			<section id="id5FC98C58E7834ADA9F3657FCAD5615EA"><enum>101.</enum><header>Coordination between National Oceanic and Atmospheric Administration, Coast Guard, and Department
			 of the Interior on oil spill matters</header>
 <subsection id="id142C8A35787849AEA200F9922D517D76"><enum>(a)</enum><header>Outer Continental Shelf Leasing Program</header><text display-inline="yes-display-inline">Section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) is amended—</text> <paragraph id="id82EAD2C8BB274896A7F071EDDEFDA689"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
 <subparagraph id="id372A83DD046549498A7D45F0C48BA148"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>from any interested Federal agency, including the Attorney General</quote> and inserting <quote>from the head of any interested Federal department or agency, including the Secretary of Commerce, the Secretary of the department in which the Coast Guard is operating, and the Attorney General</quote>; and</text>
 </subparagraph><subparagraph id="id2C23644E0559469281AF565652519B7C"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>Within nine months after the date of enactment of this section the Secretary shall submit a proposed leasing program to the Congress, the Attorney General,</quote> and inserting <quote>The Secretary shall submit any proposed leasing program to the Congress, the head of each interested Federal department or agency described in paragraph (1), the Attorney General,</quote>;</text>
 </subparagraph></paragraph><paragraph id="id0813C5C7BD6A43638259883DBC7D7762"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text> <subparagraph id="idA4BE757F981646A2A58EFE9BE8A60C6D"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>proposed leasing program,</quote> in the first sentence and all that follows through the end of the paragraph and inserting</text>
							<quoted-block display-inline="yes-display-inline" id="idC7A0C111CF8F4F1181D989D2A992D3EB" style="OLC">
 <text>proposed leasing program—</text><subparagraph id="id83BF555B295E40D0B1F80B9060EBE684"><enum>(A)</enum><text display-inline="yes-display-inline">the Attorney General, after consultation with the Federal Trade Commission, may submit comments on the anticipated effects of the proposed program on competition;</text>
 </subparagraph><subparagraph id="id6D0D831C2C56409094A00C1276519709"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Commerce may submit comments on the anticipated effects of the proposed program on the human, marine, and coastal environments, including the likelihood of occurrence and potential severity of spills and chronic pollution;</text>
 </subparagraph><subparagraph id="id821714DEDDA54C70926343AF3B8C727D"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary of the department in which the Coast Guard is operating may submit comments on the adequacy of the response capabilities of the Federal Government for spills and chronic pollution that may occur as a result of the proposed program; and</text>
 </subparagraph><subparagraph id="idD239A4CC1E6840369703789B0973D923"><enum>(D)</enum><text display-inline="yes-display-inline">any State, local government, or other person may submit comments and recommendations as to any aspect of the proposed program.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idC991DDF5554F4D56BF46394DF9802F80"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Attorney General</quote> and inserting <quote>Attorney General, the Secretary of Commerce, the Secretary of the department in which the Coast Guard is operating,</quote>; and</text>
 </subparagraph><subparagraph id="id231D6259C3C641F7B5D419069D418713"><enum>(C)</enum><text>in paragraph (3), by striking <quote>or after eighteen months following the date of enactment of this section, whichever first occurs,</quote>;</text> </subparagraph></paragraph><paragraph id="idA929A2199FA04FD985CCD95A65101251"><enum>(3)</enum><text>in subsection (e), by striking <quote>He</quote> and inserting <quote>The Secretary</quote>; and</text>
 </paragraph><paragraph id="id86EA7CA8B0684EA0A1F32F7ABCAACC2C"><enum>(4)</enum><text>in subsection (h)—</text> <subparagraph id="id4C93CD9F725F4A98BCA113710572D933"><enum>(A)</enum><text>by striking <quote>nonpriviledged</quote> and inserting <quote>nonprivileged</quote>;</text>
 </subparagraph><subparagraph id="id4853089408E54D0B960D0D5626D8E2AA"><enum>(B)</enum><text>by striking <quote>he requests to assist him</quote> and inserting <quote>the Secretary request to assist the Secretary</quote>; and</text> </subparagraph><subparagraph id="id8932B6BCE7E74C9EB93EF5248189B06B"><enum>(C)</enum><text>by striking <quote>he requests to assist him</quote> and inserting <quote>the Secretary requests to assist the Secretary</quote>.</text>
 </subparagraph></paragraph></subsection><subsection id="id2D908D4C69924AF08EAD9FA103A29D9C"><enum>(b)</enum><header>Environmental studies</header><text display-inline="yes-display-inline">Section 20(f) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1346">43 U.S.C. 1346(f)</external-xref>) is amended—</text> <paragraph id="id5CCFCA4A987B45E48B78ADCC85853B71"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In executing his</quote> and inserting <quote>(1) <header-in-text level="paragraph" style="OLC">In general</header-in-text>.—In executing the</quote> and indenting accordingly; and</text>
 </paragraph><paragraph id="id9765FD7EF596415A8F9D00BC7CBFF02C"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id30C2A4F8B897400594BEB3CDBD85F05E" style="OLC"> <paragraph id="idFE23B636F50C4A7998F0451EA8A1F1F9"><enum>(2)</enum><header>National Oceanic and Atmospheric Administration</header> <subparagraph id="id756E7CDCE749496BAAE588D6A93C0E3B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to any other requirement under law, the Secretary, prior to the approval of any program, lease, exploration plan, or development and production plan, shall consult with the Administrator of the National Oceanic and Atmospheric Administration (referred to in this paragraph as the <quote>Administrator</quote>) on any reasonably foreseeable adverse effects of the proposed action, including oil spills, to ocean and coastal resources.</text>
								</subparagraph><subparagraph id="idED24355B32154E1BBD1DC5AE722DC171"><enum>(B)</enum><header>Initiation of consultation</header>
 <clause id="id02429382AC294D759F24A7ACA51FAFDA"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall consult the Administrator under subparagraph (A) as soon as practicable, but not later than 90 days before the date of approval of the proposed action.</text>
 </clause><clause id="idAE48A22844CE40DFA13A705994609AFE"><enum>(ii)</enum><header>Provision of information</header><text display-inline="yes-display-inline">When consulting the Administrator under subparagraph (A), the Secretary shall provide to the Administrator—</text>
 <subclause id="id60C69B2C84D54FF9B9F52C026691C3CE"><enum>(I)</enum><text display-inline="yes-display-inline">information describing the nature, location, and duration of the proposed action; and</text>
 </subclause><subclause id="id5E8D0A5DCEA341EC82CED45C837096C4"><enum>(II)</enum><text display-inline="yes-display-inline">a description of all reasonably foreseeable adverse effects to ocean and coastal resources.</text>
										</subclause></clause></subparagraph><subparagraph id="id6CF20EAD87B94B338311619BE7A20DE8"><enum>(C)</enum><header>Alternatives</header>
 <clause id="id044FAC2A87BB4D279E0022F39CD34F93"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">At any time prior to the date that is 45 days before the approval of the proposed action, the Administrator may recommend to the Secretary alternatives to any proposed action, including measures that will prevent or minimize reasonably foreseeable adverse effects to ocean and coastal resources.</text>
 </clause><clause id="idBA618E40027E410289A6F06A6E7FBBE8"><enum>(ii)</enum><header>Secretarial action</header><text display-inline="yes-display-inline">The Secretary shall incorporate into the approval for the proposed action any alternative or mitigation measure recommended under clause (i), unless the Secretary—</text>
 <subclause id="id48124483BECA41F0B05C4886E7BD6313"><enum>(I)</enum><text display-inline="yes-display-inline">determines that the alternative or mitigation measure is not necessary to prevent or minimize reasonably foreseeable adverse effects to marine and coastal resources; and</text>
 </subclause><subclause id="id2A51F2F3C2D54D51AEA4AFF8A273692E"><enum>(II)</enum><text display-inline="yes-display-inline">notifies the Administrator in writing of the reasons for the determination under subclause (I).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section><section id="IDC87ADFCBAC584AB5A2324ED9E61C8434"><enum>102.</enum><header>Strengthening coastal State oil spill planning and response</header><text display-inline="no-display-inline">The <act-name parsable-cite="CAMA72">Coastal Zone Management Act of 1972</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451</external-xref> et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="ID3C5036D98F7747D18386A3C5E73EB9FC" style="OLC">
					<section id="IDCE56C1B7D6F64D5181C10C78E2821F5C"><enum>320.</enum><header>Strengthening coastal State oil spill response and planning</header>
 <subsection id="ID261F5CDECA834F0D8DF99549C31936BD"><enum>(a)</enum><header>Grants to coastal States</header><text>The Secretary may make grants to eligible coastal States—</text> <paragraph id="IDAD4A0421AF9141128822C904B4FC349B"><enum>(1)</enum><text>to revise management programs approved under section 306 and National Estuarine Research Reserves approved under section 315 to identify and implement new enforceable policies and procedures to ensure sufficient response capabilities at the State level to address the environmental, economic, and social impacts of oil spills or other accidents resulting from Outer Continental Shelf energy activities with the potential to affect land or water use or natural resources of the coastal zone; and</text>
 </paragraph><paragraph id="IDCB06FF19F1574301A9A3BF4BB2401FA8"><enum>(2)</enum><text>to review and revise as necessary applicable enforceable policies within approved coastal State management programs affecting coastal energy exploration or development activities, including geological and geophysical activities, to ensure that these policies are consistent with—</text>
 <subparagraph id="ID24EF1FFF8889438D8097D937565401F8"><enum>(A)</enum><text>other emergency response plans and policies developed under Federal or State law to address the impacts and accidents described in paragraph (1); and</text>
 </subparagraph><subparagraph id="IDD735C3CBFA5E486091D1627D47A9C7A6"><enum>(B)</enum><text>the new policies and procedures developed under paragraph (1).</text> </subparagraph></paragraph></subsection><subsection id="IDEB65D62613774E05A706456EEC5AB1E4"><enum>(b)</enum><header>Elements</header><text>In developing new enforceable policies and procedures with grants under subsection (a), an eligible coastal State shall consider—</text>
 <paragraph id="ID7FF900F2DD1A492487B84F6D6D27AA73"><enum>(1)</enum><text>other existing emergency response plans and policies developed under other Federal or State law, to address the impacts and accidents described in paragraph (1), that affect the coastal zone;</text>
 </paragraph><paragraph id="IDF43363F915F840319BA24D21544DA05F"><enum>(2)</enum><text>the identification of critical infrastructure essential to facilitate oil spill or accident response activities;</text>
 </paragraph><paragraph id="ID75D3DD1204F341E7BEC298E8C7D0E9B1"><enum>(3)</enum><text>the identification of coordination, logistics and communication networks between Federal and State government agencies, and between State agencies and affected local communities, to ensure the efficient and timely dissemination of data and other information;</text>
 </paragraph><paragraph id="ID7F6E5976906D48CCBA9DD15DD02C9806"><enum>(4)</enum><text>the inventories of shore locations and infrastructure and equipment necessary to respond to, or monitor environmental impacts of, oil spills or other accidents resulting from Outer Continental Shelf energy activities;</text>
 </paragraph><paragraph id="IDC43D8271883E4A7FB64E1BED147E3E12"><enum>(5)</enum><text>the identification and characterization of significant or sensitive marine ecosystems or other areas possessing important conservation, recreational, ecological, historic, economic, or aesthetic values;</text>
 </paragraph><paragraph id="ID889E3DDD517E4DE18CA357EB7C4D03C9"><enum>(6)</enum><text>the inventories and surveys of shore locations and infrastructure capable of supporting alternative energy development;</text>
 </paragraph><paragraph id="ID46FD3AFAB0D14B97A31648B6F2CF4EFC"><enum>(7)</enum><text>the observing capabilities necessary to assess ocean conditions before, during, and after an oil spill or other adverse incident resulting from Outer Continental Shelf energy activities; and</text>
 </paragraph><paragraph id="ID4F13B0B903954AC4879EDF2ED71FD239"><enum>(8)</enum><text>other information or actions as may be necessary to address the environmental, economic, and social impacts of oil spills or other adverse incidents resulting from Outer Continental Shelf energy activities.</text>
 </paragraph></subsection><subsection id="ID564886D06CD6475BB19FAC5963E93602"><enum>(c)</enum><header>Guidelines</header><text>Not later than 180 days after the date of enactment of the <short-title>Marine Oil Spill Prevention Act</short-title>, the Secretary, after consultation with the coastal States, shall publish guidelines for the application for and use of grants under this section.</text>
 </subsection><subsection id="ID32AA01166008445C955AD3A0173E95F9"><enum>(d)</enum><header>Participation</header><text>An eligible coastal State shall develop new enforceable policies and procedures under this section in accordance with section 306(d)(1) and amend or modify any new enforceable policies or procedures in accordance with section 306(e).</text>
						</subsection><subsection id="ID06BA1421D3C64B8A8AFEEDFD2C6ED829"><enum>(e)</enum><header>Annual grants</header>
 <paragraph id="IDB879F3B995C142F3BB82E3342595CD2A"><enum>(1)</enum><header>In general</header><text>For each of fiscal years 2018 through 2022, the Secretary may make a grant to a coastal State to develop new enforceable policies and procedures under this section.</text>
 </paragraph><paragraph id="ID60B84E23742D4557BE61D72F22FE4A29"><enum>(2)</enum><header>Grant amounts and limit on awards</header><text>The amount of any grant to any 1 coastal State under this section shall not exceed $750,000 for any fiscal year.</text>
 </paragraph><paragraph id="ID4C094B448B914B21A1B3BAF6E0D0AAC3"><enum>(3)</enum><header>No State matching contribution required</header><text>A coastal State shall not be required to contribute any portion of the cost of a grant awarded under this section.</text>
 </paragraph><paragraph id="IDBA8D63432C0745318F84B702C0555EFC"><enum>(4)</enum><header>Transfer of funds</header><text>A coastal State that receives a grant under this section may transfer grant funds to an appropriate agency of the coastal State.</text>
 </paragraph><paragraph id="ID793242A337724A8EA51E4E2AA7E11769"><enum>(5)</enum><header>Secretarial review and limit on awards</header><text>After an initial grant is made to a coastal State under this section, no subsequent grant may be made to that coastal State under this section unless the Secretary finds that the coastal State is satisfactorily developing revisions to address the impacts and accidents described in subsection (a)(1). No coastal State is eligible to receive grants under this section for more than 2 fiscal years.</text>
 </paragraph></subsection><subsection id="IDF590407AB2284C0E8B0B87C568F8159A"><enum>(f)</enum><header>Applicability</header><text>The requirements of this section shall only apply if appropriations are provided to the Secretary to make grants under this section.</text>
 </subsection><subsection id="id7AFA7A6049404585B192C88E44352B4F"><enum>(g)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to convey any new authority to any coastal State, or repeal or supersede any existing authority of any coastal State, to regulate the siting, licensing, leasing, or permitting of alternative energy facilities in areas of the Outer Continental Shelf under the administration of the Federal Government. Nothing in this section repeals or supersedes any existing coastal State authority.</text>
 </subsection><subsection id="ID938FFCBDC9A742AC9028248E2FB09F61"><enum>(h)</enum><header>Assistance by the Secretary</header><text>The Secretary, as authorized under section 310(a) and to the extent practicable, shall make available to coastal States the resources and capabilities of the National Oceanic and Atmospheric Administration to provide technical assistance to the coastal States to prepare revisions to approved management programs to meet the requirements under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id62116585DAA544C288F00D3EBB58803A"><enum>103.</enum><header>Moratorium on commercial industrial activity in certain areas of Gulf of Mexico</header><text display-inline="no-display-inline">Section 104(a) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note) is amended by striking <quote>June 30, 2022</quote> and inserting <quote>June 30, 2027</quote>.</text>
			</section><section id="id75E31C74D02D4684A3BCCE2B44004682"><enum>104.</enum><header>Coast Guard inspections</header>
 <subsection id="id9B6B0BE7D04146D0AE4D7B072ECBAFEB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating shall increase the frequency and comprehensiveness of safety inspections of all United States and foreign-flag tank vessels that enter a United States port or place, including increasing the frequency and comprehensiveness of inspections of vessel age, hull configuration, and past violations of any applicable discharge and safety regulations under United States and international law that may indicate that the class societies inspecting such vessels may be substandard, and other factors relevant to the potential risk of an oil spill.</text>
 </subsection><subsection id="idE3E510710F76433D8C5BFEC32413A575"><enum>(b)</enum><header>Enhanced Verification of Structural Condition</header><text display-inline="yes-display-inline">The Secretary of the department in which the Coast Guard is operating shall adopt, as part of the Secretary's inspection requirements for tank vessels, additional procedures for enhancing the verification of the reported structural condition of such vessels, taking into account the Condition Assessment Scheme adopted by the International Maritime Organization by Resolution 94(46) on April 27, 2001, as amended and consolidated.</text>
				</subsection></section><section id="idDC640EA7F58A4EA1BC60400A172D3F62"><enum>105.</enum><header>Navigational measures for protection of natural resources</header>
				<subsection id="idC3595353C37E4377801BBED113323EFE"><enum>(a)</enum><header>Designation of at-Risk areas</header>
 <paragraph id="id0D21E98A62D34CD3ABF89BF441868D1D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard, in consultation the Under Secretary for Oceans and Atmosphere, shall identify areas in waters subject to the jurisdiction of the United States, including the exclusive economic zone (as established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note)), in which routing or other navigational measures are warranted to reduce the risk of oil spills and potential damage to natural resources.</text>
 </paragraph><paragraph id="idC878585235214541BC31DC264F74B043"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In identifying the areas described in paragraph (1), the Commandant shall give priority consideration to natural resources of particular ecological importance or economic importance, including—</text>
 <subparagraph id="idEA78F04741AB435F96A29CBA17CB7E43"><enum>(A)</enum><text display-inline="yes-display-inline">commercial fisheries;</text> </subparagraph><subparagraph id="idF8477FEB26F94B59AF1674DC72F86D7E"><enum>(B)</enum><text display-inline="yes-display-inline">aquaculture facilities;</text>
 </subparagraph><subparagraph id="id8668ADA7203040CF9FF8EC8D06A34552"><enum>(C)</enum><text display-inline="yes-display-inline">marine sanctuaries designated by the Secretary of Commerce under the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431</external-xref> et seq.);</text>
 </subparagraph><subparagraph id="id7EF106A5E59E4BFBB81EFAE333B916FA"><enum>(D)</enum><text display-inline="yes-display-inline">estuaries of national significance designated under section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>);</text>
 </subparagraph><subparagraph id="idA9E786087006426BAF211DB05A57619F"><enum>(E)</enum><text display-inline="yes-display-inline">critical habitat, as defined in section 3(5) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532(5)</external-xref>);</text>
 </subparagraph><subparagraph id="id3EF5B903240B4504974A141308325FB8"><enum>(F)</enum><text display-inline="yes-display-inline">estuarine research reserves within the National Estuarine Research Reserve System established by section 315 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1461">16 U.S.C. 1461</external-xref>); and</text>
 </subparagraph><subparagraph id="idCDF2B0AEF1B749B6AF70A9D735A90FE0"><enum>(G)</enum><text display-inline="yes-display-inline">national parks and national seashores administered by the National Park Service under the National Park Service Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1</external-xref> et seq.).</text>
 </subparagraph></paragraph></subsection><subsection id="idE41623CA8D27441B8400756337D7C3B0"><enum>(b)</enum><header>Factors considered</header><text display-inline="yes-display-inline">In determining whether navigational measures are warranted for an area identified under subsection (a), the Commandant and the Under Secretary for Oceans and Atmosphere shall consider, at a minimum—</text>
 <paragraph id="id2C8C1D0A6D9F47C492C9E2539C8FB413"><enum>(1)</enum><text display-inline="yes-display-inline">the frequency of transits of vessels which are required to prepare a response plan under section 311(j) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)</external-xref>);</text>
 </paragraph><paragraph id="id41F8F17EF4A146EBBAA7181CFBDA6484"><enum>(2)</enum><text display-inline="yes-display-inline">the type and quantity of oil transported as cargo or fuel;</text> </paragraph><paragraph id="id02AC098264B840F6A55526A347AE38AB"><enum>(3)</enum><text display-inline="yes-display-inline">the expected benefits of routing measures in reducing risks of spills;</text>
 </paragraph><paragraph id="idD8A9324D231D4764AB984FD95B96B453"><enum>(4)</enum><text display-inline="yes-display-inline">the costs of such measures;</text> </paragraph><paragraph id="id829503CBF5E74F629046E6FE480AB690"><enum>(5)</enum><text display-inline="yes-display-inline">the safety implications of such measures; and</text>
 </paragraph><paragraph id="id15741E58705D4689AA574401FB8FE387"><enum>(6)</enum><text display-inline="yes-display-inline">the nature and value of the resources to be protected by such measures.</text> </paragraph></subsection><subsection id="id0C24D5C10D4647E6B9C104B456F6F448"><enum>(c)</enum><header>Establishment of routing and other navigational measures</header><text display-inline="yes-display-inline">The Commandant shall establish such routing or other navigational measures for areas identified under subsection (a).</text>
 </subsection><subsection id="idABB8EA7DF8004AD397AA72E50532E79D"><enum>(d)</enum><header>Establishment of areas To be avoided</header><text display-inline="yes-display-inline">To the extent that the Commandant and the Under Secretary for Oceans and Atmosphere identify areas in which navigational measures are warranted for an area under subsection (a), the Secretary of Commerce and the Under Secretary shall seek to establish such areas through the International Maritime Organization or establish comparable areas pursuant to regulations and in a manner that is consistent with international law.</text>
				</subsection><subsection id="idFB779058DAF44D6A8BF7DE11A8702A92"><enum>(e)</enum><header>Oil shipment data and report</header>
 <paragraph id="idDBC6F420D53547268B7E8EAB9F7D19D1"><enum>(1)</enum><header>Data collection</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard, in consultation with the Chief of Engineers, shall analyze data on oil transported as cargo on vessels in the navigable waters of the United States, including information on—</text>
 <subparagraph id="id1B90E1B4FFDA4AC995FB3F86F32CF12A"><enum>(A)</enum><text display-inline="yes-display-inline">the quantity and type of oil being transported;</text> </subparagraph><subparagraph id="id049A5EC784014A02B0F0F04E01933CA3"><enum>(B)</enum><text display-inline="yes-display-inline">the vessels used for such transportation;</text>
 </subparagraph><subparagraph id="idE5D610458DDB490DB5E90276CD276B67"><enum>(C)</enum><text display-inline="yes-display-inline">the frequency with which each type of oil is being transported; and</text> </subparagraph><subparagraph id="id62575D375EC14A21823B8A97DDEE9DB6"><enum>(D)</enum><text display-inline="yes-display-inline">the point of origin, transit route, and destination of each such shipment of oil.</text>
						</subparagraph></paragraph><paragraph id="idFD3133461BAE413CBEA2D2EA9CBC92FB"><enum>(2)</enum><header>Quarterly report</header>
 <subparagraph id="idB3228234BAE44E7394AD4ECC4476968E"><enum>(A)</enum><header>Requirement for quarterly report</header><text display-inline="yes-display-inline">The Secretary of Commerce, not less frequently than once each calendar quarter, shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the data collected and analyzed under paragraph (1).</text>
 </subparagraph><subparagraph id="idF300F15732194F5F92B4220E39E50E25"><enum>(B)</enum><header>Format</header><text display-inline="yes-display-inline">Each report submitted under subparagraph (A) shall be submitted in a format that does not disclose information exempted from disclosure.</text>
						</subparagraph></paragraph></subsection></section><section id="idA4E368BF2A2F4201BAD82146A3070445"><enum>106.</enum><header>Gulf of Mexico Regional Citizens’ Advisory Council</header>
 <subsection id="idD03EDE5C5D7B42DCB28244BBEE6FD6CD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of title IV of the Oil Pollution Act of 1990 is amended by inserting after section 4118 (<external-xref legal-doc="usc" parsable-cite="usc/33/1203">33 U.S.C. 1203</external-xref> note) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1A426F8337D94AB1822BBF67698B4CFB" style="OLC">
						<section id="id97957F7A37F44DC7A2FD2C1FFFAD996B"><enum>4119.</enum><header>Gulf Coast Regional Citizens’ 
Advisory Council</header>
 <subsection id="idDEF58B2145054FFA9B0A216AED6A8A7D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a Gulf Coast Regional Citizens’ Advisory Council.</text> </subsection><subsection id="id98AFD333FB4345EF8530DF39506D4524"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The Council shall be composed of voting members and nonvoting members, as follows:</text>
 <paragraph id="id93E5C259A9794DFDAFB1F9673D4A4038"><enum>(1)</enum><header>Voting members</header><text display-inline="yes-display-inline">Each of the Gulf Coast States shall be represented by 5 members on the Council who shall be residents of, and appointed from and by the following interests in, the State they represent, such that each interest in each State is represented by a voting member:</text>
 <subparagraph id="id42BA8050F1B643098BF0084039EE89A4"><enum>(A)</enum><text display-inline="yes-display-inline">Commercial fin fish and shellfish industry organizations, the members of which depend on the marine fisheries resources of the State.</text>
 </subparagraph><subparagraph id="idB7DE2CC9CD454D34AE9198DBADE46A23"><enum>(B)</enum><text display-inline="yes-display-inline">Recreational fishing industry organizations, the members of which depend on the marine fisheries resources of the State.</text>
 </subparagraph><subparagraph id="idBEBA6E4E5BE743F8B92E3875F1C3AC39"><enum>(C)</enum><text display-inline="yes-display-inline">Restaurant, hotel, and tourism industry organizations, the members of which depend upon the beaches, dunes, barrier islands, wetlands, estuaries, bayous, sounds, bays, lagoons, reefs, fish, wildlife, or other coastal resources of the State.</text>
 </subparagraph><subparagraph id="idC5706227E6DD44F481C5B08D0C8AF55D"><enum>(D)</enum><text display-inline="yes-display-inline">Marine and coastal conservation organizations, members of which reside in the State.</text> </subparagraph><subparagraph id="idC15940B2C8654022BC726A3C8F07F2B6"><enum>(E)</enum><text display-inline="yes-display-inline">Counties or parishes, and incorporated and unincorporated municipalities of the State.</text>
 </subparagraph></paragraph><paragraph id="idAECBEE473F2A41D487DD7E8FEBC9C53E"><enum>(2)</enum><header>Nonvoting members</header><text display-inline="yes-display-inline">One ex officio, nonvoting representative shall be designated by, and represent, each of the following on the Council:</text>
 <subparagraph id="idAADC34C9D22641C899098777205EC958"><enum>(A)</enum><text display-inline="yes-display-inline">The Coast Guard.</text> </subparagraph><subparagraph id="id0172DA0812E54F45A4F8358D9A8C3667"><enum>(B)</enum><text display-inline="yes-display-inline">The Environmental Protection Agency.</text>
 </subparagraph><subparagraph id="idBFC2170975EF4DAA852D7158805334EC"><enum>(C)</enum><text display-inline="yes-display-inline">The National Oceanic and Atmospheric Administration.</text> </subparagraph><subparagraph id="id40CC409C14D74818932763BF2BE7862A"><enum>(D)</enum><text display-inline="yes-display-inline">The Department of the Interior, Bureau of Safety and Environmental Enforcement.</text>
 </subparagraph><subparagraph id="idB6BE500B3D334A0DAE4A05846581F40E"><enum>(E)</enum><text display-inline="yes-display-inline">The Department of Transportation, Office of Pipeline Safety.</text> </subparagraph><subparagraph id="id329581FBE9094B4995FF9F660D6E6A1F"><enum>(F)</enum><text display-inline="yes-display-inline">The lead maritime environmental and natural resources management and enforcement agency of each of the Gulf Coast States.</text>
 </subparagraph><subparagraph id="idF3B0BB91888046029EDF8B300AA99BAE"><enum>(G)</enum><text display-inline="yes-display-inline">The maritime or shipping industry.</text> </subparagraph><subparagraph id="id7E4527FF6FDD438F82B6D8031E390787"><enum>(H)</enum><text display-inline="yes-display-inline">The energy industry.</text>
 </subparagraph></paragraph><paragraph id="idCD56734033474008B798CFAA1DAD1D8C"><enum>(3)</enum><header>Geographic balance</header><text display-inline="yes-display-inline">Voting and nonvoting members shall be drawn equally from the States represented on the Council.</text> </paragraph></subsection><subsection id="idD728F5A1DA3D4A749DCA51508D536456"><enum>(c)</enum><header>Initial formation</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of the <short-title>Marine Oil Spill Prevention Act</short-title>, the Secretary of the department in which the Coast Guard is operating shall appoint the initial voting members of the Council and call the first meeting of the Council.</text>
							</subsection><subsection id="idC4CD9800A0004C1A99044481F22CA224"><enum>(d)</enum><header>Terms</header>
 <paragraph id="idC9D5409F7BB2435E82F66D1757DF26D9"><enum>(1)</enum><header>Duration of the Council</header><text display-inline="yes-display-inline">The duration of the Council shall be throughout the lifetime of energy exploration, development, production, transportation, and facility removal activities in one or more of the Gulf Coast States, and throughout the lifetime of such activities in the Gulf of Mexico.</text>
								</paragraph><paragraph id="id5D3A107BF1AA4CC4AFB6CB94183FBB1E"><enum>(2)</enum><header>Terms of voting members</header>
 <subparagraph id="id737C44E21F384BEF919D7A5738546A94"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The voting members of the Council shall be appointed for a term of 3 years, except as provided in subparagraph (B).</text>
 </subparagraph><subparagraph id="id5DE8252089B34B148EF93F6A20AEE062"><enum>(B)</enum><header>Terms of initial appointees</header><text display-inline="yes-display-inline">The terms of service of voting members initially appointed by the Secretary of the department in which the Coast Guard is operating shall be established by a drawing of lots, under which—</text>
 <clause id="idDEA4D3D353614A8684AA84A5B3DA5D17"><enum>(i)</enum><text display-inline="yes-display-inline">9 of the voting members shall serve for 3 years;</text> </clause><clause id="idDCC2D0F364B648F1887A2F78C97D86B3"><enum>(ii)</enum><text display-inline="yes-display-inline">9 of the voting members shall serve for 2 years; and</text>
 </clause><clause id="idBAD6B900A8774D03AD0552FAEFFC1356"><enum>(iii)</enum><text display-inline="yes-display-inline">7 of the voting members shall serve for 1 year.</text> </clause></subparagraph></paragraph></subsection><subsection id="id8EC09D07DCD74A6D81A5AFA94495F614"><enum>(e)</enum><header>Governance</header> <paragraph id="id8183F93D1CEA4DB1AC56D98497F5CF03"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Council shall elect a chairperson, select staff, and make policies with regard to internal operating procedures.</text>
 </paragraph><paragraph id="id10E313AC5ED54C8892A70AC4F3E8DBD7"><enum>(2)</enum><header>Self-governing</header><text display-inline="yes-display-inline">After the initial organizational meeting called by the Secretary of the department in which the Coast Guard is operating, the Council shall be self-governing and shall hold meetings thereafter at least once each year.</text>
 </paragraph><paragraph id="idB72808071D064CF9B7AA0628DD750E08"><enum>(3)</enum><header>Transparency</header><text display-inline="yes-display-inline">The Council shall—</text> <subparagraph id="idD3F8C0513F2A4E33AA051C603229C46A"><enum>(A)</enum><text display-inline="yes-display-inline">conduct the operations of the Council in public, to the maximum extent practicable;</text>
 </subparagraph><subparagraph id="idA3DC1A6BA9094FC89049E5D64C1638D4"><enum>(B)</enum><text display-inline="yes-display-inline">make all work product adopted by the Council available to the public;</text> </subparagraph><subparagraph id="id580575D438C1483B9BAE4B3F081151D2"><enum>(C)</enum><text display-inline="yes-display-inline">hold at least 1 meeting each year that is open to the public, and for each such meeting provide notice to the public at least 30 days prior to such meeting; and</text>
 </subparagraph><subparagraph id="id0825DE6E965B4CBB98ACE99C698B8B29"><enum>(D)</enum><text display-inline="yes-display-inline">maintain a freely accessible website on which it shall make available to the public, at a minimum—</text> <clause id="idEA297E671E4C4C3A932A20CA55B4D06C"><enum>(i)</enum><text display-inline="yes-display-inline">recommendations made by the Council, together with information as to whether or not the recommendations were adopted and, if not, an explanation of why they were not adopted;</text>
 </clause><clause id="idE10F1947EC904451BD13B8A6A610A771"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of matters currently under review by the Council, without disclosing any private, confidential, or privileged information consistent with applicable law;</text>
 </clause><clause id="id1DCE9E3EE58B4F2EAEF68518298D33B4"><enum>(iii)</enum><text display-inline="yes-display-inline">a statement of industry standards; and</text> </clause><clause id="id998C49ABDA8F4C8E99A236F7686922AA"><enum>(iv)</enum><text display-inline="yes-display-inline">an interactive component through which the general public may submit questions and comments and report matters of interest.</text>
 </clause></subparagraph></paragraph><paragraph id="id65A68E76BD9A4AFCAFD00377D2434844"><enum>(4)</enum><header>Conflicts of interest</header><text display-inline="yes-display-inline">An individual selected as a voting member of the Council may not engage in any activity that may conflict with the execution of the functions or duties of the individual as a Council member.</text>
								</paragraph></subsection><subsection id="id33AC776BD6F8422B8276B5BF1B210FE5"><enum>(f)</enum><header>Duties</header>
 <paragraph id="id089B9CF043DD4B42BB95151B0E9F9B75"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Council shall, with regard to the activities, operation, and maintenance of facilities and tank vessels in the Gulf Coast States and the Gulf of Mexico—</text>
 <subparagraph id="idF3CBB54769F94B15A87DF9AD569E1DFC"><enum>(A)</enum><text display-inline="yes-display-inline">provide advice and recommendations to covered persons, relevant Federal agencies, and Gulf Coast States regarding applicable policies, permits, operations, and regulations;</text>
 </subparagraph><subparagraph id="id56D1670C50AB428F9A2C4FDE68B817D9"><enum>(B)</enum><text display-inline="yes-display-inline">monitor impacts on marine and coastal ecosystems;</text> </subparagraph><subparagraph id="idFB08B5341ADD40129CFD06B5DCF0A06E"><enum>(C)</enum><text display-inline="yes-display-inline">monitor relevant oil spill prevention and response plans, including plans relating to blowout prevention and response; and</text>
 </subparagraph><subparagraph id="id170FC6A3369F4904A9306A78BE32FBA6"><enum>(D)</enum><text display-inline="yes-display-inline">recommend standards and conditions for regulations intended to ensure safety of life and property and minimize negative impacts on marine and coastal ecosystems.</text>
 </subparagraph></paragraph><paragraph id="id0123B6C373234649AFA713AA7CBA2864"><enum>(2)</enum><header>Geographic scope</header><text display-inline="yes-display-inline">The Council shall carry out the duties described in paragraph (1) in a manner that, to the extent practicable, covers all activities, operation, and maintenance of facilities and tank vessels occurring in Gulf Coast States and the Gulf of Mexico.</text>
 </paragraph></subsection><subsection id="idDE0822202454416888A2A74288EABACA"><enum>(g)</enum><header>Estoppel</header><text display-inline="yes-display-inline">The Council is not liable under Federal or State law for costs or damages resulting from the discharge of its duties. No advice given by a voting member of the Council, or by a program representative or agent, shall be grounds for estopping the interests represented by voting Council members from seeking damages or other appropriate relief.</text>
 </subsection><subsection id="id365EEA4E265444628D65ADE76FAD44E0"><enum>(h)</enum><header>Scientific work</header><text display-inline="yes-display-inline">In carrying out its duties, the Council—</text> <paragraph id="id19DA7FDDCEE24368A9CEBFA4A87A3706"><enum>(1)</enum><text display-inline="yes-display-inline">may conduct applicable scientific research; and</text>
 </paragraph><paragraph id="idCFC6A2E7D16D4E409946C91CA7477E5E"><enum>(2)</enum><text display-inline="yes-display-inline">shall review applicable scientific work undertaken by or on behalf of the energy industry, conservation organizations, or government agencies.</text>
 </paragraph></subsection><subsection id="idB982A58A375F4BF1A1F8208A552E12D0"><enum>(i)</enum><header>Standing committees</header><text display-inline="yes-display-inline">The Council may create standing committees as necessary to carry out the duties described in subsection (f), including—</text>
 <paragraph id="id56C5BECE98C5476AB78159D30715AAC2"><enum>(1)</enum><text display-inline="yes-display-inline">a scientific and technical committee;</text> </paragraph><paragraph id="id6609E5FD8AF3480CAAEDE081471348F5"><enum>(2)</enum><text display-inline="yes-display-inline">an environmental monitoring committee;</text>
 </paragraph><paragraph id="id6BAE5DB97CE2435395BF7EEEB922389F"><enum>(3)</enum><text display-inline="yes-display-inline">an oil spill prevention and response committee;</text> </paragraph><paragraph id="id6DDDBE9F02884598B1DD1E8A860C31E3"><enum>(4)</enum><text display-inline="yes-display-inline">an offshore monitoring committee to monitor activities in waters of the Gulf of Mexico that are more than 500 feet in depth; and</text>
 </paragraph><paragraph id="idE18E6958AFB94A789DF194714CFA6834"><enum>(5)</enum><text display-inline="yes-display-inline">a coastal monitoring committee to monitor activities on the coast of the Gulf of Mexico and in waters of the Gulf of Mexico that are 500 feet or less in depth.</text>
								</paragraph></subsection><subsection id="id17D93C38F8FF4E47A9E8D9D2FCCC60DD"><enum>(j)</enum><header>Agency cooperation</header>
 <paragraph id="id07F8B71E3CD54A77AB4E664C8DA65F72"><enum>(1)</enum><header>Information</header><text display-inline="yes-display-inline">The Council may request directly from any Federal agency, and upon such request each Federal agency shall furnish to the Council to the extent authorized by law, information, suggestions, estimates, and statistics, for the purpose of fulfilling its duties under subsection (f).</text>
								</paragraph><paragraph id="idD7CA952F54B94C0397AF39B380BA664B"><enum>(2)</enum><header>Consultation</header>
 <subparagraph id="id407BC53BAC65424E8C861B7AFEA7A5FE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of the <short-title>Marine Oil Spill Prevention Act</short-title>, each Federal agency, with respect to all permits, site-specific regulations, and other matters governing the activities and actions within the purview of the Council, shall consult with the Council prior to taking substantive action with respect to such matters.</text>
 </subparagraph><subparagraph id="id8657B44AE33542909DB9928A7A46748B"><enum>(B)</enum><header>Review</header><text display-inline="yes-display-inline">Federal agency consultations required by this paragraph shall be carried out in a manner that enables the Council to review the permit, site-specific regulation, or other matter at issue and make appropriate recommendations consistent with its duties.</text>
 </subparagraph><subparagraph id="id56D1D0F305E14A0EB95FC442CCEAB8FE"><enum>(C)</enum><header>Emergencies</header><text display-inline="yes-display-inline">No consultation shall be required under this paragraph if an authorized representative of a Federal agency reasonably believes that an emergency exists requiring action without delay.</text>
									</subparagraph></paragraph></subsection><subsection id="id5814E9A5E7604AE4A62986331455B9F0"><enum>(k)</enum><header>Recommendations of the Council</header>
 <paragraph id="id59D34618E6D745179332EA208CDA8520"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">All recommendations of the Council shall be advisory only.</text> </paragraph><paragraph id="id7FC28405FEA04852A27D15B9803C7F05"><enum>(2)</enum><header>Response to recommendations</header><text display-inline="yes-display-inline">If a covered person decides not to adopt, or decides to adopt with substantial modification, a recommendation of the Council, then the covered person shall provide to the Council, not later than 10 days after the date of such decision, written notice of the decision and a written explanation of the reason or reasons for the decision.</text>
								</paragraph></subsection><subsection id="id0E136594221D40A3A44E28FB5326D251"><enum>(l)</enum><header>Location and compensation</header>
 <paragraph id="id446DFD1CE13B4D839B5D2C93642D0A9B"><enum>(1)</enum><header>Location</header><text display-inline="yes-display-inline">The Council shall establish offices in one or more of the Gulf Coast States, as the Council determines to be necessary and appropriate to the execution of its duties.</text>
 </paragraph><paragraph id="id9254BD119B24410DA7ADAAE1B6D5D5D1"><enum>(2)</enum><header>Compensation</header><text display-inline="yes-display-inline">A member of the Council may not be compensated for service on the Council, but shall be allowed travel expenses, including per diem, at a rate established by the Council, which may not exceed the rates authorized for employees of agencies under sections 5702 and 5703 of title 5, United States Code, except by express authorization of the Council in a case in which the rates are inadequate to reimburse a member not eligible for travel rates of the Federal Government.</text>
								</paragraph></subsection><subsection id="id1796F2A4635441DFBEE09E9D183339E3"><enum>(m)</enum><header>Funding</header>
 <paragraph id="id142FAC5D280A46E083EC6876A6540CB1"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Approval of the contingency plans required of covered persons under this Act shall be effective only so long as the Council is funded under paragraph (2).</text>
 </paragraph><paragraph id="idFC71385982DF47EDBC397A7E33D49E46"><enum>(2)</enum><header>Contributions by covered persons</header><text display-inline="yes-display-inline">Covered persons shall provide, on an annual basis, an aggregate amount of not more than $10,000,000, as determined by the Secretary of the department in which the Coast Guard is operating, that shall provide for the establishment and ongoing operation of the Council, and shall be adjusted annually to reflect changes in the Consumer Price Index in the Gulf Coast States.</text>
								</paragraph></subsection><subsection id="idB5AEA7C2C8804D0DB3C63A0EB67BF942"><enum>(n)</enum><header>Independent audits; reports</header>
 <paragraph id="id206C7C59042147BAB289C96C5004866E"><enum>(1)</enum><header>Annual audits</header><text display-inline="yes-display-inline">The Council shall commission an annual independent financial statement audit by an independent accounting firm and publish the results in a publicly available annual report.</text>
 </paragraph><paragraph id="id3430514374CC40FE8D35A4EDB9FDA922"><enum>(2)</enum><header>Biennial Council report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of establishment of the Council, and biennially thereafter, the Council shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that includes—</text>
 <subparagraph id="id1C598DBAF9F14AE7986870BACAC2FDDF"><enum>(A)</enum><text display-inline="yes-display-inline">the significant achievements of the Council with respect to its duties;</text> </subparagraph><subparagraph id="idE0FD3696BDAC407384564B43CC1EF284"><enum>(B)</enum><text display-inline="yes-display-inline">the unresolved problems or concerns with operations, activities, or plans;</text>
 </subparagraph><subparagraph id="id6228FEB601884C30AA2E54E70D748A24"><enum>(C)</enum><text display-inline="yes-display-inline">the Council operations and expenditures, needs, issues, and recommendations; and</text> </subparagraph><subparagraph id="id5B8471EAA58148289E219D549CAE2E6B"><enum>(D)</enum><text display-inline="yes-display-inline">the annual independent audits required under paragraph (1).</text>
 </subparagraph></paragraph><paragraph id="id15B6CF1F255F4D2CB813DA5B0805C5E8"><enum>(3)</enum><header>GAO report</header><text display-inline="yes-display-inline">Not later than 3 years after the date of establishment of the Council, and thereafter as necessary, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report covering the operations and expenditures of the Council in carrying out this section, including any recommendations the Comptroller deems appropriate.</text>
 </paragraph></subsection><subsection id="id130E37CB131E4012ADD35B834A4A7182"><enum>(o)</enum><header>Suits barred</header><text display-inline="yes-display-inline">Neither the Council nor any committee, program, association, or other organization created by or under the authority of this section may sue a public or private person or entity concerning any matter arising under this section other than the performance of a contract.</text>
 </subsection><subsection id="id8F962F4824C74DB2996E0B376F60123E"><enum>(p)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id1536EB8CA6C7437DB7A049EA8ED34676"><enum>(1)</enum><header>Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means the Gulf Coast Regional Citizens’ Advisory Council established under subsection (a).</text>
 </paragraph><paragraph id="id918ACB77DF664EA4970C34E1383B4310"><enum>(2)</enum><header>Covered person</header><text display-inline="yes-display-inline">The term <term>covered person</term> means an owner or operator of a facility, an owner or operator of a tank vessel, a lessee, or a permittee, as those terms are defined in this Act.</text>
 </paragraph><paragraph id="id6F3452192AC246C790B08A72A3868117"><enum>(3)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means any department, agency, or other instrumentality of the Federal Government, any independent agency or establishment of the Federal Government including any Government corporation, and the Government Publishing Office.</text>
 </paragraph><paragraph id="idF89FA405FAF34F67B7BCC5FF228E8BF6"><enum>(4)</enum><header>Gulf Coast States</header><text display-inline="yes-display-inline">The term <term>Gulf Coast States</term> means the States of Alabama, Florida, Louisiana, Mississippi, and Texas.</text> </paragraph><paragraph id="id8DF7B827EC3F482F9CE63A62C59FF823"><enum>(5)</enum><header>Gulf of Mexico</header><text display-inline="yes-display-inline">The term <term>Gulf of Mexico</term> means the territorial seas and exclusive economic zone of the United States in the Gulf of Mexico.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id09FFA5FD519A4DA9BE86328378FADF12"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of contents in section 2 of the Oil Pollution Act of 1990 (104 Stat. 484) is amended by adding at the end of the items relating to subtitle A of title IV the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7228995151924547AA3AB01E83804F34" style="OLC"><toc><toc-entry bold="off" level="section">4119. Gulf of Mexico Regional Citizens' Advisory Council.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="idD6664D24DD6A4492A8DD16DC119E6451"><enum>107.</enum><header>Vessel as responsible party</header><text display-inline="no-display-inline">Section 1001(32)(A) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2701">33 U.S.C. 2701(32)(A)</external-xref>) is amended by striking <quote>with a single hull after December 31, 2010</quote>.</text> </section><section id="idD1E1D563C155469D83F3C17CD3F2C200"><enum>108.</enum><header>Transportation and commerce aspects of outer continental shelf lands</header> <subsection id="idBDCE34B7891B4B2894C26E4831CE7853"><enum>(a)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 22 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1348">43 U.S.C. 1348</external-xref>) is amended—</text>
 <paragraph id="id2EF4CB4D92804E2A9ECC25428C47A560"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(1)—</text> <subparagraph id="id5ECB4F59FAA44E76AC1D3904C2132A20"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>, each marine casualty and accident that posed a serious threat to the safety of life and property at sea or to the marine environment,</quote> after <quote>fire</quote>; and</text>
 </subparagraph><subparagraph id="id6224C748BEF54D18BADFE9F68E43B6E2"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, as a condition of the leases or permits” after “any such investigation</quote>;</text> </subparagraph></paragraph><paragraph id="id170EB52FD1A841719A324CFA5FF518B5"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)(2), by inserting <quote>, as a condition of the leases or permits” after “any such investigation</quote>;</text>
 </paragraph><paragraph id="id44D4F54EED93498F9CB65100A5DF470F"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text> <subparagraph id="id730644835D9844D085102CB7E5FF71D0"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Secretary, or, in the case of occupational safety and health,</quote> and inserting <quote>Secretary or</quote>; and</text>
 </subparagraph><subparagraph id="idFDE0FF919EBC4D2ABF65A4AC6D9AC9E2"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Coast Guard is operating,</quote> and inserting <quote>Coast Guard is operating</quote>; and</text> </subparagraph></paragraph><paragraph id="idCB8B77AB1C9C4989BF41AE871B72B0F2"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end of the section the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2DC6AFA8A3504CA3935997C5EB710F20" style="OLC">
							<subsection id="id3036309EE4814CDEB9660F1EC591245E"><enum>(g)</enum><header>Independent investigation of transportation accidents</header>
 <paragraph id="id83057237593F4696A5ED5129FC0E4848"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">At the request of the Secretary of the department in which the Coast Guard is operating or the Secretary, the National Transportation Safety Board may conduct an independent investigation of any accident, occurring in the outer Continental Shelf and involving activities under this Act, that does not otherwise fall within the definition of an accident or major marine casualty (as those terms are used in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/11">chapter 11</external-xref> of title 49, United States Code).</text>
 </paragraph><paragraph id="idEC0E4DD84D6346BAA6B4C8567C7E8C0E"><enum>(2)</enum><header>Transportation accident</header><text display-inline="yes-display-inline">For purposes of an investigation under this subsection, an accident that is the subject of a request under paragraph (1) shall be treated as a transportation accident (as that term is used in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/11">chapter 11</external-xref> of title 49, United States Code).</text>
								</paragraph></subsection><subsection id="id0E3E1C2199AA47478FA399ACCD8AE01E"><enum>(h)</enum><header>Information on causes and corrective actions</header>
 <paragraph id="id3A5CB44958C9406DB52037E5C1046248"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For each accident investigated under this section, the Secretary of the department in which the Coast Guard is operating and the Secretary shall promptly make available to the public technical information about the causes of the accident and corrective actions taken.</text>
 </paragraph><paragraph id="id3B140466B803469AADF6F30645D442D1"><enum>(2)</enum><header>Public database</header><text display-inline="yes-display-inline">All data and reports related to an accident described in paragraph (1) shall be maintained in a database that is freely available to the public.</text>
								</paragraph></subsection><subsection id="idD25D478E6CE54E9FB125FA8FDAFFD1A7"><enum>(i)</enum><header>Inspection fees</header>
 <paragraph id="id8F0B4D2DFD0A4297B2F150ACDBF44FDA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent necessary to fund the carrying out of inspections and other duties under this Act of the Secretary of the department in which the Coast Guard is operating and the Secretary of Commerce, upon the request of the Secretary of the department in which the Coast Guard is operating and the Secretary of Commerce, the Secretary shall collect a non-refundable inspection fee, which shall be deposited in the Ocean Commerce, Transportation, and Navigation Enforcement Fund established under paragraph (3), from the designated operator for facilities subject to inspection under subsection (c).</text>
 </paragraph><paragraph id="id88D1CD37245F43CD93DB94C9DE59647A"><enum>(2)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish, by rule, inspection fees—</text> <subparagraph id="idA262E601C8E64DC9A9515D42A16A68EA"><enum>(A)</enum><text display-inline="yes-display-inline">at an aggregate level equal to the amount necessary to offset the annual expenses incurred by the Secretary of the Department in which the Coast Guard is operating and the Secretary of Commerce in carrying out inspections of outer Continental Shelf facilities (including mobile offshore drilling units), administering and enforcing safety and health regulations and requirements, providing comments to and consulting with the Secretary as required under this Act; and</text>
 </subparagraph><subparagraph id="id0355B99C770144DF90BA693A79922770"><enum>(B)</enum><text display-inline="yes-display-inline">which may vary based on differences in size and complexity among classes of facilities.</text> </subparagraph></paragraph><paragraph id="idA74548E6B2354A069CF7BA7F4E2E3D66"><enum>(3)</enum><header>Ocean commerce, transportation, and navigation enforcement fund</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>Ocean Commerce, Transportation, and Navigation Enforcement Fund</quote> (referred to in this subsection as the <quote>Fund</quote>), into which shall be deposited amounts collected by the Secretary under paragraph (1) and which shall be available as provided under paragraph (4).</text>
 </paragraph><paragraph id="id8F53AC3E0FA44E4DBDE5D4BDB72359EF"><enum>(4)</enum><header>Availability of fees</header><text display-inline="yes-display-inline">Notwithstanding section 3302 of title 31, United States Code, all amounts collected by the Secretary under this section—</text>
 <subparagraph id="idECC4537E7E184417BAD1B38E841306AE"><enum>(A)</enum><text display-inline="yes-display-inline">shall be available for expenditure only for purposes of carrying out inspections of outer Continental Shelf facilities (including mobile offshore drilling units) and carrying out the other duties and responsibilities of the Secretary of the department in which the Coast Guard is operating and the Secretary of Commerce under this Act;</text>
 </subparagraph><subparagraph id="idBD7B6A51EB904F378DC09DAE005887F5"><enum>(B)</enum><text display-inline="yes-display-inline">shall be available only to the extent provided for in advance in an appropriations Act; and</text> </subparagraph><subparagraph id="idAA3596414F584BAAA8BF67D6C7F90631"><enum>(C)</enum><text display-inline="yes-display-inline">shall remain available until expended.</text>
									</subparagraph></paragraph><paragraph id="idD4CA5130C5BA4E5487FAD65589C45DE6"><enum>(5)</enum><header>Annual reports</header>
 <subparagraph id="idBBDBDD8C0A01451A97C887B8B8DB22C1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the end of each fiscal year beginning with fiscal year 2018, the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committees on Transportation and Infrastructure and Natural Resources of the House of Representatives a report on the operation of the Fund during the fiscal year.</text>
 </subparagraph><subparagraph id="id4A5E3FBDAB214C06B171AB62CDC27DFD"><enum>(B)</enum><header>Content</header><text display-inline="yes-display-inline">Each report shall include, for the fiscal year covered by the report, the following:</text> <clause id="idC8112FEC073646519E35C25527C84606"><enum>(i)</enum><text display-inline="yes-display-inline">A statement of the amounts deposited into the Fund.</text>
 </clause><clause id="id6F8FC13EA1634DACB241A5A5E4227246"><enum>(ii)</enum><text display-inline="yes-display-inline">A description of the expenditures made from the Fund for the fiscal year, including the purpose of the expenditures.</text>
 </clause><clause id="idF41672EE43BB4744A3375F35C33EBFEA"><enum>(iii)</enum><text display-inline="yes-display-inline">Recommendations for additional authorities to fulfill the purpose of the Fund.</text> </clause><clause id="idD307B5E95B1840B9BAA27D0FB2A5F244"><enum>(iv)</enum><text display-inline="yes-display-inline">A statement of the balance remaining in the Fund at the end of the fiscal year.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section></title><title id="ID4A06C889C5DE49098C0B1C67C9965960"><enum>II</enum><header>Improving marine oil spill preparedness</header>
			<section id="id1EAA3757072840E08D268D97FDE5959A"><enum>201.</enum><header>Improvements to National Oceanic and Atmospheric Administration oil spill response, containment,
			 and prevention</header>
				<subsection id="id9CBA4CF22CEB4075A4C2B78490695A14"><enum>(a)</enum><header>Review of ability of National Oceanic and Atmospheric Administration To respond to oil spills</header>
 <paragraph id="id00C4FD41DB694130B3999517A5C5FD5D"><enum>(1)</enum><header>Comprehensive review required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Under Secretary for Oceans and Atmosphere shall conduct a comprehensive review of the current capacity of the National Oceanic and Atmospheric Administration to respond to oil spills.</text>
 </paragraph><paragraph id="id01F859959941469F8B5FBECEE5C2569C"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The review under paragraph (1) shall include the following:</text> <subparagraph id="id293E9F0FEA6847CC8B8FF6823EE8E9B7"><enum>(A)</enum><text display-inline="yes-display-inline">A comparison of oil spill modeling requirements with the state-of-the-art oil spill modeling with respect to near shore and offshore areas.</text>
 </subparagraph><subparagraph id="id3A689FE206B249B1915EAB8AD62CD882"><enum>(B)</enum><text display-inline="yes-display-inline">Development of recommendations on priorities for improving forecasting of oil spill, trajectories, and impacts.</text>
 </subparagraph><subparagraph id="id34F2BF0CCB32420EBCDE31BA665CBB82"><enum>(C)</enum><text display-inline="yes-display-inline">An inventory of the products and tools of the National Oceanic and Atmospheric Administration that can aid in assessing the potential risk and impacts of oil spills. The products and tools may include environmental sensitivity index maps, the United States Integrated Ocean Observing System, research vessels, aviation-based sensors, satellites, and oil spill trajectory models.</text>
 </subparagraph><subparagraph id="idC54B7F49CC6748A7A76FF8D7EBEB38C4"><enum>(D)</enum><text display-inline="yes-display-inline">An identification of the baseline oceanographic and climate data required to support state-of-the-art modeling.</text>
 </subparagraph><subparagraph id="id70AB648C58484AD1BB1D9A4EAC72D899"><enum>(E)</enum><text display-inline="yes-display-inline">An assessment of the ability of the National Oceanic and Atmospheric Administration to respond to the effects of an oil spill on its trust resources, including—</text>
 <clause id="idB36CE932587B46D29F99A757CF053F29"><enum>(i)</enum><text display-inline="yes-display-inline">marine sanctuaries, monuments, and other protected areas; and</text> </clause><clause id="idE28FF949F9DD4CBE86EBAD4AA829B303"><enum>(ii)</enum><text display-inline="yes-display-inline">marine mammals, fish, corals, sea turtles, and other protected species, and efforts to rehabilitate these species.</text>
 </clause></subparagraph></paragraph><paragraph id="idA3A35A200C5B496681AA10D72F077B5A"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Upon completion of the review, the Under Secretary shall submit to Congress a report on the review, including the findings and recommendations.</text>
 </paragraph></subsection><subsection id="id5FAB84EA13934F9E874566519B9BFAF1"><enum>(b)</enum><header>Oil spill trajectory modeling</header><text display-inline="yes-display-inline">The Under Secretary for Oceans and Atmosphere shall be responsible for developing and maintaining oil spill trajectory modeling capabilities for the United States, including taking such actions as may be required by subsections (c) through (f).</text>
				</subsection><subsection id="id943A4870553A49F59BAE59B88240BD64"><enum>(c)</enum><header>Environmental sensitivity index</header>
 <paragraph id="idECF2FC641F404F7CB6B5EE7EB2620EF6"><enum>(1)</enum><header>Update</header><text display-inline="yes-display-inline">Beginning not later than 180 days after the date of enactment of this Act, and not less frequently than once every 7 years thereafter, the Under Secretary for Oceans and Atmosphere shall update the environmental sensitivity index products of the National Oceanic and Atmospheric Administration for—</text>
 <subparagraph id="id766C695B0F9546239C5D72C54D5172E6"><enum>(A)</enum><text display-inline="yes-display-inline">each coastal area of the United States;</text>
 </subparagraph><subparagraph id="idC1210E3F67C04E6390F74AE720F82374"><enum>(B)</enum><text display-inline="yes-display-inline">each offshore area of the United States that is leased or under consideration for leasing for offshore energy production; and</text>
 </subparagraph><subparagraph id="idA931DA307B8F4B8B975C6237E06B1486"><enum>(C)</enum><text display-inline="yes-display-inline">each offshore area of the United States that is under consideration for maritime transportation.</text>
 </subparagraph></paragraph><paragraph id="id4B56EDF6C7C64305B1192253BF35520A"><enum>(2)</enum><header>Expanded coverage</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Under Secretary for Oceans and Atmosphere, to the greatest extent practicable, shall create an environmental sensitivity index product for each area described in paragraph (1) for which the National Oceanic and Atmospheric Administration did not have an environmental sensitivity index product on the day before the date of enactment of this Act.</text>
 </paragraph><paragraph id="idCEB415FF2B014BD8BE36502001E6644C"><enum>(3)</enum><header>Environmental sensitivity index product defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>environmental sensitivity index product</term> means a map or similar tool that is utilized to identify sensitive shoreline, coastal or offshore, resources prior to an oil spill event in order to set baseline priorities for protection and plan cleanup strategies, typically including information relating to shoreline type, biological resources, and human use resources.</text>
 </paragraph></subsection><subsection id="idA68A8FC96D7C43DCA72A011456A8D3A0"><enum>(d)</enum><header>Subsea hydrocarbon review</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Under Secretary for Oceans and Atmosphere shall conduct a comprehensive review of the current state of the National Oceanic and Atmospheric Administration to monitor, map, and track subsea hydrocarbons, including a review of the effect of subsea hydrocarbons and dispersants at varying concentrations on living marine resources.</text>
 </subsection><subsection id="id7329FF7176994828BA88342412B2AC4A"><enum>(e)</enum><header>Initiative on oil spills from aging and abandoned oil infrastructure</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Under Secretary for Oceans and Atmosphere shall establish an initiative—</text>
 <paragraph id="idCCA5C32915E642C0A0D98A12ED4942FA"><enum>(1)</enum><text display-inline="yes-display-inline">to determine the significance, response, frequency, size, potential fate, and potential effects, including those on sensitive habitats, of oil spills resulting from aging and abandoned oil infrastructure; and</text>
 </paragraph><paragraph id="idD4162784D83E497C9398F96C4348B123"><enum>(2)</enum><text display-inline="yes-display-inline">to formulate recommendations on how best to address the spills described in paragraph (1).</text> </paragraph></subsection><subsection id="id979A54533580419BAF9A260CD2C35F4B"><enum>(f)</enum><header>Inventory of offshore abandoned or sunken vessels</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Under Secretary for Oceans and Atmosphere shall—</text>
 <paragraph id="id243EFE5AD12644C390991074F3F37775"><enum>(1)</enum><text display-inline="yes-display-inline">develop an inventory of offshore abandoned or sunken vessels in the exclusive economic zone (as established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note)); and</text>
 </paragraph><paragraph id="id67AAB7228F9D4B48954313648BEE2BB0"><enum>(2)</enum><text display-inline="yes-display-inline">identify priorities (based on amount of oil, feasibility of oil recovery, fate and effects of oil if released, and cost-benefit of preemptive action) for potential preemptive removal of oil or other actions that may be effective to mitigate the risk of oil spills from offshore abandoned or sunken vessels.</text>
					</paragraph></subsection></section><section id="ID0FAA8C2A1DAE4FB28E0EEA3DB9686ACD"><enum>202.</enum><header>Coast Guard response plan requirements</header>
 <subsection id="ID84275041BA574026B59ECCE63D838D96"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating shall require all response plans approved by the Coast Guard under section 311(j) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)</external-xref>) to be updated not less than once every 5 years.</text>
 </subsection><subsection id="ID429B0F39FBB64F0C93A258B365CAD0FD"><enum>(b)</enum><header>Best available technology</header><text>Each response plan update under subsection (a) shall utilize the best commercially available technology and methods to contain and remove to the maximum extent practicable a worst case discharge (including a discharge resulting from fire or explosion), and to mitigate or prevent a substantial threat of such a discharge.</text>
				</subsection><subsection id="ID06B394357C3540AC92E039744C080BC3"><enum>(c)</enum><header>Technology standards</header>
 <paragraph id="id1F185350BECD408D9BF6D81BEE8551A8"><enum>(1)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating may establish requirements and guidance for utilizing the best commercially available technology and methods under subsection (b).</text>
 </paragraph><paragraph id="idA2C278A4496D41AE893963B5C7C5D136"><enum>(2)</enum><header>Requirements</header><text>The best commercially available technology and methods shall be based on measurable standards and capabilities whenever practicable.</text>
 </paragraph></subsection><subsection id="IDA9BD37D4DA7E4B1CADED274284EB9DB9"><enum>(d)</enum><header>Resubmission</header><text>Each update under subsection (a) shall be considered a significant change requiring it to be resubmitted for approval by the Coast Guard.</text>
				</subsection></section><section id="ID513DCED7935C4787A0A42A98B133BFA9"><enum>203.</enum><header>Oil spill technology evaluation</header>
 <subsection id="IDDA13332C732E480E9D61D6113D392C9E"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating shall establish a program for the formal evaluation and validation of oil pollution containment and removal methods and technologies.</text>
				</subsection><subsection id="IDADDCD96094C946EB8188888A627EC14C"><enum>(b)</enum><header>Approvals</header>
 <paragraph id="idB638A09E7CCE4C52B35207AA911AEC4E"><enum>(1)</enum><header>In general</header><text>The program under subsection (a) shall include the establishment of a process for new methods and technologies—</text>
 <subparagraph id="id66726A893F2E42AD8E53BB826FD08E63"><enum>(A)</enum><text>to be submitted to and evaluated by the Secretary of the department in which the Coast Guard is operating; and</text>
 </subparagraph><subparagraph id="idF1FEBB4CCAF64842A088CCD666866F08"><enum>(B)</enum><text>to gain validation for use in spill responses and inclusion in response plans under section 311(j) of the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idE023046121AB432C8E601C6C28EB37EB"><enum>(2)</enum><header>Performance capabilities</header><text>Following each validation under paragraph (1)(B), the Secretary of the department in which the Coast Guard is operating shall consider whether the method or technology meets a performance capability warranting designation of a new standard for best available technology or methods.</text>
 </paragraph></subsection><subsection id="IDFB57C19A7F004EC0A61E12E6A2BBE428"><enum>(c)</enum><header>Technology clearinghouse</header><text>Each technology and method validated under subsection (b)(1)(B) shall be included in the comprehensive list of spill removal resources maintained by the Coast Guard through the National Response Unit.</text>
 </subsection><subsection id="ID7EA351630CF04801B56065A5C26583BB"><enum>(d)</enum><header>Consultation</header><text>The Secretary of the department in which the Coast Guard is operating shall consult with the Secretary of the Interior, the Under Secretary for Oceans and Atmosphere, the Administrator of the Environmental Protection Agency, the Secretary of Transportation, and the Secretary of Energy in carrying out this section.</text>
				</subsection></section><section id="id87B3EE4205C24607BF2240639DFFC3E5"><enum>204.</enum><header>Safety management system requirements for mobile offshore drilling units</header>
 <subsection id="idCC9AA5E6B9C443399DE2334FC6B501F1"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">Section 3202 of title 46, United States Code, is amended—</text> <paragraph id="id987F774AB9BB4EC4B05C1C827E86BDE5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)(B) by striking <quote>vessel, or self-propelled mobile offshore drilling unit; and</quote> and inserting <quote>vessel; and</quote>; and</text>
 </paragraph><paragraph id="id7D7A0465D2F545358B6F701CBDDEB629"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subsection (b) to read as follows:</text> <quoted-block display-inline="no-display-inline" id="idA042A296AA2D4BF38CA0CA38D664F731" style="OLC"> <subsection id="idFAA6D53F5DE64D80974F397194F0FD11"><enum>(b)</enum><header>Other Vessels</header><text display-inline="yes-display-inline">This chapter applies to a vessel that—</text>
 <paragraph id="idACF25C841A74455088880D04F3ADAED5"><enum>(1)</enum><text display-inline="yes-display-inline">is a passenger vessel or small passenger vessel and is transporting more passengers than a number prescribed by the Secretary based on the number of individuals on the vessel that could be killed or injured in a marine casualty; or</text>
 </paragraph><paragraph id="id1C3F8A763AB84A7CB59CDC16F3114190"><enum>(2)</enum><text display-inline="yes-display-inline">is a mobile offshore drilling unit.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection><subsection id="id7C91248DFC7C4115AD5DCE8675676293"><enum>(b)</enum><header>Safety management systems</header><text display-inline="yes-display-inline">Section 3203 of title 46, United States Code, is amended—</text>
 <paragraph id="idC98136C9A916496F8B9EFBD997092258"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as subsection (c); and</text> </paragraph><paragraph id="id727829D377954752BED17A65F1B5488E"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text>
						<quoted-block display-inline="no-display-inline" id="id253E24874059401CB1FFA851BAC4CC82" style="OLC">
 <subsection id="idE2CE36EF9C2C426EBBC0059F2BB58825"><enum>(b)</enum><header>Mobile offshore drilling units</header><text display-inline="yes-display-inline">The safety management system described in subsection (a) for a mobile offshore drilling unit operating in waters subject to the jurisdiction of the United States, including the exclusive economic zone (as established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note)), shall include processes, procedures, and policies related to the safe, environmentally sound operation and maintenance of all machinery and systems of the unit that are used for the commercial industrial functions and purposes of the unit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="idD941A19F4B944479A799C08A56DE0521"><enum>205.</enum><header>Gulf of Mexico long-term marine environmental monitoring and research program</header>
				<subsection id="id5F56C79EECBD423A9F2C98F06ED42C19"><enum>(a)</enum><header>Environmental monitoring and research program required</header>
 <paragraph id="id46AF13D2B3A04540A1916D532F87BF8C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, and subject to the availability of appropriations or other sources of funding, the Secretary, acting through the Under Secretary for Oceans and Atmosphere, shall establish and carry out a long-term marine environmental monitoring and research program for the marine and coastal environment of the Gulf of Mexico to ensure that the Federal Government has independent, peer-reviewed scientific data and information to assess long-term direct and indirect impacts on trust resources located in the Gulf of Mexico and Southeast region resulting from the oil spill caused by the mobile offshore drilling unit Deepwater Horizon.</text>
 </paragraph><paragraph id="id78D5BCEB435A4F899609E65C7CFAB030"><enum>(2)</enum><header>Period of program</header><text display-inline="yes-display-inline">The Secretary, acting through the Under Secretary for Oceans and Atmosphere, shall carry out the program under paragraph (1) during the 10-year period beginning on the date of commencement of the program. The Secretary may extend the period if the Secretary determines that additional monitoring and research is warranted.</text>
 </paragraph></subsection><subsection id="idA1520B7AA3EA4F2BA3EFA36C46EC577A"><enum>(b)</enum><header>Scope of program</header><text display-inline="yes-display-inline">The program under subsection (a) shall include the following:</text> <paragraph id="idE1EA456B5C84455DA7FDE05E95A952C9"><enum>(1)</enum><text display-inline="yes-display-inline">Monitoring and research of the physical, chemical, and biological characteristics of the affected marine, coastal, and estuarine regions of the Gulf of Mexico and other regions of the exclusive economic zone (as established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note)) and adjacent regions affected by the oil spill caused by the mobile offshore drilling unit Deepwater Horizon.</text>
 </paragraph><paragraph id="idB86EA3AB81BE4D0D98AF9CF81F42E05B"><enum>(2)</enum><text display-inline="yes-display-inline">The fate, transport, and persistence of oil released during the spill and spatial distribution throughout the water column, including in-situ burn residues.</text>
 </paragraph><paragraph id="id7CDD087BE1B14B069DF46E7DD31A13CB"><enum>(3)</enum><text display-inline="yes-display-inline">The fate, transport, and persistence of chemical dispersants applied in-situ or on surface waters.</text> </paragraph><paragraph id="id3B4F056B4D8C467C9D83A468F1FB9ADF"><enum>(4)</enum><text display-inline="yes-display-inline">Identification of lethal and sub-lethal impacts to shellfish, fish, and wildlife resources that utilize habitats located within the affected region.</text>
 </paragraph><paragraph id="id264BF15320ED4E889F68A72D6EE9272E"><enum>(5)</enum><text display-inline="yes-display-inline">Impacts to regional, State, and local economies that depend on the natural resources of the affected region, including commercial and recreational fisheries, tourism, and other wildlife-dependent recreation.</text>
 </paragraph><paragraph id="id523B631138014A4F9773349B74EC0ABC"><enum>(6)</enum><text display-inline="yes-display-inline">Such other elements that the Secretary considers necessary to ensure a comprehensive marine research and monitoring program to comprehend the implications to trust resources caused by the oil spill from the mobile offshore drilling unit Deepwater Horizon.</text>
 </paragraph></subsection><subsection id="id7D8E8300808D4AEC974A8A5F1B1B811A"><enum>(c)</enum><header>Cooperation and consultation</header><text display-inline="yes-display-inline">In developing the research and monitoring program under subsection (a), the Secretary, acting through the Under Secretary for Oceans and Atmosphere, shall—</text>
 <paragraph id="id21734B5751FF4DDC90C8B57F5C878779"><enum>(1)</enum><text display-inline="yes-display-inline">coordinate with the United States Geological Survey; and</text> </paragraph><paragraph id="idB12C34DD6758451FBC749621CF8B29A5"><enum>(2)</enum><text display-inline="yes-display-inline">consult with—</text>
 <subparagraph id="id0076F7DA7F464D6B932663549AC6C802"><enum>(A)</enum><text display-inline="yes-display-inline">the National Ocean Research Leadership Council established under section 7902 of title 10, United States Code;</text>
 </subparagraph><subparagraph id="idAE731D7FBF954FBD849309EFE3D82E7A"><enum>(B)</enum><text display-inline="yes-display-inline">such representatives from the Gulf coast States and affected countries as the Secretary considers appropriate;</text>
 </subparagraph><subparagraph id="id9FCB49EC705849B1B643F351DC3FBD20"><enum>(C)</enum><text display-inline="yes-display-inline">such academic institutions and other research organizations as the Secretary considers appropriate; and</text>
 </subparagraph><subparagraph id="id84C9A6EA784B4B3698F49B458872AB5F"><enum>(D)</enum><text display-inline="yes-display-inline">such other experts with expertise in long-term environmental monitoring and research of the marine environment as the Secretary considers appropriate.</text>
 </subparagraph></paragraph></subsection><subsection id="id05AED090E5884961ADDA5312E5AD7C4C"><enum>(d)</enum><header>Availability of data</header><text display-inline="yes-display-inline">Upon the review by and approval of the Attorney General regarding impacts on legal claims or litigation involving the United States, data and information generated through the program established under subsection (a) shall be managed and archived to ensure that it is accessible and available to the general public for their use and information.</text>
 </subsection><subsection id="id0779190D5BC84D6DA88F424BEFE87735"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the commencement of the program under subsection (a), and biennially thereafter, the Secretary shall submit to Congress a comprehensive report—</text>
 <paragraph id="id084A9D3EF1C242E9A550DA441F8A2EA5"><enum>(1)</enum><text display-inline="yes-display-inline">summarizing the activities and findings of the program; and</text> </paragraph><paragraph id="idD6088B373E64470BB033D12CCD66DA08"><enum>(2)</enum><text display-inline="yes-display-inline">detailing areas and issues requiring future monitoring and research.</text>
 </paragraph></subsection><subsection id="id84571509D9574BA98CEFB8A70F17F356"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="id84A46454BAFD4EF7B31A1584FC334F97"><enum>(1)</enum><header>Gulf coast State</header><text display-inline="yes-display-inline">The term <term>Gulf coast State</term> means each of the States of Texas, Louisiana, Mississippi, Alabama, and Florida.</text>
 </paragraph><paragraph id="id3106FD4909984EC5B90B1EB418FD10EC"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce.</text> </paragraph><paragraph id="id7264BE253C474CD5B27817E7709674AF"><enum>(3)</enum><header>Trust resources</header><text display-inline="yes-display-inline">The term <term>trust resources</term> means the living and non-living natural resources belonging to, managed by, held in trust by, appertaining to, or otherwise controlled by the United States, any State, federally recognized Indian tribe, or a local government.</text>
					</paragraph></subsection></section><section id="idFC099035E7D54060B7B77AB287A45633"><enum>206.</enum><header>Use of oil spill liability trust fund for expenses of National Oceanic and Atmospheric
 Administration</header><text display-inline="no-display-inline">Section 1012(a)(5)(B) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(5)(B)</external-xref>) is amended by striking <quote>$15,000,000</quote> and inserting <quote>$25,000,000</quote>.</text>
			</section><section id="id15AAF11FBD8E4B189DBF15A9E354F8B4"><enum>207.</enum><header>Notice to States of bulk oil transfers</header>
 <subsection id="id344EFF1D77054A5D834508FCD66DB3FF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A State may require, by law, a person to provide notice of 24 hours or more to the State and to the Coast Guard prior to transferring oil in bulk as cargo in an amount equivalent to 250 barrels or more to, from, or within a vessel in State waters.</text>
 </subsection><subsection id="id91177C270D694825ABE4C638C1B682ED"><enum>(b)</enum><header>Coast Guard assistance</header><text display-inline="yes-display-inline">The Commandant of the Coast Guard may assist a State in developing appropriate methodologies for joint Federal and State notification of an oil transfer described in subsection (a) to minimize any potential burden to vessels.</text>
 </subsection></section><section id="id7A5B503C70DA4AF5A975CDDCB924A808"><enum>208.</enum><header>Coast Guard research and development</header><text display-inline="no-display-inline">Section 1012(a)(5)(A) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)(5)(A)</external-xref>) is amended—</text> <paragraph id="id53151B1A30934A3C803D3AD185D3E43A"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>$25,000,000</quote> and inserting <quote>$50,000,000</quote>; and</text>
 </paragraph><paragraph id="id22CDEDA43FC745BAB4DD6FF9DDF74702"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the semicolon at the end and inserting <quote>, of which amount not less than 40 percent shall be used to conduct research, development, and evaluation of oil spill response and removal technologies and methods;</quote>.</text>
				</paragraph></section></title><title id="ID1C70346EDE3B452EA02A55FA3A1E847B"><enum>III</enum><header>Improving marine oil spill response capabilities</header>
			<section id="id2BEB14E1F93A45B3A5B60C8D7D5B1C87"><enum>301.</enum><header>Prompt publication of oil spill information</header>
 <subsection id="idA9DFDB7076BD48B6BEDF9AEEA627DB16"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In any response to an oil spill in which the Commandant of the Coast Guard serves as the Federal On-Scene Coordinator leading a Unified Command, the Commandant shall publish, on a publicly accessible website, all written Incident Action Plans prepared and approved as a part of the response to such oil spill.</text>
 </subsection><subsection id="id76B264606AB141D8B368635A9432BDE7"><enum>(b)</enum><header>Timeliness and duration</header><text display-inline="yes-display-inline">The Commandant shall—</text> <paragraph id="id021E2DD0C7254E8FA5A135E20C1A712C"><enum>(1)</enum><text display-inline="yes-display-inline">publish each Incident Action Plan under subsection (a) promptly after such plan is approved for implementation by the Unified Command, and in no event later than 12 hours into the operational period for which such plan is prepared; and</text>
 </paragraph><paragraph id="id8D2A4C68867F4883B0001045C3EB644B"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that such plan remains up-to-date and publicly accessible by website for the duration of the response to an oil spill.</text>
 </paragraph></subsection><subsection id="idAB1F069E923149B9B56933E40096D271"><enum>(c)</enum><header>Redaction of personal information</header><text display-inline="yes-display-inline">The Commandant may redact information from an Incident Action Plan published under subsection (a) to the extent necessary to comply with applicable privacy laws and other requirements regarding personal information.</text>
				</subsection></section><section id="IDF7ED2E6050434480BBF4C24BCB2AC564"><enum>302.</enum><header>Coordination of Federal, State, and local activities with respect to oil spill surveys</header>
 <subsection id="ID72752C120FC9423880AB56D698F83042"><enum>(a)</enum><header>Development of national protocols for oil spill surveys</header><text>Not later than 270 days after the date of enactment of this Act, the Under Secretary for Oceans and Atmosphere, in coordination with the Secretary of Homeland Security, the Administrator of the Environmental Protection Agency, and the heads of such departments and agencies of State governments as the Under Secretary considers appropriate, shall develop standard national protocols for oil spill response and clean up assessments to promote consistent procedures for collecting shoreline characterization data and to ensure that the format and resolution of such data are consistent with the needs of coastal States. Such protocols shall encourage, to the extent practicable, the use of electronic methods of data collection.</text>
 </subsection><subsection id="IDF1DE8720C48D4480AF10BA7896413183"><enum>(b)</enum><header>Guidance and tools for application of national protocols for oil spill surveys</header><text>The Under Secretary for Oceans and Atmosphere shall develop guidance and tools for oil spill responders and offer instructional courses to ensure that the standard national protocols developed under subsection (a) are used during oil spill responses in the waters subject to the jurisdiction of the United States, including the exclusive economic zone (as established by Presidential Proclamation Numbered 5030 of March 10, 1983 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref> note)).</text></subsection></section></title></legis-body></bill>
