enum><text>information and communications technology manufacturers, suppliers, service providers, and vendors;</text> </paragraph><paragraph id="idb8733a1c37f2468bada0b803d7d50c63"><enum>(3)</enum><text>subject matter experts representing industrial sectors other than the technology sector that can benefit from the Internet of Things, including the agriculture and health care sectors;</text>
 </paragraph><paragraph id="id124a6247dd734933a222014e52684bf5"><enum>(4)</enum><text>small, medium, and large businesses;</text> </paragraph><paragraph id="id4c16229e6b9b412488d5ece2689a0fea"><enum>(5)</enum><text>think tanks and academia;</text>
 </paragraph><paragraph id="id1337c311f0b749178c5f6cbdc860a49c"><enum>(6)</enum><text>nonprofits and consumer groups;</text> </paragraph><paragraph id="id7cd3a8909a284e0cbf328dea4f1f6c36"><enum>(7)</enum><text>rural stakeholders; and</text>
 </paragraph><paragraph id="ida4ea750d7a4b46379adcd559a16fb290"><enum>(8)</enum><text>other stakeholders with relevant expertise, as determined by the Secretary.</text> </paragraph></subsection><subsection id="iddedda14ce3b94381a7d7b62b4c403ff0"><enum>(e)</enum><header>Steering committee</header> <paragraph id="id20DB0FCB4C474A139C5B7A52502A4C9D"><enum>(1)</enum><header>Establishment</header><text>There is established within the Department of Commerce a steering committee to advise the working group.</text>
 </paragraph><paragraph id="id7334e3a1dc804b19a0e8e2d451e61efb"><enum>(2)</enum><header>Duties</header><text>The steering committee shall advise the working group with regard to—</text> <subparagraph id="id4b2af8065246425082b7cc436469c0f2"><enum>(A)</enum><text>the identification of any Federal regulations, statutes, grant practices, programs, budgetary or jurisdictional challenges, and other sector-specific policies that are inhibiting or could inhibit the development of the Internet of Things;</text>
 </subparagraph><subparagraph id="idfabdaa66ef6e44f9b4be36667db6b920"><enum>(B)</enum><text>whether adequate spectrum is available to support the growing Internet of Things and what legal or regulatory barriers may exist to providing any spectrum needed in the future;</text>
 </subparagraph><subparagraph id="id1f59d731e44a49a3b4edc43135af12d2"><enum>(C)</enum><text>policies or programs that—</text> <clause id="id513134FF156F492188BFA7D20931A08C"><enum>(i)</enum><text>promote or are related to the privacy of individuals who use or are affected by the Internet of Things;</text>
 </clause><clause id="idbea3e369448f4444962322390754c9da"><enum>(ii)</enum><text>may enhance the security of the Internet of Things;</text> </clause><clause id="idf8422369efef49bf99fb49b01a78b1b6"><enum>(iii)</enum><text>may protect users of the Internet of Things; and</text>
 </clause><clause id="id0e9eb5f5da294be6ada2423db6a9fc8e"><enum>(iv)</enum><text>may encourage coordination among Federal agencies with jurisdiction over the Internet of Things;</text>
 </clause></subparagraph><subparagraph id="id34BE226B8682419C820A447B60B7457A"><enum>(D)</enum><text>the opportunities and challenges associated with the use of Internet of Things technology by small businesses; and</text>
 </subparagraph><subparagraph id="id8d727862b4874bbbb7b71d05fc092ae4"><enum>(E)</enum><text>any international proceeding, international negotiation, or other international matter affecting the Internet of Things to which the United States is or should be a party.</text>
 </subparagraph></paragraph><paragraph id="id0df645baa14a49e38a3954dece8f0e05"><enum>(3)</enum><header>Membership</header><text>The Secretary shall appoint to the steering committee members representing a wide range of stakeholders outside of the Federal Government with expertise relating to the Internet of Things, including—</text>
 <subparagraph id="id8a34781e7f344c698981ac4d56808137"><enum>(A)</enum><text>information and communications technology manufacturers, suppliers, service providers, and vendors;</text> </subparagraph><subparagraph id="idb867a5bd32654051a1253fbf096c1288"><enum>(B)</enum><text>subject matter experts representing industrial sectors other than the technology sector that can benefit from the Internet of Things, including the agriculture and health care sectors;</text>
 </subparagraph><subparagraph id="id84a831fa1a2f4ef29378d5bc8afa4c12"><enum>(C)</enum><text>small, medium, and large businesses;</text> </subparagraph><subparagraph id="id41e3846585634f5b94a2564bdb3bb092"><enum>(D)</enum><text>think tanks and academia;</text>
 </subparagraph><subparagraph id="id7ece3e5fb2ea43e1bd5922c9a92796af"><enum>(E)</enum><text>nonprofit organizations and consumer groups;</text> </subparagraph><subparagraph id="idabda1e582b1a4b0c8674410617cc9047"><enum>(F)</enum><text>rural stakeholders; and</text>
 </subparagraph><subparagraph id="idb7ece78259a24598aa55932171649eef"><enum>(G)</enum><text>other stakeholders with relevant expertise, as determined by the Secretary.</text> </subparagraph></paragraph><paragraph id="idbcebf45c3fbe46558de098c09a475cef"><enum>(4)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the steering committee shall submit to the working group a report that includes any findings or recommendations of the steering committee.</text>
				</paragraph><paragraph id="id7bbfea83085d4091bdf59794c9f7618c"><enum>(5)</enum><header>Independent advice</header>
 <subparagraph id="id7258824B0A7A44AFA99C9D5B7DAA7A79"><enum>(A)</enum><header>In general</header><text>The steering committee shall set the agenda of the steering committee in carrying out the duties of the steering committee under paragraph (2).</text>
 </subparagraph><subparagraph id="id9C65526B8D1145A684627DF65434C951"><enum>(B)</enum><header>Suggestions</header><text>The working group may suggest topics or items for the steering committee to study, and the steering committee shall take such suggestions into consideration in carrying out the duties of the steering committee.</text>
 </subparagraph><subparagraph id="id7DAC56A38FE8486A907CD81E8428A402"><enum>(C)</enum><header>Report</header><text>The steering committee shall ensure that the report submitted under paragraph (4) is the result of the independent judgment of the steering committee.</text>
 </subparagraph></paragraph><paragraph id="idec807dcab411439f88521c9ceb1691c9"><enum>(6)</enum><header>Termination</header><text>The steering committee shall terminate on the date on which the working group submits the report under subsection (f) unless, on or before that date, the Secretary files a new charter for the steering committee under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /9">section 9(c)</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.).</text>
				</paragraph></subsection><subsection id="iddcf793278bda4e9996869105e0689ae1"><enum>(f)</enum><header>Report to Congress</header>
 <paragraph id="idA795B313217B4FA69C763E2F3DEA617A"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the working group shall submit to the appropriate committees of Congress a report that includes—</text>
 <subparagraph id="id11cd1e69885545ff81f762846e393e65"><enum>(A)</enum><text>the findings and recommendations of the working group with respect to the duties of the working group under subsection (b);</text>
 </subparagraph><subparagraph id="ide9c79bcef6e34005b360b16460fcdae0"><enum>(B)</enum><text>the report submitted by the steering committee under subsection (e)(4), as the report was received by the working group;</text>
 </subparagraph><subparagraph id="id9364e629e81645a7aa5f145f0425d124"><enum>(C)</enum><text>recommendations for action or reasons for inaction, as applicable, on each recommendation made by the steering committee in the report submitted under subsection (e)(4); and</text>
 </subparagraph><subparagraph id="id4e9343d676a84d5badb8678bb0e374f3"><enum>(D)</enum><text>an accounting of any progress made by Federal agencies to implement recommendations made by the working group or the steering committee.</text>
 </subparagraph></paragraph><paragraph id="idB82A76FB4C3249BA8637CEDDDE2C9784"><enum>(2)</enum><header>Copy of report</header><text>Any committee of Congress, upon request, may obtain a copy of the report submitted under paragraph (1).</text>
				</paragraph></subsection></section><section id="id8529700441a844f9a31531bf12f17096"><enum>5.</enum><header>Assessing spectrum needs</header>
 <subsection id="id9637711308bb4b51ad6202ff0d4bea31"><enum>(a)</enum><header>In general</header><text>The Commission, in consultation with the National Telecommunications and Information Administration, shall issue a notice of inquiry seeking public comment on the current, as of the date of enactment of this Act, and future spectrum needs of the Internet of Things.</text>
 </subsection><subsection id="id1c056d1f9cf24a78a1e2f1b6b12637b0"><enum>(b)</enum><header>Requirements</header><text>In issuing the notice of inquiry under subsection (a), the Commission shall seek comments that consider and evaluate—</text>
 <paragraph id="id37e410ce8a82467c99981e4ccb538ee3"><enum>(1)</enum><text>whether adequate spectrum is available to support the growing Internet of Things;</text> </paragraph><paragraph id="idacc8cadf4726404c82befa48dba534d1"><enum>(2)</enum><text>what regulatory barriers may exist to providing any needed spectrum for the Internet of Things; and</text>
 </paragraph><paragraph id="id5f99e20971234e26a2fb7b9e1984de2f"><enum>(3)</enum><text>what the role of licensed and unlicensed spectrum is and will be in the growth of the Internet of Things.</text>
 </paragraph></subsection><subsection id="id71140b938ae448e39268e11f5d25493a"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report summarizing the comments submitted in response to the notice of inquiry issued under subsection (a).</text></subsection></section></legis-body></bill>
