			 air traffic controllers, nuclear materials couriers, members of the
			 Capitol Police, members of the Supreme Court Police, employees of the
			 Central Intelligence Agency performing intelligence activities abroad or
			 having specialized security requirements, and diplomatic security special
			 agents of the Department of State to receive retirement benefits in the
			 same manner as if they had not been disabled.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause">
 <section id="idFAA2A79F15914D10B5F72AFD976A1C81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Return for Employees on Their Initial Retirement Earned Act of 2017</short-title></quote> or the <quote><short-title>Fair RETIRE Act</short-title></quote>.</text> </section><section id="idC2F3E250FBBD4DF480354B9057B14B33"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
 <paragraph id="id3639F1A5F0C5495C8D3D9BFF9DFAF6A5"><enum>(1)</enum><text display-inline="yes-display-inline">it is in the best national and homeland security interests of the United States for Federal agencies to retain the specialized knowledge and experience of individuals who suffer an injury or illness while serving in a covered position (as defined under the amendments made by this Act); and</text>
 </paragraph><paragraph id="id2D804D1FA4BB470C9B099BB0764881BB"><enum>(2)</enum><text display-inline="yes-display-inline">in developing regulations to carry out this Act and the amendments made by this Act, the Director of the Office of Personnel Management and the Secretary of Labor should ensure, to the greatest extent possible, that the reappointment of an individual to a position in the civil service that is not a covered position is with the same Federal agency, in the same geographic location, and at a level of pay commensurate to the position which the individual held immediately prior to such injury or illness.</text>
			</paragraph></section><section id="id3C89A573D1274FA597FA003F931EAD4A" section-type="subsequent-section"><enum>3.</enum><header>Retirement for certain employees</header>
 <subsection id="id4B76524B9C334660BE8EDF9A6F2F9071"><enum>(a)</enum><header>CSRS</header><text display-inline="yes-display-inline">Section 8336(c) of title 5, United States Code, is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7615D242A85543118503226971AADDD1" style="OLC"> <paragraph id="idFBAB3C456814448EBBDD5B183C9FDD94" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id7F1F69A3843B4D33830E6A7C3D424B2A"><enum>(A)</enum><text>In this paragraph—</text>
 <clause id="idA7F19B1F81EB4A7E9AC8E90C51B733F6" indent="up1"><enum>(i)</enum><text>the term <term>covered individual</term> means an individual covered under this subchapter who—</text> <subclause id="id69E0047332D540209A660BF1264B1AF3"><enum>(I)</enum><text>is performing service in a covered position;</text>
 </subclause><subclause id="idFA513A28DD5E4D0A8614E6D2E71DCD35"><enum>(II)</enum><text>has performed not less than 3 years of creditable service in a covered position;</text> </subclause><subclause id="idB04A9BB4A3664BE6AEB529E788669771"><enum>(III)</enum><text>while in the performance of the duties of the individual, becomes ill or is injured before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), (m), or (n), as applicable;</text>
 </subclause><subclause id="id05450E3E3A864CE38F4774E9B746F357"><enum>(IV)</enum><text>because of the illness or injury described in subclause (III), is permanently unable to continue service in a covered position, determined in accordance with regulations promulgated by the Director of the Office of Personnel Management, in consultation with the Secretary of Labor; and</text>
 </subclause><subclause id="id8D17DFF31CBA487F845A27C8C5EB3851"><enum>(V)</enum><text>is appointed to a position in the civil service that is not a covered position; and</text> </subclause></clause><clause id="id8D5E9E7F659241EA9847F09EECAF32E2" indent="up1"><enum>(ii)</enum><text>the term <term>covered position</term> means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, member of the Supreme Court Police, an employee of the Central Intelligence Agency designated under section 302(a) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152(a)</external-xref>), or special agent described in section 804(15) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4044">22 U.S.C. 4044(15)</external-xref>).</text>
 </clause></subparagraph><subparagraph id="id7301727B354D4A5F9F83349C660309CD" indent="up1"><enum>(B)</enum><text>Unless a covered individual files an election described in subparagraph (C), creditable service by the covered individual in a position described in subparagraph (A)(i)(V) shall be treated as creditable service in a covered position for purposes of this chapter, including eligibility for an annuity under paragraph (1) of this subsection or subsection (e), (m), or (n), as applicable, and determining the amount to be deducted and withheld from the pay of the covered individual under section 8334.</text>
 </subparagraph><subparagraph id="idBE295A844212404087F5F5132348551A" indent="up1"><enum>(C)</enum><text>In accordance with procedures established by the Director of the Office of Personnel Management, a covered individual may file an election to have any creditable service performed by the covered individual treated in accordance with this chapter, without regard to subparagraph (B).</text>
 </subparagraph><subparagraph id="idE048DBE8FF3B44E497AE7DE25B3E0BE1" indent="up1"><enum>(D)</enum><text>If a covered individual who has not filed an election described in subparagraph (C) separates from service before the date on which the covered individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), (m), or (n), as applicable, the covered individual shall be entitled to a lump sum payment from the Fund of the difference between—</text>
 <clause id="id047281F590BD4B59B90B71D6EB567638"><enum>(i)</enum><text>the amount that was deducted and withheld from the pay of the covered individual; and</text> </clause><clause id="id1EE7772A96EA44DA82F466073F865280"><enum>(ii)</enum><text>the amount that would have been deducted and withheld from the pay of the covered individual if the covered individual had made an election described in subparagraph (C).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idACFCB8A2C6D746D88F03F059DA612264"><enum>(b)</enum><header>FERS</header>
 <paragraph id="id50007B8A97554500B94CC757C0FA2B68"><enum>(1)</enum><header>In general</header><text>Section 8412(d) of title 5, United States Code, is amended—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id60F4B2EDB4414ED4A8CB92CCA146993D"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text>
 </subparagraph><subparagraph id="idA68E75EB13424A12B3733F46F07DDC4F"><enum>(B)</enum><text>by inserting <quote>(1)</quote> before <quote>An employee</quote>; and</text> </subparagraph><subparagraph id="id0EFE0BAA29EC4FD18658AAAF30C07AF8"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idD638512F9B53487EA6E93C9E3FE08B28" style="OLC">
 <paragraph id="idFEE46FE5FEB44A868BC2881395FF1226" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC4455E47E29E4F5884284233B27389D1"><enum>(A)</enum><text>In this paragraph—</text> <clause id="idB181CAA7052E43459061C09A31AD05DF" indent="up1"><enum>(i)</enum><text>the term <term>covered individual</term> means an individual covered under this chapter who—</text>
 <subclause id="id605E536FFBC8413FAA694D16B696CF80"><enum>(I)</enum><text>is performing service in a covered position;</text> </subclause><subclause id="idBC58802827F74610912D3751BEAEEC2B"><enum>(II)</enum><text>has performed not less than 3 years of creditable service in a covered position;</text>
 </subclause><subclause id="id4AE90F30E7C44F78BB25C9C80BB7A0AB"><enum>(III)</enum><text>while in the performance of the duties of the individual, becomes ill or is injured before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), as applicable;</text>
 </subclause><subclause id="idC024B224369D4F7B8051582ADDDB5917"><enum>(IV)</enum><text>because of the illness or injury described in subclause (III), is permanently unable to continue service in a covered position, determined in accordance with regulations promulgated by the Director of the Office of Personnel Management, in consultation with the Secretary of Labor; and</text>
 </subclause><subclause id="idBA6C0C3D83304CF08A4721E9BF93455A"><enum>(V)</enum><text>is appointed to a position in the civil service that is not a covered position; and</text> </subclause></clause><clause id="id206FE26F95FA4C8A83CA52C58163D22B" indent="up1"><enum>(ii)</enum><text>the term <term>covered position</term> means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, member of the Supreme Court Police, an employee of the Central Intelligence Agency designated under section 302(a) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152(a)</external-xref>), or special agent described in section 804(15) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4044">22 U.S.C. 4044(15)</external-xref>).</text>
 </clause></subparagraph><subparagraph id="id25E5D5198DF7497190FD6A3F24893F47" indent="up1"><enum>(B)</enum><text>Unless a covered individual files an election described in subparagraph (C), creditable service by the covered individual in a position described in subparagraph (A)(i)(V) shall be treated as creditable service in a covered position for purposes of this chapter, including eligibility for an annuity under paragraph (1) of this subsection or subsection (e), as applicable, and determining the amount to be deducted and withheld from the pay of the covered individual under section 8422.</text>
 </subparagraph><subparagraph id="idB2FAB3739BF94E2AA54CF0913D3439EB" indent="up1"><enum>(C)</enum><text>In accordance with procedures established by the Director of the Office of Personnel Management, a covered individual may file an election to have any creditable service performed by the covered individual treated in accordance with this chapter, without regard to subparagraph (B).</text>
 </subparagraph><subparagraph id="id2E85862890B146D79B0E95B1F7CB84BE" indent="up1"><enum>(D)</enum><text>If a covered individual who has not filed an election described in subparagraph (C) separates from service before the date on which the covered individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), as applicable, the covered individual shall be entitled to a lump sum payment from the Fund of the difference between—</text>
 <clause id="id5911E622AC2846D3B7C9F12403C082B2"><enum>(i)</enum><text>the amount that was deducted and withheld from the pay of the covered individual; and</text> </clause><clause id="idD3FF5EE5F380455CB3AC3D48003ADD24"><enum>(ii)</enum><text>the amount that would have been deducted and withheld from the pay of the covered individual if the covered individual had made an election described in subparagraph (C).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idDC5DC96DC6374D12AC5D5D8E71FF212A"><enum>(2)</enum><header>Technical and conforming amendments</header>
 <subparagraph id="id9CAE0E809E3C4404A7FECF98279E62C5"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">Chapter 84</external-xref> of title 5, United States Code, is amended—</text> <clause id="id48924EAB0C4647B38A8E0711EEFF84C1"><enum>(i)</enum><text>in section 8414(b)(3), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>;</text>
 </clause><clause id="id7E7B617DE0B445CCBB99AD6B1C203532"><enum>(ii)</enum><text>in section 8415—</text> <subclause id="idA137D6DA48454A60ADC1E80C5E307A30"><enum>(I)</enum><text>in subsection (e), in the matter preceding paragraph (1), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>; and</text>
 </subclause><subclause id="id28B5F230EB36499DADE4FD1B3A64F7AE"><enum>(II)</enum><text>in subsection (h)(2)(A), by striking <quote>(d)(2)</quote> and inserting <quote>(d)(1)(B)</quote>;</text> </subclause></clause><clause id="idACD4522C81D042898E04C93DDB0E2F4D"><enum>(iii)</enum><text>in section 8421(a)(1), by inserting <quote>(1)</quote> after <quote>(d)</quote>;</text>
 </clause><clause id="id2ECA465D0843422DA75CE438DDB46422"><enum>(iv)</enum><text>in section 8421a(b)(4)(B)(ii), by inserting <quote>(1)</quote> after <quote>section 8412(d)</quote>;</text> </clause><clause id="id94863B5BD88B4E84AB7AD2B9C093BBEC"><enum>(v)</enum><text>in section 8425, by inserting <quote>(1)</quote> after <quote>section 8412(d)</quote> each place it appears; and</text>
 </clause><clause id="id3AC296A15C4F4C72BD7A85FB767D3588"><enum>(vi)</enum><text>in section 8462(c)(3)(B)(ii), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>.</text> </clause></subparagraph><subparagraph id="idA06B93410CA24191AA12E8A3CEF46735"><enum>(B)</enum><text>Title VIII of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4041">22 U.S.C. 4041 et seq.</external-xref>) is amended—</text>
 <clause id="id944CC21557984560AEEE28F70B1FCD60"><enum>(i)</enum><text>in section 805(d)(5) (<external-xref legal-doc="usc" parsable-cite="usc/22/4045">22 U.S.C. 4045(d)(5)</external-xref>), by inserting <quote>(1)</quote> after <quote>or 8412(d)</quote>; and</text> </clause><clause id="id28099726A88146FE806601E0D43F7AD0"><enum>(ii)</enum><text>in section 812(a)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/22/4052">22 U.S.C. 4052(a)(2)(B)</external-xref>), by inserting <quote>(1)</quote> after <quote>or 8412(d)</quote>.</text>
 </clause></subparagraph></paragraph></subsection><subsection id="id0DEB01A4049E4A3F9A3A0D695DE55069"><enum>(c)</enum><header>CIA employees</header><text>Section 302 of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2FF53BF069BF49FB8B6D8A1B7D488B33" style="OLC">
					<subsection id="id22FE99FF501E4B33875BC1B4CA9FC06B"><enum>(d)</enum><header>Employees disabled on duty</header>
 <paragraph id="idA8F2791B1FD049478723F0F35D38007F"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text> <subparagraph id="id6E7E3FA27C7F4CECA88B9AAC2D6BB5AC"><enum>(A)</enum><text>the term <term>covered employee</term> means an employee of the Agency covered under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, who—</text>
 <clause id="id94332622AED54F389C954E32B2C419E6"><enum>(i)</enum><text>is performing service in a position designated under subsection (a);</text> </clause><clause id="idEF965B7F741D45F3B74F990200ADEC7E"><enum>(ii)</enum><text>has performed not less than 3 years of creditable service in a covered position;</text>
 </clause><clause id="idACAD95AFB8F24C3B8BCA4A2C681A8A5B"><enum>(iii)</enum><text>while in the performance of the duties of the employee in the position designated under subsection (a), becomes ill or is injured before the date on which the employee becomes entitled to an annuity under section 233 of this Act or section 8412(d)(1) of title 5, United States Code;</text>
 </clause><clause id="idBC63A0883D38400A8E2FB31A55C30E5F"><enum>(iv)</enum><text>because of the illness or injury described in clause (iii), is permanently unable to continue service in a covered position, determined in accordance with regulations promulgated by the Director of the Office of Personnel Management, in consultation with the Secretary of Labor; and</text>
 </clause><clause id="id92E5594CEF0649B68469E8856ACD1B83"><enum>(v)</enum><text>is appointed to a position in the civil service that is not a covered position; and</text> </clause></subparagraph><subparagraph id="idC3011C3752544D2AA4BE9783708ACCC4"><enum>(B)</enum><text>the term <term>covered position</term> means a position as—</text>
 <clause id="id3116F848F0AA49AFBC01AD199245CDB6"><enum>(i)</enum><text>a law enforcement officer described in section 8331(20) or 8401(17) of title 5, United States Code;</text> </clause><clause id="id3DD39BE9C61C415CA28C0BBCD76C95A3"><enum>(ii)</enum><text>a customs and border protection officer described in section 8331(31) or 8401(36) of title 5, United States Code;</text>
 </clause><clause id="idE42FE619B9DD4AE99170E014026356D9"><enum>(iii)</enum><text>a firefighter described in section 8331(21) or 8401(14) of title 5, United States Code;</text> </clause><clause id="id5EF25A1A071F4F26B54ABD4CEDB79CDF"><enum>(iv)</enum><text>an air traffic controller described in section 8331(30) or 8401(35) of title 5, United States Code;</text>
 </clause><clause id="idBCDD073772F04F06AFE47DF4734672F4"><enum>(v)</enum><text>a nuclear materials courier described in section 8331(27) or 8401(33) of title 5, United States Code;</text>
 </clause><clause id="id8408230A5D7B41D99697287ADF213080"><enum>(vi)</enum><text>a member of the United States Capitol Police;</text> </clause><clause id="id3190602D6F304BE5B32515493FAAAAF4"><enum>(vii)</enum><text>a member of the Supreme Court Police;</text>
 </clause><clause id="id2D2BE32F6A4A4B64AE71F289A1DADB72"><enum>(viii)</enum><text>a covered employee; or</text> </clause><clause id="id370F518B15704F68A1EB8DECBA0E8BB0"><enum>(ix)</enum><text>a special agent described in section 804(15) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4044">22 U.S.C. 4044(15)</external-xref>).</text>
 </clause></subparagraph></paragraph><paragraph id="idC91942350AB24E9DB57387206B06EC75"><enum>(2)</enum><header>Treatment of service after disability</header><text>Unless a covered employee files an election described in paragraph (3), creditable service by the covered employee in a position described in paragraph (1)(A)(v) shall be treated as creditable service in a covered position for purposes of this Act and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, including eligibility for an annuity under section 233 of this Act or 8412(d)(1) of title 5, United States Code, and determining the amount to be deducted and withheld from the pay of the covered employee under section 8422 of title 5, United States Code.</text>
 </paragraph><paragraph id="id3C3A323335734511AEA1BF2FDAC44224"><enum>(3)</enum><header>Opt out</header><text>In accordance with procedures established by the Director of the Office of Personnel Management, a covered employee may file an election to have any creditable service performed by the covered employee treated in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, without regard to paragraph (2).</text>
 </paragraph><paragraph id="id40E43E864AC5427D8244BF87C6930510"><enum>(4)</enum><header>Separation before retirement eligibility</header><text>If a covered employee who has not filed an election described in paragraph (3) separates from service before the date on which the covered employee becomes entitled to an annuity under section 233 of this Act or 8412(d)(1) of title 5, United States Code, the covered employee shall be entitled to a lump sum payment from the Fund of the difference between—</text>
 <subparagraph id="id4CD8EC723B3047599BE26DC5010C66B6"><enum>(A)</enum><text>the amount that was deducted and withheld from the pay of the covered employee; and</text> </subparagraph><subparagraph id="id78D46AE22B8A48089B9D3B73F6F6706B"><enum>(B)</enum><text>the amount that would have been deducted and withheld from the pay of the covered employee if the covered employee had made an election described in paragraph (3).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
 </subsection><subsection id="idDA094B327115433B9B765A6D765C036C"><enum>(d)</enum><header>Foreign Service Retirement and Disability System</header><text>Section 806(a)(6) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4046">22 U.S.C. 4046(a)(6)</external-xref>) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id671B4EC21CD3428DAF21086E7D2DB446" style="OLC">
 <subparagraph id="id10F5F770AC35410B8479209CC28842CA" indent="up2"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id2BE0ECB430224BF48E59982B71CC8416"><enum>(i)</enum><text>In this subparagraph—</text> <subclause id="idA56110431FBA4688BFE2F07616A0A256" indent="up1"><enum>(I)</enum><text>the term <term>covered special agent</term> means an individual covered under this subchapter who—</text>
 <item id="idBF5D50A661DA4FDBBCAB04BD24093199"><enum>(aa)</enum><text>is performing service as a special agent;</text> </item><item id="id695F11E6660640CD9C3369BDBFE6FFD3"><enum>(bb)</enum><text>has performed not less than 3 years of creditable service in a covered position;</text>
 </item><item id="idB238A6BD9C9348FEB922AB156397E67F"><enum>(cc)</enum><text>while in the performance of the duties of the individual as a special agent, becomes ill or is injured before the date on which the individual becomes entitled to an annuity under section 811;</text>
 </item><item id="id8D92E6549A81459CADFC9122F71654D7"><enum>(dd)</enum><text>because of the illness or injury described in item (cc), is permanently unable to continue service in a covered position, determined in accordance with regulations promulgated by the Director of the Office of Personnel Management, in consultation with the Secretary of Labor; and</text>
 </item><item id="idBC44765B69684962991B9ED932245078"><enum>(ee)</enum><text>is appointed to a position in the Foreign Service that is not a covered position; and</text> </item></subclause><subclause id="id6A4FCA7D11A84DE9841CE6314DC6E9DA" indent="up1"><enum>(II)</enum><text>the term <term>covered position</term> means a position as—</text>
 <item id="id7513a0e6862940cbb2ecf59affc21eae"><enum>(aa)</enum><text>a law enforcement officer described in section 8331(20) or 8401(17) of title 5, United States Code;</text> </item><item id="idDD4699E77C604E7E99BCD474FF5CBE9A"><enum>(bb)</enum><text>a customs and border protection officer described in section 8331(31) or 8401(36) of title 5, United States Code;</text>
 </item><item id="id6607FDADA1A04FD2839BF81E8F010C8C"><enum>(cc)</enum><text>a firefighter described in section 8331(21) or 8401(14) of title 5, United States Code;</text> </item><item id="idB2982236C69C49B58291F1D3FE21D43A"><enum>(dd)</enum><text>an air traffic controller described in section 8331(30) or 8401(35) of title 5, United States Code;</text>
 </item><item id="id83E2E24F2B6F47DA8EB60C43479B717F"><enum>(ee)</enum><text>a nuclear materials courier described in section 8331(27) or 8401(33) of title 5, United States Code;</text>
 </item><item id="id1E996DE2AD6C43F79B11F1DC6AF9BE9A"><enum>(ff)</enum><text>a member of the United States Capitol Police;</text> </item><item id="id25B2C93BD928476789E1420B6E91FCF1"><enum>(gg)</enum><text>a member of the Supreme Court Police;</text>
 </item><item id="id6974BB12DFAC433CA27EFAE975275A3A"><enum>(hh)</enum><text>an employee of the Central Intelligence Agency designated under section 302(a) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152(a)</external-xref>); or</text>
 </item><item id="id05C9CD359E8D4184917C85B12C3434E8"><enum>(ii)</enum><text>a special agent.</text> </item></subclause></clause><clause id="idE92BC1DB3FEB4C9EA07A10CCAD798C96" indent="up1"><enum>(ii)</enum><text>Unless a covered special agent files an election described in clause (iii), creditable service by the covered special agent in a position described in clause (i)(I)(ee) shall be treated as creditable service as a special agent for purposes of this subchapter, including determining the amount to be deducted and withheld from the pay of the individual under section 805.</text>
 </clause><clause id="id1105039AABF34664B92710D0D64B2513" indent="up1"><enum>(iii)</enum><text>In accordance with procedures established by the Secretary, a covered special agent may file an election to have any creditable service performed by the covered special agent treated in accordance with this subchapter, without regard to clause (ii).</text>
 </clause><clause id="id4CF454D3CE9A46B0AD45E4B4FBADCC6A" indent="up1"><enum>(iv)</enum><text>If a covered special agent who has not filed an election described in clause (iii) separates from service before the date on which the covered special agent becomes entitled to an annuity under section 811, the covered special agent shall be entitled to a lump sum payment from the Fund of the difference between—</text>
 <subclause id="idD7F9141D06AB4903A12C8AC77235DEEB"><enum>(I)</enum><text>the amount that was deducted and withheld from the pay of the covered special agent; and</text> </subclause><subclause id="id2190F4061730482DBEF2014E3BD6B4B8"><enum>(II)</enum><text>the amount that would have been deducted and withheld from the pay of the covered special agent if the covered special agent had made an election described in clause (iii).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id43726ACC2C474B8B8469DCEFC0B1580E"><enum>(e)</enum><header>Implementation</header>
 <paragraph id="id14CDF52018F04843AF0D2E70B0BF293B"><enum>(1)</enum><header>In general</header><text>The Director of the Office of Personnel Management—</text> <subparagraph id="id431657A8F71B46EE8AA27DB4AF61C1B0"><enum>(A)</enum><text>not later than 60 days after the date of enactment of this Act, and in consultation with the Secretary of Labor, shall promulgate regulations regarding determining when an individual is permanently unable to continue service in a covered position (as defined in section 302(d) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152(d)</external-xref>), as added by this Act);</text>
 </subparagraph><subparagraph id="idF55EBC175C174F169381271C7AD779C8"><enum>(B)</enum><text>shall promulgate regulations to carry out the amendments made by subsections (a), (b), and (c); and</text>
 </subparagraph><subparagraph id="idA4C2A8206C564FDBB523DECA012AD377"><enum>(C)</enum><text>not later than 1 year after the date of enactment of this Act, shall issue guidance for agencies regarding implementation of the amendments made by subsections (a), (b), and (c).</text>
 </subparagraph></paragraph><paragraph id="idBAC0AEFFF3554E9A83A6607E31C2DFCB"><enum>(2)</enum><header>Foreign Service Retirement and Disability System</header><text>The Secretary of State shall promulgate regulations to carry out the amendment made by subsection (d).</text>
 </paragraph></subsection><subsection id="id2C44A7ED6A694964A199829971C40E17"><enum>(f)</enum><header>Effective date; applicability</header><text>The amendments made by this section—</text> <paragraph id="idE601C8C2F9CF478A9F1983C9367A509A"><enum>(1)</enum><text>shall take effect on the date of enactment of this Act; and</text>
 </paragraph><paragraph id="id3209C787208644E3A4E87CCFC82DE2BA"><enum>(2)</enum><text>shall apply to an individual who suffers an illness or injury described in section 8336(c)(3)(A)(i)(III) or section 8412(d)(2)(A)(i)(III) of title 5, United States Code, as amended by this section, section 302(d)(1)(A)(iii) of the Central Intelligence Agency Retirement Act, as amended by this section, or section 806(a)(6)(D)(i)(I)(cc) of the Foreign Service Act of 1980, as amended by this section, on or after the date that is 2 years after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
