						<title id="id599529f4361646c28ab261aa472fb652"><enum>XIII</enum><header>Wilderness</header>
							<section id="id48f58a710ab8437aa8a3bd1f5cf8c322"><enum>1301.</enum><header>Designation of wilderness areas</header>
 <subsection id="id8640f6c6b6bb44238ba870d17367785d"><enum>(a)</enum><header>Designation of wilderness areas To be administered by the bureau of land management</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and sections 601 and 603 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1781">43 U.S.C. 1781</external-xref>, 1782), the following land in the State is designated as wilderness areas and as components of the National Wilderness Preservation System:</text>
 <paragraph id="idbd21a2ab35e54a3fa34a036be6ba52bb"><enum>(1)</enum><header>Avawatz mountains wilderness</header><text>Certain land in the Conservation Area administered by the Director of the Bureau of Land Management, comprising approximately 87,700 acres, as generally depicted on the map entitled <quote>Avawatz Mountains Proposed Wilderness</quote> and dated September 9, 2014, to be known as the <quote>Avawatz Mountains Wilderness</quote>.</text>
 </paragraph><paragraph commented="no" id="id515835a30b844121a26fa2bb5ee53373"><enum>(2)</enum><header>Golden valley wilderness</header><text>Certain land in the Conservation Area administered by the Director of the Bureau of Land Management, comprising approximately 1,250 acres, as generally depicted on the map entitled <quote>Golden Valley Proposed Wilderness Additions</quote> and dated February 20, 2016, which shall be considered to be part of the <quote>Golden Valley Wilderness</quote>.</text>
									</paragraph><paragraph id="id25951f4ef7214cc1baa7df584cfe211c"><enum>(3)</enum><header>Great falls basin wilderness</header>
 <subparagraph id="id19c0e83c5d0e4a4599d78f726ecb142f"><enum>(A)</enum><header>In general</header><text>Certain land in the Conservation Area administered by the Director of the Bureau of Land Management, comprising approximately 7,870 acres, as generally depicted on the map entitled <quote>Great Falls Basin Proposed Wilderness</quote> and dated October 26, 2009, to be known as the <quote>Great Falls Basin Wilderness</quote>.</text>
 </subparagraph><subparagraph id="id528d048ae9c6439c927737fb51e68f9f"><enum>(B)</enum><header>Limitations</header><text>Designation of the wilderness under subparagraph (A) shall not establish a Class I Airshed under the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="idae706970b4e64e8a87377b3a4a1b1b7f"><enum>(4)</enum><header>Kingston range wilderness</header><text>Certain land in the Conservation Area administered by the Bureau of Land Management, comprising approximately 53,320 acres, as generally depicted on the map entitled <quote>Kingston Range Proposed Wilderness Additions</quote> and dated July 15, 2009, which shall be considered to be a part of the <quote>Kingston Range Wilderness</quote>.</text>
 </paragraph><paragraph id="id8e1c592f956544f28fe581403e0c44ea"><enum>(5)</enum><header>Soda mountains wilderness</header><text>Certain land in the Conservation Area, administered by the Bureau of Land Management, comprising approximately 79,990 acres, as generally depicted on the map entitled <quote>Soda Mountains Proposed Wilderness</quote> and dated September 12, 2014, to be known as the <quote>Soda Mountains Wilderness</quote>.</text>
 </paragraph></subsection><subsection id="id3de6e76310c141f1a4d0bb863938439b"><enum>(b)</enum><header>Designation of wilderness areas To be administered by the national park service</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) and sections 601 and 603 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1781">43 U.S.C. 1781</external-xref>, 1782), the following land in the State is designated as wilderness areas and as components of the National Wilderness Preservation System:</text>
 <paragraph id="idf0f6ac6505ac4447abbab5567f2fef87"><enum>(1)</enum><header>Death valley national park wilderness additions-north eureka valley</header><text>Certain land in the Conservation Area administered by the Director of the National Park Service, comprising approximately 11,496 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-North Eureka Valley</quote>, numbered 143/100,082C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
 </paragraph><paragraph id="idef835f7b1b164d1582751aad467035cb"><enum>(2)</enum><header>Death valley national park wilderness additions-ibex</header><text>Certain land in the Conservation Area administered by the Director of the National Park Service, comprising approximately 23,650 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-Ibex</quote>, numbered 143/100,081C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
 </paragraph><paragraph id="id66436d0ba4fe4bc195c703070730f737"><enum>(3)</enum><header>Death valley national park wilderness additions-panamint valley</header><text>Certain land in the Conservation Area administered by the Director of the National Park Service, comprising approximately 4,807 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-Panamint Valley</quote>, numbered 143/100,083C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
 </paragraph><paragraph id="ide6c8e7ab2ec34755bb6dad6c6f23291f"><enum>(4)</enum><header>Death valley national park wilderness additions-warm springs</header><text>Certain land in the Conservation Area administered by the Director of the National Park Service, comprising approximately 10,485 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-Warm Spring Canyon/Galena Canyon</quote>, numbered 143/100,084C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
 </paragraph><paragraph id="id7dc21f0191544929becaab6a9a9fd7fe"><enum>(5)</enum><header>Death valley national park wilderness additions-axe head</header><text>Certain land in the Conservation Area administered by the Director of the National Park Service, comprising approximately 8,638 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-Axe Head</quote>, numbered 143/100,085C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
 </paragraph><paragraph id="id8da8aeb1bab94186b2d26a6a55d24e33"><enum>(6)</enum><header>Death valley national park wilderness additions-bowling alley</header><text>Certain land in the Conservation Area administered by the Director of the Bureau of Land Management, comprising approximately 32,520 acres, as generally depicted on the map entitled <quote>Death Valley National Park Proposed Wilderness Area-Bowling Alley</quote>, numbered 143/100,086C, and dated October 7, 2014, which shall be considered to be a part of the Death Valley National Park Wilderness.</text>
									</paragraph></subsection><subsection id="id837dbca63e35468a998d23cc751a8c64"><enum>(c)</enum><header>Designation of wilderness area To be administered by the forest service</header>
 <paragraph id="id00a9eff946dc493abcd70657611f6e43"><enum>(1)</enum><header>In general</header><text>In accordance with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), the land in the State described in paragraph (2) is designated as a wilderness area and as a component of the National Wilderness Preservation System.</text>
 </paragraph><paragraph id="id0f95e070981c415e8e652419fff5437c"><enum>(2)</enum><header>Description of land</header><text>The land referred to in paragraph (1) is certain land in the San Bernardino National Forest, comprising approximately 7,141 acres, as generally depicted on the map entitled <quote>Proposed Sand to Snow National Monument</quote> and dated August 29, 2014, which shall considered to be a part of the San Gorgonio Wilderness.</text>
									</paragraph><paragraph id="idfe623fc98c254745baca59c6ccef322f"><enum>(3)</enum><header>Fire management and related activities</header>
 <subparagraph id="id3b31cf5b36a44c52a6afa333e5766c28"><enum>(A)</enum><header>In general</header><text>The Secretary may carry out such activities in the wilderness area designated by paragraph (1) as are necessary for the control of fire, insects, and disease, in accordance with section 4(d)(1) of the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1133">16 U.S.C. 1133(d)(1)</external-xref>) and House Report 98–40 of the 98th Congress.</text>
 </subparagraph><subparagraph id="id76ea7096d70c4cb1a082de27d17dd66e"><enum>(B)</enum><header>Funding priorities</header><text>Nothing in this subsection limits the provision of any funding for fire or fuel management in the wilderness area designated by paragraph (1).</text>
 </subparagraph><subparagraph id="id65c5991c4cda46919706b45207a60fce"><enum>(C)</enum><header>Revision and development of local fire management plans</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall amend the local fire management plans that apply to the wilderness area designated by paragraph (1).</text>
 </subparagraph><subparagraph id="ide2936a2a60094a3ca7271154f760e3d5"><enum>(D)</enum><header>Administration</header><text>In accordance with subparagraph (A) and other applicable Federal law, to ensure a timely and efficient response to fire emergencies in the wilderness area designated by paragraph (1), the Secretary shall—</text>
 <clause id="idcb385bf750ee43acb8f3753f68b6e028"><enum>(i)</enum><text>not later than 1 year after the date of enactment of this title, establish agency approval procedures (including appropriate delegations of authority to the Forest Supervisor, District Manager, or other agency officials) for responding to fire emergencies in the wilderness area designated by paragraph (1); and</text>
 </clause><clause id="idabeb731c1dbb4d7184457116b195bc09"><enum>(ii)</enum><text>enter into agreements with appropriate State or local firefighting agencies relating to that wilderness area.</text>
											</clause></subparagraph></paragraph></subsection></section><section id="id1349f629c8b44ca3ba7766ec2499ee63"><enum>1302.</enum><header>Management</header>
								<subsection id="id9004ec01d18042478366f30396272e37"><enum>(a)</enum><header>Adjacent management</header>
 <paragraph id="iddf3ac262b96b4d6183e9b7e729a5f72b"><enum>(1)</enum><header>In general</header><text>Nothing in this title creates any protective perimeter or buffer zone around the wilderness areas designated by section 1301.</text>
									</paragraph><paragraph id="id657b325fd4f747cd81934cddca81d037"><enum>(2)</enum><header>Activities outside wilderness areas</header>
 <subparagraph id="id75e48cd39b7847e392199b4d9eec55b8"><enum>(A)</enum><header>In general</header><text>The fact that an activity (including military activities) or use on land outside a wilderness area designated by section 1301 can be seen or heard within the wilderness area shall not preclude or restrict the activity or use outside the boundary of the wilderness area.</text>
										</subparagraph><subparagraph id="ide28d9bd9ab494614b5604e3ce4fc7cb7"><enum>(B)</enum><header>Effect on nonwilderness activities</header>
 <clause id="ida7a958e997ef4b24b399de7062ebf4a4"><enum>(i)</enum><header>In general</header><text>In any permitting proceeding (including a review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>)) conducted with respect to a project described in clause (ii) that is formally initiated through a notice in the Federal Register before December 31, 2013, the consideration of any visual, noise, or other impacts of the project on a wilderness area designated by section 1301 shall be conducted based on the status of the area before designation as wilderness.</text>
 </clause><clause id="ida772cc9d1bdf409793bad6bfe4f0471b"><enum>(ii)</enum><header>Description of projects</header><text>A project referred to in clause (i) is a renewable energy project or associated energy transport facility project—</text>
 <subclause id="id399d8cb6c0dc4f8c8e9af4aecee34e83"><enum>(I)</enum><text>for which the Bureau of Land Management has received a right-of-way use application on or before the date of enactment of this title; and</text>
 </subclause><subclause id="id214485e403da4b0996715eb89d2c19d0"><enum>(II)</enum><text>that is located outside the boundary of a wilderness area designated by section 1301.</text> </subclause></clause></subparagraph></paragraph><paragraph id="id98ffc1b78b2f4c108de43c6c6cef23bc"><enum>(3)</enum><header>No additional regulation</header><text>Nothing in this title requires additional regulation of activities on land outside the boundary of the wilderness areas.</text>
 </paragraph><paragraph id="idb2a5bf6bb3234ed4ae6052e261e5b5c7"><enum>(4)</enum><header>Effect on military operations</header><text>Nothing in this title alters any authority of the Secretary of Defense to conduct any military operations at desert installations, facilities, and ranges of the State that are authorized under any other provision of law.</text>
									</paragraph><paragraph id="idd45f5a14970541c0bbd253c74e486032"><enum>(5)</enum><header>Effect on utility facilities and rights-of-way</header>
 <subparagraph id="id6C2F74B05BDF495781F92F8038794544"><enum>(A)</enum><header>In general</header><text>Subject to paragraph (2), nothing in this title terminates or precludes the renewal or reauthorization of any valid existing right-of-way or customary operation, maintenance, repair, upgrading, or replacement activities in a right-of-way, issued, granted, or permitted to the Southern California Edison Company or predecessors, successors, or assigns of the Southern California Edison Company that is located on land included in the San Gorgonio Wilderness Area or the Sand to Snow National Monument.</text>
 </subparagraph><subparagraph id="id716D9A88CD654D99B539428B11F1C287"><enum>(B)</enum><header>Limitation</header><text>The activities described in subparagraph (A) shall be conducted in a manner that minimizes the impact of the activities resources of the San Gorgonio Wilderness Area or the Sand to Snow National Monument.</text>
 </subparagraph><subparagraph id="id5D7AF32BC9F14CE18761618F623F4CEB"><enum>(C)</enum><header>Applicable law</header><text>In accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), any approval required for an increase in the voltage of the Coachella distribution circuit shall require consideration of alternative alignments, including alignments adjacent to State Route 62.</text>
										</subparagraph></paragraph></subsection><subsection id="id0e87dee44d5b45f0a53fcda74b65a170"><enum>(b)</enum><header>Maps; legal descriptions</header>
 <paragraph id="idcdaffd24716e4230947d3a4339134622"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall file a map and legal description of each wilderness area and wilderness addition designated by section 1301 with—</text>
 <subparagraph id="id3cbb933a6d134dd994d73479dad72546"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text> </subparagraph><subparagraph id="idbf249108a9a94f63b142fa460673b085"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text>
 </subparagraph></paragraph><paragraph id="id6a310f0f64af4df9bcb08325246da159"><enum>(2)</enum><header>Force of law</header><text>A map and legal description filed under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct errors in the maps and legal descriptions.</text>
 </paragraph><paragraph id="id8a0276471cc8448299df0aa4ae235a15"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be filed and made available for public inspection in the appropriate office of the Secretary.</text>
 </paragraph></subsection><subsection id="id8598b716b26d41109052389b4e444bb5"><enum>(c)</enum><header>Administration</header><text>Subject to valid existing rights, the land designated as wilderness or as a wilderness addition by section 1301 shall be administered by the Secretary in accordance with this Act and the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that any reference in that Act to the effective date shall be considered to be a reference to the date of enactment of this title.</text>
								</subsection></section><section id="id065fa4cdde6e4601ba443be161b9db3e"><enum>1303.</enum><header>Release of wilderness study areas</header>
 <subsection id="id2dbc237044134d429fb6c986f21491d2"><enum>(a)</enum><header>Finding</header><text>Congress finds that, for purposes of section 603 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782</external-xref>), any portion of a wilderness study area described in subsection (b) that is not designated as a wilderness area or wilderness addition by section 1301 or any other Act enacted before the date of enactment of this title has been adequately studied for wilderness.</text>
 </subsection><subsection id="idf253e754d4774131a4aad3e02f8d3d86"><enum>(b)</enum><header>Description of study areas</header><text>The study areas referred to in subsection (a) are—</text> <paragraph id="id74a751b38fec4b34a375a69d46f873e9"><enum>(1)</enum><text>the Cady Mountains Wilderness Study Area;</text>
 </paragraph><paragraph id="id7e7e31a11b6443b1a7dd565e5d24ac29"><enum>(2)</enum><text>the Kingston Range Wilderness Study Area;</text> </paragraph><paragraph id="id7bfea7c80ffc4a9a95ac71aedb293a45"><enum>(3)</enum><text>the Avawatz Mountain Wilderness Study Area;</text>
 </paragraph><paragraph id="ide9fb0badd5cb4688b5739a95d8333208"><enum>(4)</enum><text>the Death Valley National Park Boundary and Wilderness 17 Wilderness Study Area;</text> </paragraph><paragraph id="iddca920dce651473b97a3332e4112d6d2"><enum>(5)</enum><text>the Great Falls Basin Wilderness Study Area; and</text>
 </paragraph><paragraph id="idec07b6086ab74d969c6a6592f8260e63"><enum>(6)</enum><text>the Soda Mountains Wilderness Study Area.</text> </paragraph></subsection><subsection id="id76d2aa3b795f4b6794688b622e61ce39"><enum>(c)</enum><header>Release</header><text>Any portion of a wilderness study area described in subsection (b) that is not designated as a wilderness area or wilderness addition by section 1301 is no longer subject to section 603(c) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1782">43 U.S.C. 1782(c)</external-xref>).</text>
								</subsection></section><section id="id83f6e3bd694748f0b8716c3b43ca8e6c"><enum>1304.</enum><header>Treatment of cherry-stemmed roads</header>
 <subsection id="id2897cc1fa01c4af0a352ef168d0fac58"><enum>(a)</enum><header>Definition of cherry-Stemmed road</header><text>In this section, the term <term>cherry-stemmed road</term> means a road or trail, as generally depicted on the maps described in section 1301, that is—</text> <paragraph id="idAB04BB7C364F46F0ADB3E952CA811A96"><enum>(1)</enum><text>excluded from a wilderness area or wilderness addition designated by that section; and</text>
 </paragraph><paragraph id="id39C63A722AC24C83B2B401DB92A9916A"><enum>(2)</enum><text>within a nonwilderness corridor having designated wilderness on both sides.</text>
 </paragraph></subsection><subsection id="idb716dad22409483c8be52cbfb70ed386"><enum>(b)</enum><header>Prohibition on closure or travel restrictions on cherry-Stemmed roads</header><text>The Secretary shall not—</text> <paragraph id="id455f8a3f64b7412f99904d19bee71ea8"><enum>(1)</enum><text>close any cherry-stemmed road that is open to the public as of the date of enactment of this title;</text>
 </paragraph><paragraph id="idf38ac78757d24adba189610d98d32a56"><enum>(2)</enum><text>prohibit motorized access on a cherry-stemmed road that is open to the public for motorized access as of the date of enactment of this title; or</text>
 </paragraph><paragraph id="idb99977ce5c7f4e328377aef4f20ae38d"><enum>(3)</enum><text>prohibit mechanized access on a cherry-stemmed road that is open to the public for mechanized access as of the date of enactment of this title.</text>
 </paragraph></subsection><subsection id="ida0a198ada5a0414a95e3f8ed160d855c"><enum>(c)</enum><header>Resource protection or public safety exceptions</header><text>Subsection (b) shall not apply to a cherry-stemmed road if the Secretary determines that a closure or traffic restriction of the cherry-stemmed road is necessary for purposes of significant resource protection or public safety.</text>
								</subsection></section></title><title id="idedd86b5fb0ce49148c9d959323c3bd63"><enum>XIV</enum><header>Designation of special management area</header>
 <section id="id7e146f5ff29b4e97b1cbead608471232"><enum>1401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="id1c25f67a73b04b93a825b7c0a12b26db"><enum>(1)</enum><header>Management area</header><text>The term <term>Management Area</term> means the Vinagre Wash Special Management Area.</text>
 </paragraph><paragraph id="id01e5b962a1f841b09f720f75552ed548"><enum>(2)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Vinagre Wash Proposed Special Management Area</quote> and dated November 10, 2009.</text> </paragraph><paragraph id="id5e521fca60d44d46bfde694a448cfde4"><enum>(3)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text>
 </paragraph><paragraph id="ida3e82f500bb44f6289f61feb9918be4f"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text> </paragraph></section><section id="iddaa0773fd51f42e3b701a8d750bacf65"><enum>1402.</enum><header>Vinagre wash special management area</header> <subsection id="id19fe11b015a148f295716e53a015a8e0"><enum>(a)</enum><header>Establishment</header><text>There is established the Vinagre Wash Special Management Area in the State, to be managed by the El Centro Field Office and the Yuma Field Office of the Bureau of Land Management.</text>
 </subsection><subsection id="id7992c0d5b6b9472caf45b13945272f99"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Management Area is to conserve, protect, and enhance—</text> <paragraph id="id1d575291a33b46a4b54a6c110415de8e"><enum>(1)</enum><text>the plant and wildlife values of the Management Area; and</text>
 </paragraph><paragraph id="idfeb1fb84ef1947179a03725fbfc2c007"><enum>(2)</enum><text>the outstanding and nationally significant ecological, geological, scenic, recreational, archaeological, cultural, historic, and other resources of the Management Area.</text>
 </paragraph></subsection><subsection id="idca51c423c36b402ab61d4d354fd91687"><enum>(c)</enum><header>Boundaries</header><text>The Management Area shall consist of the public land in Imperial County, California, comprising approximately 81,880 acres, as generally depicted on the map.</text>
								</subsection><subsection id="id0b84b2a9aedd4fea81300f4143da8f83"><enum>(d)</enum><header>Map; legal description</header>
 <paragraph id="id7e9cf11fd55b4367a7e0e20b348bcc04"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 3 years, after the date of enactment of this title, the Secretary shall submit a map and legal description of the Management Area to—</text>
 <subparagraph id="id794168ab277f4a098c90a628f946124f"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text> </subparagraph><subparagraph id="id982ce0b7bb5f400d8d7cb5443ef225e8"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text>
 </subparagraph></paragraph><paragraph id="id02c5be0e64474c2ea85d4f9231cdcbc4"><enum>(2)</enum><header>Effect</header><text>The map and legal description submitted under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct any errors in the map and legal description.</text>
 </paragraph><paragraph id="id1dbf8fc8db1d4d0296678b16fc8a9d53"><enum>(3)</enum><header>Availability</header><text>Copies of the map submitted under paragraph (1) shall be on file and available for public inspection in—</text>
 <subparagraph id="id643b837d176c42a3bfbfa68eec2deff3"><enum>(A)</enum><text>the Office of the Director of the Bureau of Land Management; and</text> </subparagraph><subparagraph id="id51b97bf9ba2d42c7bf363cd55711f662"><enum>(B)</enum><text>the appropriate office of the Bureau of Land Management in the State.</text>
										</subparagraph></paragraph></subsection></section><section id="id18a147b9cfb743f6adf770961f301389"><enum>1403.</enum><header>Management</header>
 <subsection id="idc20ca22195a24a4491087ca8ba1b0ec6"><enum>(a)</enum><header>In general</header><text>The Secretary shall allow hiking, camping, hunting, and sightseeing and the use of motorized vehicles, mountain bikes, and horses on designated routes in the Management Area in a manner that—</text>
 <paragraph id="id9fc30d70b81845de8e0b6ae6dc700601"><enum>(1)</enum><text>is consistent with the purpose of the Management Area described in section 1402(b);</text> </paragraph><paragraph id="idb97ee75e3e394daa924c4b89b244ecf7"><enum>(2)</enum><text>ensures public health and safety; and</text>
 </paragraph><paragraph id="id8e1d2958fe0845f88610b16f6e5ab7ec"><enum>(3)</enum><text>is consistent with all applicable laws (including regulations) and the Desert Renewable Energy Conservation Plan.</text>
									</paragraph></subsection><subsection id="id2e5934d12a214060910372fab9de0f82"><enum>(b)</enum><header>Off-Highway vehicle use</header>
 <paragraph id="ideb9c3fe5afa34454841c4cbec894601e"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3) and all other applicable laws, the use of off-highway vehicles shall be permitted on routes in the Management Area generally depicted on the map.</text>
 </paragraph><paragraph id="idc55f0085c7094d8782223269886adc77"><enum>(2)</enum><header>Closure</header><text>The Secretary may temporarily close or permanently reroute a portion of a route described in paragraph (1)—</text>
 <subparagraph id="id476de3f9b02b4241bcae8694856263b1"><enum>(A)</enum><text>to prevent, or allow for restoration of, resource damage;</text> </subparagraph><subparagraph id="id9b2adb219129486989b6a5f6743140f3"><enum>(B)</enum><text>to protect tribal cultural resources, including the resources identified in the tribal cultural resources management plan developed under section 1805(c);</text>
 </subparagraph><subparagraph id="idf67fd1fa900b4de1a805c1989d3bea19"><enum>(C)</enum><text>to address public safety concerns; or</text> </subparagraph><subparagraph id="ided2a9d3814a14c339fff64c06e60399a"><enum>(D)</enum><text>as otherwise required by law.</text>
 </subparagraph></paragraph><paragraph id="ida9e736857f8148eda4ee464af551d6c1"><enum>(3)</enum><header>Designation of additional routes</header><text>During the 3-year period beginning on the date of enactment of this title, the Secretary—</text> <subparagraph id="id077eeb00fb4847aa8b54853aef96814d"><enum>(A)</enum><text>shall accept petitions from the public regarding additional routes for off-highway vehicles; and</text>
 </subparagraph><subparagraph id="id0226671f057641d285c216fb2d30fdcd"><enum>(B)</enum><text>may designate additional routes that the Secretary determines—</text> <clause id="id01a198a4c3554554ad21e83b5498f218"><enum>(i)</enum><text>would provide significant or unique recreational opportunities; and</text>
 </clause><clause id="id6ca75e37ab464e93af09d3f0fafb538b"><enum>(ii)</enum><text>are consistent with the purposes of the Management Area.</text> </clause></subparagraph></paragraph></subsection><subsection id="idba5c441b28424b57a9665546ae0e3a3e"><enum>(c)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the Management Area is withdrawn from—</text>
 <paragraph id="id833247c71db64ffeb35aafaca5757223"><enum>(1)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text> </paragraph><paragraph id="id2137be8dc18f4f408302c3d71f2d0230"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text>
 </paragraph><paragraph id="idb740749929264ec7b7a36e8e09dc5074"><enum>(3)</enum><text>right-of-way, leasing, or disposition under all laws relating to—</text> <subparagraph id="id2fac07e312844c25a5044481f9baab7b"><enum>(A)</enum><text>minerals; or</text>
 </subparagraph><subparagraph id="id04b3dfb43efe41689a5e4e0fbf592c35"><enum>(B)</enum><text>solar, wind, and geothermal energy.</text> </subparagraph></paragraph></subsection><subsection id="id81d1bfd4431947c698e51da0b81741e9"><enum>(d)</enum><header>No buffers</header><text>The establishment of the Management Area shall not—</text>
 <paragraph id="id1ad58fc0fcb44e948dff6e9060b9b8f5"><enum>(1)</enum><text>create a protective perimeter or buffer zone around the Management Area; or</text> </paragraph><paragraph id="id97b1d8e088e8445f9a433fae8a1ae7ee"><enum>(2)</enum><text>preclude uses or activities outside the Management Area that are permitted under other applicable laws, even if the uses or activities are prohibited within the Management Area.</text>
 </paragraph></subsection><subsection id="id489ae88bc2a44bb79d50b126746aebf8"><enum>(e)</enum><header>Notice of available routes</header><text>The Secretary shall ensure that visitors to the Management Area have access to adequate notice relating to the availability of designated routes in the Management Area through—</text>
 <paragraph id="idc62bd9600c424159b0f71eb8a84d9694"><enum>(1)</enum><text>the placement of appropriate signage along the designated routes;</text> </paragraph><paragraph id="ida9d4c548391949fd84543f8b7830748e"><enum>(2)</enum><text>the distribution of maps, safety education materials, and other information that the Secretary determines to be appropriate; and</text>
 </paragraph><paragraph id="id9a95860af818401e8b542d393a14c426"><enum>(3)</enum><text>restoration of areas that are not designated as open routes, including vertical mulching.</text> </paragraph></subsection><subsection id="ide96bf4579b2b4fd8a248fb4469c191ed"><enum>(f)</enum><header>Stewardship</header><text>The Secretary, in consultation with Indian tribes and other interests, shall develop a program to provide opportunities for monitoring and stewardship of the Management Area to minimize environmental impacts and prevent resource damage from recreational use, including volunteer assistance with—</text>
 <paragraph id="id3f0015bb1e8d4b869a12081469de02aa"><enum>(1)</enum><text>route signage;</text> </paragraph><paragraph id="id525d61cbaeaa41729bc2eaf41bb539e7"><enum>(2)</enum><text>restoration of closed routes;</text>
 </paragraph><paragraph id="ide78d585183004702910cf75303fd0b5a"><enum>(3)</enum><text>protection of Management Area resources; and</text> </paragraph><paragraph id="id12e5818c74334348bab0ea017b500904"><enum>(4)</enum><text>recreation education.</text>
 </paragraph></subsection><subsection id="id901dbb84bdfd406dac076c4a91a37e66"><enum>(g)</enum><header>Protection of tribal cultural resources</header><text>Not later than 2 years after the date of enactment of this title, the Secretary, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code, and any other applicable law, shall—</text>
 <paragraph id="id53f4648d09c346ce8770a5c5c6770552"><enum>(1)</enum><text>prepare and complete a tribal cultural resources survey of the Management Area; and</text> </paragraph><paragraph id="idc6bb4b56655a4dd5a4035ae52bbef918"><enum>(2)</enum><text>consult with the Quechan Indian Nation and other Indian tribes demonstrating ancestral, cultural, or other ties to the resources within the Management Area on the development and implementation of the tribal cultural resources survey under paragraph (1).</text>
									</paragraph></subsection></section><section id="idbe388a933d35410190bc18247b5e2311"><enum>1404.</enum><header>Potential wilderness</header>
								<subsection id="idea028e29b2fe4165aa1980833223c4a4"><enum>(a)</enum><header>Protection of wilderness character</header>
 <paragraph id="ideee549a79ba041ad8d3c0482dcfd9581"><enum>(1)</enum><header>In general</header><text>The Secretary shall manage the Federal land in the Management Area described in paragraph (2) in a manner that preserves the character of the land for the eventual inclusion of the land in the National Wilderness Preservation System.</text>
 </paragraph><paragraph id="id25d48be4f93a41e2829b7a9300c73784"><enum>(2)</enum><header>Description of land</header><text>The Federal land described in this paragraph is—</text> <subparagraph id="id73deeec5f2044cf0b7f1678c4d66a202"><enum>(A)</enum><text>the approximately 10,860 acres of land, as generally depicted as the Indian Pass Additions on the map entitled <quote>Vinagre Wash Proposed Special Management Area</quote> and dated November 10, 2009;</text>
 </subparagraph><subparagraph id="id0faa2a390a864b67a8865ac49a6e5667"><enum>(B)</enum><text>the approximately 17,250 acres of land, as generally depicted as Milpitas Wash Potential Wilderness on the map entitled <quote>Vinagre Wash Proposed Special Management Area</quote> and dated November 10, 2009;</text>
 </subparagraph><subparagraph id="idacd8a7932ab64f3493c96e11f2395937"><enum>(C)</enum><text>the approximately 11,840 acres of land, as generally depicted as Buzzards Peak Potential Wilderness on the map entitled <quote>Vinagre Wash Proposed Special Management Area</quote> and dated November 10, 2009; and</text>
 </subparagraph><subparagraph id="id1b7568d22fd44b1b873341bec24f498b"><enum>(D)</enum><text>the approximately 9,350 acres of land, as generally depicted as Palo Verde Mountains Potential Wilderness on the map entitled <quote>Vinagre Wash Proposed Special Management Area</quote> and dated November 10, 2009.</text>
										</subparagraph></paragraph><paragraph id="id417cf3f886c04db1b4de52177c14f20c"><enum>(3)</enum><header>Use of land</header>
 <subparagraph id="id48348db9fc0843358672bd89a6a48508"><enum>(A)</enum><header>Military uses</header><text>The Secretary shall manage the Federal land in the Management Area described in paragraph (2) in a manner that is consistent with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>), except that the Secretary may authorize use of the land by the Secretary of the Navy for Naval Special Warfare Tactical Training, including long-range small unit training and navigation, vehicle concealment, and vehicle sustainment training, in accordance with applicable Federal laws.</text>
 </subparagraph><subparagraph id="idd68e011e647a40469f94ba03cf6b4362"><enum>(B)</enum><header>Prohibited uses</header><text>The following shall be prohibited on the Federal land described in paragraph (2):</text> <clause id="idbbeae33825844a53af6e53345717e7a7"><enum>(i)</enum><text>Permanent roads.</text>
 </clause><clause id="id6e9f0aa131214a0e8900ef9a656a12e9"><enum>(ii)</enum><text>Commercial enterprises.</text> </clause><clause id="idbf128da8a4744f26809cff8c363fa93a"><enum>(iii)</enum><text>Except as necessary to meet the minimum requirements for the administration of the Federal land and to protect public health and safety—</text>
 <subclause id="id78109a0917a94b8e984f4f12b24cb840"><enum>(I)</enum><text>the use of mechanized vehicles; and</text> </subclause><subclause id="idf43187697a984b5abb1e87ae82e4f5a5"><enum>(II)</enum><text>the establishment of temporary roads.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="id8878b5e413e249748e843f1c53658cb3"><enum>(4)</enum><header>Wilderness designation</header>
 <subparagraph id="id23000c9c86c04efaa6de74459a02c9be"><enum>(A)</enum><header>In general</header><text>The Federal land described in paragraph (2) shall be designated as wilderness and as a component of the National Wilderness Preservation System on the date on which the Secretary, in consultation with the Secretary of Defense, publishes a notice in the Federal Register that all activities on the Federal land that are incompatible with the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>) have terminated.</text>
 </subparagraph><subparagraph id="id34d478573f0f4df0ae1779a73002a6d8"><enum>(B)</enum><header>Designation</header><text>On designation of the Federal land under clause (i)—</text> <clause id="idb30e074b2ab442d581999c260a7881fc"><enum>(i)</enum><text>the land described in paragraph (2)(A) shall be incorporated in, and shall be considered to be a part of, the Indian Pass Wilderness;</text>
 </clause><clause id="id3fa08bdd63ac4c998074200ac4f605ca"><enum>(ii)</enum><text>the land described in paragraph (2)(B) shall be designated as the <quote>Milpitas Wash Wilderness</quote>;</text> </clause><clause id="id2e1e9efcb1e544a9a4dbeb2eaed1ada5"><enum>(iii)</enum><text>the land described in paragraph (2)(C) shall be designated as the <quote>Buzzard Peak Wilderness</quote>; and</text>
 </clause><clause id="id544ddbe55b0244d9871343fb2394ae14"><enum>(iv)</enum><text>the land described in paragraph (2)(D) shall be incorporated in, and shall be considered to be a part of, the Palo Verde Mountains Wilderness.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idca2b5d093c974ec8ba08ce429822c3ff"><enum>(b)</enum><header>Administration of wilderness</header><text>Subject to valid existing rights, the land designated as wilderness or as a wilderness addition by this title shall be administered by the Secretary in accordance with this Act and the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>).</text>
								</subsection></section></title><title id="id8cf1b2bd9cae465db4baae4499974300"><enum>XV</enum><header>National park system additions</header>
							<section id="id557706bfafbe4db482f148df61830144"><enum>1501.</enum><header>Death valley national park boundary revision</header>
 <subsection id="id4ffd7330d0444c508b56dea795053d88"><enum>(a)</enum><header>In general</header><text>The boundary of Death Valley National Park is adjusted to include—</text> <paragraph id="idc77c33cd1dec46b599f7af19adc5ab19"><enum>(1)</enum><text>the approximately 33,000 acres of Bureau of Land Management land in Inyo County, California, abutting the southern end of the Death Valley National Park that lies between Death Valley National Park to the north and Ft. Irwin Military Reservation to the south and which runs approximately 34 miles from west to east, as depicted on the map entitled <quote>Death Valley National Park Proposed Boundary Addition-Bowling Alley</quote>, numbered 143/100,080C, and dated October 7, 2014; and</text>
 </paragraph><paragraph id="id55a2abb50d9e4fdeae7cae30497af728"><enum>(2)</enum><text>the approximately 6,369 acres of Bureau of Land Management land in Inyo County, California, located in the northeast area of Death Valley National Park that is within, and surrounded by, land under the jurisdiction of the Director of the National Park Service, as depicted on the map entitled <quote>Death Valley National Park Proposed Boundary Addition-Crater</quote>, numbered 143/100,079C, and dated October 7, 2014.</text>
 </paragraph></subsection><subsection id="id61c92b006efa479e96bee2f5073f839c"><enum>(b)</enum><header>Availability of map</header><text>The maps described in paragraphs (1) and (2) of subsection (a) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text>
 </subsection><subsection id="id3cbb21e76ea24078ab656d4a61683890"><enum>(c)</enum><header>Administration</header><text>The Secretary of the Interior (referred to in this title as the <quote>Secretary</quote>) shall—</text> <paragraph id="id34d3f527843245ddaecd76f666763a70"><enum>(1)</enum><text>administer any land added to Death Valley National Park under subsection (a)—</text>
 <subparagraph id="ida26f82c6ec87420198b09e8d4b86cbd7"><enum>(A)</enum><text>as part of Death Valley National Park; and</text> </subparagraph><subparagraph id="idb4702bd8eb694cb385f2e2e049a41115"><enum>(B)</enum><text>in accordance with applicable laws (including regulations); and</text>
 </subparagraph></paragraph><paragraph id="idf1fc9c6ad76d481d8cdc5ca11989870a"><enum>(2)</enum><text>not later than 180 days after the date of enactment of this title, develop a memorandum of understanding with Inyo County, California, permitting ongoing access and use to existing gravel pits along Saline Valley Road within Death Valley National Park for road maintenance and repairs in accordance with applicable laws (including regulations).</text>
 </paragraph></subsection></section><section id="id2e1e5754a3a54c648ab48ab600304408"><enum>1502.</enum><header>Mojave national preserve</header><text display-inline="no-display-inline">The boundary of the Mojave National Preserve is adjusted to include the 25 acres of Bureau of Land Management land in Baker, California, as depicted on the map entitled <quote>Mojave National Preserve Proposed Boundary Addition</quote>, numbered 170/100,199, and dated August 2009.</text>
							</section><section id="id6CD4CED968DB4CBCB69F4A60E8F32B89"><enum>1503.</enum><header>Joshua tree national park boundary revision</header>
 <subsection id="idd852583dde2947e3b08215f04a953543"><enum>(a)</enum><header>In general</header><text>The boundary of the Joshua Tree National Park is adjusted to include—</text> <paragraph id="id14e60c5757fc4277bd371d6570535814"><enum>(1)</enum><text>the 2,879 acres of land managed by Director of the Bureau of Land Management that are contiguous at several different places to the northern boundaries of Joshua Tree National Park in the northwest section of the Park, as depicted on the map entitled <quote>Joshua Tree National Park Proposed Boundary Additions</quote>, numbered 156/100,077, and dated August 2009; and</text>
 </paragraph><paragraph id="idc97f727036f1451b8dcf30df7d1751d6"><enum>(2)</enum><text>the 1,639 acres of land to be acquired from the Mojave Desert Land Trust that are contiguous at several different places to the northern boundaries of Joshua Tree National Park in the northwest section of the Park, as depicted on the map entitled <quote>Mojave Desert Land Trust National Park Service Additions</quote>, numbered 156/126,376, and dated September 2014.</text>
 </paragraph></subsection><subsection id="idc675c5218fd54c62b7f8003d0d4a1134"><enum>(b)</enum><header>Availability of maps</header><text>The map described in subsection (a) and the map depicting the 25 acres described in subsection (c)(2) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text>
								</subsection><subsection id="idf45d9be4c5dc47f98e2b157cffbcb907"><enum>(c)</enum><header>Administration</header>
 <paragraph id="idc597be4450d847a7b768255d52b2067d"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer any land added to the Joshua Tree National Park under subsection (a) and the additional land described in paragraph (2)—</text>
 <subparagraph id="id1f18b9c3cf0f4c32ace70d72aab805c9"><enum>(A)</enum><text>as part of Joshua Tree National Park; and</text> </subparagraph><subparagraph id="id9812c9843ae14a359183c339633b1c3c"><enum>(B)</enum><text>in accordance with applicable laws (including regulations).</text>
 </subparagraph></paragraph><paragraph id="id20de31efa3a541fa8ff1cc2f1ffc784f"><enum>(2)</enum><header>Description of additional land</header><text>The additional land referred to in paragraph (1) is the 25 acres of land—</text> <subparagraph id="id7df2dc88393e478d9d8281ef581e47bb"><enum>(A)</enum><text>depicted on the map entitled <quote>Joshua Tree National Park Boundary Adjustment Map</quote>, numbered 156/80,049, and dated April 1, 2003;</text>
 </subparagraph><subparagraph id="id82c055f643ae47ae94953882e88494d0"><enum>(B)</enum><text>added to Joshua Tree National Park by the notice of the Department of the Interior of August 28, 2003 (68 Fed. Reg. 51799); and</text>

										</subparagraph></paragraph></subsection><subsection id="id1fd9a0757520434594c95c8f1c5b03c1"><enum>(d)</enum><header>Southern California edison company energy transport facilities and rights-of-Way</header>
 <paragraph id="id9997ac864e4c46debb32353ca01a2090"><enum>(1)</enum><header>In general</header><text>Nothing in this title terminates any valid right-of-way for the customary operation, maintenance, upgrade, repair, relocation within an existing right-of-way, replacement, or other authorized energy transport facility activities in a right-of-way issued, granted, or permitted to the Southern California Edison Company or the predecessors, successors, or assigns of the Southern California Edison Company that is located on land described in paragraphs (1) and (2) of subsection (a), including, at a minimum, the use of mechanized vehicles, helicopters, or other aerial devices.</text>
 </paragraph><paragraph id="idb46e5a0c7b2447aeaf7637570982cce9"><enum>(2)</enum><header>Upgrades and replacements</header><text>Nothing in this title prohibits the upgrading or replacement of—</text> <subparagraph id="id3306F0CAF26747AF9524E2EF76B0B01A"><enum>(A)</enum><text>Southern California Edison Company energy transport facilities, including the energy transport facilities referred to as the Jellystone, Burnt Mountain, Whitehorn, Allegra, and Utah distribution circuits rights-of-way; or</text>
 </subparagraph><subparagraph id="idC5C7F81B0DE14BB7A8962E8D59043550"><enum>(B)</enum><text>an energy transport facility in rights-of-way issued, granted, or permitted by the Secretary adjacent to Southern California Edison Joshua Tree Utility Facilities.</text>
 </subparagraph></paragraph><paragraph id="id0ffea3e3b3a245659d2b5a5512042ed9"><enum>(3)</enum><header>Publication of plans</header><text>Not later than the date that is 1 year after the date of enactment of this title or the issuance of a new energy transport facility right-of-way within the Joshua Tree National Park, whichever is earlier, the Secretary, in consultation with the Southern California Edison Company, shall publish plans for regular and emergency access by the Southern California Edison Company to the rights-of-way of the Southern California Edison Company within Joshua Tree National Park.</text>
 </paragraph></subsection></section><section id="id71b7578654cf45fdbccb8e8fe3d64766"><enum>1504.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this title.</text> </section></title><title id="id56f529b5a2a64e309c38014caedf53d4"><enum>XVI</enum><header>Off-highway vehicle recreation areas</header> <section id="id8a5f3f2f7018417ea4be104ca4421c05"><enum>1601.</enum><header>Designation of off-highway vehicle recreation areas</header> <subsection id="idbd823e1984624f43982ee2292b01e7a2"><enum>(a)</enum><header>In general</header> <paragraph id="id12D42014D6D74A37ABF7F086C77555D6"><enum>(1)</enum><header>Designation</header><text>In accordance with the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) and resource management plans developed under this title and subject to valid rights, the following land within the Conservation Area in San Bernardino County, California, is designated as Off-Highway Vehicle Recreation Areas:</text>
 <subparagraph id="idfc9da18d22b5420d8ab23aecd11fa231"><enum>(A)</enum><header>Dumont Dunes Off-Highway Vehicle Recreation Area</header><text>Certain Bureau of Land Management land in the Conservation Area, comprising approximately 7,630 acres, as generally depicted on the map entitled <quote>Dumont Dunes Proposed National OHV Recreation Area</quote> and dated January 5, 2015, which shall be known as the <quote>Dumont Dunes Off-Highway Vehicle Recreation Area</quote>.</text>
 </subparagraph><subparagraph id="idafc8d1a1d52b45dab479c95694f23e6b"><enum>(B)</enum><header>El Mirage Off-Highway Vehicle Recreation Area</header><text>Certain Bureau of Land Management land in the Conservation Area, comprising approximately 14,930 acres, as generally depicted on the map entitled <quote>El Mirage Proposed National OHV Recreation Area</quote> and dated July 15, 2009, which shall be known as the <quote>El Mirage Off-Highway Vehicle Recreation Area</quote>.</text>
 </subparagraph><subparagraph id="ida6b9e358e0644eaa952d9ed4e44a9b49"><enum>(C)</enum><header>Rasor Off-Highway Vehicle Recreation Area</header><text>Certain Bureau of Land Management land in the Conservation Area, comprising approximately 23,910 acres, as generally depicted on the map entitled <quote>Rasor Proposed National OHV Recreation Area</quote> and dated July 15, 2009, which shall be known as the <quote>Rasor Off-Highway Vehicle Recreation Area</quote>.</text>
 </subparagraph><subparagraph id="iddc04fcebd0754e9cbf0b40c15e841533"><enum>(D)</enum><header>Spangler Hills Off-Highway Vehicle Recreation Area</header><text>Certain Bureau of Land Management land in the Conservation Area, comprising approximately 56,140 acres, as generally depicted on the map entitled <quote>Spangler Hills Proposed National OHV Recreation Area</quote> and dated February 19, 2016, which shall be known as the <quote>Spangler Off-Highway Vehicle Recreation Area</quote>.</text>
 </subparagraph><subparagraph id="id00f0cc750713406f946433943a0a8aa8"><enum>(E)</enum><header>Stoddard Valley Off-Highway Vehicle Recreation Area</header><text>Certain Bureau of Land Management land in the Conservation Area, comprising approximately 40,110 acres, as generally depicted on the map entitled <quote>Stoddard Valley Proposed National OHV Recreation Area</quote> and dated July 16, 2009, which shall be known as the <quote>Stoddard Valley Off-Highway Vehicle Recreation Area</quote>.</text>
										</subparagraph></paragraph><paragraph id="id059ca696d94c4b6d9719823a67dfda35"><enum>(2)</enum><header>Redesignation and expansion of Johnson Valley Off-Highway Vehicle Recreation Area</header>
 <subparagraph id="id65e690ba9f6741baadb3f6f54ecdceae"><enum>(A)</enum><header>In general</header><text>The Johnson Valley Off-Highway Vehicle Recreation Area designated by section 2945 of the Military Construction Authorization Act for Fiscal Year 2014 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 1038)—</text>
 <clause id="id60df9fbeb5f548f8962ff04b7013f157"><enum>(i)</enum><text>is redesignated as the <quote>Johnson Valley National Off-Highway Vehicle Recreation Area</quote>; and</text> </clause><clause id="id22c57335978a4ac3a909543482b144eb"><enum>(ii)</enum><text>is expanded to include certain land as generally depicted on the map entitled <quote>Proposed Johnson Valley Off-Highway Vehicle Recreation Area Additions</quote> and dated September 27, 2016.</text>
 </clause></subparagraph><subparagraph id="ide3013b2b6ba346e0b80f78776c15a9a6"><enum>(B)</enum><header>Relation to authorized Navy use</header><text>The redesignation of the Johnson Valley Off-Highway Vehicle Recreation Area as the Johnson Valley National Off-Highway Vehicle Recreation Area does not alter or interfere with the rights and obligations of the Navy regarding the use of portions of the Recreation Area as provided in subtitle C of title XXIX of the Military Construction Authorization Act for Fiscal Year 2014 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 1034).</text>
 </subparagraph><subparagraph id="id5c4ce9bc39f349bc8bbac98de0ec38a6"><enum>(C)</enum><header>References</header><text>Any reference in any law, regulation, document, record, map, or other paper of the United States to the Johnson Valley Off-Highway Vehicle Recreation Area shall be deemed to be a reference to the Johnson Valley National Off-Highway Vehicle Recreation Area.</text>
 </subparagraph></paragraph></subsection><subsection id="id3a3227668b34476facaae2c6d037c9c9"><enum>(b)</enum><header>Purpose</header><text>The purpose of the off-highway vehicle recreation areas designated or expanded under subsection (a) is to preserve and enhance the recreational opportunities within the Conservation Area (including opportunities for off-highway vehicle recreation), while conserving the wildlife and other natural resource values of the Conservation Area.</text>
								</subsection><subsection id="id98468ef01dfb4250a7cbad73d6e723aa"><enum>(c)</enum><header>Maps and descriptions</header>
 <paragraph id="id6ad24143044a4b0885b1983af72f3b17"><enum>(1)</enum><header>Preparation and submission</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall file a map and legal description of each off-highway vehicle recreation area designated or expanded by subsection (a) with—</text>
 <subparagraph id="id682931b38d8249be9d3b87ad2a727b2f"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text> </subparagraph><subparagraph id="id2149064b7a13499faf964db8639636f7"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text>
 </subparagraph></paragraph><paragraph id="id42e46b518dd94edf93a8b1f376b36e67"><enum>(2)</enum><header>Legal effect</header><text>The map and legal descriptions of the off-highway vehicle recreation areas filed under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct errors in the map and legal descriptions.</text>
 </paragraph><paragraph id="idf8f65a1c5ef8460591e0186fd7a29fdd"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be filed and made available for public inspection in the appropriate offices of the Bureau of Land Management.</text>
									</paragraph></subsection><subsection id="id3bc4cc84fff94dad832bf8f030c56807"><enum>(d)</enum><header>Use of the land</header>
									<paragraph id="id404d1528e15f4956a796bb66d2c1f2fc"><enum>(1)</enum><header>Recreational activities</header>
 <subparagraph id="id63b9ec0a15284654967104dcd9c60b73"><enum>(A)</enum><header>In general</header><text>The Secretary shall continue to authorize, maintain, and enhance the recreational uses of the off-highway vehicle recreation areas designated or expanded by subsection (a), including off-highway recreation, hiking, camping, hunting, mountain biking, sightseeing, rockhounding, and horseback riding, as long as the recreational use is consistent with this section and any other applicable law.</text>
 </subparagraph><subparagraph id="id96d8af5fd25c44b6a0d9e869cc7d83a2"><enum>(B)</enum><header>Off-highway vehicle and off-highway recreation</header><text>To the extent consistent with applicable Federal law (including regulations) and this section, any authorized recreation activities and use designations in effect on the date of enactment of this title and applicable to the off-highway vehicle recreation areas designated or expanded by subsection (a) shall continue, including casual off-highway vehicular use, racing, competitive events, rock crawling, training, and other forms of off-highway recreation.</text>
 </subparagraph></paragraph><paragraph id="idb6d42844680447b096de9b928aa12855"><enum>(2)</enum><header>Wildlife guzzlers</header><text>Wildlife guzzlers shall be allowed in the off-highway vehicle recreation areas designated or expanded by subsection (a) in accordance with—</text>
 <subparagraph id="id78078712D9BA4DCF8F67B372B8B32272"><enum>(A)</enum><text>applicable Bureau of Land Management guidelines; and</text>
 </subparagraph><subparagraph id="id15D345206F1444B9881E89401137BF4B"><enum>(B)</enum><text>State law.</text> </subparagraph></paragraph><paragraph id="idb2a02ac5ad29417aa7d6f8c2197a61f5"><enum>(3)</enum><header>Prohibited uses</header><text>Commercial development (including development of mining and energy facilities, but excluding energy transport facilities, rights-of-way, and related telecommunication facilities) shall be prohibited in the off-highway vehicle recreation areas designated or expanded by subsection (a) if the Secretary determines that the development is incompatible with the purpose described in subsection (b).</text>
									</paragraph></subsection><subsection id="idde9eeafb4bdc427e9884fd8a056915b0"><enum>(e)</enum><header>Administration</header>
 <paragraph id="ide7e5c3b36c2943cfbd47d8f909327cd9"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the off-highway vehicle recreation areas designated or expanded by subsection (a) in accordance with—</text>
 <subparagraph id="ide3860476d8e144f0bd5043c9f998765f"><enum>(A)</enum><text>this title;</text> </subparagraph><subparagraph id="id063973419abc49e2a8d47d8de17681b3"><enum>(B)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="id8dc63d1b6ff847708bbbf4856897fdfe"><enum>(C)</enum><text>any other applicable laws (including regulations).</text> </subparagraph></paragraph><paragraph id="id2052594fa0fb41d6be23b4d5eedadde0"><enum>(2)</enum><header>Management plan</header> <subparagraph id="id11c279c66f9e40259a6969479f4e13a1"><enum>(A)</enum><header>In general</header><text>As soon as practicable, but not later than 3 years after the date of enactment of this title, the Secretary shall—</text>
 <clause id="id80b5cf97719949e892fd8418f365b739"><enum>(i)</enum><text>amend existing resource management plans applicable to the off-highway vehicle recreation areas designated or expanded by subsection (a); or</text>
 </clause><clause id="ide031dbc8bce14d2bb03745fdd6ce4dbf"><enum>(ii)</enum><text>develop new management plans for each off-highway vehicle recreation area designated or expanded under that subsection.</text>
 </clause></subparagraph><subparagraph id="idbaa86fdebd12476ba090a0330f327c58"><enum>(B)</enum><header>Requirements</header><text>All new or amended plans under subparagraph (A) shall be designed to preserve and enhance safe off-highway vehicle and other recreational opportunities within the applicable recreation area consistent with—</text>
 <clause id="id6f9421698a954fecbcc4f8cbd076fa4e"><enum>(i)</enum><text>the purpose described in subsection (b); and</text> </clause><clause id="idbf8c5552ece849d5b2b0c89ca3c5133c"><enum>(ii)</enum><text>any applicable laws (including regulations).</text>
 </clause></subparagraph><subparagraph id="id0eb4cd188c694fa398a4113abc205df9"><enum>(C)</enum><header>Interim plans</header><text>Pending completion of a new management plan under subparagraph (A), the existing resource management plans shall govern the use of the applicable off-highway vehicle recreation area.</text>
										</subparagraph></paragraph></subsection><subsection id="id3c9e9180e35f4684bef05d85d0934e5b"><enum>(f)</enum><header>Study</header>
 <paragraph id="idc6bd86a6c8d746da97f0fef0168ca58c"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 2 years, after the date of enactment of this title, the Secretary shall complete a study to identify Bureau of Land Management land within the Conservation Area that is suitable for addition to the national off-highway vehicle recreation areas designated or expanded by subsection (a).</text>
 </paragraph><paragraph id="id60b286522d7543e4be8655bbe6ce99cb"><enum>(2)</enum><header>Study areas</header><text>The study required under paragraph (1) shall include—</text> <subparagraph id="ide63a314ee4734b3fa0cdd13ccaf38766"><enum>(A)</enum><text>certain Bureau of Land Management land in the Conservation Area, comprising approximately 41,000 acres, as generally depicted on the map entitled <quote>Spangler Hills Proposed Expansion Study Area</quote> and dated January 23, 2015;</text>
 </subparagraph><subparagraph id="idd2b3b8937de94e10ad13309da212c152"><enum>(B)</enum><text>certain Bureau of Land Management land in the Conservation Area, comprising approximately 680 acres, as generally depicted on the map entitled <quote>El Mirage Proposed Expansion Study Area</quote> and dated January 21, 2015; and</text>
 </subparagraph><subparagraph id="id0219fd0ff85d4054bc9368f531e294da"><enum>(C)</enum><text>certain Bureau of Land Management land in the Conservation Area, comprising approximately 51,600 acres, as generally depicted on the map entitled <quote>Johnson Valley Proposed Expansion Study Area</quote> and dated September 27, 2016.</text>
 </subparagraph></paragraph><paragraph id="id984bfc19ed9a44e3b2c55fefe54d6dab"><enum>(3)</enum><header>Requirements</header><text>In preparing the study under paragraph (1), the Secretary shall—</text> <subparagraph id="idc970528e0b454f18ba1a934abeb74279"><enum>(A)</enum><text>seek input from stakeholders, including—</text>
 <clause id="id460aa32dd3c04ab7b294d6366ea1a005"><enum>(i)</enum><text>the State, including—</text> <subclause id="id81448F9EE33A48D79EFE4A7090C07EDE"><enum>(I)</enum><text>the California Public Utilities Commission; and</text>
 </subclause><subclause id="id0B9FE4FCCF37487090D4996CC0FE97D1"><enum>(II)</enum><text>the California Energy Commission;</text>
 </subclause></clause><clause id="id88618253d08844f598ba75bf271fc497"><enum>(ii)</enum><text>San Bernardino County, California;</text> </clause><clause id="id3b6afbcb4d5442beba97eece2bc56bd8"><enum>(iii)</enum><text>the public;</text>
 </clause><clause id="id71e972271cc74d6b8edf93c12c65b084"><enum>(iv)</enum><text>recreational user groups;</text> </clause><clause id="idd0c0d92dfeea42c0912536ac657d947a"><enum>(v)</enum><text>conservation organizations;</text>
 </clause><clause id="id2008bf3caa69435abeaa9ba98e8c65a8"><enum>(vi)</enum><text>the Southern California Edison Company;</text> </clause><clause id="id558a7171c3084d43912d8045f52de1cd"><enum>(vii)</enum><text>the Pacific Gas and Electric Company; and</text>
 </clause><clause id="id1282f35d2e1248ebb12ec3e33658c5bc"><enum>(viii)</enum><text>other Federal agencies, including the Department of Defense;</text> </clause></subparagraph><subparagraph id="iddbedbb0d55a74561b171710d3ae40cdb"><enum>(B)</enum><text>explore the feasibility of—</text>
 <clause id="id60A15A10ED5B41389CA38735257376F2"><enum>(i)</enum><text>expanding the southern boundary of the off-highway vehicle recreation area described in subsection (a)(1)(C) to include previously disturbed land; and</text>
 </clause><clause id="id3aece3ee726145299148870cb3d7e475"><enum>(ii)</enum><text>establishing a right-of-way for off-highway vehicle use in the areas identified in paragraph (2) to the extent necessary to connect the noncontiguous areas of the Johnson Valley National Off-Highway Vehicle Recreation Area;</text>
 </clause></subparagraph><subparagraph id="idd99a8277636e483d9a8c81486cf09b5e"><enum>(C)</enum><text>identify and exclude from consideration any land that—</text> <clause id="id25664788f7904dadb54e73ed04090a58"><enum>(i)</enum><text>is managed for conservation purposes;</text>
 </clause><clause id="id76e501485e04497190d27a632e5f4565"><enum>(ii)</enum><text>may be suitable for renewable energy development; or</text> </clause><clause id="idd5a26afc2e12465dabdaebff25a1e2b0"><enum>(iii)</enum><text>may be necessary for energy transmission; and</text>
 </clause></subparagraph><subparagraph id="id763e29cc0240453f9144a3651c6ffdb1"><enum>(D)</enum><text>not recommend or approve expansion of national off-highway recreation areas within the Conservation Area that collectively would exceed the total acres administratively designated for off-highway recreation within the Conservation Area as of the day before the date of enactment of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 672).</text>
 </subparagraph></paragraph><paragraph id="ida17c26208e054dac84a7700272abd705"><enum>(4)</enum><header>Applicable law</header><text>The Secretary shall consider the information and recommendations of the study completed under paragraph (1) to determine the impacts of expanding off-highway vehicle recreation areas designated or expanded by subsection (a) on the Conservation Area, in accordance with—</text>
 <subparagraph id="id33db8dad0eda4885ac870302671a28ac"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text> </subparagraph><subparagraph id="idfb39d9b309464bb8b9bebb11774525f5"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="idb4355cf5746e41aa834ca17238d4b7cb"><enum>(C)</enum><text>any other applicable law (including regulations), plan, and the Desert Renewable Energy Conservation Plan.</text>
 </subparagraph></paragraph><paragraph id="ida98dfd0e62064e3f8ced974f9652947f"><enum>(5)</enum><header>Submission to Congress</header><text>On completion of the study under paragraph (1), the Secretary shall submit the study to—</text> <subparagraph id="id0e9254c753a44875922d983861a8d612"><enum>(A)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text>
 </subparagraph><subparagraph id="id52487b40f4724ab1bf45ed789d23e703"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text> </subparagraph></paragraph><paragraph id="id5e8875d2ed234e059ae415f099efa04c"><enum>(6)</enum><header>Authorization for expansion</header> <subparagraph id="id86dce56152f248ac90e8cc5c4d3fb22d"><enum>(A)</enum><header>In general</header><text>On completion of the study under paragraph (1) and in accordance with all applicable laws (including regulations), the Secretary shall authorize the expansion of the off-highway vehicle recreation areas recommended under the study.</text>
 </subparagraph><subparagraph id="idc8ab1118003148d39bb12830a7668dbc"><enum>(B)</enum><header>Management</header><text>Any land within the expanded areas under subparagraph (A) shall be managed in accordance with this section.</text>
										</subparagraph></paragraph></subsection><subsection id="idb8e0d4641b0e4a62b7efcbf1a17b993e"><enum>(g)</enum><header>Southern California Edison Company utility facilities and rights-of-Way</header>
 <paragraph id="id1ce14490ce734efc9f6d016b207c18a4"><enum>(1)</enum><header>Effect of title</header><text>Nothing in this title—</text> <subparagraph id="idCE638043FB0042CEBE8647F427B77C5E"><enum>(A)</enum><text>terminates any validly issued right-of-way for the customary operation, maintenance, upgrade, repair, relocation within an existing right-of-way, replacement, or other authorized energy transport facility activities (including the use of any mechanized vehicle, helicopter, and other aerial device) in a right-of-way issued, granted, or permitted to Southern California Edison Company (including any predecessor or successor in interest or assign) that is located on land included in—</text>
 <clause id="id8EC140DD259643259BC074F2650C1D0B"><enum>(i)</enum><text>the El Mirage Off-Highway Vehicle Recreation Area;</text> </clause><clause id="id35A28C74A3E647BC89B9C8AD6CD3190B"><enum>(ii)</enum><text>the Spangler Hills National Off-Highway Vehicle Recreation Area; or</text>
 </clause><clause id="id6E02755009C64E05AAE1AABF166D80BA"><enum>(iii)</enum><text>the Stoddard Valley National Off Highway Vehicle Recreation Area;</text> </clause></subparagraph><subparagraph id="id6c2e6f93f47d47caa02a90d2f3fbaa48"><enum>(B)</enum><text>affects the application, siting, route selection, right-of-way acquisition, or construction of the Coolwater-Lugo transmission project, as may be approved by the California Public Utilities Commission and the Bureau of Land Management; or</text>
 </subparagraph><subparagraph id="id2e3689470348404b811077bf0f5b7637"><enum>(C)</enum><text>prohibits the upgrading or replacement of any Southern California Edison Company—</text>
 <clause id="id3B74AE6F1A944B62B0EB9DC8DFB20020"><enum>(i)</enum><text>utility facility, including such a utility facility known on the date of enactment of this title as—</text>
 <subclause id="id9B8979B62AA1405787782DAEAEB1A595"><enum>(I)</enum><text><quote>Gale-PS 512 transmission lines or rights-of-way</quote>; or</text>
 </subclause><subclause id="idB25BCA0AC41141609A7FBE392E6D94FB"><enum>(II)</enum><text><quote>Patio, Jack Ranch, and Kenworth distribution circuits or rights-of-way</quote>; or</text>
 </subclause></clause><clause id="id5A7BC480AF5B41B4A7C5DF4D95EDF484"><enum>(ii)</enum><text>energy transport facility in a right-of-way issued, granted, or permitted by the Secretary adjacent to a utility facility referred to in clause (i).</text>
 </clause></subparagraph></paragraph><paragraph id="id2a7a5ed0c08f4a5e905bc2bca9e23650"><enum>(2)</enum><header>Plans for access</header><text>The Secretary, in consultation with the Southern California Edison Company, shall publish plans for regular and emergency access by the Southern California Edison Company to the rights-of-way of the Company by the date that is 1 year after the later of—</text>
 <subparagraph id="id8A6BCA3E74DD495196DD4C7CB0056069"><enum>(A)</enum><text>the date of enactment of this title; and</text> </subparagraph><subparagraph id="id5BDE1DEC71AB4324B41432850083209D"><enum>(B)</enum><text>the date of issuance of a new energy transport facility right-of-way within—</text>
 <clause id="id5974AAFFEC8C4636B4A9504513E6744D"><enum>(i)</enum><text>the El Mirage Off-Highway Vehicle Recreation Area;</text> </clause><clause id="idC9D5063DC4404C289813774D636221B7"><enum>(ii)</enum><text>the Spangler Hills National Off-Highway Vehicle Recreation Area; or</text>
 </clause><clause id="idA70ACD6B9EBF4A229E3E79A715828EFD"><enum>(iii)</enum><text>the Stoddard Valley National Off Highway Vehicle Recreation Area.</text> </clause></subparagraph></paragraph></subsection><subsection id="id15343418B1CB404D9422F962F35AE50A"><enum>(h)</enum><header>Pacific Gas and Electric Company utility facilities and rights-of-Way</header> <paragraph id="idE66EE041849C474198E8584B27C948EC"><enum>(1)</enum><header>Effect of title</header><text>Nothing in this title—</text>
 <subparagraph id="id7B41148DBA13490E92ED7DB5144BB5E4"><enum>(A)</enum><text>terminates any validly issued right-of-way for the customary operation, maintenance, upgrade, repair, relocation within an existing right-of-way, replacement, or other authorized activity (including the use of any mechanized vehicle, helicopter, and other aerial device) in a right-of-way issued, granted, or permitted to Pacific Gas and Electric Company (including any predecessor or successor in interest or assign) that is located on land included in the Spangler Hills National Off-Highway Vehicle Recreation Area; or</text>
 </subparagraph><subparagraph id="id3BDB1EE4364940ADA840BA07397C0D5C"><enum>(B)</enum><text>prohibits the upgrading or replacement of any—</text> <clause id="id83E8DC52DF9B443793414C15F46A8A8E"><enum>(i)</enum><text>utility facilities of the Pacific Gas and Electric Company, including those utility facilities known on the date of enactment of this title as—</text>
 <subclause id="id5A60B2DF062744A195201E34376E1687"><enum>(I)</enum><text><quote>Gas Transmission Line 311 or rights-of-way</quote>; or</text> </subclause><subclause id="idEF40E2E589654E0AB33DF1C1070DB3E1"><enum>(II)</enum><text><quote>Gas Transmission Line 372 or rights-of-way</quote>; or</text>
 </subclause></clause><clause id="id1EA804295DB64CAE9A2A1390D8F02CB2"><enum>(ii)</enum><text>utility facilities of the Pacific Gas and Electric Company in rights-of-way issued, granted, or permitted by the Secretary adjacent to a utility facility referred to in clause (i).</text>
 </clause></subparagraph></paragraph><paragraph id="id495FDEB7C6C44BC3B780ACEFFE8EBC1F"><enum>(2)</enum><header>Plans for access</header><text>Not later than 1 year after the date of enactment of this title or the issuance of a new utility facility right-of-way within the Spangler Hills National Off-Highway Vehicle Recreation Area, whichever is later, the Secretary, in consultation with the Pacific Gas and Electric Company, shall publish plans for regular and emergency access by the Pacific Gas and Electric Company to the rights-of-way of the Pacific Gas and Electric Company.</text>
									</paragraph></subsection></section></title><title id="id995d5903d77c47419c5359c188dbe414"><enum>XVII</enum><header>Alabama Hills National Scenic Area</header>
 <section id="id21ca22c111554d15886ff31ec74495c3"><enum>1701.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="id73e2c15514364eaf8da4fa38a8f8fc52"><enum>(1)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the National Scenic Area developed under section 1703(a).</text>
 </paragraph><paragraph id="id28d58ec35690423b80e2f4a610bf2471"><enum>(2)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Proposed Alabama Hills National Scenic Area</quote> and dated September 8, 2014.</text> </paragraph><paragraph id="idfe38c952292343598c6209da2737b479"><enum>(3)</enum><header>Motorized vehicle</header><text>The term <term>motorized vehicle</term> means a motorized or mechanized vehicle and includes, when used by a utility, mechanized equipment, a helicopter, and any other aerial device necessary to maintain electrical or communications infrastructure.</text>
 </paragraph><paragraph id="id6eebc6d6507640369cf50e186b4f1d89"><enum>(4)</enum><header>National Scenic Area</header><text>The term <term>National Scenic Area</term> means the Alabama Hills National Scenic Area established by section 1702(a).</text> </paragraph><paragraph id="id80697253f0494e129679aaf2af40f30d"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
 </paragraph><paragraph id="idca702a24f2004b1999c07c450f03f739"><enum>(6)</enum><header>State</header><text>The term <term>State</term> means the State of California.</text> </paragraph><paragraph id="id470e898625eb4d8f8357c086c9585de9"><enum>(7)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Lone Pine Paiute-Shoshone Tribe.</text>
 </paragraph><paragraph id="id313bf91b0cb941fab9053df415a41183"><enum>(8)</enum><header>Utility facility</header><text>The term <term>utility facility</term> means any existing or future—</text> <subparagraph id="id6F64B136D29647FF92F81903E45BCCEE"><enum>(A)</enum><text>water system facility, including aqueducts, streams, ditches, and canals;</text>
 </subparagraph><subparagraph id="id26551ad8b4e7420e8ed55d2099007ac9"><enum>(B)</enum><text>water facility, including flow measuring stations, gauges, gates, valves, piping, conduits, fencing, and electrical power and communications devices and systems;</text>
 </subparagraph><subparagraph id="id388f214986434843a674fd6e4cf3dccb"><enum>(C)</enum><text>electric generation facility, electric storage facility, or overhead or underground electrical supply system or communication system, consisting of electric substations, electric lines, poles and towers made of various materials, <quote>H</quote> frame structures, guy wires and anchors, crossarms, wires, underground conduits, cables, vaults, manholes, handholes, above-ground enclosures, markers and concrete pads, or other fixtures, appliances, or communication circuits; or</text>
 </subparagraph><subparagraph id="id2e30b0bbb6814e36942556860e4e73b7"><enum>(D)</enum><text>other fixture, appliance, or appurtenance that is—</text> <clause id="id9a1a928febd2488f9490bc84c71f496c"><enum>(i)</enum><text>connected with a facility or system described in subparagraph (C);</text>
 </clause><clause id="id245d6a3f806b40a79581b5a22ee0e870"><enum>(ii)</enum><text>necessary or convenient for the construction, operation, regulation, control, grounding, and maintenance of electric generation, storage, lines, and communication circuits; or</text>
 </clause><clause id="id53091f8589b0435c97a4fe7703276372"><enum>(iii)</enum><text>used for the purpose of—</text> <subclause id="idEB9BF2A2903045F3A81B0B322B9CFDA7"><enum>(I)</enum><text>transmitting information relating to this title; or</text>
 </subclause><subclause id="id3fd56eaafaa2499e8a7e97ae46ce6a1a"><enum>(II)</enum><text>generating, storing, distributing, regulating, or controlling electric energy to be used for light, heat, power, communication, or other purposes.</text>
											</subclause></clause></subparagraph></paragraph></section><section id="id2a8873f40d0745bbb0beb466e509f684"><enum>1702.</enum><header>Alabama Hills National Scenic Area, California</header>
 <subsection id="id46cdc8739b924867abe826d060123c82"><enum>(a)</enum><header>Establishment</header><text>Subject to valid existing rights, there is established in Inyo County, California, the Alabama Hills National Scenic Area, to be comprised of the approximately 18,610 acres generally depicted on the Map as <quote>National Scenic Area</quote>.</text>
 </subsection><subsection id="id6590cccaa5864a5b8da25034cb0d711a"><enum>(b)</enum><header>Purpose</header><text>The purpose of the National Scenic Area is to conserve, protect, and enhance for the benefit, use, and enjoyment of present and future generations the nationally significant scenic, cultural, geological, educational, biological, historical, recreational, cinematographic, and scientific resources of the National Scenic Area managed consistent with section 302(a) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1732">43 U.S.C. 1732(a)</external-xref>).</text>
								</subsection><subsection id="id8FE276E12626498A8BD049FDED9C5FF6"><enum>(c)</enum><header>Map; legal descriptions</header>
 <paragraph id="idc39565a5d96f4baea5b77702b8f2adad"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall file a map and a legal description of the National Scenic Area with—</text>
 <subparagraph id="id8e8df48005d84861997a58a87c669c9c"><enum>(A)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text> </subparagraph><subparagraph id="id70cd5ff6e566470a9cd84c63aa57629d"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text>
 </subparagraph></paragraph><paragraph id="id59ff7edaedfa4cce883a1593ec674b00"><enum>(2)</enum><header>Force of law</header><text>The map and legal descriptions filed under paragraph (1) shall have the same force and effect as if included in this title, except that the Secretary may correct any clerical and typographical errors in the map and legal descriptions.</text>
 </paragraph><paragraph id="id4bebf8f2f1204694a3aafc8c5b2d5aa3"><enum>(3)</enum><header>Public availability</header><text>Each map and legal description filed under paragraph (1) shall be on file and available for public inspection in the appropriate offices of the Forest Service and the Bureau of Land Management.</text>
 </paragraph></subsection><subsection id="id6d19cba207ab4c67ac4cdd409e621a3d"><enum>(d)</enum><header>Administration</header><text>The Secretary shall manage the National Scenic Area—</text> <paragraph id="id4249c039fb304ccdb362c2811cea83af"><enum>(1)</enum><text>as a component of the National Landscape Conservation System;</text>
 </paragraph><paragraph id="idfb422c9d105141dda2a65da3afbbfcd8"><enum>(2)</enum><text>so as not to impact the future continuing operation and maintenance of any activities associated with valid, existing rights, including water rights;</text>
 </paragraph><paragraph id="id637ca4f75e7f4750b2801d19072a5cb4"><enum>(3)</enum><text>in a manner that conserves, protects, and enhances the resources and values of the National Scenic Area described in subsection (b); and</text>
 </paragraph><paragraph id="idb64f93a47dc64f2e9d5a87c5129f977c"><enum>(4)</enum><text>in accordance with—</text> <subparagraph id="id5e75a50513d543cab044d485aade8633"><enum>(A)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text>
 </subparagraph><subparagraph id="id268e308c332847508fdcf9df9980a67d"><enum>(B)</enum><text>this title; and</text> </subparagraph><subparagraph id="id928a13eb9cb042589d28fc1cfb03bf48"><enum>(C)</enum><text>any other applicable laws.</text>
										</subparagraph></paragraph></subsection><subsection id="idcd6d45eabf554d4d8edc3d57d9de1c92"><enum>(e)</enum><header>Management</header>
 <paragraph id="id7fa6fe31c3f54ceeb5ec0b84ec8adfb5"><enum>(1)</enum><header>In general</header><text>The Secretary shall allow only such uses of the National Scenic Area as the Secretary determines would support the purposes of the National Scenic Area as described in subsection (b).</text>
 </paragraph><paragraph id="id83b0ef19cb9f45b2bf0c16e699adde69"><enum>(2)</enum><header>Recreational activities</header><text>Except as otherwise provided in this title or other applicable law, or as the Secretary determines to be necessary for public health and safety, the Secretary shall allow existing recreational uses of the National Scenic Area to continue, including hiking, mountain biking, rock climbing, sightseeing, horseback riding, hunting, fishing, and appropriate authorized motorized vehicle use.</text>
 </paragraph><paragraph id="id2aeae05c987740059d78e19a97f224d0"><enum>(3)</enum><header>Motorized vehicles</header><text>Except as otherwise specified in this title, or as necessary for administrative purposes or to respond to an emergency, the use of motorized vehicles in the National Scenic Area shall be permitted only on—</text>
 <subparagraph id="idac4a0b9fccfa4230afc13243e0c7be06"><enum>(A)</enum><text>roads and trails designated by the Director of the Bureau of Land Management for use of motorized vehicles as part of a management plan sustaining a semiprimitive motorized experience; or</text>
 </subparagraph><subparagraph id="id3b94433ef21a4db696baacc1e3a0fa1e"><enum>(B)</enum><text>county-maintained roads in accordance with applicable State and county laws.</text> </subparagraph></paragraph></subsection><subsection id="id95909429f42e406494c47224c1b7515e"><enum>(f)</enum><header>No buffer zones</header> <paragraph id="id0a7b919081e7480fa2ebe5f3bd2934f4"><enum>(1)</enum><header>In general</header><text>Nothing in this title creates a protective perimeter or buffer zone around the National Scenic Area.</text>
 </paragraph><paragraph id="idda6b49d2418a45689864598335caa221"><enum>(2)</enum><header>Activities outside National Scenic Area</header><text>The fact that an activity or use on land outside the National Scenic Area can be seen or heard within the National Scenic Area shall not preclude the activity or use outside the boundaries of the National Scenic Area.</text>
 </paragraph></subsection><subsection id="id959cf9f426f44c07af5ec9daba6392e2"><enum>(g)</enum><header>Access</header><text>The Secretary shall continue to provide private landowners adequate access to inholdings in the National Scenic Area.</text>
 </subsection><subsection id="id0f4ccd8167594cec9d7bdd395bdd43d9"><enum>(h)</enum><header>Filming</header><text>Nothing in this title prohibits filming (including commercial film production, student filming, and still photography) within the National Scenic Area—</text>
 <paragraph id="id374099a656144afba5e0abcf935e0726"><enum>(1)</enum><text>subject to—</text> <subparagraph id="idefa1a4d202ba463d9b7f73871a51effc"><enum>(A)</enum><text>such reasonable regulations, policies, and practices as the Secretary considers to be necessary; and</text>
 </subparagraph><subparagraph id="id0d5d52f989724400ab2cce7220f5983e"><enum>(B)</enum><text>applicable law; and</text> </subparagraph></paragraph><paragraph id="id081894b60d4a443694f9395900651a2e"><enum>(2)</enum><text>in a manner consistent with the purposes described in subsection (b).</text>
 </paragraph></subsection><subsection id="id27e2db5afbd641ce88f2b2574ce8d7f8"><enum>(i)</enum><header>Fish and wildlife</header><text>Nothing in this title affects the jurisdiction or responsibilities of the State with respect to fish and wildlife.</text>
 </subsection><subsection id="id25102e70b8b047b09d461cfdbdce3141"><enum>(j)</enum><header>Livestock</header><text>The grazing of livestock in the National Scenic Area, including grazing under the Alabama Hills allotment and the George Creek allotment, as established before the date of enactment of this title, shall be permitted to continue—</text>
 <paragraph id="id15164fb098ab4134bb21bb61db968c4f"><enum>(1)</enum><text>subject to—</text> <subparagraph id="idc4e923beb4574472ab44f91ceb47c9df"><enum>(A)</enum><text>such reasonable regulations, policies, and practices as the Secretary considers to be necessary; and</text>
 </subparagraph><subparagraph id="id35a6d0128b7e4adf8b91bc4962db7277"><enum>(B)</enum><text>applicable law; and</text> </subparagraph></paragraph><paragraph id="id3aaefb1753484511bae02b74a746b4a6"><enum>(2)</enum><text>in a manner consistent with the purposes described in subsection (b).</text>
 </paragraph></subsection><subsection id="idef40d66154ad4992ba466ac081212b95"><enum>(k)</enum><header>Overflights</header><text>Nothing in this title restricts or precludes flights over the National Scenic Area or overflights that can be seen or heard within the National Scenic Area, including—</text>
 <paragraph id="ide2b28a3f96cc4bc7a3619c8492b1941b"><enum>(1)</enum><text>transportation, sightseeing and filming flights, general aviation planes, helicopters, hang gliders, and balloonists, for commercial or recreational purposes;</text>
 </paragraph><paragraph id="id6f2ae7d656774686851636094f5d7a1d"><enum>(2)</enum><text>low-level overflights of military aircraft;</text> </paragraph><paragraph id="id532f8301217a4420b4706ed704dde0d1"><enum>(3)</enum><text>flight testing and evaluation;</text>
 </paragraph><paragraph id="id00e3ab89a5d24d18b71be2d8f09880f3"><enum>(4)</enum><text>the designation or creation of new units of special use airspace, or the establishment of military flight training routes, over the National Scenic Area; and</text>
 </paragraph><paragraph id="id0059fbfb51d74447a71b4c76dff51ef8"><enum>(5)</enum><text>the use, including take-off and landing, of helicopters and other aerial devices within valid rights-of-way to construct or maintain energy transport facilities.</text>
 </paragraph></subsection><subsection id="id8cab2017c22443ecb151c920353c4bfb"><enum>(l)</enum><header>Withdrawal</header><text>Subject to the provisions of this title and valid rights in existence on the date of enactment of this title, including rights established by prior withdrawals, the Federal land within the National Scenic Area is withdrawn from all forms of—</text>
 <paragraph id="id9f862a05a5e94431b350b7be85a0f0c7"><enum>(1)</enum><text>entry, appropriation, or disposal under the public land laws;</text> </paragraph><paragraph id="id48583dc8a8c74b858e87500090e3d755"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text>
 </paragraph><paragraph id="idb00f6ab6f69b4618b95a690837a57901"><enum>(3)</enum><text>disposition under all laws pertaining to mineral and geothermal leasing or mineral materials.</text> </paragraph></subsection><subsection id="idd787cb062b9d42b091d016ec221f41ed"><enum>(m)</enum><header>Wildland fire operations</header><text>Nothing in this title prohibits the Secretary, in cooperation with other Federal, State, and local agencies, as appropriate, from conducting wildland fire operations in the National Scenic Area, consistent with the purposes described in subsection (b).</text>
 </subsection><subsection id="idc6832ef13dac456a82a7e3449132bdb5"><enum>(n)</enum><header>Grants; cooperative agreements</header><text>The Secretary may make grants to, or enter into cooperative agreements with, State, tribal, and local governmental entities and private entities to conduct research, interpretation, or public education or to carry out any other initiative relating to the restoration, conservation, or management of the National Scenic Area.</text>
 </subsection><subsection id="id19d3213cc21143aeaa619acfe68f9ed2"><enum>(o)</enum><header>Air and water quality</header><text>Nothing in this title modifies any standard governing air or water quality outside of the boundaries of the National Scenic Area.</text>
								</subsection><subsection id="idf73ac7d1436a4caba5c614e09159b51d"><enum>(p)</enum><header>Utility Facilities and Rights-of-Way</header>
 <paragraph id="id7fa4b9127a5e499da923c916a823d8e4"><enum>(1)</enum><header>Effect of title</header><text>Nothing in this title—</text> <subparagraph id="iddfa9d042cbd54151a451d7009061ea75"><enum>(A)</enum><text>affects the existence, use, operation, maintenance (including vegetation control), repair, construction, reconfiguration, expansion, inspection, renewal, reconstruction, alteration, addition, relocation, improvement, funding, removal, or replacement of any utility facility or appurtenant right-of-way within or adjacent to the National Scenic Area;</text>
 </subparagraph><subparagraph id="id5ec71bae33244c57b1b0fed759fa39c0"><enum>(B)</enum><text>subject to subsection (e), affects necessary or efficient access to utility facilities or rights-of-way within or adjacent to the National Scenic Area; and</text>
 </subparagraph><subparagraph id="id472b1bc6d5fd4962a64157836883bb2b"><enum>(C)</enum><text>precludes the Secretary from authorizing the establishment of new utility facility rights-of-way (including instream sites, routes, and areas) within the National Scenic Area in a manner that minimizes harm to the purpose of the National Scenic Area as described in subsection (b)—</text>
 <clause id="ide7e7e188861646f1ae74a58d7342f4fa"><enum>(i)</enum><text>in accordance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and any other applicable law;</text>
 </clause><clause id="idde324658a1534a638b1e0471485ffa02"><enum>(ii)</enum><text>subject to such terms and conditions as the Secretary determines to be appropriate; and</text> </clause><clause id="id97dd31c5881a4ef399c858b4c15809b6"><enum>(iii)</enum><text>that are determined by the Secretary to be the only technical or feasible location, following consideration of alternatives within existing rights-of-way or outside of the National Scenic Area.</text>
 </clause></subparagraph></paragraph><paragraph id="idc603caf7a32a4aab86748cd8d7852df0"><enum>(2)</enum><header>Management plan</header><text>Consistent with this title, the Management Plan shall establish plans for maintenance of public utility and other rights-of-way within the National Scenic Area.</text>
									</paragraph></subsection></section><section id="ida3b768ffd7a84e0a95283e03d2789b4d"><enum>1703.</enum><header>Management plan</header>
 <subsection id="id72836065a2b64410b38e59017ba26a5d"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this title, in accordance with subsections (b) and (c), the Secretary shall develop a comprehensive plan for the long-term management of the National Scenic Area.</text>
 </subsection><subsection id="id13fb7435816f4fdaa07d26bc226a2faa"><enum>(b)</enum><header>Consultation</header><text>In developing the management plan, the Secretary shall consult with—</text> <paragraph id="id0e855fe6fde748ffa98aa05fd94a8774"><enum>(1)</enum><text>appropriate State, tribal, and local governmental entities, including Inyo County, the Los Angeles Department of Water and Power, and the Tribe;</text>
 </paragraph><paragraph id="idf66753e2e7b7421b9bd87e84bf7b53c5"><enum>(2)</enum><text>investor-owned utilities, including Southern California Edison Company;</text> </paragraph><paragraph id="idbf1be44e8c5646ea8401295c9d16ae3e"><enum>(3)</enum><text>the Alabama Hills Stewardship Group; and</text>
 </paragraph><paragraph id="id4c19629495a642a28f183a69a26e5de9"><enum>(4)</enum><text>members of the public.</text> </paragraph></subsection><subsection commented="no" id="idBB96263E7B7D4EE382626E7925E98354"><enum>(c)</enum><header>Requirement</header><text>In accordance with this title, the management plan shall establish plans for maintenance of public utility and other rights-of-way within the National Scenic Area.</text>
 </subsection><subsection id="id9bc63090ee1842eea25c2464de0b6cab"><enum>(d)</enum><header>Incorporation</header><text>In developing the management plan, in accordance with this section, the Secretary shall allow, in perpetuity, casual use mining limited to the use of hand tools, metal detectors, hand-fed dry washers, vacuum cleaners, gold pans, small sluices, and similar items.</text>
 </subsection><subsection id="id431966c9d5724814a5b4041886708661"><enum>(e)</enum><header>Interim management</header><text>Pending completion of the management plan, the Secretary shall manage the National Scenic Area in accordance with section 1702(b).</text>
								</subsection></section><section id="id5937eb10b6544a028abdd1a9b62dabaf"><enum>1704.</enum><header>Land taken into trust for Lone Pine Paiute-Shoshone Reservation</header>
 <subsection id="id87f05c50e01e4cf2a286e40da5b4cd97"><enum>(a)</enum><header>Trust land</header><text>As soon as practicable after the date of enactment of this title, the Secretary shall take the approximately 132 acres of Federal land depicted on the Map as <quote>Lone Pine Paiute-Shoshone Reservation Addition</quote> into trust for the benefit of the Tribe, subject to the conditions that—</text>
 <paragraph id="id4121034d738343929963148588f35bd1"><enum>(1)</enum><text>the land shall be subject to all easements, covenants, conditions, restrictions, withdrawals, and other matters of record in existence on the date of enactment of this title; and</text>
 </paragraph><paragraph id="idc1e630a868764cef8ee3e2eb12f040c1"><enum>(2)</enum><text>the Federal land over which the right-of-way for the Los Angeles Aqueduct is located, generally described as the 250-foot-wide right-of-way granted to the City of Los Angeles pursuant to the Act of June 30, 1906 (34 Stat. 801, chapter 3926), shall not be taken into trust for the Tribe.</text>
 </paragraph></subsection><subsection id="id324462d042804ce2b565b2a84af7da02"><enum>(b)</enum><header>Reservation land</header><text>The land taken into trust pursuant to subsection (a) shall be considered to be a part of the reservation of the Tribe.</text>
 </subsection><subsection id="id0e80905c2fd24404aa336d71142c6924"><enum>(c)</enum><header>Gaming prohibition</header><text>Land taken into trust under subsection (a) shall not be eligible, or considered to have been taken into trust, for gaming (within the meaning of the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>)).</text>
 </subsection></section><section id="id0bd70ae3123b4307994b4cc98a4ea6ac"><enum>1705.</enum><header>Transfer of administrative jurisdiction</header><text display-inline="no-display-inline">Administrative jurisdiction over the approximately 40 acres of Federal land depicted on the Map as <quote>USFS Transfer to BLM</quote> is transferred from the Forest Service to the Bureau of Land Management.</text>
							</section><section id="id30bfab6e9410476ca8f7653354299b88"><enum>1706.</enum><header>Protection of services and recreational opportunities</header>
 <subsection id="idCDE4AD46900F4A2B940C7F54C7BBEEF9"><enum>(a)</enum><header>Effect of title</header><text display-inline="yes-display-inline">Nothing in this title limits the provision of any commercial service for existing or historic recreation use, as authorized by the permit process of the Bureau of Land Management.</text>
 </subsection><subsection id="idE63E658FDCC8402788CDEEFB1B7431C3"><enum>(b)</enum><header>Guided recreational opportunities</header><text display-inline="yes-display-inline">Any valid existing commercial permit to exercise guided recreational opportunities for the public may continue as authorized on the day before the date of enactment of this title.</text>
								</subsection></section><section id="idb3355ab27a904a82829c898f1dfcb34b"><enum>1707.</enum><header>Land conveyance to eliminate encroachment on public land</header>
 <subsection id="id65b1e952a0124eb98a7d6019286a9144"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idc5a98ffb52e4418e9b2a540bc3e15598"><enum>(1)</enum><header>Authorized offer period</header><text>The term <term>authorized offer period</term> means the 120-day period beginning on the date on which the required appraisal of the Federal land is completed under subsection (c).</text>
 </paragraph><paragraph id="id89b64d45756643e0a88dc2938e28c128"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the smallest parcel of land that—</text> <subparagraph id="id3700A5FC3FB7480D8E15E33AE52FC471"><enum>(A)</enum><text>the Secretary determines can be reasonably described in legal language and administered; and</text>
 </subparagraph><subparagraph id="idEA433BAA6BD24FD0920EB00F9C61AEA4"><enum>(B)</enum><text>encompasses construction completed by Reginald Cook as of January 15, 2015, within the approximately 4 acres of Bureau of Land Management land identified on the map as the <quote>Conveyance Area</quote>.</text>
 </subparagraph></paragraph><paragraph id="idd9bbaeddfe954e5ba66ff34d9996d7fb"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map titled <quote>Proposed Conveyance Property</quote>, dated January 15, 2015, and on file in the appropriate office of the Director of the Bureau of Land Management.</text>
 </paragraph><paragraph id="iddf4dab07828f43beb8efd91c3d07b122"><enum>(4)</enum><header>Reginald Cook</header><text>The term <term>Reginald Cook</term> means Mr. Reginald Cook, the owner of property adjacent to the land identified on the map as the <quote>Conveyance Area</quote>.</text> </paragraph></subsection><subsection id="id1eb374a1d6d94a48bdb30af788085ffd"><enum>(b)</enum><header>Conveyance</header><text>If, before the end of the authorized offer period, Reginald Cook submits to the Secretary an offer to acquire the Federal land consistent with subsections (d) and (e), the Secretary shall convey to Reginald Cook, subject to valid existing rights and on payment of the required consideration, all right, title, and interest of the United States in and to the surface estate of the Federal land.</text>
 </subsection><subsection id="id797e1a9f91eb4152b5ba3dddc8025bdc"><enum>(c)</enum><header>Appraisal</header><text>Not later than 120 days after the date of enactment of this title, the Secretary shall complete an appraisal of the Federal land in accordance with—</text>
 <paragraph id="idCF5D7A9026F24F91942C59ECA966567C"><enum>(1)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions; and</text> </paragraph><paragraph id="idFA7B3F1C9CBD427C87D09E9E168F58B4"><enum>(2)</enum><text>the Uniform Standards of Professional Appraisal Practice.</text>
 </paragraph></subsection><subsection id="idd5a9a05521af448a9375c53fbf1622dd"><enum>(d)</enum><header>Consideration</header><text>As consideration for the conveyance of the Federal land, Reginald Cook shall pay to the United States, for deposit in the general fund of the Treasury, an amount equal to the appraised value of the Federal land determined under subsection (c).</text>
								</subsection><subsection id="idfab739929a394586a877b18f7ac8e240"><enum>(e)</enum><header>Conditions</header>
 <paragraph id="ide097a7bbe970439d9d3326e5da57ec49"><enum>(1)</enum><header>Payment of costs of conveyance</header><text>Reginald Cook shall cover any administrative costs incurred by the Secretary to carry out the conveyance of the Federal land, including the costs of any required environmental, wildlife, cultural, or historical resources study.</text>
 </paragraph><paragraph id="id01892fc4ed454b5c934e19f9a96e9f1e"><enum>(2)</enum><header>Release</header><text>As a condition of the conveyance of the Federal land, Reginald Cook shall agree in writing to release and indemnify the United States from any claims or liabilities that may arise from use of the Federal land by the United States or Reginald Cook before the date of the conveyance.</text>
 </paragraph></subsection><subsection id="ida57704f8b90a4ee9bcf7c5c054adb890"><enum>(f)</enum><header>Access</header><text>The Secretary shall continue to provide to Reginald Cook access to the property of Reginald Cook, subject to part 2800 of title 43, Code of Federal Regulations (or successor regulations).</text>
								</subsection></section></title><title id="id0a53abc21df5444f81debd4ecf4f21f9"><enum>XVIII</enum><header>Miscellaneous</header>
							<section id="id78c10257c8e44a71bc05f627b35e3508"><enum>1801.</enum><header>Transfer of land to Anza-Borrego Desert State Park</header>
 <subsection id="ide249a1ee85ec4922bc077eb1b3026fc3"><enum>(a)</enum><header>In general</header><text>On termination of all mining claims to the land described in subsection (b), the Secretary shall transfer the land described in that subsection to the State.</text>
 </subsection><subsection id="idb2eea4a2620042e58a0be74fabf2c250"><enum>(b)</enum><header>Description of land</header><text>The land referred to in subsection (a) is certain Bureau of Land Management land in San Diego County, California, comprising approximately 934 acres, as generally depicted on the map entitled <quote>Table Mountain Wilderness Study Area Proposed Transfer to the State</quote> and dated July 15, 2009.</text>
								</subsection><subsection id="id27c12e0259e84ea09e7e0a717955b4d8"><enum>(c)</enum><header>Management</header>
 <paragraph id="id789b79a33aaa486398da555f15be0c7c"><enum>(1)</enum><header>In general</header><text>The land transferred under subsection (a) shall be managed in accordance with the provisions of the California Wilderness Act (California Public Resources Code sections 5093.30–5093.40).</text>
 </paragraph><paragraph id="id70539a0b26de4897b131dc4c7c09f878"><enum>(2)</enum><header>Withdrawal</header><text>Subject to valid existing rights, the land transferred under subsection (a) is withdrawn from—</text> <subparagraph id="id2ef5e527e439473781d5a187f734a706"><enum>(A)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text>
 </subparagraph><subparagraph id="id502f7c4f3eee4b35ac135afd987ee1e9"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text> </subparagraph><subparagraph id="idc2adc7b3d1024d3bb146035ab739636e"><enum>(C)</enum><text>disposition under all laws relating to mineral and geothermal leasing.</text>
 </subparagraph></paragraph><paragraph id="id58298386d2cf4b14b685098e306127ab"><enum>(3)</enum><header>Reversion</header><text>If the State ceases to manage the land transferred under subsection (a) as part of the State Park System or in a manner inconsistent with the California Wilderness Act (California Public Resources Code sections 5093.30–5093.40), the land shall revert to the Secretary at the discretion of the Secretary, to be managed as a Wilderness Study Area.</text>
 </paragraph></subsection></section><section id="id3cfbaab9883c42119de421c09c017e7f"><enum>1802.</enum><header>Military activities</header><text display-inline="no-display-inline">Nothing in this title—</text> <paragraph id="id95cfb72a7348464da8f2841f76826a58"><enum>(1)</enum><text>restricts or precludes Department of Defense motorized access by land or air—</text>
 <subparagraph id="idd71f0d1acefe4fa1b3440b080ef1891f"><enum>(A)</enum><text>to respond to an emergency within a wilderness area designated by this Act; or</text> </subparagraph><subparagraph id="id08c50a480f7b4271b9e8b252e4c7be68"><enum>(B)</enum><text>to control access to the emergency site;</text>
 </subparagraph></paragraph><paragraph id="id97e48c3ac3de4bd99c86c5a91f2bb1cb"><enum>(2)</enum><text>prevents nonmechanized military training activities previously conducted on wilderness areas designated by this title that are consistent with—</text>
 <subparagraph id="ida1bf3a2c32a244179066547a9df83fa9"><enum>(A)</enum><text>the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text> </subparagraph><subparagraph id="id06e7a162696b48319ae99a0f8e218ebe"><enum>(B)</enum><text>all applicable laws (including regulations);</text>
 </subparagraph></paragraph><paragraph id="ida81324df6dd6428682f23d3856cfaacd"><enum>(3)</enum><text>restricts or precludes low-level overflights of military aircraft over the areas designated as wilderness, national monuments, special management areas, or recreation areas by this Act, including military overflights that can be seen or heard within the designated areas;</text>
 </paragraph><paragraph id="idecf90af58f944508add76b2496ce48f2"><enum>(4)</enum><text>restricts or precludes flight testing and evaluation in the areas described in paragraph (3); or</text> </paragraph><paragraph id="idd4fb41ce956b4437a89f0f6cc23fbc6d"><enum>(5)</enum><text>restricts or precludes the designation or creation of new units of special use airspace, or the establishment of military flight training routes, over the areas described in paragraph (3).</text>
								</paragraph></section><section id="id3e272ca3db2548f39a1816496aedc80e"><enum>1803.</enum><header>Climate change and wildlife corridors</header>
 <subsection id="idaa1ee26cebc64835843341d88aad8d67"><enum>(a)</enum><header>In general</header><text>The Secretary shall—</text> <paragraph id="id532b1287ddaa4aba867c1d473fe37dc4"><enum>(1)</enum><text>assess the impacts of climate change on the Conservation Area; and</text>
 </paragraph><paragraph id="id2ecd7d85e27f40288aea5162eaa0d753"><enum>(2)</enum><text>establish policies and procedures to ensure the preservation of wildlife corridors and facilitate species migration likely to occur due to climate change.</text>
									</paragraph></subsection><subsection id="idb3129fb47c1844a5b3383c15e4947082"><enum>(b)</enum><header>Study</header>
 <paragraph id="iddbba5a94e7f049f7af05e6680761aafe"><enum>(1)</enum><header>In general</header><text>As soon as practicable, but not later than 2 years, after the date of enactment of this title, the Secretary shall complete a study regarding the impact of global climate change on the Conservation Area.</text>
 </paragraph><paragraph id="idb77005053d3d494c886035856e6c0871"><enum>(2)</enum><header>Components</header><text>The study under paragraph (1) shall—</text> <subparagraph id="id60a7d554176e49e2a767142fbb141f40"><enum>(A)</enum><text>identify the species migrating, or likely to migrate, due to climate change;</text>
 </subparagraph><subparagraph id="id02bb59ccd843420bb87c88812e214189"><enum>(B)</enum><text>examine the impacts and potential impacts of climate change on—</text> <clause id="ide1095a9aa35048d7ad34c284b6893ff4"><enum>(i)</enum><text>plants, insects, and animals;</text>
 </clause><clause id="id0bd0cf8463564c279fb078ab97a8c84e"><enum>(ii)</enum><text>soil;</text> </clause><clause id="id9c5a3f430df4455da5fc0a6e401a82aa"><enum>(iii)</enum><text>air quality;</text>
 </clause><clause id="id9bd2d474101f40d5ada494861f5e345d"><enum>(iv)</enum><text>water quality and quantity; and</text> </clause><clause id="id11a99bb548374443b1ef7fb497638870"><enum>(v)</enum><text>species migration and survival;</text>
 </clause></subparagraph><subparagraph id="id0f5beb313f004160b942eda558664e4b"><enum>(C)</enum><text>identify critical wildlife and species migration corridors recommended for preservation; and</text> </subparagraph><subparagraph id="id40c41dbd0cbd46d3a79683a0fd568663"><enum>(D)</enum><text>include recommendations for ensuring the biological connectivity of public land managed by the Secretary and the Secretary of Defense throughout the Conservation Area.</text>
 </subparagraph></paragraph><paragraph id="ide0efcc23810a4cbb9312569ba8731d32"><enum>(3)</enum><header>Rights-of-way</header><text>The Secretary shall consider the information and recommendations of the study under paragraph (1) to determine the individual and cumulative impacts of rights-of-way for projects in the Conservation Area, in accordance with—</text>
 <subparagraph id="idaef0fdfec4fc48e5a4f24188291de81c"><enum>(A)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text> </subparagraph><subparagraph id="ida9eb92ab6b5c4058b44576a2f462dcaa"><enum>(B)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text>
 </subparagraph><subparagraph id="id4df0a8d89f96497590a65438d8891478"><enum>(C)</enum><text>any other applicable law.</text> </subparagraph></paragraph></subsection><subsection id="id96b8223338a9456eabe0e7ba3fc47ca7"><enum>(c)</enum><header>Land management plans</header><text>The Secretary shall incorporate into all land management plans applicable to the Conservation Area the findings and recommendations of the study completed under subsection (b).</text>
								</subsection></section><section id="id7800749f70c04d90adad391f0990f051"><enum>1804.</enum><header>Prohibited uses of acquired, donated, and conservation land</header>
 <subsection id="id8e70fa1344b8453e93e3ac5e390ea5f8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="idb7b8e198dca74f999ca962b3351b3f09"><enum>(1)</enum><header>Acquired land</header><text>The term <term>acquired land</term> means any land acquired within the Conservation Area using amounts from the land and water conservation fund established under section 200302 of title 54, United States Code.</text>
 </paragraph><paragraph id="ide8c39fdadb2742c0bc001474145adeba"><enum>(2)</enum><header>Conservation land</header><text>The term <term>conservation land</term> means any land within the Conservation Area that is designated to satisfy the conditions of a Federal habitat conservation plan, general conservation plan, or State natural communities conservation plan, including—</text>
 <subparagraph id="idEFFE9EC9D62548D485928CD882DD7A69"><enum>(A)</enum><text>national conservation land established pursuant to section 2002(b)(2)(D) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7202">16 U.S.C. 7202(b)(2)(D)</external-xref>); and</text>
 </subparagraph><subparagraph id="idACFAA0F4A13D4DDFBE335CE819485C0E"><enum>(B)</enum><text>areas of critical environmental concern established pursuant to section 202(c)(3) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)(3)</external-xref>).</text>
 </subparagraph></paragraph><paragraph id="id7c2c0105972a46e1951f0070170b6333"><enum>(3)</enum><header>Donated land</header><text>The term <term>donated land</term> means any private land donated to the United States for conservation purposes in the Conservation Area.</text>
 </paragraph><paragraph id="id84fce65164194708832af38e819ac1d9"><enum>(4)</enum><header>Donor</header><text>The term <term>donor</term> means an individual or entity that donates private land within the Conservation Area to the United States.</text>
 </paragraph><paragraph id="idfedb6c3f92bd400e8b789f7826678e47"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text> </paragraph></subsection><subsection id="id8d95916598424d5cacb040da1fb59b57"><enum>(b)</enum><header>Prohibitions</header><text>Except as provided in subsection (c), the Secretary shall not authorize the use of acquired land, conservation land, or donated land within the Conservation Area for any activities contrary to the conservation purposes for which the land was acquired, designated, or donated, including—</text>
 <paragraph id="idbcac2dc23281479397179477ee17ccdd"><enum>(1)</enum><text>disposal;</text> </paragraph><paragraph id="ided5652ac178048d1a1f7686c92292e67"><enum>(2)</enum><text>rights-of-way;</text>
 </paragraph><paragraph id="id4d73bb58d09241d8985516cc93235dc3"><enum>(3)</enum><text>leases;</text> </paragraph><paragraph id="iddd03b596f9bd410786abf56760494842"><enum>(4)</enum><text>livestock grazing;</text>
 </paragraph><paragraph id="ida98587376ce74aeead4a1d608eec446d"><enum>(5)</enum><text>infrastructure development, except as provided in subsection (c);</text> </paragraph><paragraph id="id39bd1766717640d896815e2f11584b6f"><enum>(6)</enum><text>mineral entry; and</text>
 </paragraph><paragraph id="ideec1bef29a4c485cbc8024b738b22b20"><enum>(7)</enum><text>off-highway vehicle use, except on—</text> <subparagraph id="idf2d6b82ac51f44f7b29444945e2fc64c"><enum>(A)</enum><text>designated routes;</text>
 </subparagraph><subparagraph id="ida1afa041b0fa416eb966d23bfc71460d"><enum>(B)</enum><text>off-highway vehicle areas designated by law; and</text> </subparagraph><subparagraph id="idb35bd1585d1c494083ec08372b6a5b4f"><enum>(C)</enum><text>administratively designated open areas.</text>
										</subparagraph></paragraph></subsection><subsection id="id43f963dcc7384cd38f6ffc962f981b56"><enum>(c)</enum><header>Exceptions</header>
 <paragraph id="id31141ce223894f7e89076c6e405234c7"><enum>(1)</enum><header>Authorization by Secretary</header><text>Subject to paragraph (2), the Secretary may authorize limited exceptions to prohibited uses of acquired land or donated land in the Conservation Area if—</text>
 <subparagraph id="id27a4ea506a16455e87b2d382cf224a18"><enum>(A)</enum><text>a right-of-way application for a renewable energy development project or associated energy transport facility on acquired land or donated land was submitted to the Bureau of Land Management on or before December 1, 2009; or</text>
 </subparagraph><subparagraph id="id0ffffca81bf34aff9b884b4054a741a4"><enum>(B)</enum><text>after the completion and consideration of an analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Secretary has determined that proposed use is in the public interest.</text>
										</subparagraph></paragraph><paragraph id="id2d6cd8d915594ba284438198672c35a2"><enum>(2)</enum><header>Conditions</header>
 <subparagraph id="id7df8500831c74cc6bf5b3feba2196077"><enum>(A)</enum><header>In general</header><text>If the Secretary grants an exception to the prohibition under paragraph (1), the Secretary shall require the permittee to donate private land of comparable value located within the Conservation Area to the United States to mitigate the use.</text>
 </subparagraph><subparagraph id="ida7b3ca0584c0406bbccbadb5a72f1f54"><enum>(B)</enum><header>Approval</header><text>The private land to be donated under subparagraph (A) shall be approved by the Secretary after—</text> <clause id="id2C0C1FEE615D4110A18B823FE20F61E8"><enum>(i)</enum><text>consultation, to the maximum extent practicable, with the donor of the private land proposed for nonconservation uses; and</text>
 </clause><clause id="id3AB55D19E80E4E34A4737F57BA0AA49B"><enum>(ii)</enum><text>an opportunity for public comment regarding the donation.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="idf9ed2f82f8974aac93e1f80c1853066c"><enum>(d)</enum><header>Existing agreements</header><text>Nothing in this section affects permitted or prohibited uses of donated land or acquired land in the Conservation Area established in any easements, deed restrictions, memoranda of understanding, or other agreements in existence on the date of enactment of this title.</text>
 </subsection><subsection id="id690594eab4a449b6a4d914efe7878323"><enum>(e)</enum><header>Deed restrictions</header><text>Effective beginning on the date of enactment of this title, within the Conservation Area, the Secretary may—</text>
 <paragraph id="id23F1FE015B58485E85F8311E394DAB8D"><enum>(1)</enum><text>accept deed restrictions requested by landowners for land donated to, or otherwise acquired by, the United States; and</text>
 </paragraph><paragraph id="idBB82BE4341B1495195655E92571FB941"><enum>(2)</enum><text>consistent with existing rights, create deed restrictions, easements, or other third-party rights relating to any public land determined by the Secretary to be necessary—</text>
 <subparagraph id="idFBE9F4C57E044C849630552C3E98741E"><enum>(A)</enum><text>to fulfill the mitigation requirements resulting from the development of renewable resources; or</text>
 </subparagraph><subparagraph commented="no" id="id18ea34ee3c4f4420ba35d0982f5532e9"><enum>(B)</enum><text>to satisfy the conditions of—</text> <clause commented="no" id="id45d51163676c447ea389218ac22e3491"><enum>(i)</enum><text>a habitat conservation plan or general conservation plan established pursuant to section 10 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539</external-xref>); or</text>
 </clause><clause commented="no" id="idef458bafe501461ea6f37e32a5edf539"><enum>(ii)</enum><text>a natural communities conservation plan approved by the State.</text> </clause></subparagraph></paragraph></subsection></section><section id="id6dfbda7e918c4f2e8908452433a37301"><enum>1805.</enum><header>Tribal uses and interests</header> <subsection id="idb54fb8283c21450ab84ed84b14545e9f"><enum>(a)</enum><header>Access</header><text>The Secretary shall ensure access to areas designated under this Act by members of Indian tribes for traditional cultural and religious purposes, consistent with applicable law, including <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>).</text>
								</subsection><subsection id="idfcc610a9fb654c3cba914cbffa6496d7"><enum>(b)</enum><header>Temporary closure</header>
 <paragraph id="idfa1272ecffa24b3cbf5ecf4054c5c21a"><enum>(1)</enum><header>In general</header><text>In accordance with applicable law, including <external-xref legal-doc="public-law" parsable-cite="pl/95/341">Public Law 95–341</external-xref> (commonly known as the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>), and subject to paragraph (2), the Secretary, on request of an Indian tribe or Indian religious community, shall temporarily close to general public use any portion of an area designated as a national monument, special management area, wild and scenic river, area of critical environmental concern, or National Park System unit under this Act (referred to in this subsection as a <quote>designated area</quote>) to protect the privacy of traditional cultural and religious activities in the designated area by members of the Indian tribe or Indian religious community.</text>
 </paragraph><paragraph id="id55a7e6dc73e44853be4aa3584bc79ff9"><enum>(2)</enum><header>Limitation</header><text>In closing a portion of a designated area under paragraph (1), the Secretary shall limit the closure to the smallest practicable area for the minimum period necessary for the traditional cultural and religious activities.</text>
									</paragraph></subsection><subsection id="ida138ede4688c4b88bb17c003e9a4cee6"><enum>(c)</enum><header>Tribal cultural resources management plan</header>
 <paragraph id="idbaa296cffa5b4e7d9cf08178d94ad4b1"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this title, the Secretary of the Interior shall develop and implement a tribal cultural resources management plan to identify, protect, and conserve cultural resources of Indian tribes associated with the Xam Kwatchan Trail network extending from Avikwaame (Spirit Mountain, Nevada) to Avikwlal (Pilot Knob, California).</text>
 </paragraph><paragraph id="id6f7a956b58994c5e9c95a90d921fec2e"><enum>(2)</enum><header>Consultation</header><text>The Secretary shall consult on the development and implementation of the tribal cultural resources management plan under paragraph (1) with—</text>
 <subparagraph id="idcfd656220dc64e0690fac829d8ff74c6"><enum>(A)</enum><text>each of—</text> <clause id="id45f6185c6e7a4bde920d9d694467ab18"><enum>(i)</enum><text>the Chemehuevi Indian Tribe;</text>
 </clause><clause id="id5e9930a3ac394a8d820fa361bfc6893f"><enum>(ii)</enum><text>the Hualapai Tribal Nation;</text> </clause><clause id="id8933902274404034b77e04b6b0f45fc8"><enum>(iii)</enum><text>the Fort Mojave Indian Tribe;</text>
 </clause><clause id="idf6255a2c02bd40038f4da5f98504e4b3"><enum>(iv)</enum><text>the Colorado River Indian Tribes;</text> </clause><clause id="idf86f13b94cb04fd2a9fd7c54c3d4044c"><enum>(v)</enum><text>the Quechan Indian Tribe; and</text>
 </clause><clause id="idbcedd52bc1ec44c28c59cb3a6a5868f8"><enum>(vi)</enum><text>the Cocopah Indian Tribe; and</text> </clause></subparagraph><subparagraph id="idf1b14113955a40e08859531bfe243477"><enum>(B)</enum><text>the Advisory Council on Historic Preservation.</text>
 </subparagraph></paragraph><paragraph id="id871b24cfff224169a4bb7035b703ab91"><enum>(3)</enum><header>Resource protection</header><text>The tribal cultural resources management plan developed under paragraph (1) shall—</text> <subparagraph id="id68648ca1719044548d806362748a9bc5"><enum>(A)</enum><text>be based on a completed tribal cultural resources survey; and</text>
 </subparagraph><subparagraph id="id0bec7cbdf7fb450588ff1289548fd1be"><enum>(B)</enum><text>include procedures for identifying, protecting, and preserving petroglyphs, ancient trails, intaglios, sleeping circles, artifacts, and other resources of cultural, archaeological, or historical significance in accordance with all applicable laws and policies, including—</text>
 <clause id="id4568fb95ddc7423aa7a73054cb48fe29"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code;</text> </clause><clause id="idafa33fe2178149119be9e641025e39e6"><enum>(ii)</enum><text>Public Law 95–341 (commonly known as the <quote>American Indian Religious Freedom Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/1996">42 U.S.C. 1996</external-xref>);</text>
 </clause><clause id="id8da8197085544cc5bbfb4a3985ae5e87"><enum>(iii)</enum><text>the Archaeological Resources Protection Act of 1979 (<external-xref legal-doc="usc" parsable-cite="usc/16/470aa">16 U.S.C. 470aa et seq.</external-xref>);</text> </clause><clause id="id8be8a5590992403eb917d68dd6fb8f31"><enum>(iv)</enum><text>the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001 et seq.</external-xref>); and</text>
 </clause><clause id="idc515f56f4afc4350be9d072695d87117"><enum>(v)</enum><text>Public Law 103–141 (commonly known as the <quote>Religious Freedom Restoration Act of 1993</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/42/2000bb">42 U.S.C. 2000bb et seq.</external-xref>).</text> </clause></subparagraph></paragraph></subsection><subsection id="id618189184ddf425a907209ab21a47c9f"><enum>(d)</enum><header>Withdrawal</header><text>Subject to valid existing rights, all Federal land within the area administratively withdrawn and known as the <quote>Indian Pass Withdrawal Area</quote> is permanently withdrawn from—</text>
 <paragraph id="id52553aed43e742849b624712dd3deaa4"><enum>(1)</enum><text>all forms of entry, appropriation, or disposal under the public land laws;</text> </paragraph><paragraph id="idce68dd8289524715b3e23837a0664a32"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text>
 </paragraph><paragraph id="id7461571b581e4b7fa6d01c539dbf037d"><enum>(3)</enum><text>right-of-way leasing and disposition under all laws relating to minerals or solar, wind, or geothermal energy.</text>
									</paragraph></subsection></section><section id="ida0766354ba5a457780edcd46782ea387"><enum>1806.</enum><header>Release of Federal reversionary land interests</header>
 <subsection id="id683f9ac400e646a0836ea36ca1974bfe"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="ide0ea8dd2338f48708c30601fd9f2b1f7"><enum>(1)</enum><header>1932 Act</header><text>The term <term>1932 Act</term> means the Act of June 18, 1932 (47 Stat. 324, chapter 270).</text>
 </paragraph><paragraph id="id95e23eb2e255469fa9c15ab79f4918a9"><enum>(2)</enum><header>District</header><text>The term <term>District</term> means the Metropolitan Water District of Southern California.</text> </paragraph></subsection><subsection id="ide6fc005c5c2d405aa7b3d705e9ed6503"><enum>(b)</enum><header>Release</header><text>Subject to valid existing claims perfected prior to the effective date of the 1932 Act and the reservation of minerals set forth in the 1932 Act, the Secretary shall release, convey, or otherwise quitclaim to the District, in a form recordable in local county records, and subject to the approval of the District, after consultation and without monetary consideration, all right, title, and remaining interest of the United States in and to the land that was conveyed to the District pursuant to the 1932 Act or any other law authorizing conveyance subject to restrictions or reversionary interests retained by the United States, on request by the District.</text>
 </subsection><subsection id="id0cb90dc3271b4e6e87630e1e487423db"><enum>(c)</enum><header>Terms and conditions</header><text>A conveyance authorized by subsection (b) shall be subject to the following terms and conditions:</text> <paragraph id="id9f43ef390aee4c70bbd483cb299ddab8"><enum>(1)</enum><text>The District shall cover, or reimburse the Secretary for, the costs incurred by the Secretary to make the conveyance, including title searches, surveys, deed preparation, attorneys’ fees, and similar expenses.</text>
 </paragraph><paragraph id="id14da1b55ace54bc58c0fab140fbf486a"><enum>(2)</enum><text>By accepting the conveyances, the District agrees to indemnify and hold harmless the United States with regard to any boundary dispute relating to any parcel conveyed under this section.</text></paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idfd48ca7757c54e069b329c321ebc4f59"><enum>(b)</enum><header>Conforming amendments</header>
 <paragraph id="id88c85f3c99654b768f8b12ed9e10ad40"><enum>(1)</enum><header>Designation</header><text>Section 2945 of the Military Construction Authorization Act for Fiscal Year 2014 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 1038) is amended—</text>
 <subparagraph id="id254781c0ec24467cb0dfd5b21643a265"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="OLC">National</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">Valley</header-in-text></quote>;</text> </subparagraph><subparagraph id="id8fd7d20e54694c73affbf612ec5dbefb"><enum>(B)</enum><text>in subsection (a), by inserting <quote>National</quote> after <quote>Valley</quote> in the matter preceding paragraph (1); and</text>

 </paragraph></subsection></section><section id="ida0bcdf43efdf4755b02f44d0db3fa4b7"><enum>102.</enum><header>Visitor center</header><text display-inline="no-display-inline">Title IV of the California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-21">16 U.S.C. 410aaa–21 et seq.</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFF1FD5783A814027BDADEB9AC944D6AB" style="OLC">
					<section id="idf5ad339f6b974ab081d619ed8e5ae52d"><enum>408.</enum><header>Visitor center</header>
 <subsection id="id9560ccb9b5fd476eb8967c40f65689a6"><enum>(a)</enum><header>In general</header><text>The Secretary may acquire not more than 5 acres of land and interests in land, and improvements on the land and interests, outside the boundaries of Joshua Tree National Park, in the unincorporated village of Joshua Tree, for the purpose of operating a visitor center.</text>
 </subsection><subsection id="iddc9c3d2e177d4c7b9e4f8a76d0128c55"><enum>(b)</enum><header>Boundary</header><text>The Secretary shall modify the boundary of the park to include the land acquired under this section as a noncontiguous parcel.</text>
 </subsection><subsection id="idb8b80b79d8264348abadad1f87344fdb"><enum>(c)</enum><header>Administration</header><text>Land and facilities acquired under this section—</text> <paragraph id="idd57a643a85644a21aac9877028378c6c"><enum>(1)</enum><text>may include the property owned (as of the date of enactment of this section) by the Joshua Tree National Park Association and commonly referred to as the <quote>Joshua Tree National Park Visitor Center</quote>;</text>
 </paragraph><paragraph id="id13dbc754acc94c22896cfa7ad5573cca"><enum>(2)</enum><text>shall be administered by the Secretary as part of the park; and</text> </paragraph><paragraph id="id54f4826eeb294bb19169847c2995aee8"><enum>(3)</enum><text>may be acquired only with the consent of the owner, by donation, purchase with donated or appropriated funds, or exchange.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </section><section id="id33666766064e4f7cb6504795ad93d7c3"><enum>103.</enum><header>California State school land</header><text display-inline="no-display-inline">Section 707 of the California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-77">16 U.S.C. 410aaa–77</external-xref>) is amended—</text> <paragraph id="id41a9bf88ddb744f4a38e156fcc436f0b"><enum>(1)</enum><text>in subsection (a)—</text>
 <subparagraph id="ideafc4f6c0aa54d5e9a56a4a9f24e3dbf"><enum>(A)</enum><text>in the first sentence—</text> <clause id="idcb471ba44e83463e9e4446b665be6778"><enum>(i)</enum><text>by striking <quote>Upon request of the California State Lands Commission (hereinafter in this section referred to as the <quote>Commission</quote>), the Secretary shall enter into negotiations for an agreement</quote> and inserting the following:</text>

 </clause><clause id="ide63bda6f008941bdae980879a73ce3fc"><enum>(ii)</enum><text>by inserting <quote>, national monuments,</quote> after <quote>more of the wilderness areas</quote>; and</text> </clause></subparagraph><subparagraph id="idf31ffe834a0249559abbe0bc36eda866"><enum>(B)</enum><text>in the second sentence, by striking <quote>The Secretary shall negotiate in good faith to</quote> and inserting the following:</text>

 <subparagraph id="iddbf55172363345b8aa97dec7f43be646"><enum>(A)</enum><header>In general</header><text>Assembled land exchanges may be used to carry out this section through the sale of surplus Federal property and subsequent acquisitions of State school land.</text>
 </subparagraph><subparagraph id="id05d90645e4924f87979ed0bf44a550e1"><enum>(B)</enum><header>Receipts</header><text>Past and future receipts from the sale of property described in subsection (a), less any costs incurred related to the sale, shall be deposited in a Special Deposit Fund Account established in the Treasury.</text>
 </subparagraph><subparagraph id="idfad433bc423642c4adec8edb5dbcba70"><enum>(C)</enum><header>Use</header><text>Funds accumulated in the Special Deposit Fund Account may be used by the Secretary, without an appropriation, to acquire State school lands or interest in the land consistent with this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
 </paragraph></section><section id="id801be76eec664f4b8de71d754de11728"><enum>104.</enum><header>Designation of wild and scenic rivers</header><text display-inline="no-display-inline">Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended—</text> <paragraph id="idd32e986efebe417a938855844d036035"><enum>(1)</enum><text>in paragraph (196), by striking subparagraph (A) and inserting the following:</text>

 </clause><clause id="id61b4d7c294c341f69876d220e4410718" indent="up1"><enum>(ii)</enum><text>The approximately 6.1-mile segment of the Amargosa River in the State of California, from 100 feet downstream of the State Highway 178 crossing to 100 feet upstream of the Tecopa Hot Springs Road crossing, to be administered by the Secretary of the Interior as a scenic river.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block>

 </clause></subparagraph><subparagraph id="id82aa0c560d9c4d799bd5f64e100164e6"><enum>(B)</enum><header>Effect on historic mining structures</header><text>Nothing in this paragraph affects the historic mining structures associated with the former Panamint Mining District.</text>
							</subparagraph></paragraph><paragraph id="id03742714e98e4757a561366ae190f943"><enum>(214)</enum><header>Deep Creek, California</header>
 <subparagraph id="ide9e50c7d2111480ab8862f4af811ffdb"><enum>(A)</enum><header>In general</header><text>The following segments of Deep Creek in the State of California, to be administered by the Secretary of Agriculture:</text>
 <clause id="id711642155cd14a84a1205398c9658a5b"><enum>(i)</enum><text>The approximately 6.5-mile segment from 0.125 mile downstream of the Rainbow Dam site in sec. 33, T. 2 N., R. 2 W., to 0.25 miles upstream of the Road 3N34 crossing, as a wild river.</text>
 </clause><clause id="id97e6c87b1a7d4f4a8d52bf44c48c1bb3"><enum>(ii)</enum><text>The 0.5-mile segment from 0.25 mile upstream of the Road 3N34 crossing to 0.25 mile downstream of the Road 3N34 crossing, as a scenic river.</text>
 </clause><clause id="id40772cd6fafe4c17962b2f8f5f7e1455"><enum>(iii)</enum><text>The 2.5-mile segment from 0.25 miles downstream of the Road 3 N. 34 crossing to 0.25 miles upstream of the Trail 2W01 crossing, as a wild river.</text>
 </clause><clause id="idaf031edb06d54a0bb9487b546f72743e"><enum>(iv)</enum><text>The 0.5-mile segment from 0.25 miles upstream of the Trail 2W01 crossing to 0.25 mile downstream of the Trail 2W01 crossing, as a scenic river.</text>
 </clause><clause id="idfcbd632d5b33470795e57e0c3237ae79"><enum>(v)</enum><text>The 10-mile segment from 0.25 miles downstream of the Trail 2W01 crossing to the upper limit of the Mojave dam flood zone in sec. 17, T. 3 N., R. 3 W., as a wild river.</text>
 </clause><clause id="idc9e93586085546919fe1071d881046de"><enum>(vi)</enum><text>The 11-mile segment of Holcomb Creek from 100 yards downstream of the Road 3N12 crossing to .25 miles downstream of Holcomb Crossing, as a recreational river.</text>
 </clause><clause id="id6125a0f3f90f4e2894f6b4cf7b5a8fa0"><enum>(vii)</enum><text>The 3.5-mile segment of the Holcomb Creek from 0.25 miles downstream of Holcomb Crossing to the Deep Creek confluence, as a wild river.</text>
 </clause></subparagraph><subparagraph id="id1a1836008d534e0cb33972e6bbb5e4a8"><enum>(B)</enum><header>Effect on ski operations</header><text>Nothing in this paragraph affects—</text> <clause id="id7e3363a620bf487f9e90dbf17e911555"><enum>(i)</enum><text>the operations of the Snow Valley Ski Resort; or</text>
 </clause><clause id="id8787c47e2427450a96cf52ce4f1925c9"><enum>(ii)</enum><text>the State regulation of water rights and water quality associated with the operation of the Snow Valley Ski Resort.</text>
 </clause></subparagraph></paragraph><paragraph id="id30d410bc0294444fb2c4adce90459c00"><enum>(215)</enum><header>Whitewater River, California</header><text>The following segments of the Whitewater River in the State of California, to be administered by the Secretary of Agriculture and the Secretary of the Interior, acting jointly:</text>
 <subparagraph id="idfbe58d61f8844a1bbd9308cacc37970d"><enum>(A)</enum><text>The 5.8-mile segment of the North Fork Whitewater River from the source of the River near Mt. San Gorgonio to the confluence with the Middle Fork, as a wild river.</text>

 </subparagraph><subparagraph id="id4cd66ea4addf481a82d86b766a4203b4"><enum>(E)</enum><text>The 4.9-mile segment of the South Fork Whitewater River from the section line between sections 33 and 34, T. 1 S., R. 2 E., to the confluence with the Middle Fork, as a wild river.</text>

 </subparagraph></paragraph><paragraph id="id04654964d21445eb9d765c467963d1a4"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means the State of California.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection><subsection id="id1c7d0acb3acc4434959f8756ebd2e6cc"><enum>(c)</enum><header>Administration of wilderness areas</header><text>Section 103 of the California Desert Protection Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/433">Public Law 103–433</external-xref>; 108 Stat. 4481) is amended—</text>
 <paragraph id="id5a2504c97a2346ea92d2f707abba11ad"><enum>(1)</enum><text>by striking subsection (d) and inserting the following:</text> <quoted-block display-inline="no-display-inline" id="id5B21D537B5EF4CC49B1267B5C6729EA7" style="OLC"> <subsection id="id345f59a68db746cb96bc2b2bde443ab0"><enum>(d)</enum><header>No buffer zones</header> <paragraph id="id47a3fce3a48d4798ba050fc8faa9d551"><enum>(1)</enum><header>In general</header><text>Congress does not intend for the designation of wilderness areas by this Act—</text>
 <subparagraph id="id478e183dea5d4bea89c1d438d55c3311"><enum>(A)</enum><text>to require the additional regulation of land adjacent to the wilderness areas; or</text> </subparagraph><subparagraph id="idc9013b4f8b6e4590a71756f30f1d7303"><enum>(B)</enum><text>to lead to the creation of protective perimeters or buffer zones around the wilderness areas.</text>
 </subparagraph></paragraph><paragraph id="id20969d8aa2f9468b8a02ab8a3c8cf78b"><enum>(2)</enum><header>Nonwilderness activities</header><text>Any nonwilderness activities (including renewable energy projects, energy transmission or telecommunications projects, mining, camping, hunting, and military activities) in areas immediately adjacent to the boundary of a wilderness area designated by this Act shall not be restricted or precluded by this Act, regardless of any actual or perceived negative impacts of the nonwilderness activities on the wilderness area, including any potential indirect impacts of nonwilderness activities conducted outside the designated wilderness area on the viewshed, ambient noise level, or air quality of wilderness area.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
 </paragraph><paragraph id="id3cc8669ee8874c7da688f66f78253f70"><enum>(2)</enum><text>in subsection (f), by striking <quote>designated by this title and</quote> and inserting <quote>, potential wilderness areas, special management areas, and national monuments designated by this title or titles XIII through XVIII</quote>; and</text>
 </paragraph><paragraph id="id26a3e458247646f7a5ef61a84f6e670e"><enum>(3)</enum><text>in subsection (g), by inserting <quote>, a potential wilderness area, a special management area, or national monument</quote> before <quote>by this Act</quote>.</text> </paragraph></subsection><subsection id="id2ae09da1d414431eb019774aa6468b96"><enum>(d)</enum><header>Mojave National Preserve</header><text>Title V of the California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-41">16 U.S.C. 410aaa–41 et seq.</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF5346900B3ED46269EF79DE69CE4AEF4" style="OLC">
 <section id="id7d76e854ae814132859d69a147eed04c"><enum>520.</enum><header>Native groundwater supplies</header><text display-inline="no-display-inline">The Secretary shall take no action within the Conservation Area to authorize, permit, or allow the use of any right-of-way or lease to extract, consume, export, transfer, or distribute groundwater for municipal, commercial, or industrial use from aquifers supplying wild and scenic rivers, or supplying water to Areas of Critical Environmental Concern, or underlying land managed by the Barstow or Needles Field Offices of the Bureau of Land Management or the National Park Service in quantities that collectively exceed the estimated perennial safe yield or annual recharge rate, as determined by the United States Geological Survey.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idde25baf29fa14d8e8cc70389e19c0697"><enum>(e)</enum><header>Juniper flats</header><text>Section 711 of the California Desert Protection Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-81">16 U.S.C. 410aaa–81</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id6b6b266020a24620a0bbf6100cc5b8f5" style="OLC">
 <section commented="no" display-inline="no-display-inline" id="id3dc948f453d54f3a8e7f788fef296647" section-type="subsequent-section"><enum>711.</enum><header>Juniper flats</header><text display-inline="no-display-inline">Development of renewable energy generation facilities (excluding rights-of-way or facilities for the transmission of energy and telecommunication facilities and infrastructure) is prohibited on the approximately 28,000 acres of Federal land generally depicted as <quote>BLM Land Withdrawn from Energy Development and Power Generation</quote> on the map entitled <quote>Juniper Flats</quote> and dated September 21, 2015.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="iddf095b8ee62842359dfdd786ef00e0b7"><enum>(f)</enum><header>California Military Lands Withdrawal and Overflights Act of 1994</header>
 <paragraph id="idacfcddec288b4969ba653e19fee0fe7e"><enum>(1)</enum><header>Findings</header><text>Section 801(b)(2) of the California Military Lands Withdrawal and Overflights Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-82">16 U.S.C. 410aaa–82</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/103/433">Public Law 103–433</external-xref>) is amended by inserting <quote>, special management areas, potential wilderness areas,</quote> before <quote>and wilderness areas</quote>.</text>
 </paragraph><paragraph id="id9736a879b7114774b558641aa3a01a98"><enum>(2)</enum><header>Overflights; special airspace</header><text>Section 802 of the California Military Lands Withdrawal and Overflights Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/16/410aaa-82">16 U.S.C. 410aaa–82</external-xref>) is amended—</text>
 <subparagraph id="id239c64e018b54d3f88936429c4a1a257"><enum>(A)</enum><text>in subsection (a), by inserting <quote>or special management areas</quote> before <quote>designated by this Act</quote>;</text> </subparagraph><subparagraph id="id50f8d57397ae4f1296118439c1466a53"><enum>(B)</enum><text>in subsection (b), by inserting <quote>or special management areas</quote> before <quote>designated by this Act</quote>; and</text>
 </subparagraph><subparagraph id="id666f88ece4ea4f4cb00fb25af7c39e30"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="idd6aca79978b44687b756e583a70a15ba" style="OLC"> <subsection id="id00c52894e31342a2aeb382dd022a38aa"><enum>(d)</enum><header>Department of Defense facilities</header><text>Nothing in this Act alters any authority of the Secretary of Defense to conduct military operations at installations and ranges within the California Desert Conservation Area that are authorized under any other provision of law.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subparagraph></paragraph></subsection><subsection id="id5e6ca1580c2f407ebf521d8997297b49"><enum>(g)</enum><header>Clarification regarding funding</header><text>No additional funds are authorized to carry out the requirements of this title and the amendments made by this title. Such requirements shall be carried out using amounts otherwise authorized.</text>
				</subsection></section></title><title id="id50b02077d9e4419b9d3cac3b07d75d83"><enum>II</enum><header>Development of renewable energy on public land</header>
 <section id="idfa1183e5b34c42329839d7f83a56df68"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> <paragraph id="idb62237d82487466b81e310ef30f4b2dd"><enum>(1)</enum><header>Fund</header><text>The term <term>Fund</term> means the Renewable Energy Resource Conservation Fund established by section 202(c).</text>
 </paragraph><paragraph id="idbd30f975254c4bc8893b2ccacd7a6641"><enum>(2)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text> </paragraph><paragraph id="id4d5bcf0ec6ef4e85a6e1047d1881afd8"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text>
				</paragraph></section><section id="id8ce48c9b94d847c8af8c78e2930913f9"><enum>202.</enum><header>Disposition of revenues</header>
 <subsection id="id34d5be0be6324bf38997bd1634019df1"><enum>(a)</enum><header>Disposition of revenues</header><text>Of the amounts collected as bonus bids, royalties, rentals, fees, or other payments under a right-of-way, permit, lease, or other authorization for the development of wind or solar energy on land managed by the Bureau of Land Management—</text>
 <paragraph id="idc2a37b49d3be4516904f7bf966c63755"><enum>(1)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the State within the boundaries of which the income is derived;</text>
 </paragraph><paragraph id="idc686df78174b434095adde531bd59446"><enum>(2)</enum><text>25 percent shall be paid by the Secretary of the Treasury to the one or more counties within the boundaries of which the income is derived, to be allocated among the counties based on the percentage of public land from which the royalties or bonuses are derived in each county;</text>
 </paragraph><paragraph id="idbcf77040338e4af8b53a57032699907b"><enum>(3)</enum><text>15 percent shall—</text> <subparagraph id="id5b4a4a05ebcb494d8b0860b72c3a1638"><enum>(A)</enum><text>for the 10-year period beginning on the date of enactment of this Act, be deposited in the Treasury of the United States to help facilitate the processing of renewable energy permits by the Bureau of Land Management and the United States Fish and Wildlife Service, including the transfer of the funds to other Federal agencies and State agencies to facilitate the processing of renewable energy permits; and</text>
 </subparagraph><subparagraph id="id83916cfd87bb48148e3710eaaa05b82e"><enum>(B)</enum><text>beginning on the date that is 10 years after the date of enactment of this Act, be deposited in the Fund; and</text>
 </subparagraph></paragraph><paragraph id="id46c2b2f2961d47ae9415945d85c409fb"><enum>(4)</enum><text>35 percent shall be deposited in the Fund.</text> </paragraph></subsection><subsection id="id31a6ab2619994108a9b3ac8c094ae181"><enum>(b)</enum><header>Payments to States and counties</header> <paragraph id="iddb56709ebc944dbdad8ef1eb38343650"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), amounts paid to States and counties under subsection (a) shall be used consistent with section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>).</text>
 </paragraph><paragraph id="id4eeb19bf802540b6aa72aea89d0823ff"><enum>(2)</enum><header>Impacts on Federal land</header><text>Not less than 33 percent of the amount paid to a State shall be used on an annual basis for the purposes described in subsection (c)(2)(A).</text>
 </paragraph><paragraph id="idfe4d517615db4013be7e654521f570b8"><enum>(3)</enum><header>No impact on payments in lieu of taxes</header><text>Nothing in this section impacts or reduces any payment authorized under section 6903 of title 31, United States Code.</text>
					</paragraph></subsection><subsection id="idD8DF3DE5322842BA9D2C16AD43128542"><enum>(c)</enum><header>Renewable Energy Resource Conservation Fund</header>
 <paragraph id="id33a6eceaa1934774b39e90abf057e9d4"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury a fund, to be known as the <quote>Renewable Energy Resource Conservation Fund</quote>, to be administered by the Secretary for use in regions impacted by the development of wind or solar energy.</text>
					</paragraph><paragraph id="id830957e5593d41d5ba25901bf6b3ce7d"><enum>(2)</enum><header>Use</header>
 <subparagraph id="id7854ee6c9590438687fb5505edd3098e"><enum>(A)</enum><header>In general</header><text>Amounts in the Fund shall be available to the Secretary, who may make amounts available to the Secretary of Agriculture and to other Federal or State agencies, as appropriate, for the purposes of—</text>
 <clause id="id8fdc63b59cb44d109dc3bf7583851b01"><enum>(i)</enum><text>addressing the impacts of wind or solar development on Federal land, including restoring and protecting—</text>
 <subclause id="id52369f4491304aec8efeb6bdf6969bc7"><enum>(I)</enum><text>wildlife habitat for affected species;</text> </subclause><subclause id="ide7e736f5bf704a2f9e4a08a25098fcf3"><enum>(II)</enum><text>wildlife corridors for affected species; and</text>
 </subclause><subclause id="ide575a4a8c1cd4175b5b50892926036d6"><enum>(III)</enum><text>water resources in areas impacted by wind or solar energy development;</text> </subclause></clause><clause id="idd343ec5c780243a0ad865bdafc06edb7"><enum>(ii)</enum><text>conducting research with regional institutions of higher education necessary to implement restoration and protection activities described in clause (i);</text>
 </clause><clause id="id165fb3aa4fa04c95bbb7eb53828f9ce2"><enum>(iii)</enum><text>securing recreational access to Federal land through an easement, right-of-way, or fee title acquisition from willing sellers for the purpose of providing enhanced public access to existing Federal land that is inaccessible or significantly restricted if the enhanced public access does not impact the natural and cultural resource values of the Federal land;</text>
 </clause><clause id="id5d3b143a59594e88acb8fb5e826ef0c9"><enum>(iv)</enum><text>carrying out activities authorized under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/54/2003">chapter 2003</external-xref> of title 54, United States Code, in the State; and</text>
 </clause><clause id="id63a41a8852584247a59d61e909639fd4"><enum>(v)</enum><text>establishing, operating, and maintaining a trans-State desert tortoise conservation center on public land along the California-Nevada border—</text>
 <subclause id="idcfca966c9ec1423eb217bd7b6f1a9746"><enum>(I)</enum><text>to support desert tortoise research, disease monitoring, handling training, rehabilitation, and reintroduction;</text>
 </subclause><subclause id="idbcb6c49f47e245c5a81a10ecf8ea5bfb"><enum>(II)</enum><text>to provide temporary quarters for animals collected from authorized salvage from renewable energy sites; and</text>
 </subclause><subclause id="id738e9bde6dbc4b6bad00bb13c0f05886"><enum>(III)</enum><text>to ensure the full recovery and ongoing survival of the species.</text> </subclause></clause></subparagraph><subparagraph id="ida9fe292be0324219b20830c020e399f8"><enum>(B)</enum><header>Desert tortoise conservation</header><text>In carrying out subparagraph (A)(v), the Secretary shall—</text>
 <clause id="idda3c46e4af334a27a1858d10a8fb724e"><enum>(i)</enum><text>seek the participation of or contract with qualified nongovernmental organizations with expertise in desert tortoise disease research and experience with desert tortoise translocation techniques, and scientific training of professional biologists for handling tortoises, to staff and manage the desert tortoise conservation center;</text>
 </clause><clause id="idc35dc6f5143d4d4a83fc5155b4be15f8"><enum>(ii)</enum><text>ensure that the center engages in public outreach and education on tortoise handling; and</text> </clause><clause id="id51fc32cc37f848bba10b0da240b08ffc"><enum>(iii)</enum><text>consult with the State of California and the State of Nevada to ensure the center is operated consistent with State law.</text>
							</clause></subparagraph><subparagraph id="idc079d9b994cb417c8cad32637ee3aefa"><enum>(C)</enum><header>Advisory board</header>
 <clause id="id2e4de683120c47eb88b396a126c403b5"><enum>(i)</enum><header>In general</header><text>The Secretary shall establish an independent advisory board composed of key stakeholders and technical experts to provide recommendations and guidance on the disposition of any amounts expended from the Fund.</text>
 </clause><clause id="id39161d0801ea4308b8aa657ac3f6fdfd"><enum>(ii)</enum><header>Administrative costs</header><text>Amounts in the Fund shall not be used to fund any of the administrative costs of the advisory board established under clause (i).</text>
 </clause></subparagraph></paragraph><paragraph id="id9f46b2fbacab4e20aac2e91dc2f8da42"><enum>(3)</enum><header>Mitigation requirements</header><text>The expenditure of funds under this subsection shall be in addition to any mitigation requirements imposed pursuant to any law, regulation, or term or condition of any lease, right-of-way, or other authorization.</text>
					</paragraph><paragraph id="id59cf8905a192481cbbbbf3dc4dacb61b"><enum>(4)</enum><header>Investment of Fund</header>
 <subparagraph id="id5dc946deda89467f89fbae6e304cb60c"><enum>(A)</enum><header>In general</header><text>Any amounts deposited in the Fund shall earn interest in an amount determined by the Secretary of the Treasury on the basis of the current average market yield on outstanding marketable obligations of the United States of comparable maturities.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc92b06ca7a2d4576aa372e51547e17a0"><enum>(B)</enum><header>Use</header><text>Any interest earned under subparagraph (A) shall be expended in accordance with this subsection.</text></subparagraph></paragraph></subsection></section></title></legis-body></bill>
