			 Russian official and unofficial cyber operations and other attempts to
			 interfere in the 2016 United States national election, and for other
			 purposes.</official-title>

 <section id="ide0b0f28729504753a97797b253db9e6e" section-type="section-one"><enum>1.</enum><header>Establishment of Commission</header><text display-inline="no-display-inline">There is established an independent commission, which shall be known as the <quote>Commission to End Russian Interference in United States Elections</quote> (referred to in this Act as the <quote>Commission</quote>).</text> </section><section id="id2ea10ef5fe684031a2683777d30b691a"><enum>2.</enum><header>Functions</header><text display-inline="no-display-inline">The Commission shall—</text>
 <paragraph id="id04e8a06519f5405e86a359fb091d9072"><enum>(1)</enum><text>comprehensively examine the facts regarding the extent of Russian official and unofficial cyber operations and other attempts to interfere in the 2016 United States national election;</text>
 </paragraph><paragraph id="id283180D9D4794AE886FBDE639581FBF9"><enum>(2)</enum><text>examine attempts by the Russian Government, persons or entities associated with the Russian Government, or other persons or entities within Russia to use cyber-enabled means to access, alter, or otherwise tamper with—</text>
 <subparagraph id="id9ea796ea99564987b0312db285c9fc81"><enum>(A)</enum><text>United States electronic voting systems;</text> </subparagraph><subparagraph id="id532e6e86ebbc4301810871b0d069d15c"><enum>(B)</enum><text>United States voter roll information;</text>
 </subparagraph><subparagraph id="id87bd69f5042348e5a21f59a576892654"><enum>(C)</enum><text>the Democratic National Committee;</text> </subparagraph><subparagraph id="id769fe060ac9545369ab655a8a5fbdae2"><enum>(D)</enum><text>the Democratic Congressional Campaign Committee;</text>
 </subparagraph><subparagraph id="id85e2867679e143e9ac3bdab239bc58b9"><enum>(E)</enum><text>the Democratic Governors Association;</text> </subparagraph><subparagraph id="id2556bd6031b14e9c92ac4ddeeaa89879"><enum>(F)</enum><text>the Republican National Committee;</text>
 </subparagraph><subparagraph id="idb139bd58646b4c7cafa499674343c408"><enum>(G)</enum><text>the Republican Congressional Campaign Committee;</text> </subparagraph><subparagraph id="idd7b9ff71433e45ebb3097573206c4ff0"><enum>(H)</enum><text>the Republican Governors Association;</text>
 </subparagraph><subparagraph id="id43b7b2d50d6f4b498620a1d5cbf34fd9"><enum>(I)</enum><text>Donald J. Trump for President, Inc.; and</text> </subparagraph><subparagraph id="idb63fbbd60ecf4bbfa6608607c8dd4255"><enum>(J)</enum><text>Hillary for America (the Hillary Clinton Presidential campaign);</text>
 </subparagraph></paragraph><paragraph id="idc1fb6502c514477db4d369141832cbb9"><enum>(3)</enum><text>examine efforts by the Russian Government, persons or entities associated with the Russian Government, or persons or entities within Russia to generate, put forward, disseminate, or promote propaganda relevant to any election for public office held in the United States during 2016;</text>
 </paragraph><paragraph id="idc7c49e64e1c145d5adc74149410aa0e5"><enum>(4)</enum><text>examine efforts by the Russian Government to collaborate with other governments, entities, or individuals to carry out activities described in paragraphs (2) and (3);</text>
 </paragraph><paragraph id="id904191c852994238a78564b8c3cc04a6"><enum>(5)</enum><text>examine attempts or activities by governments, persons associated with a government, entities, and individuals other than those described in paragraph (3) to use electronic means to influence, interfere with, or sow distrust in elections for public office held in the United States during 2016;</text>
 </paragraph><paragraph id="idc7ce629b94c948c0b9862438f414412c"><enum>(6)</enum><text>ascertain, evaluate, and report on the evidence developed by all relevant government agencies, including the Department of State, the Office of the Director for National Intelligence, the Central Intelligence Agency, the National Security Agency, the Department of Homeland Security, the Federal Bureau of Investigation, the Department of Defense, and State election commissions, regarding the facts and circumstances surrounding Russia’s interference with elections for public office held in the United States during 2016;</text>
 </paragraph><paragraph id="id49fe4cf81c894b078ca27e69fcb46a10"><enum>(7)</enum><text>review and build upon the findings of completed or ongoing efforts to the investigate such Russian interference, including investigations or inquires conducted by—</text>
 <subparagraph id="id7ba298644a0947e79965442d45fa18f7"><enum>(A)</enum><text>the Administration of President Barack Obama;</text> </subparagraph><subparagraph id="id2a3b52de979c4cbe819745b884ccf2f7"><enum>(B)</enum><text>the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>;</text>
 </subparagraph><subparagraph id="ida85b0a1bb4c44eb49ca143ec618313a1"><enum>(C)</enum><text>the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>;</text> </subparagraph><subparagraph id="id5121caa2ffbb4a39b25b4fba8faf8648"><enum>(D)</enum><text>the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>; and</text>
 </subparagraph><subparagraph id="idC7EDD3B92DFB4965B9A656C6045360A4"><enum>(E)</enum><text>other executive branch, congressional, or independent entities;</text> </subparagraph></paragraph><paragraph id="iddcf0a1d4de2a4caebbad68f3e3ec29b5"><enum>(8)</enum><text>make a full accounting of—</text>
 <subparagraph id="id4C7E97DFAF8048B781B440F2097080BD"><enum>(A)</enum><text>the circumstances surrounding official and unofficial attempts to interfere in the 2016 United States election, including through cyber operations and the promotion of propaganda or other disinformation;</text>
 </subparagraph><subparagraph id="id5452DA359CDB48B9B914AFE56DA969E1"><enum>(B)</enum><text>the level of preparedness of Federal, State, and local governments to defend against such interference; and</text>
 </subparagraph><subparagraph id="idB39A131245464BAF9D4DF66B0CA69A0A"><enum>(C)</enum><text>the United States response to such interference; and</text> </subparagraph></paragraph><paragraph id="id337ebde6a36543b4874ce8c6b673449b"><enum>(9)</enum><text>submit a report to the President and Congress, in accordance with section 9, on the findings, conclusions, and recommendations of the Commission on preventing the reoccurrence of such interference.</text>
			</paragraph></section><section id="id6aedc27456924b0d8961760648b1995b"><enum>3.</enum><header>Composition</header>
			<subsection id="idc61d352fbdbf4e20a0148eb3139aae3b"><enum>(a)</enum><header>Appointments</header>
 <paragraph id="id52315408EA304931BE6F964334C00E15"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of eight members, of which—</text> <subparagraph id="id14be83c87c7946d5981675a9153bcba5"><enum>(A)</enum><text>two shall be appointed by the majority leader of the Senate;</text>
 </subparagraph><subparagraph id="id2F26C507423B4BFDA708551434ECD20B"><enum>(B)</enum><text>two shall be appointed by the minority leader of the Senate;</text> </subparagraph><subparagraph id="id6fd880812d3e4632921c64ae4222b761"><enum>(C)</enum><text>two shall be appointed by the Speaker of the House of Representatives; and</text>
 </subparagraph><subparagraph id="id3E438BACC8B543B2ADB32080046DB40F"><enum>(D)</enum><text>two shall be appointed by the minority leader of the House of Representatives.</text> </subparagraph></paragraph><paragraph id="idbd8ac6ca3161492b9c26ed0016694703"><enum>(2)</enum><header>Deadline for appointment</header><text>Each initial member of the Commission shall be appointed not later than 30 days after the date of the enactment of this Act.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16a2cde934c64374a6137e88c614835b"><enum>(3)</enum><header>Period of appointment</header><text>Each member of the Commission shall be appointed for the life of the Commission.</text> </paragraph></subsection><subsection id="idbc7d13f203324bf5aa15475a1db8e17c"><enum>(b)</enum><header>Qualifications</header> <paragraph id="ide013e69eb2b24dd9b477afeeca645ebe"><enum>(1)</enum><header>Political party affiliation</header><text>Not more than 4 members of the Commission may be members of the same political party.</text>
 </paragraph><paragraph id="id73452f37fd52443fa6560941a99b1e90"><enum>(2)</enum><header>Nongovernmental appointees</header><text>None of the members of the Commission may be a Member of Congress (including a Delegate or Resident Commissioner to Congress), an officer or employee of the Federal Government, or an officer or employee of any State or local government.</text>
 </paragraph><paragraph id="idd28899e375964c908f0be4165ed6c2fc"><enum>(3)</enum><header>Other qualifications</header><text>It is the sense of Congress that individuals appointed to the Commission should be prominent United States citizens, with national recognition and significant depth of experience in professions such as governmental service, law enforcement, armed services, law, public administration, intelligence gathering, cybersecurity, election administration, and foreign affairs.</text>
				</paragraph></subsection><subsection id="idf012c7f849c749ad91c4afb1914ae888"><enum>(c)</enum><header>Initial meeting; selection of Chairperson</header>
 <paragraph id="id491bff0bd19f449c8a7d9a30d071f759"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Commission shall hold an initial meeting to develop and implement a schedule for completing the review and report required under section 2(9).</text>
 </paragraph><paragraph id="iddeb687a0dd4c4a5aa15a6bd5da8e5445"><enum>(2)</enum><header>Chairperson; vice-chairperson</header><text>At the initial meeting of the Commission, the Commission shall select a Chairperson and a Vice-Chairperson from among its members. The Chairperson and Vice-Chairperson may not be members of the same political party.</text>
				</paragraph></subsection><subsection id="id8a2d3f5c9df84eed8230c8d8f253bcee"><enum>(d)</enum><header>Quorum; vacancies</header>
 <paragraph id="id0FDF7FD4590F4008878A4E2AB74DBB20"><enum>(1)</enum><header>Quorum</header><text>Six members of the Commission shall constitute a quorum.</text> </paragraph><paragraph id="id30DCC9B469C749C1BA696AFFC9702FD4"><enum>(2)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall not affect the power and duties of the Commission and shall be filled in accordance with subsection (a) not later than 90 days after the occurrence of such vacancy.</text>
				</paragraph></subsection></section><section id="id955a70342be3470bbb0d59a19bb2f226"><enum>4.</enum><header>Powers of the Commission</header>
			<subsection id="id386b0cce18014f939697c7691f2ca43b"><enum>(a)</enum><header>In general</header>
 <paragraph id="idec64700551344c329e10309160c80152"><enum>(1)</enum><header>Meetings</header><text>After its initial meeting under section 3(c)(1), the Commission shall meet upon the call of the Chairperson or a majority of its members.</text>
 </paragraph><paragraph id="iddb002a17e1bc4fba95a64cce6b423266"><enum>(2)</enum><header>Hearings and evidence</header><text>The Commission may—</text> <subparagraph id="id2d75b887384743f29636fe4887bae45f"><enum>(A)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, receive such evidence, including classified testimony, evidence, and information, and administer such oaths as may be necessary to carry out its functions under section 2; and</text>
 </subparagraph><subparagraph id="idb569e9c0a2254d58aba33453c8b6d42c"><enum>(B)</enum><text>require, by subpoena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, and documents, including classified materials, as the Commission or such designated subcommittee or designated member may determine advisable to carry out such functions.</text>
					</subparagraph></paragraph><paragraph id="id5ed0812131164296891ff838a9812423"><enum>(3)</enum><header>Subpoenas</header>
					<subparagraph id="id69c25a55b2f047e1b4b438a950879821"><enum>(A)</enum><header>Issuance</header>
 <clause id="id5ac1747fdff8473292bb8b16e6487adc"><enum>(i)</enum><header>In general</header><text>A subpoena may be issued under this subsection only by the agreement of the Chairperson and the Vice-Chairperson or by the affirmative vote of 5 members of the Commission.</text>
 </clause><clause id="id81141cba74b14c2aa33fdc3158714c00"><enum>(ii)</enum><header>Signature</header><text>Subpoenas issued under this subsection—</text> <subclause id="idFE104D55D28943C7928471D84788B3F0"><enum>(I)</enum><text>may be issued under the signature of the Chairperson or any member designated by a majority of the Commission; and</text>
 </subclause><subclause id="id454494D0EDF54C4F9228D9F1FBC37B8B"><enum>(II)</enum><text>may be served by any person designated by the Chairperson or by a member designated by a majority of the Commission.</text>
							</subclause></clause></subparagraph><subparagraph id="id6f88a3c54f3f4ea1b313caec9e94eed8"><enum>(B)</enum><header>Enforcement</header>
 <clause id="ida057609e5fc64118ba3668b77ee58f54"><enum>(i)</enum><header>In general</header><text>In the case of contumacy or failure to obey a subpoena issued under this subsection, the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found, or where the subpoena is returnable, may issue an order requiring such person to appear at any designated place to testify or to produce documentary or other evidence. Any failure to obey the order of the court may be punished by the court as a contempt of that court.</text>
 </clause><clause id="id5f96b4171b4449a9aec40ccf6f59aea4"><enum>(ii)</enum><header>Additional enforcement</header><text>If any witness fails to comply with any subpoena issued under this subsection or to testify when summoned under authority of this subsection, the Commission may, by majority vote, certify a statement of fact constituting such failure to the appropriate United States attorney, who may bring the matter before the grand jury for its action, under the same statutory authority and procedures as if the United States attorney had received a certification under sections 102 through 104 of the Revised Statutes of the United States (2 U.S.C. 192 through 194).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id27a37e465ff140e1b05b004fae7fbd6e"><enum>(b)</enum><header>Information from Federal agencies</header>
 <paragraph id="ideca5c8f728dd4af28a11d39ee6d28608"><enum>(1)</enum><header>In general</header><text>All Federal departments and agencies shall, in accordance with applicable procedures for the appropriate handling of classified information, provide reasonable access to documents, statistical data, and other such information that the Commission determines necessary to carry out its functions under section 2.</text>
 </paragraph><paragraph id="id12437aa108c542f99945ffef704b6a7b"><enum>(2)</enum><header>Obtaining information</header><text>The Chairperson of the Commission shall submit a written request, as necessary, to the head of an agency described in paragraph (1) for access to documents, statistical data, and other information described in such paragraph that is under the control of such agency.</text>
 </paragraph><paragraph id="idaa45a82dc101460199fc3a551fc96fdd"><enum>(3)</enum><header>Receipt, handling, storage, and dissemination</header><text>Information described in paragraph (1) may only be received, handled, stored and disseminated by members of the Commission and its staff in accordance with all applicable statutes, regulations, and Executive orders.</text>
				</paragraph></subsection><subsection id="id9f0dae9d9df149e5955c0ecd89bed0f0"><enum>(c)</enum><header>Assistance from Federal agencies</header>
 <paragraph id="idcfb24916c0354c2b9aff37b31a12e1d4"><enum>(1)</enum><header>General services administration</header><text>The Administrator of General Services shall make office space available for the day-to-day activities of the Commission and for scheduled meetings of the Commission. Upon request, the Administrator shall provide, on a reimbursable basis, such administrative support as the Commission requests to fulfill its duties.</text>
 </paragraph><paragraph id="id994f8352b5f346fc85cf598351e2dfec"><enum>(2)</enum><header>Other departments and agencies</header><text>In addition to the assistance required under paragraph (1), other Federal departments and agencies may provide to the Commission such services, funds, facilities, staff, and other support services as the heads of such entities determine advisable in accordance with applicable law.</text>
 </paragraph></subsection><subsection id="id8e32a8408ca44137aaa9a9c4c1566851"><enum>(d)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other Federal departments and agencies.</text>
			</subsection><subsection id="id8cc8053202bc40a3921331b14224c652"><enum>(e)</enum><header>Authority To contract</header>
 <paragraph id="id86cfab74609649e0838633fa78bf02f0"><enum>(1)</enum><header>In general</header><text>Subject to subtitle I of title 40, United States Code, and division C of subtitle I of title 41, United States Code (formerly collectively known as the <quote>Federal Property and Administrative Services Act of 1949</quote>), the Commission is authorized to enter into contracts with Federal and State agencies, private firms, institutions, and individuals for the conduct of activities necessary to the discharge of its duties under section 2.</text>
 </paragraph><paragraph id="id8669e8d9f113405e856fc473c0b066fd"><enum>(2)</enum><header>Termination</header><text>Any contract, lease, or other legal agreement entered into by the Commission under this subsection may not extend beyond the date specified in section 10.</text>
				</paragraph></subsection></section><section id="idc9eaca9ed9ba4ee789fcca424a46dc81"><enum>5.</enum><header>Staff of the Commission</header>
 <subsection id="id035bd50be4e84c2ead051c3573140442"><enum>(a)</enum><header>Director</header><text>The Commission shall have a Director, who shall be—</text> <paragraph id="id8CE58BAAD3C548AEB79977AC9D6EED9B"><enum>(1)</enum><text>appointed by a majority vote of the Commission; and</text>
 </paragraph><paragraph id="id4FE8DC92D3494B50BB5DE617D12AE539"><enum>(2)</enum><text>paid at a rate not to exceed the rate of basic pay for level IV of the Executive Schedule.</text> </paragraph></subsection><subsection id="id182e7ed64bb4419a9998408b0daf7960"><enum>(b)</enum><header>Staff</header> <paragraph id="ide84f76618c04438ebf0760d49b08fc8e"><enum>(1)</enum><header>In general</header><text>With the approval of the Commission, the Director may appoint such personnel as the Director determines to be appropriate. Such personnel shall be paid at a rate not to exceed the rate of basic pay for level IV of the Executive Schedule, as set forth in section 5315 of title 5, United States Code.</text>
 </paragraph><paragraph id="id7447fdc74d22429ca50260524805ef14"><enum>(2)</enum><header>Additional staff</header><text>The Commission may appoint and fix the compensation of such other personnel as may be necessary to enable the Commission to carry out its duties, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates, except that no rate of pay fixed under this subsection may exceed the equivalent of that payable to a person occupying a position at level V of the Executive Schedule, as set forth in section 5316 of such title.</text>
 </paragraph></subsection><subsection id="ide47d435f0f9e427797a3514a08fcf37d"><enum>(c)</enum><header>Experts and consultants</header><text>With the approval of the Commission, the Director may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, but at rates not to exceed the rate of basic pay for level IV of the Executive Schedule.</text>
 </subsection><subsection id="id2f96a5df54a54938af033e49103f325c"><enum>(d)</enum><header>Detailees</header><text>Upon the request of the Commission, any Federal Government employee may be detailed to the Commission without reimbursement from the Commission, and such detailee shall retain the rights, civil service status, and privileges of his or her regular employment without interruption.</text>
			</subsection></section><section id="ida07a61a6c44142cb96e54e780aa6f19f"><enum>6.</enum><header>Nonapplicability of Federal Advisory Committee Act</header>
 <subsection id="idc1847ee3c0a1455ea358ffaeee2bbadb"><enum>(a)</enum><header>In general</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text> </subsection><subsection id="idd7db1badebe44a53943d4427085814b4"><enum>(b)</enum><header>Public meetings and release of public versions of reports</header><text>The Commission shall—</text>
 <paragraph id="id804A70C0DB5A4E03A7B5BEE6F5877DE7"><enum>(1)</enum><text>hold public hearings and meetings to the extent appropriate; and</text> </paragraph><paragraph id="idB82603C700E34C80892260ADDF7A82FF"><enum>(2)</enum><text>release public versions of the reports required under section 9.</text>
 </paragraph></subsection><subsection id="idb02d894f7fca475996f1e37865e0a44d"><enum>(c)</enum><header>Public hearings</header><text>Any public hearings of the Commission shall be conducted in a manner consistent with the protection of information provided to or developed for or by the Commission as required under any applicable statute, regulation, or Executive order.</text>
			</subsection></section><section id="id07e0b91b33184edfa87e77b23b2d8cf7"><enum>7.</enum><header>Compensation and travel expenses</header>
 <subsection id="idb5f50f20809848b9b14f1a31ede7322e"><enum>(a)</enum><header>Compensation</header><text>Members of the Commission—</text> <paragraph id="id791f8d6992734a9dac7794091d5db781"><enum>(1)</enum><text>shall not be considered to be Federal employees for any purpose by reason of service on the Commission; and</text>
 </paragraph><paragraph id="ide044c4e9a6ff42c58ef1b78f9acc006e"><enum>(2)</enum><text>shall serve without pay.</text> </paragraph></subsection><subsection id="id03083b4cdf784bd6bfc54b720930a289"><enum>(b)</enum><header>Travel expenses</header><text>While away from their homes or regular places of business in performance of services for the Commission, members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, in accordance with section 5703 of title 5, United States Code.</text>
 </subsection></section><section id="id4f6e61201cf843c38e8e3a85f6cdc05e"><enum>8.</enum><header>Security clearances for Commission members and staff</header><text display-inline="no-display-inline">The appropriate Federal agencies or departments shall cooperate with the Commission to expeditiously provide, to the extent possible, appropriate security clearances to Commission members and staff in accordance with existing procedures and requirements, except that no person shall be provided with access to classified information under this Act without the appropriate security clearances.</text>
		</section><section id="id8393a53068354157abcf7ccfdd620f0b"><enum>9.</enum><header>Report</header>
 <subsection id="id74940cdf7037450ba020604d2a0a2873"><enum>(a)</enum><header>In general</header><text>Not later than 18 months after the first meeting of the Commission, the Commission shall submit a report to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Oversight and Government Reform of the House of Representatives</committee-name>, the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, the <committee-name committee-id="SSAS00">Committee on Armed Services of the Senate</committee-name>, and the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>. The report shall include—</text>
 <paragraph id="ida382d92c139744189884cf00fda874d3"><enum>(1)</enum><text>a detailed statement of the recommendations, findings, and conclusions of the Commission under section 2; and</text>
 </paragraph><paragraph id="idb6249cbe9e8a455490c661a3f261427a"><enum>(2)</enum><text>summaries of the input and recommendations of the leaders and organizations with which the Commission consulted.</text>
 </paragraph></subsection><subsection id="id16e1de8308ba417aaf2025993312e84f"><enum>(b)</enum><header>Public availability</header><text>The report required under subsection (a) shall be submitted in an unclassified form, which shall be made available to the public, but may include a classified annex.</text>
 </subsection></section><section id="id2bfec39916ac438399ff6785e18e78ca"><enum>10.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission shall terminate on the date that is 60 days after the date on which the Commission submits its report to Congress pursuant to section 9.</text>
