			 Colorado, and for other purposes.</official-title></form>
	<legis-body display-enacting-clause="yes-display-enacting-clause" id="H02D2ADFC08E446B18F35EB8F5D8CE0DA" style="OLC">
 <section id="HED23EEA88F454507BE255540396D1A9C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crags, Colorado Land Exchange Act </short-title></quote>.</text> </section><section id="H17DF0B3F6CA742178F1F5DCA09CCADF0"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
 <paragraph id="H88BD1245EE2545ADB1E5936FF94B2254"><enum>(1)</enum><text>to authorize, direct, expedite and facilitate the land exchange set forth herein; and</text> </paragraph><paragraph id="H72402C971E9E456CA46BE51D9E97CADC"><enum>(2)</enum><text>to promote enhanced public outdoor recreational and natural resource conservation opportunities in the Pike National Forest near Pikes Peak, Colorado, via acquisition of the non-Federal land and trail easement.</text>
 </paragraph></section><section id="HA71726D2865548E497F0EFCEF7FA2EBE"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H19A6ECCF052F481ABD821B739DB0322A"><enum>(1)</enum><header>BHI</header><text>The term <term>BHI</term> means Broadmoor Hotel, Inc., a Colorado corporation.</text>
 </paragraph><paragraph id="HDD8DD2441F88403EA428D962A38B4195"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means all right, title, and interest of the United States in and to approximately 83 acres of land within the Pike National Forest, El Paso County, Colorado, together with a nonexclusive perpetual access easement to BHI to and from such land on Forest Service Road 371, as generally depicted on the map entitled <quote>Proposed Crags Land Exchange–Federal Parcel–Emerald Valley Ranch</quote>, dated March 2015.</text>
 </paragraph><paragraph id="H029265039AE74187915AE0C3EDDDCA2B"><enum>(3)</enum><header>Non-Federal land</header><text>The term <term>non-Federal land</term> means the land and trail easement to be conveyed to the Secretary by BHI in the exchange and is—</text> <subparagraph id="H077E05DC8EED49D29C2B2138E664C9F4"><enum>(A)</enum><text>approximately 320 acres of land within the Pike National Forest, Teller County, Colorado, as generally depicted on the map entitled <quote>Proposed Crags Land Exchange–Non-Federal Parcel–Crags Property</quote>, dated March 2015; and</text>
 </subparagraph><subparagraph id="HE7799AC198C74EF5B9B735911F777108"><enum>(B)</enum><text>a permanent trail easement for the Barr Trail in El Paso County, Colorado, as generally depicted on the map entitled <quote>Proposed Crags Land Exchange–Barr Trail Easement to United States</quote>, dated March 2015, and which shall be considered as a voluntary donation to the United States by BHI for all purposes of law.</text>
 </subparagraph></paragraph><paragraph id="H66338754B307461F93358CC4F2DF873B"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, unless otherwise specified.</text> </paragraph></section><section id="HF240407F9EFC462A9F9C305C3F7EE1AF"><enum>4.</enum><header>Land exchange</header> <subsection id="H90C508765D2843E2BCDEB4C77B05C20C"><enum>(a)</enum><header>In general</header><text>If BHI offers to convey to the Secretary all right, title, and interest of BHI in and to the non-Federal land, the Secretary shall accept the offer and simultaneously convey to BHI the Federal land.</text>
 </subsection><subsection id="H320D9C9B07704ED1BA93370AD98E3769"><enum>(b)</enum><header>Land title</header><text>Title to the non-Federal land conveyed and donated to the Secretary under this Act shall be acceptable to the Secretary and shall conform to the title approval standards of the Attorney General of the United States applicable to land acquisitions by the Federal Government.</text>
 </subsection><subsection id="H6BF1A45AE49C4E7A800B56E2889DADEA"><enum>(c)</enum><header>Perpetual access easement to BHI</header><text>The nonexclusive perpetual access easement to be granted to BHI as shown on the map referred to in section 3(2) shall allow—</text>
 <paragraph id="HA816F3502A3043BE9DA8B359D829FBD5"><enum>(1)</enum><text display-inline="yes-display-inline">BHI to fully maintain, at BHI’s expense, and use Forest Service Road 371 from its junction with Forest Service Road 368 in accordance with historic use and maintenance patterns by BHI; and</text>
 </paragraph><paragraph id="HA149860D440248F4BFA91FECFB81350F"><enum>(2)</enum><text>full and continued public and administrative access and use of FSR 371 in accordance with the existing Forest Service travel management plan, or as such plan may be revised by the Secretary.</text>
 </paragraph></subsection><subsection id="H9D32857A599649DE9FA4678AD9041044"><enum>(d)</enum><header>Route and condition of road</header><text>BHI and the Secretary may mutually agree to improve, relocate, reconstruct, or otherwise alter the route and condition of all or portions of such road as the Secretary, in close consultation with BHI, may determine advisable.</text>
 </subsection><subsection id="H52B7EEDB0CAA43B589E5EC03A39CD2BD"><enum>(e)</enum><header>Exchange costs</header><text>BHI shall pay for all land survey, appraisal, and other costs to the Secretary as may be necessary to process and consummate the exchange directed by this Act, including reimbursement to the Secretary, if the Secretary so requests, for staff time spent in such processing and consummation.</text>
			</subsection></section><section id="H18152ED7A2424BD595CAEA886FCF3050"><enum>5.</enum><header>Equal value exchange and appraisals</header>
 <subsection id="H335316490B9D49EC874B682040AE7C95"><enum>(a)</enum><header>Appraisals</header><text>The values of the lands to be exchanged under this Act shall be determined by the Secretary through appraisals performed in accordance with—</text>
 <paragraph id="H8328BDC08D9F45F3A3A54728A0670814"><enum>(1)</enum><text>the Uniform Appraisal Standards for Federal Land Acquisitions;</text> </paragraph><paragraph id="H158AACA7C22D4789B7878DABDCA0FA06"><enum>(2)</enum><text>the Uniform Standards of Professional Appraisal Practice;</text>
 </paragraph><paragraph id="H03C261EE431C44EB8BBD1A5462E1A475"><enum>(3)</enum><text>appraisal instructions issued by the Secretary; and</text> </paragraph><paragraph id="H9A8FD87B98234480A4F5AA282C366D3D"><enum>(4)</enum><text>shall be performed by an appraiser mutually agreed to by the Secretary and BHI.</text>
 </paragraph></subsection><subsection id="HCD967ED5C1E44316907631CA76BEA4A7"><enum>(b)</enum><header>Equal value exchange</header><text>The values of the Federal and non-Federal land parcels exchanged shall be equal, or if they are not equal, shall be equalized as follows:</text>
 <paragraph id="H886EF91AC83543B2946E4537738E70DD"><enum>(1)</enum><header>Surplus of Federal land value</header><text>If the final appraised value of the Federal land exceeds the final appraised value of the non-Federal land parcel identified in section 3(3)(A), BHI shall make a cash equalization payment to the United States as necessary to achieve equal value, including, if necessary, an amount in excess of that authorized pursuant to section 206(b) of the Federal Land Policy and Management Act of l976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716(b)</external-xref>).</text>
 </paragraph><paragraph id="HA33831288FB24C228E79A17AD450BE23"><enum>(2)</enum><header>Use of funds</header><text>Any cash equalization moneys received by the Secretary under paragraph (1) shall be—</text> <subparagraph id="H0FA4F2A8AC094A0899777510F52671E2"><enum>(A)</enum><text>deposited in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>; <external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>); and</text>
 </subparagraph><subparagraph id="H2C599FD11D0D46008CA7DE68735FF59E"><enum>(B)</enum><text>made available to the Secretary for the acquisition of land or interests in land in Region 2 of the Forest Service.</text>
 </subparagraph></paragraph><paragraph id="H8DC1715568CD4E4A8CD20BC90C2EE87F"><enum>(3)</enum><header>Surplus of non-Federal land value</header><text>If the final appraised value of the non-Federal land parcel identified in section 3(3)(A) exceeds the final appraised value of the Federal land, the United States shall not make a cash equalization payment to BHI, and surplus value of the non-Federal land shall be considered a donation by BHI to the United States for all purposes of law.</text>
				</paragraph></subsection><subsection id="HF1F977B58F5E42278CBBB71D3B1CDC76"><enum>(c)</enum><header>Appraisal exclusions</header>
 <paragraph id="HB3D1A00CA6994F329454725A758DAEB9"><enum>(1)</enum><header>Special Use Permit</header><text>The appraised value of the Federal land parcel shall not reflect any increase or diminution in value due to the special use permit existing on the date of the enactment of this Act to BHI on the parcel and improvements thereunder.</text>
 </paragraph><paragraph id="H52D854E4394545DCB194976D35574F29"><enum>(2)</enum><header>Barr Trail easement</header><text>The Barr Trail easement donation identified in section 3(3)(B) shall not be appraised for purposes of this Act.</text>
				</paragraph></subsection></section><section id="H4CF486A86B6D46F3A0F97C716421C3A3"><enum>6.</enum><header>Miscellaneous provisions</header>
			<subsection id="H1DD4FB2893304444BB3DE65CB8D5010D"><enum>(a)</enum><header>Withdrawal provisions</header>
 <paragraph id="H3BC6038831784A4BAECB3FF9BC3AFBD2"><enum>(1)</enum><header>Withdrawal</header><text>Lands acquired by the Secretary under this Act shall, without further action by the Secretary, be permanently withdrawn from all forms of appropriation and disposal under the public land laws (including the mining and mineral leasing laws) and the Geothermal Steam Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001</external-xref> et seq.).</text>
 </paragraph><paragraph id="H782F31803E3A415C8B05604D0190668C"><enum>(2)</enum><header>Withdrawal revocation</header><text>Any public land order that withdraws the Federal land from appropriation or disposal under a public land law shall be revoked to the extent necessary to permit disposal of the Federal land parcel to BHI.</text>
 </paragraph><paragraph id="HF5A6CEFC8141469B955342F1E371A99B"><enum>(3)</enum><header>Withdrawal of Federal land</header><text>All Federal land authorized to be exchanged under this Act, if not already withdrawn or segregated from appropriation or disposal under the public lands laws upon enactment of this Act, is hereby so withdrawn, subject to valid existing rights, until the date of conveyance of the Federal land to BHI.</text>
 </paragraph></subsection><subsection id="HAB3BDDAB0EED479090A9BFDD47F1E2A0"><enum>(b)</enum><header>Postexchange land management</header><text>Land acquired by the Secretary under this Act shall become part of the Pike-San Isabel National Forest and be managed in accordance with the laws, rules, and regulations applicable to the National Forest System.</text>
 </subsection><subsection commented="no" id="H6A88FC4AFCD748FA917DE0ABBD20ACD1"><enum>(c)</enum><header>Exchange timetable</header><text display-inline="yes-display-inline">It is the intent of Congress that the land exchange directed by this Act be consummated no later than one year after the date of the enactment of this Act.</text>
			</subsection><subsection id="HCA9C8811179844E490EC6E5CAA1C3051"><enum>(d)</enum><header>Maps, estimates, and descriptions</header>
 <paragraph id="H031B14AA42774E00915C7B202817811B"><enum>(1)</enum><header>Minor errors</header><text>The Secretary and BHI may by mutual agreement make minor boundary adjustments to the Federal and non-Federal lands involved in the exchange, and may correct any minor errors in any map, acreage estimate, or description of any land to be exchanged.</text>
 </paragraph><paragraph id="HE5034903BAC445C6A6C0549CA2A9B1EC"><enum>(2)</enum><header>Conflict</header><text>If there is a conflict between a map, an acreage estimate, or a description of land under this Act, the map shall control unless the Secretary and BHI mutually agree otherwise.</text>
 </paragraph><paragraph id="H8610C4EE4CC944668D61643738D9AE6F"><enum>(3)</enum><header>Availability</header><text>Upon enactment of this Act, the Secretary shall file and make available for public inspection in the headquarters of the Pike-San Isabel National Forest a copy of all maps referred to in this Act.</text></paragraph></subsection></section></legis-body></bill>
