 <subsection id="id900B256B56A549E79607F45CBF368BFD"><enum>(a)</enum><header>Short title; authorization</header><text display-inline="yes-display-inline">The first section of the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661</external-xref>) is amended by striking <quote>For the purpose</quote> and inserting the following:</text>

						<section id="id10B41EDBBCCD4C80B6540FFCE73371D4"><enum>10.</enum><header>Protection of water and wildlife from invasive species</header>
 <subsection id="idFAE23E6DD2B7413CB65760FA69FB468C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="HA437F5D375C74540B4F58DAAD92B8B4F"><enum>(1)</enum><header>Control</header><text>The term <term>control</term>, with respect to an invasive species, means the eradication, suppression, or reduction of the population of the invasive species within the area in which the invasive species is present.</text>
 </paragraph><paragraph id="H3DC84053EC0D43508EBE1C8814482215"><enum>(2)</enum><header>Ecosystem</header><text display-inline="yes-display-inline">The term <term>ecosystem</term> means the complex of a community of organisms and the environment of the organisms.</text> </paragraph><paragraph id="HAD9CF89763F44A98A4C242646E8AED5A"><enum>(3)</enum><header>Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means any of—</text>
 <subparagraph id="id93AEEA0B6ADD44A19907978C1A0B541E"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text> </subparagraph><subparagraph id="id06B1662598704F70A3825498951A3D07"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text>
 </subparagraph><subparagraph id="idF05AC89843A04C43A2B9753889EDFBD0"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text> </subparagraph><subparagraph id="id84077D420D004CBCB3ACA4C2CFED1879"><enum>(D)</enum><text display-inline="yes-display-inline">Guam;</text>
 </subparagraph><subparagraph id="id72D82337BA9847B2987BE777D102BAF5"><enum>(E)</enum><text display-inline="yes-display-inline">American Samoa;</text> </subparagraph><subparagraph id="id078EE87BE18641EB931AC5684E0782D2"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text>
 </subparagraph><subparagraph id="idCA2D9E5DC6384C9282B84F3FB077FF4E"><enum>(G)</enum><text display-inline="yes-display-inline">the United States Virgin Islands.</text> </subparagraph></paragraph><paragraph id="H62F989CE0B6E4BC29209DD79AA67CB00"><enum>(4)</enum><header>Invasive species</header> <subparagraph id="id848E974EBACC4379B6E59D746124B999"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>invasive species</term> means an alien species, the introduction of which causes, or is likely to cause, economic or environmental harm or harm to human health.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H225253EF6ACC4A118CDF2C7B6C2E4650"><enum>(B)</enum><header display-inline="yes-display-inline">Associated definition</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <term>alien species</term>, with respect to a particular ecosystem, means any species (including the seeds, eggs, spores, or other biological material of the species that are capable of propagating the species) that is not native to the affected ecosystem.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C227619B1304169AF6269BE433D09D9"><enum>(C)</enum><header>Inclusion</header><text>The terms <term>invasive species</term> and <term>alien species</term> include any terrestrial or aquatic species determined by the relevant tribal, regional, State, or local authority to meet the requirements of subparagraph (A) or (B), as applicable.</text>
 </subparagraph></paragraph><paragraph id="H535FFD2CDAEE4679946F9403ED35C6D3"><enum>(5)</enum><header>Manage; management</header><text>The terms <term>manage</term> and <term>management</term>, with respect to an invasive species, mean the active implementation of any activity—</text> <subparagraph id="H98CD706D99354D198AC06B0B87421C31"><enum>(A)</enum><text>to reduce or stop the spread of the invasive species; and</text>
 </subparagraph><subparagraph id="H8FD50AEABFB84507BD1C548E55C138B4"><enum>(B)</enum><text>to inhibit further infestations of the invasive species, the spread of the invasive species, or harm caused by the invasive species, including investigations regarding methods for early detection and rapid response, prevention, control, or management of the invasive species.</text>
 </subparagraph></paragraph><paragraph id="HB95555324F1C47238F22121EFFBEB857"><enum>(6)</enum><header>Prevent</header><text>The term <term>prevent</term>, with respect to an invasive species, means—</text> <subparagraph id="idE92FEA6143A74D349A7DFA93CD08C399"><enum>(A)</enum><text>to hinder the introduction of the invasive species onto land or water; or</text>
 </subparagraph><subparagraph id="idBD9E41A0A49D4F1EB3290A4A8592ACC6"><enum>(B)</enum><text>to impede the spread of the invasive species within land or water by inspecting, intercepting, or confiscating invasive species threats prior to the establishment of the invasive species onto land or water of an eligible State.</text>
 </subparagraph></paragraph><paragraph id="H055F377374FC4B0BBE126CD8610E7292"><enum>(7)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> <subparagraph id="H955593E34E884671829B8E1A50E4908C"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of the Army, acting through the Chief of Engineers, with respect to Federal land administered by the Corps of Engineers;</text>
 </subparagraph><subparagraph id="idD3A109FDE29346F08635BF042049F689"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, with respect to Federal land administered by the Secretary of the Interior through—</text>
 <clause id="id8F8E8752155345A6A6C6093DA36541A8"><enum>(i)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service;</text> </clause><clause id="idCE109041FA644319B3DBD03032C1BAA2"><enum>(ii)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs;</text>
 </clause><clause id="id520D98D21E564C5CB148CDBFD18CA4E5"><enum>(iii)</enum><text display-inline="yes-display-inline">the Bureau of Land Management;</text> </clause><clause id="idF12DBA8187FB44959C1F4E3605BDD8F2"><enum>(iv)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation; or</text>
 </clause><clause id="id8E8750AD25A542529B89DE18063A5550"><enum>(v)</enum><text display-inline="yes-display-inline">the National Park Service;</text> </clause></subparagraph><subparagraph id="H4AF1CD2030524B2A8715BFD277B7748D"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to Federal land administered by the Secretary of Agriculture through the Forest Service; and</text>
 </subparagraph><subparagraph id="idE9DA7935F17F47808E826F08C471EE01"><enum>(D)</enum><text>the head or a representative of any other Federal agency the duties of whom require planning relating to, and the treatment of, invasive species for the purpose of protecting water and wildlife on land and in water.</text>
 </subparagraph></paragraph><paragraph id="H8D09EF409714415BBFA2B67F4051CB6C"><enum>(8)</enum><header>Species</header><text display-inline="yes-display-inline">The term <term>species</term> means a group of organisms, all of which—</text> <subparagraph id="id44DE2FFABEAD4592AE0F31C3B6A87C00"><enum>(A)</enum><text display-inline="yes-display-inline">have a high degree of genetic similarity;</text>
 </subparagraph><subparagraph id="idAB3422DF3B2E4C56B697ACF1AB8DA5FA"><enum>(B)</enum><text display-inline="yes-display-inline">are morphologically distinct;</text> </subparagraph><subparagraph id="id63E38878CBF949CC9631387C952B975F"><enum>(C)</enum><text display-inline="yes-display-inline">generally—</text>
 <clause id="id8435D9C4B6B44CD0B9C119E9726A9BE3"><enum>(i)</enum><text display-inline="yes-display-inline">interbreed at maturity only among themselves; and</text> </clause><clause id="id931A06C1677B427BBE563451D109BC46"><enum>(ii)</enum><text display-inline="yes-display-inline">produce fertile offspring; and</text>
 </clause></subparagraph><subparagraph id="id85E929E9796840098AADEDE1E1B4BAAE"><enum>(D)</enum><text display-inline="yes-display-inline">show persistent differences from members of allied groups of organisms.</text>
 </subparagraph></paragraph></subsection><subsection id="HC96F3D3956984B52B3EB0644CAE5E433"><enum>(b)</enum><header>Control and management</header><text display-inline="yes-display-inline">Each Secretary concerned shall plan and carry out activities on land directly managed by the Secretary concerned to protect water and wildlife by controlling and managing invasive species—</text>
 <paragraph id="idE786AA65727B4705B4FC240C0A3DCD12"><enum>(1)</enum><text display-inline="yes-display-inline">to inhibit or reduce the populations of invasive species; and</text>
 </paragraph><paragraph id="id5EF5CDA7EF874A4EBC9B561C110C8263"><enum>(2)</enum><text display-inline="yes-display-inline">to effectuate restoration or reclamation efforts.</text>
								</paragraph></subsection><subsection id="H82788FF43C8741978B2E6216FAEAF477"><enum>(c)</enum><header>Strategic plan</header>
 <paragraph id="id2759B216089D46D6A26C239D67CD8453"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each Secretary concerned shall develop a strategic plan for the implementation of the invasive species program to achieve, to the maximum extent practicable, a substantive annual net reduction of invasive species populations or infested acreage on land or water managed by the Secretary concerned.</text>
 </paragraph><paragraph id="id5FED6D54CED64C64894CFC2AB086B57C"><enum>(2)</enum><header>Coordination</header><text>Each strategic plan under paragraph (1) shall be developed—</text> <subparagraph id="idAEB13693120C4FA58C5952790F4C3CFD"><enum>(A)</enum><text>in coordination with affected—</text>
 <clause id="idEB537C1F02A14A168E5EF9A7E666D2CC"><enum>(i)</enum><text>eligible States;</text> </clause><clause id="id488DBB8615B94AA091DBEA74091FD829"><enum>(ii)</enum><text>political subdivisions of eligible States; and</text>
 </clause><clause id="id3BDED0294CCE4193822A4A5D99C68205"><enum>(iii)</enum><text>federally recognized Indian tribes; and</text> </clause></subparagraph><subparagraph id="idA2A2AEBD375F4C798FE07C431BC52399"><enum>(B)</enum><text>in accordance with the priorities established by 1 or more Governors of the eligible States in which an ecosystem affected by an invasive species is located.</text>
 </subparagraph></paragraph><paragraph id="id11e2974d44ff494fbdf201e57f8f808d"><enum>(3)</enum><header>Factors for consideration</header><text>In developing a strategic plan under this subsection, the Secretary concerned shall take into consideration the economic and ecological costs of action or inaction, as applicable.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE900270279494225A8648605CAF1DF32"><enum>(d)</enum><header display-inline="yes-display-inline">Cost-effective methods</header><text display-inline="yes-display-inline">In selecting a method to be used to control or manage an invasive species as part of a specific control or management project conducted as part of a strategic plan developed under subsection (c), the Secretary concerned shall prioritize the use of methods that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id82B01694AA1F4E34BC5DA724B57081D2"><enum>(1)</enum><text display-inline="yes-display-inline">effectively control and manage invasive species, as determined by the Secretary concerned, based on sound scientific data; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA43D136F72147F4B83713715D1F3997"><enum>(2)</enum><text display-inline="yes-display-inline">control and manage invasive species in the least costly manner.</text> </paragraph></subsection><subsection id="id818694BC2A0B4B5DA547533FA22F4B3C"><enum>(e)</enum><header>Comparative economic assessment</header><text display-inline="yes-display-inline">To achieve compliance with subsection (d), the Secretary concerned shall require a comparative economic assessment of invasive species control and management methods to be conducted.</text>
							</subsection><subsection id="idCC243D1E3A4049A8A103DD2E9B7CC55E"><enum>(f)</enum><header>Expedited action</header>
 <paragraph id="id742615CA9F534FC0B45BF9E8B640AA1D"><enum>(1)</enum><header>In general</header><text>The Secretaries concerned shall use all tools and flexibilities available (as of the date of enactment of this section) to expedite the projects and activities described in paragraph (2).</text>
 </paragraph><paragraph id="id766B6889E14F4DC9A417060244A3573D"><enum>(2)</enum><header>Description of projects and activities</header><text>A project or activity referred to in paragraph (1) is a project or activity—</text> <subparagraph id="id7C11C2E0522F4AC5ACBDF7F230992F65"><enum>(A)</enum><text>to protect water or wildlife from an invasive species that, as determined by the Secretary concerned is, or will be, carried out on land or water that is—</text>
 <clause id="id353A5D348C0C401180ED802F71214AA1"><enum>(i)</enum><text>directly managed by the Secretary concerned; and</text>
 </clause><clause id="id535CDEF667F944969358CF70466EBCB4"><enum>(ii)</enum><text>located in an area that is—</text> <subclause id="idA3EC508A1B044D968C93B80E3C7BC480"><enum>(I)</enum><text>at high risk for the introduction, establishment, or spread of invasive species; and</text>
 </subclause><subclause id="idF009D345F1E54CA9880304AE7672CFAC"><enum>(II)</enum><text>determined by the Secretary concerned to require immediate action to address the risk identified in subclause (I); and</text>
 </subclause></clause></subparagraph><subparagraph id="id4E92E5AD1FA1492191C1CC44192D978E"><enum>(B)</enum><text>carried out in accordance with applicable agency procedures, including any applicable—</text> <clause id="id3AD2409C9957407389C388C3FACE0835"><enum>(i)</enum><text>land or resource management plan; or</text>
 </clause><clause id="idF278E383255A48BBA16CEAFEFB8F432E"><enum>(ii)</enum><text>land use plan.</text> </clause></subparagraph></paragraph></subsection><subsection id="HCC0E04246EFC4C09AACAA4C468B4C823"><enum>(g)</enum><header>Allocation of funding</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, the Secretary concerned shall use not less than 75 percent for on-the-ground control and management of invasive species, which may include—</text>
 <paragraph id="H685DDD7BB84842F3999ACFC15134012B"><enum>(1)</enum><text>the purchase of necessary products, equipment, or services to conduct that control and management;</text> </paragraph><paragraph id="HFA551DDB57C5484BBC397C41DF4A878E"><enum>(2)</enum><text>the use of integrated pest management options, including options that use pesticides authorized for sale, distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref> et seq.);</text>
 </paragraph><paragraph id="HEF9DF2E5CAA04CF384B56FB96D932C7D"><enum>(3)</enum><text>the use of biological control agents that are proven to be effective to reduce invasive species populations;</text>
 </paragraph><paragraph id="HB0DD8D5FB6024EC6BF495889B6398F60"><enum>(4)</enum><text>the use of revegetation or cultural restoration methods designed to improve the diversity and richness of ecosystems;</text>
 </paragraph><paragraph id="id60DDC2D2246748D3BDB0801C399E2445"><enum>(5)</enum><text>the use of monitoring and detection activities for invasive species, including equipment, detection dogs, and mechanical devices;</text>
 </paragraph><paragraph id="id6E04B4C603CF4F3AAD9AB56632D74495"><enum>(6)</enum><text>the use of appropriate methods to remove invasive species from a vehicle or vessel capable of conveyance; or</text>
 </paragraph><paragraph id="H1E2DD65567E148C3B322F662BBDA2FD6"><enum>(7)</enum><text>the use of other effective mechanical or manual control methods.</text> </paragraph></subsection><subsection id="H373AD373C9914DEABC918C9B673C125C"><enum>(h)</enum><header>Investigations, outreach, and public awareness</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, the Secretary concerned may use not more than 15 percent for investigations, development activities, and outreach and public awareness efforts to address invasive species control and management needs.</text>
 </subsection><subsection id="H74606BF0EC9F460D93200D522322AE26"><enum>(i)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, not more than 10 percent may be used for administrative costs incurred to carry out those programs, including costs relating to oversight and management of the programs, recordkeeping, and implementation of the strategic plan developed under subsection (c).</text>
 </subsection><subsection id="HA5FA8F91A9624B5CA3C963158E2244AB"><enum>(j)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Not later than 60 days after the end of the second fiscal year beginning after the date of enactment of this section, each Secretary concerned shall submit to Congress a report—</text>
 <paragraph id="HEF6925F337154C7AAE1219932D524ADD"><enum>(1)</enum><text>describing the use by the Secretary concerned during the 2 preceding fiscal years of funds for programs that address or include invasive species management; and</text>
 </paragraph><paragraph id="HFC8D4D9B3F424B92A197B3264004EADA"><enum>(2)</enum><text>specifying the percentage of funds expended for each of the purposes specified in subsections (g), (h), and (i).</text>
								</paragraph></subsection><subsection id="H26851E741BAE415D95BA43C21AF7DA3F"><enum>(k)</enum><header>Relation to other authority</header>
 <paragraph id="H1ADFA62316484F868909E34DE1BE8EFE"><enum>(1)</enum><header>Other invasive species control, prevention, and management authorities</header><text display-inline="yes-display-inline">Nothing in this section precludes the Secretary concerned from pursuing or supporting, pursuant to any other provision of law, any activity regarding the control, prevention, or management of an invasive species, including investigations to improve the control, prevention, or management of the invasive species.</text>
 </paragraph><paragraph id="H8FB0BDF3912B46429429E886BBCBBBF1"><enum>(2)</enum><header>Public water supply systems</header><text display-inline="yes-display-inline">Nothing in this section authorizes the Secretary concerned to suspend any water delivery or diversion, or otherwise to prevent the operation of a public water supply system, as a measure to control, manage, or prevent the introduction or spread of an invasive species.</text>
 </paragraph></subsection><subsection id="HF1EBF9EBAD1E4C58BD83830F47900DE2"><enum>(l)</enum><header>Use of partnerships</header><text display-inline="yes-display-inline">Subject to the subsections (m) and (n), the Secretary concerned may enter into any contract or cooperative agreement with another Federal agency, an eligible State, a political subdivision of an eligible State, or a private individual or entity to assist with the control and management of an invasive species.</text>
							</subsection><subsection id="H1BB8EC41EACE4C5BAC2B75239966A2E8"><enum>(m)</enum><header>Memorandum of understanding</header>
 <paragraph id="H8F8958FAF3D54614AA3AA104E080F25F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of a contract or cooperative agreement under subsection (l), the Secretary concerned and the applicable Federal agency, eligible State, political subdivision of an eligible State, or private individual or entity shall enter into a memorandum of understanding that describes—</text>
 <subparagraph id="id1FBB3A15698344CC9BF7ABDEB41D997D"><enum>(A)</enum><text display-inline="yes-display-inline">the nature of the partnership between the parties to the memorandum of understanding; and</text>
 </subparagraph><subparagraph id="idFB45A6F427C9427693FA38ECB50D3D2C"><enum>(B)</enum><text display-inline="yes-display-inline">the control and management activities to be conducted under the contract or cooperative agreement.</text> </subparagraph></paragraph><paragraph id="H06471B71D3C5429DB36EF44575FBA456"><enum>(2)</enum><header>Contents</header><text>A memorandum of understanding under this subsection shall contain, at a minimum, the following:</text>
 <subparagraph id="H3C794983DAEC4C28AC357117F3752959"><enum>(A)</enum><text>A prioritized listing of each invasive species to be controlled or managed.</text> </subparagraph><subparagraph id="HA2DB289F82A7424290A889FBAE539252"><enum>(B)</enum><text>An assessment of the total acres of land or area of water infested by the invasive species.</text>
 </subparagraph><subparagraph id="H83F7BFE5D5054E49B7077B48F4782E1E"><enum>(C)</enum><text>An estimate of the expected total acres of land or area of water infested by the invasive species after control and management of the invasive species is attempted.</text>
 </subparagraph><subparagraph id="H90FC24558BB14706ACDDABE99DBC096C"><enum>(D)</enum><text>A description of each specific, integrated pest management option to be used, including a comparative economic assessment to determine the least-costly method.</text>
 </subparagraph><subparagraph id="H2BF4AD781F2546E79F8165C827B60ECA"><enum>(E)</enum><text>Any map, boundary, or Global Positioning System coordinates needed to clearly identify the area in which each control or management activity is proposed to be conducted.</text>
 </subparagraph><subparagraph id="H6B7C2F017EB544AF86B1CEF3795C96EB"><enum>(F)</enum><text display-inline="yes-display-inline">A written assurance that each partner will comply with section 15 of the Federal Noxious Weed Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/7/2814">7 U.S.C. 2814</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="HBBCC8E73CBDE4DDCA4A60CC0EE833162"><enum>(3)</enum><header>Coordination</header><text display-inline="yes-display-inline">If a partner to a contract or cooperative agreement under subsection (l) is an eligible State, political subdivision of an eligible State, or private individual or entity, the memorandum of understanding under this subsection shall include a description of—</text>
 <subparagraph id="id05E73A8AE4CF43A385B6967552992AD8"><enum>(A)</enum><text display-inline="yes-display-inline">the means by which each applicable control or management effort will be coordinated; and</text>
 </subparagraph><subparagraph id="id4989BD3A8EDA46D3931A6E160D62ADD7"><enum>(B)</enum><text display-inline="yes-display-inline">the expected outcomes of managing and controlling the invasive species.</text>
 </subparagraph></paragraph><paragraph id="H104014E6E8E941B1805DA7912ECB4705"><enum>(4)</enum><header>Public outreach and awareness efforts</header><text display-inline="yes-display-inline">If a contract or cooperative agreement under subsection (l) involves any outreach or public awareness effort, the memorandum of understanding under this subsection shall include a list of goals and objectives for each outreach or public awareness effort that have been determined to be efficient to inform national, regional, State, or local audiences regarding invasive species control and management.</text>
 </paragraph></subsection><subsection id="H134A1955D7BF41899E069FFD0BBCAE63"><enum>(n)</enum><header>Investigations</header><text display-inline="yes-display-inline">The purpose of any invasive species-related investigation carried out under a contract or cooperative agreement under subsection (l) shall be—</text>
 <paragraph id="HE48B92EDAB7B46129289CA2363DC46E6"><enum>(1)</enum><text display-inline="yes-display-inline">to develop solutions and specific recommendations for control and management of invasive species; and</text>
 </paragraph><paragraph id="HD4E4614EDB234312A23378CA3EDBC42F"><enum>(2)</enum><text>specifically to provide faster implementation of control and management methods.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD10A2B20B12C42ECBC74F73F86A2EF6E"><enum>(o)</enum><header>Coordination with affected local governments</header><text display-inline="yes-display-inline">Each project and activity carried out pursuant to this section shall be coordinated with affected local governments in a manner that is consistent with section 202(c)(9) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)(9)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection commented="no" display-inline="no-display-inline" id="idebdd8177-0c34-400a-801f-f1b19a75ed74"><enum>(a)</enum><header display-inline="yes-display-inline"> Reauthorization of the African Elephant Conservation Act</header><text display-inline="yes-display-inline">Section 2306(a) of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4245">16 U.S.C. 4245(a)</external-xref>) is amended by striking <quote>2007 through 2012</quote> and inserting <quote>2018 through 2022</quote>.</text> </subsection><subsection commented="no" display-inline="no-display-inline" id="id97783ee7-5afa-4da6-90b4-b8af1c833934"><enum>(b)</enum><header display-inline="yes-display-inline"> Reauthorization of the Asian Elephant Conservation Act of 1997</header><text display-inline="yes-display-inline">Section 8(a) of the Asian Elephant Conservation Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/16/4266">16 U.S.C. 4266(a)</external-xref>) is amended by striking <quote>2007 through 2012</quote> and inserting <quote>2018 through 2022</quote>.</text>

 <paragraph commented="no" display-inline="no-display-inline" id="id041FA2B3212E4111ACBB565F9CBA4CF7"><enum>(1)</enum><header>Panel</header><text display-inline="yes-display-inline">Section 4(i) of the Great Ape Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6303">16 U.S.C. 6303(i)</external-xref>) is amended—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idBC167065CB9F483B9B3F6F7DC2134E93"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text>

 </subparagraph><subparagraph id="id7CF36F8CCF7A4CE5BF0294FEAE799526"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (5); and</text> </subparagraph><subparagraph id="id1374A3ECC8754A6FA3B278F627839CAC"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text>

 <subparagraph id="id3F75F2FF43194F6E8CF0204F27ECD9AB"><enum>(A)</enum><text display-inline="yes-display-inline">from each country that comprises the natural range of great apes; and</text> </subparagraph><subparagraph id="id0AE38F5D501646D389046FE11008AF48"><enum>(B)</enum><text display-inline="yes-display-inline">with expertise in great ape conservation.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF82F04D40C394A7A930BBC1A00A6E794"><enum>(3)</enum><header>Conservation plans</header><text display-inline="yes-display-inline">In identifying the conservation needs and priorities under paragraph (1), the panel referred to in that paragraph shall consider any relevant great ape conservation plan or strategy, including scientific research and findings relating to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id5E3D1BF40393435C8A094CA064CDC803"><enum>(A)</enum><text display-inline="yes-display-inline">the conservation needs and priorities of great apes;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AA8D53B3D8843F3A88CF1DF5E8BB3C4"><enum>(B)</enum><text display-inline="yes-display-inline">any regional or species-specific action plan or strategy;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51CB134B540C4D42AE9DC585610CF32F"><enum>(C)</enum><text display-inline="yes-display-inline">any applicable strategy developed or initiated by the Secretary; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5BE58453798940B2B21F8312D0057FC3"><enum>(D)</enum><text display-inline="yes-display-inline">any other applicable conservation plan or strategy.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E5099C4F0FE4555AD7645BE59AE8404"><enum>(4)</enum><header>Funds</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary may use amounts available to the Secretary to pay for the costs of convening and facilitating any meeting of the panel referred to in paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb42fc993-59ea-46bd-bab9-5a0edb85257e"><enum>(2)</enum><header display-inline="yes-display-inline">Multiyear grants</header><text display-inline="yes-display-inline">Section 4 of the Great Ape Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6303">16 U.S.C. 6303</external-xref>) is amended by adding at the end the following:</text>

 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id411fae73-7747-4ef0-a936-077682181d32"><enum>(2)</enum><header display-inline="yes-display-inline">Effect of subsection</header><text display-inline="yes-display-inline">Nothing in this subsection precludes the Secretary from awarding a grant on an annual basis.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

 <subsection id="idB621C99409C84AC08B7B412C02B3D05F"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idFC19C308A3B84C0EA1F53EB1F5EA2AE9"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Prevention of Wildlife Poaching and Trafficking Technology Advisory Board established by subsection (c)(1).</text>
 </paragraph><paragraph id="idB49E4E5376314ADBB7149C263D730D85"><enum>(2)</enum><header>Prize competition</header><text>The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for the prevention of wildlife poaching and trafficking established under subsection (b).</text>
 </paragraph></subsection><subsection id="id9845C3A2B21A462F9146CE0929638078"><enum>(b)</enum><header>Authority</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize</quote> for the prevention of wildlife poaching and trafficking—</text>
 <paragraph id="id55D59A9EEDBB4779AD44567103EACFAF"><enum>(1)</enum><text>to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to the prevention of wildlife poaching and trafficking; and</text>
 </paragraph><paragraph id="id2291AC1C28F847F9883F32B4A6BB2781"><enum>(2)</enum><text>to award 1 or more prizes annually for a technological advancement that prevents wildlife poaching and trafficking.</text>
					</paragraph></subsection><subsection id="id75D2401051B04D23AD420C7EB670A66E"><enum>(c)</enum><header>Advisory board</header>
 <paragraph id="id5C00FA0E6C914E758F7DE9C7A3F946A1"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory board, to be known as the <quote>Prevention of Wildlife Poaching and Trafficking Technology Advisory Board</quote>.</text> </paragraph><paragraph id="id64E8D1ECF03246AC98A62278F7FCD427"><enum>(2)</enum><header>Composition</header><text>The Board shall be composed of not fewer than 9 members appointed by the Secretary, who shall provide expertise in—</text>
 <subparagraph id="id84FFB014B7AC48B99156D785E40A7E21"><enum>(A)</enum><text>wildlife trafficking and trade;</text> </subparagraph><subparagraph id="idC9B6D089F6854A6B84409A604B2E7E3A"><enum>(B)</enum><text>wildlife conservation and management;</text>
 </subparagraph><subparagraph id="idF7E5C5868FC54BCF82BD7BE57FF443E2"><enum>(C)</enum><text>biology;</text> </subparagraph><subparagraph id="idBC34E8A9FBD841778120B4F58B834830"><enum>(D)</enum><text>technology development;</text>
 </subparagraph><subparagraph id="id3C881991A9DF43C4A6F58C679A2EF936"><enum>(E)</enum><text>engineering;</text> </subparagraph><subparagraph id="idAFF9389E12864AA2A9D8C6876EA011DB"><enum>(F)</enum><text>economics;</text>
 </subparagraph><subparagraph id="idB3926E1B1F0B4E45A5E8E8DF12165597"><enum>(G)</enum><text>business development and management; and</text> </subparagraph><subparagraph id="idB26304937BFB4389A140BD7EAA3193D7"><enum>(H)</enum><text>any other discipline, as the Secretary determines to be necessary to achieve the purposes of this section.</text>
 </subparagraph></paragraph><paragraph id="id6C0DB5F6FE4B4627A864A11B3CA84472"><enum>(3)</enum><header>Duties</header><text>Subject to paragraph (4), with respect to the prize competition, the Board shall—</text> <subparagraph id="id6A05A62F7D5C45CC97A4E6C7E6C86687"><enum>(A)</enum><text>select a topic;</text>
 </subparagraph><subparagraph id="id6A457E6C7FE9409A8D0EE3AB05EA1858"><enum>(B)</enum><text>issue a problem statement; and</text> </subparagraph><subparagraph id="id52E5527961714153ACD2C655442334ED"><enum>(C)</enum><text>advise the Secretary on any opportunity for technological innovation to prevent wildlife poaching and trafficking.</text>
 </subparagraph></paragraph><paragraph id="idE3F29BABC9204FF09D498205F6035A4C"><enum>(4)</enum><header>Consultation</header><text>In selecting a topic and issuing a problem statement for the prize competition under subparagraphs (A) and (B) of paragraph (3), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text>
 <subparagraph id="id5A8FBE9FF297418082B7600830664708"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the prevention of wildlife poaching and trafficking;</text>
 </subparagraph><subparagraph id="id8BBDAA0DE32946C2B651F65F8460D08A"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the prevention of wildlife poaching and trafficking;</text>
 </subparagraph><subparagraph id="id4267635BDA4740B4AAA9141FB035C9EE"><enum>(C)</enum><text>1 or more State, regional, or local wildlife organizations, the mission of which relates to the prevention of wildlife poaching and trafficking; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD79844591D45429FABF50CFD590F7DE7"><enum>(D)</enum><text>1 or more wildlife conservation groups, technology companies, research institutions, institutions of higher education, industry associations, or individual stakeholders with an interest in the prevention of wildlife poaching and trafficking.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB1DEDEB153C64F7B8F9DB1E87342C4F9"><enum>(5)</enum><header>Requirements</header><text>The Board shall comply with all requirements under section 4006(a).</text> </paragraph></subsection><subsection id="idE19266E9B59A413CBC789A520A7F3A36"><enum>(d)</enum><header>Agreement with the National Fish and Wildlife Foundation</header> <paragraph id="id98E4224AE04D47A28F0F3E8B4C134ECD"><enum>(1)</enum><header>In general</header><text>The Secretary shall offer to enter into an agreement under which the National Fish and Wildlife Foundation shall administer the prize competition.</text>
 </paragraph><paragraph id="id2BD48BF431B248F5B0CD931A45A49C93"><enum>(2)</enum><header>Requirements</header><text>An agreement entered into under paragraph (1) shall comply with all requirements under section 4006(b).</text>
					</paragraph></subsection><subsection id="id19015B799A3343359F1683B52F3349DC"><enum>(e)</enum><header>Judges</header>
 <paragraph id="id348A0B77C22C488B8078B89554B3719D"><enum>(1)</enum><header>Appointment</header><text>The Secretary shall appoint not fewer than 3 judges who shall, except as provided in paragraph (2), select the 1 or more annual winners of the prize competition.</text>
 </paragraph><paragraph id="id0C63FCA7AB6D4F23B8C955A302FEC792"><enum>(2)</enum><header>Determination by the Secretary</header><text>The judges appointed under paragraph (1) shall not select any annual winner of the prize competition if the Secretary makes a determination that, in any fiscal year, none of the technological advancements entered into the prize competition merits an award.</text>
 </paragraph></subsection><subsection id="id4A84A87CDE7746B39C3001A1BC1DDFB5"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 60 days after the date on which a cash prize is awarded under this section, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report on the prize competition that includes—</text>
 <paragraph id="id5C9D437F7B9B4FEFBD1C3550562B668C"><enum>(1)</enum><text>a statement by the Board that describes the activities carried out by the Board relating to the duties described in subsection (c)(3);</text>
 </paragraph><paragraph id="id81BF8B60A33C43F1B16B99B83018EF97"><enum>(2)</enum><text>if the Secretary has entered into an agreement under subsection (d)(1), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in section 4006(b); and</text>
 </paragraph><paragraph id="idE7926B3A2B6B40D4A47F50EC84408287"><enum>(3)</enum><text>a statement by 1 or more of the judges appointed under subsection (e) that explains the basis on which the winner of the cash prize was selected.</text>
 </paragraph></subsection><subsection id="idFCE6AD36376947A2ACF004AC7EE44D7A"><enum>(g)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this section shall terminate on December 31, 2022.</text>

					</paragraph></subsection><subsection id="id45A0A87D6D5E4E36BE60FC513D3F58EB"><enum>(e)</enum><header>Judges</header>
 <paragraph id="id7BBF954793B748BF8BBBE906B1EC3968"><enum>(1)</enum><header>Appointment</header><text>The Secretary shall appoint not fewer than 3 judges who shall, except as provided in paragraph (2), select the 1 or more annual winners of the prize competition.</text>
 </paragraph><paragraph id="id32B0930A39F44CF89D35D8256D611454"><enum>(2)</enum><header>Determination by the Secretary</header><text>The judges appointed under paragraph (1) shall not select any annual winner of the prize competition if the Secretary makes a determination that, in any fiscal year, none of the technological advancements entered into the prize competition merits an award.</text>
 </paragraph></subsection><subsection id="id9A144EB1575E4F0AA6128B7976EFF7F8"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 60 days after the date on which a cash prize is awarded under this section, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report on the prize competition that includes—</text>
 <paragraph id="id902175B907944A059F607B963F431D09"><enum>(1)</enum><text>a statement by the Board that describes the activities carried out by the Board relating to the duties described in subsection (c)(3);</text>
 </paragraph><paragraph id="idAB9004C2096948BCAE7C541148671859"><enum>(2)</enum><text>if the Secretary has entered into an agreement under subsection (d)(1), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in section 4006(b); and</text>
 </paragraph><paragraph id="id1D29CC0322D241218D1D6024C130C0D9"><enum>(3)</enum><text>a statement by 1 or more of the judges appointed under subsection (e) that explains the basis on which the winner of the cash prize was selected.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6683F43073CF4FCEA85C14A3EC4A7F61"><enum>(g)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this section shall terminate on December 31, 2022.</text>
				</subsection></section><section changed="deleted" id="idD83D016D37914F46A44CB88D4EE0CF48" reported-display-style="strikethrough"><enum>4005.</enum><header>Theodore Roosevelt Genius Prize for the protection of endangered species</header>
 <subsection id="idB8A2C1C6C70147F58D472891E61AFF65"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idAC98C5B2095E432EA0C7327515C02826"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Protection of Endangered Species Technology Advisory Board established by subsection (c)(1).</text>
 </paragraph><paragraph id="id284D06F3DE88486B9203DA53A3F51D0F"><enum>(2)</enum><header>Prize competition</header><text>The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for the protection of endangered species established under subsection (b).</text>
 </paragraph></subsection><subsection id="idC6D6E0733E0749B7917208D8D784C42E"><enum>(b)</enum><header>Authority</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize</quote> for the protection of endangered species—</text>
 <paragraph id="id1D6DB175F6B54AB1BC26F673A581703D"><enum>(1)</enum><text>to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to the protection of endangered species; and</text>
 </paragraph><paragraph id="id6478691AAC814262979BC54AA0EEEED9"><enum>(2)</enum><text>to award 1 or more prizes annually for a technological advancement that protects endangered species.</text>
					</paragraph></subsection><subsection id="id710139713C9D4F69A741592DB17FC572"><enum>(c)</enum><header>Advisory board</header>
 <paragraph id="idA5B8068F4B0A45CCBE4786B2F6711F8A"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory board, to be known as the <quote>Protection of Endangered Species Technology Advisory Board</quote>.</text> </paragraph><paragraph id="id9B4BA0E3C7BD4C74A91F973DA98D67A0"><enum>(2)</enum><header>Composition</header><text>The Board shall be composed of not fewer than 9 members appointed by the Secretary, who shall provide expertise in—</text>
 <subparagraph id="idAD924F3403D84F52BB5BE5AEE943E091"><enum>(A)</enum><text>endangered species;</text> </subparagraph><subparagraph id="id3CC359E95E304469B4DF2EE394490B7B"><enum>(B)</enum><text>biology;</text>
 </subparagraph><subparagraph id="id845B3B89483D415B85ED651E883B3145"><enum>(C)</enum><text>technology development;</text> </subparagraph><subparagraph id="id6B66FB172ED14F119F0290A5E998FEE4"><enum>(D)</enum><text>engineering;</text>
 </subparagraph><subparagraph id="idE9D7E7EEC3204A5FB42E603A6715AA48"><enum>(E)</enum><text>economics;</text> </subparagraph><subparagraph id="id4B731D395B2B44C181828B716A518CB6"><enum>(F)</enum><text>business development and management; and</text>
 </subparagraph><subparagraph id="id3F694F8A48A642ACAAB37808463A75EE"><enum>(G)</enum><text>any other discipline, as the Secretary determines to be necessary to achieve the purposes of this section.</text>
 </subparagraph></paragraph><paragraph id="id83A482FB5A734F739F826F5F3090DBEC"><enum>(3)</enum><header>Duties</header><text>Subject to paragraph (4), with respect to the prize competition, the Board shall—</text> <subparagraph id="id6D54E9C711BA4B07AE9A0CE536926CA9"><enum>(A)</enum><text>select a topic;</text>
 </subparagraph><subparagraph id="id512DE9CE0AC04F189F3C6163D01F6611"><enum>(B)</enum><text>issue a problem statement; and</text> </subparagraph><subparagraph id="id2CE110316CB247B099D7EA933EE106C3"><enum>(C)</enum><text>advise the Secretary on any opportunity for technological innovation to protect endangered species.</text>
 </subparagraph></paragraph><paragraph id="id99158009D77D44DE855D298D359E86FE"><enum>(4)</enum><header>Consultation</header><text>In selecting a topic and issuing a problem statement for the prize competition under subparagraphs (A) and (B) of paragraph (3), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text>
 <subparagraph id="id5DEB5E8AB8124D79B10900A2D3D90B7B"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the protection of endangered species;</text> </subparagraph><subparagraph id="idDC4A38D3406446E6BDF0AEC9DF939596"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the protection of endangered species;</text>
 </subparagraph><subparagraph id="idCB2B4880FB8F4CF4A56EBF935F561F71"><enum>(C)</enum><text>1 or more State, regional, or local wildlife organizations, the mission of which relates to the protection of endangered species; and</text>
 </subparagraph><subparagraph id="id34CE8632C98849A3BC90AB5381CEFDAE"><enum>(D)</enum><text>1 or more wildlife conservation groups, technology companies, research institutions, institutions of higher education, industry associations, or individual stakeholders with an interest in the protection of endangered species.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60E8D267D32F433D818A8365DFE2078E"><enum>(5)</enum><header>Requirements</header><text>The Board shall comply with all requirements under section 4006(a).</text> </paragraph></subsection><subsection id="id1268D9507E5B451E89FDD1B6669F654E"><enum>(d)</enum><header>Agreement with the National Fish and Wildlife Foundation</header> <paragraph id="id96A336E313934A31949A86648F1FE70A"><enum>(1)</enum><header>In general</header><text>The Secretary shall offer to enter into an agreement under which the National Fish and Wildlife Foundation shall administer the prize competition.</text>
 </paragraph><paragraph id="id5DDCCC6AAD044F8CB9BC704D365AA5CB"><enum>(2)</enum><header>Requirements</header><text>An agreement entered into under paragraph (1) shall comply with all requirements under section 4006(b).</text>
					</paragraph></subsection><subsection id="idB6C2A1AFE7474AD983C6BB04001716AA"><enum>(e)</enum><header>Judges</header>
 <paragraph id="idE118310DA1C648198ABBB271DB71655D"><enum>(1)</enum><header>Appointment</header><text>The Secretary shall appoint not fewer than 3 judges who shall, except as provided in paragraph (2), select the 1 or more annual winners of the prize competition.</text>

 </paragraph><paragraph id="id58369F6A72944E32B08D6464F8069B69"><enum>(2)</enum><text>if the Secretary has entered into an agreement under subsection (d)(1), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in section 4006(b); and</text>
 </paragraph><paragraph id="id6594FEF0223D45B18B531EFF17F347C7"><enum>(3)</enum><text>a statement by 1 or more of the judges appointed under subsection (e) that explains the basis on which the winner of the cash prize was selected.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEA685AEA13E1437580EFAE1E7D227775"><enum>(g)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this section shall terminate on December 31, 2022.</text>
				</subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="idB11BF13A9259486BA7DF09BE524A1C72" reported-display-style="strikethrough"><enum>4006.</enum><header>Administration of prize competitions</header>
 <subsection commented="no" display-inline="no-display-inline" id="id043B4F608E144873B24B654EC56CB3DA"><enum>(a)</enum><header>Additional requirements for advisory boards</header><text>An advisory board established under section 4002(c)(1), 4003(c)(1), 4004(c)(1), or 4005(c)(1) (referred to in this section as a <quote>Board</quote>) shall comply with the following requirements:</text>
					<paragraph id="idABD67406E9B2478792ACC25C7E0408EB"><enum>(1)</enum><header>Term; vacancies</header>
 <subparagraph id="idBE19651BBC65470888EDB2A6343EAED3"><enum>(A)</enum><header>Term</header><text>A member of the Board shall serve for a term of 5 years.</text> </subparagraph><subparagraph id="id8A2A8A179A4242E9A096124EDC208090"><enum>(B)</enum><header>Vacancies</header><text>A vacancy on the Board—</text>
 <clause id="idEB656589B6FD4859A85B8C2E9DD6C7E7"><enum>(i)</enum><text>shall not affect the powers of the Board; and</text> </clause><clause id="idB24D8B77435B4DB0AACEFA129772842B"><enum>(ii)</enum><text>shall be filled in the same manner as the original appointment was made.</text>
 </clause></subparagraph></paragraph><paragraph id="id8BBD3DD114654C2AB5B049713A24A1D0"><enum>(2)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Board have been appointed, the Board shall hold the initial meeting of the Board.</text>
					</paragraph><paragraph id="id4E0D8FC7410D4142A3BACB065B9FB758"><enum>(3)</enum><header>Meetings</header>
 <subparagraph id="idFA196336252C4F8381FB1D7F37DA2030"><enum>(A)</enum><header>In general</header><text>The Board shall meet at the call of the Chairperson.</text>
						</subparagraph><subparagraph id="idFA4E218BEA9B4AF68EA786E8F6E48B91"><enum>(B)</enum><header>Remote participation</header>
 <clause id="id21CB77DA82CB4EE3AF5745DD30A3FE2F"><enum>(i)</enum><header>In general</header><text>Any member of the Board may participate in a meeting of the Board through the use of—</text> <subclause id="id4CA6EEAC419C4E63A579B1265F959EE3"><enum>(I)</enum><text>teleconferencing; or</text>
 </subclause><subclause id="id8E16A34CDD3745DCBF77520431B1998E"><enum>(II)</enum><text>any other remote business telecommunications method that allows each participating member to simultaneously hear each other participating member during the meeting.</text>
 </subclause></clause><clause id="id67FD613C15574DB08B474563495A075B"><enum>(ii)</enum><header>Presence</header><text>A member of the Board who participates in a meeting remotely under clause (i) shall be considered to be present at the meeting.</text>
 </clause></subparagraph></paragraph><paragraph id="id081ABA50C1A54B559CE3B11EFBA0A504"><enum>(4)</enum><header>Quorum</header><text>A majority of the members of the Board shall constitute a quorum, but a lesser number of members may hold a meeting.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id395F45AE844940C88229AB2B140403FF"><enum>(5)</enum><header>Chairperson and Vice Chairperson</header><text>The Board shall select a Chairperson and Vice Chairperson from among the members of the Board.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3C4974138FED469AA29C88BEF8A4E07B"><enum>(6)</enum><header display-inline="yes-display-inline">Administrative cost reduction</header><text display-inline="yes-display-inline">The Board shall, to the maximum extent practicable, minimize the administrative costs of the Board, including by encouraging the remote participation described in paragraph (3)(B)(i) to reduce travel costs.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB83BDD1E7AF64533841108B3D5CA154D"><enum>(b)</enum><header>Agreements with the National Fish and Wildlife Foundation</header><text>Any agreement entered into under section 4002(d)(1), 4003(d)(1), 4004(d)(1), or 4005(d)(1) shall comply with the following requirements:</text>
 <paragraph id="idF46CD65D5B384890A55C762743115038"><enum>(1)</enum><header>Contents</header><text>An agreement shall provide the following:</text> <subparagraph id="idCE4170AF8F1F4CC2BC4F8055AB56BC2B"><enum>(A)</enum><header>Duties</header><text>The National Fish and Wildlife Foundation shall—</text>
 <clause id="id310D2971E4B14298864BB607E1DBAA54"><enum>(i)</enum><text>advertise the prize competition;</text> </clause><clause id="id54CC06B1B29049F3929B4EA3C3CC0027"><enum>(ii)</enum><text>solicit prize competition participants;</text>
 </clause><clause id="id845E7892BEB04CA8AF6E2B7F1FD96A00"><enum>(iii)</enum><text>administer funds relating to the prize competition;</text> </clause><clause id="id83AC55B0C00544B187055978F5C61A19"><enum>(iv)</enum><text>receive Federal funds—</text>
 <subclause id="id9DEC33F36F12471AA4EE25DDC1FA7289"><enum>(I)</enum><text>to administer the prize competition; and</text> </subclause><subclause id="id5E850D094F424600A6DE6C61D38A2376"><enum>(II)</enum><text>to award a cash prize;</text>
 </subclause></clause><clause id="id445FD7D5557D4016A04696D52B210D30"><enum>(v)</enum><text>carry out activities to generate contributions of non-Federal funds to offset, in whole or in part—</text>
 <subclause id="id88F0F3D95AE149078C58721473D7AF98"><enum>(I)</enum><text>the administrative costs of the prize competition; and</text> </subclause><subclause id="id562DEDDF296747EFB5800DE9CB9563DD"><enum>(II)</enum><text>the costs of a cash prize;</text>
 </subclause></clause><clause id="idF6F31E8F435544DB9C491D6F2DB0DF62"><enum>(vi)</enum><text>in consultation with, and subject to final approval by, the Secretary, develop criteria for the selection of prize competition winners;</text>
 </clause><clause id="idE93628D9F44F4FFBB2D4D2EFEE5E652D"><enum>(vii)</enum><text>provide advice and consultation to the Secretary on the selection of judges under sections 4002(e), 4003(e), 4004(e), and 4005(e) based on criteria developed in consultation with, and subject to the final approval of, the Secretary;</text>
 </clause><clause id="id265B2F4F100B4FD084942D051934EDFF"><enum>(viii)</enum><text>announce 1 or more annual winners of the prize competition;</text> </clause><clause id="id3E2B6BD246264823B62F6676ECD30960"><enum>(ix)</enum><text>subject to subparagraph (B), award 1 cash prize annually; and</text>
 </clause><clause id="id0C47E0D3D7FE4B4C941017550D636E53"><enum>(x)</enum><text>protect against unauthorized use or disclosure by the National Fish and Wildlife Foundation of any trade secret or confidential business information of a prize competition participant.</text>
 </clause></subparagraph><subparagraph id="id2B01B904B7F54EE3859F51BE74304777"><enum>(B)</enum><header>Additional cash prizes</header><text>The National Fish and Wildlife Foundation may award more than 1 cash prize annually if the initial cash prize referred to in subparagraph (A)(ix) and any additional cash prize are awarded using only non-Federal funds.</text>
 </subparagraph><subparagraph id="id7329D0B18567405F92E8F81C31069923"><enum>(C)</enum><header>Solicitation of funds</header><text>The National Fish and Wildlife Foundation—</text> <clause id="id820CF6D52A31408BA288A736710309A7"><enum>(i)</enum><text>may request and accept Federal funds and non-Federal funds for a cash prize;</text>
 </clause><clause id="idF79CD69087AC4E02A9368DF55C661D72"><enum>(ii)</enum><text>may accept a contribution for a cash prize in exchange for the right to name the prize; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id732DCA7F923E43BB95E376ADF30F15BC"><enum>(iii)</enum><text>shall not give special consideration to any Federal agency or non-Federal entity in exchange for a donation for a cash prize awarded under this section.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id862023113B884941AFF7EFB3D903AE18"><enum>(c)</enum><header>Award amounts</header>
 <paragraph id="idE35219216F0E4354A958AAE63F3EFEA4"><enum>(1)</enum><header>In general</header><text>The amount of the initial cash prize referred to in subsection (b)(1)(A)(ix) shall be $100,000.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3BD1C9ED2887431BA05EEEAC1780F95F"><enum>(2)</enum><header>Additional cash prizes</header><text>On notification by the National Fish and Wildlife Foundation that non-Federal funds are available for an additional cash prize, the Secretary shall determine the amount of the additional cash prize.</text>

 </subsection><subsection id="id9F7934C45962443388C37A95FEE781FE"><enum>(b)</enum><header>Protection of water, oceans, coasts, and wildlife from invasive species</header><text>The Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/661">16 U.S.C. 661</external-xref> et seq.) is amended by adding at the end the following:</text>

						<section id="id3E7E584B24934ED288001A06919D19DA"><enum>10.</enum><header>Protection of water, oceans, coasts, and wildlife from invasive species</header>
 <subsection id="idC35AB54464B6469AAD5A2BCDC7C11ECB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="idF055BA022CA6409DBA1B710B4E06F5A6"><enum>(1)</enum><header>Control</header><text>The term <term>control</term>, with respect to an invasive species, means the eradication, suppression, or reduction of the population of the invasive species within the area in which the invasive species is present.</text>
 </paragraph><paragraph id="idC2432E0DE42A45CF82D4CD2745CC6AE4"><enum>(2)</enum><header>Ecosystem</header><text display-inline="yes-display-inline">The term <term>ecosystem</term> means the complex of a community of organisms and the environment of the organisms.</text> </paragraph><paragraph id="id4A2B5A005E044E79B130164D540BF125"><enum>(3)</enum><header>Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means any of—</text>
 <subparagraph id="idCB922105C4884B6A96DF8F9D8E093602"><enum>(A)</enum><text display-inline="yes-display-inline">a State;</text> </subparagraph><subparagraph id="idCAFD62BAC3E24D929F4F064CEEF06334"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text>
 </subparagraph><subparagraph id="id3DBDE4AB934A4AC9A9177D7CDD3DCAFA"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text> </subparagraph><subparagraph id="id0EA1924C6713491C8F5FF71A2471F579"><enum>(D)</enum><text display-inline="yes-display-inline">Guam;</text>
 </subparagraph><subparagraph id="id8E37775DBC2D465FB661DC6C8CE8E672"><enum>(E)</enum><text display-inline="yes-display-inline">American Samoa;</text> </subparagraph><subparagraph id="id2B900D1D946541ECB6BA5AB7D8DEA836"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text>
 </subparagraph><subparagraph id="id6DCDE3A21D10415FB1067CD19BD4B7EE"><enum>(G)</enum><text display-inline="yes-display-inline">the United States Virgin Islands.</text> </subparagraph></paragraph><paragraph id="id5A615D880304448492624186C60050D9"><enum>(4)</enum><header>Invasive species</header> <subparagraph id="id03664EE39BD8480A955D7361480F4937"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>invasive species</term> means an alien species, the introduction of which causes, or is likely to cause, economic or environmental harm or harm to human health.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id100C7F0982E2424CA438FBD5EAC15A80"><enum>(B)</enum><header display-inline="yes-display-inline">Associated definition</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <term>alien species</term>, with respect to a particular ecosystem, means any species (including the seeds, eggs, spores, or other biological material of the species that are capable of propagating the species) that is not native to the affected ecosystem.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF08D8E4A2AD3423C84BAAF97B1A5EAC9"><enum>(C)</enum><header>Inclusion</header><text>The terms <term>invasive species</term> and <term>alien species</term> include any terrestrial or aquatic species determined by the relevant tribal, regional, State, or local authority to meet the requirements of subparagraph (A) or (B), as applicable.</text>
 </subparagraph></paragraph><paragraph id="idB9A72AAC8374448CB9A159F82E8CF2A7"><enum>(5)</enum><header>Manage; management</header><text>The terms <term>manage</term> and <term>management</term>, with respect to an invasive species, mean the active implementation of any activity—</text> <subparagraph id="idC88A356A51C04198B8583A9D6A198761"><enum>(A)</enum><text>to reduce or stop the spread of the invasive species; and</text>
 </subparagraph><subparagraph id="id7DBA0BEEC30444EA9098B7B957C8C3FF"><enum>(B)</enum><text>to inhibit further infestations of the invasive species, the spread of the invasive species, or harm caused by the invasive species, including investigations regarding methods for early detection and rapid response, prevention, control, or management of the invasive species.</text>
 </subparagraph></paragraph><paragraph id="id550F25E458574B3A825293E05F56951E"><enum>(6)</enum><header>Prevent</header><text>The term <term>prevent</term>, with respect to an invasive species, means—</text> <subparagraph id="id3532930D799A4CD49A20DFF68D685D48"><enum>(A)</enum><text>to hinder the introduction of the invasive species onto land or water; or</text>
 </subparagraph><subparagraph id="idF6B849AAC4D9447C81B1918A9034574E"><enum>(B)</enum><text>to impede the spread of the invasive species within land or water by inspecting, intercepting, or confiscating invasive species threats prior to the establishment of the invasive species onto land or water of an eligible State.</text>
 </subparagraph></paragraph><paragraph id="id6A46073DDD6048EAADC44C7A78E6251C"><enum>(7)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text> <subparagraph id="id7D8302F7C8B54D43ACDBDBAB48452C1B"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of the Army, acting through the Chief of Engineers, with respect to Federal land administered by the Corps of Engineers;</text>
 </subparagraph><subparagraph id="id93B1ECFC85EA49B7BA07D52F79F2987C"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, with respect to Federal land administered by the Secretary of the Interior through—</text>
 <clause id="id800E751CE2B647EEA1987515DE8C431E"><enum>(i)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service;</text> </clause><clause id="id4D53483FB1E94BAE9A8616771C36B349"><enum>(ii)</enum><text display-inline="yes-display-inline">the Bureau of Indian Affairs;</text>
 </clause><clause id="id5B990D2A1AA045FF9564D8574866493D"><enum>(iii)</enum><text display-inline="yes-display-inline">the Bureau of Land Management;</text> </clause><clause id="id629D20EAE352494493B039BF0B5AB73E"><enum>(iv)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation; or</text>
 </clause><clause id="id20161BCC302C4A348915CF4007998B9B"><enum>(v)</enum><text display-inline="yes-display-inline">the National Park Service;</text> </clause></subparagraph><subparagraph id="id5387AE4B2832478F8C408A2F5A517D45"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to Federal land administered by the Secretary of Agriculture through the Forest Service; and</text>
 </subparagraph><subparagraph id="id09FE02B1A8404A2EBF3BDC704D85A2A7"><enum>(D)</enum><text>the head or a representative of any other Federal agency the duties of whom require planning relating to, and the treatment of, invasive species for the purpose of protecting water and wildlife on land and coasts and in oceans and water.</text>
 </subparagraph></paragraph><paragraph id="id7DE84039C1AC426DAA067FC7C0DD7D51"><enum>(8)</enum><header>Species</header><text display-inline="yes-display-inline">The term <term>species</term> means a group of organisms, all of which—</text> <subparagraph id="idE8C90B16EB194FC58D79F76A37377DAA"><enum>(A)</enum><text display-inline="yes-display-inline">have a high degree of genetic similarity;</text>
 </subparagraph><subparagraph id="idC07FF0B2565841A0B8F22E01FBBEE358"><enum>(B)</enum><text display-inline="yes-display-inline">are morphologically distinct;</text> </subparagraph><subparagraph id="id611A9704128F4DFD8233ECED5F0FAFC0"><enum>(C)</enum><text display-inline="yes-display-inline">generally—</text>
 <clause id="id3A38728D58B24774ACF10CFB8A22E297"><enum>(i)</enum><text display-inline="yes-display-inline">interbreed at maturity only among themselves; and</text> </clause><clause id="idFA49452F17F642A5A6F81335710902FC"><enum>(ii)</enum><text display-inline="yes-display-inline">produce fertile offspring; and</text>
 </clause></subparagraph><subparagraph id="idBBAFB6EB7C4349E2A84094608FACA749"><enum>(D)</enum><text display-inline="yes-display-inline">show persistent differences from members of allied groups of organisms.</text>
 </subparagraph></paragraph></subsection><subsection id="idB90D23E06FA8417B92DBED93B00F2C9F"><enum>(b)</enum><header>Control and management</header><text display-inline="yes-display-inline">Each Secretary concerned shall plan and carry out activities on land directly managed by the Secretary concerned to protect water and wildlife by controlling and managing invasive species—</text>
 <paragraph id="id87831BBDBD484BEC94B818DA71AE9708"><enum>(1)</enum><text display-inline="yes-display-inline">to inhibit or reduce the populations of invasive species; and</text>
 </paragraph><paragraph id="id08105758F5BB451D8EF6018761BD02B3"><enum>(2)</enum><text display-inline="yes-display-inline">to effectuate restoration or reclamation efforts.</text>
								</paragraph></subsection><subsection id="id9FDFFCAE1C1B4241906929933F8D02C6"><enum>(c)</enum><header>Strategic plan</header>
 <paragraph id="id8246024FD8FA40CCA9D4AA1BFBB8106C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each Secretary concerned shall develop a strategic plan for the implementation of the invasive species program to achieve, to the maximum extent practicable, a substantive annual net reduction of invasive species populations or infested acreage on land or water managed by the Secretary concerned.</text>
 </paragraph><paragraph id="id22524A0747684819A9DE9FC70E84ADCF"><enum>(2)</enum><header>Coordination</header><text>Each strategic plan under paragraph (1) shall be developed—</text> <subparagraph id="id3E62AB1A36C1404990B6A85DF7FC2138"><enum>(A)</enum><text>in coordination with affected—</text>
 <clause id="id2D443063501D4F9B9165E5067ECC3A12"><enum>(i)</enum><text>eligible States;</text> </clause><clause id="id77AECCAEF99F4D7890751C455241E3CC"><enum>(ii)</enum><text>political subdivisions of eligible States; and</text>
 </clause><clause id="id0BF5B8BDB5084C5AA6A4D9E887B47C49"><enum>(iii)</enum><text>federally recognized Indian tribes; and</text> </clause></subparagraph><subparagraph id="id53B44F6C4761459786616B79BBC917BC"><enum>(B)</enum><text>in accordance with the priorities established by 1 or more Governors of the eligible States in which an ecosystem affected by an invasive species is located.</text>
 </subparagraph></paragraph><paragraph id="id4364BBE28C524AFB8005913A57C0D71D"><enum>(3)</enum><header>Factors for consideration</header><text>In developing a strategic plan under this subsection, the Secretary concerned shall take into consideration the economic and ecological costs of action or inaction, as applicable.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id395C48E091E6463CA18B08D876D430E4"><enum>(d)</enum><header display-inline="yes-display-inline">Cost-effective methods</header><text display-inline="yes-display-inline">In selecting a method to be used to control or manage an invasive species as part of a specific control or management project conducted as part of a strategic plan developed under subsection (c), the Secretary concerned shall prioritize the use of methods that—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id666E3092230F4D4A81F05EABF030A1C6"><enum>(1)</enum><text display-inline="yes-display-inline">effectively control and manage invasive species, as determined by the Secretary concerned, based on sound scientific data;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id808451ECB5334891A06AA1DC2E894976"><enum>(2)</enum><text display-inline="yes-display-inline">minimize environmental impacts; and</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1559805727934643A577A19749C0DCC3"><enum>(3)</enum><text display-inline="yes-display-inline">control and manage invasive species in the least costly manner.</text>
 </paragraph></subsection><subsection id="id26A72C92C8894CC3929DD73B99E874A0"><enum>(e)</enum><header>Comparative economic assessment</header><text display-inline="yes-display-inline">To achieve compliance with subsection (d), the Secretary concerned shall require a comparative economic assessment of invasive species control and management methods to be conducted.</text>
							</subsection><subsection id="idA43942B45359456CB578986D39D1A936"><enum>(f)</enum><header>Expedited action</header>
 <paragraph id="id8CC3102E46344F17AE7A807CECE662B7"><enum>(1)</enum><header>In general</header><text>The Secretaries concerned shall use all tools and flexibilities available (as of the date of enactment of this section) to expedite the projects and activities described in paragraph (2).</text>
 </paragraph><paragraph id="id4CF8ACE687694F6D8E2281803FB389F3"><enum>(2)</enum><header>Description of projects and activities</header><text>A project or activity referred to in paragraph (1) is a project or activity—</text> <subparagraph id="id8FBE2B252B8B4AA3B89E75C88954E043"><enum>(A)</enum><text>to protect water or wildlife from an invasive species that, as determined by the Secretary concerned is, or will be, carried out on land or water that is—</text>
 <clause id="id4F2C9675E23E4D289F6A52311B209BB3"><enum>(i)</enum><text>directly managed by the Secretary concerned; and</text>
 </clause><clause id="id47A02BD11BF7490CBE16D171341E9871"><enum>(ii)</enum><text>located in an area that is—</text> <subclause id="id045068E19843413DB30F95B8443226DA"><enum>(I)</enum><text>at high risk for the introduction, establishment, or spread of invasive species; and</text>
 </subclause><subclause id="idDA231A9716AB4072865C42023DF30256"><enum>(II)</enum><text>determined by the Secretary concerned to require immediate action to address the risk identified in subclause (I); and</text>
 </subclause></clause></subparagraph><subparagraph id="id0BC2469D057E419984300C2A528183A3"><enum>(B)</enum><text>carried out in accordance with applicable agency procedures, including any applicable—</text> <clause id="id585728EE7A4948FE815BDB80FF1849C4"><enum>(i)</enum><text>land or resource management plan; or</text>
 </clause><clause id="id8D474AE6ED994360A98B9B45E0B8735F"><enum>(ii)</enum><text>land use plan.</text> </clause></subparagraph></paragraph></subsection><subsection id="id98EB65F47BE74444B15CCDF587FFA926"><enum>(g)</enum><header>Allocation of funding</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, the Secretary concerned shall use not less than 75 percent for on-the-ground control and management of invasive species, which may include—</text>
 <paragraph id="id28C391F68012447DB29B2749E4FF2073"><enum>(1)</enum><text>the purchase of necessary products, equipment, or services to conduct that control and management;</text> </paragraph><paragraph id="idCF92D044E690460BA7148890D5BDADC9"><enum>(2)</enum><text>the use of integrated pest management options, including options that use pesticides authorized for sale, distribution, or use under the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref> et seq.);</text>
 </paragraph><paragraph id="idCE289023CBC84D81856BC33D4D7364E1"><enum>(3)</enum><text>the use of biological control agents that are proven to be effective to reduce invasive species populations;</text>
 </paragraph><paragraph id="id4B5110646A1348AD83EE8FA728003841"><enum>(4)</enum><text>the use of revegetation or cultural restoration methods designed to improve the diversity and richness of ecosystems;</text>
 </paragraph><paragraph id="id035832D4B62141A4BAAB5D7B7A82F4DE"><enum>(5)</enum><text>the use of monitoring and detection activities for invasive species, including equipment, detection dogs, and mechanical devices;</text>
 </paragraph><paragraph id="id11503B5ADDB7409EACB6657D0A70B44E"><enum>(6)</enum><text>the use of appropriate methods to remove invasive species from a vehicle or vessel capable of conveyance; or</text>
 </paragraph><paragraph id="id4EBB91355FC445D89697BDC841B2181C"><enum>(7)</enum><text>the use of other effective mechanical or manual control methods.</text> </paragraph></subsection><subsection id="id4A8038A5E27741399150EF2A3A8F650E"><enum>(h)</enum><header>Investigations, outreach, and public awareness</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, the Secretary concerned may use not more than 15 percent for investigations, development activities, and outreach and public awareness efforts to address invasive species control and management needs.</text>
 </subsection><subsection id="id124125FE4FE747759E6A8946A821E651"><enum>(i)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Of the amount appropriated or otherwise made available to each Secretary concerned for a fiscal year for programs that address or include protection of land or water from an invasive species, not more than 10 percent may be used for administrative costs incurred to carry out those programs, including costs relating to oversight and management of the programs, recordkeeping, and implementation of the strategic plan developed under subsection (c).</text>
 </subsection><subsection id="id906ED1CE479841018BB34719E4CEF570"><enum>(j)</enum><header>Reporting requirements</header><text display-inline="yes-display-inline">Not later than 60 days after the end of the second fiscal year beginning after the date of enactment of this section, each Secretary concerned shall submit to Congress a report—</text>
 <paragraph id="id54AE7182C50741BF9D76647E19154E53"><enum>(1)</enum><text>describing the use by the Secretary concerned during the 2 preceding fiscal years of funds for programs that address or include invasive species management; and</text>
 </paragraph><paragraph id="idAD24E6697B274752B72AD6F788492EC2"><enum>(2)</enum><text>specifying the percentage of funds expended for each of the purposes specified in subsections (g), (h), and (i).</text>
								</paragraph></subsection><subsection id="idBFDE8075FFE543A69ECF96619AB202EE"><enum>(k)</enum><header>Relation to other authority</header>
 <paragraph id="id995B2F0DC33D420BBBB18B19F8E6B4E4"><enum>(1)</enum><header>Other invasive species control, prevention, and management authorities</header><text display-inline="yes-display-inline">Nothing in this section precludes the Secretary concerned from pursuing or supporting, pursuant to any other provision of law, any activity regarding the control, prevention, or management of an invasive species, including investigations to improve the control, prevention, or management of the invasive species.</text>
 </paragraph><paragraph id="id27BCEA24054B49FFB41BB085595C99DF"><enum>(2)</enum><header>Public water supply systems</header><text display-inline="yes-display-inline">Nothing in this section authorizes the Secretary concerned to suspend any water delivery or diversion, or otherwise to prevent the operation of a public water supply system, as a measure to control, manage, or prevent the introduction or spread of an invasive species.</text>
 </paragraph></subsection><subsection id="id871BC5813CC441A78D213C7AC11F84C7"><enum>(l)</enum><header>Use of partnerships</header><text display-inline="yes-display-inline">Subject to the subsections (m) and (n), the Secretary concerned may enter into any contract or cooperative agreement with another Federal agency, an eligible State, a political subdivision of an eligible State, or a private individual or entity to assist with the control and management of an invasive species.</text>
							</subsection><subsection id="idA7079C6042874D01AA32F7EEDF9F4D87"><enum>(m)</enum><header>Memorandum of understanding</header>
 <paragraph id="id9F6BA0CE86314203B8F3A2ED01FF31AC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of a contract or cooperative agreement under subsection (l), the Secretary concerned and the applicable Federal agency, eligible State, political subdivision of an eligible State, or private individual or entity shall enter into a memorandum of understanding that describes—</text>
 <subparagraph id="id02E6EABFB57B451A91207C2C7319BAA5"><enum>(A)</enum><text display-inline="yes-display-inline">the nature of the partnership between the parties to the memorandum of understanding; and</text>
 </subparagraph><subparagraph id="idCCB325E28197427DB13710B4B8CDBB1C"><enum>(B)</enum><text display-inline="yes-display-inline">the control and management activities to be conducted under the contract or cooperative agreement.</text> </subparagraph></paragraph><paragraph id="id29221E750E0944C682420EA1655D02A0"><enum>(2)</enum><header>Contents</header><text>A memorandum of understanding under this subsection shall contain, at a minimum, the following:</text>
 <subparagraph id="idE7F10B8F0E334F02B4AE7DE63942FC50"><enum>(A)</enum><text>A prioritized listing of each invasive species to be controlled or managed.</text> </subparagraph><subparagraph id="id058665FD0F4542A8AAD6469E35130A87"><enum>(B)</enum><text>An assessment of the total acres of land or area of water infested by the invasive species.</text>
 </subparagraph><subparagraph id="idE7B4F081EF1E40ED85136EBB381D0700"><enum>(C)</enum><text>An estimate of the expected total acres of land or area of water infested by the invasive species after control and management of the invasive species is attempted.</text>
 </subparagraph><subparagraph id="idF0A6A702178D430683FF83441E803BDE"><enum>(D)</enum><text>A description of each specific, integrated pest management option to be used, including a comparative economic assessment to determine the least-costly method.</text>
 </subparagraph><subparagraph id="idCC579173E2644BE1AB3574893EB21CCA"><enum>(E)</enum><text>Any map, boundary, or Global Positioning System coordinates needed to clearly identify the area in which each control or management activity is proposed to be conducted.</text>
 </subparagraph><subparagraph id="id178C92BF23174CCC9EF41225A9C8761E"><enum>(F)</enum><text display-inline="yes-display-inline">A written assurance that each partner will comply with section 15 of the Federal Noxious Weed Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/7/2814">7 U.S.C. 2814</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idD293B99B75AB460C99D1311E0F69639D"><enum>(3)</enum><header>Coordination</header><text display-inline="yes-display-inline">If a partner to a contract or cooperative agreement under subsection (l) is an eligible State, political subdivision of an eligible State, or private individual or entity, the memorandum of understanding under this subsection shall include a description of—</text>
 <subparagraph id="id2E41A7DC22844BF7845E6E77296C80CF"><enum>(A)</enum><text display-inline="yes-display-inline">the means by which each applicable control or management effort will be coordinated; and</text>
 </subparagraph><subparagraph id="id5FC18C05A747460E83DADBF4798A6CA6"><enum>(B)</enum><text display-inline="yes-display-inline">the expected outcomes of managing and controlling the invasive species.</text>
 </subparagraph></paragraph><paragraph id="id4C078F0C19F0440297A1FB7FC30983CD"><enum>(4)</enum><header>Public outreach and awareness efforts</header><text display-inline="yes-display-inline">If a contract or cooperative agreement under subsection (l) involves any outreach or public awareness effort, the memorandum of understanding under this subsection shall include a list of goals and objectives for each outreach or public awareness effort that have been determined to be efficient to inform national, regional, State, or local audiences regarding invasive species control and management.</text>
 </paragraph></subsection><subsection id="id6207D66ED6C94BF49D4065028A96E480"><enum>(n)</enum><header>Investigations</header><text display-inline="yes-display-inline">The purpose of any invasive species-related investigation carried out under a contract or cooperative agreement under subsection (l) shall be—</text>
 <paragraph id="id2ABE5D2BF8234BDFB2EC15B35238FFCB"><enum>(1)</enum><text display-inline="yes-display-inline">to develop solutions and specific recommendations for control and management of invasive species; and</text>
 </paragraph><paragraph id="id2A93111A3F7E46C994C7C4EEA63A4F49"><enum>(2)</enum><text>specifically to provide faster implementation of control and management methods.</text> </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDEE51198A6A84686B83480317CFDD20C"><enum>(o)</enum><header>Coordination with affected local governments</header><text display-inline="yes-display-inline">Each project and activity carried out pursuant to this section shall be coordinated with affected local governments in a manner that is consistent with section 202(c)(9) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)(9)</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

 </subparagraph><subparagraph id="id7C3F5E42AE3B4B969287FDAD018BD894"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (5); and</text> </subparagraph><subparagraph id="id93729D26199B490C901CA51E0B04B386"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text>

 <subparagraph id="idE011AE4E67DD4BB385CB027929A1ADA9"><enum>(A)</enum><text display-inline="yes-display-inline">from each country that comprises the natural range of great apes; and</text> </subparagraph><subparagraph id="idE003F71E599A48FB962DFF98E1E33DD7"><enum>(B)</enum><text display-inline="yes-display-inline">with expertise in great ape conservation.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1862BF8C24FB482F962710AABAFD1362"><enum>(3)</enum><header>Conservation plans</header><text display-inline="yes-display-inline">In identifying the conservation needs and priorities under paragraph (1), the panel referred to in that paragraph shall consider any relevant great ape conservation plan or strategy, including scientific research and findings relating to—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id0CDE53431C91465BAB30AEE59A2A54F4"><enum>(A)</enum><text display-inline="yes-display-inline">the conservation needs and priorities of great apes;</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5C09103E470F47C48CB8A9F00597EB03"><enum>(B)</enum><text display-inline="yes-display-inline">any regional or species-specific action plan or strategy;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41D89AD3073B4FD88B0ADA59DB81BDBA"><enum>(C)</enum><text display-inline="yes-display-inline">any applicable strategy developed or initiated by the Secretary; and</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id261499BE89404B79A4FA147D0CEACC54"><enum>(D)</enum><text display-inline="yes-display-inline">any other applicable conservation plan or strategy.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE2311FFCD8545988A76FB9020D1AA3F"><enum>(4)</enum><header>Funds</header><text display-inline="yes-display-inline">Subject to the availability of appropriations, the Secretary may use amounts available to the Secretary to pay for the costs of convening and facilitating any meeting of the panel referred to in paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

 </paragraph><paragraph id="idA41227C70CE64C15807590066DA113EB"><enum>(3)</enum><header>Wildlife</header><text>The term <term>wildlife</term> has the meaning given the term in section 8 of the Fish and Wildlife Coordination Act (<external-xref legal-doc="usc" parsable-cite="usc/16/666b">16 U.S.C. 666b</external-xref>).</text>
				</paragraph></section><section id="id4F4AFD81845940178A84A499EC52798E"><enum>4002.</enum><header>Theodore Roosevelt Genius Prize for the prevention of wildlife poaching and trafficking</header>
 <subsection id="id4AF1DF31351542F5A422DF929AFF0062"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id7CE560F0ED4B48CF9F381AC30E3FEFE7"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Prevention of Wildlife Poaching and Trafficking Technology Advisory Board established by subsection (c)(1).</text>
 </paragraph><paragraph id="idA13A519B96DB4A29B3423FBD22355FA6"><enum>(2)</enum><header>Prize competition</header><text>The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for the prevention of wildlife poaching and trafficking established under subsection (b).</text>
 </paragraph></subsection><subsection id="id3C8B78A535BA4AD3B99F5EBA809150AC"><enum>(b)</enum><header>Authority</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize</quote> for the prevention of wildlife poaching and trafficking—</text>
 <paragraph id="idF62198D7E3F74A0A9C75E536C7ECC602"><enum>(1)</enum><text>to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to the prevention of wildlife poaching and trafficking; and</text>
 </paragraph><paragraph id="idE29468F5977D4C35AAD4E1DE7C7E9E4C"><enum>(2)</enum><text>to award 1 or more prizes annually for a technological advancement that prevents wildlife poaching and trafficking.</text>
					</paragraph></subsection><subsection id="id368CE6CE39404572B13DC49B41739233"><enum>(c)</enum><header>Advisory board</header>
 <paragraph id="id80B9276AF6EF4FAF894E3F6B4ED96358"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory board, to be known as the <quote>Prevention of Wildlife Poaching and Trafficking Technology Advisory Board</quote>.</text> </paragraph><paragraph id="id648371E0A2BE497DBA9686835F5A5F8A"><enum>(2)</enum><header>Composition</header><text>The Board shall be composed of not fewer than 9 members appointed by the Secretary, who shall provide expertise in—</text>
 <subparagraph id="id03A11FF2BEC24656859479E73DA3F032"><enum>(A)</enum><text>wildlife trafficking and trade;</text> </subparagraph><subparagraph id="id09C27ED60B3D4DA089941EE9C881D19B"><enum>(B)</enum><text>wildlife conservation and management;</text>
 </subparagraph><subparagraph id="id2215881156F84EAC85125BD21FC1348E"><enum>(C)</enum><text>biology;</text> </subparagraph><subparagraph id="idDE58CA25B619413DBE3A80B450796E8D"><enum>(D)</enum><text>technology development;</text>
 </subparagraph><subparagraph id="id0A1A8B2C1C304EB3A720752C8B28D17E"><enum>(E)</enum><text>engineering;</text> </subparagraph><subparagraph id="id927BE40662CC4E7386D9EDE7E5C79E3A"><enum>(F)</enum><text>economics;</text>
 </subparagraph><subparagraph id="id02BDEF1CBCF842CB83E7E8A10BFC0F0D"><enum>(G)</enum><text>business development and management; and</text> </subparagraph><subparagraph id="idC21BE2CBCE7C4A1980734BE389BF076B"><enum>(H)</enum><text>any other discipline, as the Secretary determines to be necessary to achieve the purposes of this section.</text>
 </subparagraph></paragraph><paragraph id="id24FADA0F491C4148B600E0ADA165E751"><enum>(3)</enum><header>Duties</header><text>Subject to paragraph (4), with respect to the prize competition, the Board shall—</text> <subparagraph id="id5C33760D45D34064A9986BC024A69AEE"><enum>(A)</enum><text>select a topic;</text>
 </subparagraph><subparagraph id="id021B4123F15B4C2EAB0ED4541102A38B"><enum>(B)</enum><text>issue a problem statement; and</text> </subparagraph><subparagraph id="id680A086EB8134AC4B745356F46F2280A"><enum>(C)</enum><text>advise the Secretary on any opportunity for technological innovation to prevent wildlife poaching and trafficking.</text>
 </subparagraph></paragraph><paragraph id="id9F501413CE49445BBCE584ACE17702F4"><enum>(4)</enum><header>Consultation</header><text>In selecting a topic and issuing a problem statement for the prize competition under subparagraphs (A) and (B) of paragraph (3), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text>
 <subparagraph id="idB747F200E71B4E64859236033F6B7800"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the prevention of wildlife poaching and trafficking;</text>
 </subparagraph><subparagraph id="idE28B4CA0D25847DDAA003558A1A10CAF"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the prevention of wildlife poaching and trafficking;</text>
 </subparagraph><subparagraph id="idE03C7F9F3A78444FBE038A58F2C45718"><enum>(C)</enum><text>1 or more State, regional, or local wildlife organizations, the mission of which relates to the prevention of wildlife poaching and trafficking; and</text>

 </paragraph><paragraph id="id469E6396F0D0431286FFDE496EEC9533"><enum>(2)</enum><header>Prize competition</header><text>The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for the promotion of wildlife conservation established under subsection (b).</text>
 </paragraph></subsection><subsection id="id114C659FB8534B118E8C4F30F827DC82"><enum>(b)</enum><header>Authority</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize</quote> for the promotion of wildlife conservation—</text>
 <paragraph id="id5C74FD6B277A4CB3B22CE871DCBF7F92"><enum>(1)</enum><text>to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to the promotion of wildlife conservation; and</text>
 </paragraph><paragraph id="id61B531DA01FB4245A9E616BE73D3CF58"><enum>(2)</enum><text>to award 1 or more prizes annually for a technological advancement that promotes wildlife conservation.</text>
					</paragraph></subsection><subsection id="id8F6EE49503944A43819656949ED8A648"><enum>(c)</enum><header>Advisory board</header>

 </subparagraph><subparagraph id="idD226D068B68445A7A7A1D1B1F19B357D"><enum>(C)</enum><text>technology development;</text> </subparagraph><subparagraph id="id2DABAD8198004CD5ADFFC1C6F5284D8D"><enum>(D)</enum><text>engineering;</text>
 </subparagraph><subparagraph id="id4AAE623ED76D4D8484BC788273A87877"><enum>(E)</enum><text>economics;</text> </subparagraph><subparagraph id="id9C3F7D0A0D1749FC8CFB9C66183398E2"><enum>(F)</enum><text>business development and management; and</text>
 </subparagraph><subparagraph id="idA780D21994654C4B8C902D61EF48BD12"><enum>(G)</enum><text>any other discipline, as the Secretary determines to be necessary to achieve the purposes of this section.</text>
 </subparagraph></paragraph><paragraph id="idE1ECB5C73434445F92AC09E88B2F2A83"><enum>(3)</enum><header>Duties</header><text>Subject to paragraph (4), with respect to the prize competition, the Board shall—</text> <subparagraph id="idBA8C6852A024403BB7F4BC004970F5E8"><enum>(A)</enum><text>select a topic;</text>

 <subparagraph id="id1DAA2ED1189A4FD0A9AC793BBA600577"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the promotion of wildlife conservation;</text> </subparagraph><subparagraph id="id69A40A0978A24BBDA375A1408A1371E0"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the promotion of wildlife conservation;</text>

 </subparagraph></paragraph><paragraph id="id0345DA285A8A46989C2AEECA02E20024"><enum>(4)</enum><header>Consultation</header><text>In selecting a topic and issuing a problem statement for the prize competition under subparagraphs (A) and (B) of paragraph (3), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text>
 <subparagraph id="id8AB86F8BDF9E433EA62FEA9F476A1029"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the protection of endangered species;</text> </subparagraph><subparagraph id="id7ED2DBB894DD44D7A52BE4DBC06AD5B2"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the protection of endangered species;</text>
 </subparagraph><subparagraph id="idB3E00C705F464F9581D87309E5EA87F9"><enum>(C)</enum><text>1 or more State, regional, or local wildlife organizations, the mission of which relates to the protection of endangered species; and</text>
 </subparagraph><subparagraph id="id9FBAAADC62184B0E8A5178E450F14E8F"><enum>(D)</enum><text>1 or more wildlife conservation groups, technology companies, research institutions, institutions of higher education, industry associations, or individual stakeholders with an interest in the protection of endangered species.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0A0C890F00B4CBCAF8D9501A25C03F9"><enum>(5)</enum><header>Requirements</header><text>The Board shall comply with all requirements under section 4007(a).</text> </paragraph></subsection><subsection id="id26E6F73418744BCEA14B04A94C51D3FD"><enum>(d)</enum><header>Agreement with the National Fish and Wildlife Foundation</header> <paragraph id="idF1E4D5F7520C44CB9C03F5E2BE1CA250"><enum>(1)</enum><header>In general</header><text>The Secretary shall offer to enter into an agreement under which the National Fish and Wildlife Foundation shall administer the prize competition.</text>
 </paragraph><paragraph id="idD9A3CE1967EE4CCC8804DF60CDB05E12"><enum>(2)</enum><header>Requirements</header><text>An agreement entered into under paragraph (1) shall comply with all requirements under section 4007(b).</text>
					</paragraph></subsection><subsection id="idB208B86BD8224E7F8BE18AD5A458E71A"><enum>(e)</enum><header>Judges</header>
 <paragraph id="id21FED0A7D5C9485FA9E0D51867705D7D"><enum>(1)</enum><header>Appointment</header><text>The Secretary shall appoint not fewer than 3 judges who shall, except as provided in paragraph (2), select the 1 or more annual winners of the prize competition.</text>
 </paragraph><paragraph id="id96A51FD4BD2849D89E5A97939D841160"><enum>(2)</enum><header>Determination by the Secretary</header><text>The judges appointed under paragraph (1) shall not select any annual winner of the prize competition if the Secretary makes a determination that, in any fiscal year, none of the technological advancements entered into the prize competition merits an award.</text>
 </paragraph></subsection><subsection id="id369882F05298499CA6DD91BD4756E0F7"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 60 days after the date on which a cash prize is awarded under this section, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report on the prize competition that includes—</text>
 <paragraph id="id108DED7371E043B782A0B48ABF18CA2D"><enum>(1)</enum><text>a statement by the Board that describes the activities carried out by the Board relating to the duties described in subsection (c)(3);</text>
 </paragraph><paragraph id="id906FC079F0F64AD08C5A952655B6D1BA"><enum>(2)</enum><text>if the Secretary has entered into an agreement under subsection (d)(1), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in section 4007(b); and</text>
 </paragraph><paragraph id="id668D74EF599D4C7BB91CD3A2F7D29491"><enum>(3)</enum><text>a statement by 1 or more of the judges appointed under subsection (e) that explains the basis on which the winner of the cash prize was selected.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id299872890CBF422EB8582CD7DA0C2C5C"><enum>(g)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this section shall terminate on December 31, 2022.</text>
				</subsection></section><section id="idA859A9C512524E22BC59449B99E18B3E"><enum>4006.</enum><header>Theodore Roosevelt Genius Prize for nonlethal management of human-wildlife conflicts</header>
 <subsection id="id568528FD1C514A55A549094A284FEB8C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id66D17A5BE8B94123AF03872E3C57FFC6"><enum>(1)</enum><header>Board</header><text>The term <term>Board</term> means the Nonlethal Management of Human-Wildlife Conflicts Technology Advisory Board established by subsection (c)(1).</text>
 </paragraph><paragraph id="id33AD70CC3C684C389706E8EDF30D2357"><enum>(2)</enum><header>Prize competition</header><text>The term <term>prize competition</term> means the Theodore Roosevelt Genius Prize for the nonlethal management of human-wildlife conflicts established under subsection (b).</text>
 </paragraph></subsection><subsection id="id179C82ABB7FA456AA0D5ABB5D0DBA4D3"><enum>(b)</enum><header>Authority</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a prize competition, to be known as the <quote>Theodore Roosevelt Genius Prize</quote> for the nonlethal management of human-wildlife conflicts—</text>
 <paragraph id="idE4F45FDFB6E44ED4A5196CCC4498AEAA"><enum>(1)</enum><text>to encourage technological innovation with the potential to advance the mission of the United States Fish and Wildlife Service with respect to the nonlethal management of human-wildlife conflicts; and</text>
 </paragraph><paragraph id="id1ECFB7AFCB0042B584665478AD712401"><enum>(2)</enum><text>to award 1 or more prizes annually for a technological advancement that promotes the nonlethal management of human-wildlife conflicts.</text>
					</paragraph></subsection><subsection id="idB4FED60AC0B24890AF5F150BFD14EBEE"><enum>(c)</enum><header>Advisory board</header>
 <paragraph id="id0F42A161EEEE49B88B0CC8AA02D454EB"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory board, to be known as the <quote>Nonlethal Management of Human-Wildlife Conflicts Technology Advisory Board</quote>.</text> </paragraph><paragraph id="id24394D25859A4AC58021687D09581807"><enum>(2)</enum><header>Composition</header><text>The Board shall be composed of not fewer than 9 members appointed by the Secretary, who shall provide expertise in—</text>
 <subparagraph id="id22ACCE3F8BA14BC8AB5541136569D9E2"><enum>(A)</enum><text>nonlethal wildlife management;</text> </subparagraph><subparagraph id="idE3CC438BF6BE431691570EFB1D830505"><enum>(B)</enum><text>social aspects of human-wildlife conflict management;</text>
 </subparagraph><subparagraph id="idF2AC832F0C1A4D89A1D1EE0120337501"><enum>(C)</enum><text>biology;</text> </subparagraph><subparagraph id="id5906DF91CF974CF0AB23C874799049C5"><enum>(D)</enum><text>technology development;</text>
 </subparagraph><subparagraph id="id45AC3BE6BD764E56A4F5B5CA45D05E57"><enum>(E)</enum><text>engineering;</text> </subparagraph><subparagraph id="idB5B4B11B5E994F848621E6253872119C"><enum>(F)</enum><text>economics;</text>
 </subparagraph><subparagraph id="idAB9C9E899DB04E779FBF18C7BC86375C"><enum>(G)</enum><text>business development and management; and</text> </subparagraph><subparagraph id="id7099518E612349DF9DC3478BCD211F5F"><enum>(H)</enum><text>any other discipline, as the Secretary determines to be necessary to achieve the purposes of this section.</text>
 </subparagraph></paragraph><paragraph id="idF0DAE63CD3A94B5AA6F89036398966FB"><enum>(3)</enum><header>Duties</header><text>Subject to paragraph (4), with respect to the prize competition, the Board shall—</text> <subparagraph id="id5C80BFEC0AAF496F928EE8F7534C21D6"><enum>(A)</enum><text>select a topic;</text>
 </subparagraph><subparagraph id="idEC5E90FEFC6F4B9394460D1CA8F270BD"><enum>(B)</enum><text>issue a problem statement; and</text> </subparagraph><subparagraph id="id4E3E991E1C384603BFBCAEA261E25749"><enum>(C)</enum><text>advise the Secretary on any opportunity for technological innovation to promote the nonlethal management of human-wildlife conflicts.</text>
 </subparagraph></paragraph><paragraph id="idC15C2110A4B84B32A13DA8C5C451F5A8"><enum>(4)</enum><header>Consultation</header><text>In selecting a topic and issuing a problem statement for the prize competition under subparagraphs (A) and (B) of paragraph (3), respectively, the Board shall consult widely with Federal and non-Federal stakeholders, including—</text>
 <subparagraph id="id6C1CC493590D4223BA10D24BC89CBB71"><enum>(A)</enum><text>1 or more Federal agencies with jurisdiction over the management of native wildlife species at risk due to conflict with human activities;</text>
 </subparagraph><subparagraph id="id7DD5482E9AF14BA98B845BAAC0D713AB"><enum>(B)</enum><text>1 or more State agencies with jurisdiction over the management of native wildlife species at risk due to conflict with human activities;</text>
 </subparagraph><subparagraph id="idB1A567AE9B6C4D45B7111A53FF3818D3"><enum>(C)</enum><text>1 or more State, regional, or local wildlife organizations, the mission of which relates to the management of native wildlife species at risk due to conflict with human activities; and</text>
 </subparagraph><subparagraph id="id50B988D3FD514FACA17C57C6EE59C779"><enum>(D)</enum><text>1 or more wildlife conservation groups, technology companies, research institutions, institutions of higher education, industry associations, or individual stakeholders with an interest in the management of native wildlife species at risk due to conflict with human activities.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA963EDA8599F4310AA369F309460ED81"><enum>(5)</enum><header>Requirements</header><text>The Board shall comply with all requirements under section 4007(a).</text> </paragraph></subsection><subsection id="id72D43DECF6DD4609B6BF023DAF97DF9B"><enum>(d)</enum><header>Agreement with the National Fish and Wildlife Foundation</header> <paragraph id="idD6FB48275E834CBD8D475769F29261F9"><enum>(1)</enum><header>In general</header><text>The Secretary shall offer to enter into an agreement under which the National Fish and Wildlife Foundation shall administer the prize competition.</text>
 </paragraph><paragraph id="idB1A8B639A0814DECA9B0D2C92B480AC4"><enum>(2)</enum><header>Requirements</header><text>An agreement entered into under paragraph (1) shall comply with all requirements under section 4007(b).</text>
					</paragraph></subsection><subsection id="id88F45EAEF1914055BB74D945E05C558C"><enum>(e)</enum><header>Judges</header>
 <paragraph id="id45221BDE67354E1EB36FB6A1CFF9AEEB"><enum>(1)</enum><header>Appointment</header><text>The Secretary shall appoint not fewer than 3 judges who shall, except as provided in paragraph (2), select the 1 or more annual winners of the prize competition.</text>

 </paragraph></subsection><subsection id="idC61ED3733B5D4011A456DE9D3CB51D5D"><enum>(f)</enum><header>Report to Congress</header><text>Not later than 60 days after the date on which a cash prize is awarded under this section, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report on the prize competition that includes—</text>

 </paragraph><paragraph id="id729179465B8145A1B426127D97E2473B"><enum>(2)</enum><text>if the Secretary has entered into an agreement under subsection (d)(1), a statement by the National Fish and Wildlife Foundation that describes the activities carried out by the National Fish and Wildlife Foundation relating to the duties described in section 4007(b); and</text>
 </paragraph><paragraph id="id1464663AAE2C4FCAB808B865EDD13866"><enum>(3)</enum><text>a statement by 1 or more of the judges appointed under subsection (e) that explains the basis on which the winner of the cash prize was selected.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id80BC91ED2D3949368AC75E74DD52209F"><enum>(g)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">The Board and all authority provided under this section shall terminate on December 31, 2022.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id8D4EF8386A124C6EAE34453170317EC9"><enum>4007.</enum><header>Administration of prize competitions</header>
 <subsection commented="no" display-inline="no-display-inline" id="idC40ABEDC3D174F7E91EDC65ED6798868"><enum>(a)</enum><header>Additional requirements for advisory boards</header><text>An advisory board established under section 4002(c)(1), 4003(c)(1), 4004(c)(1), 4005(c)(1), or 4006(c)(1) (referred to in this section as a <quote>Board</quote>) shall comply with the following requirements:</text>
					<paragraph id="id598B47FFD5554393B85F073E1BFBACD0"><enum>(1)</enum><header>Term; vacancies</header>
 <subparagraph id="id41F6DA0E312A4366A92F7E5A7CE75295"><enum>(A)</enum><header>Term</header><text>A member of the Board shall serve for a term of 5 years.</text> </subparagraph><subparagraph id="idAF95858353594E68829064BE2E72E7CC"><enum>(B)</enum><header>Vacancies</header><text>A vacancy on the Board—</text>
 <clause id="id68AD324A940C499EAD10838A3AECD462"><enum>(i)</enum><text>shall not affect the powers of the Board; and</text> </clause><clause id="id395EB6A17ED145E29B4D334CE8D4D76D"><enum>(ii)</enum><text>shall be filled in the same manner as the original appointment was made.</text>
 </clause></subparagraph></paragraph><paragraph id="id099B93A90966448E869A1F4815D22356"><enum>(2)</enum><header>Initial meeting</header><text>Not later than 30 days after the date on which all members of the Board have been appointed, the Board shall hold the initial meeting of the Board.</text>
					</paragraph><paragraph id="id1B05F01939694081BACB7418A0DE2E59"><enum>(3)</enum><header>Meetings</header>
 <subparagraph id="idEFC85765B7AE4098AABB240AD2C5F1D6"><enum>(A)</enum><header>In general</header><text>The Board shall meet at the call of the Chairperson.</text>
						</subparagraph><subparagraph id="idAF3950D4A8984B2AB2725B884464343C"><enum>(B)</enum><header>Remote participation</header>
 <clause id="idFFA02355385E4001BE7CF4EDC895FC1C"><enum>(i)</enum><header>In general</header><text>Any member of the Board may participate in a meeting of the Board through the use of—</text> <subclause id="id8A6A3549490C4048BC7D0D31A56558E1"><enum>(I)</enum><text>teleconferencing; or</text>
 </subclause><subclause id="idDE4EB19CD6DC488A9DE449743CB34C55"><enum>(II)</enum><text>any other remote business telecommunications method that allows each participating member to simultaneously hear each other participating member during the meeting.</text>
 </subclause></clause><clause id="idAAF15FE569AA44079F6A82FF34C552B2"><enum>(ii)</enum><header>Presence</header><text>A member of the Board who participates in a meeting remotely under clause (i) shall be considered to be present at the meeting.</text>
 </clause></subparagraph></paragraph><paragraph id="idF2B4E7F2B43E4CD7A178C3EB8F7E9611"><enum>(4)</enum><header>Quorum</header><text>A majority of the members of the Board shall constitute a quorum, but a lesser number of members may hold a meeting.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D07D44FA5FD4D809A8B446F4B255628"><enum>(5)</enum><header>Chairperson and Vice Chairperson</header><text>The Board shall select a Chairperson and Vice Chairperson from among the members of the Board.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6AA6EF71EE341D58396E5F7222B81DE"><enum>(6)</enum><header display-inline="yes-display-inline">Administrative cost reduction</header><text display-inline="yes-display-inline">The Board shall, to the maximum extent practicable, minimize the administrative costs of the Board, including by encouraging the remote participation described in paragraph (3)(B)(i) to reduce travel costs.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB96FF53D5F1A4A08875290FC7007BBF4"><enum>(b)</enum><header>Agreements with the National Fish and Wildlife Foundation</header><text>Any agreement entered into under section 4002(d)(1), 4003(d)(1), 4004(d)(1), 4005(d)(1), or 4006(c)(1) shall comply with the following requirements:</text>
 <paragraph id="idC985D727467846F191622A848D7B72D4"><enum>(1)</enum><header>Contents</header><text>An agreement shall provide the following:</text> <subparagraph id="id1C8B86AA661740E2AAF03328B5A21DDA"><enum>(A)</enum><header>Duties</header><text>The National Fish and Wildlife Foundation shall—</text>
 <clause id="id23FFD485EAE0459693DCBB6D07BC75EF"><enum>(i)</enum><text>advertise the prize competition;</text> </clause><clause id="id9AC68F9CB3B94B81B291493652B2E94C"><enum>(ii)</enum><text>solicit prize competition participants;</text>
 </clause><clause id="idFBC5BAEF9A9B451791AA0D012835D507"><enum>(iii)</enum><text>administer funds relating to the prize competition;</text> </clause><clause id="id27FCDDABEE83470CAE4FB190E90FB7CA"><enum>(iv)</enum><text>receive Federal funds—</text>
 <subclause id="id746EC3EA51814ADBA693E882AA0205AB"><enum>(I)</enum><text>to administer the prize competition; and</text> </subclause><subclause id="id8F771DF53F664B4787597F61F287A3B2"><enum>(II)</enum><text>to award a cash prize;</text>
 </subclause></clause><clause id="idF05953A175B04BDDB668186BFC3659B6"><enum>(v)</enum><text>carry out activities to generate contributions of non-Federal funds to offset, in whole or in part—</text>
 <subclause id="idEC26685DDFEA4D4F9B8055C08C42ED86"><enum>(I)</enum><text>the administrative costs of the prize competition; and</text> </subclause><subclause id="idE6FE12FAD12F4A6DB283BD615CBED98F"><enum>(II)</enum><text>the costs of a cash prize;</text>
 </subclause></clause><clause id="id03E7D6694DD54C1798C60E63300C6974"><enum>(vi)</enum><text>in consultation with, and subject to final approval by, the Secretary, develop criteria for the selection of prize competition winners;</text>
 </clause><clause id="idF66611A53A3C4CAD903C5B0A59A50484"><enum>(vii)</enum><text>provide advice and consultation to the Secretary on the selection of judges under sections 4002(e), 4003(e), 4004(e), 4005(e), 4006(e) based on criteria developed in consultation with, and subject to the final approval of, the Secretary;</text>
 </clause><clause id="idE58017FAE38346B999DDBBE07E28161D"><enum>(viii)</enum><text>announce 1 or more annual winners of the prize competition;</text> </clause><clause id="id6D91CFA616B74C24B6E09A473E637C93"><enum>(ix)</enum><text>subject to subparagraph (B), award 1 cash prize annually; and</text>
 </clause><clause id="id9AAB652ABD62468CA86EA585C31C4119"><enum>(x)</enum><text>protect against unauthorized use or disclosure by the National Fish and Wildlife Foundation of any trade secret or confidential business information of a prize competition participant.</text>
 </clause></subparagraph><subparagraph id="id6145EF4FFB2E437DAAF1E58A8D040EFF"><enum>(B)</enum><header>Additional cash prizes</header><text>The National Fish and Wildlife Foundation may award more than 1 cash prize annually if the initial cash prize referred to in subparagraph (A)(ix) and any additional cash prize are awarded using only non-Federal funds.</text>
 </subparagraph><subparagraph id="id25D9CC0C054943D981C185C4CF6FFD9F"><enum>(C)</enum><header>Solicitation of funds</header><text>The National Fish and Wildlife Foundation—</text> <clause id="idA5FEC81536DA44FCB0E129BA83EC7733"><enum>(i)</enum><text>may request and accept Federal funds and non-Federal funds for a cash prize;</text>
 </clause><clause id="id7908A0A63B4A473D8EC6AF233FE43342"><enum>(ii)</enum><text>may accept a contribution for a cash prize in exchange for the right to name the prize; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id95A0BCB979C34936B37DA1C39D6CFC9F"><enum>(iii)</enum><text>shall not give special consideration to any Federal agency or non-Federal entity in exchange for a donation for a cash prize awarded under this section.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id44FC78F739334F2696D0E704EF23EFE7"><enum>(c)</enum><header>Award amounts</header>
 <paragraph id="idEB8CD021E1C041BFA88D28D81E59D919"><enum>(1)</enum><header>In general</header><text>The amount of the initial cash prize referred to in subsection (b)(1)(A)(ix) shall be $100,000.</text> </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BDC3BC250174E4BB829109DF1D5A584"><enum>(2)</enum><header>Additional cash prizes</header><text>On notification by the National Fish and Wildlife Foundation that non-Federal funds are available for an additional cash prize, the Secretary shall determine the amount of the additional cash prize.</text></paragraph></subsection></section></title></legis-body><endorsement><action-date>May 17, 2017</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
