			 who is unlawfully present in the United States and has been charged with
			 driving under the influence or driving while intoxicated.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taking Action Against Drunk Drivers Act</short-title></quote>.</text>
 </section><section id="id0b6d9efd6a3e442f86ffe02e47d907c5"><enum>2.</enum><header>Mandatory detention for drunk drivers</header><text display-inline="no-display-inline">Section 236(c)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)(1)</external-xref>) is amended—</text> <paragraph id="ide196b3dad4cd41cd829f5031b637a6ca"><enum>(1)</enum><text>in subparagraphs (A) and (B), by striking the comma at the end of each subparagraph and inserting a semicolon;</text>
 </paragraph><paragraph id="id48ed14882979479e8b68c409c56ff925"><enum>(2)</enum><text>in subparagraph (C)—</text> <subparagraph id="id4167697ee23c47ad85bdcfb917f43062"><enum>(A)</enum><text>by striking <quote>sentence</quote> and inserting <quote>sentenced</quote>; and</text>
 </subparagraph><subparagraph id="idb73e56e77ef34569868fb900553f9056"><enum>(B)</enum><text>by striking <quote>, or</quote> and inserting a semicolon;</text> </subparagraph></paragraph><paragraph id="idc5738c05d97942fe979097590ee8defe"><enum>(3)</enum><text>in subparagraph (D), by striking the comma at the end and inserting <quote>; or</quote>; and</text>
 </paragraph><paragraph id="id857b0c2ecf6446128d4f12e405dba651"><enum>(4)</enum><text>by inserting after subparagraph (D) the following:</text> <quoted-block display-inline="no-display-inline" id="id833fa640cfd84d29af65238c57fc93e5" style="OLC"> <subparagraph id="id982b4fdef2ec458885bd91d73e44ef9c"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id03CE3D6A4325453BA8B1AA93006F0629"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE97BA56A42414B369F1B5B35E8BFD7FF"><enum>(I)</enum><text>was not inspected and admitted into the United States;</text>
 </subclause><subclause id="idDB84AEFA329B45F0939261885D0DCFEE" indent="up2"><enum>(II)</enum><text>held a nonimmigrant visa (or other documentation authorizing admission into the United States as a nonimmigrant) that has been revoked under section 221(i); or</text>
 </subclause><subclause id="idFE258E76999B4031A9EC402F5512122F" indent="up2"><enum>(III)</enum><text>is described in section 237(a)(1)(C)(i); and</text> </subclause></clause><clause id="id42655625342744E7B3FBE013F7CDAEB9" indent="up1"><enum>(ii)</enum><text>has a pending charge, by a prosecuting authority in the United States, of driving under the influence or driving while intoxicated, under Federal or State law, regardless of whether the offense is classified as a felony or a misdemeanor,</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id21f8cef8e2c24dcc96f87847cc801d1e"><enum>3.</enum><header>Banning habitual drunk drivers from the United States</header>
 <subsection id="id2a73f3868b0e4257a700356cddb8d8a8"><enum>(a)</enum><header>Grounds for inadmissibility</header><text>Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended—</text> <paragraph id="id01d451af909f49d7937219fff9b7abcf"><enum>(1)</enum><text>by redesignating subparagraph (F) as subparagraph (J) and placing it after subparagraph (I); and</text>
 </paragraph><paragraph id="idd96be550e6864183bccc9c9dd807c0c7"><enum>(2)</enum><text>by inserting after subparagraph (E) the following:</text> <quoted-block display-inline="no-display-inline" id="idEA9D0FDF8AD44094AA61C13750CA2F81" style="OLC"> <subparagraph id="id6b160364fddd49be9063784b776d0b04"><enum>(F)</enum><header>Habitual drunk drivers</header><text>An alien convicted of three or more offenses for driving under the influence or driving while intoxicated, under Federal or State law, regardless of whether the offenses are classified as felonies or misdemeanors, is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></subsection><subsection id="id0b3c86671b074893985b0a46a96692b4"><enum>(b)</enum><header>Grounds for deportation</header><text>Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id710770F823EC401795DAF83330E4ABE9" style="OLC">
 <subparagraph id="ide6713c50ff394a568e9adba5a1210127"><enum>(G)</enum><header>Habitual drunk drivers</header><text>An alien convicted of three or more offenses for driving under the influence or driving while intoxicated, under Federal or State law, regardless of whether the offenses are classified as felonies or misdemeanors, is deportable if at least one of such offenses occurred after the date of the enactment of this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id9f5a5a8da88d429a8e78288aa6b6f248"><enum>(c)</enum><header>Definition of aggravated felony</header>
 <paragraph id="idb12b115ef7114ce4a009fd2c4b4799f9"><enum>(1)</enum><header>In general</header><text>Section 101(a)(43)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(43)(F)</external-xref>) is amended by striking <quote>for which the term of imprisonment</quote> and inserting <quote>, including a third conviction for driving under the influence or driving while intoxicated, under Federal or State law, regardless of whether the offense is classified as a felony or a misdemeanor, for which the term of imprisonment is</quote>.</text>
				</paragraph><paragraph id="id4935ECBC7DF946C5A275706BEFDDB9C2"><enum>(2)</enum><header>Effective date; application</header>
 <subparagraph id="idd2def5c5310c4789af11171677f50d19"><enum>(A)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect on the date of the enactment of this Act.</text>
					</subparagraph><subparagraph id="id8bc1e8cb21f34a55bd4b75c7b77a9c78"><enum>(B)</enum><header>Application</header>
 <clause id="id41a8f6b28fe2482788e0acd8f8652cb3"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the amendment made by paragraph (1) shall apply to a conviction for driving under the influence of alcohol or drugs that occurred before, on, or after such date of enactment.</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id5fab35f081e341178e315b7b233dea7e"><enum>(ii)</enum><header>Two or more prior convictions</header><text>An alien who received two or more convictions for driving under the influence of alcohol or drugs before the date of the enactment of this Act may not be subject to removal for the commission of an aggravated felony pursuant to section 237(a)(2)(A)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)(A)(iii)</external-xref>) on the basis of such convictions until the date on which the alien is convicted of another such offense after such date of enactment.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
