			 and surveillance efforts and to improve public education and awareness of
			 congenital heart
			 disease, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H34913623FE394EADA04626ED59875CC8" style="OLC">
 <section id="HDBAE328E90E7455D913FDE588CD93D09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congenital Heart Futures Reauthorization Act of 2017</short-title></quote>.</text> </section><section id="HCD8CCC57B29946F38DC5864FF2A94E3C"><enum>2.</enum><header>National congenital heart disease cohort study, surveillance, and awareness campaign</header><text display-inline="no-display-inline">Section 399V–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g-13">42 U.S.C. 280g–13</external-xref>) is amended—</text>
 <paragraph id="idEFE9B5A341AD4CB78A537026C7531C0B"><enum>(1)</enum><text display-inline="yes-display-inline">by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">National congenital heart disease cohort study, surveillance system, and awareness campaign</header-in-text></quote>;</text> </paragraph><paragraph id="idEEC34C7E6EB4483D96175A0F0D2CA783"><enum>(2)</enum><text>by amending subsection (a) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H1B46DB00C96D466EA096817B2FBF5BF9" style="OLC">
					<subsection id="id32BB288F9F944BB6AB75293949744F1A"><enum>(a)</enum><header>In general</header>
 <paragraph id="id5DAF46CDB6264DC79839E6D24FD7EA34"><enum>(1)</enum><header>Activities</header><text>The Secretary shall—</text> <subparagraph id="idD8CC17A3A5934146987E76CF5F294ECD"><enum>(A)</enum><text>enhance and expand research and surveillance infrastructure to study and track the epidemiology of congenital heart disease (in this section referred to as <quote>CHD</quote>) across the lifespan; and</text>
 </subparagraph><subparagraph id="id2E1CC60A7E0F44AA82A4A2BEC4ACD24A"><enum>(B)</enum><text>plan and implement a public outreach and education campaign regarding CHD across the lifespan.</text> </subparagraph></paragraph><paragraph id="id0969AEA0009F4DB7A2F081A7E13065D6"><enum>(2)</enum><header>Grants</header><text>The Secretary may award grants to eligible entities to carry out the activities described in subsections (b), (c), and (d).</text>
						</paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
 </paragraph><paragraph id="idDEA9C8D3C3BD463490BC34FC5BB137E4"><enum>(3)</enum><text>in subsection (b)—</text> <subparagraph id="id0422E9B664674C6EBF2D87D59B42C85C"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Purpose</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">National Congenital Heart Disease Surveillance System</header-in-text></quote>; and</text>
 </subparagraph><subparagraph id="id9CF0702E0F7B4C66B38CCA1B98FDBA98"><enum>(B)</enum><text>by striking <quote>The purpose of the Congenital Heart Disease Surveillance System shall be to facilitate</quote> and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id9799ECCC59E5422E888C68F8E52F695A" style="OLC"> <paragraph id="idEC2E3F38048542DC86F90B4703560AD2"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a Congenital Heart Disease Surveillance System for the purpose of facilitating</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id171F100812C342A793DA4CECFED41A72"><enum>(4)</enum><text>in subsection (c)—</text> <subparagraph id="id16E1505A43CC45CC90F53787A4DE4615"><enum>(A)</enum><text>in paragraph (2), by redesignating subparagraphs (A) through (E) as clauses (i) through (v), respectively, and adjusting the margins accordingly;</text>
 </subparagraph><subparagraph id="id0E7D11BB12D5404E98A1A4F7DB27F456"><enum>(B)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and adjusting the margins accordingly; and</text>
 </subparagraph><subparagraph id="id91AE7E050428424F8E2AA10BBAC1B8D7"><enum>(C)</enum><text>by redesignating such subsection (c) as paragraph (2) of subsection (b) and adjusting the margin accordingly;</text>
 </subparagraph></paragraph><paragraph id="idA69C5477207745AC954FDED3E70260D9"><enum>(5)</enum><text>by striking subsections (d) and (e) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="idD4FA98B770A34ECE870A78BD0AC2DFEA" style="OLC"> <subsection id="id8D467A5C4EE14F969070D73A780F06C0"><enum>(c)</enum><header>National congenital heart disease cohort study</header> <paragraph id="id9FAC3B93D81345B2810FF0B7680F69EB"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall plan, develop, implement, and submit annual reports to the Congress on research and surveillance activities of the Centers for Disease Control and Prevention, including a cohort study to improve understanding of the epidemiology of CHD across the lifespan, from birth to adulthood, with particular interest in the following:</text>
 <subparagraph id="idA97C35B13FD54F2898F5E0372244DA4D"><enum>(A)</enum><text>Health care utilization and natural history of individuals affected by CHD.</text> </subparagraph><subparagraph id="idCA7FC5DED08F483BBD5C02F9D4B5FB8B"><enum>(B)</enum><text>Demographic factors associated with CHD, such as age, race, ethnicity, gender, and family history of individuals who are diagnosed with the disease.</text>
 </subparagraph><subparagraph id="id47BF55764F3C4418A33D64F488187EA8"><enum>(C)</enum><text>Outcome measures, such that analysis of the outcome measures will allow derivation of evidence-based best practices and guidelines for CHD patients.</text>
 </subparagraph></paragraph><paragraph id="id900B6CE137EE461694939E352CA21C9E"><enum>(2)</enum><header>Permissible considerations</header><text>The study under this subsection may—</text> <subparagraph id="H51114714F4614B3894669117F119405E"><enum>(A)</enum><text>gather data on the health outcomes of a diverse population of those affected by CHD;</text>
 </subparagraph><subparagraph id="HDC76A99E31D94DC9B2139ABE87F5291B"><enum>(B)</enum><text>consider health disparities among those affected by CHD which may include the consideration of prenatal exposures; and</text>
 </subparagraph><subparagraph id="H92E2723742CB4BB8AB868B258F02BE75"><enum>(C)</enum><text>incorporate behavioral, emotional, and educational outcomes of those affected by CHD.</text> </subparagraph></paragraph><paragraph id="id0C17932C443A49399CE739C16885C170"><enum>(3)</enum><header>Public access</header><text>Subject to appropriate protections of personal information, including protections required under paragraph (4), data generated from the study under this subsection and through the Congenital Heart Disease Surveillance System under subsection (b) shall be made available for purposes of CHD research and to the public.</text>
 </paragraph><paragraph id="idE65FDD9C94C340B083D9C3C21D24F769"><enum>(4)</enum><header>Patient privacy</header><text>The Secretary shall ensure that the study under this subsection and the Congenital Heart Disease Surveillance System under subsection (b) are carried out in a manner that complies with the requirements applicable to a covered entity under the regulations promulgated pursuant to section 264(c) of the Health Insurance Portability and Accountability Act of 1996.</text>
						</paragraph></subsection><subsection id="id3204FEBBFF56493D9EE02342121E134E"><enum>(d)</enum><header>Congenital heart disease awareness campaign</header>
 <paragraph id="id52DA2A412CA74814830CF0E231AC2F9B"><enum>(1)</enum><header>In general</header><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall establish and implement an awareness, outreach, and education campaign regarding CHD across the lifespan. The information expressed through such campaign may—</text>
 <subparagraph id="id9AF9E19EF49A441BB215B87211820D53"><enum>(A)</enum><text>emphasize the prevalence of CHD;</text> </subparagraph><subparagraph id="HA62D0A1B02A94438985384CB0C86C19B"><enum>(B)</enum><text>identify CHD as a condition that affects those diagnosed throughout their lives; and</text>
 </subparagraph><subparagraph id="H42ED2D9EDCA64A63A8E8DCD20AD3AD9A"><enum>(C)</enum><text>promote the need for pediatric, adolescent, and adult individuals with CHD to seek and maintain lifelong, specialized care.</text>
 </subparagraph></paragraph><paragraph id="id330222D6E35241289E1F581745901E4D"><enum>(2)</enum><header>Permissible activities</header><text>The campaign under this subsection may—</text> <subparagraph id="HA1D7A3FEF29144FEA3E7D1FF72826695"><enum>(A)</enum><text>utilize collaborations or partnerships with other agencies, health care professionals, and patient advocacy organizations that specialize in the needs of individuals with CHD; and</text>
 </subparagraph><subparagraph id="HCBDCBA669984499796C8D909EE05A9A2"><enum>(B)</enum><text>include the use of print, film, or electronic materials distributed via television, radio, Internet, or other commercial marketing venues.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id1B8BF08AE5CA4986BE81FA0407512712"><enum>(6)</enum><text>by redesignating subsection (f) as subsection (e); and</text> </paragraph><paragraph id="idB66382C66BAB48F38D5675A22B054FB9"><enum>(7)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE47D1BC1F3DC49F1BA148E3B55F7846A" style="OLC">
 <subsection id="idD1ACCD4D969140C792552EBF449A202A"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary for each of fiscal years 2017 through 2021.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="H96BF9F8A764E4DC8AB6DF7A08EDA1EA8"><enum>3.</enum><header>Congenital heart disease research</header><text display-inline="no-display-inline">Section 425 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285b-8">42 U.S.C. 285b–8</external-xref>) is amended by adding the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H1CAE5A6A3F6A4499A0417B66A7637D31" style="OLC">
 <subsection id="H62C17C0CE5524F42BAD7B1A5DEA0837F"><enum>(d)</enum><header>Report from NIH</header><text>Not later than 1 year after the date of enactment of the <short-title>Congenital Heart Futures Reauthorization Act of 2017</short-title>, the Director of NIH, acting through the Director of the Institute, shall provide a report to Congress—</text>
 <paragraph id="H678741112324422FB380F22CD4F13628"><enum>(1)</enum><text>outlining the ongoing research efforts of the National Institutes of Health regarding congenital heart disease; and</text>
 </paragraph><paragraph id="H5CBE285C083D4A5EAD9F8B722B74B43A"><enum>(2)</enum><text>identifying—</text> <subparagraph id="H2E41DEE636DD47AEACB261590FAC7A85"><enum>(A)</enum><text>future plans for research regarding congenital heart disease; and</text>
 </subparagraph><subparagraph id="HBD5D44163B4349998C3EF750E1341F99"><enum>(B)</enum><text>the areas of greatest need for such research.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section></legis-body></bill>
