	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
 <section id="idC4F6375D3E43444DABAEDA1920CEB965" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>John P. Smith Act</short-title></quote>.</text> </section><section commented="no" display-inline="no-display-inline" id="idF34DBE9EBDB4403EAD08AD804A45DF5A" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of the Interior.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idB14DE5E5A12442B69AC73169B88CBB58" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Application of categorical exclusions to certain tribal transportation facilities</header>
			<subsection commented="no" display-inline="no-display-inline" id="id55ff4bb1929b4053b1aac8ba5108d2aa"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of tribal transportation safety project</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id2DDB4740297C4DBEB509183D3D3CBEE5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In this section, the term <term>tribal transportation safety project</term> means a project described in paragraph (2) that is eligible for funding under section 202 of title 23, United States Code, and that—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idF4434D95895B4ADA9F3C974AAE0B8281"><enum>(A)</enum><text display-inline="yes-display-inline">corrects or improves a hazardous road location or feature; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A1B64175FDF49F4AC4C88890792CA1D"><enum>(B)</enum><text display-inline="yes-display-inline">addresses a highway safety problem.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7594BE3D58B941B4B214E2468C1D2BB5"><enum>(2)</enum><header display-inline="yes-display-inline">Projects described</header><text display-inline="yes-display-inline">A project described in this paragraph is a project for one or more of the following:</text> <subparagraph commented="no" display-inline="no-display-inline" id="idf8e2772c3e3a488eb2a8ddd717d27872"><enum>(A)</enum><text display-inline="yes-display-inline">An intersection safety improvement.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7897b5a3c59848fea874f229d6d68000"><enum>(B)</enum><text display-inline="yes-display-inline">Pavement and shoulder widening (including the addition of a passing lane to remedy an unsafe condition).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idabd63db2a1c64201901fa85c84f36f5e"><enum>(C)</enum><text display-inline="yes-display-inline">Installation of rumble strips or another warning device, if the rumble strips or other warning devices do not adversely affect the safety or mobility of bicyclists and pedestrians, including persons with disabilities.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaef9d4a3bf4a413a8f79a9e9c7a12a79"><enum>(D)</enum><text display-inline="yes-display-inline">Installation of a skid-resistant surface at an intersection or other location with a high frequency of crashes.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc8d4fd28c4174f59aff98c2406daefe7"><enum>(E)</enum><text display-inline="yes-display-inline">An improvement for pedestrian or bicyclist safety or the safety of persons with disabilities.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf91281f3fce2444bae8d01b6cf4c22a5"><enum>(F)</enum><text display-inline="yes-display-inline">Construction and improvement of a railway-highway grade crossing safety feature, including the installation of protective devices.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide22a83d5d5ff470f886a49f9a82c0522"><enum>(G)</enum><text display-inline="yes-display-inline">The conduct of a model traffic enforcement activity at a railway-highway crossing.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa641aa13ed44d40abfce2634131c6d1"><enum>(H)</enum><text display-inline="yes-display-inline">Construction of a traffic calming feature.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddaa668947b0c44d5a4f6fa39688924c5"><enum>(I)</enum><text display-inline="yes-display-inline">Elimination of a roadside hazard.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0b12d66cf4f4a1687ed71de11dbe5d5"><enum>(J)</enum><text display-inline="yes-display-inline">Installation, replacement, and other improvements of highway signage and pavement markings or a project to maintain minimum levels of retroreflectivity that addresses a highway safety problem consistent with a State strategic highway safety plan.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8de4429a1f0144ab927ed169d879eee9"><enum>(K)</enum><text display-inline="yes-display-inline">Installation of a priority control system for emergency vehicles at signalized intersections.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d368532301a477abf43715ce8dbf349"><enum>(L)</enum><text display-inline="yes-display-inline">Installation of a traffic control or other warning device at a location with high crash potential.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id845a6d549317417dba511f6e4498e193"><enum>(M)</enum><text display-inline="yes-display-inline">Transportation safety planning.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec687e1a41ab4c7bbf9a8a0cbe405f86"><enum>(N)</enum><text display-inline="yes-display-inline">Collection, analysis, and improvement of safety data.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7a249dec7424eb4a583b2a4f8369bb7"><enum>(O)</enum><text display-inline="yes-display-inline">Planning integrated interoperable emergency communications equipment, operational activities, or traffic enforcement activities (including police assistance) relating to work zone safety.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fac9bba3ea5471ea5d415270a9a4b44"><enum>(P)</enum><text display-inline="yes-display-inline">Installation of guardrails, barriers (including barriers between construction work zones and traffic lanes for the safety of road users and workers), and crash attenuators.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf80008cacc474847939f2a3fae56b856"><enum>(Q)</enum><text display-inline="yes-display-inline">The addition or retrofitting of structures or other measures to eliminate or reduce crashes involving vehicles and wildlife.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb65847b95882464d8757181c8f4ae663"><enum>(R)</enum><text display-inline="yes-display-inline">Installation of yellow-green signs and signals at pedestrian and bicycle crossings and in school zones.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7809c34ca8584294a3fad862dc1bef6f"><enum>(S)</enum><text display-inline="yes-display-inline">Construction and operational improvements on a high risk rural road (as defined in section 148(a) of title 23, United States Code).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46f1d60ed9134f52b60c58e9f50ab270"><enum>(T)</enum><text display-inline="yes-display-inline">Geometric improvements to a road for the purposes of safety improvement.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12ac771e13cb4aeb903f7267bd83da07"><enum>(U)</enum><text display-inline="yes-display-inline">A road safety audit.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe75c53059c94f92acd5efea9b924e30"><enum>(V)</enum><text display-inline="yes-display-inline">Roadway safety infrastructure improvements consistent with the recommendations included in the publication of the Federal Highway Administration entitled <quote>Handbook for Designing Roadways for the Aging Population</quote> (FHWA–SA–14–015), dated June 2014 (or a revised or updated publication).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47dc7efbffcd4fe3b085c7dc2b024d8d"><enum>(W)</enum><text display-inline="yes-display-inline">Truck parking facilities eligible for funding under section 1401 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/23/137">23 U.S.C. 137</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>).</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e753a5c576046438f4dd0bb58b0a05b"><enum>(X)</enum><text display-inline="yes-display-inline">Systemic safety improvements.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide38b5152eba94cd2b3c2830f05dfa074"><enum>(Y)</enum><text display-inline="yes-display-inline">Installation of vehicle-to-infrastructure communication equipment.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb47a95d9f456424b8e923ae129b95b4a"><enum>(Z)</enum><text display-inline="yes-display-inline">Pedestrian hybrid beacons.</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25965f7ee25f467db79b24d58b5807dc"><enum>(AA)</enum><text display-inline="yes-display-inline">Roadway improvements that provide separation between pedestrians and motor vehicles, including medians and pedestrian crossing islands.</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb588c23cc36a434eb09282590df3f420"><enum>(BB)</enum><text display-inline="yes-display-inline">A physical infrastructure safety project not described in subparagraphs (A) through (AA).</text> </subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c8021183b2c41adbb3b36d621fa923b"><enum>(b)</enum><header display-inline="yes-display-inline">New categorical exclusions</header> <paragraph commented="no" display-inline="no-display-inline" id="idce460da12b114609803a21e966c03ec4"><enum>(1)</enum><header display-inline="yes-display-inline">Review of existing categorical exclusions</header><text display-inline="yes-display-inline">The Secretary shall review the categorical exclusions under section 771.117 of title 23, Code of Federal Regulations (or successor regulations), to determine which, if any, are applicable for use by the Secretary in review of projects eligible for assistance under section 202 of title 23, United States Code.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id234650d6ddd2488289e7b164b118630f"><enum>(2)</enum><header display-inline="yes-display-inline">Review of tribal transportation safety projects</header><text display-inline="yes-display-inline">The Secretary shall identify tribal transportation safety projects that meet the requirements for categorical exclusions under sections 1507.3 and 1508.4 of title 40, Code of Federal Regulations.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4bc59f13e8484fb7b48df8e4ed50ea14"><enum>(3)</enum><header display-inline="yes-display-inline">Proposal</header><text display-inline="yes-display-inline">The Secretary shall issue a proposed rule, in accordance with sections 1507.3 and 1508.4 of title 40, Code of Federal Regulations, to propose any categorical exclusions identified under paragraphs (1) and (2).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9289f8877564bdaa0ed9232544abfde"><enum>(4)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, and after considering any comments on the proposed rule issued under paragraph (3), the Secretary shall promulgate a final rule for the categorical exclusions, in accordance with sections 1507.3 and 1508.4 of title 40, Code of Federal Regulations.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id488777c077f84da7ba8aaad55a30d40b"><enum>(5)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Secretary of Transportation shall provide technical assistance to the Secretary in carrying out this subsection.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb8ba27e882d84856b8c8ca071c25545c"><enum>(c)</enum><header display-inline="yes-display-inline">Reviews of tribal transportation safety projects</header>
 <paragraph commented="no" display-inline="no-display-inline" id="id14b8e260fe874e9a976e5cdde2ea1062"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary or the head of another Federal agency responsible for a decision related to a tribal transportation safety project shall complete any approval or decision for the review of the tribal transportation safety project required under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) or any other applicable Federal law on an expeditious basis using the shortest existing applicable process.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec5d6863a3ef4bee8da8b3c891862ca0"><enum>(2)</enum><header display-inline="yes-display-inline">Review of applications</header><text display-inline="yes-display-inline">Not later than 45 days after the date of receipt of a complete application by an Indian tribe for approval of a tribal transportation safety project, the Secretary shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idf05912b48469454181e26ee1608c9866"><enum>(A)</enum><text display-inline="yes-display-inline">take final action on the application; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d9db226d63440eb91cb254b94d77756"><enum>(B)</enum><text display-inline="yes-display-inline">provide the Indian tribe a schedule for completion of the review described in paragraph (1), including the identification of any other Federal agency that has jurisdiction with respect to the project.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7BB3EDBE727646559E863E8908D35EA4"><enum>(3)</enum><header display-inline="yes-display-inline">Decisions under other Federal laws</header><text display-inline="yes-display-inline">In any case in which a decision under any other Federal law relating to a tribal transportation safety project (including the issuance or denial of a permit or license) is required, not later than 45 days after the Secretary has made all decisions of the lead agency under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) with respect to the project, the head of the Federal agency responsible for the decision shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="idF8373338B0E9435786FBFECF36A19152"><enum>(A)</enum><text display-inline="yes-display-inline">make the applicable decision; or</text> </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8B068309C7644FCE9442C51FBFC2BFD0"><enum>(B)</enum><text display-inline="yes-display-inline">provide the Indian tribe a schedule for making the decision.</text>
 </subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd4ba71e29e148e192b851d2e0a88975"><enum>(4)</enum><header display-inline="yes-display-inline">Extensions</header><text display-inline="yes-display-inline">The Secretary or the head of an applicable Federal agency may extend the period under paragraph (2) or (3), as applicable, by an additional 30 days by providing the Indian tribe notice of the extension, including a statement of the need for the extension.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddcd56df071954019af937eb81227286e"><enum>(5)</enum><header display-inline="yes-display-inline">Notification and explanation</header><text display-inline="yes-display-inline">In any case in which a required action is not completed by the deadline under paragraph (2), (3), or (4), as applicable, the Secretary or the head of a Federal agency, as applicable, shall—</text>
 <subparagraph commented="no" display-inline="no-display-inline" id="id85A8326CBD364581A621EAC5E84C754A"><enum>(A)</enum><text display-inline="yes-display-inline">notify the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives of the failure to comply with the deadline; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D491C1ED73D4BA0AE3A113691DF514E"><enum>(B)</enum><text display-inline="yes-display-inline">provide to the Committees described in subparagraph (A) a detailed explanation of the reasons for the failure to comply with the deadline.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idb2170846b4324e718d4199d0d2566f7c" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Programmatic agreements for categorical exclusions</header>
 <subsection commented="no" display-inline="no-display-inline" id="id3c219350febc4f078f62fcf4229c5d84"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall enter into programmatic agreements with Indian tribes that establish efficient administrative procedures for carrying out environmental reviews for projects eligible for assistance under section 202 of title 23, United States Code.</text>
 </subsection><subsection commented="no" display-inline="no-display-inline" id="id6eafd3d54eb644899d4cc972ca6268dd"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">A programmatic agreement under subsection (a)—</text> <paragraph commented="no" display-inline="no-display-inline" id="id5D2DEAE133DF430CBD9DFABCD28AF82E"><enum>(1)</enum><text display-inline="yes-display-inline">may include an agreement that allows an Indian tribe to determine, on behalf of the Secretary, whether a project is categorically excluded from the preparation of an environmental assessment or environmental impact statement under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE4C012BBCAE4E7980DCFDF15C0C7754"><enum>(2)</enum><text display-inline="yes-display-inline">shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2b1ef6619ac74cd7ab20d739e0288280"><enum>(A)</enum><text display-inline="yes-display-inline">require that the Indian tribe maintain adequate capacity in terms of personnel and other resources to carry out applicable agency responsibilities pursuant to section 1507.2 of title 40, Code of Federal Regulations (or successor regulations);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5357c5c7852f493bae2b71ead4ab5b7f"><enum>(B)</enum><text display-inline="yes-display-inline">set forth the responsibilities of the Indian tribe for making categorical exclusion determinations, documenting the determinations, and achieving acceptable quality control and quality assurance;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfe81aee9ace44d88a73a925289e4f6bf"><enum>(C)</enum><text display-inline="yes-display-inline">allow—</text> <clause commented="no" display-inline="no-display-inline" id="id3F467F5322C64B27B0C9564A01EA73C2"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary to monitor compliance of the Indian tribe with the terms of the agreement; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idC144BF27DB8F463198BF03D0C78C7251"><enum>(ii)</enum><text display-inline="yes-display-inline">the Indian tribe to execute any needed corrective action;</text> </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95415ec4830e48039aaf71a3ecddd4ae"><enum>(D)</enum><text display-inline="yes-display-inline">contain stipulations for amendments, termination, and public availability of the agreement once the agreement has been executed; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58ccde98e19d482193e7ee58544a8fbf"><enum>(E)</enum><text display-inline="yes-display-inline">have a term of not more than 5 years, with an option for renewal based on a review by the Secretary of the performance of the Indian tribe.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
