			 voluntary, short-term conserving use program for participating farmers,
			 and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Soil Health and Income Protection Program Act of 2017</short-title></quote> or the <quote><short-title>SHIPP Act of 2017</short-title></quote>.</text>
		</section><section id="idA553375C7FEB4947B23947E6AF157296"><enum>2.</enum><header>Soil health and income protection program</header>
 <subsection id="id9D6E8273D55C4312B5C39F5FA0365D05"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 5 of subtitle D of title XII of the Food Security Act of 1985 is amended by inserting after section 1240M (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb</external-xref>) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC0AECB07E7A3450F9F91376D57BC5F50" style="OLC">
					<section id="id650F5F96E0F64F0C969ED0C0A2C64680"><enum>1240N.</enum><header>Soil health and income protection program</header>
 <subsection id="idB1672A3E38544286B9C27713113B9FAC"><enum>(a)</enum><header>Definition of eligible land</header><text>In this section:</text> <paragraph id="id3522D812BEA341A2925EC648E2F1CC2B"><enum>(1)</enum><header>In general</header><text>The term <term>eligible land</term> means land that—</text>
 <subparagraph id="id4C190747D2A14079B5F47AEA0B802CDF"><enum>(A)</enum><text>is selected by the owner or operator of the land for proposed enrollment in the program under this section; and</text>
 </subparagraph><subparagraph id="id4E8DBDC2B89549FC85253A4918206F04"><enum>(B)</enum><text>as determined by the Secretary—</text> <clause id="id5E066AF797A24BBE9A30607845F08F55"><enum>(i)</enum><text>had a cropping history or was considered to be planted during the 3 crop years preceding the crop year described in subsection (b)(2); and</text>
 </clause><clause id="id852500751F3B4F3185168CBAE027F888"><enum>(ii)</enum><text>is verified to be less-productive land, as compared to other land on the applicable farm.</text> </clause></subparagraph></paragraph><paragraph id="idA6C8207BF5264032895CD72EDBD0AD45"><enum>(2)</enum><header>Exclusion</header><text>The term <term>eligible land</term> does not include any land covered by a conservation reserve program contract under subchapter B of chapter 1 that expires during the crop year described in subsection (b)(2).</text>
							</paragraph></subsection><subsection id="idB753192C0F734974A86321A41F728051"><enum>(b)</enum><header>Establishment</header>
 <paragraph id="idC2065796F9DD42F38C1478EF56C4BC00"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a voluntary soil health and income protection program under which eligible land is enrolled through the use of agreements to assist owners and operators of eligible land to conserve and improve the soil, water, and wildlife resources of the eligible land.</text>
 </paragraph><paragraph id="idE3C09796BC9A468C846F4CBAF3D9E063"><enum>(2)</enum><header>Deadline for participation</header><text>Eligible land may be enrolled in the program under this section only during the first crop year beginning after the date of enactment of this section.</text>
							</paragraph></subsection><subsection id="id86FA614DD6EF4110818D89CFC0A7FF94"><enum>(c)</enum><header>Agreements</header>
 <paragraph id="id38EB1F37D24A46D2AF8BA12053C10924"><enum>(1)</enum><header>Requirements</header><text>An agreement described in subsection (b) shall—</text> <subparagraph id="id36966445B0994FE48B11BACCF43166AA"><enum>(A)</enum><text>be entered into by the Secretary, the owner of the eligible land, and (if applicable) the operator of the eligible land; and</text>
 </subparagraph><subparagraph id="id729BACDDC29348F88A6EFA1526C48228"><enum>(B)</enum><text>provide that, during the term of the agreement—</text> <clause id="id348E2BE839B04DCB8D98F8754093BD60"><enum>(i)</enum><text>the lowest practicable cost perennial conserving use cover crop for the eligible land, as determined by the applicable State conservationist after considering the advice of the applicable State technical committee, shall be planted on the eligible land;</text>
 </clause><clause id="idC2F77BCA7AF2401AA95926048BB07BE1"><enum>(ii)</enum><text>except as provided in paragraph (5), the owner or operator of the eligible land shall pay the cost of planting the conserving use cover crop under clause (i);</text>
 </clause><clause id="idF7D85CAB6EF3454984848561CB569277"><enum>(iii)</enum><text>subject to paragraph (6), the eligible land may be harvested for seed, hayed, or grazed outside the nesting and brood-rearing period established for the applicable county;</text>
 </clause><clause id="id8D69F1228861435CA4BAAEFC5A1C8910"><enum>(iv)</enum><text>the eligible land may be eligible for a walk-in access program of the applicable State, if any; and</text> </clause><clause id="id279F1BDAD8C147BF8BF65D31A93DF3BC"><enum>(v)</enum><text>a nonprofit wildlife organization may provide to the owner or operator of the eligible land a payment in exchange for an agreement by the owner or operator not to harvest the conserving use cover.</text>
 </clause></subparagraph></paragraph><paragraph id="idA27E472D09984B0B81685F3430268610"><enum>(2)</enum><header>Payments</header><text>Except as provided in paragraphs (5) and (6)(B)(ii), the annual rental rate for a payment under an agreement described in subsection (b) shall be equal to 50 percent of the average rental rate for the applicable county under section 1234(d), as determined by the Secretary.</text>
 </paragraph><paragraph id="idE7C4246872B147AEB53E3D0B1B697AE2"><enum>(3)</enum><header>Limitation on enrolled land</header><text>Not more than 15 percent of the eligible land on a farm may be enrolled in the program under this section.</text>
							</paragraph><paragraph id="id68E00673F94E4AB09E7D895BE2ABF19F"><enum>(4)</enum><header>Term</header>
 <subparagraph id="id174C9E6C282444CF9DF1702CBDB415BF"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), each agreement described in subsection (b) shall be for a term of 3, 4, or 5 years, as determined by the parties to the agreement.</text>
								</subparagraph><subparagraph id="id5A107BCE4C0D4796ADCF216E9A1390B1"><enum>(B)</enum><header>Early termination</header>
 <clause id="id435E4209AC574A6C918563686F964712"><enum>(i)</enum><header>Secretary</header><text>The Secretary may terminate an agreement described in subsection (b) before the end of the term described in subparagraph (A) if the Secretary determines that the early termination of the agreement is necessary.</text>
 </clause><clause id="idAE88F72814174A579F752E77E6367554"><enum>(ii)</enum><header>Owners and operators</header><text>An owner and (if applicable) an operator of eligible land enrolled in the program under this section may terminate an agreement described in subsection (b) before the end of the term described in subparagraph (A) if the owner and (if applicable) the operator pay—</text>
 <subclause id="id5AD122BA87144C70A2163043C0DF87F4"><enum>(I)</enum><text>to the Secretary an amount equal to the amount of rental payments received under the agreement; and</text> </subclause><subclause id="id2A8DD67DF2D0453CAD8088439F13842D"><enum>(II)</enum><text>if applicable, to the Federal Crop Insurance Corporation the amount of the increase in premium discounts provided under subparagraph (B) of section 508(d)(3) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1508">7 U.S.C. 1508(d)(3)</external-xref>).</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id9DAD6F494F3B4921B81799D1042CF702"><enum>(5)</enum><header>Beginning, small, socially disadvantaged, young, or veteran farmers and ranchers</header>
 <text>With respect to a beginning, small, socially disadvantaged, young, or veteran farmer or rancher, as determined by the Secretary—</text>
 <subparagraph id="id8A8B41C7BDCA43F0A5EB32F6218C736E"><enum>(A)</enum><text>an agreement described in subsection (b) shall provide that, during the term of the agreement, the beginning, underserved, or young farmer or rancher shall pay 50 percent of the cost of planting the conserving use cover crop under paragraph (1)(B)(i); and</text>
 </subparagraph><subparagraph id="idB7F6A61116B64593B9629354EE2FF901"><enum>(B)</enum><text>the annual rental rate for a payment under an agreement described in subsection (b) shall be equal to 75 percent of the average rental rate for the applicable county under section 1234(d), as determined by the Secretary.</text>
 </subparagraph></paragraph><paragraph id="id73AF824DC54A4DAA8AF41E90B2101B1B"><enum>(6)</enum><header>Harvesting, haying, and grazing outside applicable period</header><text>The harvesting for seed, haying, or grazing of eligible land under paragraph (1)(B)(iii) outside of the nesting and brood-rearing period established for the applicable county shall be subject to the conditions that—</text>
 <subparagraph id="id8E5629766DD44A5BA0172C604D554825"><enum>(A)</enum><text>with respect to eligible land that is so hayed or grazed, adequate stubble height shall be maintained to protect the soil on the eligible land, as determined by the applicable State conservationist after considering the advice of the applicable State technical committee; and</text>
 </subparagraph><subparagraph id="iddcfe223258524fb2b3129420fc8c1786"><enum>(B)</enum><text>with respect to eligible land that is so harvested for seed—</text> <clause id="idE4ED954893BD4C7FA608B65959FA5D1D"><enum>(i)</enum><text>the eligible land shall not be eligible to be insured or reinsured under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501</external-xref> et seq.); and</text>
 </clause><clause id="id7AA7573BB1B64F4FAE5EEB0FC6EA010D"><enum>(ii)</enum><text>the rental payment otherwise applicable to the eligible land under this subsection shall be reduced by 25 percent.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idB48825BECD0D4D15960F3CE46F224A22"><enum>(d)</enum><header>Funding</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="idB26AB0B251B34039A5B4B6677DF127E3"><enum>(b)</enum><header>Adjustment of base acres</header><text>Section 1112(b)(1) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/7/9012">7 U.S.C. 9012(b)(1)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id999F9BF0610A4219BEBA8EB88E498DDF" style="OLC">
 <subparagraph commented="no" display-inline="no-display-inline" id="P3A9BCB9B4AFC54F93877CF815521C56"><enum>(D)</enum><text display-inline="yes-display-inline">A soil health and income protection program agreement entered into under section 1240N of the Food Security Act of 1985 with respect to the farm expires or is terminated.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="id50B25BE57EF9424595C82C5A2D9C7080"><enum>(c)</enum><header>Crop insurance</header><text>Section 508(d)(3) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1508">7 U.S.C. 1508(d)(3)</external-xref>) is amended—</text> <paragraph id="idD8B8A8945A5A49529C3C025A6C1B1544"><enum>(1)</enum><text>by striking <quote>The Corporation</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id28F4AA02F97445269741F41E06EE4C5A" style="OLC">
 <subparagraph id="idE506C26994EC4A3B841A69C9D494D05E"><enum>(A)</enum><header>In general</header><text>The Corporation</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph><paragraph id="id8C25928653C64C4483C354CE920F9808"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1E93C652C8624E93A2AD052AB900EA60" style="OLC">
						<subparagraph id="idCB895873DBFC434882DC7252BEDCE8C9"><enum>(B)</enum><header>Increase for participation in soil health and income protection program</header>
 <clause id="idF65BFF29B54445D2939C6CAA3C3C5F1D"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the Corporation may increase the amount of a premium discount provided under this paragraph by not more than 2 percent (or not more than 3 percent with respect to a beginning, small, socially disadvantaged, young, or veteran farmer or rancher described in subsection (c)(5) of section 1240N of the Food Security Act of 1985) for any agricultural commodity planted in an insurable unit that contains any eligible land (as defined in subsection (a) of that section) that is enrolled in the soil health and income protection program under that section.</text>
 </clause><clause id="idCD4DC8FE100E4F81A8EAF3A9A8EF3D1B"><enum>(ii)</enum><header>Applicability</header><text>An increase in the amount of a premium discount provided pursuant to clause (i)—</text> <subclause id="idC7D7E87DD0D649D1B5E1AC68179E4EE9"><enum>(I)</enum><text>shall apply only for a premium discount equal to less than 80 percent; and</text>
 </subclause><subclause id="id16C981111987432EB2F40E21631161FF"><enum>(II)</enum><text>shall not apply to a catastrophic risk protection plan provided under subsection (b).</text> </subclause></clause><clause commented="no" id="id64480562307F4E3DA90A890287543A15"><enum>(iii)</enum><header>Multiple insurable units</header><text>With respect to an agricultural producer that owns or operates multiple insurable units on 1 farm, at least 1 insurable unit of which contains eligible land (as defined in subsection (a) of section 1240N of the Food Security Act of 1985) that is enrolled in the soil health and income protection program under that section, an increase in the amount of a premium discount under this subparagraph shall apply to all insurable units of the agricultural producer on the farm.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section></legis-body></bill>
