			 and loan cancellation for founders and employees of small business

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reigniting Opportunity for Innovators Act</short-title></quote>.</text> </section><section id="idc0dbbb37ff5042f2bf4b769882772f25"><enum>2.</enum><header>Small business startup founder and employee loan deferment and cancellation</header> <subsection commented="no" id="idd505e1fa29d94ae2b30245ed747fda93"><enum>(a)</enum><header>Deferment without interest accrual for small business startup founders and employees</header><text>Section 455(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(f)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id64321ab757f4425da072527f18bb1757" style="OLC">
					<paragraph commented="no" id="idcadf9730ccd44647875294fce9b1f06c"><enum>(5)</enum><header>Deferment without interest accrual for small business startup founders and employees</header>
 <subparagraph commented="no" id="id247D008986B545F2B03AE5D87DC20A5E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a qualifying small business startup borrower shall be eligible for a deferment, during which periodic installments of principal need not be paid and interest shall not accrue, during any period while the borrower is employed as a founder or full-time employee of a small business startup.</text>
 </subparagraph><subparagraph commented="no" id="id10EC3D0EBC7D4EC1B06EF07A6F4887FB"><enum>(B)</enum><header>Limitations</header><text>A qualifying small business startup borrower shall not receive a deferment under this paragraph for any period—</text>
 <clause commented="no" id="idE7B98F9D6BB342E2BAD1FD2321B1C013"><enum>(i)</enum><text>in excess of 3 years; or</text> </clause><clause commented="no" id="id1B245F9D77434EEA9C4D0313F49ED927"><enum>(ii)</enum><text>that begins more than 5 years, or ends more than 8 years, after the date the small business startup was established (as determined by the small business development center that approved such borrower under section 21(o)(5) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(5)</external-xref>)).</text>
 </clause></subparagraph><subparagraph commented="no" id="id35D51614F1F44E459E1A2561B23B71BD"><enum>(C)</enum><header>Definitions</header><text>In this paragraph—</text> <clause commented="no" id="id022081C949F84634B65575AA098E3E3C"><enum>(i)</enum><text>the terms <term>founder</term>, <term>full-time employee</term>, and <term>small business startup</term> have the meanings given the terms in subsection (r)(2); and</text>
 </clause><clause commented="no" id="idD2BEFBCCD75D4CAEA3A0285B429FF0B1"><enum>(ii)</enum><text>the term <term>qualifying small business startup borrower</term> means a borrower of a loan made under this part whose employment as a small business startup founder or full-time employee is approved by a small business development center under section 21(o)(5) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(5)</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idaaed3b3fe2af4ece8bb92ac0e13ea916"><enum>(b)</enum><header>Loan cancellation</header><text>Section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id691b85b0c67b4e47bf01a9405acba0af" style="OLC">
					<subsection id="id4defa832d9fe40aea1f990e9db774d0b"><enum>(r)</enum><header>Loan cancellation for founders and employees of small business startups in distressed areas</header>
						<paragraph id="id15b1c51fce3e43159a63f0ed24df0694"><enum>(1)</enum><header>Loan cancellation</header>
 <subparagraph id="idd39b48583b144ee3b196520ef9974c20"><enum>(A)</enum><header>In general</header><text>The Secretary shall cancel the balance of interest and principal due, subject to subparagraph (B), on any eligible Federal Direct Loan not in default for a borrower who—</text>
 <clause commented="no" display-inline="no-display-inline" id="id1839486338C74BCFBF1FEDD713B99701"><enum>(i)</enum><text display-inline="yes-display-inline">at the time of such cancellation, is employed as a founder or full-time employee of a small business startup in a distressed area who—</text>
 <subclause commented="no" display-inline="no-display-inline" id="id4BE81755867B47AC86985FFC96E6D33B"><enum>(I)</enum><text display-inline="yes-display-inline">has been approved for loan cancellation by a small business development center under section 21(o)(6) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(6)</external-xref>); and</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="idA3455AC01E6B4F26A6A9DA15AA25BD71"><enum>(II)</enum><text display-inline="yes-display-inline">began such employment during the 5-year period beginning on the date that the small business startup was established (as determined by such small business development center); and</text>
 </subclause></clause><clause id="id788361f664444c499c6689460f042eeb"><enum>(ii)</enum><text>during the time period for which the borrower has been approved by the small business development center, which in no case shall be more than 10 years after the date on which the small business startup was established, has made 24 monthly payments on the eligible Federal Direct Loan pursuant to any repayment plan under subsection (d)(1) or a combination of such plans while so employed.</text>
 </clause></subparagraph><subparagraph id="ida1aec8779f9c493c8aebcd54a77aff9e"><enum>(B)</enum><header>Loan cancellation maximum</header><text>The Secretary shall cancel under this subsection not more than an aggregate of $20,000 of the loan obligation on the eligible Federal Direct Loans of a borrower.</text>
 </subparagraph><subparagraph id="id7C967B920A2447338E8AD3C12543C6C4"><enum>(C)</enum><header>Timing requirements</header><text>Each of the 24 monthly payments required under this subsection shall be made after the date of enactment of this subsection.</text>
 </subparagraph><subparagraph id="id7f7bdaedacf847be94800152d22c7d8f"><enum>(D)</enum><header>Ineligibility for double benefits</header><text>No borrower may, for the same service, receive a reduction of loan obligations under both this subsection and—</text>
 <clause id="ida97e6252c94e44cbab6d50adb6118553"><enum>(i)</enum><text>subsection (m); or</text> </clause><clause id="id15bcc09bd6064930a2e1d895965cd7ee"><enum>(ii)</enum><text>section 428J, 428K, 428L, or 460.</text>
 </clause></subparagraph></paragraph><paragraph id="id29ca77f3301a4b6c976ce42652b9a593"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="id88D6F0ACC62C44FF94E740FF96846855"><enum>(A)</enum><header>Distressed area</header><text>The term <term>distressed area</term> has the meaning given the term in section 21(o)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(1)</external-xref>).</text>
 </subparagraph><subparagraph id="ida91efdb002d34c37918097e1047bb852"><enum>(B)</enum><header>Eligible Federal direct loan</header><text>The term <term>eligible Federal Direct Loan</term> means a Federal Direct Stafford Loan, Federal Direct PLUS Loan, Federal Direct Unsubsidized Stafford Loan, or a Federal Direct Consolidation Loan.</text>
 </subparagraph><subparagraph id="id47B9E43178B24CB997DC7C84E0D1DBEB"><enum>(C)</enum><header>Founder; full-time employee</header><text>The terms <term>founder</term> and <term>full-time employee</term> have the meanings given the terms in section 21(o)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(1)</external-xref>).</text>
 </subparagraph><subparagraph id="idd0eb1d96022a412d95be81cc7672c908"><enum>(D)</enum><header>Small business startup</header><text>The term <term>small business startup</term> means a business that is certified by a small business development center under section 21(o)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(o)(3)</external-xref>).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id2483F148369C432391025A70D2FE86AF"><enum>(c)</enum><header>Conforming amendments</header><text>Title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref> et seq.) is further amended—</text> <paragraph id="id39AA34CB4EA94010B491971623F01D3D"><enum>(1)</enum><text>in section 428J(g)(2), by striking <quote>section 455(m)</quote> and inserting <quote>subsection (m) or (r) of section 455</quote>;</text>
 </paragraph><paragraph id="idD37444F47662445C831DB64529639251"><enum>(2)</enum><text>in section 428K(f)—</text> <subparagraph id="id0B8159716AE84DDB91AF52BBAF03226E"><enum>(A)</enum><text>by inserting <quote>subsection (m) or (r) of section 455 or </quote> before <quote>section 428J</quote>; and</text>
 </subparagraph><subparagraph id="idF8084DCD5A424046937AF52DD6B15788"><enum>(B)</enum><text>by striking <quote>455(m)</quote>;</text> </subparagraph></paragraph><paragraph id="idE89B5D3512904F0D817A6E63B058C9DD"><enum>(3)</enum><text>in section 428L(g), by striking <quote>455(m)</quote> and inserting <quote>subsection (m) or (r) of section 455</quote>;</text>
 </paragraph><paragraph id="idEA3E39007E4A4A46B40B33FAAE180736"><enum>(4)</enum><text>in section 455(m)(4), by inserting <quote>subsection (r) or</quote> before <quote>section 428J</quote>; and</text> </paragraph><paragraph id="idA6D2DB4DC1914725875196C5B2144CF5"><enum>(5)</enum><text>in section 460(g)(2)(B), by striking <quote>section 455(m)</quote> and inserting <quote>subsection (m) or (r) of section 455</quote>.</text>
				</paragraph></subsection></section><section id="idBB0EE621EE414639847CADC824DF9303"><enum>3.</enum><header>Small business development centers</header>
 <text display-inline="no-display-inline">Section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>) is amended—</text> <paragraph id="idCF25BD83054649D0B95F4D67739A78D2"><enum>(1)</enum><text>in subsection (c)(3)—</text>
 <subparagraph id="id011FD95A52D7499AB4494293BC8F611D"><enum>(A)</enum><text>in subparagraph (S), by striking <quote>and</quote> at the end;</text> </subparagraph><subparagraph id="id40C7CB4552BC4A93A8AC2B8A2CFA1088"><enum>(B)</enum><text>in subparagraph (T), by striking the period at the end and inserting a semicolon; and</text>
 </subparagraph><subparagraph id="idE3828ABEE2954A9884297573E865A14D"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="idD06430968FB04D838BB850207649856F" style="OLC"> <subparagraph id="id4DFD796C390C4033B90C9592E2DE4A72" indent="up1"><enum>(U)</enum><text>certifying small business startups under subsection (o)(3); and</text>
 </subparagraph><subparagraph id="id8ED9ABA7CB974E3C8EF588DA8EFCFBAD" indent="up1"><enum>(V)</enum><text>approving loan deferment or cancellation under paragraph (5) or (6) of subsection (o) for founders and full-time employees of certain small business startups.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="idE22F09D645FB4B8995A06D1E4B532255"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block act-name="" id="id0776E2FACF704D3291C419C8225C2AB4" style="OLC"> <subsection id="id942F145A493E4125BED6E1A866222204"><enum>(o)</enum><header>Deferment or cancellation of certain loans</header> <paragraph id="idBAF25E4D290A41559588D017D161F387"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
 <subparagraph id="id9EBA09A5D634429AA090D94A6B5C5811"><enum>(A)</enum><text>the term <term>distressed area</term> has the meaning given the term <term>low-income community</term> in <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986;</text> </subparagraph><subparagraph id="id725D7B7FC9BA4FBA9F021BAD018D85D6"><enum>(B)</enum><text>the term <term>eligible Federal Direct Loan</term> has the meaning given the term in section 455(r)(2) of the Higher Education Act of 1965;</text>
 </subparagraph><subparagraph id="idD0E46AB2C17B499D8CCE0897278178FF"><enum>(C)</enum><text>the terms <term>founder</term> and <term>full-time employee</term>, with respect to a small business startup, have the meanings given the terms by the Administrator; and</text>
 </subparagraph><subparagraph id="idAC4EE5E3D15446D791F8688800D4FA3C"><enum>(D)</enum><text>the term <term>small business startup</term> means a small business concern that, as of the date that the small business concern submits an application under paragraph (3), has been in existence for not more than 3 years.</text>
 </subparagraph></paragraph><paragraph id="idD50F799AD43B43848017AA141A41C2F7"><enum>(2)</enum><header>Role of small business development centers</header><text>Any small business development center may, for purposes of eligible Federal Direct Loan deferment or cancellation under subsection (f)(5) or (r) of section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>)—</text>
 <subparagraph id="id3A101C053A0C4475A0393FC0F2BD2CFC"><enum>(A)</enum><text>certify a small business startup under paragraph (3); and</text> </subparagraph><subparagraph id="idF7CCE6EC3BAD4FE0BB923F70A75671EC"><enum>(B)</enum><text>approve eligible Federal Direct Loan deferment or cancellation for a founder or full-time employee of a qualifying small business startup under paragraph (5) or (6).</text>
 </subparagraph></paragraph><paragraph id="id9A8148532439473C90CA8FBDA9EF9D58"><enum>(3)</enum><header>Certification</header><text>In order to be certified by a small business development center, a small business startup shall submit to the small business development center an application that includes—</text>
 <subparagraph id="idA1EDB2A1A61C448EB3F439ED2426C673"><enum>(A)</enum><text>a 5-year business plan for the small business startup;</text> </subparagraph><subparagraph id="id0E3AF71C0AC444AE8A8CADD41FBD1CD0"><enum>(B)</enum><text>the number of employees that the small business startup intends to employ on an annual basis; and</text>
 </subparagraph><subparagraph id="id4EAF61D63CDF409891178F7D6C5FE6EC"><enum>(C)</enum><text>information that demonstrates that the small business startup has the potential for success.</text> </subparagraph></paragraph><paragraph id="id8DA8EBB4833341B284AB413F0B9FDCC2"><enum>(4)</enum><header>Publication of distressed areas</header><text>The Administrator shall identify and make publicly available on the website of the Administration a list of distressed areas.</text>
						</paragraph><paragraph id="id75DE2BEA3F834103A095CAECD8906734"><enum>(5)</enum><header>Loan deferment for founders and full-time employees of a small business startup</header>
 <subparagraph id="id0639B2B2D2CD4F26BBA640C1D1C4B1D8"><enum>(A)</enum><header>Application</header><text>In order to be approved by a small business development center for eligible Federal Direct Loan deferment under subsection (f)(5) of section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>), a borrower of an eligible Federal Direct Loan shall submit to the small business development center an application that includes such information as the Administrator may require.</text>
 </subparagraph><subparagraph id="idCBE41A73A371421A92C351495976149E"><enum>(B)</enum><header>Requirements</header><text>A small business development center shall approve a borrower who applies under subparagraph (A) for eligible Federal Direct Loan deferment if the small business development center determines that—</text>
 <clause id="id0A1D77B1C45A4767BEA358B4D68F6B25"><enum>(i)</enum><text>the borrower is, as of the date of the application, a founder or full-time employee of a small business startup that is certified under paragraph (3); and</text>
 </clause><clause id="id8A3083AEE492458AAB4A8D093DEC4817"><enum>(ii)</enum><text>the employment of the borrower with the small business startup began during the 5-year period beginning on the date on which the small business startup was established.</text>
								</clause></subparagraph></paragraph><paragraph id="id2FD7A6F2952B428782922106CA1986F1"><enum>(6)</enum><header>Loan cancellation for founders and full-time employees of a small business startup in a distressed
			 area</header>
 <subparagraph id="id5FCC2288D2BC4F249BB4B57AB19FD053"><enum>(A)</enum><header>Application</header><text>In order to be approved by a small business development center for eligible Federal Direct Loan cancellation under subsection (r) of section 455 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e</external-xref>), a borrower of an eligible Federal Direct Loan shall submit to the small business development center an application that includes such information as the Administrator may require, including an identification of the time period during which the borrower has made 24 monthly payments on the eligible Federal Direct Loan, as required under subparagraphs (A)(ii) and (C) of paragraph (1) of such subsection (r).</text>
 </subparagraph><subparagraph id="id340F8F61A5B04179B2D4E478A1E3B2BC"><enum>(B)</enum><header>Requirements</header><text>A small business development center shall approve a borrower who applies under subparagraph (A) for eligible Federal Direct Loan cancellation if the small business development center determines that the borrower—</text>
 <clause id="idA12AE7DFCC9D4112982D06376282158E"><enum>(i)</enum><text>as of the date of the application, is employed as a founder or full-time employee of a small business startup that—</text>
 <subclause id="id6735331D77D84966A5AB1BDD57148B1F"><enum>(I)</enum><text>is located in an area that was a distressed area when the small business startup was established;</text>
 </subclause><subclause id="id4473FFBBE08E4C789706A0D6C546C384"><enum>(II)</enum><text>is certified under paragraph (3) by the small business development center; and</text> </subclause><subclause id="idFB41E49D62CE460FB54066909F636A36"><enum>(III)</enum><text>as of the date that the small business development center approves the borrower under this paragraph, has been operating continuously for not less than 5 years and not more than 10 years; and</text>
 </subclause></clause><clause id="id23E72AB1AA434732B49921C39FE4B0C9"><enum>(ii)</enum><text>was employed as a founder or a full-time employee by a small business startup described in clause (i) during a period beginning not more than 5 years after the date on which the small business startup was established, as identified by the borrower under subparagraph (A).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
