		<official-title>To preserve the integrity of American elections by providing the Attorney General with the
			 investigative tools to identify and prosecute foreign agents who seek to
			 circumvent Federal registration requirements and unlawfully influence the
			 political process. </official-title>

 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Agents Registration Modernization and Enforcement Act</short-title></quote>.</text>
 </section><section id="iddb39f43e0c004ac89f9227ebf5fadde9"><enum>2.</enum><header>Civil investigative demand authority</header><text display-inline="no-display-inline">The Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref> et seq.) is amended—</text> <paragraph id="id1d1f9045321a402f853a1c6aca5859f4"><enum>(1)</enum><text>by redesignating sections 8, 9, 10, 11, 12, 13, and 14 as sections 9, 10, 11, 12, 13, 14, and 15, respectively; and</text>
 </paragraph><paragraph id="idBBD9155993B8473D9A3A4DA921330B6C"><enum>(2)</enum><text>by inserting after section 7 (<external-xref legal-doc="usc" parsable-cite="usc/22/617">22 U.S.C. 617</external-xref>) the following:</text> <quoted-block display-inline="no-display-inline" id="id58a4fcfd4b034fb9b33a8a319dd0beae" other-style="archaic" style="other"><section id="id189d7adc83274829827b3cc486fbc04d"><enum>8.</enum><header>Civil investigative demand authority</header><subsection commented="no" display-inline="yes-display-inline" id="idB6F5D764078C4794AE143EF1BB0C380D"><enum>(a)</enum><text display-inline="yes-display-inline">Whenever the Attorney General has reason to believe that any person or enterprise may be in possession, custody, or control of any documentary material relevant to an investigation under this Act, the Attorney General, before initiating a civil or criminal proceeding with respect to the production of such material, may serve a written demand upon such person to produce such material for examination.</text>
 </subsection><subsection id="idbc86812c32a440d5b0695ce88f6e3d2a"><enum>(b)</enum><text>Each such demand under this section shall—</text> <paragraph id="id39777f275a3e435b919112096adc2e2a"><enum>(1)</enum><text>state the nature of the conduct constituting the alleged violation which is under investigation and the provision of law applicable to such violation;</text>
 </paragraph><paragraph id="id95d35f0fdc7140b49d0e10c315d3c847"><enum>(2)</enum><text>describe the class or classes of documentary material required to be produced under such demand with such definiteness and certainty as to permit such material to be fairly identified;</text>
 </paragraph><paragraph id="id4f13c0006b004852a5d9919cb213347b"><enum>(3)</enum><text>state that the demand is immediately returnable or prescribe a return date which will provide a reasonable period within which the material may be assembled and made available for inspection and copying or reproduction; and</text>
 </paragraph><paragraph id="idfd3e8bf4a83b46db876948ae0b0a4d9f"><enum>(4)</enum><text>identify the custodian to whom such material shall be made available.</text> </paragraph></subsection><subsection id="ide8c70c91fec84e4cb7b3563ff7ceec52"><enum>(c)</enum><text>A demand under this section may not—</text>
 <paragraph id="id6438809359454556bb4f52b8abeae76f"><enum>(1)</enum><text>contain any requirement that would be considered unreasonable if contained in a subpoena duces tecum issued by a court of the United States in aid of grand jury investigation of such alleged violation; or</text>
 </paragraph><paragraph id="id44e1545bd3254ab59a2df8277c1032ce"><enum>(2)</enum><text>require the production of any documentary evidence that would be privileged from disclosure if demanded by a subpoena duces tecum issued by a court of the United States in aid of a grand jury investigation of such alleged violation.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id6876633368524cb4b90142f5e69e7876"><enum>3.</enum><header>Informational materials</header>
 <subsection id="idBC6F0E7731B24671BC9D1FA90BC7AC25"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>) is amended—</text> <paragraph id="id9C564349FB6948FC928F58EFAF3E9105"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (1), by striking <quote>Expect</quote> and inserting <quote>Except</quote>; and</text>
 </paragraph><paragraph id="idD32E0A3155DB44159FFD1502CD42D58C"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (i) the following:</text> <quoted-block display-inline="no-display-inline" id="idcbd7151d0eb04f33ab05c684aef1bd11" style="OLC"> <subsection id="id6462cf6cb9e2415f945049bf6bc1036c"><enum>(j)</enum><text>The term <term>informational materials</term> means any oral, visual, graphic, written, or pictorial information or matter of any kind, including matter published by means of advertising, books, periodicals, newspapers, lectures, broadcasts, motion pictures, or any means or instrumentality of interstate or foreign commerce or otherwise.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id7A555819BF2A459E967C132B45B874E0"><enum>(b)</enum><header>Informational materials</header><text display-inline="yes-display-inline">Section 4 of the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/614">22 U.S.C. 614</external-xref>) is amended—</text> <paragraph id="id859e4dc22a5744ca863f9d45c6296cdd"><enum>(1)</enum><text>in section (a)—</text>
 <subparagraph id="id98DC1854ABD44F65AD3D8DD86026CDAD"><enum>(A)</enum><text>by inserting <quote>, including electronic mail and social media,</quote> after <quote>United States mails</quote>; and</text> </subparagraph><subparagraph id="idefac069613044f5c9e6d967afaae34ce"><enum>(B)</enum><text>by striking <quote>, not later than forty-eight hours after the beginning of the transmittal thereof, file with the Attorney General two copies thereof</quote> and inserting <quote>file such materials with the Attorney General in conjunction with, and at the same intervals as, disclosures required under section 2(b).</quote>; and</text>
 </subparagraph></paragraph><paragraph id="id92b4ff8bed3c48e2a09a051569ba98fd"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="idE2466EF8C4DB45F9BC6EE2DB175106DD"><enum>(A)</enum><text>by striking <quote>It shall</quote> and inserting <quote>(1) Except as provided in paragraph (2), it shall</quote>; and</text>
 </subparagraph><subparagraph id="ida70514d847ea4f4bbf0a7b052c939eb2"><enum>(B)</enum><text>by inserting at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id249fca9b4abc4e5db108dcec7109e5d8" style="OLC"> <paragraph id="id2d452138beb94e4db0be60f2795339a6" indent="up1"><enum>(2)</enum><text>Foreign agents described in paragraph (1) may omit disclosure required under that paragraph in individual messages, posts, or transmissions on social media on behalf of a foreign principal if the social media account or profile from which the information is sent includes a conspicuous statement that—</text>
 <subparagraph id="id26FD09B931724EC6BB6F49E4869316BD"><enum>(A)</enum><text>the account is operated by, and distributes information on behalf of, the foreign agent; and</text> </subparagraph><subparagraph id="idBA5C69D052D84C8E9D51690C696CE455"><enum>(B)</enum><text>additional information about the account is on file with the Department of Justice in Washington, District of Columbia.</text>
 </subparagraph></paragraph><paragraph id="idE1FB78BEC6AE4CFEBE99CDF7D2ED0B26" indent="up1"><enum>(3)</enum><text>Informational materials disseminated by an agent of a foreign principal as part of an activity that is exempt from registration, or an activity which by itself would not require registration, need not be filed under this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection></section><section id="ide926cec0332f4be28e7fbae07461acf6"><enum>4.</enum><header>Fees</header>
 <subsection id="idcc945cddd46041caa7fa77df1071892a"><enum>(a)</enum><header>Repeal</header><text>The Department of Justice and Related Agencies Appropriations Act, 1993 (title I of <external-xref legal-doc="public-law" parsable-cite="pl/102/395">Public Law 102–395</external-xref>) is amended, under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses, General Legal Activities</header-in-text></quote>, by striking <quote>In addition, notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/3302">31 U.S.C. 3302</external-xref>, for fiscal year 1993 and thereafter, the Attorney General shall establish and collect fees to recover necessary expenses of the Registration Unit (to include salaries, supplies, equipment and training) pursuant to the Foreign Agents Registration Act, and shall credit such fees to this appropriation, to remain available until expended.</quote>.</text>
 </subsection><subsection id="idF1F3F212E78344B0AB1CAA0DC30BBA8A"><enum>(b)</enum><header>Registration fee</header><text>The Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref> et seq.), as amended by this Act, is further amended by adding at the end the following:</text>
 <quoted-block display-inline="no-display-inline" id="id0F572E0316284DC090FB36C64C4B817A" other-style="archaic" style="other"><section id="idE1467014A5684F87BC6D8B515895ADC0"><enum>16.</enum><header>Fees</header><text display-inline="yes-display-inline">The Attorney General shall establish and collect a registration fee, as part of the initial filing requirement and at no other time, to help defray the expenses of the Registration Unit, and shall credit such fees to this appropriation, to remain available until expended.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection></section><section id="id1F361F1E1EF449F1ADA2C191163390DB"><enum>5.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Section 12 of the Foreign Agents Registration Act of 1938, as amended, as redesignated by section 3, is amended to read as follows:</text>
 <quoted-block display-inline="no-display-inline" id="idAC9A6EA131D349A78C0A3C7A449F0120" other-style="archaic" style="other"><section id="id898EA68823A64A1090A3C3031AD6DC45"><enum>12.</enum><header>Reports to Congress</header><text>The Assistant Attorney General for National Security, through the FARA Registration Unit of the Counterintelligence and Export Control Section, shall submit a semiannual report to Congress regarding the administration of this Act, including, for the reporting period, the identification of—</text>
 <paragraph id="idB0A1CBD272D9401DB783765EEA233507"><enum>(1)</enum><text display-inline="yes-display-inline">registrations filed pursuant to this Act;</text> </paragraph><paragraph id="id8239840FF7C9483594DF84FE1C9940D8"><enum>(2)</enum><text display-inline="yes-display-inline">the nature, sources, and content of political propaganda disseminated and distributed by agents of foreign principal;</text>
 </paragraph><paragraph id="id9BAAC66258CC43868EAACE857BE35BDE"><enum>(3)</enum><text display-inline="yes-display-inline">the number of investigations initiated based upon a perceived violation of section 7; and</text> </paragraph><paragraph id="idC30B0A50AF934E529CAEE15A22894EEB"><enum>(4)</enum><text display-inline="yes-display-inline">the number of such investigations that were referred to the Attorney General for prosecution.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
