			 forms of relief.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Alien gang members</header>
 <subsection id="idb24ea7d1afa54e5cbd13faa62378522e"><enum>(a)</enum><header>Definition</header><text>Section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id40DFC97381A94653AADD2CC4ABABB8C1" style="OLC">
 <paragraph id="id5347c3f3b54c480686af992ff4d880ee" indent="up1"><enum>(53)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id00E6AC184D4F4F56B925061961A3918E"><enum>(A)</enum><text>The term <term>criminal gang</term> means an ongoing group, club, organization, or association of five or more persons—</text> <clause id="id0E465BDC18A94F8D9641E83FBCBE2FE5" indent="up1"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idB675E6F07EF845F982AFA3B0A58C34E5"><enum>(I)</enum><text>that has as one of its primary purposes the commission of one or more of the criminal offenses described in subparagraph (B); and</text>
 </subclause><subclause id="id246A1B7DD69D4D18BAA8EE083FECF5B4" indent="up1"><enum>(II)</enum><text>the members of which engage, or have engaged within the past five years, in a continuing series of offenses described in subparagraph (B); or</text>
 </subclause></clause><clause id="id242C8AC548D74786ADBF912189F90C6E" indent="up1"><enum>(ii)</enum><text>that has been designated as a criminal gang under section 220 by the Secretary of Homeland Security, in consultation with the Attorney General, or by the Secretary of State.</text>
 </clause></subparagraph><subparagraph id="id18CEC99261AC4C5F96F1777734507B52" indent="up1"><enum>(B)</enum><text>The offenses described in this subparagraph, whether in violation of Federal or State law or foreign law and regardless of whether the offenses occurred before, on, or after the date of the enactment of this paragraph, are the following:</text>
 <clause id="idbf47c0c627ee491e8d2ecdb54df600f0"><enum>(i)</enum><text>A <term>felony drug offense</term> (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)).</text> </clause><clause id="idac5b200b4a014d7b93c94764fde831fd"><enum>(ii)</enum><text>An offense under section 274 (relating to bringing in and harboring certain aliens), section 277 (relating to aiding or assisting certain aliens to enter the United States), or section 278 (relating to importation of alien for immoral purpose).</text>
 </clause><clause id="id826c59d533df44149ffaafb77eb0fd19"><enum>(iii)</enum><text>A crime of violence (as defined in section 16 of title 18, United States Code).</text> </clause><clause id="id630db73577a14e12afee4c843d3b25ca"><enum>(iv)</enum><text>A crime involving obstruction of justice, tampering with or retaliating against a witness, victim, or informant, or burglary.</text>
 </clause><clause id="id8a674a1451b5416183cb9ac203790a60"><enum>(v)</enum><text>Any conduct punishable under section 1028 or 1029 of title 18, United States Code (relating to fraud and related activity in connection with identification documents or access devices), sections 1581 through 1594 of such title (relating to peonage, slavery and trafficking in persons), section 1952 of such title (relating to interstate and foreign travel or transportation in aid of racketeering enterprises), section 1956 of such title (relating to the laundering of monetary instruments), section 1957 of such title (relating to engaging in monetary transactions in property derived from specified unlawful activity), or sections 2312 through 2315 of such title (relating to interstate transportation of stolen motor vehicles or stolen property).</text>
 </clause><clause id="idb0937623f3c44bc9a33b4f5f6291536d"><enum>(vi)</enum><text>A conspiracy to commit an offense described in clauses (i) through (v).</text> </clause></subparagraph><subparagraph id="idaa4b98982f8648b2934ce756f9941c52" indent="up1"><enum>(C)</enum><text>Notwithstanding any other provision of law (including any effective date), the term <term>criminal gang</term> applies regardless of whether the conduct occurred before, on, or after the date of the enactment of this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idec7bb5b36039462c8b30601d0de471bf"><enum>(b)</enum><header>Inadmissibility</header><text>Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id09A149504E444D91875A805DCA0C7F5E" style="OLC">
 <subparagraph id="idbaa6c1a9f79143e496db6645e38c193b"><enum>(J)</enum><header>Aliens associated with criminal gangs</header><text>Any alien is inadmissible if a consular officer, the Secretary of Homeland Security, or the Attorney General knows or has reason to believe that the alien—</text>
 <clause id="id8502ee8ac2aa4a019f081dc4ca9e8421"><enum>(i)</enum><text>is or has been a member of a criminal gang; or</text> </clause><clause id="id629b797033b44fef865f40814491ee82"><enum>(ii)</enum><text>has participated in the activities of a criminal gang, knowing or having reason to know that such activities will promote, further, aid, or support the illegal activity of the criminal gang.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id3d650c390ca24070b2f64c15ebe32080"><enum>(c)</enum><header>Deportability</header><text>Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0FBC3C3F1DA54087BA3883563434107C" style="OLC">
 <subparagraph id="id5e6146810162418a807497dd48dcac95"><enum>(G)</enum><header>Aliens associated with criminal gangs</header><text>Any alien is deportable if the Secretary of Homeland Security or the Attorney General knows or has reason to believe that the alien—</text>
 <clause id="id2327cd4ed58e4ba2bd312c2a3f43808e"><enum>(i)</enum><text>is or has been a member of a criminal gang; or</text> </clause><clause id="id38268342b0ab495cb453050453c08077"><enum>(ii)</enum><text>has participated in the activities of a criminal gang, knowing or having reason to know that such activities will promote, further, aid, or support the illegal activity of the criminal gang.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ide9b96820f349415e8cbe1602f82c9fcb"><enum>(d)</enum><header>Designation</header>
 <paragraph id="idf729e7f3d27848f6b0c01ffadaf04e18"><enum>(1)</enum><header>In general</header><text>Chapter 2 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181</external-xref> et seq.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD98B597DE35448CCA98FE229B27AAADF" style="OLC">
						<section id="id3bf5c2554ca04a21ae30d7971732891e"><enum>220.</enum><header>Designation of criminal gangs</header>
 <subsection id="idE0BA04A2B881458193EDB9B41149B330"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in consultation with the Attorney General, or the Secretary of State may designate a group or association as a criminal gang if their conduct is described in section 101(a)(53) or if the group or association conduct poses a significant risk that threatens the security and the public safety of nationals of the United States or the national security, homeland security, foreign policy, or economy of the United States.</text>
 </subsection><subsection id="id1c9c6644f5434562908d286b530a7815"><enum>(b)</enum><header>Effective date</header><text>A designation made under subsection (a) shall remain in effect until the designation is revoked after consultation between the Secretary of Homeland Security, the Attorney General, and the Secretary of State or is terminated in accordance with Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id4172ff4e4b60484ab7d5107d5a2fe145"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents in the first section of the Immigration and Nationality Act is amended by inserting after the item relating to section 219 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id12B485C5A4174F75A22F30A1947501DE" style="OLC"><toc><toc-entry bold="off" level="section">220. Designation of criminal gangs.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id416222586063463a88331f6258cebcad"><enum>(e)</enum><header>Mandatory detention of criminal gang members</header>
 <paragraph id="id44130aa70ac84665a3f77757cf22a04f"><enum>(1)</enum><header>In general</header><text>Section 236(c)(1)(D) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(1)(D)</external-xref>) is amended—</text>
 <subparagraph id="id6f39ff338c71444196105965300294ff"><enum>(A)</enum><text>by striking <quote>section 212(a)(3)(B)</quote> and inserting <quote>paragraph (2)(J) or (3)(B) of section 212(a)</quote>; and</text> </subparagraph><subparagraph id="id9c1cad2d8dff44c292805f36287b99b9"><enum>(B)</enum><text>by striking <quote>237(a)(4)(B),</quote> and inserting <quote>paragraph (2)(G) or (4)(B) of section 237(a),</quote>.</text>
 </subparagraph></paragraph><paragraph id="idf2e7aa78a3d9414284653803fd6637ba"><enum>(2)</enum><header>Annual report</header><text>Not later than March 1 of each year (beginning 1 year after the date of the enactment of this Act), the Secretary of Homeland Security, after consultation with the appropriate Federal agencies, shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> on the number of aliens detained as a result of the amendments made by paragraph (1).</text>
				</paragraph></subsection><subsection id="id7f1560e60f9f45779a1dcf505dff6efc"><enum>(f)</enum><header>Asylum claims based on gang affiliation</header>
 <paragraph id="id6d8d16bc14cc45b8af2f303e4c4487df"><enum>(1)</enum><header>Ineligibility for asylum</header><text>Section 208(b)(2)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)</external-xref>) is amended—</text> <subparagraph id="id129f084093ba4120864cada04bd0dde3"><enum>(A)</enum><text>in clause (v), by striking <quote>or</quote> at the end;</text>
 </subparagraph><subparagraph id="id1ec4492a46d54559b6559f37ab72fd00"><enum>(B)</enum><text>by redesignating clause (vi) as clause (vii); and</text> </subparagraph><subparagraph id="idb6107d5f648b40b984a8179d765fb9a9"><enum>(C)</enum><text>by inserting after clause (v) the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD4C968ECD7A34795A344DCC618055FDC" style="OLC">
 <clause id="id1bb19327007e4ff3b23caa9dff7ae503"><enum>(vi)</enum><text>the alien is described in section 212(a)(2)(J)(i) or 237(a)(2)(G)(i) (relating to participation in criminal gangs); or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="iddfa689d51d3e404090a43e705263ff56"><enum>(2)</enum><header>Inapplicability of restriction on removal to certain countries</header><text>Section 241(b)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)(B)</external-xref>) is amended, in the matter preceding clause (i), by inserting <quote>who is described in section 212(a)(2)(J)(i) or section 237(a)(2)(G)(i) or who is</quote> after <quote>to an alien</quote>.</text>
 </paragraph></subsection><subsection id="id6404f9fe13a64b9facebdebcbde03b69"><enum>(g)</enum><header>Temporary protected status</header><text>Section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>) is amended—</text> <paragraph id="id038ec15dc8bf40ea8d6692838fb41d44"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> each place that term appears and inserting <quote>Secretary of Homeland Security</quote>;</text>
 </paragraph><paragraph id="idbb79c69c66034d80a96a91509e35a8a5"><enum>(2)</enum><text>in subparagraph (c)(2)(B)—</text> <subparagraph id="id8d688a986f09406c9d27a332df9141ac"><enum>(A)</enum><text>in clause (i), by striking <quote>States, or</quote> and inserting <quote>States;</quote>;</text>
 </subparagraph><subparagraph id="id08fb0fd60a624eda9683c6f474434ddc"><enum>(B)</enum><text>in clause (ii), by striking the period and inserting <quote>; or</quote>; and</text> </subparagraph><subparagraph id="id1f90dbdcf7c44eddb4544219fa6fba85"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idC3A542DABF6843E5A298BD52137031D8" style="OLC">
 <clause id="id2b0a2bcf0d694c9f95fdebdf70b2bcde"><enum>(iii)</enum><text>the alien is a member of a criminal gang.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph><paragraph id="id68113d16b304447e8748463a572cd37b"><enum>(3)</enum><text>in subsection (d)—</text>
 <subparagraph id="id0ff3af6df78e411580f1626514ba7487"><enum>(A)</enum><text>by striking paragraph (3);</text> </subparagraph><subparagraph id="id4b5a18c7e73946c1a2c8dc7d48fdfbe6"><enum>(B)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text>
 </subparagraph><subparagraph id="id2249C71D76AA459F91C9BDF284F8D833"><enum>(C)</enum><text>in paragraph (3), as redesignated, by adding at the end the following: <quote>The Secretary of Homeland Security may detain an alien provided temporary protected status under this section whenever appropriate under any other provision of law.</quote>.</text>
 </subparagraph></paragraph></subsection><subsection id="id61d728673e3b47b2b1ff7e4446a59751"><enum>(h)</enum><header>Special immigrant juvenile visas</header><text>Section 101(a)(27)(J)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)(iii)</external-xref>) is amended—</text>
 <paragraph id="id1c54a832ebdf4c5c80baec6f138ba837"><enum>(1)</enum><text>in subclause (I), by striking <quote>and</quote>;</text> </paragraph><paragraph id="id148a6dc62343422492fb8be5baf2593c"><enum>(2)</enum><text>in subclause (II), by adding <quote>and</quote> at the end; and</text>
 </paragraph><paragraph id="idaabebb2fa16c47579b0961297bd91ba4"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id4EAAE34B104344608156C1752CDE1F9B" style="OLC"> <subclause id="id2ee8b6aa57fa45bd958a8f4a8af05b2e"><enum>(III)</enum><text>no alien who is a member of a criminal gang shall be eligible for any immigration benefit under this subparagraph;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="iddbd9c01ac71c443abb12ee65f73fc300"><enum>(i)</enum><header>Deferred action</header><text>An alien described in section 212(a)(2)(J) of the Immigration and Nationality Act, as added by subsection (b), shall not be eligible for deferred action.</text>
 </subsection><subsection id="id12F770FC2A2C43629E242FF8F849BCEA"><enum>(j)</enum><header>Parole</header><text>An alien described in section 212(a)(2)(J) of the Immigration and Nationality Act, as added by subsection (b), shall not be eligible for parole under section 212(d)(5)(A) of such Act unless—</text>
 <paragraph id="id4225F7176163467083E594575F40E518"><enum>(1)</enum><text>the alien is assisting or has assisted the United States Government in a law enforcement matter, including a criminal investigation; and</text>
 </paragraph><paragraph id="idCDBEDEEB190E445F813519931395E190"><enum>(2)</enum><text>the alien’s presence in the United States is required by the Government with respect to such assistance.</text>
 </paragraph></subsection><subsection id="id66499910DD404355A884BF57F8025704"><enum>(k)</enum><header>Effective date</header><text>The amendments made by this section—</text> <paragraph id="idB1F5BC52F7A54B0E9F2A3D1108CB7CB1"><enum>(1)</enum><text>shall take effect on the date of the enactment of this Act; and</text>
 </paragraph><paragraph id="idF49884B9299A4AE991FF534FB1A912DB"><enum>(2)</enum><text>shall apply to acts that occur before, on, or after such date.</text> </paragraph></subsection></section><section id="id0d174be75345401cb7b4eecca4bbd64e"><enum>2.</enum><header>Mandatory expedited removal of dangerous criminals, terrorists, and gang members</header> <subsection id="id81819371834c4bd1854d372ca29747e3"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, an immigration officer who finds an alien described in subsection (b) at a land border or port of entry of the United States and determines that such alien is inadmissible under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.) shall treat such alien in accordance with section 235 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225</external-xref>).</text>
 </subsection><subsection id="idaa8468cf207a4dd8839e39b5170b5e6f"><enum>(b)</enum><header>Threats to public safety</header><text>An alien described in this subsection is an alien who the Secretary of Homeland Security determines, or has reason to believe—</text>
 <paragraph id="id315874829CEC466BB511D24C4DE67E66"><enum>(1)</enum><text>has been convicted of any offense carrying a maximum term of imprisonment of more than 180 days;</text>
 </paragraph><paragraph id="id56921673FBD74464AD724E1404EAFA17"><enum>(2)</enum><text>has been convicted of an offense involving—</text> <subparagraph id="id15c5ee1e377d4118bdb8d591ff37e699"><enum>(A)</enum><text>domestic violence (as defined in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>));</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id153aa9afcaa142f1b79c21c9c502c8ea"><enum>(B)</enum><text>child abuse and neglect (as defined in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13925">42 U.S.C. 13925(a)</external-xref>));</text>
 </subparagraph><subparagraph id="idA11D3FCE9C3F4D97900D08FCF4FF8201"><enum>(C)</enum><text>assault resulting in bodily injury (as defined in section 2266 of title 18, United States Code);</text>
 </subparagraph><subparagraph id="id2967E681E43148B6B076A34BFD29178B"><enum>(D)</enum><text>the violation of a protection order (as defined in section 2266 of title 18, United States Code);</text>
 </subparagraph><subparagraph id="idF765F5AE0E4B40B08DC1682B31DF3D3A"><enum>(E)</enum><text>driving while intoxicated (as defined in section 164(a) of title 23, United States Code); or</text>
 </subparagraph><subparagraph id="id688A72DF8ADA41FFA438794E9049592A"><enum>(F)</enum><text>any offense under foreign law, except for a purely political offense, which, if the offense had been committed in the United States, would render the alien inadmissible under section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>);</text>
 </subparagraph></paragraph><paragraph id="id83682e718ea74f988edcaeddd7b30ec9"><enum>(3)</enum><text>has been convicted of more than one criminal offense (other than minor traffic offenses);</text> </paragraph><paragraph id="idD5BC4799B1984F41910D7FC650F0443E"><enum>(4)</enum><text>has engaged in, is engaged in, or is likely to engage after entry in any terrorist activity (as defined in section 212(a)(3)(B)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(iii)</external-xref>)), or intends to participate or has participated in the activities of a foreign terrorist organization (as designated under section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>));</text>
 </paragraph><paragraph id="idC9ADACC3D41C4D6ABD0F7CF74D61C31E"><enum>(5)</enum><text>is or was a member of a criminal street gang (as defined in paragraph (53) of section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>), as added by section 1(a)); or</text>
 </paragraph><paragraph id="id6B86555C03C84930B94E6E86AB11E777"><enum>(6)</enum><text>has entered the United States more than one time in violation of section 275(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>), knowing that such entry was unlawful.</text></paragraph></subsection></section></legis-body></bill>
