	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H39713A61A5BB4BD2B6670CC3B3F56658" style="OLC">
 <section id="H14CC191FA1264A83ADA983BB7E46610A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Regulations Act of 2017</short-title></quote>.</text> </section><section id="HBF6DA4BC40A64BE0B623804DB2A1A3EE"><enum>2.</enum><header>Agency Standards for Guidance Documents</header> <subsection id="H4158A76DDEEF42498CBCAA3DABD1B83C"><enum>(a)</enum><header>Definitions</header><text>In this section:</text>
 <paragraph id="HAA9920272A164C8597AE03FDDEAABDDE"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Office of Information and Regulatory Affairs in the Office of Management and Budget.</text>
 </paragraph><paragraph id="H033C20EE9FA64842ACDACFFDF8B15919"><enum>(2)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given the term in section 3502 of title 44, United States Code.</text> </paragraph><paragraph id="H0B16C56CE0A845B9A0253E85D9BE712F"><enum>(3)</enum><header>Guidance document</header><text display-inline="yes-display-inline">The term <term>guidance document</term>—</text>
 <subparagraph id="idAD7E390FB158499CB0D813C20A966B4D"><enum>(A)</enum><text display-inline="yes-display-inline">means an agency statement of general applicability and future effect, other than a regulatory action, that sets forth a policy on a statutory, regulatory, or technical issue or an interpretation of a statutory or regulatory issue; and</text>
 </subparagraph><subparagraph id="HC74B3A62A79E421E97C0E5B3FEE4D810"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text> <clause id="H212BA88B441747A6997B9595FDE6131B"><enum>(i)</enum><text>a legal advisory opinion for internal executive branch use and not for release (such as Department of Justice Office of Legal Counsel opinions);</text>
 </clause><clause id="H9F375811B57C4FED9FACE5AA1508955A"><enum>(ii)</enum><text>a brief or other position taken by an agency in an investigation, pre-litigation, litigation, or other enforcement proceeding;</text>
 </clause><clause id="HDBAF7B4A941145DA993C9945DFC37F0B"><enum>(iii)</enum><text>a speech, editorial, media interview, press material, or congressional correspondence;</text> </clause><clause id="H68C77A7F5381418EB41D65A50F1FB52A"><enum>(iv)</enum><text>a guidance document that relates to a military or foreign affairs function of the United States (other than a guidance document on procurement or the import or export of non-defense articles and services);</text>
 </clause><clause id="H4B2A0369A4544650B98C226719A86497"><enum>(v)</enum><text>a grant solicitation, warning letter, or case or investigatory letter responding to a complaint involving a fact-specific determination;</text>
 </clause><clause id="HACE9B3DA16414E0E83AC10955A5DE1C9"><enum>(vi)</enum><text>a purely internal agency policy;</text> </clause><clause id="H20B82C534054499197D31BF20050C7C3"><enum>(vii)</enum><text>a guidance document that relates to the use, operation, or control of a government facility;</text>
 </clause><clause id="H7A63EFB5FED44663A45B8014583ACC59"><enum>(viii)</enum><text>an internal guidance document directed solely to other agencies; or</text> </clause><clause commented="no" display-inline="no-display-inline" id="H11191590107A4CF893420BE5EE9E9806"><enum>(ix)</enum><text>any other category of guidance documents exempted by the head of an agency, in consultation with the Administrator.</text>
 </clause></subparagraph></paragraph><paragraph id="HB05EFD6500E84A52993A685EA2F3F49E"><enum>(4)</enum><header>Regulation</header><text display-inline="yes-display-inline">The term <term>regulation</term> means an agency statement of general applicability and future effect, which the agency intends to have the force and effect of law, that is designed to implement, interpret, or prescribe law or policy or to describe the procedure or practice requirements of an agency.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="H35C22D4008EB4833BD245B59DE9626F9"><enum>(5)</enum><header>Regulatory action</header><text display-inline="yes-display-inline">The term <term>regulatory action</term> means any substantive action by an agency (normally published in the Federal Register) that promulgates or is expected to lead to the promulgation of a final regulation, including notices of inquiry, advance notices of inquiry and notices of proposed rule making.</text>
				</paragraph></subsection><subsection id="H5EAEA49B388C4C188FF826A517DBD048"><enum>(b)</enum><header>Approval procedures</header>
 <paragraph id="HCA2919A0B97C4D589A97B43C84283F40"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 210 days after the date of enactment of this Act, the head of each agency shall develop or have written procedures for the approval of guidance documents, which shall ensure that the issuance of guidance documents is approved by each appropriate senior agency official.</text>
 </paragraph><paragraph id="H73B9FC9EFD4A44C786E9C3771113627C"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">An employee of an agency may not deviate from the requirements of the procedures developed pursuant to paragraph (1) unless—</text>
 <subparagraph id="id9C918A12F17745ADBC94F3B29579CDE7"><enum>(A)</enum><text display-inline="yes-display-inline">the employee has submitted an appropriate justification to a supervisor who is an appropriate senior agency official described paragraph (1) or the head of the agency; and</text>
 </subparagraph><subparagraph id="idA883EDF36D834AA49580C76F63C8FBA3"><enum>(B)</enum><text display-inline="yes-display-inline">the supervisor or head of the agency has agreed to the deviation.</text>
					</subparagraph></paragraph></subsection><subsection id="HA8039D2988A7485CB33F758A285213E6"><enum>(c)</enum><header>Contents of guidance document</header>
 <paragraph id="H25DD96A0A74D408EBDB04599B57A612D"><enum>(1)</enum><header>Requirements</header><text display-inline="yes-display-inline">Each guidance document issued by an agency shall include the following:</text> <subparagraph id="H294CE91DE3AE4DCA854258C4E0133A0C"><enum>(A)</enum><text>The term <term>guidance</term> or a functional equivalent of that term.</text>
 </subparagraph><subparagraph id="HA4759F2B18D241E8AB0A0CBEBFA1F826"><enum>(B)</enum><text>An identification of each agency and office issuing the document.</text> </subparagraph><subparagraph id="H217300E7D2BB44F88FBC3D3480EA0B76"><enum>(C)</enum><text display-inline="yes-display-inline">An identification of the activity to which and the person to whom the guidance document applies.</text>
 </subparagraph><subparagraph id="H336690748FAA44E4967CC957152F75A4"><enum>(D)</enum><text>The date of issuance.</text> </subparagraph><subparagraph id="HA034CBD680E4427D8BE4C453AA4D9412"><enum>(E)</enum><text display-inline="yes-display-inline">If the document is a revision to a previously issued guidance document, a notation of such and an identification of the document replaced.</text>
 </subparagraph><subparagraph id="H92A15D3A60404826867422C38B2885D8"><enum>(F)</enum><text>The title of the document and any identification number, if applicable.</text> </subparagraph><subparagraph id="H3EA911E3A358404F85A120403093B764"><enum>(G)</enum><text>A citation to the statutory provision or regulation to which the document applies or interprets.</text>
 </subparagraph></paragraph><paragraph id="HEB9CC870D72B4F148ABADD8EBFA866A2"><enum>(2)</enum><header>Prohibited</header><text display-inline="yes-display-inline">A guidance document may not include mandatory language such as <quote>shall</quote>, <quote>must</quote>, <quote>required</quote>, or <quote>requirement</quote>, unless—</text> <subparagraph id="HB7CE51E1C6044B068277AA00626DC8E1"><enum>(A)</enum><text>the agency is using these words to describe a statutory or regulatory requirement;</text>
 </subparagraph><subparagraph id="HA9F6668890054FF888701AE5D8F77530"><enum>(B)</enum><text>the language is addressed to agency employees; or</text> </subparagraph><subparagraph id="H542387A6E8A843F0BB27F40EAC4C3BF5"><enum>(C)</enum><text>the prohibition against that mandatory language prevents agency consideration of a position advanced by any affected private party.</text>
					</subparagraph></paragraph></subsection><subsection id="HC2ECAF7D155642F69A95C9C2561B08CB"><enum>(d)</enum><header>Public access and feedback for guidance documents</header>
				<paragraph id="H862723169126435CA66AB591AD103411"><enum>(1)</enum><header>Internet access</header>
 <subparagraph id="HC211C3590BDD4DFBB3E8514DDB25E287"><enum>(A)</enum><header>List required</header><text display-inline="yes-display-inline">The head of each agency shall maintain on the website of the agency a list of each guidance document in effect, which shall include the following:</text>
 <clause id="HEEAC7ECEFE7945CC9986B71FF0945A99"><enum>(i)</enum><text>The name of each guidance document.</text> </clause><clause id="H81A71474F2BF4A498BCE94DE0AA1E707"><enum>(ii)</enum><text>Any document identification number.</text>
 </clause><clause id="H0CDD12505378439288D6CB03D938C350"><enum>(iii)</enum><text>The dates of issuance and revision.</text> </clause><clause id="H9A6AC6571C50466399CFCED5406F33B3"><enum>(iv)</enum><text>An identification of which documents have been added, revised, or withdrawn during the previous year.</text>
 </clause></subparagraph><subparagraph id="H402C39CD5DE94BDD87B5C57463EAFBDA"><enum>(B)</enum><header>Link to document required</header><text>The head of the agency shall provide a link from the list described in subparagraph (A) to each such guidance document.</text>
 </subparagraph><subparagraph id="HE5ED6A3FF08A4655880FA1A38BDFAFDE"><enum>(C)</enum><header>Updates to website</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which a guidance document is issued, the head of the agency shall update the list of guidance documents and links described in this paragraph accordingly.</text>
					</subparagraph></paragraph><paragraph id="H1442D7581F234F358817A39CCF634527"><enum>(2)</enum><header>Public feedback</header>
					<subparagraph id="HCD68C9A7F5A041948974A1A09AE0DF7A"><enum>(A)</enum><header>Submission of public comments</header>
 <clause id="HECD13C01FFE149AF9AF9CBACE8E1AC3D"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the head of each agency shall establish and prominently display on the website of the agency a means for the public—</text>
 <subclause id="HC40B4571EB8A4E2C9E3553207A7BA856"><enum>(I)</enum><text>to electronically submit comments on any guidance document; and</text> </subclause><subclause id="HC22628350CFD4DB2ADD5D3504980BF25"><enum>(II)</enum><text display-inline="yes-display-inline">to electronically submit a request for issuance, reconsideration, modification, or rescission of any guidance document.</text>
 </subclause></clause><clause id="HA85BF968F07E41E7B22C745655574197"><enum>(ii)</enum><header>No response required</header><text>Any public comment submitted under this paragraph is for the benefit of the agency, and a formal response to any such comment by the agency is not required.</text>
 </clause></subparagraph><subparagraph id="HE482472E8F124E61AA2B55CE38E5B0EC"><enum>(B)</enum><header>Complaints by the public</header><text display-inline="yes-display-inline">The head of each agency shall—</text> <clause id="idED1ADE17E0CA4BA8868D4DD1C8330455"><enum>(i)</enum><text display-inline="yes-display-inline">designate one or more offices to receive and address complaints submitted by the public that the agency is not following the procedures in this section or is improperly treating a guidance document as a binding requirement; and</text>
 </clause><clause id="id56465488320C464382286CA5F4C2B379"><enum>(ii)</enum><text display-inline="yes-display-inline">provide, on the website of the agency, the name and contact information for any office described in clause (i).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H1AAE55D3431C47D4BA13F99DB877897A"><enum>(e)</enum><header>Notice and public comment for guidance documents</header>
 <paragraph id="HC133B6489A6B4A95AA2279DE358B847D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not later than 60 days after the date on which an agency prepares a draft of a guidance document, the agency shall complete the following requirements:</text>
 <subparagraph id="H7ED322E005974097A647404C14E2D778"><enum>(A)</enum><text display-inline="yes-display-inline">Publish a notice in the Federal Register announcing that the draft document is available.</text> </subparagraph><subparagraph id="H9FE9CA706FAA4CA8AA52224C85E3EEAC"><enum>(B)</enum><text>Post the draft document on the website of the agency and make the draft publicly available in hard copy (or notify the public how the guidance document may be reviewed if not in a format that permits electronic posting with reasonable efforts).</text>
 </subparagraph><subparagraph id="HE6E47991F1EE4A53B56F569797691D19"><enum>(C)</enum><text>Invite public comment on the draft document.</text> </subparagraph><subparagraph id="HC2117A2A31CA46B5B99EF1DE59EB19D3"><enum>(D)</enum><text>Prepare and post on the website of the agency a response-to-comments document.</text>
 </subparagraph></paragraph><paragraph id="H49B470B446134188BCABC6E2BAD5578C"><enum>(2)</enum><header>Exemptions</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the head of an agency, in consultation with the Administrator, may designate a guidance document or group of guidance documents as exempt from the requirements of this section for being not feasible or appropriate.</text>
				</paragraph></subsection><subsection id="HD9A6F734280A4DCB9AB9312ACA0BF7F9"><enum>(f)</enum><header>Exigent circumstances</header>
 <paragraph id="idF6D99E8EF39B4BFB84FA147061A71771"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In an imminent threat to public health or safety or similar exigent circumstance exists or when an agency is required by law to act more quickly than the procedures described in this section allow, the head of the agency shall certify the circumstance to the Administrator as soon as possible and, to the extent practicable, comply with this section.</text>
 </paragraph><paragraph id="id4373578C7A2447ECB9002BCC6DB03BD6"><enum>(2)</enum><header>Other deadlines</header><text display-inline="yes-display-inline">For any guidance document that is governed by a statutory or court-imposed deadline, the agency shall, to the extent practicable, schedule any proceeding for such document to permit sufficient time to comply with this section.</text>
 </paragraph></subsection><subsection id="HDDEB744905984332B6EFC0D1F7668CF4"><enum>(g)</enum><header>Applicability</header><text display-inline="yes-display-inline">This section does not affect the authority of an agency to communicate the views of the agency in court or in any other enforcement proceeding.</text>
 </subsection><subsection id="HD0B055F859C24EAC88C596BEC258BAA4"><enum>(h)</enum><header>Effective date</header><text display-inline="yes-display-inline">The requirements of this section shall take effect 180 days after the date of enactment of this Act.</text>
			</subsection></section><section id="HA2CF364721284B22ACBD1A7334B9B139"><enum>3.</enum><header>Limitations on use of interim final rules</header>
 <subsection id="H7058670E7980467BB52CA89A583A4AA2"><enum>(a)</enum><header>Enhanced showing required for interim final rules</header><text display-inline="yes-display-inline">Section 553(b)(B) of title 5, United States Code, is amended by striking <quote>for good cause</quote> and all that follows through the period at the end and inserting the following: <quote>determines that an imminent threat to public health or safety or similar exigent circumstance exists.</quote>.</text>
 </subsection><subsection id="HB9A2C40AC5C74BE5980E959CC516E083"><enum>(b)</enum><header>Required publication or service date</header><text>Section 553(d)(3) of title 5, United States Code, is amended to read as follows:</text> <quoted-block display-inline="no-display-inline" id="HB172CE3AFB9A4E17B3D8D8B867AB1C57" style="USC"> <paragraph id="H130BEACA823E4CF197B9921059F151C7"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of any rule to which the exception under subsection (b)(B) applies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="H745F7B04FDC54EC99878689C9475CB81"><enum>(c)</enum><header>Lookback period for interim final rules</header><text display-inline="yes-display-inline">Section 553 of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HC4CC1892A87342739AB1F951869861F1" style="USC"> <subsection id="HD9B505DFBE394652A5241C967DA1C752"><enum>(f)</enum><text display-inline="yes-display-inline">In the case of a rule making in which the exception under subsection (b)(B) was applied, by not later than 18 months after the rule takes effect, the agency shall provide for a period in which interested persons may submit written data, views, or arguments, in the same manner as submissions under subsection (c), shall give such submissions due consideration, and, if appropriate, repeal or amend the rule accordingly.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section></legis-body></bill>
