			 energy codes</header>
				<section id="id2335CC177D49410D8F064F629F81A6B7"><enum>101.</enum><header>Greater energy
			 efficiency in building codes</header>
 <subsection id="idAA7D004B440244EBB649FCF8FD80A980"><enum>(a)</enum><header>Definitions</header><text>Section 303 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6832">42 U.S.C. 6832</external-xref>) is amended—</text>
 <paragraph id="idB1CCB6F82ED34D72A86855A80D8E0679"><enum>(1)</enum><text>by striking paragraph (14) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id62568A7D63964838A30A72EE83E5EC00" style="OLC">
								<paragraph id="id25EF88996CA84967A74C2692C0C64771"><enum>(14)</enum><header>Model building
 energy code</header><text>The term <term>model building energy code</term> means a voluntary building energy code and standards developed and updated through a consensus process among interested persons, such as the IECC or the code used by—</text>
 <subparagraph id="idCD5B753A29024122BB7BD8E8914C3F2B"><enum>(A)</enum><text>the Council of American Building Officials, or its legal successor, International Code Council, Inc.;</text>
 </subparagraph><subparagraph id="id2ED48B9BB5A246C793E6EC82E770E333"><enum>(B)</enum><text>the American Society of Heating, Refrigerating, and Air-Conditioning Engineers; or</text>
 </subparagraph><subparagraph id="id7A6ECFC899C74FABA5D74E06D0460F3F"><enum>(C)</enum><text>other appropriate organizations.</text></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="idB99D7C64A36847F684779657CC2012D1"><enum>(2)</enum><text>by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id79F0DCACE9C5416899A71DEC016C71AD" style="OLC">
 <paragraph id="id2ca536af-0e67-4fdd-8b32-8e0f2e2bf87e"><enum>(17)</enum><header>IECC</header><text>The term <term>IECC</term> means the International Energy Conservation Code.</text>
								</paragraph><paragraph id="id28F4BDEC32234C15A7C305B5A60D7D36"><enum>(18)</enum><header>Indian
 tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd68f9b31-03f6-4046-911d-ab7261594098"><enum>(b)</enum><header>State
 building energy efficiency codes</header><text>Section 304 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6833">42 U.S.C. 6833</external-xref>) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id85C7235C1CE54E7BA0C27B8602891B13" style="OLC">
							<section id="id25544534-b23b-4f6f-b473-e83069a6a0b6"><enum>304.</enum><header>Updating
				State building energy efficiency codes</header>
								<subsection id="id24647201-6884-4160-9277-ef5321a5d126"><enum>(a)</enum><header>In
 general</header><text>The Secretary shall—</text> <paragraph id="id6f6128ca-90a2-4b94-abaf-860a90b2a86c"><enum>(1)</enum><text>encourage and support the adoption of building energy codes by States, Indian tribes, and, as appropriate, by local governments that meet or exceed the model building energy codes, or achieve equivalent or greater energy savings; and</text>
 </paragraph><paragraph id="ida49107b2-f667-4970-9ff0-c09b2428b6f4"><enum>(2)</enum><text>support full compliance with the State and local codes.</text>
									</paragraph></subsection><subsection id="id767a0a09-ff9d-41c2-94a8-eb35b5125ff2"><enum>(b)</enum><header>State and
				Indian tribe certification of building energy code updates</header>
									<paragraph id="id298852ec-e3f0-4e7b-8e95-92906389b7b2"><enum>(1)</enum><header>Review and
				updating of codes by each State and Indian tribe</header>
										<subparagraph id="idead0dc0a-cf23-4c29-a9dc-6ba6c8486dfd"><enum>(A)</enum><header>In
 general</header><text>Not later than 2 years after the date on which a model building energy code is updated, each State or Indian tribe shall certify whether or not the State or Indian tribe, respectively, has reviewed and updated the energy provisions of the building code of the State or Indian tribe, respectively.</text>
 </subparagraph><subparagraph id="idd731490c-891c-4e7b-bfdc-c7d606c7ea3c"><enum>(B)</enum><header>Demonstration</header><text>The certification shall include a demonstration of whether or not the energy savings for the code provisions that are in effect throughout the State or Indian tribal territory meet or exceed—</text>
 <clause id="idae05cc21-e074-4f80-bd52-773f668e88e8"><enum>(i)</enum><text>the energy savings of the updated model building energy code; or</text>
 </clause><clause id="idd393b32f-ffd2-4f02-9fc1-39da6ffe3581"><enum>(ii)</enum><text>the targets established under section 307(b)(2).</text>
											</clause></subparagraph><subparagraph id="id9cff36a5-a41a-46ed-bbea-63aad0b8688e"><enum>(C)</enum><header>No model
 building energy code update</header><text>If a model building energy code is not updated by a target date established under section 307(b)(2)(D), each State or Indian tribe shall, not later than 2 years after the specified date, certify whether or not the State or Indian tribe, respectively, has reviewed and updated the energy provisions of the building code of the State or Indian tribe, respectively, to meet or exceed the target in section 307(b)(2).</text>
										</subparagraph></paragraph><paragraph id="id37e4636c-71d4-49ca-bfe0-0c6f1cfd8d7b"><enum>(2)</enum><header>Validation
 by Secretary</header><text>Not later than 90 days after a State or Indian tribe certification under paragraph (1), the Secretary shall—</text>
 <subparagraph id="idd9ed7248-dff8-4f25-8875-d257996565e9"><enum>(A)</enum><text>determine whether the code provisions of the State or Indian tribe, respectively, meet the criteria specified in paragraph (1); and</text>
 </subparagraph><subparagraph id="id28b3a82d-7feb-4ed1-b187-c4a1aa6f59fe"><enum>(B)</enum><text>if the determination is positive, validate the certification.</text>
										</subparagraph></paragraph></subsection><subsection id="idb00a0ecd-2306-4f02-954d-069e2a24e00d"><enum>(c)</enum><header>Improvements
				in compliance with building energy codes</header>
									<paragraph id="ide41f999f-3183-4b46-9186-c7048c36d1a4"><enum>(1)</enum><header>Requirement</header>
										<subparagraph id="id7e70223e-42e4-4f76-8c9b-a5cebe53552c"><enum>(A)</enum><header>In
 general</header><text>Not later than 3 years after the date of a certification under subsection (b), each State and Indian tribe shall certify whether or not the State and Indian tribe, respectively, has—</text>
 <clause id="id6721fd7f-58b0-43b0-b8aa-7c3305859a20"><enum>(i)</enum><text>achieved full compliance under paragraph (3) with the applicable certified State and Indian tribe building energy code or with the associated model building energy code; or</text>
 </clause><clause id="id02e94d8a-fde8-4436-9764-56131ee5061b"><enum>(ii)</enum><text>made significant progress under paragraph (4) toward achieving compliance with the applicable certified State and Indian tribe building energy code or with the associated model building energy code.</text>
											</clause></subparagraph><subparagraph id="id9e294917-7840-4318-8bc2-2ed84097d210"><enum>(B)</enum><header>Repeat
 certifications</header><text>If the State or Indian tribe certifies progress toward achieving compliance, the State or Indian tribe shall repeat the certification until the State or Indian tribe certifies that the State or Indian tribe has achieved full compliance, respectively.</text>
										</subparagraph></paragraph><paragraph id="idda7c5714-e66e-40dc-a78d-6f05e1076f10"><enum>(2)</enum><header>Measurement
 of compliance</header><text>A certification under paragraph (1) shall include documentation of the rate of compliance based on—</text>
 <subparagraph id="idfc78c77f-ffba-48bc-b62f-5bc4f3364fda"><enum>(A)</enum><text>independent inspections of a random sample of the buildings covered by the code in the preceding year; or</text>
 </subparagraph><subparagraph id="idbd927aa9-0816-46d2-8478-0d56369a931f"><enum>(B)</enum><text>an alternative method that yields an accurate measure of compliance.</text>
										</subparagraph></paragraph><paragraph id="id1d508f52-e62e-43ab-8f8a-1988e61b12fc"><enum>(3)</enum><header>Achievement
 of compliance</header><text>A State or Indian tribe shall be considered to achieve full compliance under paragraph (1) if—</text>
 <subparagraph id="idcb00e54c-3be7-4b97-9738-465a69372463"><enum>(A)</enum><text>at least 90 percent of building space covered by the code in the preceding year substantially meets all the requirements of the applicable code specified in paragraph (1), or achieves equivalent or greater energy savings level; or</text>
 </subparagraph><subparagraph id="id4884781b-7005-4c0c-b11d-fff4bff62201"><enum>(B)</enum><text>the estimated excess energy use of buildings that did not meet the applicable code specified in paragraph (1) in the preceding year, compared to a baseline of comparable buildings that meet this code, is not more than 5 percent of the estimated energy use of all buildings covered by this code during the preceding year.</text>
										</subparagraph></paragraph><paragraph id="ide07a0a26-ffc7-48de-b01f-eb445614c0b0"><enum>(4)</enum><header>Significant
 progress toward achievement of compliance</header><text>A State or Indian tribe shall be considered to have made significant progress toward achieving compliance for purposes of paragraph (1) if the State or Indian tribe—</text>
 <subparagraph id="id4f4156c9-0154-4f6d-8fa3-a8cc65d9dd5a"><enum>(A)</enum><text>has developed and is implementing a plan for achieving compliance during the 8-year-period beginning on the date of enactment of this paragraph, including annual targets for compliance and active training and enforcement programs; and</text>
 </subparagraph><subparagraph id="idb9cf0e76-90fd-4c7c-bae2-bd37a1426682"><enum>(B)</enum><text>has met the most recent target under subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="idd667fc17-1295-4878-88cc-e86797cfe567"><enum>(5)</enum><header>Validation
 by Secretary</header><text>Not later than 90 days after a State or Indian tribe certification under paragraph (1), the Secretary shall—</text>
 <subparagraph id="idbc6e15f3-a3d4-4ffc-b893-ae0f929b3a52"><enum>(A)</enum><text>determine whether the State or Indian tribe has demonstrated meeting the criteria of this subsection, including accurate measurement of compliance; and</text>
 </subparagraph><subparagraph id="id61a2c2c9-e9f4-4e66-a5c6-fb43c09c0aec"><enum>(B)</enum><text>if the determination is positive, validate the certification.</text>
										</subparagraph></paragraph></subsection><subsection id="idce13cabd-a153-4eb4-8b32-6aae7cbde8b9"><enum>(d)</enum><header>States or
				Indian tribes that do not achieve compliance</header>
 <paragraph id="id6dc7990d-e38b-411b-b42e-5c48eb305246"><enum>(1)</enum><header>Reporting</header><text>A State or Indian tribe that has not made a certification required under subsection (b) or (c) by the applicable deadline shall submit to the Secretary a report on—</text>
 <subparagraph id="idadf5298a-cdb2-408d-ad3a-b2e921295eea"><enum>(A)</enum><text>the status of the State or Indian tribe with respect to meeting the requirements and submitting the certification; and</text>
 </subparagraph><subparagraph id="id3505ea74-29bf-4784-9630-0f415fc53d3f"><enum>(B)</enum><text>a plan for meeting the requirements and submitting the certification.</text>
										</subparagraph></paragraph><paragraph id="ID7a2c5486a7854809a5af5a24588167bf"><enum>(2)</enum><header>Federal
 support</header><text>For any State or Indian tribe for which the Secretary has not validated a certification by a deadline under subsection (b) or (c), the lack of the certification may be a consideration for Federal support authorized under this section for code adoption and compliance activities.</text>
									</paragraph><paragraph id="ID0bda389e14a44535b46c899fee3fc3de"><enum>(3)</enum><header>Local
 government</header><text>In any State or Indian tribe for which the Secretary has not validated a certification under subsection (b) or (c), a local government may be eligible for Federal support by meeting the certification requirements of subsections (b) and (c).</text>
									</paragraph><paragraph id="id960abdd1-3ba9-4d36-9ff0-f3ba1411128d"><enum>(4)</enum><header>Annual
				reports by Secretary</header>
										<subparagraph id="id116e2c22-b301-4daa-aa4d-09a70bbac468"><enum>(A)</enum><header>In
 general</header><text>The Secretary shall annually submit to Congress, and publish in the Federal Register, a report on—</text>
 <clause id="idf0c225f0-086d-4a0a-86e7-359e7dae3cc7"><enum>(i)</enum><text>the status of model building energy codes;</text>
 </clause><clause id="idd155cee7-4c36-43f3-b98c-13011f063b7c"><enum>(ii)</enum><text>the status of code adoption and compliance in the States and Indian tribes;</text>
 </clause><clause id="id5a1b2eb3-2ea0-461b-9a81-1d8df8a5db27"><enum>(iii)</enum><text>implementation of this section; and</text>
 </clause><clause id="id3fe184ed-1bc6-4850-9907-950c4e1d8b35"><enum>(iv)</enum><text>improvements in energy savings over time as result of the targets established under section 307(b)(2).</text>
 </clause></subparagraph><subparagraph id="id04ca2301-4cd5-47d8-8fd1-443a74e2c837"><enum>(B)</enum><header>Impacts</header><text>The report shall include estimates of impacts of past action under this section, and potential impacts of further action, on—</text>
 <clause id="id7b2e9c43-10cb-4bc1-a7e8-d78ad78fdf6f"><enum>(i)</enum><text>upfront financial and construction costs, cost benefits and returns (using investment analysis), and lifetime energy use for buildings;</text>
 </clause><clause id="id3a66467f-7d3a-4a88-8e05-5bda1e5d89c6"><enum>(ii)</enum><text>resulting energy costs to individuals and businesses; and</text>
 </clause><clause id="id20713271-6a4b-4561-9770-956754590ed5"><enum>(iii)</enum><text>resulting overall annual building ownership and operating costs.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="idfc9029a1-22ab-4814-8266-cb1e3b3a3184"><enum>(e)</enum><header>Technical
 assistance to States and Indian tribes</header><text>The Secretary shall provide technical assistance to States and Indian tribes to implement the goals and requirements of this section, including procedures and technical analysis for States and Indian tribes—</text>
 <paragraph id="idA3CF365830B64E2985AC3BCD25194F08"><enum>(1)</enum><text>to improve and implement State residential and commercial building energy codes;</text>
 </paragraph><paragraph id="id9ea82f43-afae-4940-a226-ddd031dfbe84"><enum>(2)</enum><text>to demonstrate that the code provisions of the States and Indian tribes achieve equivalent or greater energy savings than the model building energy codes and targets;</text>
 </paragraph><paragraph id="idfb3056a4-2332-4128-9a20-ab65d2a5ecfc"><enum>(3)</enum><text>to document the rate of compliance with a building energy code; and</text>
 </paragraph><paragraph id="id37c48f6e-35f9-4df3-9d28-30a309cfe9a1"><enum>(4)</enum><text>to otherwise promote the design and construction of energy efficient buildings.</text>
									</paragraph></subsection><subsection id="ide6098097-d5ce-4e2f-9678-2e7f8e2dfcad"><enum>(f)</enum><header>Availability
				of incentive funding</header>
									<paragraph id="id3b8be199-a59c-44d0-8ff0-9eae6b0eacf3"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall provide incentive funding to States and Indian tribes—</text>
 <subparagraph id="id8094f578-0334-48ca-9f69-3c35b9894a5b"><enum>(A)</enum><text>to implement the requirements of this section;</text>
 </subparagraph><subparagraph id="id396070ab-78be-4442-bb7f-62fdb0ae6c75"><enum>(B)</enum><text>to improve and implement residential and commercial building energy codes, including increasing and verifying compliance with the codes and training of State, tribal, and local building code officials to implement and enforce the codes; and</text>
 </subparagraph><subparagraph id="idb0c5f139-8a0b-4b2b-a5fb-b7e511be2cd0"><enum>(C)</enum><text>to promote building energy efficiency through the use of the codes.</text>
										</subparagraph></paragraph><paragraph id="id608a8e5e-74de-407d-9128-ae99ef9912bf"><enum>(2)</enum><header>Additional
 funding</header><text>Additional funding shall be provided under this subsection for implementation of a plan to achieve and document full compliance with residential and commercial building energy codes under subsection (c)—</text>
 <subparagraph id="IDcf380c6b47c049fa9fa77514f7a693c8"><enum>(A)</enum><text>to a State or Indian tribe for which the Secretary has validated a certification under subsection (b) or (c); and</text>
 </subparagraph><subparagraph id="id1a7cf048-5c6e-45b5-98fd-aa48546104ad"><enum>(B)</enum><text>in a State or Indian tribe that is not eligible under subparagraph (A), to a local government that is eligible under this section.</text>
 </subparagraph></paragraph><paragraph id="ida0af2956-ab48-495c-894b-f47921ea1fc7"><enum>(3)</enum><header>Training</header><text>Of the amounts made available under this subsection, the State or Indian tribe may use amounts required, but not to exceed $750,000 for a State, to train State and local building code officials to implement and enforce codes described in paragraph (2).</text>
									</paragraph><paragraph id="id828045d3-30bc-4f3b-8247-237440589c34"><enum>(4)</enum><header>Local
 governments</header><text>States may share grants under this subsection with local governments that implement and enforce the codes.</text>
									</paragraph></subsection><subsection id="ID3aa4a84464e04fa4aaf6c0368a5e3a2f"><enum>(g)</enum><header>Stretch codes
				and advanced standards</header>
									<paragraph id="ID5d49b936be854c93a7f65e988a0cc215"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall provide technical and financial support for the development of stretch codes and advanced standards for residential and commercial buildings for use as—</text>
 <subparagraph id="IDd34ab458309b43739262002f381b94c5"><enum>(A)</enum><text>an option for adoption as a building energy code by local, tribal, or State governments; and</text>
 </subparagraph><subparagraph id="IDf5cd0fb2ae424ac2bf20a8b41c0ca4e1"><enum>(B)</enum><text>guidelines for energy-efficient building design.</text>
 </subparagraph></paragraph><paragraph id="IDaa86c3b002174f95a3c34990babed676"><enum>(2)</enum><header>Targets</header><text>The stretch codes and advanced standards shall be designed—</text>
 <subparagraph id="idE300292B6EDE470AAA3AFD20CFD53FB2"><enum>(A)</enum><text>to achieve substantial energy savings compared to the model building energy codes; and</text>
 </subparagraph><subparagraph id="id2056FCDD804848998F1E6615BAB3E628"><enum>(B)</enum><text>to meet targets under section 307(b), if available, at least 3 to 6 years in advance of the target years.</text>
 </subparagraph></paragraph></subsection><subsection id="id81fdf070-e53e-46f8-b812-5ce24cae8bac"><enum>(h)</enum><header>Studies</header><text>The Secretary, in consultation with building science experts from the National Laboratories and institutions of higher education, designers and builders of energy-efficient residential and commercial buildings, code officials, and other stakeholders, shall undertake a study of the feasibility, impact, economics, and merit of—</text>
 <paragraph id="ida3392673-43b2-48c7-abeb-0da5e1ed4c8d"><enum>(1)</enum><text>code improvements that would require that buildings be designed, sited, and constructed in a manner that makes the buildings more adaptable in the future to become zero-net-energy after initial construction, as advances are achieved in energy-saving technologies;</text>
 </paragraph><paragraph id="id8de13d6a-dc63-4554-9495-f2c1449f86b2"><enum>(2)</enum><text>code procedures to incorporate measured lifetimes, not just first-year energy use, in trade-offs and performance calculations; and</text>
 </paragraph><paragraph id="id13975f7f-52dc-42a9-848a-948fb03681b7"><enum>(3)</enum><text>legislative options for increasing energy savings from building energy codes, including additional incentives for effective State and local action, and verification of compliance with and enforcement of a code other than by a State or local government.</text>
									</paragraph></subsection><subsection id="id843243562d034c08b938447404b6e735"><enum>(i)</enum><header>Effect on other
 laws</header><text>Nothing in this section or section 307 supersedes or modifies the application of sections 321 through 346 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6291">42 U.S.C. 6291</external-xref> et seq.).</text>
								</subsection><subsection id="idf95f9dd5-ec11-4af5-8944-d84161f6ed82"><enum>(j)</enum><header>Authorization
 of appropriations</header><text>There are authorized to be appropriated to carry out this section and section 307 $200,000,000, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id2A141D0F467847909FFEE4F6117090D4"><enum>(c)</enum><header>Federal
 building energy efficiency standards</header><text display-inline="yes-display-inline">Section 305 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834</external-xref>) is amended by striking <quote>voluntary building energy code</quote> each place it appears in subsections (a)(2)(B) and (b) and inserting <quote>model building energy code</quote>.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id65B42DB41D884362A36169D2C8E96E99"><enum>(d)</enum><header>Model building
 energy codes</header><text>Section 307 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6836">42 U.S.C. 6836</external-xref>) is amended to read as follows:</text>

							<section id="idA758956ABF1D4C4ABDF98AB0FF61807E"><enum>307.</enum><header>Support for
				model building energy codes</header>
								<subsection id="idBBF077454CEA488B929CFD950DF7CF05"><enum>(a)</enum><header>In
 general</header><text>The Secretary shall support the updating of model building energy codes.</text>
								</subsection><subsection id="id0C7857A9E61F447796F2A0821FC3A1B0"><enum>(b)</enum><header>Targets</header>
									<paragraph id="idE43409F8521A4129BF893B1E621F7773"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall support the updating of the model building energy codes to enable the achievement of aggregate energy savings targets established under paragraph (2).</text>
									</paragraph><paragraph id="id63C291A19FA14A59B3EA102FFBEB1F7F"><enum>(2)</enum><header>Targets</header>
										<subparagraph id="id508D5DE47C984B8BA92CA02BC2463A5F"><enum>(A)</enum><header>In
 general</header><text>The Secretary shall work with State, Indian tribes, local governments, nationally recognized code and standards developers, and other interested parties to support the updating of model building energy codes by establishing one or more aggregate energy savings targets to achieve the purposes of this section.</text>
										</subparagraph><subparagraph id="idA32E86E2E87340DCAC5F1C63F70CCD44"><enum>(B)</enum><header>Separate
 targets</header><text>The Secretary may establish separate targets for commercial and residential buildings.</text>
 </subparagraph><subparagraph id="id901C4C8874144BC298158BD4A38ABAB1"><enum>(C)</enum><header>Baselines</header><text>The baseline for updating model building energy codes shall be the 2009 IECC for residential buildings and ASHRAE Standard 90.1–2010 for commercial buildings.</text>
										</subparagraph><subparagraph id="id53FABAD9C01B48528A6D93E5645F4092"><enum>(D)</enum><header>Specific
				years</header>
											<clause id="idB7FB450E496E451998459DAD5E1B7A48"><enum>(i)</enum><header>In
 general</header><text>Targets for specific years shall be established and revised by the Secretary through rulemaking and coordinated with nationally recognized code and standards developers at a level that—</text>
 <subclause id="idF21285C75B654E8DB9842776967E3DBB"><enum>(I)</enum><text>is at the maximum level of energy efficiency that is technologically feasible and life-cycle cost effective, while accounting for the economic considerations under paragraph (4);</text>
 </subclause><subclause id="id2100B432CBED445BAA47CE71710AA794"><enum>(II)</enum><text>is higher than the preceding target; and</text>
 </subclause><subclause id="id299CC28511B14D0BAB8F54CC83D4B6B6"><enum>(III)</enum><text>promotes the achievement of commercial and residential high-performance buildings through high performance energy efficiency (within the meaning of section 401 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17061">42 U.S.C. 17061</external-xref>)).</text>
												</subclause></clause><clause id="idBFEEB0FC7B5F4D44A123E7F220A4A761"><enum>(ii)</enum><header>Initial
 targets</header><text>Not later than 1 year after the date of enactment of this clause, the Secretary shall establish initial targets under this subparagraph.</text>
											</clause><clause id="idAE235062BD5248AEB147DE43820742C1"><enum>(iii)</enum><header>Different
 target years</header><text>Subject to clause (i), prior to the applicable year, the Secretary may set a later target year for any of the model building energy codes described in subparagraph (A) if the Secretary determines that a target cannot be met.</text>
											</clause><clause id="idF65B5646B6F64A5BB192CC5D806BE1A1"><enum>(iv)</enum><header>Small
 business</header><text>When establishing targets under this paragraph through rulemaking, the Secretary shall ensure compliance with the Small Business Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/121">Public Law 104–121</external-xref>).</text>
											</clause></subparagraph></paragraph><paragraph id="idD98AB64C39C14D528EBCAD8EC9647E2A"><enum>(3)</enum><header>Appliance
 standards and other factors affecting building energy use</header><text>In establishing building code targets under paragraph (2), the Secretary shall develop and adjust the targets in recognition of potential savings and costs relating to—</text>
 <subparagraph id="idCB6B600A1C5D4144B64D49146F791A68"><enum>(A)</enum><text>efficiency gains made in appliances, lighting, windows, insulation, and building envelope sealing;</text>
 </subparagraph><subparagraph id="idE82C8858B38F4E0DB987E134F111A22E"><enum>(B)</enum><text>advancement of distributed generation and on-site renewable power generation technologies;</text>
 </subparagraph><subparagraph id="id3E339C3287824D6D82897774D0707778"><enum>(C)</enum><text>equipment improvements for heating, cooling, and ventilation systems;</text>
 </subparagraph><subparagraph id="id3A4F4E8963F745168B2C6FE3CEE21709"><enum>(D)</enum><text>building management systems and SmartGrid technologies to reduce energy use; and</text>
 </subparagraph><subparagraph id="id84545A3876694D5A8AE5D9B3348DAED4"><enum>(E)</enum><text>other technologies, practices, and building systems that the Secretary considers appropriate regarding building plug load and other energy uses.</text>
										</subparagraph></paragraph><paragraph id="id402CBD5D53114552858B712759F6E45E"><enum>(4)</enum><header>Economic
 considerations</header><text>In establishing and revising building code targets under paragraph (2), the Secretary shall consider the economic feasibility of achieving the proposed targets established under this section and the potential costs and savings for consumers and building owners, including a return on investment analysis.</text>
									</paragraph></subsection><subsection id="id2701C1D4C3E84C6FB816C140AD87312B"><enum>(c)</enum><header>Technical
				assistance to model building energy code-Setting and standard
			 development
				organizations</header>
									<paragraph id="idF6DF9FA00CD34B0098D516D62DB33991"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall, on a timely basis, provide technical assistance to model building energy code-setting and standard development organizations consistent with the goals of this section.</text>
 </paragraph><paragraph id="id06D03561DBFC45988C2B5D295298AE97"><enum>(2)</enum><header>Assistance</header><text>The assistance shall include, as requested by the organizations, technical assistance in—</text>
 <subparagraph id="id4F86E06C692443A895B18DAFD4E0B200"><enum>(A)</enum><text>evaluating code or standards proposals or revisions;</text>
 </subparagraph><subparagraph id="idECFB7B36786F4A7F8542F2B39B1D5A95"><enum>(B)</enum><text>building energy analysis and design tools;</text>
 </subparagraph><subparagraph id="id8240ED36C9234B12AE018744D7934D41"><enum>(C)</enum><text>building demonstrations;</text>
 </subparagraph><subparagraph id="id9B207E3F38B14E02A7223C29B7787447"><enum>(D)</enum><text>developing definitions of energy use intensity and building types for use in model building energy codes to evaluate the efficiency impacts of the model building energy codes;</text>
 </subparagraph><subparagraph id="id42E59D632FA04CC29348D427015A7264"><enum>(E)</enum><text>performance-based standards;</text>
 </subparagraph><subparagraph id="idE6C45D4D14E94AF0A8FE92908A083753"><enum>(F)</enum><text>evaluating economic considerations under subsection (b)(4); and</text>
 </subparagraph><subparagraph id="idBCD04CB223F5486CB4262CBCD98AF217"><enum>(G)</enum><text>developing model building energy codes by Indian tribes in accordance with tribal law.</text>
										</subparagraph></paragraph><paragraph id="id440DED5DEDA240048DA64493E4820DF5"><enum>(3)</enum><header>Amendment
 proposals</header><text>The Secretary may submit timely model building energy code amendment proposals to the model building energy code-setting and standard development organizations, with supporting evidence, sufficient to enable the model building energy codes to meet the targets established under subsection (b)(2).</text>
									</paragraph><paragraph id="id1240009E9EBC4B78A837C996E7464E94"><enum>(4)</enum><header>Analysis
 methodology</header><text>The Secretary shall make publicly available the entire calculation methodology (including input assumptions and data) used by the Secretary to estimate the energy savings of code or standard proposals and revisions.</text>
									</paragraph></subsection><subsection id="idEF72E22999574B40A294BAF77C4A5D91"><enum>(d)</enum><header>Determination</header>
									<paragraph id="id10F6963D4CF74CA6911EC7C1BEFFC3D0"><enum>(1)</enum><header>Revision of
 model building energy codes</header><text>If the provisions of the IECC or ASHRAE Standard 90.1 regarding building energy use are revised, the Secretary shall make a preliminary determination not later than 90 days after the date of the revision, and a final determination not later than 15 months after the date of the revision, on whether or not the revision will—</text>
 <subparagraph id="id6A0C07B08CDC45BC8E595BA91916C561"><enum>(A)</enum><text>improve energy efficiency in buildings compared to the existing model building energy code; and</text>
 </subparagraph><subparagraph id="idA8FB9196221A4A65ABF9F8EDE52FDD48"><enum>(B)</enum><text>meet the applicable targets under subsection (b)(2).</text>
										</subparagraph></paragraph><paragraph id="id5748C5314DCF4438AD7838A24881A560"><enum>(2)</enum><header>Codes or
				standards not meeting targets</header>
										<subparagraph id="idB85EED00F7174CEAAAE8BAD0E9B4CE2E"><enum>(A)</enum><header>In
 general</header><text>If the Secretary makes a preliminary determination under paragraph (1)(B) that a code or standard does not meet the targets established under subsection (b)(2), the Secretary may at the same time provide the model building energy code or standard developer with proposed changes that would result in a model building energy code that meets the targets and with supporting evidence, taking into consideration—</text>
 <clause id="id35E646C723EC496782A1133B6B5F94C5"><enum>(i)</enum><text>whether the modified code is technically feasible and life-cycle cost effective;</text>
 </clause><clause id="id82D8C59527874DD4ACBF68DBC86F46EC"><enum>(ii)</enum><text>available appliances, technologies, materials, and construction practices; and</text>
 </clause><clause id="idD5ED2FD85E4C479CB33E39372705288F"><enum>(iii)</enum><text>the economic considerations under subsection (b)(4).</text>
											</clause></subparagraph><subparagraph id="idE8AEC775E2864BD8AD5A9EE72AF39CF7"><enum>(B)</enum><header>Incorporation
				of changes</header>
											<clause id="idDE242431FCF441A6ACD653244D0C5C84"><enum>(i)</enum><header>In
 general</header><text>On receipt of the proposed changes, the model building energy code or standard developer shall have an additional 270 days to accept or reject the proposed changes of the Secretary to the model building energy code or standard for the Secretary to make a final determination.</text>
											</clause><clause id="id72079CF4FEF04A3785FD47171EC0C408"><enum>(ii)</enum><header>Final
 determination</header><text>A final determination under paragraph (1) shall be on the modified model building energy code or standard.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id2084436F8B8746E69787701C8AB533B4"><enum>(e)</enum><header>Administration</header><text>In carrying out this section, the Secretary shall—</text>
 <paragraph id="idFA0BF9125B7742A297BE0C9EBB738498"><enum>(1)</enum><text>publish notice of targets and supporting analysis and determinations under this section in the Federal Register to provide an explanation of and the basis for such actions, including any supporting modeling, data, assumptions, protocols, and cost-benefit analysis, including return on investment; and</text>
 </paragraph><paragraph id="id44A35EC04EDB48EF9E8DA048B6061970"><enum>(2)</enum><text>provide an opportunity for public comment on targets and supporting analysis and determinations under this section.</text>
									</paragraph></subsection><subsection id="ID4e898f1e42f745409f41322a046861bd"><enum>(f)</enum><header>Voluntary codes
 and standards</header><text>Notwithstanding any other provision of this section, any model building code or standard established under section 304 shall not be binding on a State, local government, or Indian tribe as a matter of Federal law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section></subtitle><subtitle id="iddf84b1a1-e789-4d23-9bbe-adb8b9411ac4"><enum>B</enum><header>Worker
			 training and capacity building</header>
				<section id="id3ba2aedb-d2a9-4d4c-a2d1-3ba8b31df5b0"><enum>111.</enum><header>Building
			 training and assessment centers</header>
					<subsection id="idb6415abc-f835-4356-8467-0928026d13a4"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">The Secretary shall provide grants to institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) and Tribal Colleges or Universities (as defined in section 316(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)) to establish building training and assessment centers—</text>
 <paragraph id="id5ec17e14-e4c3-4106-8222-815936a2535b"><enum>(1)</enum><text>to identify opportunities for optimizing energy efficiency and environmental performance in buildings;</text>
 </paragraph><paragraph id="id2feb47a0-3d77-42ea-9e0b-7273ffca0a16"><enum>(2)</enum><text>to promote the application of emerging concepts and technologies in commercial and institutional buildings;</text>
 </paragraph><paragraph id="idc27ced1c-5f70-42eb-8340-5e1c38de8d6e"><enum>(3)</enum><text>to train engineers, architects, building scientists, building energy permitting and enforcement officials, and building technicians in energy-efficient design and operation;</text>
 </paragraph><paragraph id="id0a9d8bbf-28a1-44c8-b4a0-3dc2bc0e148c"><enum>(4)</enum><text>to assist institutions of higher education and Tribal Colleges or Universities in training building technicians;</text>
 </paragraph><paragraph id="ida186eae1-3d5b-4d85-a671-4677c371cfeb"><enum>(5)</enum><text>to promote research and development for the use of alternative energy sources and distributed generation to supply heat and power for buildings, particularly energy-intensive buildings; and</text>
 </paragraph><paragraph id="idc7649866-1e46-488e-b6fb-5e6607ad9a7f"><enum>(6)</enum><text>to coordinate with and assist State-accredited technical training centers, community colleges, Tribal Colleges or Universities, and local offices of the National Institute of Food and Agriculture and ensure appropriate services are provided under this section to each region of the United States.</text>
						</paragraph></subsection><subsection id="id204e2a9c-6270-4d9f-9590-aa9f8e3d1bbe"><enum>(b)</enum><header>Coordination
			 and nonduplication</header>
						<paragraph id="id11a888c5-bdda-439a-ac96-d4e57e431ca5"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall coordinate the program with the industrial research and assessment centers program and with other Federal programs to avoid duplication of effort.</text>
 </paragraph><paragraph id="id965cb0c9-75f1-4a42-b5c5-1436fb0a30fd"><enum>(2)</enum><header>Collocation</header><text>To the maximum extent practicable, building, training, and assessment centers established under this section shall be collocated with Industrial Assessment Centers.</text>
						</paragraph></subsection><subsection id="idA63121F8EFB84F7C95406B469D3EE271"><enum>(c)</enum><header>Authorization
 of Appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000, to remain available until expended.</text>
					</subsection></section><section id="id48258ef4e96949b1a48877ef56fb8fe0"><enum>112.</enum><header>Career skills
			 training</header>
					<subsection id="id20fe237ff1b44f5aba4fc75a4d9462ab"><enum>(a)</enum><header>In
 general</header><text>The Secretary shall pay grants to eligible entities described in subsection (b) to pay the Federal share of associated career skills training programs under which students concurrently receive classroom instruction and on-the-job training for the purpose of obtaining an industry-related certification to install energy efficient buildings technologies, including technologies described in section 307(b)(3) of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6836">42 U.S.C. 6836(b)(3)</external-xref>).</text>
 </subsection><subsection id="idb3f92ce9c18a475387d9ec90a760c2d5"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to obtain a grant under subsection (a), an entity shall be a nonprofit partnership described in section 171(e)(2)(B)(ii) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2916">29 U.S.C. 2916(e)(2)(B)(ii)</external-xref>).</text>
					</subsection><subsection id="id20a81e2a315b433cb986ab3944344067"><enum>(c)</enum><header>Federal
 share</header><text>The Federal share of the cost of carrying out a career skills training program described in subsection (a) shall be 50 percent.</text>
					</subsection><subsection id="id4CC964EDAF1041B09FD2102BB7189056"><enum>(d)</enum><header>Authorization
 of Appropriations</header><text>There is authorized to be appropriated to carry out this section $10,000,000, to remain available until expended.</text>
					</subsection></section></subtitle><subtitle id="id72390F61B669456D84EB4BDEFEFAB21D"><enum>C</enum><header>School
		buildings</header>

		assistance for schools</header>
 <subsection commented="no" display-inline="no-display-inline" id="idA25E77DE6BB54B32AA6180945D584FB3"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of school</header><text display-inline="yes-display-inline">In this section, the term <term>school</term> means—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="IDed75340b641546a1a601210a9590a805"><enum>(1)</enum><text display-inline="yes-display-inline">an elementary school or secondary school (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>));</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID730ceb9c31054d918fd3ffbf58a08f1c"><enum>(2)</enum><text display-inline="yes-display-inline">an institution of higher education (as defined in section 102(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002(a)</external-xref>));</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf632bc7d88cc4422b11bcb4a49cbed9f"><enum>(3)</enum><text display-inline="yes-display-inline">a school of the defense dependents’ education system under the Defense Dependents’ Education Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/20/921">20 U.S.C. 921</external-xref> et seq.) or established under section 2164 of title 10, United States Code;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9e32294e98e14b21981909f128332b8f"><enum>(4)</enum><text display-inline="yes-display-inline">a school operated by the Bureau of Indian Affairs;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8facc23be8aa4418b117127983990a74"><enum>(5)</enum><text display-inline="yes-display-inline">a tribally controlled school (as defined in section 5212 of the Tribally Controlled Schools Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/25/2511">25 U.S.C. 2511</external-xref>)); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa2cb354874e94928af5aaa5cdca206b9"><enum>(6)</enum><text display-inline="yes-display-inline">a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFD42755727054ED594C7D57C7C4AAC91"><enum>(b)</enum><header display-inline="yes-display-inline">Designation of lead agency</header><text display-inline="yes-display-inline">The Secretary, acting through the Office of Energy Efficiency and Renewable Energy, shall act as the lead Federal agency for coordinating and disseminating information on existing Federal programs and assistance that may be used to help initiate, develop, and finance energy efficiency, renewable energy, and energy retrofitting projects for schools.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id0213B396825C420E815D40D07F92FE27"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In carrying out coordination and outreach under subsection (b), the Secretary shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="IDe01eea877acf45acb6ba0b64519ab953"><enum>(1)</enum><text display-inline="yes-display-inline">in consultation and coordination with the appropriate Federal agencies, carry out a review of existing programs and financing mechanisms (including revolving loan funds and loan guarantees) available in or from the Department of Agriculture, the Department of Energy, the Department of Education, the Department of the Treasury, the Internal Revenue Service, the Environmental Protection Agency, and other appropriate Federal agencies with jurisdiction over energy financing and facilitation that are currently used or may be used to help initiate, develop, and finance energy efficiency, renewable energy, and energy retrofitting projects for schools;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDebdc018538a64cfda953627272ceb6bb"><enum>(2)</enum><text display-inline="yes-display-inline">establish a Federal cross-departmental collaborative coordination, education, and outreach effort to streamline communication and promote available Federal opportunities and assistance described in paragraph (1), for energy efficiency, renewable energy, and energy retrofitting projects that enables States, local educational agencies, and schools—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id1237213AEAA84260A71C96B51C11306E"><enum>(A)</enum><text display-inline="yes-display-inline">to use existing Federal opportunities more effectively; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6E9BC01C0321445CADB791FBBE849046"><enum>(B)</enum><text display-inline="yes-display-inline">to form partnerships with Governors, State energy programs, local educational, financial, and energy officials, State and local government officials, nonprofit organizations, and other appropriate entities, to support the initiation of the projects;</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2c4f260766d04b20b9f0be18667decea"><enum>(3)</enum><text display-inline="yes-display-inline">provide technical assistance for States, local educational agencies, and schools to help develop and finance energy efficiency, renewable energy, and energy retrofitting projects—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="IDd164fd7df3334adc8ceab583776ee6a6"><enum>(A)</enum><text display-inline="yes-display-inline">to increase the energy efficiency of buildings or facilities;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID89aec68a53fc44e0a156e14d3f003458"><enum>(B)</enum><text display-inline="yes-display-inline">to install systems that individually generate energy from renewable energy resources;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf8b062be9d724035bc3fca91d4f73368"><enum>(C)</enum><text display-inline="yes-display-inline">to establish partnerships to leverage economies of scale and additional financing mechanisms available to larger clean energy initiatives; or</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58924BFD1E764456895D95F7957C7D6D"><enum>(D)</enum><text display-inline="yes-display-inline">to promote—</text> <clause commented="no" display-inline="no-display-inline" id="id28DD5117898C4D3A8E2ED4CC861AF851"><enum>(i)</enum><text display-inline="yes-display-inline">the maintenance of health, environmental quality, and safety in schools, including the ambient air quality, through energy efficiency, renewable energy, and energy retrofit projects; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id7FA3E50CBF0E4C238430EBDF72378E9E"><enum>(ii)</enum><text display-inline="yes-display-inline">the achievement of expected energy savings and renewable energy production through proper operations and maintenance practices;</text>
 </clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4e9ebb3fe5e543de8d37aba35ac8b2e6"><enum>(4)</enum><text display-inline="yes-display-inline">develop and maintain a single online resource website with contact information for relevant technical assistance and support staff in the Office of Energy Efficiency and Renewable Energy for States, local educational agencies, and schools to effectively access and use Federal opportunities and assistance described in paragraph (1) to develop energy efficiency, renewable energy, and energy retrofitting projects; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID49617e43e8004c1d9f290c19012a3f7c"><enum>(5)</enum><text display-inline="yes-display-inline">establish a process for recognition of schools that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="ID7bbbb37084fc4abbb8e3d654b5e4b4e3"><enum>(A)</enum><text display-inline="yes-display-inline">have successfully implemented energy efficiency, renewable energy, and energy retrofitting projects; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID928d15212a58425b86b65a52c136ca83"><enum>(B)</enum><text display-inline="yes-display-inline">are willing to serve as resources for other local educational agencies and schools to assist initiation of similar efforts.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf040d9ad6d6a4d479683ebac3f7815bb"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to Congress a report describing the implementation of this section.</text>
					</subsection></section></subtitle></title><title id="idca329195-d430-44c2-9e82-0048ab288af0"><enum>II</enum><header>Industrial
			 efficiency and competitiveness</header>
			<subtitle id="id57e316b3-d2a8-4c43-af81-bec3d5d63a83"><enum>A</enum><header>Manufacturing
			 energy efficiency</header>
 <section id="id6c24d200f4f549699273baa5611dd335"><enum>201.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this subtitle are—</text> <paragraph id="id4aa74617d9e242cbb8e8d483bd30ad63"><enum>(1)</enum><text>to reform and reorient the industrial efficiency programs of the Department of Energy;</text>
 </paragraph><paragraph id="id5f33910300ad4ba9807503530b3bd557"><enum>(2)</enum><text>to establish a clear and consistent authority for industrial efficiency programs of the Department;</text>
 </paragraph><paragraph id="id513d6edb0d1a4918989a46cdae1da640"><enum>(3)</enum><text>to accelerate the deployment of technologies and practices that will increase industrial energy efficiency and improve productivity;</text>
 </paragraph><paragraph id="id4a1d6efc35784ccfb7f4472505c35cac"><enum>(4)</enum><text>to accelerate the development and demonstration of technologies that will assist the deployment goals of the industrial efficiency programs of the Department and increase manufacturing efficiency;</text>
 </paragraph><paragraph id="id9d6d7f009f354ffa9075f62d418d3964"><enum>(5)</enum><text>to stimulate domestic economic growth and improve industrial productivity and competitiveness; and</text>
 </paragraph><paragraph id="id256e652ab8b043cbbe52561c1ff0ebe6"><enum>(6)</enum><text>to strengthen partnerships between Federal and State governmental agencies and the private and academic sectors.</text>

			 Industry program</header>

 general</header><text display-inline="yes-display-inline">Section 452 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17111">42 U.S.C. 17111</external-xref>) is amended by striking the section heading and inserting the following: <quote><header-in-text level="section" style="OLC">Future of Industry program</header-in-text></quote>.</text>
					</subsection><subsection id="id4F4E6126302043D89BE2D8CE8C6BB34F"><enum>(b)</enum><header>Definition of

 </clause><clause id="id986D0BAF9A224C3C8EA054BE53A6F4F1"><enum>(ii)</enum><text>coordinate with the Building Technologies Program of the Department of Energy to provide building assessment services to manufacturers;</text>
 </clause><clause id="idC93EC2B949054611960C1A3994559EEE"><enum>(iii)</enum><text>increase partnerships with the National Laboratories of the Department of Energy to leverage the expertise and technologies of the National Laboratories for national industrial and manufacturing needs;</text>
 </clause><clause id="idB490458A1C454DFFB1CDA471F8FD19B4"><enum>(iv)</enum><text>increase partnerships with energy service providers and technology providers to leverage private sector expertise and accelerate deployment of new and existing technologies and processes for energy efficiency, power factor, and load management;</text>
 </clause><clause id="idD39C7DA4431B49B69DF63D55F6EFB28B"><enum>(v)</enum><text>identify opportunities for reducing greenhouse gas emissions; and</text>
 </clause><clause id="idFF20BA8118354D52A54B245E7BED31EB"><enum>(vi)</enum><text>promote sustainable manufacturing practices for small- and medium-sized manufacturers.</text>
 </clause></subparagraph></paragraph><paragraph id="idACC44B61B5B349C78DF0EFF640756D9B"><enum>(3)</enum><header>Outreach</header><text>The Secretary shall provide funding for—</text>
 <subparagraph id="id1DD152EBB6E84E78A817925CF9D26688"><enum>(A)</enum><text>outreach activities by the industrial research and assessment centers to inform small- and medium-sized manufacturers of the information, technologies, and services available; and</text>
 </subparagraph><subparagraph id="id0AF37EBCB03B4F079DBF3144355F0A89"><enum>(B)</enum><text>coordination activities by each industrial research and assessment center to leverage efforts with—</text>
 <clause id="id0308AF40289D40419DDF74AA829F5774"><enum>(i)</enum><text>Federal and State efforts;</text>
 </clause><clause id="id2AE21E4091EB49839C23BD51F5E6E7D2"><enum>(ii)</enum><text>the efforts of utilities and energy service providers;</text>
 </clause><clause id="id60383FAA481C40EFB2737BF827004365"><enum>(iii)</enum><text>the efforts of regional energy efficiency organizations; and</text>
 </clause><clause id="id6D4B4364A38C4B3B8884FA5C4C3CFB35"><enum>(iv)</enum><text>the efforts of other industrial research and assessment centers.</text>
										</clause></subparagraph></paragraph><paragraph id="idBA6695C027F34F23B101CC215136CB00"><enum>(4)</enum><header>Workforce
				training</header>
									<subparagraph id="id4F22A26797C54A0E9B88CE6215E34731"><enum>(A)</enum><header>In
 general</header><text>The Secretary shall pay the Federal share of associated internship programs under which students work with or for industries, manufacturers, and energy service providers to implement the recommendations of industrial research and assessment centers.</text>
									</subparagraph><subparagraph id="idC59B4F1CD31C4EBA80301DC30A9C33B1"><enum>(B)</enum><header>Federal
 share</header><text>The Federal share of the cost of carrying out internship programs described in subparagraph (A) shall be 50 percent.</text>
									</subparagraph></paragraph><paragraph id="id342C58AA3E264ED7A3CE82C9BF764329"><enum>(5)</enum><header>Small business
 loans</header><text>The Administrator of the Small Business Administration shall, to the maximum extent practicable, expedite consideration of applications from eligible small business concerns for loans under the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> et seq.) to implement recommendations of industrial research and assessment centers established under paragraph (1).</text>
								</paragraph><paragraph id="idf0b0f9fb0eff41df87754c1d1e982c4c"><enum>(6)</enum><header>Advanced
 manufacturing steering committee</header><text>The Secretary shall establish an advisory steering committee to provide recommendations to the Secretary on planning and implementation of the Advanced Manufacturing Office of the Department of Energy.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="id27bd708a-8057-452a-a326-20b99c74c159"><enum>203.</enum><header>Sustainable
			 manufacturing initiative</header>
					<subsection id="idf77a7751-37fc-4271-b474-16d07cf73976"><enum>(a)</enum><header>In
 general</header><text display-inline="yes-display-inline">Part E of title III of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6341">42 U.S.C. 6341</external-xref>) is amended by adding at the end the following:</text>

 general</header><text>As part of the Office of Energy Efficiency and Renewable Energy, the Secretary, on the request of a manufacturer, shall conduct onsite technical assessments to identify opportunities for—</text>
 <paragraph id="idc8ffd756-75a1-486f-90a5-139f8d0b32ec"><enum>(1)</enum><text>maximizing the energy efficiency of industrial processes and cross-cutting systems;</text>
 </paragraph><paragraph id="ida460da8c-5f8c-424e-a345-ac408d5c4b4e"><enum>(2)</enum><text>preventing pollution and minimizing waste;</text>
 </paragraph><paragraph id="id8e84d7f0-5fae-4715-a8cd-60c229ea807b"><enum>(3)</enum><text>improving efficient use of water in manufacturing processes;</text>
 </paragraph><paragraph id="id77ee525d-a878-432e-961a-e3e72b474961"><enum>(4)</enum><text>conserving natural resources; and</text>
 </paragraph><paragraph id="idf7d904c3-8052-4a45-8a74-f017ed2f38dd"><enum>(5)</enum><text>achieving such other goals as the Secretary determines to be appropriate.</text>
 </paragraph></subsection><subsection id="idc2f2b24e-9fec-4a22-8655-ae229ad078a2"><enum>(b)</enum><header>Coordination</header><text>The Secretary shall carry out the initiative in coordination with the private sector and appropriate agencies, including the National Institute of Standards and Technology, to accelerate adoption of new and existing technologies and processes that improve energy efficiency.</text>
								</subsection><subsection id="id04b03943-4c71-4b3d-8aa1-dff0ed8dacfa"><enum>(c)</enum><header>Research
				and development program for sustainable manufacturing and
			 industrial
 technologies and processes</header><text>As part of the industrial efficiency programs of the Department of Energy, the Secretary shall carry out a joint industry-government partnership program to research, develop, and demonstrate new sustainable manufacturing and industrial technologies and processes that maximize the energy efficiency of industrial plants, reduce pollution, and conserve natural resources.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="idf0b0d455-1748-4bba-92a8-fd11976e0a10"><enum>(b)</enum><header>Table of
 contents</header><text>The table of contents of the Energy Policy and Conservation Act (42 U.S.C. prec. 6201) is amended by adding at the end of the items relating to part E of title III the following:</text>

 </subsection><subsection id="id855ade074d06462e9473e0bee7a0587d"><enum>(b)</enum><text>Sections 131, 132, 133, 2103, and 2107 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/6348">42 U.S.C. 6348</external-xref>, 6349, 6350, 13453, 13456) are repealed.</text>

						<section commented="no" display-inline="no-display-inline" id="idab57720b-b3ab-4cfd-840a-8f1a84885dcb" section-type="subsequent-section"><enum>324B.</enum><header display-inline="yes-display-inline">Supply Star Program</header>
 <subsection commented="no" display-inline="no-display-inline" id="id004eb43b-5c0b-49f9-b138-e5f0e0837624"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established within the Department of Energy a Supply Star program to identify and promote practices, recognize companies, and, as appropriate, recognize products that use highly efficient supply chains in a manner that conserves energy, water, and other resources.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="idb0ac8216-2672-4bd5-9afe-de2ee8f17d2c"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In carrying out the program described in subsection (a), the Secretary shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id61ce7626-ea3a-46e0-bcb9-8395bb3f664d"><enum>(1)</enum><text display-inline="yes-display-inline">consult with other appropriate agencies; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id011e69f8-7e3d-48fa-9634-e08fd8d2239b"><enum>(2)</enum><text display-inline="yes-display-inline">coordinate efforts with the Energy Star program established under section 324A.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id719e657d-8597-4c2b-b8de-8d83ad1e3274"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">In carrying out the Supply Star program described in subsection (a), the Secretary shall—</text>
 <paragraph commented="no" display-inline="no-display-inline" id="id545bee1b-71e3-4880-b227-7f39bc659c39"><enum>(1)</enum><text display-inline="yes-display-inline">promote practices, recognize companies, and, as appropriate, recognize products that comply with the Supply Star program as the preferred practices, companies, and products in the marketplace for maximizing supply chain efficiency;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57e5ca08-7382-4f0c-8cd3-943d6608f392"><enum>(2)</enum><text display-inline="yes-display-inline">work to enhance industry and public awareness of the Supply Star program;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80a4a7b2-4dea-4259-9fba-8d5865c1958b"><enum>(3)</enum><text display-inline="yes-display-inline">collect and disseminate data on supply chain energy resource consumption;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id988076ad-ab35-4d49-9bc6-162c1d7ff45f"><enum>(4)</enum><text display-inline="yes-display-inline">develop and disseminate metrics, processes, and analytical tools (including software) for evaluating supply chain energy resource use;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56b2b2f8-d21b-4f0f-ba6a-dded8aebeb93"><enum>(5)</enum><text display-inline="yes-display-inline">develop guidance at the sector level for improving supply chain efficiency;</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddae34c58-f49a-4931-96ec-2a80d8858e30"><enum>(6)</enum><text display-inline="yes-display-inline">work with domestic and international organizations to harmonize approaches to analyzing supply chain efficiency, including the development of a consistent set of tools, templates, calculators, and databases; and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c065b72-b625-4b0c-ac88-9ee5219fed67"><enum>(7)</enum><text display-inline="yes-display-inline">work with industry, including small businesses, to improve supply chain efficiency through activities that include—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idbb212c52-8bd8-4a4c-9836-c665b8982a1b"><enum>(A)</enum><text display-inline="yes-display-inline">developing and sharing best practices; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id803ee33e-776b-4e02-b6d4-a8a675ac77ff"><enum>(B)</enum><text display-inline="yes-display-inline">providing opportunities to benchmark supply chain efficiency.</text>
 </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id47ae3db6-1e0a-4dcc-b17a-4f5e543f8c44"><enum>(d)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">In any evaluation of supply chain efficiency carried out by the Secretary with respect to a specific product, the Secretary shall consider energy consumption and resource use throughout the entire lifecycle of a product, including production, transport, packaging, use, and disposal.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id2269634c-a050-46e7-8dcc-0bb603ebd3b5"><enum>(e)</enum><header display-inline="yes-display-inline">Grants and Incentives</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id1ef73a71-1cf2-413a-9a5c-94d1b52f0385"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may award grants or other forms of incentives on a competitive basis to eligible entities, as determined by the Secretary, for the purposes of—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id17f831e6-a2fe-403f-88c6-e82d60ef3a3d"><enum>(A)</enum><text display-inline="yes-display-inline">studying supply chain energy resource efficiency; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide159402e-b9bd-4dd2-8444-84d2eb55c7b2"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrating and achieving reductions in the energy resource consumption of commercial products through changes and improvements to the production supply and distribution chain of the products.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id321f1eab-f54d-4aee-9172-43d70018d5f6"><enum>(2)</enum><header display-inline="yes-display-inline">Use of information</header><text display-inline="yes-display-inline">Any information or data generated as a result of the grants or incentives described in paragraph (1) shall be used to inform the development of the Supply Star Program.</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb7947d4-de48-4a6f-8148-5ae0b48ed789"><enum>(f)</enum><header display-inline="yes-display-inline">Training</header><text display-inline="yes-display-inline">The Secretary shall use funds to support professional training programs to develop and communicate methods, practices, and tools for improving supply chain efficiency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id19769b74-1a2a-408f-a0d2-cc1dcb0c410e"><enum>(g)</enum><header>Effect of
 outsourcing of American jobs</header><text>For purposes of this section, the outsourcing of American jobs in the production of a product shall not count as a positive factor in determining supply chain efficiency.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id584a952e-9367-4601-bc4d-ec472a656cc2"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of
 Appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $10,000,000 for the period of fiscal years 2018 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="id875B3F03069248CB93D74419DA52AE97"><enum>C</enum><header>Extended product system
			 rebate program</header>
				<section id="idc4f49fbeec70447d942eee2b6b4fb18f"><enum>221.</enum><header>Extended product system  rebate
			 program</header>
 <subsection id="ida3759b44f33646feb26b57d50cbdf358"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id359a8cde1faf4691b2b3595f3bb4619e"><enum>(1)</enum><header>Electric motor</header><text>The term <term>electric motor</term> has the meaning given the term in section 431.12 of title 10, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text>
 </paragraph><paragraph id="id744d291170664020a36c404f59424239"><enum>(2)</enum><header>Electronic control</header><text>The term <term>electronic control</term> means—</text> <subparagraph commented="no" id="idAB9D9A7A02224C9EBEF976C893513195"><enum>(A)</enum><text>a power converter; or</text>
 </subparagraph><subparagraph commented="no" id="id72DA83BB8C034062832152490841C663"><enum>(B)</enum><text>a combination of a power circuit and control circuit included on 1 chassis.</text> </subparagraph></paragraph><paragraph id="id95c85dbec67243bcb1e257d388df22e5"><enum>(3)</enum><header>Extended product system</header><text>The term <term>extended product system</term> means an electric motor and any required associated electronic control and driven load that—</text>
 <subparagraph id="id38c3b88c2d8c4d93a18a7e5d8da24011"><enum>(A)</enum><text>offers variable speed or multispeed operation;</text> </subparagraph><subparagraph id="idf90282214bac49ef951b536a084c8952"><enum>(B)</enum><text>offers partial load control that reduces input energy requirements (as measured in kilowatt-hours) as compared to identified base levels set by the Secretary; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id427a8607dbf94985b0b1e27736de4eef"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idB02DF36FC1D545FBB34026350A4430EE"><enum>(i)</enum><text>has greater than 1 horsepower; and</text> </clause><clause commented="no" display-inline="no-display-inline" id="id703BF971BC354679A61B2DAEDFF1313F" indent="up1"><enum>(ii)</enum><text>uses an extended product system technology, as determined by the Secretary.</text>
								</clause></subparagraph></paragraph><paragraph id="id243bed89a8814bc9908a89e62851608a"><enum>(4)</enum><header>Qualified extended product system</header>
 <subparagraph id="idDB592B7557694EB888D20ABE09E6548E"><enum>(A)</enum><header>In general</header><text>The term <term>qualified extended product system</term> means an extended product system that—</text> <clause id="idd2ae415c6bda4f88b40f9c1c61aab74b"><enum>(i)</enum><text>includes an electric motor and an electronic control; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id3c369e937e954a8f84876ac2bf2189dd"><enum>(ii)</enum><text>reduces the input energy (as measured in kilowatt-hours) required to operate the extended product system by not less than 5 percent, as compared to identified base levels set by the Secretary.</text>
 </clause></subparagraph><subparagraph id="id7844463E2BC344DDAB92196AA4938DEF"><enum>(B)</enum><header>Inclusions</header><text>The term <term>qualified extended product system</term> includes commercial or industrial machinery or equipment that—</text> <clause id="id663E999900BF4C5EA1402D46949E41C6"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="idE7D56A2E56D3452294CC1AF8513F5C8F"><enum>(I)</enum><text>did not previously make use of the extended product system prior to the redesign described in subclause (II); and</text>
 </subclause><subclause id="idDC09FEE96DEA49BD8B77DC95C4B7E959" indent="up1"><enum>(II)</enum><text>incorporates an extended product system that has greater than 1 horsepower into redesigned machinery or equipment; and</text>
 </subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3d6695f5efb84bd1ac6b9018b24586a5"><enum>(ii)</enum><text>was previously used prior to, and was placed back into service during, calendar year 2019 or 2020.</text> </clause></subparagraph></paragraph></subsection><subsection id="ida79fbc4ac50e4b50917b081fa769787d"><enum>(b)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide rebates for expenditures made by qualified entities for the purchase or installation of a qualified extended product system.</text>
					</subsection><subsection id="idab7fadc146fc4d14a379766cf3a458e5"><enum>(c)</enum><header>Qualified entities</header>
 <paragraph id="id1D5E623BC36F49648C5E39FC7B8A565B"><enum>(1)</enum><header>Eligibility requirements</header><text>A qualified entity under this section shall be—</text> <subparagraph id="id2d3cf5fe596d4cf49844a82989a41af5"><enum>(A)</enum><text>in the case of a qualified extended product system described in subsection (a)(4)(A), the purchaser of the qualified extended product that is installed; and</text>
 </subparagraph><subparagraph id="id3794ecdf35e14c2dba9b9a1fb8e5daad"><enum>(B)</enum><text>in the case of a qualified extended product system described in subsection (a)(4)(B), the manufacturer of the commercial or industrial machinery or equipment that incorporated the extended product system into that machinery or equipment.</text>
 </subparagraph></paragraph><paragraph id="idaaae13d9cd1d4d809af746759001382c"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a rebate under this section, a qualified entity shall submit to the Secretary—</text>
 <subparagraph id="id77FDD32A97E34F7A93A2B1C1FB4249EE"><enum>(A)</enum><text>an application in such form, at such time, and containing such information as the Secretary may require; and</text>
 </subparagraph><subparagraph id="id58D9FF4D9D6C44F990C96611866AA45C"><enum>(B)</enum><text>a certification that includes demonstrated evidence—</text> <clause id="id609B5C7E34DF443F8F3CAB53CF962933"><enum>(i)</enum><text>that the entity is a qualified entity; and</text>
 </clause><clause id="id824a2a9ed90d4ea99f061e71440d6f01"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id138C1D55BC9346AF9B5EEA1D055A0E92"><enum>(I)</enum><text>in the case of a qualified entity described in paragraph (1)(A)—</text> <item id="idD34EBF4EF3E642C089574BFC10D2F272" indent="up1"><enum>(aa)</enum><text>that the qualified entity installed the qualified extended product system during the 2 fiscal years following the date of enactment of this Act;</text>
 </item><item id="id5A17B4A6806542C3BB262657F1DD659A" indent="up1"><enum>(bb)</enum><text>that the qualified extended product system meets the requirements of subsection (a)(4)(A); and</text> </item><item id="id488292FF7EEF45C8B77C5CACA99783D3" indent="up1"><enum>(cc)</enum><text>showing the serial number, manufacturer, and model number from the nameplate of the installed motor of the qualified entity on which the qualified extended product system was installed; or</text>
 </item></subclause><subclause id="idC788C1584065422996EAE012023785AA" indent="up1"><enum>(II)</enum><text>in the case of a qualified entity described in paragraph (1)(B), demonstrated evidence—</text> <item id="id08D3833205ED4DD79694B7FDC3C9A608"><enum>(aa)</enum><text>that the qualified extended product system meets the requirements of subsection (a)(4)(B); and</text>
 </item><item id="id1BFBC1E6FAC54F65ABD4EFEEAA9FD150"><enum>(bb)</enum><text>showing the serial number, manufacturer, and model number from the nameplate of the installed motor of the qualified entity with which the extended product system is integrated.</text>
										</item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id84be9e53c0d3485e9eaf066aef44a93f"><enum>(d)</enum><header>Authorized amount of rebate</header>
 <paragraph id="id36F15861CB4E43EE9F3D4F4B3F13A8DB"><enum>(1)</enum><header>In general</header><text>The Secretary may provide to a qualified entity a rebate in an amount equal to the product obtained by multiplying—</text>
 <subparagraph id="id20a3ed0f463441ad9a396e313e8b2b23"><enum>(A)</enum><text>an amount equal to the sum of the nameplate rated horsepower of—</text> <clause id="id05c78e90cf0047f49217f95729c1a3bc"><enum>(i)</enum><text>the electric motor to which the qualified extended product system is attached; and</text>
 </clause><clause id="id3e5053555af7487da723bb8ed652c1e5"><enum>(ii)</enum><text>the electronic control; and</text> </clause></subparagraph><subparagraph id="id0b1576983c9d4b7c8a942f51d9d85abe"><enum>(B)</enum><text>$25.</text>
 </subparagraph></paragraph><paragraph id="id82831a7e93674665a2a5cf59ab1ca22a"><enum>(2)</enum><header>Maximum aggregate amount</header><text>A qualified entity shall not be entitled to aggregate rebates under this section in excess of $25,000 per calendar year.</text>
 </paragraph></subsection><subsection id="idc5befc99c3aa4e73b32b7edefb884bfb"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each of the first 2 full fiscal years following the date of enactment of this Act, to remain available until expended.</text>
					</subsection></section></subtitle><subtitle id="idB3AC996769854AD291033008426DA064"><enum>D</enum><header>Transformer
			 rebate program</header>
				<section id="ID5edffc947adc4bac9f4ccaee49e852a9"><enum>231.</enum><header>Energy
			 efficient transformer rebate program</header>
 <subsection id="id1ab50467aed2401aa985ce9fceaab0ed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id30DB6564271D44C9A7D8032390A03776"><enum>(1)</enum><header>Qualified energy efficient transformer</header><text>The term <term>qualified energy efficient transformer</term> means a transformer that meets or exceeds the applicable energy conservation standards described in the tables in subsection (b)(2) and paragraphs (1) and (2) of subsection (c) of section 431.196 of title 10, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text>
 </paragraph><paragraph id="idb6cf0cdbd2b8451baf75a7e2ee430e5b"><enum>(2)</enum><header>Qualified energy inefficient transformer</header><text>The term <term>qualified energy inefficient transformer</term> means a transformer with an equal number of phases and capacity to a transformer described in any of the tables in subsection (b)(2) and paragraphs (1) and (2) of subsection (c) of section 431.196 of title 10, Code of Federal Regulations (as in effect on the date of enactment of this Act) that—</text>
 <subparagraph id="id4D4483E97F554CD8B244FAFDD9B614CB"><enum>(A)</enum><text>does not meet or exceed the applicable energy conservation standards described in paragraph (1); and</text>
 </subparagraph><subparagraph id="id635E8740E97F486D8AF17F5AFBC77EB9"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id388DC1354768459D963057CB326AAC78"><enum>(i)</enum><text>was manufactured between January 1, 1985, and December 31, 2006, for a transformer with an equal number of phases and capacity as a transformer described in the table in subsection (b)(2) of section 431.196 of title 10, Code of Federal Regulations (as in effect on the date of enactment of this Act); or</text>
 </clause><clause id="id14A57814E1A5410385DAE700D9A21340" indent="up1"><enum>(ii)</enum><text>was manufactured between January 1, 1990, and December 31, 2009, for a transformer with an equal number of phases and capacity as a transformer described in the table in paragraph (1) or (2) of subsection (c) of that section (as in effect on the date of enactment of this Act).</text>
 </clause></subparagraph></paragraph><paragraph id="id9C9BD4AEC84A4962B1313B3D62AF43B3"><enum>(3)</enum><header>Qualified entity</header><text>The term <term>qualified entity</term> means an owner of industrial or manufacturing facilities, commercial buildings, or multifamily residential buildings, a utility, or an energy service company that fulfills the requirements of subsection (d).</text>
 </paragraph></subsection><subsection id="id48ab82ada6294b09bd13499dc4c8f6d8"><enum>(b)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish a program to provide rebates to qualified entities for expenditures made by the qualified entity for the replacement of a qualified energy inefficient transformer with a qualified energy efficient transformer.</text>
 </subsection><subsection id="id8e110577c7bc42c1b40c9ba80b93ca31"><enum>(c)</enum><header>Requirements</header><text>To be eligible to receive a rebate under this section, an entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary may require, including demonstrated evidence—</text>
 <paragraph id="id8dbb6d0c431f4b4590f250349bd6a366"><enum>(1)</enum><text>that the entity purchased a qualified energy efficient transformer;</text> </paragraph><paragraph id="id58c80bd37842475e8d91b2963a486d7b"><enum>(2)</enum><text>of the core loss value of the qualified energy efficient transformer;</text>
 </paragraph><paragraph id="id99d5182681484f3c87d3a9e5686eb342"><enum>(3)</enum><text>of the age of the qualified energy inefficient transformer being replaced;</text> </paragraph><paragraph id="id1cd975928f7543e1a48011d15e8640b0"><enum>(4)</enum><text>of the core loss value of the qualified energy inefficient transformer being replaced—</text>
 <subparagraph id="idac7590dcdf0c467e820bba153b95c6fe"><enum>(A)</enum><text>as measured by a qualified professional or verified by the equipment manufacturer, as applicable; or</text>
 </subparagraph><subparagraph id="id4c3953d58b764d4bae24d4df1a897049"><enum>(B)</enum><text>for transformers described in subsection (a)(2)(B)(i), as selected from a table of default values as determined by the Secretary in consultation with applicable industry; and</text>
 </subparagraph></paragraph><paragraph id="id78bc268abab74c26af0bb64ecca0c04e"><enum>(5)</enum><text>that the qualified energy inefficient transformer has been permanently decommissioned and scrapped.</text>
 </paragraph></subsection><subsection id="id4c0a293753bb45a0b6e9d0ba70c0a63a"><enum>(d)</enum><header>Authorized amount of rebate</header><text>The amount of a rebate provided under this section shall be—</text> <paragraph id="id0b03a96708a4474c8b9367126ec732d9"><enum>(1)</enum><text>for a 3-phase or single-phase transformer with a capacity of not less than 10 and not greater than 2,500 kilovolt-amperes, twice the amount equal to the difference in Watts between the core loss value (as measured in accordance with paragraphs (2) and (4) of subsection (c)) of—</text>
 <subparagraph id="idF68E588D35434C248E97C67A80B26ACD"><enum>(A)</enum><text>the qualified energy inefficient transformer; and</text>
 </subparagraph><subparagraph id="id2FF1C3165D694126A72D09D6D1F69B3F"><enum>(B)</enum><text>the qualified energy efficient transformer; or</text> </subparagraph></paragraph><paragraph id="id096a93f60f8a488c9e7e3370114f30ac"><enum>(2)</enum><text>for a transformer described in subsection (a)(2)(B)(i), the amount determined using a table of default rebate values by rated transformer output, as measured in kilovolt-amperes, as determined by the Secretary in consultation with applicable industry.</text>
 </paragraph></subsection><subsection id="id7718aefc786a4d1cb8aa681546397ec5"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2018 and 2019, to remain available until expended.</text>
 </subsection><subsection id="idab3d618b483842b9b4ae7c6c2ddc4212"><enum>(f)</enum><header>Termination of effectiveness</header><text>The authority provided by this section terminates on December 31, 2019.</text> </subsection></section></subtitle></title><title id="id17f322dd969b428babbad417963217db"><enum>III</enum><header>Federal agency energy efficiency</header> <section id="HB41A3F92FB544F639465E10EB5EFA41B" section-type="subsequent-section"><enum>301.</enum><header>Energy-efficient and energy-saving information technologies</header><text display-inline="no-display-inline">Section 543 of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253</external-xref>) is amended—</text>
 <paragraph id="H6B30E2C17C914D509A51E74C47E6D3E1"><enum>(1)</enum><text>by redesignating the second subsection (f) (relating to large capital energy investments) as subsection (g); and</text>
 </paragraph><paragraph id="H0970C542EDAB42FA94003B5EA6BF06A2"><enum>(2)</enum><text>by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H2AE77878B55E47DAB58CFBFACAB47999" style="OLC">
						<subsection id="H6F9D83D12C694145A985231EBB951462"><enum>(h)</enum><header>Federal
		  Implementation Strategy for Energy-Efficient and Energy-Saving Information

 <paragraph id="idBC781E05AE154E19973C96C4CFC6C999"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
 <subparagraph id="id453886EB4C984398AF190B4C2A944368"><enum>(A)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Office of Management and Budget.</text>
								</subparagraph><subparagraph id="idD706C77AB7764E548D7A2F6BF214AA1E"><enum>(B)</enum><header>Information
 technology</header><text>The term <quote>information technology</quote> has the meaning given the term in section 11101 of title 40, United States Code.</text>
								</subparagraph></paragraph><paragraph id="HFC3270BD98404BCCB8590B8ADA7792E5"><enum>(2)</enum><header>Development of
 implementation strategy</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subsection, each Federal agency shall collaborate with the Director to develop an implementation strategy (including best-practices and measurement and verification techniques) for the maintenance, purchase, and use by the Federal agency of energy-efficient and energy-saving information technologies.</text>
 </paragraph><paragraph id="HA0C713B46F2540FBA32B3787BC307135"><enum>(3)</enum><header>Administration</header><text>In developing an implementation strategy, each Federal agency shall consider—</text>
 <subparagraph id="HF60A3489E55C4580BE38FA0C40A1D388"><enum>(A)</enum><text>advanced metering infrastructure;</text>
 </subparagraph><subparagraph id="HED3EB773074340B2B6C104B54CC8BFC4"><enum>(B)</enum><text display-inline="yes-display-inline">energy efficient data center strategies and methods of increasing asset and infrastructure utilization;</text>
 </subparagraph><subparagraph id="H77356C64816A4BF6B1B0E589E5A1D538"><enum>(C)</enum><text display-inline="yes-display-inline">advanced power management tools;</text> </subparagraph><subparagraph id="H849AF64C3AA24354B82E7C4F0A89F5C8"><enum>(D)</enum><text display-inline="yes-display-inline">building information modeling, including building energy management; and</text>
 </subparagraph><subparagraph id="H4555BE2AA5A54B2A8FFDC46F2A3AAFEB"><enum>(E)</enum><text display-inline="yes-display-inline">secure telework and travel substitution tools.</text>
								</subparagraph></paragraph><paragraph id="HC722BFD504FD48A38E5B7CA178FA2296"><enum>(4)</enum><header>Performance
		  goals</header>
								<subparagraph id="H9F574BC71A2A466395B31E3D722F3E68"><enum>(A)</enum><header>In
 general</header><text display-inline="yes-display-inline">Not later than September 30, 2017, the Director, in consultation with the Secretary, shall establish performance goals for evaluating the efforts of Federal agencies in improving the maintenance, purchase, and use of energy-efficient and energy-saving information technology systems.</text>
								</subparagraph><subparagraph id="idd2603fd2a0c74f17904aaa6f5c3da9f0"><enum>(B)</enum><header>Best
 practices</header><text>The Chief Information Officers Council established under section 3603 of title 44, United States Code, shall supplement the performance goals established under this paragraph with recommendations on best practices for the attainment of the performance goals, to include a requirement for agencies to consider the use of—</text>
 <clause id="id7916A8499F59461AAE540F883F54DC44"><enum>(i)</enum><text>energy savings performance contracting; and</text>
 </clause><clause id="idBA57FC160F1D4222A0822CF5181D86E8"><enum>(ii)</enum><text>utility energy services contracting.</text>
									</clause></subparagraph></paragraph><paragraph id="H7F82F7F72A6A47CAA0B7E7CC094D20C4"><enum>(5)</enum><header>Reports</header>
								<subparagraph id="HD6DDBADB60B04FBFB4F774D4172B11AD"><enum>(A)</enum><header>Agency
 reports</header><text>Each Federal agency subject to the requirements of this subsection shall include in the report of the agency under section 527 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17143">42 U.S.C. 17143</external-xref>) a description of the efforts and results of the agency under this subsection.</text>
								</subparagraph><subparagraph id="H37A0CBF176CC4CE98EE39DBD5A4F415C"><enum>(B)</enum><header>OMB Government
 efficiency reports and scorecards</header><text>Effective beginning not later than October 1, 2017, the Director shall include in the annual report and scorecard of the Director required under section 528 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17144">42 U.S.C. 17144</external-xref>) a description of the efforts and results of Federal agencies under this subsection.</text>
								</subparagraph><subparagraph id="id87d8f6fc995b42f8aaf9df40a12dc320"><enum>(C)</enum><header>Use of existing
 reporting structures</header><text>The Director may require Federal agencies to submit any information required to be submitted under this subsection though reporting structures in use as of the date of enactment of the Energy Savings and Industrial Competitiveness Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="HC29CF19AB53C454AA6959A60CB8BC6B1"><enum>302.</enum><header>Energy
 efficient data centers</header><text display-inline="no-display-inline">Section 453 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17112">42 U.S.C. 17112</external-xref>) is amended—</text> <paragraph id="id8f013b0dcd9549c89e6b952c309e2cde"><enum>(1)</enum><text>in subsection (b)—</text>
 <subparagraph id="ida18800d584f74756b01bc15184d7c45a"><enum>(A)</enum><text>in paragraph (2)(D)(iv), by striking <quote>the organization</quote> and inserting <quote>an organization</quote>; and</text> </subparagraph><subparagraph id="ida30d7430a25347fab6ac3b8f4e845214"><enum>(B)</enum><text>by striking paragraph (3); and</text>
 </subparagraph></paragraph><paragraph id="idbead42b2cd584933bcce3825c977997c"><enum>(2)</enum><text>by striking subsections (c) through (g) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id3A86E82F267C4634BB14F6668B2BE2E5" style="OLC"> <subsection id="idf5b5cfd1386843ee8c763dd2a7879463"><enum>(c)</enum><header>Stakeholder involvement</header> <paragraph id="idD3E95592F9C44E4C953B29A1AA04E06C"><enum>(1)</enum><header>In general</header><text>The Secretary and the Administrator shall carry out subsection (b) in consultation with the information technology industry and other key stakeholders, with the goal of producing results that accurately reflect the best knowledge in the most pertinent domains.</text>
 </paragraph><paragraph id="id978921827EEB4D4EA8814DA5E3D6C5E8"><enum>(2)</enum><header>Considerations</header><text>In carrying out consultation described in paragraph (1), the Secretary and the Administrator shall pay particular attention to organizations that—</text>
 <subparagraph id="id85c7073931f744b2814f3b6692488267"><enum>(A)</enum><text>have members with expertise in energy efficiency and in the development, operation, and functionality of data centers, information technology equipment, and software, including representatives of hardware manufacturers, data center operators, and facility managers;</text>
 </subparagraph><subparagraph id="idd03b455b17774829ae16d0263a766a91"><enum>(B)</enum><text>obtain and address input from the National Laboratories (as that term is defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>)) or any institution of higher education, research institution, industry association, company, or public interest group with applicable expertise;</text>
 </subparagraph><subparagraph id="idad935675c3d64cf3983ac30424aedcd3"><enum>(C)</enum><text>follow—</text> <clause id="id39de43687d9d44a69f883593a0ac5c95"><enum>(i)</enum><text>commonly accepted procedures for the development of specifications; and</text>
 </clause><clause id="ide1bb8b1d5164439a99758e31420a4ec1"><enum>(ii)</enum><text>accredited standards development processes; or</text> </clause></subparagraph><subparagraph id="idd0f6cbfce341494e9bf72073c4ea9b81"><enum>(D)</enum><text>have a mission to promote energy efficiency for data centers and information technology.</text>
 </subparagraph></paragraph></subsection><subsection id="id82257f8563ac42c089795d5c401e546e"><enum>(d)</enum><header>Measurements and specifications</header><text>The Secretary and the Administrator shall consider and assess the adequacy of the specifications, measurements, and benchmarks described in subsection (b) for use by the Federal Energy Management Program, the Energy Star Program, and other efficiency programs of the Department of Energy or the Environmental Protection Agency.</text>
 </subsection><subsection id="id5f8fc598bcff49a192b22fe6b386b88c"><enum>(e)</enum><header>Study</header><text>The Secretary, in consultation with the Administrator, not later than 18 months after the date of enactment of the Energy Savings and Industrial Competitiveness Act, shall make available to the public an update to the report submitted to Congress pursuant to section 1 of the Act of December 20, 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/431">Public Law 109–431</external-xref>; 120 Stat. 2920), entitled <quote>Report to Congress on Server and Data Center Energy Efficiency</quote> and dated August 2, 2007, that provides—</text>
 <paragraph id="idefe231007bce4b53932f2bbf4e249ff3"><enum>(1)</enum><text>a comparison and gap analysis of the estimates and projections contained in the original report with new data regarding the period from 2007 through 2016;</text>
 </paragraph><paragraph id="ida51b4cb131e4438eadbfff6825823d2d"><enum>(2)</enum><text>an analysis considering the impact of information technologies, including virtualization and cloud computing, in the public and private sectors;</text>
 </paragraph><paragraph id="ide5ba947cac94480384ec613200853093"><enum>(3)</enum><text>an evaluation of the impact of the combination of cloud platforms, mobile devices, social media, and big data on data center energy usage; and</text>
 </paragraph><paragraph id="id9cc7cf7246674aa2968ca4460efaa69c"><enum>(4)</enum><text>updated projections and recommendations for best practices through fiscal year 2022.</text> </paragraph></subsection><subsection id="id01eefb77bbbf4737b35cafc057d61d41"><enum>(f)</enum><header>Data center energy practitioner program</header> <paragraph id="id8FDA731080AF4E91A799EFF49120898B"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with key stakeholders and the Director of the Office of Management and Budget, shall maintain a data center energy practitioner program that provides for the certification of energy practitioners qualified to evaluate the energy usage and efficiency opportunities in Federal data centers.</text>
 </paragraph><paragraph id="id8BB5C57210A946CB84D01FECE84625E5"><enum>(2)</enum><header>Evaluations</header><text>Each Federal agency shall consider having the data centers of the agency evaluated once every 4 years by energy practitioners certified pursuant to the program, whenever practicable using certified practitioners employed by the agency.</text>
							</paragraph></subsection><subsection id="id3692b67c14394f9fbe6e1b3773fb8475"><enum>(g)</enum><header>Open data initiative</header>
 <paragraph id="id1ACE6759EDB646B1835F6D1900406627"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with key stakeholders and the Director of the Office of Management and Budget, shall establish an open data initiative for Federal data center energy usage data, with the purpose of making the data available and accessible in a manner that encourages further data center innovation, optimization, and consolidation.</text>
 </paragraph><paragraph id="idF2688A31E7314FE893B0629323646B4E"><enum>(2)</enum><header>Consideration</header><text>In establishing the initiative under paragraph (1), the Secretary shall consider using the online Data Center Maturity Model.</text>
 </paragraph></subsection><subsection id="idf6e962d13442411c806d349454f52f30"><enum>(h)</enum><header>International specifications and metrics</header><text>The Secretary, in consultation with key stakeholders, shall actively participate in efforts to harmonize global specifications and metrics for data center energy efficiency.</text>
 </subsection><subsection id="id76fceebe08c44608b27efa1f1b87070b"><enum>(i)</enum><header>Data center utilization metric</header><text>The Secretary, in collaboration with key stakeholders, shall facilitate in the development of an efficiency metric that measures the energy efficiency of a data center (including equipment and facilities).</text>
 </subsection><subsection id="id30fd0d06532e41efaf9dc81ebc09e421"><enum>(j)</enum><header>Protection of proprietary information</header><text>The Secretary and the Administrator shall not disclose any proprietary information or trade secrets provided by any individual or company for the purposes of carrying out this section or the programs and initiatives established under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="idC1CD96AA120C46E7A875EABFC9B573B5"><enum>303.</enum><header>Budget-neutral
		demonstration program for energy and water conservation improvements at
		multifamily residential units</header>
 <subsection id="id22FAC99C7058406EB5EC6245E0379B8B"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Housing and Urban Development (referred to in this section as the <term>Secretary</term>) shall establish a demonstration program under which, during the period beginning on the date of enactment of this Act, and ending on September 30, 2020, the Secretary may enter into budget-neutral, performance-based agreements that result in a reduction in energy or water costs with such entities as the Secretary determines to be appropriate under which the entities shall carry out projects for energy or water conservation improvements at not more than 20,000 residential units in multifamily buildings participating in—</text>
 <paragraph id="id97FB00F968404638AE19796433B181D3"><enum>(1)</enum><text>the project-based rental assistance program under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>), other than assistance provided under section 8(o) of that Act;</text>
 </paragraph><paragraph id="idEDA30D76C65D4B41900694D2BF77AC6B"><enum>(2)</enum><text>the supportive housing for the elderly program under section 202 of the Housing Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701q">12 U.S.C. 1701q</external-xref>); or</text>
 </paragraph><paragraph id="id17823635AF08475E9FAF710B8BBB3C58"><enum>(3)</enum><text>the supportive housing for persons with disabilities program under section 811(d)(2) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013(d)(2)</external-xref>).</text>
					</paragraph></subsection><subsection id="idEFC353C9B640410380917B11C7537FEE"><enum>(b)</enum><header>Requirements</header>
					<paragraph id="idA74A5E5EA72B42FABA498CC1F8B881EB"><enum>(1)</enum><header>Payments
		contingent on savings</header>
						<subparagraph id="idB3B96150E580410D9507EBAF080E138F"><enum>(A)</enum><header>In
 general</header><text>The Secretary shall provide to an entity a payment under an agreement under this section only during applicable years for which an energy or water cost savings is achieved with respect to the applicable multifamily portfolio of properties, as determined by the Secretary, in accordance with subparagraph (B).</text>
						</subparagraph><subparagraph id="id6F1FB5AA47494C13A72DE10B83BCF877"><enum>(B)</enum><header>Payment
		methodology</header>
							<clause id="id18D648FF0FEB4991BBEEE57FACBF78AF"><enum>(i)</enum><header>In
 general</header><text>Each agreement under this section shall include a pay-for-success provision—</text>
 <subclause id="idF87E8653A1F142CB9EF3051D6393EAF8"><enum>(I)</enum><text>that will serve as a payment threshold for the term of the agreement; and</text>
 </subclause><subclause id="id298294CFEF9F41A384C0BE57EFDD145A"><enum>(II)</enum><text>pursuant to which the Department of Housing and Urban Development shall share a percentage of the savings at a level determined by the Secretary that is sufficient to cover the administrative costs of carrying out this section.</text>
 </subclause></clause><clause id="idCF581D9F8C004BAAAAB2A55BA478B2B8"><enum>(ii)</enum><header>Limitations</header><text>A payment made by the Secretary under an agreement under this section shall—</text>
 <subclause id="id61F8FB0D9E8A43319A5BB2A1BF836230"><enum>(I)</enum><text>be contingent on documented utility savings; and</text>
 </subclause><subclause id="id8A079664267E49DFABE960FA39CD22FC"><enum>(II)</enum><text>not exceed the utility savings achieved by the date of the payment, and not previously paid, as a result of the improvements made under the agreement.</text>
								</subclause></clause></subparagraph><subparagraph id="idcb1ecf63ff514fa9b6c395a9b87e3ede"><enum>(C)</enum><header>Third-party
 verification</header><text>Savings payments made by the Secretary under this section shall be based on a measurement and verification protocol that includes at least—</text>
 <clause id="idef1d2ec50fa84d86a4ae3e2406566fe1"><enum>(i)</enum><text>establishment of a weather-normalized and occupancy-normalized utility consumption baseline established preretrofit;</text>
 </clause><clause id="id1030982336834d20b77f724f53533f1d"><enum>(ii)</enum><text>annual third-party confirmation of actual utility consumption and cost for owner-paid utilities;</text>
 </clause><clause id="id2f525efaa94e466485d963b3009c333b"><enum>(iii)</enum><text>annual third-party validation of the tenant utility allowances in effect during the applicable year and vacancy rates for each unit type; and</text>
 </clause><clause id="idd5497be9dbf4497b835140df647cac4b"><enum>(iv)</enum><text>annual third-party determination of savings to the Secretary.</text>
 </clause></subparagraph></paragraph><paragraph id="id80969AD187AB42D49DE434FD056EC48F"><enum>(2)</enum><header>Term</header><text>The term of an agreement under this section shall be not longer than 12 years.</text>
					</paragraph><paragraph id="idfa25a1ae28174621898f838b360f2c1e"><enum>(3)</enum><header>Entity
 eligibility</header><text>The Secretary shall—</text> <subparagraph id="idD37C112229EC402AABE8D3C25E73B7F8"><enum>(A)</enum><text>establish a competitive process for entering into agreements under this section; and</text>
 </subparagraph><subparagraph id="idD36F8012A9D4419FA7DE69B328EB46F5"><enum>(B)</enum><text>enter into such agreements only with entities that demonstrate significant experience relating to—</text>
 <clause id="id1314520282154977b1c8db96bd002ad3"><enum>(i)</enum><text>financing and operating properties receiving assistance under a program described in subsection (a);</text>
 </clause><clause id="idb01e94076d814d13a63bd7e5ebf43fb3"><enum>(ii)</enum><text>oversight of energy and water conservation programs, including oversight of contractors; and</text>
 </clause><clause id="id50a92723426e4c4eaf9e6a0ba7f45ec3"><enum>(iii)</enum><text>raising capital for energy and water conservation improvements from charitable organizations or private investors.</text>
							</clause></subparagraph></paragraph><paragraph id="id24c0dc32ef544e1ca27578bb5ded247c"><enum>(4)</enum><header>Geographical
 diversity</header><text>Each agreement entered into under this section shall provide for the inclusion of properties with the greatest feasible regional and State variance.</text>
					</paragraph></subsection><subsection id="id33605802DCC142CC997C45B34D34240E"><enum>(c)</enum><header>Plan and
		reports</header>
 <paragraph id="id3F2752764993460284C29B7B85E40E3B"><enum>(1)</enum><header>Plan</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate a detailed plan for the implementation of this section.</text>
 </paragraph><paragraph id="id73A9A824803E4684930FE60D824094BD"><enum>(2)</enum><header>Reports</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall—</text>
 <subparagraph id="idF29CB22D1E7A4DA8AA0E0E3006B99702"><enum>(A)</enum><text>conduct an evaluation of the program under this section; and</text>
 </subparagraph><subparagraph id="idC9563009166046E5B0CE7FC9743D652A"><enum>(B)</enum><text>submit to Congress a report describing each evaluation conducted under subparagraph (A).</text>
 </subparagraph></paragraph></subsection><subsection id="idC9ADE5699F8849F487DCCE4FADCC880D"><enum>(d)</enum><header>Funding</header><text>For each fiscal year during which an agreement under this section is in effect, the Secretary may use to carry out this section any funds appropriated to the Secretary for the renewal of contracts under a program described in subsection (a).</text>
				</subsection></section></title><title id="id5C1D384B741440858A3C34944FCE52A4" style="OLC"><enum>IV</enum><header>Regulatory provisions</header>
			<subtitle id="id52D4CE2BA5EC4082A21EA15622BAECA1" style="OLC"><enum>A</enum><header>Third-Party
		Certification Under Energy Star Program</header>
				<section id="id6B677A22B8C14381A2E708116AB88317"><enum>401.</enum><header>Third-Party
 Certification Under Energy Star Program</header><text display-inline="no-display-inline">Section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8838353FBF4A4E3E8D26FC022E469ED1" style="OLC">
						<subsection id="idCC6FC0740E4C417AB23E5E02946C7E21"><enum>(e)</enum><header>Third-Party
		  Certification</header>
							<paragraph id="id73c89c52d1ad4f64a178c1e08ea51bbc"><enum>(1)</enum><header>In
 general</header><text>Subject to paragraph (2), not later than 180 days after the date of enactment of this subsection, the Administrator shall revise the certification requirements for the labeling of consumer, home, and office electronic products for program partners that have complied with all requirements of the Energy Star program for a period of at least 18 months.</text>
 </paragraph><paragraph id="id5F912CEF96434B09A99EFEE15563A7F8"><enum>(2)</enum><header>Administration</header><text>In the case of a program partner described in paragraph (1), the new requirements under paragraph (1)—</text>
 <subparagraph id="idBE19F2E928A84E5387E5D43CA6A99FA5"><enum>(A)</enum><text>shall not require third-party certification for a product to be listed; but</text>
 </subparagraph><subparagraph id="idAD7F287AF5DE403B9021D2530BDE28FD"><enum>(B)</enum><text>may require that test data and other product information be submitted to facilitate product listing and performance verification for a sample of products.</text>
								</subparagraph></paragraph><paragraph id="idE6FD67F86D4542199A20E692535173F0"><enum>(3)</enum><header>Third
 parties</header><text>Nothing in this subsection prevents the Administrator from using third parties in the course of the administration of the Energy Star program.</text>
							</paragraph><paragraph id="id338eda5c94a14312b14e49778930a63e"><enum>(4)</enum><header>Termination</header>
								<subparagraph id="id79491197F6014512B9667382D3019232"><enum>(A)</enum><header>In
 general</header><text>Subject to subparagraph (B), an exemption from third-party certification provided to a program partner under paragraph (1) shall terminate if the program partner is found to have violated program requirements with respect to at least 2 separate models during a 2-year period.</text>
 </subparagraph><subparagraph id="idA144582EF8524933A26EEC9CE8EBDBDF"><enum>(B)</enum><header>Resumption</header><text>A termination for a program partner under subparagraph (A) shall cease if the program partner complies with all Energy Star program requirements for a period of at least 3 years.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section></subtitle><subtitle id="idA89CDB5FC3E141AEA1299F5D8748D276" style="OLC"><enum>B</enum><header>Federal green buildings</header>
				<section id="id6d50493c4eeb42c2bde3406b2f568815"><enum>411.</enum><header>High-performance
 green Federal buildings</header><text display-inline="no-display-inline">Section 436(h) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17092">42 U.S.C. 17092(h)</external-xref>) is amended—</text>
 <paragraph id="id6A6D861A3C2B4F468E49B677E8CBE00E"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">system</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">systems</header-in-text></quote>;</text>
 </paragraph><paragraph id="id4B69B399B5E84A58B82B376916C4EB83"><enum>(2)</enum><text>by striking paragraph (1) and inserting the following:</text>

		performance requirement for Federal buildings</header>
				<section id="id95083A0966DE4CBE8D5799FDE9EC1199"><enum>421.</enum><header>Energy
 performance requirement for Federal buildings</header><text display-inline="no-display-inline">Section 543 of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8253">42 U.S.C. 8253</external-xref>) is amended—</text>
 <paragraph id="id3ADC187B4BE94CF4BCF1AC5D38C57711"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text>

		  performance requirement for Federal buildings</header>

									<subparagraph id="id226337D3D9A34974949E06AF9087CCE4"><enum>(A)</enum><header>In
 general</header><text>An agency may exclude from the requirements of paragraph (1) any building (including the associated energy consumption and gross square footage) in which energy intensive activities are carried out.</text>
 </subparagraph><subparagraph id="id9C5CADFE1A5C40BFB3B7BD56801AAF89"><enum>(B)</enum><header>Reports</header><text>Each agency shall identify and list in each report made under section 548(a) the buildings designated by the agency for exclusion under subparagraph (A).</text>
 </subparagraph></paragraph><paragraph id="id7551123e84c4492ab4d67c4632573e71"><enum>(3)</enum><header>Review</header><text>Not later than December 31, 2017, the Secretary shall—</text>
 <subparagraph id="idF7931F44E2E9471283F3E24A0D173A84"><enum>(A)</enum><text>review the results of the implementation of the energy performance requirements established under paragraph (1); and</text>
 </subparagraph><subparagraph id="idB87762114F164A06B4AC063DF416A675"><enum>(B)</enum><text>based on the review conducted under subparagraph (A), submit to Congress a report that addresses the feasibility of requiring each agency to apply energy conservation measures to, and improve the design for the construction of, the Federal buildings of the agency (including each industrial or laboratory facility) so that the energy consumption per gross square foot of the Federal buildings of the agency in each of fiscal years 2018 through 2030 is reduced, as compared with the energy consumption per gross square foot of the Federal buildings of the agency in the prior fiscal year, by 3 percent.</text></subparagraph></paragraph></subsection><after-quoted-block>;
		  and</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id2D5DB929E90F40F3B79AF933089B0C74"><enum>(2)</enum><text>in subsection (f)—</text>
 <subparagraph id="idBB371CEDE80D41E49EA392A8BF0FA8BE"><enum>(A)</enum><text>in paragraph (1)—</text>
 <clause id="id8FFD4EA9F7714289B6651B1CEB01AEC5"><enum>(i)</enum><text>by redesignating subparagraphs (E), (F), and (G) as subparagraphs (F), (G), and (H), respectively; and</text>
 </clause><clause id="id5F515FEBB52C426CA673C9CB01104138"><enum>(ii)</enum><text>by inserting after subparagraph (D) the following:</text>

									<subparagraph id="ide3438898275f46ea97f0e26a9c185922"><enum>(E)</enum><header>Ongoing
 commissioning</header><text>The term <term>ongoing commissioning</term> means an ongoing process of commissioning using monitored data, the primary goal of which is to ensure continuous optimum performance of a facility, in accordance with design or operating needs, over the useful life of the facility, while meeting facility occupancy requirements.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </clause></subparagraph><subparagraph id="id013770BF29EE4735B036C5646933B22B"><enum>(B)</enum><text>in paragraph (2), by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idA44E56FEBF2744E7AE1F1D7C6177AA9F" style="OLC">
								<subparagraph id="iddb093d8ae4234552b635c0aaa560a3f2"><enum>(C)</enum><header>Energy
 management system</header><text>An energy manager designated under subparagraph (A) shall consider use of a system to manage energy use at the facility and certification of the facility in accordance with the International Organization for Standardization standard numbered 50001 and entitled <quote>Energy Management Systems</quote>.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idEBEA2086EBDA4297924FF315643507C6"><enum>(C)</enum><text>by striking paragraphs (3) and (4) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="idCD04FD1B9328420892C740D296BDDFAC" style="OLC">
								<paragraph id="id9b8c2ba8e3044d4f90d52e38b22be130"><enum>(3)</enum><header>Energy and
		  water evaluations and commissioning</header>
 <subparagraph id="id5849117a6fc54bbbbb91ea7dbe2a4a21"><enum>(A)</enum><header>Evaluations</header><text>Except as provided in subparagraph (B), effective beginning on the date that is 180 days after the date of enactment of the Energy Savings and Industrial Competitiveness Act, and annually thereafter, each energy manager shall complete, for each calendar year, a comprehensive energy and water evaluation and recommissioning or retrocommissioning for approximately 25 percent of the facilities of each agency that meet the criteria under paragraph (2)(B) in a manner that ensures that an evaluation of each facility is completed at least once every 4 years.</text>
 </subparagraph><subparagraph id="id0e11a77d6f8b41f4973f02a1e36ed43f"><enum>(B)</enum><header>Exceptions</header><text>An evaluation and recommissioning shall not be required under subparagraph (A) with respect to a facility that—</text>
 <clause id="id9046d4f24c8e4e258794aeb34c70f50b"><enum>(i)</enum><text>has had a comprehensive energy and water evaluation during the 8-year period preceding the date of the evaluation;</text>
 </clause><clause id="id9f85ac7e46ab436183b21b8b049bf5b4"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id9B0862D558394B74BF598445D38A44AC"><enum>(I)</enum><text>has been commissioned, recommissioned, or retrocommissioned during the 10-year period preceding the date of the evaluation; or</text>
 </subclause><subclause id="id2ABFF800885441638AD6D814C20B741C" indent="up1"><enum>(II)</enum><text>is under ongoing commissioning;</text> </subclause></clause><clause id="idae0eb911a86443129289ebee3d935810"><enum>(iii)</enum><text>has not had a major change in function or use since the previous evaluation and commissioning;</text>
 </clause><clause id="id0431d0644e96429fa14640979643e3b5"><enum>(iv)</enum><text>has been benchmarked with public disclosure under paragraph (8) within the year preceding the evaluation; and</text>
 </clause><clause id="id2ccb02a814644c85a2f9a6fe2c2d5692"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="idD0221B3C88714299B72C21F4546E4DAE"><enum>(I)</enum><text>based on the benchmarking, has achieved at a facility level the most recent cumulative energy savings target under subsection (a) compared to the earlier of—</text>
 <item id="id5877B8D8B5BA445CBFA402588C7E3614" indent="up1"><enum>(aa)</enum><text>the date of the most recent evaluation; or</text>
 </item><item id="idBC24EF1563DF415EAF250DC6D4234A4F" indent="up1"><enum>(bb)</enum><text>the date—</text> <subitem id="id09DA14933CE14CF3BCFF82B90725F915"><enum>(AA)</enum><text>of the most recent commissioning, recommissioning, or retrocommissioning; or</text>
 </subitem><subitem id="id1F20BF9123A44943B8AA883424974551"><enum>(BB)</enum><text>on which ongoing commissioning began; or</text>
 </subitem></item></subclause><subclause id="idFBA852C61DB147E88CDAEED8144435CC" indent="up1"><enum>(II)</enum><text>has a long-term contract in place guaranteeing energy savings at least as great as the energy savings target under subclause (I).</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="id97a4804537c84e3f8b63dc5991669dbd"><enum>(4)</enum><header>Implementation
		  of identified energy and water efficiency measures</header>
									<subparagraph id="idcb911dc4c1234578b83f126605781ec1"><enum>(A)</enum><header>In
 general</header><text>Not later than 2 years after the date of completion of each evaluation under paragraph (3), each energy manager may—</text>
 <clause id="idf2349b925bcb4fce8ce0420c9ebc25c0"><enum>(i)</enum><text>implement any energy- or water-saving measure that the Federal agency identified in the evaluation conducted under paragraph (3) that is life-cycle cost effective; and</text>
 </clause><clause id="id0d3e4a4c23f247b5b46aff913160cbad"><enum>(ii)</enum><text>bundle individual measures of varying paybacks together into combined projects.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4a43451ef8e495990209cd57a613a75"><enum>(B)</enum><header>Measures not
 implemented</header><text>The energy manager shall, as part of the certification system under paragraph (7), explain the reasons why any life-cycle cost effective measures were not implemented under subparagraph (A) using guidelines developed by the Secretary.</text></subparagraph></paragraph><after-quoted-block>;
		  and</after-quoted-block></quoted-block>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id35D3718FEE8D4CD395993EA6C53CF4B6"><enum>(D)</enum><text>in paragraph (7)(C), by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id2D49F6B8646B4C2C9F2D6A68554409A8" style="OLC">
								<clause id="id861f875c5472427fb5e5257466117c78"><enum>(iii)</enum><header>Summary
 report</header><text>The Secretary shall make available a report that summarizes the information tracked under subparagraph (B)(i) by each agency and, as applicable, by each type of measure.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></section><section id="id501E64E203C544A386474D4882EC2775"><enum>422.</enum><header>Federal
		building energy efficiency performance standards; certification system and
		level for green buildings</header>
 <subsection id="id64CA5865754441C68ADC5682B5438E0A"><enum>(a)</enum><header>Definitions</header><text>Section 303 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6832">42 U.S.C. 6832</external-xref>) (as amended by section 101(a)) is amended—</text>
 <paragraph id="id1A701DA5A6874DC29FE54B3CD0380B88"><enum>(1)</enum><text>in paragraph (6), by striking <quote>to be constructed</quote> and inserting <quote>constructed or altered</quote>; and</text>

						</paragraph></subsection><subsection id="id87DED2DEB7E04534914C69FCCEA7FE9A"><enum>(b)</enum><header>Federal
 Building Efficiency Standards</header><text>Section 305 of the Energy Conservation and Production Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6834">42 U.S.C. 6834</external-xref>) is amended—</text>
 <paragraph id="id5098DCB983A049E9BC3B36CCD294B8B4"><enum>(1)</enum><text>in subsection (a)(3)—</text>

 general</header><text>Not later than 1 year after the date of enactment of the Energy Savings and Industrial Competitiveness Act, the Secretary shall establish, by rule, revised Federal building energy efficiency performance standards that require that—</text>
 <subclause id="idE78A962BAB634944A812982C947C4EB5"><enum>(I)</enum><text>new Federal buildings and alterations and additions to existing Federal buildings—</text>
 <item id="id550215BC87644FFEAF5E63651714BF26"><enum>(aa)</enum><text>meet or exceed the most recent revision of the International Energy Conservation Code (in the case of residential buildings) or ASHRAE Standard 90.1 (in the case of commercial buildings) as of the date of enactment of the Energy Savings and Industrial Competitiveness Act; and</text>
 </item><item id="id4EEB92C813114D0BA06607448327F009"><enum>(bb)</enum><text>meet or exceed the energy provisions of State and local building codes applicable to the building, if the codes are more stringent than the International Energy Conservation Code or ASHRAE Standard 90.1, as applicable;</text>
 </item></subclause><subclause id="idFE0670E7863941DCBE22FB725E884072"><enum>(II)</enum><text>unless demonstrated not to be life-cycle cost effective for new Federal buildings and Federal buildings with major renovations—</text>
 <item id="id26AE56C039434F4BB07736B51AFD9EFA"><enum>(aa)</enum><text>the buildings be designed to achieve energy consumption levels that are at least 30 percent below the levels established in the version of the ASHRAE Standard or the International Energy Conservation Code, as appropriate, that is applied under subclause (I)(aa), including updates under subparagraph (B); and</text>
 </item><item id="id609154E570594820A6EFBC42165A9F57"><enum>(bb)</enum><text>sustainable design principles are applied to the location, siting, design, and construction of all new Federal buildings and replacement Federal buildings;</text>
 </item></subclause><subclause id="idB8C8EFD87BD146E1B06B6708AB01324B"><enum>(III)</enum><text>if water is used to achieve energy efficiency, water conservation technologies shall be applied to the extent that the technologies are life-cycle cost effective; and</text>
 </subclause><subclause id="idCF013520FB484B35AE2484893B1C489E"><enum>(IV)</enum><text>if life-cycle cost effective, as compared to other reasonably available technologies, not less than 30 percent of the hot water demand for each new Federal building or Federal building undergoing a major renovation be met through the installation and use of solar hot water heaters.</text>
 </subclause></clause><clause id="id1EE3AF361CBE4332ADD920B18FC7D98B"><enum>(ii)</enum><header>Limitation</header><text>Clause (i)(I) shall not apply to unaltered portions of existing Federal buildings and systems that have been added to or altered.</text>
 </clause></subparagraph><subparagraph id="id0D6820E1607A4F2FB91077CEFDE872A1"><enum>(B)</enum><header>Updates</header><text>Not later than 1 year after the date of approval of each subsequent revision of the ASHRAE Standard or the International Energy Conservation Code, as appropriate, the Secretary shall determine whether the revised standards established under subparagraph (A) should be updated to reflect the revisions, based on the energy savings and life-cycle cost-effectiveness of the revisions.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
 </subparagraph><subparagraph id="idE8B102ED512A4397A00773FBA09F1CE8"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>(C) In the budget request</quote> and inserting the following:</text>

 certification systems</header><text>The Secretary, after reviewing the findings of the Federal Director under section 436(h) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17092">42 U.S.C. 17092(h)</external-xref>), in consultation with the Administrator of General Services, and in consultation with the Secretary of Defense relating to those facilities under the custody and control of the Department of Defense, shall determine those certification systems for green commercial and residential buildings that the Secretary determines to be the most likely to encourage a comprehensive and environmentally sound approach to certification of green buildings.</text>
										</clause><clause id="idB5F1E6A21ECE4C9780055274E7807E75"><enum>(iii)</enum><header>Basis for
 selection</header><text>The determination of the certification systems under clause (ii) shall be based on ongoing review of the findings of the Federal Director under section 436(h) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17092">42 U.S.C. 17092(h)</external-xref>) and the criteria described in clause (v).</text>
 </clause><clause id="idDB5874FA76E24778B19840AA22004D90"><enum>(iv)</enum><header>Administration</header><text>In determining certification systems under this subparagraph, the Secretary shall—</text>
 <subclause id="id94C67E5D94D44F0D924392DCA4F64AC8"><enum>(I)</enum><text>make a separate determination for all or part of each system; and</text>
 </subclause><subclause id="id9663fd24be4944acaced49cd78bc4269"><enum>(II)</enum><text>confirm that the criteria used to support the selection of building products, materials, brands, and technologies—</text>
 <item id="idc1f18898767e46af9f7d1fcda81294ae"><enum>(aa)</enum><text>are based on relevant technical data;</text> </item><item id="idcc52cc322f764130aa46c3744bfda9da"><enum>(bb)</enum><text>use and reward evaluation of health, safety, and environmental risks and impacts across the lifecycle of the building product, material, brand, or technology, including methodologies generally accepted by the applicable scientific disciplines;</text>
 </item><item id="idc22388fff26b496dbaa5717f4c8f830a"><enum>(cc)</enum><text>as practicable, give preference to performance standards instead of prescriptive measures; and</text> </item><item id="idfd5f6be697e9431cb1f08c882600c76b"><enum>(dd)</enum><text>reward continual improvements in the lifecycle management of health, safety, and environmental risks and impacts.</text>
 </item></subclause></clause><clause id="id0A1835A458AA46F3B848FF4635FAAED0"><enum>(v)</enum><header>Considerations</header><text>In determining the green building certification systems under this subparagraph, the Secretary shall take into consideration—</text>
 <subclause id="id72C2A88408364F0BA7E25E6CC82830BA"><enum>(I)</enum><text>the ability and availability of assessors and auditors to independently verify the criteria and measurement of metrics at the scale necessary to implement this subparagraph;</text>
 </subclause><subclause id="id5FC5F6EB6E2446AEA741488829A06B80"><enum>(II)</enum><text>the ability of the applicable certification organization to collect and reflect public comment;</text> </subclause><subclause id="idCA78F5E40EC04F539CC02607757BA3BC"><enum>(III)</enum><text>the ability of the standard to be developed and revised through a consensus-based process;</text>
 </subclause><subclause id="idF9F3490F08814A1489BFB32B6956A04C"><enum>(IV)</enum><text>an evaluation of the robustness of the criteria for a high-performance green building, which shall give credit for promoting—</text>
 <item id="idAE1EA772262B43C1A5AEE69AEEE6F7AE"><enum>(aa)</enum><text>efficient and sustainable use of water, energy, and other natural resources;</text> </item><item id="id48EA3430D9DA403B81577757054637FF"><enum>(bb)</enum><text>use of renewable energy sources;</text>
 </item><item id="id06A0D1A6C18F4A54BDC1164AAAB7DE61"><enum>(cc)</enum><text>improved indoor environmental quality through enhanced indoor air quality, thermal comfort, acoustics, day lighting, pollutant source control, and use of low-emission materials and building system controls;</text>
 </item><item id="id14500D2EC4924E4481B2C8B76BB0D136"><enum>(dd)</enum><subitem commented="no" display-inline="yes-display-inline" id="id243D3F4B9AFD4C7FB9B5739E854449DE"><enum>(AA)</enum><text>the sourcing of grown, harvested, or mined materials; and</text> </subitem><subitem id="id34FABBB63836415788DA67B85D2CC5AB" indent="up1"><enum>(BB)</enum><text>certifications of responsible sourcing, such as certifications provided by the Forest Stewardship Council, the Sustainable Forestry Initiative, the American Tree Farm System, or the Programme for the Endorsement of Forest Certification; and</text>
 </subitem></item><item id="idD20C5B99C46E4803AD684D70AB61BA63"><enum>(ee)</enum><text>such other criteria as the Secretary determines to be appropriate; and</text> </item></subclause><subclause id="id2103B7804F61490089F1C08B68533EC6"><enum>(V)</enum><text>national recognition within the building industry.</text>
 </subclause></clause><clause id="idBD366031A42D46A1841AEA25160C4EA6"><enum>(vi)</enum><header>Review</header><text>The Secretary, in consultation with the Administrator of General Services and the Secretary of Defense, shall conduct an ongoing review to evaluate and compare private sector green building certification systems, taking into account—</text>
 <subclause id="id720A8758E1E747A8AE317FFC45064F4C"><enum>(I)</enum><text>the criteria described in clause (v); and</text> </subclause><subclause id="id8C3F265B6B7242B384F77E6C458BECB9"><enum>(II)</enum><text>the identification made by the Federal Director under section 436(h) of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17092">42 U.S.C. 17092(h)</external-xref>).</text>
											</subclause></clause><clause id="id65A56091E9A6419C9B0B052679A1CA13"><enum>(vii)</enum><header>Exclusions</header>
 <subclause id="id4F562E03342D442FB8AF331551C93D52"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), if a certification system fails to meet the review requirements of clause (v), the Secretary shall—</text>
 <item id="id16C19B745F014F86889407505D24025D"><enum>(aa)</enum><text>identify the portions of the system, whether prerequisites, credits, points, or otherwise, that meet the review criteria of clause (v);</text>
 </item><item id="id050D362B603C49368ED7425E66A6FAF2"><enum>(bb)</enum><text>determine the portions of the system that are suitable for use; and</text> </item><item id="id29A120AED3A2468FBB8B47B4CE1FA8ED"><enum>(cc)</enum><text>exclude all other portions of the system from identification and use.</text>
 </item></subclause><subclause id="id864CD53716B54546958A57070EC90163"><enum>(II)</enum><header>Entire systems</header><text>The Secretary shall exclude an entire system from use if an exclusion under subclause (I)—</text> <item id="idDDCD6B3F5E80444C80EDB98BE7ED4545"><enum>(aa)</enum><text>impedes the integrated use of the system;</text>
 </item><item id="idCEDF3574BD1B4022A95DE2A2AF56334E"><enum>(bb)</enum><text>creates disparate review criteria or unequal point access for competing materials; or</text> </item><item id="id803253705B204EACAEEBB51F7F4C73C6"><enum>(cc)</enum><text>increases agency costs of the use.</text>
 </item></subclause></clause><clause id="id0A6E421E1186468B82F7AB003C919101"><enum>(viii)</enum><header>Internal certification processes</header><text>The Secretary may by rule allow Federal agencies to develop internal certification processes, using certified professionals, in lieu of certification by certification entities identified under clause (ii).</text>
 </clause><clause id="id779FFA45DAC542C887DBE7942FECC27A"><enum>(ix)</enum><header>Privatized military housing</header><text>With respect to privatized military housing, the Secretary of Defense, after consultation with the Secretary may, through rulemaking, develop alternative certification systems and levels than the systems and levels identified under clause (ii) that achieve an equivalent result in terms of energy savings, sustainable design, and green building performance.</text>
 </clause><clause id="id2FB833738D0F4B4185E6F00EBA185630"><enum>(x)</enum><header>Water conservation technologies</header><text>In addition to any use of water conservation technologies otherwise required by this section, water conservation technologies shall be applied to the extent that the technologies are life-cycle cost-effective.</text>
										</clause><clause id="id0239CD1B59AF4E3CBCCD567340ADF5E6"><enum>(xi)</enum><header>Effective date</header>
 <subclause id="id6478F2EBDA7E46D3848D28F133BB78C3"><enum>(I)</enum><header>Determinations made after December 31, 2017</header><text>The amendments made by section 432(b)(1)(C) of Energy Savings and Industrial Competitiveness Act shall apply to any determination made by a Federal agency after December 31, 2017.</text>
 </subclause><subclause id="id6B3040F671134E14A26F5FC7609D9038"><enum>(II)</enum><header>Determinations made on or before December 31, 2017</header><text>This subparagraph (as in effect on the day before the date of enactment of Energy Savings and Industrial Competitiveness Act) shall apply to any use of a certification system for green commercial and residential buildings by a Federal agency on or before December 31, 2017.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>
 </subparagraph></paragraph><paragraph id="id41F566BC5CCF4A84A578C3C15CD3136B"><enum>(2)</enum><text>by striking subsections (c) and (d) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id6368384EA8A949C8A6C1AF75C15B7E41" style="OLC">
								<subsection id="id1F615C09AAB841B3B99436EA3ADC713E"><enum>(c)</enum><header>Periodic
 review</header><text>The Secretary shall—</text> <paragraph id="id826605F18DFF4ECBA71D6484387A5216"><enum>(1)</enum><text>once every 5 years, review the Federal building energy standards established under this section; and</text>
 </paragraph><paragraph id="id008B8DA129674555BFE2E70AAA2A0556"><enum>(2)</enum><text>on completion of a review under paragraph (1), if the Secretary determines that significant energy savings would result, upgrade the standards to include all new energy efficiency and renewable energy measures that are technologically feasible and economically justified.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="id520CA6635EB6446EBAC1D8B6F4273655"><enum>423.</enum><header>Enhanced
		energy efficiency underwriting</header>
 <subsection id="id3856a484eb744b5fb3d402fbcbd2b36c"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="idB7D79B6818624653A0A9FC63E9BB3DFD"><enum>(1)</enum><header>Covered agency</header><text>The term <term>covered agency</term>—</text>
 <subparagraph id="idD72182047F1C4374ADE2D18F5CD4AFBE"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text> <clause id="id44D81C20133D44FDBDD0551785F57187"><enum>(i)</enum><text display-inline="yes-display-inline">an executive agency, as that term is defined in section 102 of title 31, United States Code; and</text>
 </clause><clause id="idCBB9F9213CCD4D7984204FCE39D17DD7"><enum>(ii)</enum><text display-inline="yes-display-inline">any other agency of the Federal Government; and</text>
 </clause></subparagraph><subparagraph id="id5FCE7D2452FA4CAA8DA575A8BBE1A193"><enum>(B)</enum><text display-inline="yes-display-inline">includes any enterprise, as that term is defined under section 1303 of the Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/12/4502">12 U.S.C. 4502</external-xref>).</text>
							</subparagraph></paragraph><paragraph id="idE8785055A0D0444A95F2F662411F17AF"><enum>(2)</enum><header>Covered
 loan</header><text display-inline="yes-display-inline">The term <term>covered loan</term> means a loan secured by a home that is issued, insured, purchased, or securitized by a covered agency.</text>
 </paragraph><paragraph id="id9748FDF1DDF1487E85E9C3E26E4F44EB"><enum>(3)</enum><header>Homeowner</header><text display-inline="yes-display-inline">The term <term>homeowner</term> means the mortgagor under a covered loan.</text>
 </paragraph><paragraph id="idA25C478A9DD34354BA80E3C99CBD8814"><enum>(4)</enum><header>Mortgagee</header><text display-inline="yes-display-inline">The term <term>mortgagee</term> means—</text>
 <subparagraph id="id6C1ACBC729B64CC980DD3278E03C7BAC"><enum>(A)</enum><text display-inline="yes-display-inline">an original lender under a covered loan or the holder of a covered loan at the time at which that mortgage transaction is consummated;</text>
 </subparagraph><subparagraph id="id391E6E16241E4CD5993823F00FBE3C4C"><enum>(B)</enum><text display-inline="yes-display-inline">any affiliate, agent, subsidiary, successor, or assignee of an original lender under a covered loan or the holder of a covered loan at the time at which that mortgage transaction is consummated;</text>
 </subparagraph><subparagraph id="id056A92BCE207435C9BD307E3B5895E47"><enum>(C)</enum><text display-inline="yes-display-inline">any servicer of a covered loan; and</text> </subparagraph><subparagraph id="idE5B03CF8A3C94B658E8425C3CED42A00"><enum>(D)</enum><text display-inline="yes-display-inline">any subsequent purchaser, trustee, or transferee of any covered loan issued by an original lender.</text>
 </subparagraph></paragraph><paragraph id="id5B0B03ACEC3C4910862ECC7E8D1BB28D"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text>
 </paragraph><paragraph id="id1AC8A333BAAD44C288F12B0776C6EC46"><enum>(6)</enum><header>Servicer</header><text display-inline="yes-display-inline">The term <term>servicer</term> means the person or entity responsible for the servicing of a covered loan, including the person or entity who makes or holds a covered loan if that person or entity also services the covered loan.</text>
 </paragraph><paragraph id="id04151DF27041410F8DF6EA9E84DDD35F"><enum>(7)</enum><header>Servicing</header><text display-inline="yes-display-inline">The term <term>servicing</term> has the meaning given the term in section 6(i) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(i)</external-xref>).</text>
						</paragraph></subsection><subsection id="id87623080852B40C6A5A0354D1A0548A1"><enum>(b)</enum><header>Findings and
		purposes</header>
 <paragraph id="idC39C624B9D96453BAE629379C25A8584"><enum>(1)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> <subparagraph id="id4EDE317BC52743D78E476824867DC032"><enum>(A)</enum><text display-inline="yes-display-inline">energy costs for homeowners are a significant and increasing portion of their household budgets;</text>
 </subparagraph><subparagraph id="idE5D0B2691734498CA0421211356ECAB1"><enum>(B)</enum><text display-inline="yes-display-inline">household energy use can vary substantially depending on the efficiency and characteristics of the house;</text>
 </subparagraph><subparagraph id="idE14B471C2459469599991FCF521AC29C"><enum>(C)</enum><text display-inline="yes-display-inline">expected energy cost savings are important to the value of the house;</text>
 </subparagraph><subparagraph id="idC98EE9A7D477480487447DED0A403F5B"><enum>(D)</enum><text display-inline="yes-display-inline">the current test for loan affordability used by most covered agencies, commonly known as the <term>debt-to-income</term> test, is inadequate because it does not take into account the expected energy cost savings for the homeowner of an energy efficient home; and</text>
 </subparagraph><subparagraph id="id31F9C72E355A40E88D16E87ADC600F7F"><enum>(E)</enum><text display-inline="yes-display-inline">another loan limitation, commonly known as the <term>loan-to-value</term> test, is tied to the appraisal, which often does not adjust for efficiency features of houses.</text>
 </subparagraph></paragraph><paragraph id="idC62CC749A07949859EA1094F1193E1D7"><enum>(2)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are to—</text> <subparagraph id="idAE93941039D7462F97AE39EBACA0779D"><enum>(A)</enum><text display-inline="yes-display-inline">improve the accuracy of mortgage underwriting by Federal mortgage agencies by ensuring that energy cost savings are included in the underwriting process as described below, and thus to reduce the amount of energy consumed by homes and to facilitate the creation of energy efficiency retrofit and construction jobs;</text>
 </subparagraph><subparagraph id="id12521B3F3A9545159C354FA3CE43795B"><enum>(B)</enum><text display-inline="yes-display-inline">require a covered agency to include the expected energy cost savings of a homeowner as a regular expense in the tests, such as the debt-to-income test, used to determine the ability of the loan applicant to afford the cost of homeownership for all loan programs; and</text>
 </subparagraph><subparagraph id="id747DDB4CCB4D4E6D86DEA809BA814361"><enum>(C)</enum><text display-inline="yes-display-inline">require a covered agency to include the value home buyers place on the energy efficiency of a house in tests used to compare the mortgage amount to home value, taking precautions to avoid double-counting and to support safe and sound lending.</text>
							</subparagraph></paragraph></subsection><subsection id="id09190967AD644C429C9990B46F1B9537"><enum>(c)</enum><header>Enhanced energy
		efficiency underwriting criteria</header>
						<paragraph id="id8C62286D98884FE994215F57B28779D9"><enum>(1)</enum><header>In
 general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall, in consultation with the advisory group established in subsection (f)(2), develop and issue guidelines for a covered agency to implement enhanced loan eligibility requirements, for use when testing the ability of a loan applicant to repay a covered loan, that account for the expected energy cost savings for a loan applicant at a subject property, in the manner set forth in paragraphs (2) and (3).</text>
						</paragraph><paragraph id="id3C93949EAEC94853931BF2E29C4871E3"><enum>(2)</enum><header>Requirements To
 account for energy cost savings</header><text display-inline="yes-display-inline">The enhanced loan eligibility requirements under paragraph (1) shall require that, for all covered loans for which an energy efficiency report is voluntarily provided to the mortgagee by the mortgagor, the covered agency and the mortgagee shall take into consideration the estimated energy cost savings expected for the owner of the subject property in determining whether the loan applicant has sufficient income to service the mortgage debt plus other regular expenses. To the extent that a covered agency uses a test such as a debt-to-income test that includes certain regular expenses, such as hazard insurance and property taxes, the expected energy cost savings shall be included as an offset to these expenses. Energy costs to be assessed include the cost of electricity, natural gas, oil, and any other fuel regularly used to supply energy to the subject property.</text>
						</paragraph><paragraph id="id4A7D5EF4446F49EAA9C28052536DE907"><enum>(3)</enum><header>Determination
		of estimated energy cost savings</header>
							<subparagraph id="idE888D97B1769477EA98F4A29F354A1CB"><enum>(A)</enum><header>In
 general</header><text display-inline="yes-display-inline">The guidelines to be issued under paragraph (1) shall include instructions for the covered agency to calculate estimated energy cost savings using—</text>
 <clause id="ide2d43da7aa694ef7b2ac20cbbc57997b"><enum>(i)</enum><text>the energy efficiency report;</text>
 </clause><clause id="idd7df0e4b57934f82af3908a5e5fd4ff9"><enum>(ii)</enum><text>an estimate of baseline average energy costs; and</text>
 </clause><clause id="idf2d9b3a2ddcd4274912f2c582c30df88"><enum>(iii)</enum><text>additional sources of information as determined by the Secretary.</text>
								</clause></subparagraph><subparagraph id="idf995779bc6784486ab5121bcea3d3f53"><enum>(B)</enum><header>Report
 requirements</header><text>For the purposes of subparagraph (A), an energy efficiency report shall—</text>
 <clause id="id75e63488b32d4bb6b27fd07a8203f0ac"><enum>(i)</enum><text>estimate the expected energy cost savings specific to the subject property, based on specific information about the property;</text>
 </clause><clause id="id1c13dca4b0974e8aba244a2c8965d967"><enum>(ii)</enum><text>be prepared in accordance with the guidelines to be issued under paragraph (1); and</text>
 </clause><clause id="id19b3c4ca494948eab524edca6794e554"><enum>(iii)</enum><text>be prepared—</text>
 <subclause id="id2c826c910fcd42cfa420d6152f4f7d47"><enum>(I)</enum><text>in accordance with the Residential Energy Service Network’s Home Energy Rating System (commonly known as <term>HERS</term>) by an individual certified by the Residential Energy Service Network, unless the Secretary finds that the use of HERS does not further the purposes of this section; or</text>
 </subclause><subclause id="id57a3b218d89f4f0b93adb9e6d9c0e05c"><enum>(II)</enum><text>by other methods approved by the Secretary, in consultation with the Secretary of Energy and the advisory group established in subsection (f)(2), for use under this section, which shall include a third-party quality assurance procedure.</text>
									</subclause></clause></subparagraph><subparagraph id="id71fb5d3e4e424713916eadc7b629c109"><enum>(C)</enum><header>Use by
 appraiser</header><text>If an energy efficiency report is used under paragraph (2), the energy efficiency report shall be provided to the appraiser to estimate the energy efficiency of the subject property and for potential adjustments for energy efficiency.</text>
							</subparagraph></paragraph><paragraph id="id553a645a3001437ca09d2f3d15fbfa01"><enum>(4)</enum><header>Required
		disclosure to consumer for a home with an energy efficiency
 report</header><text>If an energy efficiency report is used under paragraph (2), the guidelines to be issued under paragraph (1) shall require the mortgagee to—</text>
 <subparagraph id="id2441f7204bb94f04bca0138ba7fec2c6"><enum>(A)</enum><text>inform the loan applicant of the expected energy costs as estimated in the energy efficiency report, in a manner and at a time as prescribed by the Secretary, and if practicable, in the documents delivered at the time of loan application; and</text>
 </subparagraph><subparagraph id="id24a36f0746b84d329bef99f4ccf80536"><enum>(B)</enum><text>include the energy efficiency report in the documentation for the loan provided to the borrower.</text>
							</subparagraph></paragraph><paragraph id="id057c3f373d104956a39671bd466c4480"><enum>(5)</enum><header>Required
		disclosure to consumer for a home without an energy efficiency
 report</header><text>If an energy efficiency report is not used under paragraph (2), the guidelines to be issued under paragraph (1) shall require the mortgagee to inform the loan applicant in a manner and at a time as prescribed by the Secretary, and if practicable, in the documents delivered at the time of loan application of—</text>
 <subparagraph id="id262161f0cf7f4c9a9a64b20bcf0b5d6b"><enum>(A)</enum><text>typical energy cost savings that would be possible from a cost-effective energy upgrade of a home of the size and in the region of the subject property;</text>
 </subparagraph><subparagraph id="id8d5fa926555540e2ad8168acd9c1fcec"><enum>(B)</enum><text>the impact the typical energy cost savings would have on monthly ownership costs of a typical home;</text>
 </subparagraph><subparagraph id="id9f6d9f0f9364459387c8da0066f38aa7"><enum>(C)</enum><text>the impact on the size of a mortgage that could be obtained if the typical energy cost savings were reflected in an energy efficiency report; and</text>
 </subparagraph><subparagraph id="id68ab83022d9a46a7a92da9a4e718cbd0"><enum>(D)</enum><text>resources for improving the energy efficiency of a home.</text>
							</subparagraph></paragraph><paragraph id="idece603ab333d42699fd0fe33cfdc7f05"><enum>(6)</enum><header>Pricing of
		loans</header>
							<subparagraph id="id7b40836c2dcf41559c869e32fd181932"><enum>(A)</enum><header>In
 general</header><text>A covered agency may price covered loans originated under the enhanced loan eligibility requirements required under this section in accordance with the estimated risk of the loans.</text>
							</subparagraph><subparagraph id="id898D6A33DB36485B9FDD1389B4F8C8CB"><enum>(B)</enum><header>Imposition of
 certain material costs, impediments, or penalties</header><text>In the absence of a publicly disclosed analysis that demonstrates significant additional default risk or prepayment risk associated with the loans, a covered agency shall not impose material costs, impediments, or penalties on covered loans merely because the loan uses an energy efficiency report or the enhanced loan eligibility requirements required under this section.</text>
							</subparagraph></paragraph><paragraph id="id6C6B04FE1EBC4B6F94B30F32E6CF81A5"><enum>(7)</enum><header>Limitations</header>
 <subparagraph id="id8056fee67939454581dda802c38260ff"><enum>(A)</enum><header>In general</header><text>A covered agency may price covered loans originated under the enhanced loan eligibility requirements required under this section in accordance with the estimated risk of those loans.</text>
 </subparagraph><subparagraph id="id12E4D11AC08049589D9BCAFFA83EC014"><enum>(B)</enum><header>Prohibited actions</header><text>A covered agency shall not—</text>
 <clause id="id4cd0758536334c4e8685c846954612a8"><enum>(i)</enum><text>modify existing underwriting criteria or adopt new underwriting criteria that intentionally negate or reduce the impact of the requirements or resulting benefits that are set forth or otherwise derived from the enhanced loan eligibility requirements required under this subsection; or</text>
 </clause><clause id="idf401817be56349c9a838e247c00a85ae"><enum>(ii)</enum><text>impose greater buy back requirements, credit overlays, or insurance requirements, including private mortgage insurance, on covered loans merely because the loan uses an energy efficiency report or the enhanced loan eligibility requirements required under this subsection.</text>
								</clause></subparagraph></paragraph><paragraph id="id3387113d9ed64909a6323652c0fc26d8"><enum>(8)</enum><header>Applicability
 and implementation date</header><text>Not later than 3 years after the date of enactment of this Act, and before December 31, 2019, the enhanced loan eligibility requirements required under this subsection shall be implemented by each covered agency to—</text>
 <subparagraph id="idc03bc0d7767442ffb7859f8c709329dd"><enum>(A)</enum><text>apply to any covered loan for the sale, or refinancing of any loan for the sale, of any home;</text>
 </subparagraph><subparagraph id="iddfb3ca11dcf04af9851ce82d964f3a97"><enum>(B)</enum><text>be available on any residential real property (including individual units of condominiums and cooperatives) that qualifies for a covered loan; and</text>
 </subparagraph><subparagraph id="ide45c85feed214ea7a5944a7247a4e7be"><enum>(C)</enum><text>provide prospective mortgagees with sufficient guidance and applicable tools to implement the required underwriting methods.</text>
							</subparagraph></paragraph></subsection><subsection id="idc4f1efc8b0f947b5b338cba8a3bbf397"><enum>(d)</enum><header>Enhanced energy
		efficiency underwriting valuation guidelines</header>
						<paragraph id="id6e448e2533ea405a85484322f7a969ef"><enum>(1)</enum><header>In
 general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall—</text>
 <subparagraph id="idF66F1F9F1B0A4462B225AB35BA2EA1D5"><enum>(A)</enum><text>in consultation with the Federal Financial Institutions Examination Council and the advisory group established in subsection (f)(2), develop and issue guidelines for a covered agency to determine the maximum permitted loan amount based on the value of the property for all covered loans made on properties with an energy efficiency report that meets the requirements of subsection (c)(3)(B); and</text>
 </subparagraph><subparagraph id="idA947308D32464FD992BB728F92D42E34"><enum>(B)</enum><text>in consultation with the Secretary of Energy, issue guidelines for a covered agency to determine the estimated energy savings under paragraph (3) for properties with an energy efficiency report.</text>
 </subparagraph></paragraph><paragraph id="idD2F592521DAE4257832FA2C1F33E64A5"><enum>(2)</enum><header>Requirements</header><text>The enhanced energy efficiency underwriting valuation guidelines required under paragraph (1) shall include—</text>
 <subparagraph id="id5485c232ffbd4a80937fc48463dd75e9"><enum>(A)</enum><text>a requirement that if an energy efficiency report that meets the requirements of subsection (c)(3)(B) is voluntarily provided to the mortgagee, such report shall be used by the mortgagee or covered agency to determine the estimated energy savings of the subject property; and</text>
 </subparagraph><subparagraph id="idd57da94fae3947e688bd10260e2a964c"><enum>(B)</enum><text>a requirement that the estimated energy savings of the subject property be added to the appraised value of the subject property by a mortgagee or covered agency for the purpose of determining the loan-to-value ratio of the subject property, unless the appraisal includes the value of the overall energy efficiency of the subject property, using methods to be established under the guidelines issued under paragraph (1).</text>
							</subparagraph></paragraph><paragraph id="id466b385d14a545f791eede75f1a8c513"><enum>(3)</enum><header>Determination
		of estimated energy savings</header>
							<subparagraph id="idA55339AA8EF344CE9FBFF83B3A16F8AB"><enum>(A)</enum><header>Amount of
 energy savings</header><text>The amount of estimated energy savings shall be determined by calculating the difference between the estimated energy costs for the average comparable houses, as determined in guidelines to be issued under paragraph (1), and the estimated energy costs for the subject property based upon the energy efficiency report.</text>
							</subparagraph><subparagraph id="id3BE9F0EFD1494EB8BEFD06F675F807BF"><enum>(B)</enum><header>Duration of
 energy savings</header><text>The duration of the estimated energy savings shall be based upon the estimated life of the applicable equipment, consistent with the rating system used to produce the energy efficiency report.</text>
							</subparagraph><subparagraph id="id1B435BE8F01343B9B56E2DB2A9C4B4E8"><enum>(C)</enum><header>Present value
 of energy savings</header><text>The present value of the future savings shall be discounted using the average interest rate on conventional 30-year mortgages, in the manner directed by guidelines issued under paragraph (1).</text>
							</subparagraph></paragraph><paragraph id="idc361b86d9207435bb8b5abe430111bcf"><enum>(4)</enum><header>Ensuring
 consideration of energy efficient features</header><text>Section 1110 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3339">12 U.S.C. 3339</external-xref>) is amended—</text>
 <subparagraph id="idcf477bafb65c4cd48ca45fa8440ad7c3"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon; and</text>
 </subparagraph><subparagraph id="idFAB66AD83A7D4C5FB0ADB10033EFAD01"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote> and inserting after paragraph (3) the following:</text>
								<quoted-block display-inline="no-display-inline" id="id1D5CC14203CF44AF88952E04973F7C21" style="OLC">
 <paragraph id="id97a0664822724b91b07bf613bcec77a8"><enum>(4)</enum><text>that State certified and licensed appraisers have timely access, whenever practicable, to information from the property owner and the lender that may be relevant in developing an opinion of value regarding the energy- and water-saving improvements or features of a property, such as—</text>
 <subparagraph id="id9072F53E2DCC49A8995A00DAA9F34C33"><enum>(A)</enum><text>labels or ratings of buildings;</text>
 </subparagraph><subparagraph id="idD7C600DFCF9E44C99A486B99F70BCE08"><enum>(B)</enum><text>installed appliances, measures, systems or technologies;</text>
 </subparagraph><subparagraph id="id4282FE8531D84694A802B953C5CB3ABD"><enum>(C)</enum><text>blueprints;</text> </subparagraph><subparagraph id="idD7FAF7BC6D64498BA4D32DCD1D3485C6"><enum>(D)</enum><text>construction costs;</text>
 </subparagraph><subparagraph id="id88F37A4A62794B289CDAB180DBF6BF02"><enum>(E)</enum><text>financial or other incentives regarding energy- and water-efficient components and systems installed in a property;</text>
 </subparagraph><subparagraph id="id6AA5C9F1FE5C4CFD984847D0CAB5621B"><enum>(F)</enum><text>utility bills;</text>
 </subparagraph><subparagraph id="id4CFA0153C32B4F86B2896B28E9111B64"><enum>(G)</enum><text>energy consumption and bench­mark­ing data; and</text>
 </subparagraph><subparagraph id="id37D430F0B44F4A888DFDE47882D96B12"><enum>(H)</enum><text>third-party verifications or representations of energy and water efficiency performance of a property, observing all financial privacy requirements adhered to by certified and licensed appraisers, including section 501 of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6801">15 U.S.C. 6801</external-xref>).</text>
										</subparagraph><continuation-text continuation-text-level="paragraph">Unless a
		  property owner consents to a lender, an appraiser, in carrying out the
		  requirements of paragraph (4), shall not have access to the commercial or
		  financial information of the owner that is privileged or
		  confidential.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph id="id8DC6F84F094C4E2BB40B3AA50EE76573"><enum>(5)</enum><header>Transactions
 requiring state certified appraisers</header><text>Section 1113 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/3342">12 U.S.C. 3342</external-xref>) is amended—</text>
 <subparagraph id="id2100e52216dc4c3387ac451739091c30"><enum>(A)</enum><text>in paragraph (1), by inserting before the semicolon the following: <quote>, or any real property on which the appraiser makes adjustments using an energy efficiency report</quote>; and</text>
 </subparagraph><subparagraph id="id02e85c42e8114e0e851d19607c463bb7"><enum>(B)</enum><text>in paragraph (2), by inserting after <quote>atypical</quote> the following: <quote>, or an appraisal on which the appraiser makes adjustments using an energy efficiency report.</quote>.</text>
							</subparagraph></paragraph><paragraph id="idd2be2f11fd454edb97421fdd8222ff96"><enum>(6)</enum><header>Protections</header>
							<subparagraph id="id1c1ed0b834bf48188a229c12d16e7cf7"><enum>(A)</enum><header>Authority to
 impose limitations</header><text>The guidelines to be issued under paragraph (1) shall include such limitations and conditions as determined by the Secretary to be necessary to protect against meaningful under or over valuation of energy cost savings or duplicative counting of energy efficiency features or energy cost savings in the valuation of any subject property that is used to determine a loan amount.</text>
							</subparagraph><subparagraph id="id216c76858bbd402b80408f747464b4bf"><enum>(B)</enum><header>Additional
 authority</header><text>At the end of the 7-year period following the implementation of enhanced eligibility and underwriting valuation requirements under this section, the Secretary may modify or apply additional exceptions to the approach described in paragraph (2), where the Secretary finds that the unadjusted appraisal will reflect an accurate market value of the efficiency of the subject property or that a modified approach will better reflect an accurate market value.</text>
							</subparagraph></paragraph><paragraph id="iddc97c9cf0bac4b929ea295f6a220a2ad"><enum>(7)</enum><header>Applicability
 and implementation date</header><text>Not later than 3 years after the date of enactment of this Act, and before December 31, 2019, each covered agency shall implement the guidelines required under this subsection, which shall—</text>
 <subparagraph id="id72397681E55349C782174B92BA5D97D7"><enum>(A)</enum><text>apply to any covered loan for the sale, or refinancing of any loan for the sale, of any home; and</text>
 </subparagraph><subparagraph id="idbdc966a2500247c08565e822f992149b"><enum>(B)</enum><text>be available on any residential real property, including individual units of condominiums and cooperatives, that qualifies for a covered loan.</text>
 </subparagraph></paragraph></subsection><subsection id="id221e345b154c4c409fa772f8265016cd"><enum>(e)</enum><header>Monitoring</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the enhanced eligibility and underwriting valuation requirements are implemented under this section, and every year thereafter, each covered agency with relevant activity shall issue and make available to the public a report that—</text>
 <paragraph id="idDE77A78C1BE24F44BAF06F2366827D78"><enum>(1)</enum><text display-inline="yes-display-inline">enumerates the number of covered loans of the agency for which there was an energy efficiency report, and that used energy efficiency appraisal guidelines and enhanced loan eligibility requirements;</text>
 </paragraph><paragraph id="id38F5817EBD164A16BB5876C3FD96BA55"><enum>(2)</enum><text display-inline="yes-display-inline">includes the default rates and rates of foreclosures for each category of loans; and</text>
 </paragraph><paragraph id="id33d3af995ef349eeaedff4d58f20be05"><enum>(3)</enum><text>describes the risk premium, if any, that the agency has priced into covered loans for which there was an energy efficiency report.</text>
						</paragraph></subsection><subsection id="id02e0b0b95e1549659629d0f84565691e"><enum>(f)</enum><header>Rulemaking</header>
						<paragraph id="id7f361c29400a4a5a8bda5d7c77f669dd"><enum>(1)</enum><header>In
 general</header><text>The Secretary shall prescribe regulations to carry out this section, in consultation with the Secretary of Energy and the advisory group established in paragraph (2), which may contain such classifications, differentiations, or other provisions, and may provide for such proper implementation and appropriate treatment of different types of transactions, as the Secretary determines are necessary or proper to effectuate the purposes of this section, to prevent circumvention or evasion thereof, or to facilitate compliance therewith.</text>
						</paragraph><paragraph id="idb657c33b310f496a91be387e4cc9f801"><enum>(2)</enum><header>Advisory
 group</header><text>To assist in carrying out this section, the Secretary shall establish an advisory group, consisting of individuals representing the interests of—</text>
 <subparagraph id="id991FFB06440A4CC992BCCCFA6E7DED21"><enum>(A)</enum><text>mortgage lenders;</text>
 </subparagraph><subparagraph id="idBCBCF663A97E458280820AEC5A9E43FC"><enum>(B)</enum><text>appraisers;</text> </subparagraph><subparagraph id="idEFE4175566A843DC8393FAA3576FAFC9"><enum>(C)</enum><text>energy raters and residential energy consumption experts;</text>
 </subparagraph><subparagraph id="idE28414B9C3DA4E0BBC8BCDED6D10DCC4"><enum>(D)</enum><text>energy efficiency organizations;</text>
 </subparagraph><subparagraph id="idAE20092162324D74813235D8C63813D7"><enum>(E)</enum><text>real estate agents;</text>
 </subparagraph><subparagraph id="idD3CC7AA5DC494256ACDC50D5BBF18BF7"><enum>(F)</enum><text>home builders and remodelers;</text>
 </subparagraph><subparagraph id="id6AC6E25DF7B348B0824675CA3812DCD4"><enum>(G)</enum><text>State energy officials; and</text>
 </subparagraph><subparagraph id="idB0C95BEEDBFE4D81AC06F7E4CC89CB20"><enum>(H)</enum><text>others as determined by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection id="idb17bfa4bce21444db49987e7f711bae3"><enum>(g)</enum><header>Additional
		study</header>
						<paragraph id="idCF0EB6E3544842029DB3639271F66EBE"><enum>(1)</enum><header>In
 general</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall reconvene the advisory group established in subsection (f)(2), in addition to water and locational efficiency experts, to advise the Secretary on the implementation of the enhanced energy efficiency underwriting criteria established in subsections (c) and (d).</text>
 </paragraph><paragraph id="id34D612B0B47041F7AD41AAF8823CB00A"><enum>(2)</enum><header>Recommendations</header><text>The advisory group established in subsection (f)(2) shall provide recommendations to the Secretary on any revisions or additions to the enhanced energy efficiency underwriting criteria deemed necessary by the group, which may include alternate methods to better account for home energy costs and additional factors to account for substantial and regular costs of homeownership such as location-based transportation costs and water costs. The Secretary shall forward any legislative recommendations from the advisory group to Congress for its consideration.</text>
						</paragraph></subsection></section></subtitle></title><title id="idc5edd5dc-e63e-4fe0-a21d-0b5459609aa4"><enum>V</enum><header>Miscellaneous</header>
			<section id="id5854d0b8-40ad-43f8-9c1a-e7f45c7a30bd"><enum>501.</enum><header>Budgetary
 effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <term>Budgetary Effects of PAYGO Legislation</term> for this Act, submitted for printing in the Congressional Record by the Chairman of the Senate Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text>
			</section><section id="idd5627b3f-f445-4962-9b0e-b96c282bc2c6"><enum>502.</enum><header>Advance
 appropriations required</header><text display-inline="no-display-inline">The authorization of amounts under this Act and the amendments made by this Act shall be effective for any fiscal year only to the extent and in the amount provided in advance in appropriations Acts.</text></section></title></legis-body><endorsement><action-date>May 10, 2017</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
